Qatari Prince refuses to appear in person before JIT

ISLAMABAD: Qatari Prince Hamad Bin Jasim Bin Jaber Al Thani has on Monday responded to the Joint Investigation Team (JIT) by sending in a letter but on the other hand has apologised from appearing in person before the investigating team.

According to the letter submitted to the JIT, the Prince wouldn’t be able to come to Pakistan due to his personal engagements.

Reportedly, Hussain Nawaz had suggested the JIT to record Hamad Bin Jasim Bin Jaber Al Thani’s statement through video link, which they rejected.

On the other hand, the Joint Investigation Team (JIT) has received the reply of Qatari Prince through a letter.

According to reports, Pakistan’s mission in Doha had received Qatari Prince’s reply three days ago.

That is incorrect, when he is testifying in a case (through his letter) he is party to the case and has to appear before the judicial authority that is overseeing the case.

You cannot be a witness to a murder trail and just give your witness account through a letter and refuse to come to podium when asked to do so, otherwise, your witness account is thrown in the garbage where it belongs.

Their favourite Geo journalists have been posting garbage against JIT and judges to give impression that judges and JIT is extremely biased and mis treating Sharifs. Even once credible Talat Hussain has been posting absolute garbage even when PMLN leaders were threatning judges and their families of dire consequences for just doing their job.

How conveniently they forgot that these 3 judges they are threatning are the reaosn they were found distrubuting sweets when other 2 judges declared Sharifs corrupt and opted for their disqualification.

Even if they are disqualified now, they will claim that judges and JIT were biased when fact is they could not provide ONE genuine transaction of millions of dollars of investments.

in any case, PTI next election is based on "NS is corrupt".
and PML-N that they are innocent and PTI are not letting them work and they are always available for accountability even with hostile SC/JIT etc.

Common people have to decide through Vote so media is the key.

I have never understood why some PPP jyalay are so bitter about Imran.

We heard following from jyalas for years and years (and very rightly):

Nawaz Sharif is corrupt.
Nawaz Sharif destroys institutions.
Nawaz Sharif fixes elections and bribes everyone form media to judiciary.
Nawaz Sharif is a tax defaulter and money launderer.
Nawaz Sharif is a black mailer.
Nawaz plays dirty politics attacking families, personal attacks etc

Benazir in particular was biggest victims of all these tactics but now when Imran Khan says EXACTLY the same, he is immature, he is a liar, he is immature politician, he accuses without proof.

I can totally understand why Nawaz Sharif supporters hate IK but never understand current/former pipliyas totally opposing EVERYTHING Imran says and even go as far as supporting Nawaz Sharif on ALL issues.

Wrong. Under Criminal Rules & Procedural Code 1898, under which JIT is investigating, his personal appearance is necessary before the Investigators. Only at the time of court hearing he can be granted an exception, and that too by the relevant court.

as JIT has no jurisdiction over non-pakistani citizen so personal appearance clause does not apply to him. If you say it does, then I would say issue a non-bailable warrant for Prince and arrest him, if you can ...


so basically two options available for JIT:

1- Conduct interview through Video Link
2- Bin the letter.

#2 will raise so many questions about the sincerity of JIT to find the truth.
and based only on this, in future, verdict of JIT will be overturned and JIT-2 would be setup to investigate the intentions of JIT-1.

so it's in JIT's own interest to go for video link.

Firstly, the letter is a document that has been presented by accused persons in their defence. As per law, no document has any evidentiary value unless it has not been authenticated by the producer. The producer has to authenticate it in person in front of firstly, the investigators and secondly, the court. If he fails to do so, the document is as good as a blank paper.

Secondly, this document in itself is not an evidence. It merely is a statement by a person about different facts. It shall be admitted as evidence only if it is supported by chain of documents verifying his version. If there are no bank statements, lease/sale deeds, GPAs supporting version of Qatari prince, again, the letter is as good as a blank paper.

Remember, no word of any person, be it a Prince or a President, can be taken as true on face of it. If that could happen, any person accumulating wealth beyond his means could provide a heap of letters and statements from 10 different persons and every criminal would go Scott free.

And lastly, it's not responsibility of JIT to ensure presence of Prince before it. It's defence's. Otherwise the letter shall be disregarded as per law.

I read it today in Dawn. (though Photogenic part was not mentioned).
It seems that Judge also read PP as I have pasted the reports which clearly mentioned that JIT declined the option of video link.
