The middle-north Indian naxals who were in the news during the Congress (and who seem to have dropped off the news radar under Modi) wouldn't be around if successive governments haven't been trying to get rid of the tribals living on mining resources.

'Need To See Intent': Aaditya Thackeray On 'Free Kashmir' Poster Row


Mumbai: Mumbai Police has taken "serious cognisance" of a 'Free Kashmir' poster spotted at the Gateway of India last night during protests against Sunday's mob violence at Delhi's Jawaharlal Nehru University. The poster, held by a young woman who later identified herself as Mehak Mirza Prabhu, was among several held aloft by protesters who had gathered at the iconic monument by the sea after a masked mob, armed with iron rods and sledgehammers, attacked JNU students and teachers and left 34 people injured.
"We have taken serious cognizance of the 'Free Kashmir' poster seen in the protest last night at Gateway of India. Yes, we are definitely investigating it," Sangramsingh Nishandar, Deputy Commissioner of Police, was quoted this morning by news agency ANI.

The Shiv Sena, in power in Maharashtra at the head of an alliance including the Congress and the NCP, has been criticised over the poster by BJP leader and former Chief Minister Devendra Fadnavis.

"Protest is for what exactly? Why slogans of 'Free Kashmir'? How can we tolerate such separatist elements in Mumbai? Uddhav-ji, are you going to tolerate this Free Kashmir Anti India campaign right under your nose???" Mr Fadnavis said in a tweet.

Once steadfast allies, the BJP and the Sena broke apart after October's Assembly elections, in which they emerged as the largest alliance but failed to form a working government.

The Sena's Sanjay Raut said this morning his party "would not tolerate anyone talking of freedom of Kashmir from India". He also said the poster had been misunderstood.

"I read in a newspaper that those who held 'Free Kashmir' banner clarified they want Kashmir to be free of restrictions on internet services, mobile services and other issues," Mr Raut was quoted by news agency ANI.

Sena leader Aaditya Thackeray also responded to the incident, saying "we need to see her (Mehak's) intent".

"Apart from that incident (we need to) look at larger picture... we need to see her intent. Was it to remove internet blockade? If it was to free Kashmir from India, then it is wrong. Obviously everyone condemned it... not even other protesters supported it," the newly sworn-in Environment and Tourism Minister said.

In a YouTube video posted last night Mehak, the young woman photographed with the poster, sought to explain her action and address the "crazy" reaction it has elicited.

"Yesterday (January 6) around 7 pm I reached the protest at Gateway of India and, like anybody else who believes in democracy, I joined it. There were posters relating to many issues - NRC, CAA and, of course, JNU students," she said.

"I saw one on the ground that said 'Free Kashmir' and I thought we are here to talk about basic constitutional rights that people in Kashmir don't have because of the internet shutdown... this is why I picked it up," Mehak explained.

Jammu and Kashmir is facing a prolonged internet shutdown that has been in place since Article 370 was revoked in August last year and the state was bifurcated into two union territories.

Mehak went on to say the controversy surrounding the poster had been "blown out of proportion" and that as a woman she now feared for her safety.

Hundreds had gathered at the Gateway of India on Sunday night in what was described as a "spontaneous" protest against Sunday's brutal attack on JNU students and faculty members. This morning cops forced protesters to move to Azad Maidan, following which the protest was called off.

Students attacked by police in Jamia Millia Islamia
 
Safoora Zargar, a research scholar from Jamia Millia Islamia (JMI) university, spent her first day of Ramadan in the high-security Tihar jail in the Indian capital, New Delhi.

The 27-year old, in the second trimester of her first pregnancy, was arrested on April 10 and subsequently charged under the stringent anti-terror law, the Unlawful Activities Prevention Act, 2019 (UAPA), by the Delhi police.

Zargar was associated with the Jamia Coordination Committee (JCC), which organised weeks of peaceful protests in the capital against a citizenship law passed last December.

Activists say the Citizen Amendment Act (CAA) discriminates against the country's 180 million Muslim minority and runs against the country's secular constitution.

Police accuse Zargar of being a key "conspirator" in the February violence that erupted in northeast Delhi after supporters of the Hindu nationalist government attacked peaceful sit-ins. At least 53 people were killed, mostly Muslims, in the worst violence in the capital since the 1984 anti-Sikh riots.

"She was the strongest women voice in the JCC but, she wasn't there to just be in the spotlight unlike some others", said Kausar Jan, an art student, who along with others had painted protest art on the walls of the university.

Speaking to Al Jazeera, one of Zargar's teachers described her as "outspoken and hard working". "I really hope that the judiciary will consider her academic record and her medical condition and release her soon," she said, requesting to remain anonymous.

A member of the JCC, who also wished to remain anonymous, said the arrests amid the coronavirus pandemic were to ensure that the anti-CAA movement died a slow death, even after the lockdown is lifted.

On February 10, Zargar had fainted after being caught in a scuffle between the police and students, and had to be hospitalised briefly.

"Since then, with her advancing pregnancy a concern, she had gradually restricted her physical movement. And after the outbreak of COVID-19 she had virtually stopped stepping out of the house except for essential work. She was mostly working from home," her husband, who requested his name not be used, told Al Jazeera.

The Tihar prison complex in New Delhi is one of India's most overcrowded prisons with nearly double the number of inmates than it can accommodate.

The COVID-19 outbreak has led to Indian courts ordering the release of those who have not been to trial but Zargar, charged with as many as 18 crimes including rioting, possession of arms, attempt to murder, incitement of violence, sedition, murder, and promoting enmity between different groups on grounds of religion, is not eligible for an early release.

