PML-N senior leader Khawaja Asif has been arrested by the National Accountability Bureau (NAB) in Islamabad, a spokesperson for the bureau, Nawazish Ali, confirmed on Tuesday.

"NAB Lahore has arrested Khawaja Muhammad Asif in assets beyond known sources of income case," Ali told DawnNewsTV.

According to the bureau's spokesperson, the PML-N leader had earlier been summoned for an inquiry but he failed to provide the required evidence.

The spokesperson said Asif held an iqama (work permit) from 2004 to 2008, adding that he earned a total of Rs136 million for his services as a consultant legal adviser.

Earlier this year, NAB and the Anti-Corruption Establishment (ACE) had initiated action against the close confidant of former premier Nawaz Sharif on the allegation of illegally establishing a housing project in his hometown Sialkot.

According to NAB, evidence shows Asif established the Kent Housing Society, which has been operating illegally.

In November, NAB had sought records from him regarding sources and local amount of funds invested in the project by him, his family members (wife and son) and other partners/close relatives.

NAB says the former foreign minister had in collusion with the management of the society illegally occupied various pieces of land owned by individuals who never sold their land to the society.

ISLAMABAD: Foreign Minister Shah Mahmood Qureshi urged PML-N leader Khawaja Asif to stop hiding behind the excuse of "political vendetta" and face accountability.

The foreign minister was holding the news conference with Adviser to Prime Minister for Parliamentary Affairs Babar Awan. He was reacting to Khawaja Asif's arrest in the assets beyond means case and the PML-N's strong reaction against it.

"Khawaja Asif was invited many times to present himself to NAB and satisfy the bureau," said FM Qureshi. "It seems as if Asif couldn't answer NAB's questions [related to assets beyond means]."

The foreign minister said that since yesterday evening — when Asif was arrested — a storm has erupted and Opposition parties have been saying that NAB has been exacting revenge on political rivals of the government.

"NAB is an independent institution and is not subservient to the government," he said. "The laws according to which NAB operares were not introduced by the PTI," added FM Qureshi.

The foreign minister said that people should refrain from speaking about a PTI-NAB nexus since the accountability bureau was an independent body.

"Only Khawaja Asif can shed light on why he was arrested," he said. "They say, 'If you asks us questions, we will lay a siege around you,'" said FM Qureshi, hitting out at the PML-N.

'Now we understand why Opposition wanted to amend NAB laws'
Continuing his tirade against the Opposition, FM Qureshi said every person was held accountable in respectable societies the world over. "Now we are understanding why they wanted to amend NAB laws," he said. "They had told us [the government] that if NAB laws are relaxed then [Opposition] will hold talks with us," added Qureshi.

He accused the Opposition of demanding an NRO from the government, adding that Khawaja Asif had been present in the FATF-relaed legislation meetings that took place between the government and Opposition.

He urged Khawaja Asif and other Opposition leaders to reply to NAB's accusations and expose them if they were indeed filthy. "But they don't have answers to NAB's questions," he said. "Imran Khan brought forth a 40-year-old record and appeared before the court," said Qureshi, adding that after weighing the evidence, the Supreme Court declared PM Imran Khan "Sadiq and Ameen'.

Babar Awan accuses Nawaz Sharif of laundering money
Awan spoke next, hitting out at PML-N vice president Maryam Nawaz for saying that Nawaz Sharif should not have been punished for holding an Iqamah.

"I want to explain to people the various advantages that come with holding an Iqamah," he said. "With an Iqamah, you can hold accounts in foreign banks," he added.

Awan said that Iqamahs are a residency permit that those who work abroad get. He said that money earned through illegal means is sent abroad and then brought back to the country by Pakistan's politicians.

"People who continuously live abroad become locals in foreign countries," he said. "However, why did Nawaz Sharif and Khawaja Asif felt the need to get an Iqamah?" he asked.

