MQM founder Altaf Hussain arrested in London

LONDON: Muttahida Qaumi Movement (MQM) founder Altaf Hussain was arrested by Scotland Yard in an early morning raid on Tuesday.

Credible security sources have revealed to Geo News that Altaf Hussain was arrested this morning and taken to a local police station. 15 officers took part in a dawn raid at his north London home.

A forensic unit of Scotland Yard is searching the residence of Altaf Hussain, the MQM office and International Secretariat.

Meanwhile, MQM sources have confirmed that Altaf Hussain was arrested.

It’s believed that Altaf Hussain has been arrested in relation to the hate speech of 2016 in which he had urged his followers to take law into their own hands. Also, Altaf Hussain had issues violent threats to former DG Rangers Major General Bilal Akbar.

In 2017, Scotland Yard had sent a letter under ‘Mutual Legal Assistance’ to Pakistan in relation to two speeches made by the MQM founder on March 11, 2015 and August 22, 2016.

Both the Crown Prosecution Service and Metropolitan Police Services had confirmed to Geo News that a criminal investigation had started against Altaf Hussain.

"The man, who is aged in his 60s, was arrested at an address in north west London. He was arrested on suspicion of intentionally encouraging or assisting offences contrary to Section 44 of the Serious Crime Act 2007."

Section 44 'Intentionally encouraging or assisting an offence':

(1) A person commits an offence if —- (a) he does an act capable of encouraging or assisting the commission of an offence; and- (b) he intends to encourage or assist its commission.

(2) But he is not to be taken to have intended to encourage or assist the commission of an offence merely because such encouragement or assistance was a foreseeable consequence of his act.

"He was detained under PACE [Police and Criminal Evidence Act 1984] and taken to a south London police station, where he currently remains in police custody," added the statement.

The Police and Criminal Evidence Act 1984 codes of practice regulate police powers and protect public rights.

"As part of the investigation, officers are carrying out a search at the north west London address. Detectives are also searching a separate commercial address in north west London.

"The investigation, which is being led by officers from the Met's Counter Terrorism Command, is focused on a speech broadcast in August 2016 by an individual associated with the MQM movement in Pakistan as well as other speeches previously broadcast by the same person," said the statement.

Over 20 identical FIRs pertaining to hate speech were registered against Hussain and several other leaders and workers of the MQM's London and Pakistan factions.

The London Met Police which began investigating Hussain's 2016 speech visited Islamabad in April this year to collect evidence and interview key witnesses.

The arrest is in relation to a hate speech made by Hussain on August 22, 2016.

Hours after Hussain delivered the incendiary speech, MQM workers had attacked the ARY News office in Karachi. Shortly after, the Rangers had detained a handful of senior MQM leaders overnight.

In the days that followed, the Karachi wing of the party led by Farooq Sattar distanced itself from Hussain and the London wing.

Perspective: The MQM crisis

Parts of Hussain's speech that went viral on social media minutes after the violence broke out in Karachi showed that while addressing the MQM workers protesting outside the Karachi Press Club against “enforced disappearances and extrajudicial killings of workers”, the MQM supremo had not only raised slogans against Pakistan but also called the country “a cancer for entire world”.

“Pakistan is cancer for entire world,” he had said. “Pakistan is headache for the entire world. Pakistan is the epicentre of terrorism for the entire world. Who says long live Pakistan...it’s down with Pakistan.”

The minister for interior at the time had sought assistance from British authorities, and asked them to take action against Hussain for “inciting people of Pakistan to violence”.

On August 23, Hussain apologised to the then army chief, Gen Raheel Sharif, and the Rangers director general for his vitriolic speech.

“From the depth of heart, I beg pardon from my remarks against Pakistan, the establishment including Gen Raheel Sharif and DG Rangers,” he said in a statement shared on Twitter by MQM spokesperson Wasay Jalil.

“I was under severe mental stress over extra-judicial arrests and precarious condition of my workers sitting at the hunger strike camp.”

UK does not allow deportation to a country which has the death penalty. This is a major reason why everyone runs away to London and Pakistan cannot get them back.

There was news a while back that if Pakistan gives assurance that the death penalty will not be administered then something might be worked. But that falls outside of the governments jurisdiction. The only way to get him back may be an assurance that a presidential pardon will be given in case of the death penalty.

