The Ministry of Interior has cancelled the no-objection certificate (NOC) of ARY Communications Private Ltd, citing "adverse reports from agencies" as the reason behind the decision, it emerged on Friday.

The notification issued by the ministry, dated August 11, to the Pakistan Electronic Media Regulatory Authority (Pemra) reads: "The NOC issued in favour of M/S ARY Communications Private (Ltd). is cancelled with immediate effect and until further orders on the basis of adverse reports from agencies."

Reporting on the development, ARY News' English website called the cancellation by "the coalition government led by PML-N" an "economic murder of more than 4,000 media workers associated with the news channel". The report also called it a "a new move against the journalist fraternity", saying this was done without any notice.

"The channel’s administration condemned the suspension of its transmissions, saying the network is being victimised by the federal government," it added.

The decision from the Interior Ministry comes two days after the Sindh High Court directed Pemra and cable operators to immediately restore the transmission of ARY News, which had been suspended on orders of the government.

ARY News embroiled into a controversy after PTI leader Shahbaz Gill uttered "seditious remarks" against the Pakistan Army while talking to the TV channel earlier this week. Later on Tuesday, he was taken into custody at Banigala Chowk in the capital.

Gill was subsequently booked on charges of sedition and inciting the public against state institutions.

The ARY report published today also highlighted that the channel had issued a clarification that Gill’s statement was his personal opinion and had nothing to do with the channel’s policy.

Hours after Gill's arrest, Pemra had issued a show-cause notice to ARY News for airing his controversial remarks, which the authority described as "highly hateful and seditious" and tantamount to inciting the "armed forces towards revolt".

Politicians, journalists condemn govt action

Meanwhile, politicians and journalists denounced the government's move to revoke the license of the channel.

PPP Secretary General Farhatullah Babar expressed concern, saying "using state power arbitrarily will backfire".

"Effects of law of diminishing returns already becoming apparent," he tweeted.

I’m certain ARY was in favor of GEO getting banned few years ago on similar grounds.

This is politics it will keep happening, Pakistan keeps doing this again and again in different forms.

Geo is a mafia channel and subsequent events have shown this to be a fact. Whether ARY were in favour or not is irrelevent, there is a due process of Law and the fascists aren't following it.

PTI passed laws. PDM cant do much here. These laws were bulldozed by pti last year and it came back to bite them.

All though what has happened is terrible, but no media house or journalist of other channels should support ARY. ARY journalist and owner were the same people that advocated kidnapping and banning other channels and journalist. Many of their journalist celebrated the kidnappings and would say that journalists were only doing dramaybazi.

Today, they got the taste of their own medicine. The press society should not led them support, because this same group did not lend support to other journalists.

ARY alienated any friends it had just for their dumb acts.

Its like how when Asad Qaiser couldn't make a decision and he was reminded by his mates that if he goes to jail, his party isn't going to help him and it was those people that would have to help him out.

But during the last recent years, when PTI came into power and bought in ordinances or passed media control laws, ARY has been going after GEO. GEO was taken of air, many journalists were arrested for no reason and ARY journalists had the audacity to say that they were faking it.

Thing is, if tomr GEO gets banned, it has the support of other news groups like DAWN, The News and other media houses that will stand with them and support them. ARY on the other hand has alienated itself due to the mess they created.

Press unity is an important part in our politics. You are absolutely right, this is a fascist move by the govt.

Whenever such a move is made by a govt against the press, it is there fellow journalists and media houses that have to stand up for them and protect them. Press unity is what protects our journalists or else journalists and anchors are very weak people and could easily be made victims.

This is why when same crap was happening with GEO or the likes of Matiullah, Toor or Hamid Mir, media houses like Ary and its journalist should had spoken up and stood by them.

But the thing is, in your mind what PTI did with GEO and the above mentioned journalist was correct while what PDM is doing is wrong. You cant have it that way, either both were right or both were wrong.

PMLN has a very bad history of targeting journalists. I know an extended family member who was locked up and killed on a bogus treason case during Nawaz Shareefs govt when he had the army's backing.

The journalist fraternity and legal experts on Friday strongly condemned the cancellation of ARY News NOC by the Ministry of Interior without serving any notice.