Awan said that Pakistan was that "unfortunate country" from where billions were stolen and stashed abroad. He accused the Opposition of making the NRO an excuse or their resignations from the parliament to escape NAB's accountability.

PML-N leader Khawaja Asif claimed on Wednesday that Prime Minister Imran Khan was "100%" behind his arrest, adding that this was an attempt to weaken party supremo Nawaz Sharif.

Asif was arrested by NAB Tuesday night in a case pertaining to acquiring assets beyond means of income. The party had gathered at PML-N leader Ahsan Iqbal’s house in the federal capital for a huddle which was being attended by PML-N Vice-President Maryam Nawaz.

Talking to reporters outside an accountability court in Islamabad, Asif had said attempts have been made to break the party in the last two-and-a-half years.

When a reporter asked Asif to elaborate on a statement made by Maryam claiming that the Asif had been told all cases against him would be written off if he stood against Nawaz Sharif, the ex-defence minister had said: “This is what we are all being told.”

Asif added that the case has been pending for over two years now. “I was given a charge sheet that assets increased but NAB has so far not investigated the matter. I have been facing this case for over two years, first in Rawalpindi then in Lahore.”

An accountability in Lahore on Thursday granted the National Accountability Bureau (NAB) 14-day remand of Parliamentary Leader of the PML-N in the National Assembly Khawaja Muhammad Asif.

The NAB prosecutor informed the court that Asif, who had been arrested from Islamabad on Tuesday, was facing charges of accumulating assets beyond known sources of income.

Asif had acquired assets in the names of his wife and children as well, the prosecutor said, adding that initially worth Rs5.1 million, Asif’s assets now amounted to Rs812.1m.

The prosecutor told the court that the PML-N leader had not disclosed the means through which he accumulated these assets and requested physical remand of Asif so that the investigation against the PML-N leader could be completed.


However, Asif's counsel objected to the request, maintaining that the case against his client was “baseless” and “false”.

Asif alleged he had been shifted to NAB's custody in Lahore because Prime Minister Imran Khan "couldn’t get the desired result when an inquiry was launched against him by the watchdog's Rawalpindi chapter".

Asif's counsel told the court that the NAB, Rawalpindi, had summoned his client multiple times and Asif had appeared before the anti-graft watchdog each time. Besides, he appeared before the NAB, Lahore, all five times he was summoned, the counsel added.

He said all records asked for by the NAB too had been provided, objecting to the watchdog’s request of a physical remand.

The court, however, sent Asif on a physical remand till Jan 13, directing the NAB to submit a progress report on the investigation at the next hearing. It further directed the watchdog to let Asif meet his relatives, adding that Asif must be presented before the court at the next hearing as well.

A NAB team had moved Asif from Islamabad to Lahore after obtaining his transit remand from an accountability court on Wednesday. Asif was arrested a day earlier from outside the Islamabad residence of another senior PML-N leader, Ahsan Iqbal, where the former had come to attend a party meeting.

The dramatic arrest of the firebrand opposition leader had prompted a strong reaction from his party, with PML-N vice president Maryam Nawaz alleging that NAB had acted like a “terrorist” and “kidnapped” Asif in the darkness of night.

PML-N supreme leader Nawaz Sharif, in a tweet, had condemned the arrest and termed it a result of the “nexus between the selectors and the selected”.

“Such belittle acts reflect the government’s state of panic, but it is moving even closer to its end through such actions,” he wrote.

On Wednesday, speaking to the media outside the court premises in Islamabad, Asif had claimed efforts PM Imran was behind his arrest and that efforts were underway to create a rift within the PML-N for the past two years.

Addressing a press conference later in the day, Foreign Minister Shah Mahmood Qureshi said Asif had been summoned by the NAB several times to come and answer questions to "satisfy" the anti-graft watchdog.

"It seems that he was not able to satisfy [NAB]. He could not give satisfactory answers to allegations against him regarding money laundering and assets beyond means. If he had given the money trail and an explanation, then maybe it would not have come to the point of arrest."

