ISLAMABAD: The Supreme Court on Friday unanimously disqualified Prime Minister Nawaz Sharif from his post after an investigative panel alleged his family’s wealth was far above their earnings in a scathing corruption report.

The apex court has ordered NAB to complete investigation in Panamagate case within six weeks. The judges reserved that the premier had been dishonest to parliament and the courts, hence could not continue in office.

SC judges arrived in court room 1 after a brief consultation in the chambers, while a large number of Pakistan Tehreek-e-Insaf and Pakistan Muslim League-Nawaz workers converged outside the SC.

The legal proceedings against Sharif have captivated the country, where politicians are seldom subjected to the kind of scrutiny undergone by the premier.

Supreme Court to rule on PM Nawaz’s fate

PM Nawaz, 67, denied wrongdoing and had warned his ouster would destabilise Pakistan at a time when the economy was rebounding after a decade of political and security chaos.

The premier had alleged a conspiracy against him, although he had not named anyone. His allies, however, had privately spoken of elements in the judiciary and the military, with whom PM Nawaz has strained relations, acting against him. The army denied any involvement.

The Supreme Court started reading its verdict at 1130 local time. There was a heavy police and army presence around the court in the hours before the ruling.

“As long as the Supreme Court stays within the law, we feel very good and confident that nothing negative will happen to the prime minister,” Miftah Ismail, a state minister and senior official in Sharif’s ruling PML-N party, told Reuters.

“If the Supreme Court takes a flight away from strict interpretation of the law, then anything can happen.”

Some analysts said the court may also refer PM Nawaz to the electoral commission to see whether he is fit to stand again as premier. Several cabinet ministers, including PM Nawaz’s closest allies, said the ruling party would respect the SC verdict.

PM Nawaz, the son of an industrialist, saw both of his first two stints in power cut short in the 1990s, including by a military coup by General Pervez Musharraf in 1999.

“Panama Papers” fallout

The SC agreed last year to investigate the Sharif family’s wealth after the opposition threatened protests after the leaking of the “Panama Papers”, which revealed his family had bought posh London apartments through offshore companies.

The SC ruled in April there was insufficient evidence to remove Sharif from office – by a 2-3 verdict – but it ordered a probe by an investigative panel that included members of the military intelligence agencies.

The Joint Investigation Team (JIT) this month returned its findings in a 254-report that said Sharif’s family assets do not match their earnings. The panel also accused his children, including heir apparent Maryam, of signing forged documents to obscure ownership of the London flats.

Michael Kugelman, a South Asia specialist at the Woodrow Wilson Center, said PM Nawaz’s ouster would leave Pakistan in a “precarious” position but added that the country has a long history of dealing with such disqualifications. The SC in 2012 disqualified then-Prime Minister Yusuf Raza Gilani over a contempt of court case.

“This wouldn’t exactly be uncharted territory for Pakistan, because we’ve seen this movie before,” he said.

Wow, just wow! I´m truly overwhelmed. A long way to go, but this a landmark decision by the court and possibly the biggest verdict ever in the history of Pakistan. Congratulations Imran Khan, your political career and your ambition for a corruption-free country has got a rocket-like lift. A lot, a lot of work to go of course. A step in the right direction.

As Geo News is reporting, it´s a 5-0 verdict, meaning the three judges that decided for JIT back then, they too were convinced for his disqualification.

And the most jolting bit for PML-N, Nawaz Shareef has been disqualified for lifetime. He cannot ever again contest elections.

The Supreme Court on Friday disqualified Prime Minister Nawaz Sharif from holding public office in a landmark decision on the Panama Papers case.

This is the third time the prime minister has been unable to complete his term in the chief executive's office. It is unclear at the moment who will be appointed to take over the post till the next general elections, which are scheduled for 2018.

The Election Commission of Pakistan will have to de-notify the prime minister to fulfill the technicalities of implementing the order.

Justice Ejaz Afzal Khan, who had headed the apex court's implementation bench following its April 20 order on the Panama Papers case, announced that the larger bench had unanimously deemed PM Sharif from holding office and would also order an accountability court to open a case against him.

The judgement was announced shortly after 12:00pm.

Justice Khan said the bench had recommended that all material collected by the joint investigation team (JIT) tasked with probing the Sharif family's financial dealings would be sent to an accountability court within six weeks.

