Imran Khan and Bushra Bibi indicted in Toshakhana 2.0 case [Post Updated #451]

PTI founder, Bushra Bibi’s remand extended for 11 days

Accountability Court Judge Nasir Javed Rana extended the remand and adjourned the proceedings until August 12.

Former Prime Minister Imran Khan and his wife Bushra Bibi were earlier sent on 10-day physical remand in NAB Toshakhana reference.

On July 13, Imran Khan and his wife Bushra Bibi were arrested in a fresh National Accountability Bureau (NAB) reference related to Toshakhana, hours after their acquittal in the Iddat case.

The NAB team headed by Deputy Director Mohsin Haroon arrested Imran Khan and Bushra Bibi from the Adiala Jail, the sources privy to the development added.

The development came after the Islamabad district and sessions court accepted the appeals filed by former prime minister Imran Khan and his spouse Bushra Bibi against their conviction in the Iddat case.

The couple was sentenced to seven years in prison and awarded a fine of Rs500,000 each, in February earlier this year after a trial court found their nikah to be fraudulent.

The verdict clears the last existing legal hurdle keeping the deposed prime minister in jail. His sentences in the two Toshakhana cases were suspended while he was acquitted by the Islamabad High Court (IHC) in the cipher case.

NAB files new Toshakhana reference against Imran Khan, Bushra Bibi

The National Accountability Bureau (NAB) filed another Toshakhana reference against incarcerated Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and former first lady Bushra Bibi on Tuesday.

Investigation officer Moshin Haroon and case officer Waqarul Hassan filed the reference in an accountability court of Islamabad. The new Toshakahana reference consists of two volumes.

The registrar of the accountability court would examine the reference after which it would be sent to the administrative judge where he would decide if this case would be heard by his court or transferred to another court.

It must be noted that Nasir Javed Rana was already hearing case involving 190 million pounds reference in which both Khan and his wife were arrested on July 13 and remained in the NAB custody for 37 days.

Toshakhana case: NAB issued notice on Imran’s bail plea

An accountability court on Tuesday issued a notice to the National Accountability Bureau (NAB) on the post-arrest bail petition of former prime minister Imran Khan and his spouse, Bushra Bibi.

The accountability watchdog has filed a reference against the couple, accusing them of retaining an expensive Bvlgari jewellery set from Toshakhana at a throwaway price.

Mr Khan and his spouse are seeking bail in the reference filed by NAB last week.

The couple also pleaded with the court to grant them interim bail till their post-arrest bail petition is decided.

The accountability court judge, Nasir Javed Rana, summoned the case record from NAB and adjourned the hearing till Aug 30.

The bureau alleged that the Saudi royal family gifted a Bvlgari jewellery set to Ms Bibi during her visit to the kingdom in May 2021.

It said that the jewellery set comprises a ring, bracelet, necklace and earrings.

The initial investigation found that the former first couple illegally retained this jewellery set, according to NAB.

On May 18, 2021, the then deputy military secretary to the PM, Col Rehan Mohammad, asked the Toshakhana section officer to evaluate the set’s price.

The section officer was also told that Mr Khan intends to retain the gift and declare it in his record.

According to the reference, a franchise of Bvlgari sold the said jewellery set to the Saudi government on May 25, 2018, for 300,000 euros and earrings for 80,000 euros.

NAB claimed that in May 2021, the total value of the jewellery set was over Rs75 million, and 50pc of that amount — over Rs35.7m — was not deposited in the treasury.

NAB alleged Mr Khan retained 58 of 108 gifts he received from heads of state and other dignitaries.

NAB withdraws Toshakhana case against Imran Khan, Bushra Bibi

The National Accountability Bureau withdrew on Monday the Toshakhana case against the founder of former prime minister Imran Khan and his wife Bushra Bibi.

Following NAB’s request, the accountability court transferred the Toshakhana reference to a special judge in Central Islamabad. A prosecutor stated that, after the restoration of amendments to NAB laws, the Toshakhana case no longer falls under its jurisdiction.

The attorney representing the PTI founder stated that, in light of such amendments, the case should not even exist.

But the former prime minister would not be released as he still faces dozens of cases related to the May 9 events when violent protests started after his arrest from the Islamabad High Court premises in a graft case.

This comes after Khan sought acquittal in the NAB cases against him after the Supreme Court’s decision. Last week, the apex court rejected Khan’s plea to declare the NAB amendments null and void while approving intra-court appeals from federal and provincial governments, thereby reinstating the NAB amendments.

The detailed ruling stated that Khan could not satisfactorily convince the court regarding the invalidation of the NAB amendments.

Khan, 71, has been imprisoned at the Adiala Jail for over a year following his conviction in four cases, including two Toshakhana references. His sentences in the Toshakhana references were suspended, and he was also acquitted by the Islamabad High Court in the cipher case earlier this year.

In June, the national-graft buster re-arrested them in a new Toshakhana case reference hours after a court acquitted both in the unlawful marriage case, dashing their hopes of being released from prison.

Earlier this year, a UN panel of experts found Khan’s detention “had no legal basis and appears to have been intended to disqualify him from running for political office”.

“Thus, from the outset, that prosecution was not grounded in law and was reportedly instrumentalised for a political purpose,” it said, calling for his immediate release after nearly a year in jail.

