Shoaib Akhtar's lawyer responds to defamation notice from Tafazzul Rizvi

Seems like Niazi's trying to build a case around a legal technality. Section 8 reads 'specifying the defamatory matter' - not 'specifying the defamatory statement'
Well shoaib went on a rant on 3 different mediums: geotv, PTV and his YouTube channel. Mr. Rizvi has specified all 3 in his notice. This Niazi might prove to be a more incompetent lawyer than Rizvi
 
Lahore: Former Pakistan pacer Shoaib Akhtar has been summoned by the FIA Cyber Cribe on 5th June at 11 AM, ARY News reported.

The 44-year-old has been called after the Pakistan Cricket Board (PCB) legal advisor, Mr. Taffazul Rizvi applied the application to the FIA.

Mr. Rizvi has taken the stance that Shoaib used wrong words regarding him on social media platforms.

“Shoaib Akhtar damaged his reputation on social media and he has tried to tarnish his reputable career,” Application holder.

It must be noted that Shoaib after Umar Akmal’s ban, criticized PCB legal department and legal advisor. He also called PCB’s legal advisor Taffazul Rizvi as an inept person.

Rizvi filed a Rs100 million defamation suit against former pacer and wants him to retract from his statements, in the same manner, he made in the first place and make an unconditional apology that he misstated.

Sources in the FIA informed a private news channel that Akhtar has been ordered to appear before the agency on Friday at 11am.

However, Akhtar's team has denied receiving any notice from the FIA.

"My client has not received any notice from the FIA," his lawyer, Abuzar Salman Niazi, said. "If a notice is received, we will respond with a reasonable answer."

KARACHI: The Pakistan Cricket Board on Thursday clarified that it has not filed any complaint with the cyber crime unit of the Federal Investigation Agency (FIA) against former pacer Shoaib Akhtar, insisting that the charge was made by its legal advisor Tafazzul Rizvi in his individual capacity.

Akhtar has been summoned to the FIA office in Lahore on Friday.

"Just received an absolutely vague, incomprehensible, imprecise and ambiguous Notice from FIA, Lahore. I will issue my response after due consultation with my Lawyer Salman Niazi," Akhtar tweeted.

A PCB spokesman, however, said Akhtar was summoned on Rizvi's complaint and the board has nothing to do with this matter.

"Tafazzul Rizvi is pursuing a defamation case against Shoaib Akhtar in his personal capacity, the board has filed no complaint against the fast bowler with the FIA," the spokesperson said.

Rizvi had complained to the FIA that Akhtar has been spreading propaganda and false allegations against him through social media and his youtube channel.

Rizvi has sent two notices to Akhtar -- one in Pakistan and one through a law firm in the United Kingdom -- seeking a public apology and damages worth 10 million rupees after the former fast bowler ripped him apart on his channel.

Akhtar's lawyer has responded to the notice sent in Pakistan but Rizvi said a reply was still waiting for the notice sent from the UK.

Rizvi made it clear that he intended to pursue his defamation case against the fast bowler, who had made false allegations against him and tried to damage his standing in the legal community.

The PCB has, however, filed a complaint with the FIA cyber crime cell against three former and present members of its Board of Governors.

The complaint has been filed after Shakeel Shaikh, Noman Butt and Tariq Sarwar targeted PCB chief executive Wasim Khan.

Why are lawyers a "community" in Pakistan? LOL. The fraternization and politicization of lawyers in Pakistan is a cancer.

let's be clear...what Shoaib openly said through all those medium was NOT just an opinion. Maybe this Niazi guy thought he could use his skills to make it sound like an opinion. I'm no expert in law nor have an idea how things work in Pakistan justice system but the fact is...Shoaib's statement that Rizvi "knowingly complicates cases to make money" is NOT just an opinion and is clear accusation of malpractice. I'm super intrigued to see how this turns out but wouldn't be surprised if they settle off the record to save face.
 
Based on sources, Taffazul Rizvi comes from a very prestigious family of lawyers and he is very well connected to Supreme Court Justice's. It was no wonder he got the entire legal community on his side instantly and is now using all the tools at his disposal to cause inconvenience. There had to be a powerful reason why this guy kept getting retained by the PCB as their external counsel inspite of losing many high profile cases especially the BCCI Mou case

The FIA cybercrime Lahore had summoned him in connection with the ‘cyber stalking’ charges leveled against him by Pakistan Cricket Board (PCB)’s legal advisor Taffazul Rizvi.


Shoaib Akhtar on social media said that he would respond to the FIA notice after consulting his lawyer. “(I have) just received an absolutely vague, incomprehensible, imprecise and ambiguous notice from FIA, Lahore. I will issue my response after due consultation with my lawyer,” Shoaib said in a tweet.

Earlier, Taffazul had sent a defamation notice of Rs 100 million to Shoaib for using “inappropriate and derogatory” language against him in a video clip and he filed a complaint with FIA alleging that he committed offence of cyber-stalking against him.

Shoaib, who has often been involved in controversial incidents during the past as well due to his aggressive style, had criticised Taffazul Rizvi in his YouTube channel, pointing out the flaws of the PCB’s legal department. He alleged that Taffazul had always been interested in taking high profile cricketers of the country to court to earn a name for himself.

The maverick pacer had also criticized the PCB, alleging that it has failed to curb the menace of match-fixing by allowing the tainted players to come back to cricket set up after serving their punishments.

He is probably trying to settle it outside court. I am not aware of the cyber law in Pakistan, but in BD Cyber law, what he wrote as a statement (on the competence of Rizvi as a lawyer, his integrity and his commitment to his employer), Shoaib could have found himself in deep trouble. He has a knack of throwing random comments at every directions, but this time he has made a wrong choice - a lawyer.
 
It'll be interesting to see how this plays out and whether it will have an impact on the 'say what you want culture on tv and social media in Pakistan'
 
Given how Umar Akmal has got his 3 year ban reduced, PCB legal team must be looking a little stupid?
 
Whats happening here? Has Shoaib defeated Rizvi's and gotten away with it?
