Big crackdown against terrorism financing by CTD Punjab.

Hafiz Saeed of Jamat ud Dawa & other leaders booked in cases of terrorism financing.

Cases registered in Lahore, Gujranwala & Multan for collection of funds for terrorism financing through assets/properties made and held in the names of Trusts/Non-Profit Organisations (NPO) including Al-Anfaal Trust, Dawat ul Irshad Trust, Muaz Bin Jabal Trust, etc.

Large scale investigations launched into financing matters of Proscribed Organisations Jamat ud Dawa & Lashkar-e-Taiba in connection with the implementation of UN Sanctions against these Designated Entities & Persons as directed by NSC (National Security Committee) in its Meeting of 1st January 2019 chaired by the PM Imran Khan for implementing National Action Plan.

On 1st & 2nd July, the CTD Punjab has registered 23 Cases against the leadership of JuD (Jamat ud Dawa), LeT (Lashkar-e-Taiba) & FIF (Falah-i-Insaniyat Foundation) for making assets from terrorism financing through the following Trusts/NPOs:

1- Dawat ul Irshad Trust

2- Muaz Bin Jabal Trust

3- Al-Anfaal Trust

4- Al Hamd Trust

5- Al Madina Foundation Trust.

The leaders of JuD & LeT that have been booked include:

1- Hafiz Muhammad Saeed;

2- Abdul Rehman Makki;

3- MaliK Zafar Iqbal;

4- Ameer Hamza;

5- Muhammad Yahya Aziz;

6- Muhammad Naeem Sh;

7- Mohsin Bilal;

8- Abdul Raqeeb;

9- Dr. Ahmad Daud;

10- Dr. Muhammad Ayub;

11- Abdullah Ubaid;

12- Muhammad Ali;

13- Abdul Ghaffar & others.

Large scale investigations have been launched into matters of JuD, LeT & FIF regarding their holding & use of Trusts to raise funds for terrorism financing.

They made these Assets from funds of terrorism financing, they held & used these assets to raise more funds for further terrorism financing. Hence, they committed multiple offences of terrorism financing & money laundering under Anti-Terrorism Act 1997. They will be prosecuted in ATCs (Anti Terrorism Courts) for commission of these offences.

These Assets/NPOs have already been taken over by the government in compliance with UN Sanctions.

ATC grants pre-arrest bail to JuD chief Hafiz Saeed and 3 others

An anti-terrorism court (ATC) in Lahore on Monday granted pre-arrest bail to Jamatud Dawa (JuD) chief Hafiz Muhammad Saeed and three others in a case pertaining to the outfit's alleged illegal use of land for its seminary.

The ATC granted interim bail to the accused, that included Saeed, Hafiz Masood, Ameer Hamza, and Malik Zafar, until Aug 3 against surety bonds of Rs50,000 each.

During the hearing, the legal counsel of the accused insisted that JuD was not using any piece of land illegally and urged the court to accept bail pleas.

Meanwhile, the Lahore High Court (LHC) issued notices to the federal government, the Punjab government and the Counter-Terrorism Department (CTD) regarding a petition filed by Jamatud Dawa chief Hafiz Muhammad Saeed and his seven aides, challenging a case carrying charge of terror financing lodged by the CTD.

A two-member bench of the LHC comprising Justice Shehram Sarwar Chaudhry and Justice Mohammad Waheed Khan asked the parties to submit their replies within two weeks.

A lawyer for the federal government objected to the notices, arguing that the petition was non-maintainable. The bench, however, dismissed the objection and adjourned proceedings until July 30.

During the proceedings, Saeed and the seven other petitioners were represented by senior lawyer A.K. Dogar.

The other petitioners include Muhammad Ayub Sheikh, Zafar Iqbal, Syed Luqman Ali Shah, Hafiz Abdul Rehman Makki, Abdul Salam, Abdul Ghaffar and Abdul Qudoos Shahid.

According to the joint petition submitted earlier in July, the JuD leaders submitted that the facts, narrated in the impugned FIR lodged on July 1, illegally described them as members of the Lashkar-e-Tayyaba (LeT) and levelled unlawful allegation of terror financing.

