The Supreme Court on Friday will announce its verdict on a petition seeking the disqualification of Pakistan Tehreek-i-Insaf chief Imran Khan and secretary-general Jahangir Tareen, DawnNews reported on Thursday evening.

The verdict, which had been reserved by the bench on November 14, is expected to be read out at 2pm tomorrow afternoon by Chief Justice Saqib Nisar. Justices Nisar, Faisal Arab and Umar Ata Bandial had comprised the three-member bench which heard the case.

The petitions filed by Pakistan Muslim League-Nawaz leader Hanif Abbasi on Nov 2 last year sought the two PTI leaders’ disqualification over non-disclosure of assets and existence of their offshore companies, as well as receiving foreign funds for their party.

Senior counsel Naeem Bukhari, who represented Khan, had argued during the proceedings that the case should not be treated on a par with the Panama Papers case in which former prime minister Nawaz Sharif was disqualified because, according to him, there was a world of difference between the two.

In this case, he had said, no money was sent out of the country, adding that it could be the case of a young man who could not manage his accounts properly.

Bukhari had also argued that his client did not mention his Draycott flats of London in his statement of assets and later benefited from the tax amnesty scheme of 2000, asking if utilising the amnesty scheme be considered dishonesty. But he admitted that the line between honesty and dishonesty had to be drawn by the apex court.

During closing arguments Bukhari had told the court that his client had submitted all documents they could obtain before the court.

After the court reserved its verdict in the case against Khan, the bench had proceeded to question the lawyer representing Tareen regarding the latter's properties in Britain.

Specifically, the bench had inquired after Hyde House — a piece of property in London which covers 12 acres of land — which Tareen claims to have bought for his children through a trust.

The bench had subsequently reserved its verdict on Tareen's disqualification after hearing arguments on his line of defence from both sides.

However, before closing the proceedings, the chief justice had told all parties not to expect an early decision on the case.

If IK is disqualified then every Noora rep that had every been elected will go to prison. And the same JT, if the top tax payer gets disqualified then what happens to all the parliamentary Nooras and PPP reps. Any ways very interesting day ahead.

Disqualification of IK is out of question unless decision is made purely to balance things based on some technicality. Imran's case basically why didn't he declare his offshore company in previous elections. He had declared his flat and that was the only asset the company held so it's a non issue. He was asked to prove how he made money for flat and he provided most of the transactions even from 80s confirming money earned. If every parliamentarian is asked to prove their wealth on same level, probably 95% will be disqualified.

Tareen's case is more interesting, he should be disqualified if he failed to declare any of his properties. It will be a setback for PTI but these things happen in politics. I think Tareen gets heavily criticized because he is in PTI otherwise i always had respect for being highest tax paying parliamentarian. He pays tax more than whole top PMLN leadership combined (MUCH more than Sharif family).

ISLAMABAD: The Supreme Court will hand down on Friday (today) the anxiously-awaited judgement that will determine the political fate of Pakistan Tehreek-i-Insaf chief Imran Khan and secretary general Jahangir Khan Tareen amid the turbulent political environment in the country.

Once again, Courtroom No 1 will be the focus of attention when a three-judge bench consisting of Chief Justice Mian Saqib Nisar, Justice Umar Ata Bandial and Justice Faisal Arab will announce its verdict on two petitions moved on Nov 2 last year by Pakistan Muslim League-Nawaz leader Hanif Abbasi seeking disqualification of Mr Khan and Mr Tareen for not disclosing their assets, owning offshore companies and running a foreign-aided party.

The verdict will be announced at 2pm after Friday prayers.

Last time, Courtroom No 1 came into limelight when a five-judge SC bench comprising Justices Asif Saeed Khosa, Gulzar Ahmed, Ejaz Afzal Khan, Sheikh Azmat Saeed and Ijaz-ul-Ahsan disqualified Nawaz Sharif as prime minister in the Panama Papers case and directed the National Accountability Bureau (NAB) to file three corruption references against Mr Sharif and members of his family.

Three-judge bench will hand down verdict on PML-N leader’s petitions seeking disqualification of the two PTI leaders

The apex court had on Nov 14 closed the proceedings and reserved its ruling on Mr Abbasi’s petitions.

The Islamabad police have been directed to ensure tight security in and around the Supreme Court to avoid any untoward incident at the time of the announcement of the judgement.