In response to the correspondence related to sharing of evidence in the murder case, the FIA’s special prosecutor Khawaja Imtiaz said, the UK Central Authority has explained UK’s long-standing opposition to the death penalty and its corollary refusal to extradite or share evidence in cases in which the death penalty could be exercised. The prosecutor has apprised the ATC that the UK Central Authority has said that the European laws did not permit sharing of evidence with a country where the offence was punishable by death.

They refuse to share evidence if it may result in a death penalty. There was also an incident some time back where they would not deport a convicted terrorist because he would be given the death penalty.

With the US it may be a case of deportation in cases which do not result in capital punishment. And I am not sure but I think that not every US state has the death penalty. There's also the case of the US having more diplomatic clout.

Pakistan has found it hard to get back prisoners even in cases where the death penalty should not apply because the accused claim they will be executed under made up charges or blasphemy.

UK to US deportation are almost always on federal charges like terrorism, in which case state laws are superseded and under federal laws death penalty is still valid .

A few months ago the UK and Pak officials met to strengthen the extradition treaty between both nations. Sure some paid human rights lawyers will try to stop this on his behalf but there is nothing to say this cirminal cannot be deported under these new agreements.

As long as they promise not to use the death penalty,he can be extradited. The reality is he won't be extradited as he has been part of the British intelligence operations for over 2 decades, but he will end up with some fine.

- I ve lived through army operations in Karachi during 90s and witnessed discrimination and extrajudicial killings, torture and Abduction by Rangers (i.e Army) and the Police on ethnical basis.
- Not a single Ranger personnel or Police Officer was ever charged or trialled in the court.
- Still to this day Establishment (army) keeps on coming up fictional stories like discovery of Large ammunition in Water tank of a house in Azizabad. Many other goofy stories like these.

After all this the Media houses (incl. ARY) act as mouth pieces of the Establishment and never dare to speak against their Masters.

So all I am saying is that this partiality and misinformation by ARY is “EQUALLY” bad (or even worse than) what Altaf Hussain said.

All true , If you want to kill an ideology , kill the root cause(discrimination) of the issue .Karachi has always been treated as a paraya by the establishment and natives . Not sure what the situation is now but when i lived in Pakistan it was pretty damn evident .

Muttahida Qaumi Movement (MQM) founder Altaf Hussain was released on bail on Wednesday after remaining in the custody of the London Metropolitan Police for a day.

The Met Police announced Hussain's arrest on Tuesday, saying that an MQM-linked man in his 60s had been arrested in northwest London on suspicion of intentionally encouraging or assisting offences contrary to Section 44 of the Serious Crime Act 2007.

A statement by the Met Police today, without naming Hussain, said that "a man [...] associated with the MQM in Pakistan has today, Wednesday, 12 June been bailed to return to a police station in mid-July".

"As part of the investigation, officers carried out a search at the north west London address and at a separate commercial address in north west London. Both these searches are now complete," the Met police said in their statement.

"The investigation, which is being led by officers from the Met's Counter Terrorism Command, is focused on a speech broadcast in August 2016 by an individual associated with the MQM movement in Pakistan as well as other speeches previously broadcast by the same person," the statement added.

The Met Police also said that officers have been "liaising with Pakistani authorities in relation to [their] ongoing enquiries" and that the investigation shall continue.

Police officials told DawnNewsTV that Hussain had been released due to "insufficient evidence to charge him with a crime". Sources within the party also confirmed the development.

A number of chanting MQM supporters gathered outside the Southwark Police Station to show support for Hussain following reports that the party founder had secured bail.

The sources said that the case against Hussain "was still open and he could be called again [by police] at any time".

Muttahida Qaumi Movement (MQM) founder Altaf Hussain was on Thursday charged with a terrorism offence in a case related to his incendiary speech relayed from the United Kingdom to his followers in Pakistan in 2016.

Hussain had earlier arrived at a London police station after his bail expired.

"Altaf Hussain [...], of Abbey View, Mill Hill, NW7, was charged under section 1(2) of the Terrorism Act (TACT) 2006 with encouraging terrorism," the Met Police said in a statement on its website.

The charge as stated by the UK police is that Hussain "On 22 August 2016 published a speech to crowds gathered in Karachi, Pakistan which were likely to be understood by some or all of the members of the public to whom they were published as a direct or indirect encouragement to them to the commission, preparation or instigation of acts of terrorism and at the time he published them, intended them to be so encouraged, or was reckless as to whether they would be so encouraged."

Hussain reached the Metropolitan Police Southwark Police Station, accompanied by a handful of London-based supporters.

This is his third appearance at the station in connection with the case.