Imran’s acquittal plea in £190m case rejected

An accountability court on Thursday rejected the petitions of former premier Imran Khan and his spouse, Bushra Bibi, seeking acquittal in the £190 million corruption case under the amended National Accountability Ordinance of 1999.

Mr Khan, while relying upon the amended NAO, claimed that the case against him was initiated on the basis of a meeting of the federal cabinet and the law has protected the decision taken by the cabinet.

“Despite being fully aware that the case does not fall within the ambit of the NAO, NAB exceeded its jurisdiction and filed a false and frivolous reference, alleging that the applicant, as prime minister of Pakistan, chaired the cabinet meeting held on Dec 3, 2019, during which a deed of confidentiality was approved,” said the petition filed by the PTI founding chairman.

It said the NAB had accused Mr Khan of misusing his authority for according the said approval and, in return, obtained approximately 458 kanals of land in tehsil Sohawa of Jhelum district, Rs285m in cash, and other benefits under the guise of donations for Al-Qadir University Project Trust.

“Additionally, it is alleged that the applicant and his spouse, through their associate Farhat Shehzadi, received 240 kanals of land from co-accused Ahmad Ali Riaz Malik as compensation for personal gain.

“Thus, the accused/applicant, as a public officeholder, is accused of misusing his authority for personal gain for himself and his wife in the form of donations and other benefits,” the petition said.

The NAB prosecution contended that the case is that the ex-PM had misled the cabinet to obtain the approval. The prosecutor said Mr Khan had concealed the facts from the cabinet members and forced them to approve the confidential deed in a sealed envelope.

Subsequently, accountability judge Nasir Javed Rana dismissed the petition.

Bushra Bibi moves LHC about ‘undisclosed’ cases

Bushra Bibi, the incarcerated wife of jailed PTI founding chairman Imran Khan, has approached the Lahore High Court seeking details of all undisclosed cases registered against her.

In a petition, Bushra Bibi challenged the authorities’ failure to provide information regarding the undisclosed cases and pointed out that she was being targeted for political reasons.

The petitioner through a counsel argues that she has been unlawfully imprisoned despite not being required in any criminal case following her acquittal, confirmation of bail and suspension of the sentences in all previous cases registered against her.

The petition pleads that the petitioner has become a victim of the state’s visible mischief, with the sole purpose to pressurise her husband.

Therefore, if the petitioner has been arrested in any other case without bringing it to her knowledge, it would amount to miscarriage of justice.

The petition asks the court to order the respondents to submit a fresh list of disclosed and undisclosed cases against the petitioner and also issue an order preventing her arrest in any such cases.

The Punjab police, the FIA, and the interior ministry have been listed as respondents in the petition. Justice Farooq Haider will hear the petition on Monday (tomorrow).

Imran Khan, Bushra Bibi's bail in Toshakhana 2 case rejected

A special court in Rawalpindi rejected the bail applications of PTI Founder Imran Khan and his wife, Bushra Bibi. The court, presided over by Special Judge Central Shahrukh Arjumand, heard the case inside Adiala Jail on Monday.

FIA Prosecutor Zulfiqar Abbas Naqvi and his team appeared in court, while Barrister Salman Safdar represented the PTI founder and Bushra Bibi. After hearing detailed arguments from both the prosecution and defense, the court reserved its decision. Following deliberations, the court denied bail to both suspects.

The prosecution has alleged that Imran Khan received a valuable jewellery set from Saudi Arabia worth Rs70 million during his stint as the prime minister and retained it for a much lower price of Rs2.9 million. According to the prosecution, the set -- comprising a necklace, earrings, bracelets, and rings -- was not deposited in the Toshakhana repository, but was instead retained by Khan. The prosecution also argued that the actual price of the gift was verified through the Foreign Office.

The prosecution further alleged that Imran Khan, while serving as prime minister, undervalued the jewellery set at Rs5.8 million and arranged for it to be kept without proper registration. The court was informed that Imran Khan got the price of the jewellery set fixed through his office secretary, Inam Shah, who along with Toshakhana officials confirmed this action.

Barrister Salman Safdar, representing the defense, argued that the case is similar to a previous reference filed in connection with the Toshakhana gifts. He asserted that the allegations, witnesses, and evidence were largely the same, and contended that the case should be dismissed following the Supreme Court's decision to restore NAB amendments.

Despite these arguments, the court dismissed the bail applications and set the date for framing charges against Imran Khan and Bushra Bibi for October 2.

On September 26, the court set October 2 as the date for the indictment. The proceedings took place at Adiala Jail, Rawalpindi, where Special Judge Central Shahrukh Arjamand presided over the hearing.

On Thursday, the defense lawyer, Salman Safdar, completed his arguments regarding the bail applications of the PTI founder and Bushra Bibi.

However, the prosecution was unable to present its arguments and requested additional time. The defense opposed the request, urging the court to make a decision on the bail applications without delay.

Both the PTI founder and Bushra Bibi addressed the court, expressing their desire for swift justice, stating that the prolonged proceedings were unfair.

Despite the defense’s appeal for a same-day decision, the court adjourned the hearing to September 28, granting the prosecution more time to present their case.

Notice issued on Bushra’s bail plea in new Toshakhana case

The Islamabad High Court (IHC) on Friday issued notice to the Federal Investigation Agency (FIA) on Bushra Bibi’s petition seeking post-arrest bail in a case related to an expensive Bulgari jewellery set obtained from Toshakhana at a throwaway price.