Charges against Asif

According to the NAB, investigations against the PML-N leader were initiated under Clause 4 of the NAB Ordinance 1999 and Section 3 of the Anti-Money Laundering Act 2010.

“Before assuming the public office in 1991, the total worth of Khawaja Asif’s assets was Rs5.1 million which increased to Rs221m in 2018 after serving on different posts which do not match with his known sources of income,” said a statement issued by the NAB.

“Accused Khawaja Asif claimed to have received Rs130m from a UAE firm M/s IMECO, but during the course of investigation, he failed to present any solid evidence of receiving this amount as a salary,” it said, adding: “This clearly shows that the accused tried to prove his income through fake sources.”

Moreover, the NAB alleged that Asif was also running a benami firm 'Tariq Mir and Company' which was registered in the name of his employee. It said that an amount of Rs400m was deposited in the account of Tariq Mir and no sources of this huge amount were disclosed.

ISLAMABAD: Advisor to the Prime Minister on Accountability and Interior Barrister Mirza Shahzad Akbar on Saturday said that PML-N parliamentary leader Khawaja Asif and his family have 48 bank accounts into which, since 2009, Rs507 million were deposited.

Briefing the media regarding the arrest of Khawaja Asif, he said the "method of looting" adopted by Khawaja Asif was same as his quaid (leader) — referring to PML-N supremo Nawaz Sharif — and which was also employed by Ishaq Dar and Shahbaz Sharif.

He was referring to telegraphic transfers of money between Pakistan and countries abroad.

Akbar said the assets of Asif multiplied in numerous cities of the country, especially during PML-N’s tenure, when he served various ministries.

"In 1993, Khawaja had only Rs5.1 million in assets, that too in the shape of his inherited house," said the premier's aide.

Asif's declared assets touched the Rs118-million mark in 2013 but on query he failed to explain any legitimate reason for the increase in assets, said Akbar.

He said that Asif had been receiving Rs2.2 million per month in salary from a Dubai firm during his stint as Minister for Water and Power and Minister for Defence from 2013-18. He claimed receiving a sum of Rs140 million in five years as salary in cash, Akbar added.

"Khawaja Asif was perhaps the world’s only employee who received millions in cash as salary," the premier's aide said.

Later, Asif transferred that amount from his Dubai account to Pakistan through Telegraphic Transfers (TT), Akbar said.

He said that the salary payment to Asif was stopped with the completion of the PML-N's five-year term.

"Khawaja Asif purchased a Rs80-million plot in Gujranwala in September 2014 and sold it to the same party after a few months for Rs40 million," said Akbar, also detailing numerous other "bogus" transactions.

No source was explained for transactions worth Rs507 million from the year 2009 to 2018, he said, adding that proving corruption was difficult in the absence of a documented economy.

Akbar said "under the law, the unexplained wealth of a public office holder is perceived to be corruption".

Responding to a question, he lauded the performance of the National Accountability Bureau (NAB) for making record recoveries as compared to recoveries made by the bureau during the PML-N regime.

LAHORE: An accountability court in Lahore on Friday rejected a National Accountability Bureau (NAB) request seeking a 15-day extension in PML-N leader Khawaja Asif's physical remand and issued orders for 14-day judicial remand instead.

Khawaja Asif had been arrested by the anti-graft watchdog on December 30, 2020 from outside Ahsan Iqbal's residence in Islamabad where he had come to attend a party meeting. NAB said the former defence minister was arrested in a case pertaining to accumulating assets beyond known sources of income.

The bureau presented Khawaja Asif before the accountability court's Judge Jawad ul Hassan today and sought a 15-day extension in his physical remand.

Khawaja Asif's counsel argued however that the accountability watchdog has finished the inquiry and is in possession of all records. The counsel further informed the accountability court that his client was cleared by the Supreme Court for holding an Iqamah in 2018 when PTI leader Usman Dar challenged his candidacy for the National Assembly.