The bench said that on the basis of this information, cases would be opened against Finance Minister Ishaq Dar; MNA Captain Muhammad Safdar; Maryam, Hassan and Hussain Nawaz; as well as the premier.

A judgement on these references should be announced within 30 days, he said.

One judge will oversee the implementation of this order.

The judgement was unanimous.

The prime minister was disqualified from holding his office as the judges ruled that he had been dishonest to parliament and the courts and could not be deemed fit for his office.

Finance Minister Ishaq Dar and Captain Safdar, who is an MNA, also stood disqualified from office, Justice Khan said.

The lead up
From Friday morning, all eyes were on Courtroom No. 1 of the Supreme Court in Islamabad, where a five-judge bench was set to announce the much-awaited verdict on the Panama Papers case at 11:30am. The proceedings started around half an hour later.

The original five-member bench of the Supreme Court which heard the Panama Papers case issued the final verdict. Justices Asif Saeed Khosa, Ejaz Afzal Khan, Gulzar Ahmed, Sheikh Azmat Saeed, Ijazul Ahsan were present for the hearing.

According to media reports, the courtroom was filled to capacity as prominent politicians, lawyers and journalists crowded the room to hear the judges decide Prime Minister Nawaz Sharif's fate.

The twin cities of Islamabad and Rawalpindi had been on high alert in anticipation of the SC verdict.

The Red Zone had also been partially sealed and people were only being allowed inside after undergoing identification and strict security checks.


Rangers and Frontier Constabulary personnel had been deployed at the Supreme Court and the Red Zone to assist the police.

Speculations before SC judgement
Over the last few days, the entire country had been awaiting the apex court's verdict with bated breath. Gossip, speculation and rumours had been rife over when the final verdict would be announced and what conclusion the judges would arrive at. The most important question of all remained whether the prime minister would be unseated or not.

On Thursday evening, the Supreme Court office had put all speculation to rest when it issued a supplementary cause list heralding the announcement of the judgement on Friday.

On the announcement that the larger bench would deliver the judgement, legal observers took the view that the earlier minority judgement, which recommended sending the prime minister packing, may become a majority view in case even one of the three majority judges ruled against the prime minister.

The court could also rule that there is still not enough evidence to topple Sharif, and call for a further investigation.

April 20 order and JIT investigation
The April 20 judgement issued by the larger bench in the Panama Papers case had been split 3-2 among the five judges, with two dissenting notes from Justice Asif Saeed Khosa and Justice Gulzar Ahmed. Justice Ejaz Afzal authored the majority opinion in the 540-page judgement.

The two judges who ruled against PM Nawaz Sharif had said he should be disqualified as he could not be considered 'honest' and 'truthful' (ameen and sadiq), whereas the other three were in favour of forming a joint investigation team (JIT) to definitively answer the question of whether the allegations against the prime minister were true or not.

The court had further said that: "upon receipt of the reports, periodic or final of the JIT, as the case may be, the matter of disqualification of respondent No. 1 [Nawaz Sharif] shall be considered. If found necessary for passing an appropriate order in this behalf, [Nawaz Sharif or any other person may be summoned and examined."

A special bench of the Supreme Court was subsequently constituted to examine the case under Section 184/3 of the Constitution. The bench comprised the three judges who had prevailed.

The Sup*reme Court had on May 6 formed the JIT, putting a senior officer of the Federal Investigation Agency (FIA) in charge.

After considering the background and antecedents of the officer, FIA’s Additional Director General Wajid Zia, a grade 21 officer, was appointed head of the probe team.

Amer Aziz of the State Bank of Pakistan, Executive Director of the Securities and Exchange Commission of Pakistan Bilal Rasool, National Accountability Bureau Director Irfan Naeem Mangi, Brig Muha*mmad Nauman Saeed of Inter-Services Intelligence and Brig Kamran Khurshid of the Military Intelligence were appointed as the remaining members of the team.

The six-member JIT's damning report, submitted after a 60-day investigation that sought answers to 13 questions raised by the Supreme Court's larger bench, had maintained that Prime Minister’s family owned assets beyond its known sources of income. It declared that both Hussain and Hassan Nawaz were used as proxies to build family assets.