Justice Miangul Hassan Aurangzeb heard the bail petition.

Khalid Yousaf Chaudhry — the counsel for Bushra Bibi, wife of former prime minister Imran Khan — informed the court that his client was arrested on July 13. He requested the court to fix the case for regular hearing on Monday.

Justice Aurangzeb while adjourning the case directed the registrar office to fix a date for hearing during the next week.

On Sept 30, Special Judge Central Shahrukh Arjumand had rejected the couple’s petitions in the same case.

According to the prosecution, the jewellery set worth Rs71.5 million was retained by the former premier and his spouse for Rs2.9m only.

The court, without initiating any formal proceedings, adjourned the case until Oct 21.

It was scheduled that the indictment against Imran Kahn and his wife would take place today.

However, due to security concerns at Adiala Jail, the hearing was delayed.

Jail authorities had requested the postponement of proceedings, citing security threats.

The case will now be heard later this month.

Islamabad High Court grants bail to Bushra Bibi in Toshakhana 2.0

The Islamabad High Court (IHC) has granted bail to Bushra Bibi, wife of incarcerated former prime minister Imran Khan, in the ongoing Toshakhana case.

The bail was approved by Justice Mian Gul Hassan Aurangzeb during a hearing on Wednesdsy, with Bushra Bibi required to submit a bond of Rs1 million.

This decision provides temporary relief to Bushra Bibi, who faces allegations related to the improper handling of state gifts.

During the hearing, Justice Aurangzeb questioned the Federal Investigation Agency’s (FIA) investigative officer about the necessity of further interrogation of Bushra Bibi.

The officer confirmed that no additional investigation was required, after which the judge granted bail.

The court further referenced similar practices in other countries, noting that the British Prime Minister had also taken gifts home, citing regulations.

The judge highlighted how other nations, like Azerbaijan, display gifts in museums, with the only photograph of a Pakistani leader being that of Benazir Bhutto.

The Toshakhana case involves allegations of corruption against Imran Khan and his wife Bushra Bibi, specifically regarding the sale of gifts received from foreign dignitaries.

Indictment of Imran, Bushra postponed in Toshakhana2.0

Meanwhile, the indictment proceedings against both Imran Khan and Bushra Bibi, scheduled for the same day, were postponed due to security concerns.

Initially set to take place at Adiala Jail, the hearing was moved to Islamabad's Judicial Complex.

However, security concerns continued preventing the proceedings, and the court rescheduled the indictment for October 26.

Imran’s wife Bushra Bibi freed after nearly 9 months following bail in new Toshakhana case

Bushra Bibi, the wife of incarcerated ex-premier Imran Khan, was released from Adiala Jail on Thursday a day after being granted bail in a recent Toshakhana case, ending nearly nine months of her detention.

The former first lady was taken into custody on January 31 after an Islamabad accountability court sentenced her and Imran to 14 years in jail in the Toshakhana reference.

The conviction was the second in a series of three back-to-back ones against Imran, just days before the February 8 general elections.

Bushra had been kept at Adiala Jail, where the PTI founder also remains incarcerated since his arrest on August 5 last year in a separate Toshakhana case.

Imran and Bushra were apprehended in the case on July 13, following their acquittal in the Iddat case the same day. The next day, the already imprisoned politician was “arrested” in connection with a dozen May 9 cases.

In the most recent case, the Federal Investigation Agency (FIA) has accused the couple of retaining an expensive Bvlgari jewellery set gifted by a foreign leader — including a necklace, earrings, bracelets, and rings — at a low price, saying it caused significant loss to the exchequer.

A day ago, the IHC had approved Bushra’s bail in the same case, following which a special court issued her release orders today.

Earlier today, Special Judge (central) Shahrukh Arjumand issued Bushra’s release orders, a copy of which is available with Dawn.com, after her counsels Malik Tariq Mehmood Noon and Sohail Satti submitted surety bonds worth Rs1 million.

“The bail of the accused in the above-mentioned case has been approved by the high court,” the release order said, adding that “if the accused is not wanted in any other case, then they should be released on confirmation”.

PTI ‘welcomes’ Bushra back

The PTI hailed her release: “Welcome back Bushra Bibi!”

“You have faced extremely difficult times, disgusting campaign and character assassination attempts against your during your illegal time in jail. The Pakistani nation salutes your bravery!” the party said on X.

Speaking outside Adiala Jail, PTI Chairman Gohar Khan highlighted that the former first lady had “endured jail for nine months in extreme conditions with a lot of courage”.

He said that despite all the hardships, Bushra had stood by Imran’s vision, adding that he was hopeful of Imran’s release soon.

On rumours of a deal being settled between Imran and the powers that be, Gohar said that if it was possible to get Bushra out of jail via a deal, she would not have stayed imprisoned until now.

“Khan sahib would not have been in jail for 16 months [either],” Gohar said.

Responding to a question about how Bushra was finally released today instead of being re-arrested, as in previous cases, Gohar quipped: “In what else case could they have arrested her in.”

“Red salute to Bushra Bibi, the woman who endured 265 worst days in jail,” PTI leader Salman Akram Raja said on X.

