A 39-year-old man has been arrested in western Sydney as part of an investigation into a notebook outlining plans to kill senior politicians that led to the wrongful imprisonment of a UNSW employee.

NSW Police detained Arsalan Khawaja, the brother of cricket star Usman Khawaja, over the alleged terror hit list, which was found in an office in the same building as the university's library earlier this year.

The book contained plans to kill the former prime minister Malcolm Turnbull, his then-deputy Julie Bishop and former speaker Bronwyn Bishop, as well as a blueprint to target train stations and Sydney landmarks such as the Opera House and the Harbour Bridge.

The ABC understands Arsalan Khawaja never intended to carry out a terror attack, but that he allegedly framed his colleague, 25-year-old Mohamed Nizamdeen, in a dispute over a woman.

These allegations have to be proved in court. Being arrested does not prove anything. Even if found guilty Usman can not be held responsible for this.

Cricket star's brother released on strict bail conditions over 'terror hit list' charges

The brother of Australian cricket star Usman Khawaja has been charged by police over the discovery of a fake terror plot to kill senior politicians, which he allegedly created to "set up" a male work colleague, when the two were fighting over a woman.

Arsalan Khawaja, 39, was arrested around 8.30am on Tuesday, when he was pulled over while driving through Parramatta in Sydney's west.

He was taken to Parramatta police station where he was charged with attempting to pervert justice, by giving untrue evidence in proceedings against Kamer Nizamdeen, and forgery, by making a false document.

Mr Khawaja appeared before Parramatta Local Court on Tuesday afternoon, wearing a white collared shirt, black trousers and black framed glasses.

He was granted bail with strict conditions, including surrendering his passport, not going within 100 metres of the University of NSW and a $50,000 surety, provided by his father Tariq Khawaja.

The 39-year-old is also required to report to Parramatta police station three times a week and to cease communication with a number of people who may be called as witnesses in future.

His arrest comes following the sensational mistaken arrest of his colleague Mohamed Kamer Nilar Nizamdeen, a PhD student working at UNSW.

Mr Nizamdeen was arrested in August, before being held in solitary confinement in Goulburn Supermax prison for four weeks, after the initial discovery of the notebook on the UNSW eastern suburbs campus.

Police now allege Mr Nizamdeen was "set up in a plan" that was devised by Mr Khawaja in relation to a "personal grievance" over a woman.

"We believe this was planned and it was calculated," said Assistant Commissioner Mick Willing, of the NSW Counter Terrorism and Special Tactics Command.

After the discovery of the notebook in August, Mr Nizamdeen was wrongly accused of planning a potential attack on Sydney landmarks and plotting to kill former prime minister Malcolm Turnbull and his former deputy Julie Bishop.

However, authorities dropped all charges against the 25-year-old PhD student in a surprising about-face in October, when a handwriting expert found there was no "conclusive" proof that the writing in the notebook was Mr Nizamdeen's.

"We regret the circumstances which led to him being charged and the time he subsequently spent in custody," Assistant Commissioner Willing said.

"We feel very sorry for him and what has happened to him...[but] we had to act early at the time, given the threats contained in that notebook."

Assistant Commissioner Willing said he could not comment on whether Mr Khawaja had been the first person to report the notebook to police, or detail what led police to believe the notebook was part of a plan to "set up" Mr Nizamdeen.

He said there was no ongoing threat to the community.

He added that police had paid Mr Nizamdeen's court costs. It remains unclear if further compensation will be offered.

AFP Assistant Commissioner Ian McCartney said, despite the mistaken arrest of Mr Nizamdeen, investigators had always acted in good faith.

"I think it's fair to say this investigation is quite unique. We stand by the investigators and the decision they made at the time ... we have acted in good faith, we have acted expeditiously," he said.

In November, Mr Nizamdeen held a press conference in his native Sri Lanka, where he called out Australian authorities for "immature" and "unprofessional" conduct that violated "basic and fundamental human rights".

Mr Khawaja is scheduled to appear again before Parramatta Local Court on February 12.

Like Muslims don't get enough bad press you get a 39 yr old man not a teenager framing a guy on terror charges. He knew terror charges would be the one thing taken seriously. In terms of khawaja's career I don't think it should effect it.

Usman Khawaja has asked that his family’s privacy be respected and that due legal process be allowed to proceed unhindered after his older brother was arrested by New South Wales Police today.