“Will the captain [Imran Khan] continue to stand on the pitch or be shown the pavilion is a million dollar question which can only be answered when the judgement is announced,” commented a senior counsel who observed the entire court proceedings with interest.

When asked about his expectations, senior counsel Mohammad Akram Sheikh, who had argued the case on behalf of Hanif Abbasi, said: “We hope that the Supreme Court will decide in consistence with the law declared by it in a similar matter by a larger bench (Panama Papers case) as the question in the two [cases] are absolutely identical as much as though not corruption or the criminal charge but the concealment of assets and making of false declaration.”

But PTI spokesperson Fawad Chaudhry insisted that it would be absurd drawing comparison between the case of Nawaz Sharif and those of Imran Khan and Jahangir Tareen, adding that the PTI side had during the course of hearing explained the money trail of even a single penny.

Besides, he said, there was no allegation of money laundering or corruption against Mr Khan.

Likewise, he said, the case against Mr Tareen had started with money laundering but ended with allegations of concealment of assets. In this case too, Mr Tareen did not hide anything from the court and come out with clean hands, he added.

Asked if Mr Khan and Mr Tareen would come to the court, along with other party leaders, to witness the historic moment, the spokesman said he would alone be in the courtroom.

Chaudhry Faisal Hussain, who also assisted the PTI’s panel of counsel in the case, said he was confident that the petitions would be dismissed because no allegations of dishonesty could be attributed to Mr Khan or Mr Tareen since both had provided the money trail and accounted for even a single penny. On the other hand, he claimed, Nawaz Sharif and his family had hidden everything from the court and never provided the money trail.

In his concluding arguments, Advocate Naeem Bokhari, the counsel for Imran Khan, had argued that his case should not be treated like that of Panama Papers because there was no question of money going out of the country, though it could be said that there was a ‘young man’ who could not manage his accounts properly.

Akram Sheikh had contended that Mr Khan had shifted his stance before the court 18 times, adding that Justice Khosa had in the Panama Papers case judgement mentioned the word shifting stances for Nawaz Sharif twice and eventually disqualified him.

It was expected though. Well, who cares about him.

Although party can handle it but still he was the most important person for PTI after IK. Tareen was handling all the pre election strategies and negotiating with electables he was doing lot of work on ground from last 2 years it was pretty clear.

This time, IK didn't take wicket, he won the match comprehensively.
 
The Supreme Court on Friday rejected Hanif Abbasi's petition for Imran Khan's disqualification. The court, however, disqualified Jahangir Tareen under Article 62 of the Constitution.

Chief Justice Mian Saqib Nisar said that Khan was not liable to declare Niazi Services Ltd in his 2013 nomination papers as he was not a shareholder, adding that he submitted all the information asked of him, DawnNews reported.

The CJ said the delay in the verdict, which was supposed to be announced at 2am, was due to a mistake on one page. "We had to go through the entire 250-page document," he explained, apologizing for the delay.

He asked that the verdict be heard with patience.

The Supreme Court sent the foreign funding case to the Election Commission of Pakistan to consider, DawnNews reported. It is the responsibility of the ECP to look at the foreign funding case in detail Justice Nisar said.

The SC on Friday announced the highly anticipated judgement on a petition filed by PML-N leader Hanif Abbasi, who seeks the disqualification of PTI chief Imran Khan and secretary general Jahangir Khan Tareen on charges they did not fully disclose their assets in nomination papers.

The verdict was announced in Courtroom No. 1 by a three-judge bench comprising Chief Justice Nisar, Justice Umar Ata Bandial and Justice Faisal Arab. Petitioner Abbasi as well as other members of PML-N — including Talal Chaudhry and Maryam Aurungzeb — are present in the court.

Neither Imran Khan — currently in Karachi — nor Tareen are in attendance, DawnNews reported.

PTI members and supporters have gathered outside the court to show solidarity with their party leaders.

Strict security arrangements have been for today's verdict. At least 900 security officers have been stationed outside the court, while 300 more officers are deployed inside.

Courtroom No. 1 was last in the limelight when a five-judge SC bench comprising Justices Asif Saeed Khosa, Gulzar Ahmed, Ejaz Afzal Khan, Sheikh Azmat Saeed and Ijaz-ul-Ahsan disqualified Nawaz Sharif as prime minister in the Panama Papers case on July 28.