On September 12, the MQM chief was grilled for five hours at the same police station in connection with the case. He was released with an extension in his bail.

The MQM founder was arrested by the Met Police on June 11 as part of the investigation into his alleged hate speeches. However, he was released on bail a day later by the British authorities without filing charges relating to the probe.

Hussain had been arrested on suspicion of intentionally encouraging or assisting offences contrary to Section 44 (intentionally encouraging or assisting an offence) of the Serious Crime Act, 2007.

The investigation that led to his arrest in June was led by the Met’s counterterrorism command, a statement released at the time said.

The Met said the inquiry was "focused on a speech broadcast in August 2016 by an individual associated with the MQM movement in Pakistan as well as other speeches previously broadcast by the same person".

Officers in June had searched two addresses linked to the MQM founder in north-west London. Police had also said that its officers had been liaising with authorities in Pakistan in relation to their ongoing inquiry.

Altaf Hussain, the self-exiled founder of one of Pakistan's biggest political parties, has been charged with a terrorism offence in the UK.

The Metropolitan Police confirmed that the 66-year-old had been charged in connection with a speech he made to supporters in Pakistan in August 2016.

Mr Hussain requested asylum in the 1990s and later gained UK citizenship.

Despite a split in the MQM, he still wields considerable influence in the party and its main power base, Karachi.

A statement from the Metropolitan Police said that the speech had been relayed from London to crowds gathered in Karachi on 22 August 2016.

Mr Hussain was arrested at his address in north London on 11 June. He is due to appear in court later on 10 October.

Correspondents say Mr Hussain is a maverick politician who has encouraged a personality cult to build up around him.

The Muttahida Qaumi Movement (MQM) has dominated politics in Karachi for three decades because of its support in the densely populated working class neighbourhoods of Urdu-speaking Muhajirs, descendants of Muslims who migrated from India when Pakistan was created in 1947.

From his base in London, Mr Hussain would address supporters of his MQM party in Pakistan's biggest city via telephone. His messages would be relayed to crowds by loudspeaker.

The Pakistani authorities have repeatedly demanded action be taken against him - but his supporters have always maintained his innocence.

Mark my words that nothing will come out of this. AH will again be released.

Eh? Ofcourse he will be released on bail, there is no reason to keep him in for remand. But he will have to go through a trial now. A trial where he can't intimidate, threaten or harass the judiciary.
 
The bail for Muttahida Qaumi Movement (MQM) founder Altaf Hussain, in the incitement to violence case against him, was extended on Friday after he appeared before a judge via video link at London’s Central Criminal Court.

A trial date was also set today; a preliminary hearing will be held on March 20, 2020 and the trial will begin on June 1.

Hussain appeared before Justice Sweeney via video link at the crown court famously known as Old Bailey, after a Magistrates court on October 10 passed his case here for trial. It is not uncommon for a hearing of this nature to be conducted via video link. Courts in England may opt for prisoner video link (PVL) to save costs, for security measures or at the request of a lawyer.

On October 11, Hussain was formally charged by the Crown Prosecution Service under Section 1(2) of the Terrorism Act 2006 for encouraging terrorism during a speech he made in August 2016. If convicted, he could face a maximum prison sentence of 15 years along with a fine.

The court last month had granted him bail based on conditions, which include restrictions to broadcasting speeches, a curfew which limits his movements outside his residence, a warning against application for a travel permit and the custody of his passport to police.

The conditions will remain in effect while he is on bail.

This is the first time the MQM supremo has been charged with any offence in the United Kingdom, where he has been living in self-imposed exile since 1991. The move comes as a blow to the party, which has maintained that Hussain is innocent and that the allegations against him are fabricated.

2016 speech and investigation
On Aug 22, 2016, hours after Hussain had delivered the incendiary speech, MQM workers had attacked the ARY News office in Kara*chi. Shortly after, the Rangers had detained a handful of senior MQM leaders overnight.

While addressing the MQM workers protesting outside the Karachi Press Club against “enforced disappearances and extrajudicial killings of workers”, the MQM supremo had not only raised slogans against ******tan but also called the country “a cancer for entire world”.

The speech allegedly incited the supporters of opposition politician Hussain to attack media organisations. Hussain denied encouraging terrorism over Skype when the charge was put to him.

An Islamabad anti-terrorism court (ATC) on Thursday ruled that Muttahida Qaumi Movement (MQM) founder Altaf Hussain ordered the killing of the party's senior leader Dr Imran Farooq, who was was stabbed to death outside his home in London in September 2010.