Arsalan Khawaja, 39, was arrested in Sydney in relation to an investigation into a notebook found at the University of New South Wales, the contents of which subsequently led to the wrongful imprisonment of a UNSW employee.

He has been charged with forgery and attempting to pervert justice.

Usman Khawaja, who is in Adelaide as part of the Australia Test team as it prepares for the opening Test of the Domain Series against India starting on Thursday, is in no way linked to the investigation and he made a brief media statement today.

“It's a matter for the police to deal with,” he told reporters at Adelaide Oval today.

“Out of respect for the process, it would be inappropriate for me to make any further comments.

“I just ask you to please respect my privacy, and my family's privacy during this time.

“Thank you.”

Usman Khawaja is expected to occupy the pivotal number three batting berth in the upcoming Test against the world’s top-ranked team, but this week noted he would also be unfazed if asked to open the innings as was the case in Australia’s most recent Test campaign against Pakistan in the UAE.

"The only thing it affects is how fast I have to run off the field," Khawaja told Melbourne radio’s RSN when asked if he preferred opening to batting further down the order.

"You only get 10 minutes as an opener, which is a pain in the a***.

“I love batting number three because you often get a little rest, little breather, put your pads on nice and easy, watch the openers scurry off.

"But it doesn't make a difference whatsoever."

It's like he has no understanding of what kind of consequences muslims/pakistanis and his brother would have to face, I think he must have development issues cause no normal person does this.

The middle of Adelaide Oval has proven Usman Khawaja’s happy place in the past, now it shapes as a sanctuary for the batsman after the arrest of his brother for allegedly perverting the course of justice and forging a document.
Khawaja is set to take his place in Australia’s XI in the four-Test series opener against India, which starts on Thursday.

The batsman is being supported by teammates and Cricket Australia staff, while wife Rachel is in Adelaide with him.

Adelaide was the scene of one of Khawaja’s career highlights, when he scored 145 against South Africa in 2016.

He suffered a knee injury during Australia’s previous Test, played two months ago in the UAE, and had been racing the clock to prove his fitness.

The Queensland captain demonstrated great resilience and composure throughout that recovery process, as was the case during an epic 141 in October that helped Australia salvage a draw in Dubai.

“He’s a really calm, composed young man,” Langer said.

Khawaja read a prepared statement on Tuesday, asking the media to “please respect my privacy and my family’s privacy”.

The brother of Australian Test cricketer Usman Khawaja has been charged with trying to influence a witness over a case where he allegedly framed a love rival with a fake terror plot, police said Friday.

Arsalan Khawaja was released on bail in early December after appearing in a Sydney court on charges of forgery and attempting to pervert justice.

He was re-arrested on Thursday “after allegedly attempting to influence a witness” in the counter-terror investigation, a New South Wales state police spokeswoman told AFP. The 39-year-old was charged with breaching his bail conditions and influencing a witness in judicial procedures. He was refused bail ahead of his court appearance in Sydney later Friday.

Sri Lankan Mohamed Nizamdeen was arrested in August over a “hit list” written in a notebook, which outlined plans to kill then prime minister Malcolm Turnbull. But police released Nizamdeen in September and later dropped the charges after investigators could not link the handwriting in the notebook to him.

Investigators have said they believe Arsalan Khawaja set up his university colleague Nizamdeen in relation to a dispute over a woman.

The man wrongly imprisoned over the Arsalan Khawaja fake terror plot has told of how the incident made him feel “I am not worth anything” and plunged him into bouts of “existential crisis”.

Khawaja, 40, the lovelorn brother of Australian cricketer Usman Khawaja, on Friday conceded in court that he was set to be imprisoned over the bizarre saga.

Khawaja will next month learn his fate when he is sentenced in the District Court having pleaded guilty to four charges including perverting the course of justice after he attempted to frame two men for terror offences in 2017 and 2018.

His lawyers have pleaded for leniency, claiming he was mentally ill at the time, however the impact of his crimes have been laid bare in a victim impact statement tendered to the court.

Mohamed Kamer Nizamdeen’s once bright world was turned on its head in late August 2018 when he was arrested as part of a major terror investigation.

Khawaja took a notepad that belonged to Nizamdeen, a University of NSW colleague, and forged false entries.

Mr Nizamdeen said: “Khawaja’s heinous and devious actions are everlasting” after he was forced to spend 28 days in solitary confinement in a maximum-security prison.