Barrister Salman Safdar said it was a “great day” for Bushra’s family, noting that his legal team “worked tirelessly”. He expressed the hope that the release of Imran and his sisters was also “around the corner”.

IHC orders Imran’s production in court by 3pm

Separately, the IHC on Thursday ordered that Imran be produced before the court, and be allowed to have a virtual meeting with his lawyers there.

Today, Justice Sardar Ejaz Ishaq Khan took up a Advocate Faisal Chaudhry’s contempt petition against Adiala jail authorities for not allowing meetings with Imran despite previous court orders.

Earlier this month, the Punjab government, citing security concerns, banned meetings with prisoners at Adiala jail till October 18, which was then extended for an indefinite period.

Adiala Jail Superintendent Ghafoor Anjum appeared before the court today on its orders, along with the additional attorney general and state counsel.

Ordering Anjum to present Imran in the court by 3pm and have him hold a virtual meeting with his lawyers, Justice Khan also told him to explain the reasons if the order was not acted upon.

IHC hearing

At the outset of the hearing, Justice Khan, referring to the ban on prisoner meetings, asked: “Are you saying that the government can stop the process of providing justice with a single notification?”

The state counsel replied that since court hearings had not been taking place, Imran’s meetings had not been arranged either.

Justice Khan then noted that the petitioner had argued that a court order had been violated via a notification.

“I am not saying whether the notification is correct or not; they will have to file a separate petition for that [matter],” he clarified. “However, denying a meeting despite court orders is violation of court orders.”

To this, the state counsel informed the court about the ban on prisoner meetings by the Punjab government based on a law and order situation.

“Have meetings with lawyers also been banned?” the judge asked. He said “those who issued the notification also committed contempt of court”, adding that if the Punjab government barred lawyers’ meetings then it was contempt of court.

Justice Ishaq said the interior ministry should submit a report detailing what the security reasons were.

Here, the petitioner’s counsel informed the court that no lawyer has been allowed meetings at Adiala Jail since October 3.

The court questioned what the results would be if this was not genuine. “I will ask on camera those who wrote the letters.”

“I will put my hand on the Quran and ask whether they will give an affidavit and this was really the position,” the court said.

“If we all go to jail are we all some security threat?” Advocate Shoaib Shaheen asked.

Justice Khan ordered the jail authorities to produce Imran in the court by 3pm, and arrange his meeting with his lawyers via video-link at the court.

Along with summoning the interior ministry’s joint secretary along with relevant records, the judge issued notices seeking judicial assistance from Attorney-General for Pakistan Mansoor Usman Awan.

“I am aware that you will not implement my court orders,” Justice Khan remarked, adding that the court would be accorded respect if Imran was presented in court.

Addressing the jail authorities, the judge ordered: “You should make [necessary] security arrangements and present the PTI founder in court.

“If you cannot do so, you must inform the court tomorrow about the reasons,” Justice Khan stressed.

“You must satisfy the court about the security threat due to which you might not present him,” he told the jail superintendent.

Second Toshakhana case history

In September, Special Judge Central Shahrukh Arjumand had set the couple’s indictment in the case for October 2. However, it was deferred to October 5 on the defence counsel’s request for more time. A day prior to that, Judge Arjumand had rejected their post-arrest bail petitions.

On Oct 24, a day after the IHC approved her bail plea in the case, Bushra was released from Adiala Jail.

In its reference filed with the court, the National Accountability Bureau (NAB) has accused Imran and his wife of illegally retaining the jewellery set gifted to Bushra by the Saudi royal family during their visit to the kingdom in May 2021.

In its reference, the anti-graft watchdog further alleged that during his term as prime minister, Imran and his wife had received a total of 108 gifts from different heads of state and foreign dignitaries.

Of those gifts, they allegedly retained 58 gifts against an undervalued amount of over Rs142m. “Out of these 108 gifts, the accused persons retained 58 gift boxes/sets against an undervalued amount of Rs142.1 million as assessed by appraisers,” the reference said.

After the Supreme Court upheld amendments to NAB laws in September, the case was transferred to an FIA special court from an accountability court.

Pakistan Tehreek-e-Insaaf PTI Chairman Barrister Gohar stated that if Bushra Bibi's release had been the result of a deal, she wouldn't have remained in jail

Speaking to the media outside Adiala Jail, Barrister Gohar mentioned that Bushra Bibi's release after nine months was possible because she endured tough conditions in prison while standing firm with Khan's ideology.

He said, "We salute her courage and congratulate all PTI voters and supporters. Khan sahib will also be released soon."

Barrister Gohar stated that keeping his wife in jail was intended to put pressure on Khan. He assured that the founder's release would happen and it would be on merit, adding that claims of a deal are unfounded. "If that were the case, she wouldn't be in jail," he remarked.

He said, "What is it that you haven't arrested for? Tosha Khana 1, Iddat,Tosha Khana 2"

He further said "Arrests have happened, and all have seen releases based on merit."

The chairman of PTI emphasized that Bushra Bibi has no connection to the Toshakhana case or any other case. "No matter what you do, the public stands with Khan. He has confidence in us, and we are following his orders. He will soon be among the people; everyone is united under the founder's leadership."

He further stated, "I deny any claims of Imran Khan expressing anger during meetings with party leaders. There is no truth to that; it is misinformation. We did not accept the 26th amendment before, and we do not accept it now."