The journalist fraternity and legal experts termed the government’s move as the ‘economic murder’ of the journalists’ families without giving the reasons behind the cancellation of the NOC.

Karachi Press Club (KPC) President Fazil Jamili said that such steps were not even taken in the worst scenario of martial laws in the country. He strongly condemned the savage step against ARY News by the federal government.

Fazil Jamili said that the Sindh High Court (SHC) issued clear directives and the government was going to create financial troubles for the thousands of media workers and their families amid the skyrocketing inflation.

He announced that journalists will record their strong protests across the country.

KPC Secretary Rizwan Bhatti said that the journalist fraternity will never accept the political and revengeful action against any TV channel.

He said that KPC office-bearers were standing side-by-side with the media workers of ARY News in the tough time and the press club will struggle to stop the economic murder of the journalists.

Pakistan Federal Union of Journalists (PFUJ) President Afzal Butt said, “This day will be remembered as the Black Day in the history of Pakistani media. Economic murder of thousands of media workers is being committed.”

Afzal Butt said that such a situation was not even witnessed in the dictators’ era. He expressed surprise over the move to end the security clearance of a channel after 30 years. The PFUJ president asked the rulers to refrain from making such decisions.

Pakistan Federal Union of Journalists (PFUJ) Secretary-General Rana Azeem said that the move has exposed the enmity of the current government with the journalist and thousands of media workers were unemployed.

“The government is planning the economic murder of the journalists,” said Azeem, adding that the interior minister Rana Sanaullah should immediately review the decision. He said that an emergency session of the PFUJ has been summoned. The PFUJ secretary general announced to approach the courts and the parliament against the decisions.

Senior lawyer Barrister Aitzaz Ahsan said that it is a legal requirement to issue a show-cause notice and listen to the reply in such decisions. Ahsan said that NOC cancellation could be challenged.

The senior lawyer said that the court will not take a long time to nullify the government’s decision of the NOC cancellation of ARY News. He said that the decision came under the contempt of the court as the SHC issued orders to not close the transmission of the channel.

Awan said that the government was making attempts to suppress independent voices. He said that the move was apparently against the verdict of the Sindh High Court (SHC) and the government committed contempt of the court.

He condemned the cancellation of ARY News’ NOC and demanded the government to give clarification regarding its decision.

Legal expert Abuzar Salman Niazi said, “According to PEMRA law, a notice will be issued to seek a reply. The court will not take time to nullify the decision and such steps cannot be taken in a democracy. The NOC cancellation is an unconstitutional and illegal move.”

Pemra moves against ARY News after licence revoked

ISLAMABAD: In an unprecedented move, the Pakistan Elec*tronic Media Regulatory Authority (Pemra) revoked the operating licence of ARY News late on Friday night after the security clearance of the channel was withdrawn by the Ministry of Interior, paving the way for the permanent closure of the TV channel.

Earlier, in a notification, the interior ministry said: “The NOC issued in favour of M/S ARY Communications Pvt Limited (ARY News) is cancelled with immediate effect and until further orders on the basis of adverse reports from agencies.”

The decision by Pemra was taken during its 172nd meeting which was chaired by re-appointed chief Saleem Baig.

Sources in the regulatory authority said Mr Baig chaired the meeting in the presence of three other members, while four members, including the Pakistan Telecommunication Authority (PTA) chairman, Federal Board of Revenue (FBR) chairman and the interior secretary joined the meeting via video link.

Channel vows to challenge decision in court; head of electronic media body slams ‘excessive measure’

After detailed information and background regarding the renewal of the operating licence, the working paper of the meeting said, “...Ministry of Interior vide letter dated 10.11.2021 had initially granted NOC/ security cle*a*rance for renewal of satellite TV licences of M/s ARY Comm*unication Ltd. However, the Ministry has withdrawn the NOC in respect of M/s ARY Comm*unication Ltd. (ARY News) vide letter dated 11.8.2022.”

“Foregoing in view and based on the fact that the mandatory requirement of security clearance has not been fulfilled since NOC has been withdrawn by Ministry of Interior, the request of M/s ARY Communication Ltd. for renewal of licence for another term of 15 years may be regretted by the authority,” the working paper added.