The counsel contended that Khawaja Asif has already admitted to being employed by a company overseas, adding that the NAB should provide in writing what it wanted to investigate.

NAB prosecutor in turn informed the accountability court about the PML-N leader owning a restaurant abroad and transactions it deemed suspicious. He said Rs20 million were transferred into Khawaja Asif's account by Khawaja Sultan, Rs30 million by Rana Waheed and there was another transaction worth Rs20.8 million.

The prosecutor said both Rana Waheed and Khawaja Sultan had claimed the money was given to them by Khawaja Asif. To this, Khawaja Asif said that he can submit in writing that he received the amounts.

"Rs1.8 billion was transferred into his account which he said was for selling a plot. There are also transactions worth Rs100 million to foreign countries," said the bureau's prosecutor.

After hearing arguments from both sides, the bench rejected the anti-graft watchdog's plea for extension in physical remand and sent Khawaja Asif on a 14-day judicial remand instead

LAHORE: Pakistan Muslim League - Nawaz (PML-N) leader Khawaja Muhammad Asif on Saturday sought post-arrest bail from the Lahore High Court (LHC) in assets beyond means and a money-laundering inquiry initiated by the National Accountability Bureau (NAB) against him.

Asif contended that during his 22-day physical remand with NAB, he was not confronted with any direct or circumstantial evidence that would construct a case of owning assets disproportionate to his known sources of income.

The application, under section 24 (d) of NAO, filed by respondent Assistant Director NAB Muhammad Ikram, for seeking physical remand of the petitioner did not disclose any incriminating material supporting the alleged commission of a crime under section 9 (a) (v) of NAO.

"Mere ownership of property/assets did not constitute an offence under section 9 (a) (v). It is the failure to explain the source of funds that points towards the commission of the offence. The inquiry is being conducted on conjectures and surmises with a view to rope the petitioner into baseless and unfounded allegations" claimed Asif in his petition.

"In the absence of any plausible reason to reject the detailed explanation offered by the petitioner regarding his ownership of assets and source of income, this case is one of further inquiry and post-arrest bail should be granted", the petitioner further added.

Asif further stated that he had provided the respondents with an explanation of the various sources of income that adequately justify the acquisition of the assets presently owned, and which were owned by him in the past.

"Rejection of the explanation, without any reasonable ground, is itself evidence of the arbitrary exercise of power on part of respondents hence justifying interference by the court and grant of post-arrest bail."

The senior PML-N leader made the respondents NAB, its DG, and other officials involved in his post-arrest bail.

He prayed that the court would admit to his petition and that he is granted post-arrest bail in the stated matter.

NAB Lahore had also summoned the managing director of International Mechanical and Electrical Company (IMECO), a UAE-based international firm, in connection with the assets beyond means case against former federal minister Khawaja Asif, in January earlier this year.

LAHORE: PML-N leader Khawaja Asif has been released on bail in a money laundering and assets beyond means case.

The decision to grant the bail was announced by the Lahore High Court a day ago in exchange for bail bonds worth Rs10 million

Following the court's decision, prison officials on Thursday rushed to Jinnah Hospital where Khawaja Asif is admitted after undergoing surgery and handed over the bail orders to the hospital staff.

Commenting on the move, Kot Lakhpat Jail Superintendent Kashif Rasool said that the court's orders have been implemented and Asif is free to go.

Despite the bail orders, however, Khawaja Asif's lawyer Najam Al Hassan said that doctors have advised him to stay in the hospital for two more days for a complete recovery.

It may be recalled that Khawaja Asif was arrested on December 29, 2020, while he had filed a bail application on March 27, 2021.

Prime Minister Imran Khan on Friday appeared before a district and sessions court via video link from his office to record a statement in a defamation suit worth Rs10 billion filed against the Pakistan Muslim League-Nawaz (PML-N) senior leader Khawaja Asif.

