MUMBAI: Sharjeel Khan, the Pakistani opener who has been suspended for five years (including a sentence of two-and-a-half years) are suspended for his alleged role in the spot-fixing in the Pakistan Super League (PSL) is to challenge the judgement. This was revealed by his lawyer Shaigan Ijaz.

Speaking exclusively from his Lahore office, minutes after the judgement was announced, the lawyer said, “I have discussed the verdict with Sharjeel Khan and it has been decided to challenge the same”.

"We have two options, either to move the Court of Arbitration for Sports (CAS) or to the independent Tribunal. We may prefer later as we it has an easy and the hearing will take place in Lahore”.

“Will have 14 days to appeal after the receipt of the detailed order. The detailed order will be released on 7th September. To-day we only got the short order and one member of the tribunal, Wasim Bari, who was in Lahore for the hearings, will return to his home-town Karachi for Eid festivals and is expected to return only in the first week of September”.

Interestingly, both Sharjeel Khan and his lawyer, at the invitation of the Pakistan Cricket Board (PCB) went personally to hear the judgement. “It was announced to us in the Board room of the National Cricket Academy (NCA), where no media persons were present. The tribunal chairman retired Justice Asghar Haider announced the verdict in the presence of other two members (retired Lt Gen Tauqir Zia and former wicket keeper and team manager Wasim Bari) and the PCB lawyer Taffazul Rizvi”, the lawyer said.

“No, my client (Sharjeel Khan) didn’t cry on hearing the judgement. But, yes, he was disappointed. He believes that the punishment for the offence which he has not committed is “too harsh”.

“Had it been a shorter ban, say one year or 6 months, we would not have opted to challenge it because of Sharjeel’s non-disclosure of the approach by the bookie but the charges of fixing without the solid evidence is not accepted to us”, the lawyer added.

Immediately after the verdict was announced, Sharjeel Khan accompanied his lawyer to his office, where the strategy for the next course of line was discussed. Sharjeel Khan preffered to avoid questions from the media. Perhaps, may be at the instructions of the PCB.

The fate of the other players, who too have been suspended for the alleged fixing charges in the PSL (Pakistan Super League) matches will be decided and announced later.

Sharjeel Khan to appeal against five year ban

Tainted Pakistan batsman Sharjeel Khan has decided to appeal against the five-year ban imposed on him by the Anti-Corruption Tribunal of the Pakistan Cricket Board for his role in spot-fixing in the PSL.

Sharjeel's lawyer Shaighan Ejaz confirmed to PTI that a decision has been taken to appeal the ban but on what grounds the appeal would be filed would be decided after the full order of the tribunal comes out by September 7.


"Yes we have decided that we will appeal the ban as we have our reservations over the tribunal finding Sharjeel guilty of three major charges which include doing spot-fixing and agreeing to spot-fix a match in the Pakistan Super League," Ejaz said.

A source close to Sharjeel said the batsman was not willing to carry the slur of being a spot-fixer all his life.

"Sharjeel is adamant he will not accept this tag of being branded as a spot-fixer even though the verdict handed down by the tribunal in its short order technically means he can resume playing cricket after one year and 10 months," the source said.

"Sharjeel has also conveyed to the cricket board he is not satisfied with the decision as the tribunal has found him guilty of two major charges. He is willing to accept the charges of being made an offer and not informing the competent authorities on time about it. But not more," the source said.

Shaighan Ejaz insisted that he was surprised by the tribunal finding Sharjeel guilty of major charges as the PCB had failed to submit any evidence against his client during the course of the tribunal hearings.

"When the Board could not produce any evidence against Sharjeel confirming that he agreed to spot-fix a match in the PSL, we are not happy with the decision and we plan to appeal it when the time comes," Ejaz added.

The tribunal has banned Sharjeel starting from February 10 this year when he was initially suspended by the Board under the anti-corruption code of the PCB during the PSL and sent back home from Dubai.

Ejaz said that the Board had failed to produce any witnesses or video or audio recordings or pictures confirming that Sharjeel met with the bookmaker and accepted an offer to spot-fix in the PSL match.

"There is no question of any financial transaction taking place between my client and this bookmaker and nothing of this sort was shown before the tribunal. There is no evidence to suggest Sharjeel did spot-fixing at any time," he said.

