On Wednesday, February 14 when a protest rally was organized in Kathua against the arrest of Special Police Officer (SPO) accused of rape and murder of eight-year-old Asifa, chief minister Mehbooba Mufti took on to the virtual world to express her anger.

“Appalled by the marches & protests in defense of the recently apprehended rapist in Kathua. Also horrified by their use of our national flag in these demonstrations, this is nothing short of desecration. The accused has been arrested & the law will follow its course,” she wrote on social networking site Twitter.

The rally which Mehbooba condemned was led jointly by the leaders of her alliance partner BJP and Hindu Ekta Manch threatening agitation in the case accused SPO is not released.

As Mehbooba was “appalled” by the protest rally, her coalition partner BJP leaders were at the forefront in seeking the release of the accused and a CBI probe.

Surprisingly, the Hindu Ekta Manch, is headed by state BJP secretary Vijay Sharma.

Warning government of serious repercussions BJP’s district president Kathua P N Dogra said the arrest of SPO is an attempt to suppress the ‘nationalist’ people of Kathua and also said this is a form of ‘Jihad’ and an ‘injustice’ to the people of Kathua by the government.

“Every day there is a new story. 15 Days ago police said a juvenile was involved who even had confessed the crime, Dogra said and added that “we even had doubt on that.”

Terming the accused SPO as innocent, the BJP leader said “I will tell you the fault of SPO, he was part of the investigation in a very fair manner and he had tried to stop anti-national people who shouted Pakistan Zindabad slogans and asked them not to shout such slogans. This is why he is behind the bars.’

Dogra alleged that “this is the reason how Crime Branch is taking advantage and this is being done on directions of few people and is part of Jihad.”

Dogra said if it would have been fair, then “there should have been equal representation of Hindu and other community in the team.” And added that the person who is investigating the matter “has the bad track record.”

This he said is an attempt to frame the innocent people and this investigation should be handed over to CBI. “If the government won’t do it, it is flame today which can engulf everything tomorrow and it would difficult for government manage the situation.

Pertinent to mention, Crime branch is headed by ADG Alok Puri.

Prominent among the BJP leaders who have taken part in protests is Rashpal Sharma, who was appointed by Mehbooba led coalition government as Vice Chairman of Jammu and Kashmir State Advisory Board for Welfare and Development of the Other Backward Classes in August 2016 and MLA Hira Nagar Kuldeep Varma.

Congress leaders of the area are on the same page with BJP. Taking part in the protests, the district president of Kathua Congress Committee and ex-MLC Subash Gupta along is also part of the Hindu Ekta Manch. The other Congress leaders prominent in the protests are former MLA Girdhari Lal and former MLC Subash Chander.

The Hindu leaders of the area in a meeting of Manch in Parshu Ram Temple have decided to boycott the Gujjars and has sought that the purchase of milk products and livestock from them should be stopped. “No one will sell any land to nomads (Muslims). Whosoever will be found even giving them fodder will have to face social boycott.”

Seeking release of accused, the Hindu leaders appealed to the people of the area that “they should not buy milk or live stocks from the nomads.” “They want to change the demography of the area and we will not allow them. We should unite to stall their business activities too.”

However, both Sharma and Varma have denied that they have boycotted nomads, but confirmed to be part of the meeting.

However, Congress’s Gupta has also admitted of attending the Manch meeting and said that “we are of the opinion that the accused in rape and murder case of Asifa Bano should be put behind the bars but innocent people also not be harassed for the sake of investigation.” “We should not support any attempt to disrupt peace,” he added.

The social sites reacted to the protest march and posed questions on the chemistry of the ruling coalition.

In response to the tweet of CM Mehbooba, National Conferences spokesperson Junaid Azim Mattu wrote “Madam the march was led by a BJP leader. You are in an alliance with them and you are culpable in this desecration by association. You speciality of eating the cake and having it too is crossing a very intolerable limit.”

A netizen Farooq Lone commented on Facebook alleging government of treating two communities differently. “When bakerwal community protested against the dastardly rape and murder of little girl they were lathi-charged and chased. Police escorted the goons who were out on roads to protect the criminal.”

Replying to series of tweets about the incident, Anil Pandit wrote on Twitter “Asifa of Kathua is daughter of India. We spit on them who stood for accused. Why don’t you pose this question to Home Minister of J&K. Ask her why is she accommodating this SP. During his tenure as SP Udhampur two Kashmiris were burnt alive and now this episode happened.”