While appearing via video link before Additional District and Sessions Judge Muhammad Adnan, the premier submitted an affidavit against the PML-N leader for levelling allegations of non-transparency, money laundering and use of anonymous companies in the Shaukat Khanum Memorial Trust funds.

On August 1, 2012, PM Imran said: Asif first made the allegations that Imran “had indulged in money laundering or had caused money laundering to be done or has approved the commission of money laundering through SKMT” in his press conference held at the Punjab House and later on the same evening at a private TV programme he repeated the allegations.

PM Imran said that Asif also alleged that he was said to be a person who played satta [betting] with the charity money.

“My life from a very early age has been an open book,” PM Imran stated in the affidavit. “The people of Pakistan have loved and admired me as a human being and have believed in my financial integrity despite whatever personal vilification regarding my early life as an international sporting superstar I have faced.”

The prime minister informed the court that Asif’s statements were “false and were made and published to injure my reputation”, adding that the statements subjected him to unjust criticism.

Apart from the defamatory tone and tenor of the defendant, the premier said that the PML-N leader alleged that he being the chairman of the Board of SKMT was personally responsible for making investments out of Zakat funds in a non-transparent manner through Benami companies set up to enable the non-transparent investment.

In the affidavit, the premier said that Asif claimed that he [Imran] had acted in a manner worse than the notorious “Double Shah” who defrauded a large number of people.

PM Imran added that Double Shah was the alias of a notorious fraudster whose case came to light a few years earlier and who had deprived thousands of people of their hard-earned savings by extracting funds based on false representations.

“Comparing me to the said Double Shah is the worst form of defamation that has been caused to me by the defendant [Asif],” PM stated. He added that the allegations made against him were pertaining to two sets of transactions made by the Endowment Fund of SKMT which were disclosed in the financial report for the year 2010, and published on SKMT website.

The first set of transactions made into an issue by the defendant related to ABN-AMRO Bank Notes, the prime minister stated, saying Asif portrayed the deposit of funds by the Endowment Fund in various ABN-AMRO Bank Notes as a suspicious transaction. He added that the deposit of funds yielded a return that is duly reflected in the financial statement for the year ended 2010.

The second transaction pertained to the investment made out of the Endowment Fund of SKMT of a sum of $3 million in Cinnabar – a company involved in a housing development project in Oman, and details of which were disclosed in the financial statement of SKMT.

“The investment decision was made by the Investment Committee of the Board of SKMT of which I was not a member,” PM Imran informed the court.

He maintained that “no Zakat money was utilised in this transaction and neither was any Benami transaction entered into”. Referring to the 2010 financial statement, he said, “Out of Rs807,018,400 that were collected as Zakat in the year 2010, not one rupee of Zakat was transferred to the Endowment Fund.”

On conveying the impression that an offshore company was equivalent to a Benami company, the PM stated that “this is absolutely not the case”, adding an offshore company is simply a company registered outside the jurisdiction where it is conducting its primary business.

“I could only have laundered money if, as is falsely alleged by the defendant, the donations and Zakat given by the public of Pakistan to SKMT were the proceeds of crime and that I and SKMT knew that these were the proceeds of such crime,” PM argued over the allegations of money laundering.

“The statement of the defendant that money laundering took place was completely false,” he said adding the Asif made the allegations knowing fully well that damage to his standing and esteem would hurt SKMT.

“The Defendant is liable to make good all the losses caused to my reputation and pay damages commensurate with such losses,” PM Imran added. “I conservatively estimate such losses to be a sum of Rs.10,000,000,000/- (Rupees Ten Billion Only) as damages, which may kindly be granted to me.”

The statement issued from the PM Office stated that running e-courts was a welcoming step as it saves time and money of the court and swiftly helps deciding cases.

“The judiciary and government agencies deserve commendation for the successful introduction of e-courts,” the primer was quoted as saying. He along with his counsel, Senator Waleed Iqbal, participated in the court proceedings from the PM Office, it added.