He was branded a terrorist, sparking a ripple effect across his whole world including his family.

“I cannot find joy in the things that I used to do as I am constantly reminded of how violently and sudden my life was taken from me and I fear that it may happen again,” Mr Nizamdeen said.

He said his family spent $50,000 in legal fees and $40,000 in other expenses, only to be freed when handwriting analysis proved he wasn’t the author of the notes.

“I hold Arsalan Khawaja accountable for causing this irreparable grief, trauma and issues on me and my family,” Mr Nizamdeen said.

Among Khawaja’s fake manifesto were references to carrying out terrorist acts, jihad, recruiting for Islamic state and travelling to Sri Lanka for weapons training.

Mr Nizamdeen returned to his native Sri Lanka soon after he was cleared but said he was still treated with suspicion by authorities and his name had been permanently tarred.

He also angrily denied that he was involved in a “love triangle” with Khawaja and said Khawaja’s jealousy had no basis in reality.

Khawaja has said he wanted Mr Nizamdeen to be preoccupied with the accusations so he could get closer to Shakeela Shahid, a young woman who also worked at the University of NSW campus.

However Mr Nizamdeen was at the time seeing another woman who is now his fiancee.

Khawaja is facing a maximum jail term of 10 years and his barrister Phillip Boulten SC on Friday told the court that he accepted he was facing a lengthy prison sentence.

Khawaja sobbed openly as Mr Boulten described his remorse and how his acute mental illness contributed to the bizarre incidents.

The court heard he was suffering from borderline personality disorder and was experiencing auditory and visual hallucinations at the time.

“On the one hand, there’s little doubt that at the time the offender did what he did that he was suffering from mental illness,” Mr Boulten said.

“That it was enduring, severe and debilitating.

“He would never have done anything remotely like this if he wasn’t mentally ill. His mental illness was driving his thinking, it was preposterous. It was goal-orientated, but it was crazy.”

Khawaja will also be sentenced for a similar offence in January 2017 when he called the Border Watch hotline to make a false complaint about a man, who can only be known as M1.

M1 had dated a woman, who can only be known as F1 for legal reasons, who Khawaja had previously been in a relationship with.

Khawaja told the operator that M1 had expressed extreme religious views and attended a training camp in Pakistan in 2017.

According to a statement of agreed facts, Khawaja also made an anonymous internet report to the Border Watch website about M1 four months earlier.

“There is an escalation of the conduct, he’s had three cracks at it,” prosecutor Paul McGuire SC said.

Khawaja will be sentenced by Judge Robert Weber on November 5.

He's got borderline personality disorder like his lawyer said, I think being institutionalized in a mental illness facility makes more sense.

NSW District Court Judge Robert Weber said Khawaja's "unforgivable" actions had "real and dire" consequences for Mr Nizamdeen.

Khawaja was arrested and charged in late 2018 after a handwriting expert couldn't conclusively prove the plans had been written by Mr Nizamdeen.

He pleaded guilty last November to perverting the course of justice and dishonestly influencing a Commonwealth public official, and also admitted to forgery and inducing a witness to give false testimony.

The court has previously heard Khawaja had a "crippling fear of abandonment" stemming from the end of a previous relationship.

He quickly developed an "emotional connection" to the woman at UNSW and was "terrified" of losing her.

Khawaja apologised in court during a hearing in September, admitting he had been "a coward" for not coming forward earlier and sparing Mr Nizamdeen further suffering.

"The guy did nothing and I caused him a lot of pain," he said, sobbing in the dock.

Mr Nizamdeen was not only wrongfully imprisoned, but incorrectly labelled as a terrorist on the front page of a newspaper before police failed to find any evidence against him.

Khawaja's barrister, Philip Boulten SC, said his client had been diagnosed with borderline personality disorder and described the mental illness as "enduring, severe and debilitating".

But the judge said there could be no suggestion Khawaja's condition deprived him of the capacity to reason, citing a psychiatrist's evidence.

Khawaja had previously attempted to frame another man with similar allegations of terrorism after his ex left him for that man.

Mr Nizamdeen, who returned to Sri Lanka after the ordeal, has spoken out about how his life was ruined and called for an independent inquiry.

His visa for the US was cancelled as a result of the incident and he is now unable to visit his fiancee, who resides there.