Prior to this on July 3, top 13 leaders of the banned JuD, including Saeed and Naib Emir Abdul Rehman Makki, were booked in nearly two dozen cases for terror financing and money laundering under the Anti-Terrorism Act, 1997.

The counsel had referred to a 2009 judgment by a full bench of the LHC against the detention of Saeed at that time and stated that the petitioners were not members of the LeT.

He had stated that the LHC through another judgment issued in 2003 had held that Saeed had left the leadership of LeT on Dec 24, 2001 while the organisation was banned on Jan 14, 2002.

The lawyer had pleaded that the claim of the government that the petitioners were the members of the LeT stood disapproved in the light of the two judgments. Therefore, he had asked the court to quash the impugned FIR lodged by the CTD for being unlawful and of no legal effect.

The federation through the secretary ministry of interior, Punjab government through the home department and the SHO CTD regional headquarters Lahore were made party in the petition submitted in the high court.

Hafiz Saeed arrested by Punjab CTD, sent on judicial remand in terrorism financing case

Jamatud Dawa (JuD) chief Hafiz Muhammad Saeed on Wednesday was arrested in a terrorism financing case on his way from Lahore to Gujranwala, said officials of Punjab Counter-Terrorism Department.

Punjab chief minister's spokesman Dr Shahbaz Gill told Reuters that Saeed was arrested near Gujranwala.

"The main charge is that he is gathering funds for banned outfits, which is illegal," Gill said.

According to a spokesperson for CTD Punjab, following his arrest, Saeed was sent to prison on judicial remand after the counter-terrorism department presented him before a Gujranwala anti-terrorism court (ATC).

The CTD has been directed to complete its investigation and submit a charge sheet to the court in the stipulated time.

Earlier, according to the CTD sources, Saeed was arrested by the CTD Punjab in the Gujranwala jurisdiction, while he on his way to an ATC in Gujranwala to seek bail.

A JuD spokesperson also confirmed the arrest to Reuters.

On July 3, top 13 leaders of the banned JuD, including Saeed and Naib Emir Abdul Rehman Makki, were booked in nearly two dozen cases for terror financing and money laundering under the Anti-Terrorism Act, 1997.

The CTD, which registered the cases in five cities of Punjab, declared that the JuD was financing terrorism from the massive funds collected through non-profit organisations and trusts including Al-Anfaal Trust, Dawatul Irshad Trust, Muaz Bin Jabal Trust, etc.

These non-profit organisations were banned in April as the CTD during detailed investigations found that they had links with the JuD and its top leadership, accused of financing terrorism by building huge assets/properties from the collected funds in Pakistan.

On Monday, a Lahore High Court division bench sought replies from the Ministry of Interior, Punjab home department and CTD on a petition of JuD chief Hafiz Saeed and his seven aides challenging an FIR carrying a charge of terror financing.

Advocate A.K. Dogar represented the petitioners and contended that the facts narrated in the impugned FIR registered on July 1, 2019 illegally described them as members of LeT and levelled unlawful allegations of terror financing.

The counsel referred to a 2009 judgement by an LHC full bench against the then detention of Hafiz Saeed and stated that the petitioners were not members of LeT.

He said the LHC through another judgement issued in 2003 had also held that Hafiz Saeed left the leadership of LeT on Dec 24, 2001 while the organisation was banned on Jan 14, 2002.

The lawyer pleaded that the claim of the government that the petitioners were members of LeT stood disapproved in light of the two judgements.

A government law officer opposed the petition and stated that it was not maintainable at this stage of the case.

However, the bench comprising Justice Shehram Sarwar Chaudhry and Justice Waheed Khan directed the law officer to furnish written replies on behalf of the respondents by July 30.

The other petitioners are Mohammad Ayub Sheikh, Zafar Iqbal, Syed Luqman Ali Shah, Hafiz Abdul Rehman Makki, Abdul Salam, Abdul Ghaffar and Abdul Qudoos Shahid.

Also on Monday, an anti-terrorism court (ATC) in Lahore had granted pre-arrest bail to the JuD chief and three others in a case pertaining to the outfit's alleged illegal use of land for its seminary, against surety bonds of Rs50,000 each.