The case
The petition, filed by Abbasi in November 2016, accuses the two PTI leaders of not declaring their assets to the Election Commission of Pakistan (ECP) and seeks their disqualification based on alleged violations of the lncome Tax Ordinance 1979 and Representation of Peoples Act 1974.

On May 3, amidst a heightened political backdrop, a three-member bench of the apex court had begun hearing the petition.

During the length of the case, the lawyers from both sides had presented their arguments for over 100 hours and referred to 73 different cases as precedent, DawnNews reported. After more than 50 court hearings, the verdict was reserved on November 14.

Abbasi's petition
Abbasi's petition had sought the PTI leaders’ disqualification under charges of false declaration before the ECP, non-disclosure of assets in offshore companies, and for being a foreign-funded party.

The petiton had aruged that by failing to disclose the existence of "Niazi Services Limited" — an off-shore company allegedly owned by the PTI chairman — to the ECP, Khan stands in violation of the Income Tax Ordinance of 1979.

Additionally, Abbasi had claimed that the 'off-shore company' has consistently been submitting its financial documents to the relevant authorities in the Channel Islands, where the company is said to be based.

Abbasi had maintained that Imran Khan failed to formally declare his 'off-shore company' to authorities in Pakistan and opines that Khan's intention to establish the off-shore company, which was dissolved in October 2015, was rooted in tax evasion.

Furthermore, Abbasi had argued that Imran Khan failed to disclose to the ECP his Rs2.97 million purchase of a luxury apartment in the capital city of Islamabad. That, he had argued, is a violation of the Peoples Act of 1974 and can result in the dismissal of PTI Chairman Imran Khan.

Questions posed to Imran's lawyer
Throughout the proceedings of the case, Khan's lawyer Advocate Naeem Bukhari was questioned by the apex bench on various matters, specifically the money trail for PTI chief's flat in London and his Banigala property.

In one of the hearings, Advocate Bukhari was questioned over Khan's failure to declare the London flat as an asset. He had told the court that the flat was not declared as it was located outside of Pakistan.

Over several hearings, the court had sought clarity from Khan's lawyer with regards to the PTI chief's Banigala residence, questioning where the money for it had come from and if Khan had accepted a loan or a gift from his former wife, Jemima Khan, to purchase the property.

During the course of the hearing, the bench had also asked for the account details of Niazi Services Limited (NSL), Khan's offshore company, that was dissolved in 2015

Tareen's land and off-shore company
The court had raised questions pertaining to Tareen's 18,500 acres of land, which his lawyer had argued was leased and not owned. The lawyer had attempted to explain why his client had not declared the land is his election forms and had made the distinction between land owned by his client and that which was leased as the basis for his defence.

Several hearings had also focused on Tareen's offshore company, Shiny View Limited, established under British Virgin Islands laws in 2011. The company owned a residential property in Berkshire, UK, for the use of his four children, who were beneficial owners of the property, Tareen's lawyer had told the court.

Banned for life. IK said that whoever gets disqualified will be thrown out from party. Let's see what IK will do with Tareen.

Looks like Tareen family isn't going to stop supporting IK even if JKT is disqualified. I had lot of issues with JKT joining PTI back in 2011 but the way he stood with IK in all up and downs and worked really hard on ground is amazing :bow:

Great news for Pakistan that an honest leader has been declared honest once again and now comes with Supreme Court stamp that he is "Sadiq and Ameen".

Huge setback due to Tareen's disqualification but it was always expected and to be fair there were few issues in his declaration so can't complain much. He worked EXTREMELY hard for PTI and strengthened it so much in South Punjab.

Crying faces of Denial Aziz, Hanif, Maryam etc was great to see, they didn't even celebrate Tareen's disqualification as it would legitimize Sharif's disqualification as well.

So from now on, Khan OFFICIALLY CLEAN :D

If this is true, then its not good from SC. They cant let criticism influence their decisions. Judiciary should be independent and deaf to any commands from outsiders.

Lols what are you talking about? He is one of the biggest members of the party and has spent alot of money on the party. Whole party should look to be clean, in this case of there was cases against all other members of PTI you would have been happy as long as Imran was safe?
