Former prime minister Nawaz Sharif said on Friday that a former dictator was enjoying virtual immunity while he stood barred from visiting his ailing wife in London.

Sharif made the remarks while speaking to journalists at an accountability court. Talking about the recent apex court move allowing Musharraf to conditionally file nomination papers in connection with the forthcoming general elections, Sharif listed all cases the former president stood accused in.

“Placing judges under house arrest, May 12, violating the Constitution, Akbar Bugti’s. He is named accused in all, yet he is promised on-arrival leniency. I, on the other hand, cannot even obtain five-day permission to visit my wife,” Sharif said.

On one hand, he has been booked for treason. On the other, he has been granted conditional permission to contest elections. “Under what law has he been allowed to contest elections? I want to see such laws too,” a livid Sharif told reporters.

The PML-N supremo said it was beyond one’s comprehension how Musharraf got to enjoy preferential treatment. “Illegal. Where does Article 6 stand now? How can one individual be above the law and Constitution?”

In an unprecedented development, the top court on Thursday summoned Musharraf on June 13 in response to a petition against his lifetime disqualification to contest the elections in view of the 2013 Peshawar High Court (PHC) judgement. A three-judge SC bench heard the former dictator’s appeal against a PHC verdict disqualifying him for life for promulgating Emergency in November, 2007.

The court also assured Musharraf’s counsel that the former president would not be arrested. It also allowed returning officers to receive his nomination paperwork for the elections subject to case outcome.

Lovely stuff to see the courts backing Musharraf over Nawaz Sharif. Things in Pakistan are indeed heading in the right direction.

Former president Pervez Musharraf is set to file nomination papers to contest elections from NA-247 (Karachi South-II), Express News reported.

The development comes after the Supreme Court allowed the former military ruler to conditionally file nomination papers in connection with the forthcoming general elections. The documents will reportedly be sent to Dubai for signatures, according to Express News.

A five-way contest is expected between Mustafa Kamal of the Pak Sarzameen Party (PSP), Arif Alvi of Pakistan Tehreek-e-Insaf (PTI), rights activist Jibran Nasir and Mutahidda Qaumi Movement-Pakistan (MQM-P) chief Farooq Sattar if his nomination papers are accepted.

On Thursday, a three-judge SC bench headed by Chief Justice of Pakistan (CJP) Saqib Nisar heard the former dictator’s appeal against a Peshawar High Court (PHC) verdict disqualifying him for life for promulgating Emergency in November, 2007.

The apex court also assured Musharraf’s counsel that the former president would not be arrested. It also allowed ROs to receive his nomination papers for the upcoming elections. Acceptance of his nomination papers, however, will be subject to case outcome.

SC orders NADRA to unblock Musharraf's CNIC, passport so that he can return to Pakistan

The Supreme Court (SC) on Monday ordered that national identity card (CNIC) and passport of former military dictator Pervez Musharraf be unblocked so that he is able to return to the country.

The order was issued after National Database and Registration Authority (NADRA) Chairman Usman Mobin was spotted sitting in on a full-bench hearing for a separate case by Chief Justice of Pakistan (CJP) Saqib Nisar.

When Justice Nisar asked Mobin why he was in court, the NADRA chairman — who was called to the rostrum by the CJP — said that although the SC had last week allowed Musharraf to submit his nomination papers if he returned to Pakistan for a court hearing on June 13, the former dictator would not be able to since his CNIC and passport had been blocked.

The Interior Ministry had earlier issued directives to NADRA and the Directorate General of Immigration and Passports to suspend Musharraf's CNIC and passport in compliance with the order of a special court conducting a treason trial against the former president.

"Why would you block the card? To give him a reason to not return?" the CJP asked Mobin. "Musharraf should return and face the cases against him," he asserted.

On Mobin's verbal request seeking formal directives about what must be done about Musharraf's travel and ID documents, the CJP ordered that his CNIC and passport be unblocked.

The top judge also reiterated his earlier order that the former military ruler should not be arrested on his way to court from the airport.

The CJP also issued an order stating that a tribunal be formed within two days to conduct the pending treason trial against Musharraf.
Case history

The Peshawar High Court had in April 2013 disqualified Musharraf for life in view of a July 31, 2009 judgement in which the Nov 3, 2007 emergency imposed by Musharraf was declared illegal.

Following his disqualification, Musharraf's nomination papers for Karachi's NA-250 seat in the polls that year were rejected by a returning officer on the grounds that he had held in abeyance and suspended the Constitution on Nov 3, 2007, detained and removed a number of superior court judges, and publicly insulted then chief justice Iftikhar Muhammad Chaudhry.

Musharraf's appeal against the PHC judgement in the Supreme Court questioned whether — by disqualifying the former ruler from contesting elections for the National Assembly, provincial assemblies or Senate or holding a public office — the court had not failed at the touchstone of legal and constitutional parameters settled by the Constitution and human rights declarations.