Earlier Bushra Bibi has been released from Adial jail after being granted bail in the Toshakhana 2.0 case.

Additional security forces have been deployed at Adiala Jail in Rawalpindi, with Bushra Bibi's release. The jail administration plans to complete legal formalities after receiving the release order.

I think she was jailed so that Imran Khan's spirit could be broken. Someone like him could bear personal insults but his resilience could not bear something being done to his family, and especially someone who keeps away from public life.

Either those who did it found that even this tactic would not work, or they got what they wanted and Imran Khan compromised for her release.

Locked up for being IKs wife. All the fake stories by the mafia about her corruption could not stand up to any mild scrutiny in court. Those beghairat that believed these stories have gone quiet. An innocent woman was locked and tortured by the junta. @FearlessRoar

Then there is the money trail, where is the money trail. Can you give a single proof that has stood up in court?

Imran hasn’t compromised, not after 9 months of his wife being in jail. She would get bail in one case, then they’d arrest her on the same day for another bogus case just to prevent her release. They just ran out of cases to keep her in jail.

‘Not in favour of cases against Bushra Bibi, PTI founder’s sisters,’ says Sanaullah

Adviser to Prime Minister (PML-N) stalwart Rana Sanaullah said on Thursday that he was not in favor of cases against Bushra Bibi and the sisters of the Pakistan Tehreek-e-Insaf (PTI) founder.

Expressing his thoughts to the foreign media outlet, Sanaullah said: “It is normal for the political leaders to face cases. But I am against involving women in the cases.”

The Pakistan Muslim League-Nawaz (PML-N) stalwart lavished his praise on JUI-F chief Maulana Fazlur Rehman, saying, “Maulana Fazlur Rehman has played a substantial role in line with the 26th constitutional amendment. The PTI had agreed on the draft of the constitutional amendment proposed by the JUI-F.

“The PTI has remained against the approval of the 26th constitutional amendment,” he stated.

Speaking about Justice Mansoor Ali Shah, Sanaullah said: “The way of Justice Mansoor Ali Shah has stopped, but the PTI has interfered more in this regard.”

He maintained: “Justice Mansoor Ali Shah is a competent judge. But the PTI had resorted to propaganda against him.”

“Justice Mansoor Ali Shah will not spearhead the constitutional bench,” Sanaullah added.

Have you heard of bringing proof to a court of law. In this case all judges were yours, all the witnesses were yours and still not a single allegation came close to being proved. Does she have houses in Dubai or Avenfield or a Palace in Surrey? Does she have secret bank accounts, and if so where are they? Does she walk around in Gucci shoes or hand bags? Does she go on holiday to exotic places.

Bushra Bibi poisoned while in jail: Omar Ayub

The central leader of Pakistan Tehreek-e-Insaf (PTI) and Leader of the Opposition in the National Assembly, Omar Ayub Khan, has alleged that Bushra Bibi was poisoned during her time in jail, ARY News reported on Sunday.

Ayub asserted that the former first lady, Bushra Bibi, survived nine months in custody with resilience, adding that her recent release, along with the Aleema Khan and Uzma Khan, was not the result of any political deal with the government.

He further claimed that substandard food, along with interruptions to water and electricity, are part of the poor treatment given to PTI’s founder, who remains imprisoned in Adiala Jail on what Ayub described as fabricated charges.

IHC bars trial court from delivering final order in £190 million corruption case

The Islamabad High Court (IHC) on Monday extended its restraining order, barring the trial court from delivering a final order in the £190 million corruption case involving Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan and his wife, Bushra Bibi.

A division bench comprising Chief Justice Aamer Farooq and Justice Mian Gul Hasan Aurangzeb took up the acquittal pleas filed by the former PM and his wife.

The prosecutor further informed the court that the trial was approaching its conclusion, with the investigating officer undergoing cross-examination since October 20. Imran Khan's counsel pointed out that this witness was the last in the case and that a conclusion to the trial could adversely impact their defense.

Separately, Bushra Bibi's lawyer, Usman Gul, explained that his client had been unable to attend the previous day’s hearing due to health reasons. The court advised against any unnecessary delays, stressing the importance of timely proceedings.

After hearing arguments, the court adjourned the case for 10 days, extending its order that restrains the trial court from issuing a final judgment until further notice.

Court warns of Bushra Bibi's bail cancellation as lawyers absent

An accountability court expressed strong displeasure over the absence of Bushra Bibi and her lawyers, stating that if this situation continues, the accused’s bail could be revoked and arrest warrants could be reissued.

An accountability court hearing on the 190 million pound reference was held at Adiala Jail, presided over by Judge Nasir Javed Rana.

Former Prime Minister Imran Khan was present in the courtroom, while his wife, Bushra Bibi, was represented by assistant lawyer Khalid Yousuf Chaudhry.

During the proceedings, Khalid Yousuf Chaudhry filed a request for Bushra Bibi to be exempted from attendance on medical grounds. However, the prosecution opposed this request, stating that neither Bushra Bibi nor her lawyers were present in court.

The National Accountability Bureau (NAB) prosecutor pointed out that today’s hearing had been scheduled in the presence of the lawyers, who should have informed the court if they were occupied elsewhere.

The prosecutor further noted that the exemption request lacked signatures from Bushra Bibi and her legal team, indicating that proper procedures had not been followed.

