India not to challenge bail of Samjhauta blasts accused

NEW DELHI: India’s National Investigation Agency (NIA) will not challenge the conditional bail granted to Naba Kumar Sarkar alias Swami Aseemanand by the Punjab and Haryana high court last year in the Samjhauta blasts case, Times of India said on Tuesday.

It quoted the home ministry as informing the Lok Sabha that the NIA, upon examining the feasibility of filing a special leave petition, found no grounds to challenge the order in the Supreme Court.

“The NIA’s decision is bound to be questioned not only at home, with the opposition likely to charge the government with going soft on terror cases involving rightwing outfits, but also across the border in Pakistan,” the paper said.

Of the 68 killed in the February 2007 explosions, 42 were Pakistani citizens. The Times recalled that only recently, special public prosecutor in 2008 Malegaon blasts case Rohini Salian had alleged that she was eased out of her job following her claims that NIA was pressuring her to go soft on the Samjhauta accused, including Sadhvi Pragya and Col Srikant Purohit. The charge was refuted by NIA.

Meanwhile, Islamabad too has been pressing India to ensure proper and speedy trial in the case.

With the NIA now letting Aseemanand’s bail go unchallenged, Pakistan is likely to bring up the issue at the NSA-level talks proposed later this month, the paper said.

Its Shameful to say the least.The Govn is defn not proceeding properly ,was expected but didn't think it would be that obvious.

If yes, then not good for the region at all. We do not need similar people at our side of border at all.

Typical India, A semi-apartheid state response. Mass-murderer convicts Sarpotdar of shiv Sena immediately got bail and died few years back without single day in jail. Same for Bajrangi and Maya Kodnani, their convictions were also involvement in murders and rapes of several hundred. State govt. requested no death penalty for them. A prioritised hindu state.

Bail needs to be challenged.But then again these days the Supreme court also favours giving bail to accuseds lodged for a long time in jails.

Among the dead were 138 Indians (including 17 policemen and NSG commandos) and 28 foreigners. The breakdown of the foreigners was as follows: four Americans, three Germans, two Israeli-Americans, two Israelis, two Australians, two Canadians, two French, two Italians, one British-Cypriot, one Dutch, one Japanese, one Jordanian, one Malaysian, one Mauritian, one Mexican, one Singaporean and one Thai.

True but maybe it also needs a little less finger pointing from our "friends" from the eastern boarder when a similar topic arises accusing them of the same charges.

When India cannot bring its own terrorists to justice, then who the heck are India to demand action on alleged terrorists from other countries?
 
Pakistan should bomb the last known, general location of these terrorists since India will not take any action...

Samjhauta Express blasts: Indian court acquits Swami Aseemanand, three others

New Delhi: Indian court has acquitted four accused in Samjhauta Express blast case that killed 68 people, mostly Pakistani nationals.

The court in Panchkula, Haryana acquitted Indian extremist and godman Swami Aseemanand. The three other people who have been acquitted are: Lokesh Sharma, Kamal Chauhan and Rajinder Chaudhary.

Indian media quoted NIA counsel Rajan Malhotra as saying "All the four accused, Naba Kumar Sarkar alias Swami Aseemanand, Lokesh Sharma, Kamal Chauhan and Rajinder Chaudhary have been acquitted by the court."

The verdict came after Indian court dismissed the plea filed by a Pakistani woman for examining eyewitnesses from Pakistan, saying it was "devoid of any merit".

Pakistan national Rahila Wakil had moved an application through an Indian advocate and requested the Pakistan-based eyewitnesses and witnesses be summoned to depose before the court.

The applicant from Dhingrawali village in Hafizabad district of Punjab claimed her father Mohammad Wakil died in the train blast that had left 68 dead.

Rahila Wakil also claimed that the Pakistan based eyewitnesses were not issued summons and they were willing to appear before the court. She also said the eyewitnesses had 'no knowledge' about the developments in the case.

In February 2007, the Hindu extremists had bombed the train killing 68 people, 42 of whom were Pakistanis. The train was near Panipat and was heading towards Lahore from New Delhi when it was attacked.

Now India is in no position to cry about Hafiz Saeed or Azhar Masood. If they found the samjhauta express perpetrators innocent then we found those on their wanted list the same.
 
Well these are pavitr terrorists, so what if they killed 70 people. This is all done in self defence as they never attack anyone, these holy cows of India.

What would the witness have testified, how the big and devastating the blast was???

This is a technicality that wasn't central the case and guilt of the accused didn't hang on the testimony of the 13 Pakistani witnesses.

All in all typical pathetic miscarriage of justice, not unique to Indian judiciary.

Oh actually there are people who are banned by the US and the UN for their involvement in samjhauta blast.

But the then Indian govt ignored these investigations and went on a tangent to somehow blame others for the blast and get electoral gains.