Although both the Pemra chairman and DG Tahir Shaikh did not respond to queries regarding the outcome of the meeting, sources confirmed that the auth*ority had approved the notification forwarded by the interior ministry and the electronic med*ia regulator could now “legally” shut down the channel’s transmission across the country. However, ARY’s transmission continued in many cities on Friday night, including Karachi, as the authority did not issue a formal notice in this regard.

‘Excessive measure’

The decision to shut down the news channel was met with disapproval across the board.

The ARY management condemned the ban, saying the network was being victimised by the federal government. This move is akin to the “economic murder of more than 4,000 media workers associated with the news channel”, it said, adding that the interior ministry’s notification will be taken to the courts as it was done without any due notice.

Association of Electronic Media Editors and News Directors (AEMEND) President Azhar Abbas condemned it as an “excessive measure” and said such moves have never worked. He urged the government to immediately withdraw the decision.

PPP leader and ex-senator Farhatullah Babar tweeted that the use of state power “arbitrarily will backfire”. “There may be 101 good reasons but question as to who is competent to cancel, how & whether due process followed must be answered,” he said, adding, “Effects of [the] law of diminishing returns already becoming apparent.”

In a tweet, PTI leader Asad Umar said: “This is ‘purana’ Pakistan desperately trying to hang on. The tide of history cannot be stopped by coercive illegal measures.”

“Under the fascist regime, the freedom of the press is being curtailed. Journalists cannot speak freely. They face FIRs, arrests and bans are being imposed on TV channels,” PTI leader Farrukh Habib said. He added that people who were trying to suppress the freedom to speak were harming Pakistan.

PTI leader Ali Mohammad Khan said the decision by the ministry to revoke the NOC of the news channel was a “political” and “totally wrong” decision.

The interior ministry “takes decisions in the national interest to protect the state from all kinds of threats. It is not a party office to be used for political purposes”, he added.

Separately, the Lahore High Court granted protective bail to journalist Khawar Ghumman in a case registered against him by the Islamabad police.

Mr Ghumman, the Islamabad bureau chief of ARY News, appeared before the court along with his counsel Abuzar Salman Khan Niazi.

His counsel argued before the court that police registered a “fake case against his client and wanted to arrest him”.

Justice Saleem Safdar Shahid heard the petition and granted Mr Ghumman interim protective bail for seven days to enable him to approach the court concerned for the pre-arrest bail.

WASHINGTON: The United States (US) has expressed concern over the cancellation of no-objection certificate (NOC) of ARY Communications Private Ltd by Ministry of Interior.

In a statement, the US State Department expressed concern over the cancellation of ARY News NOC, stating that they were aware of the restrictions imposed on media outlets and civil society in Pakistan.

“A vibrant press and an informed citizen are key to any free nation,” US State Department spokesperson noted, adding that restrictions on media outlets harm the freedom of expression.

The US State Department also expressed concern over absence of accountability in attacks against journalists

A day earlier, in a new move against the journalist fraternity, the Ministry of Interior cancelled the NOC of ARY News without serving any notice.

The coalition government led by Pakistan Muslim League Nawaz (PML-N) has taken one more step toward the economic murder of the journalist fraternity by cancelling the NOC of ARY News without issuing any show-cause notice.

The cancellation of NOC will be meant by the economic murder of more than 4,000 media workers associated with the news channel.
 
KARACHI: The Sindh High Court (SHC) on Saturday suspended the Interior Ministry’s notification of cancellation of ARY News no-objection certificate (NOC).

According to details, the Sindh High Court suspended the notification of cancellation of ARY News NOC and issued notices to respondents for August 17.

ARY News Counsel Barrister Ayyan maintained that the channel always follows the rules and regulations. “The channel’s broadcast should be restored after the suspension of the notification,” he added.

Barrister Ayyan warned of filing a contempt petition if broadcasting is not restored.

Talking to ARY News exclusively, Pakistan Federal Union of Journalist (PFUJ) President Afzal Butt extended his gratitude to the journalists for supporting the channel.

“The government’s move was not justified after the institution distanced itself from the PTI leader’s remarks,” he said, praising the Sindh High Court’s decision.

He noted that security clearance of the channel is carried out every year. The PFUJ President reiterated its support, saying that the journalists union will always stand by ARY News.

It is pertinent to mention here in a new move against the journalist fraternity, the Ministry of Interior cancelled the NOC of ARY News without serving any notice.