"We do not insist that Bushra Bibi must attend every hearing, but if she does not wish to appear, she should appoint a representative," the prosecutor stated.

He also highlighted the absence of medical reports, asserting that Bushra Bibi was misusing her bail and recommended that a show-cause notice be issued against her.

In response, the court expressed strong discontent over the absence of Bushra Bibi and her legal representatives, warning that if this behaviour continued, her bail could be revoked, and arrest warrants might be reissued.

Due to the lack of legal representation, the cross-examination of the case's investigating officer could not proceed, leading the court to postpone the hearing until the following day.

Bushra Bibi gets exemption from appearance in Toshakhana case

An accountability court in Rawalpindi approved a request for exemption from appearance for former first lady Bushra Bibi in the Toshakhana case, with instructions for her to ensure attendance in the next hearing.

Special Judge Central Shahrukh Arjumand heard the case inside Adiala Jail, where arguments were presented by the defence and prosecution.

Lawyer Salman Safdar, representing Bushra Bibi and PTI founder Imran Khan, filed the request for her exemption and submitted pleas seeking acquittal for both individuals. Safdar argued that additional documents supporting their case were forthcoming and requested more time.

Meanwhile, the prosecution opposed the acquittal pleas, arguing they served to delay the indictment process. The prosecutor asserted that the court had previously set multiple dates for indictments, but progress was hindered due to such requests.

The court, after hearing the parties, adjourned the case until Nov 8 and directed both parties to complete arguments on the acquittal pleas by the next hearing.

£190m case: IHC nullifies trial court verdict against PTI founder, Bushra Bibi

The Islamabad High Court (IHC) has nullified the trial court verdict on acquittal pleas of PTI founder Imran Khan and his wife Bushra Bibi in the £190 million case, ARY News reported.

As per details, Chief Justice Amir Farooq and Justice Gul Hasan Aurangzeb issued a nine-page verdict on a petition filed by the PTI founder and Bushra Bibi.

The court declared the trail court verdict null and void and directed the concerned court to decide on both pleas again.

Earlier, an Accountability Court rejected PTI founder Imran Khan’s plea seeking acquittal in a £190 million settlement reference.

Poor guy! Wanted to do something goof ... er, I mean good for his nation, in the process got tempted to steal and to commit theft. Got caught, and is now serving time in jail like any thief would. I feel for his kids. They'll forever have to live with the stigma of being children of a chor.

Hold on, I'm missing something. What was the name of his daughter whom he refused to acknowledge because of his political ambitions? Oh, her name is Tyrian Jade. What does she have to say? Not even people like Zardari, the Shariff family, etc wohom those blind Imran Khan fans refer to as thieves would do something as puke worthy as this.

Imran Khan gets bail in new Toshakhana case ahead of PTI Nov 24 protest

In a major development ahead of the looming November 24 protest by Pakistan Tehreek-e-Insaf (PTI), the Islamabad High Court (IHC) on Wednesday approved the bail plea of party founder Imran Khan in the new Toshakhana case.

IHC's Justice Miangul Hassan Aurangzeb accepted Khan's bail plea against two surety bonds worth Rs1 million each, which must be submitted by separate guarantors.

PTI founder is no longer wanted in any other case within Islamabad's jurisdiction following the latest development.

During the hearing, the FIA prosecutor voiced concerns over media narratives, claiming that reports had prematurely suggested the approval of bail.

Justice Aurangzeb advised the prosecutor to disregard media speculation, emphasising that the court's decisions would not be influenced by such narratives.

The judge remarked on certain claims made in the media, questioning their credibility. He also inquired about the valuation of a jewellery set, asking how its worth was determined.

Barrister Salman Safdar, representing the PTI founder, responded that the prosecution was responsible for clarifying this matter in court. He also highlighted discrepancies in the receipts, noting that the receipts in question were issued in the name of Bushra Bibi, not the PTI founder.

The defence argued that the prosecution's case relied on testimonies from key witnesses such as Sohaib Abbasi, who had been granted pardon and declared an approver in the case.

Barrister Safdar clarified that Abbasi alleged threats from the PTI founder but denied any direct interaction with either the PTI founder or his wife.

The court further asked whether customs officers involved in the valuation had mentioned any intimidation, to which the defence replied that no such claims had been made by these officials.

The FIA prosecutor argued that the Bulgari jewellery set was not deposited in the Toshakhana and alleged that its undervaluation caused financial harm to the state.

Justice Aurangzeb asked how the PTI founder benefited from the undervaluation, to which the prosecutor responded that his wife’s gain inherently benefited him as well.

Justice Aurangzeb dismissed this logic, questioning such assumptions. "My wife's things are not mine. I don't know what ear are we living in."

Barrister Safdar defended his client by stating that all gifts were acquired under the Toshakhana policy of 2018, and the valuation was conducted according to the law.

He added that payments were made as per the policy, and no wrongdoing was evident. Justice Aurangzeb noted that the previous government had withheld Toshakhana details, despite inquiries from the court.

The prosecution highlighted the conduct of the accused during trial proceedings, alleging delay tactics.

The FIA prosecutor presented evidence that Abbasi had submitted an apology for undervaluing the set, which was accepted by the NAB chairman.

The defence, however, criticised the expedited manner in which the FIA had filed its challan, stating that essential aspects of the investigation were overlooked.