In February, Paris-based Financial Action Task Force (FATF) had warned Pakistan to deliver on its commitments to curb terror financing and money laundering.

Risks to the global financial system had virtually put the country’s entire machinery into an aggressive mode to show tangible progress within two months of the warning.

While the meetings were taking place, the government had announced a ban on JuD and Falah-e-Insanyat Foundation (FIF) to partially address the concerns raised by India that Pakistan supported these and six similar organisations, including Jaish-e-Mohammad (JeM) or at least considered them low-risk entities.

Shah said this during a press conference held at the Sindh Governor House on Thursday.

An anti-terrorism court in Lahore on Wednesday indicted Hafiz Saeed, the chief of the proscribed Jamaatud Dawa (JuD), and four other JuD leaders who were booked in July for offences pertaining to terror financing.

Saeed, along with the others, was presented before the court today under strict security protocol.

During the proceedings, Saeed's lawyer presented arguments against the indictment.

After filing charges, the court summoned the prosecution's witnesses. ATC-I judge Malik Arshad Bhutta, who heard the case, adjourned proceedings until tomorrow.

On Saturday, the court had delayed the indictment owing to unavailability of one of the suspects in a case registered by the Counterterrorism Department (CTD) on charges of terror financing.

The JuD leaders deny allegations against them as being baseless and a result of international pressure on the Pakistan government. They claim that they have been charged in cases by wrongly attributing them as leaders of the banned Lashkar-e-Taiba (LeT).

They plead it was an admitted fact supported by superior courts’ decisions that they had already quit the LeT before the organisation was proscribed in 2002. They argue the cases against them have been made on the basis of a link to defunct Al-Nifal Trust which, they claim, was formed to construct mosques in the country. They say the CTD registered cases without any substantive evidence.

Financing terror
On July 3, the top 13 leaders of the JuD were booked in nearly two dozen cases pertaining to terror financing and money laundering under the Anti-Terrorism Act (ATA), 1997.

The CTD, which registered the cases in five cities of Punjab, declared that the JuD was financing terrorism from the massive funds collected through non-profit organisations and trusts including Al-Anfaal Trust, Dawatul Irshad Trust, Muaz Bin Jabal Trust, etc.

These non-profit organisations were banned in April as the CTD, during detailed investigations, found that they had links with the JuD and its top leadership.

Subsequently, on July 17, Saeed was arrested from Gujranwala on charges of terror financing by the Punjab CTD. He was sent to prison on judicial remand after the CTD presented him before a Gujranwala ATC.

Pakistan warned to curb terror financing
In February, the Paris-based Financial Action Task Force (FATF) had warned Pakistan to deliver on its commitments to curb terror financing and money laundering.

Risks to the global financial system virtually put the country’s entire machinery into an aggressive mode to show tangible progress within two months of the warning.

In late February, the government announced a ban on JuD and Falah-e-Insaniyat Foundation to partially address the concerns raised by India that Pakistan supported these and six similar organisations, including Jaish-e-Mohammad (JeM), or at least considered them low-risk entities.

Law enforcement agencies over the next few weeks intensified their crackdown on JeM, JuD, FIF and other banned outfits, and arrested more than 100 activists. Nearly 200 seminaries besides hundreds of other facilities and assets associated with them across the country were taken over by the government.

Quarterly assessments by the FATF of Pakistan's progress continued over the course of the year.

In the latest FATF review held in October, it was found that while Pakistan has made significant improvements, it will have to take "extra measures" for "complete" elimination of terror financing and money laundering. A reprieve until February 2020 has been given until when Pakistan will remain on the task force's "grey list".

In 2012, Pakistan was placed on the grey list and remained on it till 2015. The country was put on the list again on June 29, 2018. Pakistan was given 15 months for implementation of the 27-point action plan, with a warning that in case of failure the country would be added to the blacklist — a list of the countries branded as uncooperative and tax havens for terror funding.

Currently, only Iran and North Korea are on the blacklist.

