SC accepts Imran’s bail pleas in eight May 9 cases

The Supreme Court on Thursday accepted the bail pleas of former prime minister Imran Khan in eight cases related to the May 9, 2023 riots.

In November 2024, a Lahore anti-terrorism court had denied Imran bail in the cases related to the May 9, 2023 riots, including an attack on the house of the Lahore corps commander.

The incarcerated PTI leader’s plea challenging that was also rejected by the Lahore High Court (LHC) on June 24. Subsequently, days later, Imran had challenged that dismissal before the apex court.

A three-member bench led by Chief Justice of Pakistan (CJP) Yahya Afridi, which also comprised Justices Muhammad Shafi Siddiqui and Miangul Hassan Aurangzeb, resumed hearing the petitions today.

Barrister Salman Safdar appeared on behalf of the PTI founder, while Punjab Special Prosecutor Zulfiqar Naqvi represented the state.

Both concluded their arguments, following which the CJP announced the bench’s decision.

However, Imran has multiple other cases against him. Imprisoned since August 2023 in a case related to state gifts, the PTI founder is serving a sentence at the Adiala Jail in the £190 million graft case and faces pending trials related to the May 9 riots.

The PTI hailed the SC ruling, using the hashtag “Victory For Imran Khan” in its post on X.

At the outset of the hearing, the Punjab prosecutor informed the court that he could not appear yesterday due to illness.

CJP Afridi, noting he had two questions from Naqvi, asked, “You must have read the Lahore High Court’s verdict. Can a final observation be made in a case of bail?”

During the hearing on August 12, the chief justice had raised questions over some observations made by the LHC, noting that the SC will not touch upon the legal findings so as not to affect any party’s case.

Asking his second question, the CJP said, “This same court (LHC) gave bail to a suspect on the charge of conspiracy. Will the principle of precedence not apply to this case?”

The prosecutor responded that a court’s observation in a bail case was always of an “interim nature”. “A court observation does not have any impact on the trial,” he contended.

When the hearing resumed after a brief break, the prosecutor requested that the court allow him to assist on the merits of the case.

However, CJP Afridi observed, “We will not allow anyone to argue on the merits of the case. You may only answer the legal questions pertaining to the conspiracy [charge].”

The SC is a total circus. It has denied justice to people locked up years on this event totally perpetrated by the Junta. The evidence is poor that if heard in open court they would never live it down. Its the reason why the cases have been delayed. Imran's nephew Shershah sent on five-day remand in May 9 riots case​

An anti-terrorism court on Saturday handed over former prime minister Imran Khan’s nephew, Shershah Khan, to police on a five-day physical remand in connection with the May 9 riots.

The order was passed by ATC Judge Manzar Ali Gill, a day after Shershah’s brother, Shahrez Khan, was remanded into police custody for eight days in the same case. Both were nominated in the case more than two years after the incident.

May 9 riots erupted nationwide following the arrest of Imran Khan, after which Pakistan Tehreek-i-Insaaf (PTI) leaders and workers staged protests targeting both civil and military installations, including Jinnah House and the General Headquarters (GHQ) in Rawalpindi.Monsoon travel packages

The military condemned the events as a "Black Day" and decided to try the protesters under the Army Act. Military court convicted 25 individuals, including Imran Khan’s nephew, Hassan Khan Niazi, and later sentenced 60 more. In January, 19 convicts had their sentences pardoned following successful mercy appeals.

According to court proceedings, Shahrez was arrested on August 21 and produced before the court on August 22, while Shershah was taken into custody on August 22 and presented the following day.

The prosecution argued that Shershah was present at the scene of the riots and that video evidence was available to establish his presence. Police had requested a 30-day physical remand to continue investigations and recover the accused’s social media accounts. The court, however, granted five days of custody instead.

PTI General Secretary Salman Akram Raja argued the 27-month delay in Shershah’s arrest was mala fide and victimisation, saying he had no political ties. Lawyer Rana Mudassar Umar added the delay showed prosecutorial ill intent, urging the court to discharge him.

A day earlier, the same court remanded Shahrez into police custody for eight days in connection with the May 9 riots. Police told the court that Shahrez had been nominated in two supplementary statements on September 23, 2023. Raja criticised the development as “ridiculous,” arguing that authorities had suddenly “remembered” the accused more than two years after the events, despite knowing he had no role in political activity.

He claimed Shahrez’s implication was part of a broader crackdown, pointing out that Aleema Khan’s house was raided soon after the Supreme Court granted Imran Khan post-arrest bail. Shahrez was in Chitral between May 6 and 13, he argued and urged the court to discharge him from the case. He added that Aleema Khan had already been discharged.

The judge asked the investigating officer to specify Shahrez’s alleged role. After briefly adjourning to review the case record, the court was told by police that the accused was not wanted in any other case linked to the May 9 riots. Raja further submitted that Shahrez is an athlete, warning that implicating him in such cases would send a “bad message” internationally.