As the hearing progressed, the court observed that the Toshakhana case had faced significant delays, with over three years passing before its registration.

I was hoping someone would spell it out for me, and I agree, wont read much into it. If he does get out somehow, best he leave the country imo enough is enough, he has suffered too much.

So what’s happening does that mean he is outta jail..
I think it's pretty doubtful it'll happen for a couple of years.

From what I can see, post Munir's term extension and the 26th amendment, Pakistan is effectively in a state of martial law with all branches of government UK under the control of the military. It serves them no purpose right now to have Imran out causing problems.

Maybe in a couple of years if the PDM government gets a bit big for it's boots and doesn't immediately offer Munir another term, they might be willing to release Imran Khan as a chaos agent to force the government's hand.

Imran granted bail in Toshakhana case but release unlikely

The Islamabad High Court (IHC) on Wednesday granted bail to former prime minister Imran Khan in the second Toshakhana case concerning the purchase of an expensive Bulgari jewellery set at a throwaway price.

However, Mr Khan is unlikely to be released from jail as he needs to secure bail in nearly two dozen other cases. Late in the night, Rawalpindi police arrested him on terrorism charges related to a September protest.

Justice Miangul Hassan Aurangzeb approved Mr Khan’s post-arrest bail against surety bonds worth Rs10 million, cautioning that any non-cooperation during trial proceedings could lead to the cancellation of the bail.

The decision came after detailed arguments from Mr Khan’s legal counsel and the Federal Investigation Agency (FIA) prosecution. The case pertains to allegations that Mr Khan retained state gifts, including a Bulgari jewellery set, by undervaluing them in violation of Toshakhana rules.

According to the FIA, the alleged undervaluation resulted in financial losses to the state while benefiting Mr Khan and his wife, Bushra Bibi.

Mr Khan’s counsel rejected the allegations, stressing that the gifts were acquired under the 2018 Toshakhana policy, with payments made in accordance with valuations by customs and appraisers. The defence argued that the appraiser, Sohaib Abbasi, was coerced into altering his statement to implicate Mr Khan.

The counsel further highlighted procedural flaws, such as a delay of over three years in filing the case and vague charges under Section 109 of PPC.

During the hearing, Justice Aurangzeb questioned the prosecution’s evidence, including the reliability of witness statements and the specifics of alleged threats.

He also criticised the PTI government’s policy of withholding Toshakhana details, remarking, “When we asked, the details were hidden. Transparency was deliberately avoided.”

The judge dismissed the prosecution’s argument that Mr Khan benefited financially through his wife, quipping, “My wife’s belongings are not mine — what kind of logic is this?”

Ultimately, the court granted bail, noting that the case required further inquiry. The trial will now proceed to determine the validity of the charges.

Imran’s challenges persist

Despite the bail order, Mr Khan remains in Adiala Jail as he faces about two dozen FIRs across Lahore, Rawalpindi and Islamabad. Sources said he must secure bail in at least eight cases in Lahore related to the May 9, 2023 violent protests.

The former PM also faces three new cases registered in Rawalpindi under anti-terrorism laws, linked to PTI protests on Sept 28 and Oct 5. These cases were filed at the Naseerabad, New Town and Taxila police stations.

Sources also said Mr Khan has been granted bail in five earlier cases concerning the May 9 riots, but has yet to submit the required bail bonds, raising questions about his legal team’s diligence. In Islamabad alone, Mr Khan faces 62 cases, requiring bail in at least 15 of them.

Case filed in Rawalpindi

Hours after the IHC granted bail to Mr Khan, the Rawalpindi police arrested him in connection with a new case registered at New Town Police Station on terrorism and other charges.

On late Wednesday evening, a police spokesperson said Mr Khan had been detained in a case filed on Sept 28. A team, led by SSP investigations, has been tasked with probing the matter.

A source said the police team investigated the PTI leader on Wednesday.

In the three FIRs regarding the protest, the police allege Mr Khan, while imprisoned in Adiala Jail, had called for a protest at Liaquat Bagh. In response, KP Chief Minister Ali Amin Gandapur and his supporters declared their intention to participate, leading to violent demonstrations.

A senior police officer said PTI leaders, including Mr Khan and Mr Gandapur, called for the protest despite a ban.

Rawalpindi police have registered six cases across five police stations — two with the City Police Station, and one each with New Town, Waris Khan, R.A. Bazar, and Civil Lines — against PTI members, including lawmakers and local leaders.

The charges include violations of the Anti-Terrorism Act, defying the government ban on public gatherings, obstructing police duty, damaging police vehicles and endangering public safety.

Four cases include provisions under Section 21(1) of the Anti-Terrorism Act. Mr Khan and Mr Gandapur have been formally named under Section 109 of the PPC for aiding and abetting these offences.

£190m case hearing

Earlier, an accountability court held a hearing on the £190 million reference at Adiala Jail. Mr Khan and Bushra Bibi have yet to submit responses to the questionnaires issued to them.

The court granted Bushra Bibi’s request for an exemption from court appearance on medical grounds and adjourned the hearing till Nov 22.

LHC rejects plea

Meanwhile, the Lahore High Court dismissed a plea by Imran Khan’s sister, Noreen Niazi, seeking bail for her brother in all cases against him in Punjab and Islamabad.