According to Judge Shahrukh Arjumand, during the trial of three arrested accused it was "proved that Altaf Hussain ordered the killing of Dr Imran Farooq".

The court handed life imprisonment and imposed a fine of Rs2 million on three men — Shamim Khalid, Syed Mohsin Ali and Moazzam Ali — and directed them to pay Rs1m each to the deceased doctor's family.

In its judgement, a copy of which is available with Dawn.com, the court said that "it is expected from governments of Pakistan and UK that absconders [MQM founder Altaf Hussain, Iftikhar Hussain, Mohammad Anwar and Kashif Kamran] will be traced, arrested and brought before court as soon as possible."

The court ruled that two senior party leaders based in London "conveyed Hussain's orders to the relevant people in Pakistan". The court said it had found that accused Moazzam Ali, another senior member working at Nine Zero (the headquarters of MQM in Karachi) and accused Khalid Shamim engaged accused Syed Mohsin Ali and Kashif Khan Kamran to execute Farooq.

"The two executors were properly facilitated who went with the sole purpose to London for committing the murder and as per pre-planned conspiracy, an innocent person was brutally murdered.

"The act of abettors and executors was preconceived with a design to intimidate and overawe the public in general and workers of MQM in particular so that in future no one can raise voice against Altaf Hussain, the leader of MQM," the judgement stated.

"The motive thus for murdering Imran Farooq upon the orders of Altaf Hussain and other senior [MQM] leadership is proved because of his [Imran Farooq's] strong position and services in the party."

The court observed that Dr Farooq's notes, written and signed by him in 2008, showed that he feared he would be killed on the pretext of trying to become number one in the MQM. "Existence of that threat also figures in the two confessional statements made by accused and further more Khalid Shamim while directly referring to a conversation with his leader Altaf Hussain states that Altaf Hussain told him that no one can be his number 2, 3 or 1 ½ what to say of number one."

Joint investigation by two countries
The judgement termed the case "historical in nature" as an agreement was made between two sovereign countries for sharing documentary evidence.

The British High Commissioner to Pakistan Dr Christian Turner said that the conviction "marked a team effort between law agencies in the UK and Pakistan working together to get justice for the murder of Dr Imran Farooq".

A statement from the British High Commission said that the conviction came about after a "ground-breaking piece of collaboration" between the two countries, which allowed evidence gathered by the Metropolitan Police to be shared with Pakistani prosecutors and be presented as part of their case and used in the successful prosecution of Mohsin Ali Syed.

The trial proceedings in the case concluded on May 22. The proceedings had been at a standstill since last year as the prosecution case was stuck up because of non-availability of evidence.

In 2018, the Islamabad High Court had directed the ATC to conclude the much-delayed trial by October 2018. However, the prosecution of the Federal Investigation Agency repeatedly requested the court for extension of the deadline since the British government was reluctant to share evidence related to the murder fearing that the accused might get death sentence if convicted.

Two suspects in the case — Shamim and Mohsin Ali — recorded their confessional statements before a magistrate, saying Dr Farooq was killed because he was a "potent threat to the leadership of the MQM".

However, they later backtracked from their confessional statements, saying they had recorded the previous statements under coercion.

Farooq, a senior leader of the MQM, was murdered outside his home in London in 2010.

Who was Imran Farooq?

Dr Imran Farooq is considered as one of the key figures who laid the foundation for the All Pakistan Mohajir Students' Organisation (APMSO), which eventually turned out to be a forerunner of the MQM.

During the early 1980s, the APMSO was converted into a fully fledged political party to advocate the cause of the Urdu-speaking popuce, mainly in Karachi and other parts of urban Sindh.

With Altaf Hussain as its leader, the bespectacled Farooq was appointed secretary general of the party. He was also regarded as one of the main ideologues and the brain behind education of the party cadre.

When in 1992 Hussain went into self-imposed exile in the wake of a military crackdown, Farooq went underground in Karachi, running the party from hiding. Although he was declared absconder by the then government, he continued to dodge the authorities.

Eventually he managed to slip out of the country on a fake passport and under an assumed name. After arriving in London, he applied for political asylum.

In the initial years he was one of the main players who helped Hussain oversee the party's restructuring from London.

However, differences emerged a few years later, sending Farooq into obscurity. Since then he had been living the life of a recluse, with no role in party affairs.

In 2015, Altaf Hussain was also formally booked in Farooq's murder case.