In a separate case, Musharraf was charged with high treason in December 2013 by a special court and indicted on March 31, 2014. The trial remained suspended after the court in November 2014 ordered a re-investigation into the case to identify any abettors in the imposition of emergency in November 2007.

The former military dictator left for Dubai in 2016 to 'seek medical treatment' and has not returned since.

This is also precisely why I support Imran Khan.
Because he belongs in strong, democratic institutions.
If there is any hope at all then it will be in this coming election.

If Imran loses then I see no hope for the country.
 
This is why PMLN will win again. The double standards in pakistan are embarrassing. This democracy killer needs to be at least tried for his cases but it’s pakistan, he gets an election ticket. The reason india is far Ahead is because they dont have their security guards meddling in their politics.
 
Great to see Pakistani courts side with Musharraf and kick Nawaz out. Gives me absolute pleasure to see the Nooras defeated inspite of all their efforts behind the scenes to bypass the system.

Former military ruler Pervez Musharraf on Monday submitted nomination papers to contest the upcoming general elections from a National Assembly constituency in Khyber Pakhtunkhwa's Chitral district.

The papers were submitted by the former president's lawyer and party leaders from NA-1 Chitral to the returning officer in the area, the first constituency of the lower house of parliament.

APML District President Chitral Sultan Wazir told DawnNewsTV that Musharraf would soon return to the country and hold a rally in Chitral.

Musharraf had submitted nomination papers from Chitral in the 2013 poll as well. His party, the All Pakistan Muslim League (APML), had managed to win a seat each in the National Assembly and KP Assembly from Chitral's NA-32 and PK-90 constituencies, despite announcing a boycott of the 2013 general elections.

The leaders of the APML Chitral chapter expressed hope that their leader would win the imminent contest by a large margin.

Earlier today, the chief justice ordered the unblocking of Musharraf's identity card and passport.

Retired Gen Musharraf, who is also facing a high treason case, was allowed last week by the Supreme Court to file nomination papers if he personally appeared before the court in Lahore for a hearing on June 13.

The SC is currently hearing Musharraf's appeal against a 2013 Peshawar High Court (PHC) verdict disqualifying him for promulgating a state of emergency in November 2007.

Former president General (retd) Pervez Musharraf’s hope of contesting the upcoming polls was quashed on Thursday after the Supreme Court (SC) withdrew the conditional permission given earlier to the All Pakistan Muslim League (APML) chairperson.

Musharraf set to file nomination papers for Karachi NA seat

The apex court had earlier granted conditional permission to Musharraf, allowing him to file his nomination papers and contest the polls scheduled for July 25, provided the former military ruler presented himself in court.

A four-member bench of the SC heard the case pertaining to Musharraf’s return. The former dictator requested more time to return to the country, however, the court refused to entertain his requests after granting a day-long extension in the June 13 deadline.

Musharraf’s counsel, Qamar Afzal, appeared on his behalf. “I have spoken to Musharraf, he asks for more time. He plans to come to Pakistan but due to Eid holidays and illness, he can’t travel immediately,” Afzal added.

“Alright, we’ll adjourn the court hearing till indefinite time period, will hold it on your wish,” the chief justice responded.

Secretary-General APML Dr Mohammad Amjad Chaudhry confirmed that Musharraf will not be appearing before the Supreme Court (SC) on Thursday. The apex court had set a deadline of 2pm for the former military ruler to appear before the three-member bench.

Chaudhry also added that Musharraf’s legal team will be applying for an extension. “We will request them to set a date after Eidul Fitr. If they agree, Musharraf will return,” Chaudhry confirmed to The Express Tribune.

Musharraf can conditionally file nomination papers, says SC

However, late Thursday morning, the party’s tweets stated that Musharraf was due to land in the wee hours of the night as “preparations [for his return] were in the last stages.”


The APML and Dr Amjad also thanked the chief justice of Pakistan for granting the former president the opportunity to return to the country.



On June 7, the top court summoned Musharraf in response to a petition filed against his lifetime disqualification to contest the elections in view of Peshawar High Court’s (PHC) 2013 judgement.

The court also assured Musharraf’s counsel the former president would not be arrested. It also allowed the returning officers to receive his nomination papers for the upcoming election. However, acceptance of his nomination papers will be subject to the outcome of the case.

“The appellate court’s decision was challenged in the PHC, which disqualified him for life,” he said.

The petition said the PHC decision was an excessive exercise of judicial authority as it failed to provide and protect the rights guaranteed under articles 4, 9, 10, 17, 25 of the Constitution.

Nomination Papers of Farooq Sattar,Pervez Musharraf rejected.

The nomination papers of Muttahida Qaumi Movement-Pakistan's (MQM-P) Dr Farooq Sattar as well as All Pakistan Muslim League (APML) chief Pervez Musharraf were rejected on Tuesday by returning officers (ROs).