An assistant attorney general presented a report to the court, stating that 62 cases had been registered against Mr Khan by the Islamabad police. The report was submitted in response to her petition.

After going through the report, Ms Niazi’s counsel asked the court to grant bail to Mr Khan in all the cases. However, Justice Farooq Haider turned down the request, observing that bail petitions must be filed personally by the suspect.

Bushra Bibi gets transit bail from PHC until Dec 23

The Peshawar High Court approved transit bail for Bushra Bibi, spouse of former Prime Minister Imran Khan, in multiple cases until December 23.

Justice Waqar Ahmed presided over the hearing regarding her transit bail applications, while a separate two-member bench reviewed the details of her summons-related case.

During the proceedings, Bushra Bibi's counsel informed the court that she had filed for transit bail in 27 cases to ensure her appearance in relevant courts. The Additional Attorney General argued that she should directly approach the courts handling these cases. Responding to this, Justice Waqar Ahmed remarked, “We grant transit bail to facilitate her appearance in the appropriate courts.”

The petitioner’s lawyer requested an extension, citing over 50 cases requiring appearances. However, Justice Waqar Ahmed declined, pointing out the limited time available due to the upcoming winter vacations.

Meanwhile, a separate bench, comprising Justice SM Atiq Shah, addressed the admissibility of a petition linked to the summoning of Bushra Bibi. Justice Shah allowed time for the petitioner’s lawyer to prepare and deferred the hearing to the end of the court's schedule.

The court assured that Bushra Bibi’s presence would only be required when necessary, emphasizing adherence to due process and timely resolution of legal proceedings.

A special court on Thursday formally indicted Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife Bushra Bibi in the Toshakhana 2.0 case.

Both Imran Khan, the former prime minister, and Bushra Bibi appeared in court before Judge Shahrukh Arjumand, who conducted the hearing at Adiala Jail, Express News reported.

Judge Shah Rukh Arjumand read the charges aloud to the defendants, marking the official start of the legal proceedings. The hearing was adjourned following the indictment.

Imran Khan is currently serving time in Adiala Jail on multiple charges, including the infamous "Iddat case," which led to his initial arrest.

He has since faced multiple detentions and releases related to different cases. Bushra Bibi, on the other hand, was acquitted in the Iddat case and has since been granted bail in other cases.

In another development, PTI leaders Shah Mehmood Qureshi and Yasmin Rashid were also indicted today.

They face charges related to their involvement in the May 9 unrest in Lahore, where they were accused of orchestrating acts of arson and violence.

The Lahore Anti-Terrorism Court indicted them for their alleged role in the destruction at Shadman Police Station.

The indictment of high-profile political figures, including Imran Khan and his inner circle, adds further complexity to the ongoing legal battles surrounding the PTI leadership. The cases are expected to shape the political landscape as Pakistan heads towards upcoming elections.

Toshakhana 2.0 case

Bushra Bibi received the Bulgari jewelry set during a visit to Saudi Arabia from May 7 to 10, 2021.

The jewelry set included a ring, a bracelet, a necklace, and a pair of earrings.

During the investigation for the reference, it was found that Imran Khan and Bushra Bibi illegally retained the Bulgari jewelry set.

On May 18, 2021, the Deputy Military Secretary informed the Section Officer of Toshakhana to assess and declare the value of the jewelry set, but it was not deposited.

According to the reference, Bulgari had sold the necklace to the Saudi Arabian franchise Solugent Trading on May 25, 2018, for 300,000 euros and the earrings for 80,000 euros.

However, the prices of the bracelet and ring were not available. On May 28, 2021, the total value of the Bulgari jewelry set was approximately Rs75,661,600 .

The necklace was valued at 56,496,000 Rupees, and the earrings at Rs15,065,600.

According to Toshakhana rules, the jewelry set's value, after paying 50 percent, should be Rs35,765,800.

However, the NAB reference added that by undervaluing the jewelry set, a loss of Rs32,851,300 was incurred to the national treasury.

The PTI founder, along with Bushra Bibi, has violated Section 9 and Subsections 3, 4, 6, and 12 of the NAB Ordinance 1999.

£190m case: Court to ‘not announce’ verdict against PTI founder tomorrow

According to sources, the court will not announce its verdict tomorrow and the court staff has informed the PTI lawyers about the development.

The Accountability Court will announce a new date for the verdict in the 190 million pound reference tomorrow.

Earlier, an accountability court in Islamabad reserved its verdict in £190 million reference against Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife Bushra Bibi.

Accountability court judge Nasir Javed Rana conducted the hearing at Adiala Jail. The court reserved the verdict of the case after the prosecution team and defence lawyers completed their arguments.

The verdict of the case will be announced on December.

The National Accountability Bureau (NAB) had launched an investigation against Imran Khan and his wife and others for the alleged gain of hundreds of canals of land in the name of Al Qadir University Trust, which reportedly caused a loss of 190 million pounds to the national exchequer.

As per the charges, the former prime minister and others accused allegedly adjusted Rs50 billion — 190 million pounds at the time — sent by Britain’s National Crime Agency (NCA) to the government.

The NAB filed a corruption reference against Imran and seven others, including his wife, in connection with the Al-Qadir University.

The PTI chief registered Trust for Al-Qadir University Project on Dec 26, 2019.
