PCB's lawyer is minting money by fooling the PCB management. I am not a law student but the below-highlighted clause makes it very clear?

The PCB must do what it can to be compensated from the BCCI, strong case or not.
 
By reading that clause, I am 110% sure that PCB is not getting a single penny out of this. There is no question of compensation, so what the use of wasting millions on lawyers when no return is guaranteed?

This is not a legal clause it's a statement in a letter written by BCCI
 
By reading that clause, I am 110% sure that PCB is not getting a single penny out of this. There is no question of compensation, so what the use of wasting millions on lawyers when no return is guaranteed?

Important to fight for your rights and to send the message across to the BCCI that they are not going to let them continue to screw over the PCB financially.
 
PCB to approach ICC over compensation claim case against BCCI

Karachi: The Pakistan Cricket Board has decided to take its compensation claim case against the BCCI to the disputes resolution committee of the International Cricket Council.

An official source in the PCB told PTI that the Board Chairman Shaharyar Khan, Chairman of the Executive Committee, Najam Sethi and Chief Operating Officer Subhan Ahmad had held three separate meetings with the BCCI representatives last month in Birmingham and London.

"At two of the meetings, ICC chief executive Dave Richardson was also present while the third meeting held on the sidelines of the ICC executive board meeting also featured ICC Chairman Shashank Manohar," he said.

He said in all three meetings, the BCCI representatives had stuck to their gun that they can't play any bilateral series with Pakistan until their government gives clearance.

"They said that since their government was not giving clearance for a series with Pakistan because of the political and diplomatic situation between the two countries there was no question of paying any compensation to the PCB," the source said.

He said the PCB chairman had made it clear that the BCCI should have thought about this while signing the MoU with Pakistan in 2014.

"He said in the MoU, the BCCI had promised to play six bilateral series between 2015 and 2023 but had not played even one series as yet. The PCB chairman also made it clear that the PCB wanted a compensation of around 447 crore rupees from the BCCI for not playing bilateral cricket," he said.

The source said after the three meetings ended in a deadlock, the PCB had decided to now push through its legal case against the BCCI and would file a case with the ICC disputes resolution committee within a month.

"The BCCI had not responded to our notice of intent sent to them but they agreed to the meetings to find a solution and prevent the matter from going to the ICC disputes resolution committee. Unfortunately all meetings have ended in a deadlock despite the presence of ICC officials," he said.

The source said that during the meetings, the PCB noted that Pakistan had even gone to India on a short limited over series in the winter of 2012 as a goodwill gesture but the BCCI did not reciprocate at all.

"The fact is India has not played a bilateral series with us since 2007 and it has caused a lot of financial losses to Pakistan cricket," the source said.

In 2014, both boards signed a Memorandum of Understanding (MoU) which stated that the two arch-rivals will play six bilateral series between 2015-2023. According to the 2014 agreement, India was scheduled to play six series against Pakistan, four of them were going to be Pakistan’s home series. While the BCCI has repeatedly snubbed Pakistan’s request for resumption of ties, the PCB wants the Indian cricket board to honour its commitment under the MoU signed, which is subjected to clearance from the Government of India.

Pakistan was expected to generate bulk of revenue in these eight years from hosting India but since BCCI denied playing the series in wake of tensions between the two countries, the PCB is suffering huge financial losses due to it. Earlier in 2017, BCCI rejected the PCB’s demand for compensation for not honouring the MoU, saying that the MoU was not binding and also raised the issue of security problems in Pakistan. As reported by Express Tribune, in a meeting planned on July 28, PCB chairman Shaharyar Khan will take other board members into confidence about legal consultations.

The legal battle will take place in front of the International Cricket Council (ICC) dispute resolution committee. If the concerns of PCB will not be addressed then PCB might avail the option of not playing against India at ICC events. In May, the PCB had sent a legal notice to its Indian counterpart for failing to honour the MoU. The PCB had also demanded compensation close to USD 60 million from the BCCI for not honouring the MoU signed when N. Srinivasan was at the helm of affairs in the Indian board.

Despite not playing a full-fledged bilateral series against Pakistan since the 2008 terror attacks in Mumbai, the arch-rivals have played each other a number of times in the ICC events, with the most recent coming at the 2016 ICC T20 World Cup. Although, Pakistan toured India for a short series in December 2012.