Meanwhile, nomination papers of PTI chief Imran Khan, PPP supremo Bilawal Bhutto-Zardari, and PML-N's Hamza Shahbaz and Maryam Nawaz following scrutiny have been accepted, DawnNewsTV reported.

Dr Sattar had filed nomination papers to contest elections on NA-245 constituency in Karachi while Musharraf's nomination papers had been filed from Chitral for NA-1.

The returning officer for NA-245, Ahsan Khan, rejected Sattar's nomination papers on the grounds that he is a declared absconder in two cases.

The official, in his decision, mentioned that Dr Sattar concealed the two cases and his status as an absconder.

Detailed orders are awaited as the Election Commission of Pakistan (ECP) concludes the scrutiny of nomination papers today.

The scrutiny of nomination papers to exclude ineligible candidates from the race started last Tuesday, a day after ROs completed the process of receiving nomination papers from prospective candidates.

According to the revised election schedule issued by the ECP on June 8, the last date for filing appeals against acceptance or rejection of nomination papers by the ROs is June 22. The last date for decision on the appeals by tribunals is June 27.

Revised lists of validly nominated candidates will be published on June 28 whereas the last date for withdrawal of candidature is June 29.

The final list of contesting candidates is expected to be published on June 30.

Musharraf explains why he put off his return

ISLAMABAD: All Pakistan Muslim League (APML) chairman retired Gen Pervez Musharraf has said that he was all set to return to the country but the Supreme Court order forced him to change his mind.

Speaking to journalists through a video link, the former president said the apex court order “barring the authorities from arresting me till my appearance before the august court has forced me to rethink my plans about return”.

“There will be no benefit of my return to the country if I am arrested just after my appearance before the court,” he said.

“The entire world knows that I am not a coward, but now I will wait for an appropriate time to return,” Mr Musharraf said.

In reply to a question about the National Accountability Bureau’s (NAB) probe into his assets, the former army chief said he was living in a three-bedroom apartment and the bureau must investigate his assets and he would fully cooperate with it.

Before the video-link interaction with journalists, Mr Musharraf also addressed the APML’s National Assembly candidates and answered their questions.

Meanwhile, APML president Dr Muhammad Amjad said that Mr Musharraf was willing to return to the country, but the Supreme Court had given him insufficient time under which arrangements for his travel, accommodation and security could not be made.

He alleged that the caretaker government was not allowing Mr Musharraf’s return as it had blocked his CNIC and passport when the Supreme Court asked the APML chief to come back to the country.

Former president Pervez Musharraf has resigned as the chairman of the All Pakistan Muslim League (APML), according to the new party chairman, Dr Mohammad Amjad.

Dr Amjad told DawnNewsTV that Musharraf had tendered his resignation to the party on June 18 due to the Peshawar High Court's 2013 verdict which had disqualified him from politics for life.

That verdict has been challenged on Musharraf's behalf in the Supreme Court, which had issued a directive earlier this month allowing him to file his nomination papers only if he returned and was present in the court hearing on June 13 in Lahore, cautioning that the fate of the papers would be subject to the final decision in the present case.

Although Musharraf's representatives had submitted his nomination papers for Chitral's NA-1 seat, the former military ruler failed to return to Pakistan after which the SC withdrew its directive allowing nomination papers to be filed.

Musharraf explained that he had put off his return after the SC order forced him to change his mind.

Speaking to journalists via video link, the former president said the apex court order "barring the authorities from arresting me till my appearance before the august court has forced me to rethink my plans about return".

A day after resigning as the chairman of the All Pakistan Muslim League (APML), Pervez Musharraf has clarified that he has not quit politics.

Musharraf, in a video message, said he had been planning to contest the upcoming general elections but wanted certain assurances, including that of not being arrested, the removal of lifetime disqualification and his name from the Exit Control List.

"If Khawaja Asif's lifetime disqualification can be overturned, why not mine." he said. "If Nawaz Sharif has the freedom to move in and outside the country, why can I not have it."

The former president said that since those assurances were not given, he knew he could not do anything for his party or for himself and therefore, after consultation with other APML leaders, he said he decided not to return to the country.

The former army chief said that the decision was taken because of legal issues and that he would continue to support the party he founded. He also said that his future plan of action would be announced as things unfold and assured his followers that things will take a turn for the better.

Moreover, he requested his party to support its new chairman, Dr Amjad Shoaib and Mehreen Malik Adam, who has been elevated to the position of secretary general.

Musharraf, who is facing a treason case among others, has not returned to the country since he left for Dubai in 2016 for medical treatment.

"I am a commando and I love my homeland," he had said before leaving. "I will come back in a few weeks or months."

The Supreme Court recently allowed Musharraf to conditionally file his nomination papers and assured him that he would not be arrested until his appearance before the court, but he chose not to end his self-imposed exile.