The lawyer made it clear that there were some glaring loopholes in the case against his client and unanswered questions.

"The way we look at it the board's anti-corruption unit took a hurried decision and the board came up with this story about Sharjeel spot-fixing and they have not been able to prove it," he said.

Tafazzul Rizvi, the PCB legal advisor, said that Sharjeel and the Board both had option of lodging an appeal against the tribunal decision.

"We have reservations that despite being charged on all counts, the tribunal did not impose any fine on Sharjeel. We also have issues with two years and six months of his five- year ban being a suspended sentence," Rizvi said.

This is the main take, I'd argue with too. Where is the evidence they supposedly had, and Sethi claimed he had against the pair and was going to show to everyone?

Why have those that have been interviewed [Aqib, Yousuf etc] claimed they weren't shown any proof of guilt by the PCB/ACU?

I knew they'd appeal because they won't be happy with the length of the ban. As was stated before - if you have proof ban then everyone of them for life and be done with it. Otherwise this is going to be appealed.

I mentioned this possibility before the decision was announced. At the time, posters told me there was no way the PCB would appeal the decision as they had "fixed" the tribunal to impose a lifetime ban. Happy to have been proved right.

I agree that Sharjeel and co are the more likely to appeal the decision. But given the PCB are pushing for life bans it's possible they will appeal if they think the punishment is too lenient. After all, if it is an independent tribunal it's still possible for the decision to go against the PCB. That's my reading of the situation anyway.

Sharjeel to appeal against ban before independent adjudicator

KARACHI: Pakistan's swashbuckling opener Sharjeel Khan will appeal against the five-year ban imposed on him by the Anti-Corruption Tribunal of the Pakistan Cricket Board before an independent adjudicator, which will be appointed by the board.

His lawyer, Shaighan Ejaz said on Wednesday that a decision had been made to file the appeal with an independent adjudicator as allowed under the PCB anti-corruption code.

"We have the option of filing the appeal either with the Court of Arbitration for Sports (CAS) in Switzerland or an independent adjudicator of the board and we have decided for the latter option," he said.

Ejaz said once the appeal was filed the board would ask a retired judge of the Supreme or High Courts to hear the appeal independently.

The lawyer said that the appeal would be filed within the 14-days time limit given after the full order of the tribunal was released last week.

"My client, Sharjeel Khan, is adamant he is innocent and has not committed any spot-fixing in the Pakistan Super League," Ejaz said.

"He does not accept the decision of the tribunal to accept all five charges filed against him by the PCB. He does not want to live with the stigma of being called a spot- fixer," Ejaz said.

The PCB's tribunal headed by a Lahore High Court judge, Asghar Haider is also due to give its decision on another Pakistani batsman, Khalid Latif in the PSL fixing case before September 22nd.

Khalid is expected to be given a longer ban different from the one imposed on Sharjeel who has been banned for five years with half of the ban remaining a suspended sentence. Sharjeel and Khalid were both suspended under the anti- corruption code and sent back from the PSL in Dubai last February.

In its 60 pages final order, the tribunal listed many reasons for it reaching the conclusion that Sharjeel had committed all five charges brought against him by the PCB.

In it s final order, the tribunal observed that despite being given anti-corruption lectures, Sharjeel allegedly knowingly met with bookmaker/fixer called Yousuf Anwar at a cafe near Conrad hotel in Dubai on February 9th with Khalid Latif.

The order stated that Sharjeel agreed to spot fixing while playing for Islamabad United against Peshawar Zalmi in the first match of the 2nd PSL and the arrangement in lieu of payment was that he would after the first over when coming on strike play the first two balls he faced as dot balls and not score runs.

The order says as alleged by PCB the signal agreed between Sharjeel and the bookmaker and his accomplice was that Sharjeel would do a stretch (a squat) before facing the balls after the first over to confirm the deal.

Banned Pakistani opener Sharjeel Khan to rely on Mohammad Ashraful’s judgement

MUMBAI: Pakistani opener Sharjeel Khan, who has been suspended by the Pakistan Cricket Board (PCB) for his alleged role in the spot-fixing will now rely on the judgement passed by the disciplinary committee of the Bangladesh Cricket Board (BCB) on their player Mohammad Ashraful, it is learnt here.