"In fact, we had secured bail in the Jaffrabad case where she had been accused of leading women and children to protest and disrupt traffic," her lawyer, who also withheld his name, said.

But, before she could be released, police arrested her in another case. They refused to disclose what the exact charges were against her, or even the material which formed the basis for her arrest.

It was after the court ordered that charges and material be disclosed that the police invoked UAPA against Zargar.

"Incarcerating her despite her pregnancy on the basis of vague charges is a grave miscarriage of justice," her lawyer said.

Al Jazeera called Delhi Police PRO MS Randhawa, who referred to a statement issued by the police last week. On April 20, the police tweeted that all arrests in relation to the Delhi riots were in compliance with the law and based on scientific evidence, warning that "it will not be deterred by false propaganda and rumours…".

Justice in time of pandemic
Concerns are being raised about limited access to justice during the coronavirus pandemic. Visits to prisons by lawyers and families have been banned.

After several days, the court allowed Zargar's lawyer to speak to her over the phone.

"I am aghast to learn that in the name of quarantine, Safoora [Zargar] is being kept in solitary confinement! Can you imagine the psychological toll this will take on her? She told me that she had made five applications to speak telephonically to her husband but was denied each time by citing COVID-19 protocols," the lawyer said. The lawyer is worried that Zargar is suffering from medical and dietary negligence.

UAPA is often characterised by activists as 'the process which is the punishment'. It allows police up to six months to file charges against the accused - as against three months under regular criminal law. Using it against an ordinary student such as Zargar has raised serious concerns about the Delhi police's impartiality.

"This case shows that diminished access to justice during the lockdown is being used to implicate and imprison student activists who led the peaceful anti-CAA protests," said Vrinda Grover, a Supreme Court advocate.

"Given her pregnant condition she is at high risk and having been sent to jail by a court order, the court is fully responsible that as an undertrial, her health is in no way harmed in judicial custody," Grover said.

Zargar's family marked the first day of Ramadan with sadness and anxiety.

"It would have been a very joyful occasion given that we are expecting our first child. All we did was pray for her safety and quick release. In her condition she needs care, not jail," her husband told Al Jazeera.

The Delhi Police has added charges under the Unlawful Activities (Prevention) Act (UAPA) against former JNU student Sharjeel Imam, officials said on Wednesday.

Imam was arrested from Bihar's Jehanabad on January 28 for allegedly making inflammatory speeches at the Jamia Millia Islamia in Delhi and in Aligarh.

Imam, a PhD student at the Jawaharlal Nehru University's Centre for Historical Studies, was booked in sedition cases lodged across several states for alleged "inflammatory" speeches made during protests against the Citizenship (Amendment) Act.

"He was arrested in two cases of violence at Jamia on December 13 and 15, 2019, for instigating and abetting the Jamia riots, due to his seditious speech on December 13 and based on evidences collected, IPC sections 124 A and 153 A were also invoked," said Anil Mittal, Additional PRO, Delhi Police.

A supplementary chargesheet was filed in Saket court against Imam for giving 'seditious speech' and 'abetting riots' in Jamia on December 15 last year, the Delhi Police had said on April 18.

Imam's lawyer Ahmad Ibrahim had earlier said that appropriate measures will be taken after going through the charge-sheet.

Earlier, former JNU student Umar Khalid and Jamia Millia Islamia students Meeran Haider and Safoora Zagar were also booked under the UAPA for allegedly hatching a conspiracy to incite the communal riots in the national capital. While Zargar is the media coordinator of Jamia Coordination Committee, Haider is a member of the committee.

In the FIR, police have claimed that the communal violence was a "premeditated conspiracy" which was allegedly hatched by former JNU student leader Umar Khalid and two others.

Communal violence had broken out in northeast Delhi on February 24 after clashes between citizenship law supporters and protesters spiralled, leaving at least 53 people dead and around 200 injured.

On Monday, a Delhi court sent Jamia Millia Islamia Alumni Association President Shifa Ul Rahman to 10-day custody of Delhi Police Special Cell, with police claiming that "anti-CAA protests at the varsity and other parts of Delhi were funded from the Middle East".

The police told the court that Shifa-Ur-Rehman, also a member of Jamia Coordination Committee, was involved in a criminal conspiracy along with former Umar Khalid.

Aligarh Muslim University Student Injured After Cricket Match Turns Violent

Aligarh: A minor tiff during a cricket match turned violent and a student of Aligarh Muslim University (AMU) got injured allegedly after being hit on the head, a varsity official said.

Sajid Husain, a native of Jammu and Kashmir, was rushed to the Jawaharlal Nehru Medical College in an unconscious state, he said. Husain is in ICU and his condition is said to be serious, AMU spokesperson Omar Peerzada told PTI.

According to the spokesperson, Husain and Shobhit Singh, who had allegedly hit him with a cricket bat, are second-year students of AMU's Zakir Husain College of Engineering and Technology.

A large group of students blocked the campus' centenary gate following the incident on Wednesday evening, he said.

The students demanded immediate rustication of the attacker, according to a senior university official.

Omar Peerzada said immediately after the clash, Shobhit Singh was escorted out from the hostel and later handed over to the police.

A case under section 307 (attempt to murder) of the Indian Penal Code has been registered at the Civil Lines police station, officials said.

The students of the technical college boycotted classes in protest.

According to the AMU Proctor Syed Waseem Ali, the centenary gate has been reopened after the students were persuaded to withdraw their blockade and were assured that strong action will be taken against anyone found guilty after the due process of investigation is carried out.

Shobhit Singh has been suspended with immediate effect and the university campus has been declared out of bounds for him, pending further inquiry, he said.

Police patrolling at the entry points at the AMU campus has been intensified as a precautionary measure, he said.