The Islamabad High Court (IHC) on Tuesday set aside an order of Additional District and Sessions Judge (ADSJ) Mohammad Adnan and issued a notice to Prime Minister Imran Khan seeking his response in a defamation case against Khawaja Asif over the PML-N leader's allegations about misappropriation of funds of Shaukat Khanam Memorial Trust (SKMT).

The premier had filed the defamation suit against Asif in 2012 for recovery of Rs10 billion as the latter had at a press conference levelled allegations about misappropriation of and money laundering through the SKMT funds.

In Dec 2021, the prime minister, while recording his statement before the digitally connected court, which was presided over by the ADSJ, said he was the biggest individual donor of the SKMT from 1991 to 2009 and the investments, against which allegations had been made, were fully recovered by the SKMT without any loss.

The legality of the statement was challenged by the PML-N leader in the IHC on Monday, arguing that the ADSJ had unilaterally closed his right of the prime minister's cross-examination. The petition stated that on December 17 of 2021, before the commencement of proceedings, the court was informed that Asif’s counsel was unable to appear because of sickness, but the ADSJ recorded the premier's statement in the absence of the defence counsel. The petition had requested the IHC to set aside the ADSJ’s order.

IHC Chief Justice Athar Minallah presided over the hearing for the petition today. He questioned that since when the case was pending.

Asif's counsel replied that the defamation suit was filed in 2012 and questions were formulated in 2021, to which the judge asked who was responsible for the delay when the court had ordered that defamation cases be disposed of quickly.

"Are you saying that the delay was caused by Imran Khan? The case is being delayed since 2012. It should have been decided in two months," the judge said.

The counsel responded that both parties had taken adjournments. He said the prime minister had not pursued the case initially and only started doing so later. He added that Asif was in the custody of the National Accountability Bureau for six months — from December 2020 to June 2021 — when the issues were framed.

He added that during that time Asif was unable to consult his lawyer and the ADSJ decided to proceed ex parte on account of the counsel's absence.

"The sessions judge's order is illegal, unsustainable and based on not reading the record," Asif's counsel said, adding that the ADSJ had acted without the authority of the law.

The court was requested to declare the lower court's order illegal and suspend it.

Subsequently, the IHC stayed the ADSJ from conducting proceedings until the next hearing and issued a notice to the premier. The hearing was adjourned to Jan 12.

He further stated that the court would order the trial court to decide the case within two months.

During the proceedings, the court asked Khawaja Asif's lawyer why he was postponing the case, claiming that he was unnecessarily delaying the case, cautioning him against doing so.

Referring to the premier's counsel, the court observed that it was the defandant's right to cross-examine the prime minister. It further maintained that the cross-examination should have been held the next day of the statement being recorded.

“The statement was recorded on December 17. How can the trial court terminate the right to cross-examine on the same day?” the CJ questioned.

Responding to the IHC chief justice, PM Imran’s lawyer aruged that Khawaja Asif had not appeared before the court for a year.

Earlier this month, PML-N leader Khawaja Asif had challenged the sessions court’s decision of not giving his counsel the right to present arguments in a defamation suit worth Rs10 billion filed by Prime Minister Imran Khan against him.

The prime minister last month submitted an affidavit to Additional District and Sessions Judge Muhammad Adnan via video link against the PML-N leader for levelling allegations of non-transparency, money laundering and use of anonymous companies in the Shaukat Khanum Memorial Trust funds.

The PML-N leader filed an application in the IHC against the lower court’s verdict and nominated PM Imran and the sessions court judge as respondents.

Former prime minister Imran Khan was fined Rs5,000 on Saturday for seeking an adjournment of the hearing in the Rs10billion defamation case filed against Defence Minister Khawaja Asif.

Additional Sessions Judge Adnan Khan imposed a fine of Rs5,000 on the Pakistan Tehreek-e-Insaf (PTI) chief for seeking an adjournment in the hearing due to his engagement in the party’s ongoing rallies.