A Lahore anti-terrorism court (ATC) on Tuesday accepted a plea seeking the simultaneous hearing and verdict of six cases against the chief of the proscribed organisation Jamaatud Dawa (JuD), Hafiz Saeed, and his associates.

Deputy Prosecutor General Abdul Rauf Wattoo told DawnNewsTV that in total six cases against the said individuals were pending before the same court, adding that in four of these cases presentation of evidence was in progress.

Wattoo said hearing of all four remaining cases will be concluded simultaneously at the end of the week, which is when the court will issue its verdicts. The court has already reserved its verdicts in two of the cases. The reserved verdicts, which relate to terror financing cases, will also be announced with those on other cases at the end of the week, he added.

On Saturday, the ATC had delayed announcing its verdict in the terror financing cases and had decided to hear arguments on February 11 (today) on the defendants' application to hear all cases first before announcing the verdict. The application, filed by the suspects' counsel, demands that collective verdicts be issued after the completion of trials in all the cases pending against them.

A prosecutor had opposed the application and argued that the court could announce its verdict in cases for which arguments had been closed. The court, however, had deferred the decision and sought arguments on the application from both sides.

Saeed is nominated in about 29 cases pertaining to terror financing, money laundering as well as illegal land grabbing. The verdict was reserved against him in two cases on Feb 6.

Lahore ATC convicts Hafiz Saeed in two terror-financing cases

A Lahore anti-terrorism court convicted Jamatud Dawa leader Hafiz Saeed in two terror-financing cases on Wednesday.

He was slapped with a prison sentence of five and a half years and a fine of Rs15,000 in each case. The sentences of both cases will run concurrently. The court also granted him the benefit of Section 382-B of the Code of Criminal Procedure (reduction of period of sentence of imprisonment). Malik Zafar Iqbal, the secretary of Al-Anfaal Trust, has also been convicted in the same cases and has been awarded similar punishment.

They were convicted under the Anti-Terrorism Act Section 11-F(2) — pertaining to membership, support and meetings relating to a proscribed organisation — and 11-N (punishment under Sections 11-H to 11-K).

Section 11H relates to fundraising for the purpose of terrorism, 11-I is about the use and possession of money or other property for terrorism, 11-J relates to funding arrangements which result in money being made available for terrorism, while 11-K relates to money laundering.

The court directed authorities to keep Saeed under custody until further orders.

The verdict was announced by ATC judge Arshad Hussain Bhatta. Saeed was also present in the courtroom while the judge read out the sentence.

The JuD leader was found guilty of “being part of a banned terrorist outfit” and for “having illegal property”, his lawyer Imran Gill told AFP.

“Hafiz Saeed and another of his close aides have been sentenced in two cases of terrorism financing,” prosecutor Abdul Rauf Watto told Reuters.

The court had reserved its verdicts in the two cases on February 6. Saeed is nominated in multiple cases pertaining to money laundering, terror financing and land grabbing.

Chief US diplomat for South Asian affairs Alice Wells on Thursday hailed the conviction of Jamatud Dawa leader Hafiz Saeed and his aide Malik Zafar Iqbal as a "step forward" for Pakistan.

A day earlier, an anti-terrorism court convicted the two JuD leaders to five-and-a-half-years of rigorous imprisonment (RI) in two cases relating to terror financing. The verdict came days ahead of the Financial Action Task Force's (FATF) meeting in Paris to decide Pakistan’s grey list fate.

Wells, in a tweet by the Bureau of South and Central Asian Affairs early Thursday, said that the conviction was a step forward, "both toward holding the banned Lashkar-e-Taiba (LeT) accountable for its crimes and for Pakistan in meeting its international commitments to combat terrorist financing".

In a subsequent tweet, Wells noted that "as Prime Minister Imran Khan has said, it is in the interest of Pakistan's future that it not allow non-state actors to operate from its soil".

ATC-I presiding judge Arshad Hussain Bhutta convicted both the JuD leaders under Section 11-N of the Anti-Terrorism Act 1997 and sentenced them to five years RI with a fine of Rs10,000 each and six months RI under Section 11-F (2) of the Act with a fine of Rs5,000.