Consequently, the six-man JIT concluded that it was compelled to refer to sections 9(a)(v) and 14(c) of the National Accountability Ordinance (NAO) 1999, which deal with corruption and corrupt practices, though such charges are yet to be proven in an accountability court.

The JIT report also highlighted Articles 122, 117, 129 and other sections of the Qanoon-i-Shahadat Order 1984 (Law of Evidence), which places the burden of disproving the allegations on the person facing accusations.

The JIT pointed out failure on the part of the Sharifs to produce the required information that would confirm their “known sources of income”, saying that prima facie, it amounted to saying that they were not able to reconcile their assets with their means of income.

The prime minister's daughter, Maryam Nawaz, had on the same evening issued a strongly-worded statement on behalf of the PML-N, saying:

"JIT report REJECTED. Every contradiction will not only be contested but decimated in SC. NOT a penny of public exchequer involved: PMLN."

Her tweet followed a press conference conducted by four senior PML-N leaders, who had taken turns to criticise the JIT report as 'serving Imran Khan's agenda'.

The Sharif family's legal team's strategy in subsequent hearings had focused on discrediting the report, the evidence collected and the means used to do so, and raising questions about the impartiality and capability of the six men who had comprised the JIT.

Unless you have been sleeping under a rock, which by the looks of it you have, the front runners were Asif and Sadiq. Asif now probably ruled out as he ran to US. Shahbaz was never in the running, try listening to people who talk about our politics instead of posting drivel and calling other people naive.

Shahbaz has a criminal reference, so does entire Sharif family. They're done.

There is confusion about the period of disqualification of Nawaz Sharif. It may be for 10 years or for life.

Again you misunderstand my point. I know NS is done now, much like AAZ is publicly unelectable. But both will still wield huge power behind the scenes using patsies and puppets.

Look at how much AAZ stole in his five years. Look at the promises the MLN made about punishing him if they came into power. And look at the inaction against him subsequently.

Nothing will change unless these cancerous families are removed en masse once and for all.

Have to confirm but i think ECP rules says you can't be head of a party if you can't stand in elections. So if that's true NS isn't going to chair the meetings openly
 
I hope that someone files petition against Sindh provincial govt and whole PPP. They need to be disqualified and jailed for life.

He got exposed 2 days ago when his Iqama (work permit) of UAE was leaked. He was getting salary from UAE while being defence minister of Pak. 2 other federal ministers also had iqamas lol just like their PM Nawaz had an iqama of UAE
 
the sad part is that NS supporters are still defending him like if he was their family member.

I would've given up my support even if he was a family member..

Because all of them have iqamas, which are residence/job card holders for people in Saudi/UAE. And all of them have them while they're ministers of our country. PM, Finance minister, Defence Minister, Minister of Planning and Development...it goes on and on. They knew it was their turn after Nawaz.

Our finance minister worked as an advisor to an Arab government....WHILE BEING in power.

I hope its the end for them forever. The reason for India's progress is India's democracy, I hope this sets us to that path as well.

He renewed it last month! and it was valid till 2019. He is also federal minister of water and power and if i am not wrong the company in his Iqama was also related to power and there were some agreements so conflict of interest you know...

I am sure that will only divide the party and many will jump. PMLN is party of power not a typical nazryaati party like PPP

They were drawing salaries, but not working. Those iqamas were likely to run away and also to hide their dual nationalities, which is illegal. Eg all of them said on those documents they don't have diplomatic passports, when every minister does which is why the ticked the 'normal' passports box, because to get a diplomatic passport you have to hand your normal passport in. So people think they have dual nationalities, which won't be new. The last Interior minister had it, that is illegal. Also them working as advisors to other nations while knowing the goings and ins of our government as ministers is illegal and a massive national security risk.

Only UAE cooperated with us, Saudi Arabia and UK refused to.

Also I am reading judgement, seems he was dismissed also due to having an off-shore company which showed massive losses yet it was sending millions to Nawaz...i.e. laundered money. He could provide no money trail for it either!

I am not sure about the credibility part. Some people would still support PMLN after this. I was watching TV earlier and there were people protesting Supreme Court's decision. But from Judiciary's standpoint this was great. Hopefully PPP and PMLN will do some soul searching and become more compe

Nisar havent resigned yet... may be he thinks he will be the PM during this interim period until next elections..