According to the highly placed in Dhaka, Sharjeel Khan’s lawyer (Shaigan Ijaz) has sent a letter (a copy of the letter seen by this paper) to the BCB requesting to share the details under what circumstances Ashraful’s ban was reduced.

Asharful was initially suspended for eight years for his involvement in corruption but on his appeal the same was reduced to five years by the disciplinary committee.

Confirming this move, Sharjeel Khan’s lawyer, speaking exclusively said, “the circumstances in the case of Ashraful may be different but we have asked for more details”.

“If Ashraful’s details are not shared by the BCB, will request his London-based lawyer (Yasin Patel)”, Shaigan Ijaz added.

Sharjeel Khan’s appeal against the ban will be heard by an independent adjudicator.

“In our first hearing we already had the preliminary arguments. The PCB’s lawyers were also present and Sharjeel Khan also appeared”.

“Tomorrow is the next date (26-10-2017) of hearing. Sharjeel is in Karachi. He may arrive (in Lahore) late night to-day or early morning tomorrow to remain present”.

Karachi, Nov 9 Test batsman Sharjeel Khan's appeal against the five-year ban imposed on him by an Anti-Corruption tribunal for spot-fixing has been dismissed by an independent adjudicator of the Pakistan Cricket Board.

The adjudicator, a former Supreme court judge, dismissed Sharjeel’s appeal and also the appeal filed by the PCB seeking a longer punishment and imposition of a fine on the batsman.

The Anti-Corruption tribunal had imposed a five-year ban, half of it suspended, on Sharjeel after finding him guilty on all five counts of charges related to the PCB’s anti- corruption code in September.

Sharjeel was found guilty of meeting with a suspected bookmaker and accepting an offer to spot-fix during a match of the Pakistan Super League in Dubai in February.

Sharjeel and another Pakistan player, Khalid Latif were both sent back from Dubai after being suspended under the anti-corruption code by the PCB.

Sharjeel’s lawyer confirmed that the batsman would now most probably file another appeal in the High Court. Sharjeel has pleaded not guilty to all five charges brought against him by the PCB and had appealed for the dismissal of the ban imposed on him by the tribunal.

The PCB’s adjudicator is also expected to give a decision on the appeal filed by Khalid Latif who has been banned for five year’s and fined one million rupees for the same breaches including one additional charge of instigating other players to spot-fix.

The PCB has also filed an appeal seeking a longer ban and heavier fine on Khalid.

Both the players can appeal in the High Court in the second step and as a final resort can approach the International Court of Arbitration in Sports in Geneva if their appeals are dismissed.

The PSL spot-fixing scandal shook Pakistan cricket and led to suspensions of four other national team players, Shahzaib Hasan, Nasir Jamshed, Muhammad Irfan and Muhammad Nawaz.

LAHORE: A day after Sharjeel Khan’s appeal against the five-year ban over spot-fixing was rejected by the appellate tribunal, the Pakistan opener’s lawyer Shaigan Ijaz vowed on Thursday to challenge the decision in a high court.

Sharjeel, 28, was banned for five years, two-and-a-half of them suspended, in August following an investigation by a three-member Pakistan Cricket Board (PCB) tribunal.

The scandal surfaced during the second edition of the Pakistan Super League in February this year. The league was held in the United Arab Emirates with the final staged in Lahore.

One-man adjudicator retired Justice Faqir Khokhar upheld the ban late Wednesday and also rejected the PCB’s appeal to increase the punishment, which can range from five years to a life ban according to the anti-corruption code.

“The decision is disappointing and we will definitely go to the high court after knowing on what grounds our appeal was rejected,” Shaigan Ijaz said. “The PCB has not been able to prove the spot-fixing and that has halted a promising career.”

At the time of the ban, Sharjeel had played one Test, 25 One-day Internationals and 15 Twenty20s. He was also contracted by English county Leicestershire and was in line for getting more contracts in Twenty20 leagues around the world.

His fellow opener Khalid Latif was banned for five years and fined one Rs1 million for orchestrating the deal with a bookie.

Paceman Mohammad Irfan and spinner Mohammad Nawaz were banned for one year and two months respectively over not reporting fixing offers.

Two other players — Shahzaib Hasan and Nasir Jamshed — are also under investigation by the tribunal.
