Senior journalist and Express News anchorperson Imran Riaz Khan, who has been booked for a range of offences including criticising state institutions and abetting mutiny, was arrested from Islamabad Toll Plaza late on Tuesday.

In a video of his arrest, which went viral on social media, over a dozen policemen of Punjab Police can be seen surrounding his car.

Reportedly, he was arrested in a case lodged at the Attock police station and was taken to the same district.

In the video Riaz can be heard saying that he was coming to the federal capital to get bail from the Islamabad High Court (IHC). “I don’t think this [arrest] makes any difference.. I am requesting all journalists to raise your voice and continue performing your duties,” he said, adding that the arrest was a clear contempt of court.

“This is Islamabad’s jurisdiction where I am being arrested because Toll Plaza starts from here. Justice Athar Minallah [Chief Justice Islamabad High Court] has also granted me bail so in this situation this arrest is wrong. I have to appear in his court to get bail in the morning,” the journalist could be heard as saying in the video.

“It makes no difference whether they imprison me or kill me or whatever they do… I think we should continue performing our duties… I am requesting all journalists to raise your voice and keep doing your jobs.

“I am going to give arrest with courage… will see what happens next… my car and weapons have been snatched [by authorities] and 20 FIRs were registered against me.”

Punjab Law Minister Malik Ahmad confirmed the development but said that Imran Riaz was arrested in the limits of Rawalpindi division as cases against him were registered in Punjab.

"The impression that the arrest was made in Islamabad is wrong," he added.

Police sources told The Express Tribune that instructions to arrest the journalist were received from Lahore and his belongings including mobile phone and wallet were also later seized by the police officials.

They said attempts were made to cover up his arrest but the Attock police later confirmed the development after the footage of his arrest went vial on social media.

Police team headed by the RPO Rawalpindi said that Riaz was later shifted to Airport Police Station in the federal capital.

The police officials said the journalist was arrested in a case registered at City Attock police station on the complaint of a citizen named Malik Mureed Abbas under the Electronic Crimes Act and six other sections.

In the FIR, the citizen stated that he saw a video on social media in which Riaz tried to tarnish the image of a state institution.

The journalist had filed a petition in the Islamabad High Court to avoid arrest, on which the court directed the authorities concerned not to arrest him and directed the journalist to co-operate with the law enforcement agencies.

"There were 17 cases registered against Imran Riaz Khan across Punjab. When we filed a petition in the Islamabad High Court, the court had directed the authorities concerned across the country not to arrest him," his lawyer Mian Ali Ashfaq said.

He added that they had also filed a petition in the Lahore High Court (LHC) on which the judge had directed the Punjab police chief to provide a copy of the cases and not to arrest him. The lawyer said that he will file a petition in the Islamabad High Court against the arrest and hoped that the honourable judges would take strict action against the violators of the court orders and ensure his release.

The Islamabad High Court (IHC) on Wednesday disposed of a petition filed by journalist Imran Riaz Khan against his arrest, ruling the case did not fall within its jurisdiction and advised the petitioner to approach the Lahore High Court (LHC).

Khan was arrested by the Attock police Tuesday night on the outskirts of Islamabad as he was headed to the federal capital to acquire pre-arrest bail from the IHC in a treason case registered against him.

Sources in the police department told Dawn that a contingent of the Attock police supported by a team of the Elite Force took the journalist into custody and moved him to the Attock City Police Station.

They said a case was registered against the journalist at the city police station on June 25 under sections 505-1(C) (statements conducing to public mischief with intent to incite, or which is likely to incite, any class or community of persons to commit any offence against any other class or community), 505 (2) (whoever makes, publishes or circulates any statement or report containing rumour or alarming news with intent to create or promote feelings of enmity, hatred or ill-will between different religious, racial, language or regional groups or castes or communities), 501 (printing or engraving matter known to be defamatory), and 109 (punishment of abetment if the Act abetted committed In consequence and where no express provision is made for its punishment) of the Pakistan Penal Code and six different sections of the Prevention Of Electronic Crimes Act (PECA) 2016.

Later, the journalist also shared a video of himself at the time of the arrest wherein he could be seen sitting in his car surrounded by police officials. “You have taken my [bulletproof] car and weapons, registered 20 FIRs against me, now you want to arrest me as well, go ahead and arrest me,” he said defiantly as he got out of the car to surrender.

Immediately after the incident was reported, a contempt petition was filed by Khan's legal team in the IHC naming the police chiefs of Islamabad and Punjab as respondents. Taking late-night action, Justice Athar Minallah had issued notices to the Islamabad police chief and chief commissioner and told them to appear before the high court.

During the hearing today, Khan's counsel contended that his client was arrested from the Islamabad Toll Plaza. "In the LHC, the police had given us a report which said 17 cases were registered against Riaz.