The ATC judge observed that in addition to evidence presented by the prosecution, both accused also admitted the ownership of the property by Tanzeem Markaz Dawatul Irshad, a proscribed organisation.

“Careful scanning of Section 11-F (1) of ATA 1997 reflects that a person is guilty of an offence if he belongs to a proscribed organisation and it is not mentioned in the said section that the said membership is post-proscription or pre-proscription and in this case ... it is established by the prosecution that accused Hafiz Mohammad Saeed and Malik Zafar Iqbal belong to proscribed organisation Jamaatud Dawa and Tanzeem Markaz Dawatul Irshad,” observed the judge.

He said it had been established on record that the property in question was in the name of Dawatul Irshad and the same remained in possession of the accused persons being trustees.

The court had reserved its verdicts in the two cases on February 6. Saeed is nominated in multiple cases pertaining to money laundering, terror financing and land grabbing.

The JuD chief was arrested by CTD in July last year, while he was travelling from Lahore to Gujranwala. Prior to his arrest, 23 first information reports had been registered against JuD leaders, including Saeed and JuD Naib Emir Abdul Rehman Makki, at CTD police stations of Lahore, Gujranwala, Multan, Faisalabad and Sargodha in July 2019.

According to the CTD, JuD was financing terrorism from the massive funds collected through non-profit organisations and trusts including Al-Anfaal Trust, Dawatul Irshad Trust, Muaz Bin Jabal Trust, etc. These non-profit organisations were banned in April last year as the CTD, during detailed investigations, found that they had links with the JuD and its top leadership.

The crackdown on JuD last year followed a warning by Paris-based FATF to Pakistan to deliver on its commitments to curb terror financing and money laundering.

The government had announced a ban on JuD and Falah-e-Insanyat Foundation (FIF) to partially address the concerns raised by India that Pakistan supported these and six similar organisations, including Jaish-e-Mohammad (JeM) or at least considered them low-risk entities.

Law enforcement agencies over the next few weeks had intensified their crackdown on JeM, JuD, FIF and other banned outfits, and arrested more than 100 activists. Verdict of 4 cases against him is pending, if those are against him he will spend rest of his life in jail but like all influential people of subcontinent he will be controlling the activities of his organisation from there.
 
So basically he is going to go to jail for a while where a 5 star treatment will be given to him care of ISI. Once the FAFT issue has been cooled he may get released.. This will be fun to watch the events unfold from here.

After sept 11 Saudi, where 19 of the hijackers originated were not even put on FATF list, money was flowing in and out of that country, even Pakistan was not placed on that list up until 2012.

Anyone helping occupied people to attack those who are occupying them are not financing anything but freedom fighters. If he has targeted innocent people then yes he is a terrorist. But we cant take the word of Indians or the Yanks who openly finance terrorism but the we must take the Pakistani justice system to make their verdict.

Sure, any banned oufit in Pakistan is banned and nobody should have any link with such groups.

He was not been found guilty of directly supporting the resistance in Kashmir. For this he should be given a medal.

ISLAMABAD: The Foreign Office on Monday rejected the reports as "factually incorrect and misleading" in which it was claimed that Pakistan has restored the bank accounts of Jamaat-ud-Dawa (JuD) chief Hafiz Saeed along with his four aides who are on the United Nations' sanctions list.

"The bank accounts belonging to the UN Designated Persons have not been unfrozen by Pakistan," said Foreign Office spokesperson Aisha Farooqui, while responding to media queries, adding that the reports about the restoration of bank accounts of UN Designated Persons is factually incorrect and misleading.

She said that the targeted financial sanctions, on the UN Designated Persons, including freezing of their bank accounts are in place and being strictly monitored, in compliance with the UN sanctions.

She said that the UNSC 1267 Sanctions Committee had granted basic expense exemptions to the designated individuals in 2019, in accordance with the exemption provisions of the relevant UNSC resolutions provided for in the relevant UNSC resolutions.

"The exemptions were granted to allow these individuals to meet their basic expenses and do not involve any restoration or unfreezing of the bank accounts. These exemptions are being enforced and monitored as per law," she asserted.

It is hoped that due care would be taken in ascertaining facts with relevant government departments before filing such reports in the future.