Hussain is also facing terrorism charges in Britain, which are related to an incendiary speech relayed from UK to his followers in Pakistan on August 22, 2016. He was charged in October, 2019.

ISLAMABAD (Reuters) - A Pakistani court on Thursday sentenced three men to life in imprison for their part in the assassination of a Pakistani political leader who was stabbed to death in London in 2010, a government prosecutor said.

Imran Farooq, 50, was a founding member of the Muttahida Qaumi Movement (MQM) but had moved to London and had not been active in the party for about two years. He was on his way home from work in north London when he was attacked.

The three accused were members of the party. Their motives were unclear.

Besides their life sentences, the three were each fined 1 million Pakistani rupees ($6,050), the prosecutor, Khawaja Mohammad Imtiaz, told reporters.

Britain gave Pakistan legal assistance, sharing evidence and having its officers testify at the trial, according Toby Cadman, counsel to a Pakistani government barrister, Toby Cadman.

Imtiaz said it was first trial of its kind in Pakistan. “There are hardly any examples in the world that an offence is committed in one country and the trial is conducted in another,” he said.

Farooq’s death marked the start of cracks in the leadership of the MQM. The ethnic party, which held sway for decades in Pakistan’s commercial capital, Karachi, later split into several factions.
 
An Anti-Terrorism Court (ATC) in Islamabad handed life imprisonment to three accused in the Imran Farooq murder case on Thursday.

The judgment was read by ATC Judge Shahrukh Arjumand as the accused appeared before the court through a video link to attend the hearing.

“The prosecution has succeeded in proving the case against all three of you,” remarked the judge during today’s hearing.

The accused, Khalid Shamim, Mohsin Ali Syed and Moazzam Ali had been in Adiala jail ever since they were arrested. Their sentences will run concurrently and their time already spent in jail will count towards their sentence, according to the detailed verdict issued.

The court ordered the sentenced individuals to pay Rs1 million each to the heirs of the murdered MQM leader.

It also issued perpetual arrest warrants for MQM founder Altaf Hussain, Iftikhar Hussain, Muhammad Anwar and Muhammad Kashif Khan Kamran.

Following the announcement of the verdict, the slain MQM leader’s wife, Shumaila Farooq said that she won't even wish for her enemies to go through such tough times as she had.

She said that "strength" and "patience" are two important virtues to live by and she accepts the court's decision.

'MQM founder gave the orders'

The court in its detailed order stated that it had been proved that the "MQM founder gave the orders" to murder Farooq.

“Two senior leaders of MQM-London conveyed the orders to Pakistan,“ said the court in its 39-page order. It added that Moazzam Ali selected the boys to carry out the murder from the then MQM headquarter, Nine-Zero.

“Mohsin Ali and Kashif Khan Kamran were selected for murdering Imran Farooq,” said the order, adding that both were taken to London and were provided support to carry out the crime.

According to the judgment, the sole purpose of the murder ordered by the MQM founder was to remove the resistance being faced by him from within the party ranks. It adds that the statement provided by the convicts to the magistrate and the evidence presented had a clear link.

“The aim of the murder was to ensure that no one raises their voice against the party founder,” said the order.

The order said that those who murder innocent people under an elaborate plot are deserving of exemplary punishment. Under the Pakistan Penal Code, the death sentence is applicable for such a crime but an amendment in the Code does not allow death sentence to be given in a case where the evidence has been gathered in a different country — Britain in this case.

Imran Farooq murder case

The ATC announced the reserved judgment today (Thursday) in the murder case of the MQM leader Dr Imran Farooq, who was killed nine years ago in London.

The judgment was reserved on May 21 after the completion of the trial. During the hearings, 29 witnesses recorded their statements in the case.

In February, a team of Scotland Yard officers had arrived in Islamabad for a week to facilitate the trial taking place in both London and Pakistan after the UK and Pakistan decided to cooperate. Subsequently, Britain sent the entire murder case file to Pakistan for the trial.

Last year, Pakistan’s lawyer in the UK for the murder case, Toby Cadman, said Britain handed “compelling evidence” to Islamabad.

The MQM leader’s wife, Shumaila Farooq, was also interviewed from London during the lengthy trial. She read out her statement on what happened on September 16, 2010, when her husband was stabbed to death outside his home in Edgware.

Every few years the Pakistani establishment keep on coming up with these verdicts but it has NO impact what so ever. UK judiciary is the only one that matters in this case.