"I have separately also filed a contempt petition in the LHC," he said. "But the court was never told about the FIR booked last night."

Here, Justice Minallah remarked that every court had its own jurisdiction and the LHC could look into this matter. "The arrest of Imran Riaz Khan in Attock does not fall under the jurisdiction of this court," he said, continuing that the IHC couldn't investigate issues pertaining to Punjab.

The journalist's counsel, however, argued that the court's orders, barring any arrests, had been violated. He also stated that the Islamabad police, not Punjab's, had arrested Khan.

"The court had talked about arrests in Islamabad. Khan was arrested outside the court's jurisdiction," the IHC chief justice reiterated, adding that if the LHC ruled that the arrests were made in Islamabad, "you can bring the order here".

The court, subsequently, disposed of the petition and instructed the journalist to approach the LHC as it would be in his "best interest".

In a recent video on his Youtube channel, the journalist had directly addressed Chief of Army Staff General Qamar Javed Bajwa and alleged that he was threatened after asking questions from military sources about the country's current political and economic situation.

Over the past few months, several cases have been lodged against pro-PTI senior journalists including Khan, Arshad Sharif and Sabir Shakir for allegedly spreading hate against army and state institutions.

In May, Khan had filed two petitions with the LHC through his lawyer Mian Ali Ashfaq and obtained pre-arrest bails.

The International Federation of Journalists (IFJ) and its Pakistan affiliate, the Pakistan Federal Union of Journalists (PFUJ), on Wednesday urged the government to withdraw the cases against Express News anchorperson Imran Riaz Khan, the most vocal critic of the ruling coalition.

An official statement said that the cases against the journalist were filed with police in numerous areas of Punjab, all with similar charges, adding that several residents submitted applications to register first information reports (FIRs), alleging that the journalist was inciting anti-national sentiments by disparaging state institutions.

On June 30, three indictments were filed against the TV anchor, one in Gojra and two in Jhang, on the complaints of three separate persons. According to the FIRs, the anchor's actions violated Pakistan's constitution as they "wounded" Pakistani people's feelings and went against state institutions.

The cases were filed under Sections 505-1 ©, 505-2, 501, and 109 of the Pakistan Penal Code (PPC) and various sections of the Prevention of Electronic Crime Act, 2016.

Chowk Sarwar Shaheed police in Muzaffargarh also filed a separate charge against Khan under the Anti-Electronic Crime Act and other laws. Complainant Advocate Riazul Haq, the brother of Maj Zakaul Haq Shaheed, alleged that Khan had harmed the army's reputation.

Imran Riaz Khan has since been arrested on July 5 for an FIR filed at Attock police station.

According to the IFJ's South Asia Press Freedom Report 2021-2022, "two-thirds of the complainants invoking the PECA law against journalists are private citizens, with the Federal Investigation Agency (FIA) officials the second-highest initiator of complaints".

"Opinions or criticism of the military and the intelligence agencies is the most frequent complaint against journalists," the report said.

The PFUJ said: "Registration of cases against journalists is an attempt to gag them. This is an action which cannot be permitted in any democratic and civilised country."

The IFJ stated: "As the number of cases lodged against journalists increases in Pakistan, the IFJ urges the Pakistani authorities to withdraw the cases against Imran Riaz Khan and cease the use of government mechanisms to harass journalists and media workers."

Imran Riaz's arrest

Senior journalist Imran Riaz Khan was arrested from Islamabad Toll Plaza late on Tuesday, disregarding the fact that a court has already granted him a pre-arrest bail.

The journalist has been implicated in a slew of cases which he says were motivated by his refusal to “stop speaking the truth”.

Of late, more than a dozen FIRs have been registered against him on charges as serious as abetment of mutiny and criticism of the state institutions.

In a video of his arrest, which went viral on social media, over a dozen police officers of the Punjab Police can be seen surrounding his car.

Reportedly, he was arrested in a case lodged at the Attock police station and was taken to the same district.

ATTOCK: Anchorperson Imran Riaz Khan on Thursday got relief from a local court when a case filed against him was wrapped up and the police were ordered to release the TV personality if not wanted in another case.

Imran Riaz Khan was presented before the court by the Punjab Police, seeking three-day physical remand.

He was taken into custody by the police from the Islamabad Toll Plaza when he was going to the federal capital ahead of a hearing in the Islamabad High Court (IHC) for an extension in bail.

Judicial Magistrate Attock Yasir Tanveer, after hearing the case till 3am, had reserved the verdict which was issued later in the morning.