Hafiz Saeed, Masood Azhar-linked terror camps attacked by Indian armed forces in Pakistan

In a strong response to the Pahalgam terror attack, the Indian Armed Forces launched ‘Operation Sindoor’ on Wednesday(May 7), striking major terror bases across Pakistan and Pakistan-occupied Jammu and Kashmir (PoJK). The move comes after 26 people, most of them tourists, were killed in a deadly terrorist attack in Baisaran valley of J-K on April 22. The Indian armed forces today targeted several terror camps of Hafiz Saeed and Masood Azhar in large numbers.

One of the most significant targets was Muridke, a town in Pakistan’s Punjab province, located around 40 kilometres from Lahore. Muridke is known as a major centre for terror activities and houses the headquarters of Lashkar-e-Taiba (LeT), the group believed to be behind the Pahalgam attack. LeT is led by Hafiz Saeed, the mastermind of several past attacks on India. The LeT campus in Muridke is spread across nearly 200 acres and includes terror training facilities and other infrastructure. It also houses Jamaat-ud-Dawa, a front organisation for LeT.

Terrorist camps of Lashkar-e-Taiba attacked in Pakistan

Markaz Taiba is the ‘alma mater’, which was established in the year 2000, is the most important training centre of LeT located in Nangal Sahdan, Muridke, Sheikhupura, Punjab, Pakistan.

Markaz Ahle Hadith Barnala Lashkar-e-Taiba Bhimber District, PoK- Markaz Ahle Hadith, Barnala is one of the important Markaz of LeT in PoJK and is used for infiltration of LeT terrorists and arms, ammunition into Poonch, Rajouri and Reasi sectors. The Markaz is situated at the outskirts of Barnala town on Kote Jamel road and is at a distance of 500 metres from Barnala town and 200 metre from Kote Jemel road.

Shawai Nallah Camp is one of the most important camps of LeT and is used for the recruitment, registration and training of LeT cadres. This camp has been functional since early 2000.

Masood Azhar-linked terror camps hit

India’s strikes also hit Bahawalpur, which is another terror hub in the Punjab region of Pakistan. This location is home to Jaish-e-Mohammed (JeM), a group led by Masood Azhar, who is known for plotting the 2008 Mumbai terror attacks. In addition, targets in Kotli and Muzaffarabad in PoJK were also struck.

Syedna Bilal Masjid is the main centre of JeM in PoJK, located opposite Red Fort, Muzaffarabad. This facility is used as a transit camp for JeM terrorists prior to their launching into J&K. At any point of time 50-100 cadres reside in this facility.

The Ministry of Defence said that altogether, nine sites have been targeted. Our actions have been focused, measured and non-escalatory in nature. No Pakistani military facilities have been targeted. India has demonstrated considerable restraint in the selection of targets and the method of execution. Further, as per the Ministry, these steps come in the wake of the barbaric Pahalgam terrorist attack in which 25 Indians and one Nepali citizen were murdered. We are living up to the commitment that those responsible for this attack will be held accountable.

According to the Ministry, these steps were taken in response to the barbaric Pahalgam terrorist attack, in which 25 Indians and one Nepali citizen were killed. The government reiterated its commitment to hold those responsible accountable.

India targets JeM, LeT headquarters in Pakistan

Indian forces targeted the headquarters of the banned Jaish-e-Mohammed and Lashkar-e-Taiba groups in the missile attacks against terror infrastructure in Pakistan and Pakistan-occupied-Jammu and Kashmir in the early hours of Wednesday. Among the nine sites targeted are the JeM headquarters in Bahawalpur and the LeT’s in Muridke, both in Pakistan Punjab.

India has categorically stated that its actions have been focused, measured and non-escalatory in nature and that no Pakistani military facilities have been targeted. India’s action comes two weeks after the April 22 Pahalgam terror attack in which 26 people were killed, "A little while ago, the Indian Armed forces launched 'Operation Sindoor' hitting terrorist infrastructure in Pakistan and Pakistan-occupied Jammu and Kashmir from where terrorist attacks against India have been planned and directed," the Defence Ministry said in a statement