…..keeping in view the above said facts and circumstances and guidance from the above said case laws, at this moment the case in hand is not a case of sufficient evidence which connect the accused Imran Riaz with the commission of the offence as embodied in the crime report, therefore, the accused Imran Riaz Khan is hereby discharged from this case,” the judge stated in the eight-page order.

The order also pointed out that the Punjab police was directed by the Lahore High Court to submit details of all the cases filed against him for which it shared 17 FIRs but concealed this case from the LHC, hence, did not come to the court with clean hands.

“…..for clarification of judicial mind whether in this case sufficient material as alleged in the crime report as embodied in the said CD available or not? Therefore, the CD which was recovered by the police has run in open court and seen. As per the recording of the CD the present accused being an anchorperson programmed in a private room and uploaded on his YouTube Channel. After hearing and seeing the whole CD at this stage it is found that the accused present in the court did not used any derogatory remarks or any other word which can be said that the accused committed the offences leveled in the FIR.”

The order said that Imran Riaz Khan be released forthwith if not required in any other case, adding that the police, however, after adopting legal procedures can investigate the matter further and if collects sufficient evidence, then they may proceed against but, strictly in accordance with law.

After being arrested, Imran Riaz Khan was produced before the Attock court on Wednesday which refused to hear the case stating the matter does not fall under its jurisdiction as sections of the Prevention Of Electronic Crimes Act (PECA) 2016 were added to the FIR.

Later, the anchorperson was taken to the court of Judicial Magistrate Muhammad Pervaiz Khan in Rawalpindi which directed the charges framed under the PECA sections be repealed and ordered that the matter be fixed before the Attock court.

The court announced the verdict after an official of the Federal Investigation Agency (FIA) informed the judge that the offences mentioned in the first information report against Imran were not “actually made out” and the police had wrongly lodged the FIR regarding the PECA sections.

The FIA official further informed the court that no offence had been committed according to the PECA sections and the FIA did not have the privilege to investigate the matter further.

Earlier, the IHC had disposed of the case and directed him to approach the Lahore High Court.

The Lahore High Court fixed a petition seeking to either quash 18 cases filed against detained journalist Imran Riaz Khan, or consolidating them all into a single first information report (FIR) for hearing today (Tuesday) — a public holiday — his lawyer Mian Ali Ashfaq told reporters.

The hearing, however, had not started until 1:35pm, when the last update for this report was filed.

Justice Ali Baqar Najafi will be taking up the petition, in which the Punjab government and inspector general of police (IGP) have been nominated as respondents.

The petition, a copy of which is available with Dawn.com, also requested the court to suspend the "operations of all ... FIRs till the final decision of this case and direct the respondents to produce the petitioner before this honourable court and release the forthwith till the final disposal of the instant petition".

Imran, who is facing charges of treasons in multiple case, was initially taken into custody by Attock police near Islamabad on Tuesday night. He was later granted relief by a local court in the wee hours of Thursday, only to be immediately arrested by a team of Chakwal police outside the courtroom.

He was then shifted to Lahore, prior to which a local court of Chakwal district had allowed his judicial remand.

It emerged on Friday that Lahore police had handed over the journalist to the Crime Investigation Agency in a case pertaining to the abetment of mutiny and criticism of state institutions.

The petition
The plea contended that Imran had been "working hard to provide and deliver information based on quality of truth and by doing that, he has been exposing illegitimacies and wrong doings of everyone without any bias any distinguish, call it ruler or the institutions".

He had "always given his opinion based on his complete independent journalist[ic] view on all sorts of topics [...] in the larger interest of public of Pakistan" and "exposed thousands of people and stories with no fear", the plea said.

It maintained that the incumbent government was being "revengeful" against several journalists, including Imran.

The petition said Imran believed "more bogus cases" in forms of FIRs or complaints against him were registered against him on behalf of "different unknown persons on the instructions and behest of the incumbent government and with the connivance and collusion of the respondents".

It mentioned that Imran had sent a letter dated June 30 to the Punjab IGP, requesting details about any pending complaints/FIRs against him so that he may approach the relevant forum for an investigation and seek pre-arrest bail.

But due to "non-cooperation showed by the Punjab IGP", the plea said, Imran filed a writ petition before the LHC, which then directed the Punjab police chief to submit on July 1 the record of cases and complaints against the journalist.

A report was then submitted on the matter by the Punjab government, the plea stated. However, it added, while the report showed the records of 17 FIRs registered against Imran, some of the complaints and FIRs were "deliberately and intentionally" concealed for the sole purpose of arresting the journalist "by whatever means to please the people in present [the] government on whose instructions these bogus FIRs were registered against the petitioner by the respondent no.1 through planted complainants".

The petition said Imran then decided to approach the Islamabad High Court for protective/transitory bail but was arrested by Attock police at Islamabad Toll Plaza on July 5 at 10:30pm.