The Crime

The budget session of assembly was in session when Rasana, a sleepy village far away from Jammu, in Kathua lost its sleep when body of missing eight-year-old girl was found, mercilessly done to death, seven days after she disappeared mysteriously, one km down her hill house where she had taken the horses to a ditch.

The family of the girl alleged she was raped and tortured before her tiny body was dumped on a roadside. It took several protests by the family, the intervention of lawmakers and a continuous reportage that government acted by suspending the local SHO.


The Investigation

The first response was police came to the Bakerwal family only to mourn the death. With uproar in assembly and protests by the family, the SHO was suspended and magisterial inquiry was ordered.

Later police claimed of solving the case by arresting a 15-year-old boy for his involvement in the crime. However, it was alleged to be the cover-up for the real culprits. After the allegation and the dissatisfaction, the case was handed over to the crime branch, which then set up an independent five-member Special Investigation Team (SIT), led by Additional SP Crime Branch Kashmir Peerzada Naveed.

The questioning of arrested minor bot led SIT to arrest SPO Deepak Khajuria and SPO Surinder Kumar. Surprisingly, Khajuria was part of the police team that searched for the missing girl and even part of the party which handed over the body to the family.

Sources said this was done to create fear among the members of the Gujjar community so that they would leave the area.

The local tribal leader told Kashmir Life that the crime was perpetuated deliberately on the minor to scare away the minuscule Muslim community in the area.

‘’Actually, the majority community does not want Muslims to stay there even on their genuine lands. The idea is to frighten them and dispossess them of their land and property. This is an RSS plan,’’ he alleged. He linked the incident with the literal banishment of Gujjars from the forests and, later, setting fire to their properties even outside the woods. The lower Jammu districts of Samba and Kathua have a 2 and 4 percent Muslim population respectively.

Forget about outrage over 8-yr-old Ashifa’s rape, a rally was held in support of the accused. BJP supports the rally, a Cong official is part of it, Mehbooba shows little concern & public outside J&K is not enraged. Why? Because Ashifa was Muslim & Kashmiri.
 
Restrictions imposed in Hiranagar area of Kathua after rally to support rape-and-murder accused

The district administration Kathua on Monday imposed restrictions on assembly of more than four people in Hiranagar sub-division after a rightwing Hindu organization took out a rally to support a Special Police Officer (SPO) accused of rape and murder of a minor girl.
The District Commissioner Kathua Rohit Khajuria, in his order, citing the reason for the restrictions said that a heinous crime was committed against a minor, which is being investigated, and some people are trying to foment trouble in the district by raising undue demands.

“Whereas peace and tranquility is mandatory for the progress and development of the district. Whereas, it is also necessary and important for the education of the children in view of the crucial time of annual examination of different levels,” read the order.
It said that the investigation has already been entrusted to the crime branch of J&K Police by the govt and the investigation is under progress.
“Whereas it has been observed that few persons are fermenting trouble by raising undue demands which are not the mandate of district administration and such actions by these persons are causing interference in the ongoing investigations as well as destroying harmony in the dist and hence undesirable,” the order read.

“Now, therefore, to maintain harmony and law and order in sub division Hiranagar, I Rohit Kajuria, DC Kathua hereby impose restrictions under section 144 of CrPC in the jurisdiction of sub division Hiranagar for a period of one month from the date of issuance this order preventing the Assembly of four or more persons with exceptions of funerals, marriage parties and govt functions,” it said.
On February 16, the activists of Hindu Ekta Manch took out a protest rally from Ghagwal to Hiranagar in support of the accused cop Ravinder Khajuria.

Why are these Hindu radicals marching in support of someone accused or rape? Do they feel he's innocent or it was ok for him to do what he is accused of?

I can’t believe what I am reading this is the utmost shame for the entire nation, let the probe end case go to courts and the guilty should be hanged if he is innocent he will be set free..But so much politics over it..

I hope the girl gets justice and her murderers and hanged whoever it may be..

They are playing politics saying he’s innocent and is being framed.. Basicaly it’s religion based politics being played at the expense of a rape and murder of an 8 year old kid.. Rather than protesting against the rapes and asking police/investigating agency/judiciary to catch the culprit ASAP and hang him they are protesting against release of accused.. Even if he was framed he would be released by courts will these activists protest to get the real culprit caught?
 
This was reported in the Indian Express, so I'll believe this as it seems ridiculous at first read. So a 15 year old was first accused and he "confessed". Then an SIT was set up and the result of that was the arrest of the cop. Local Hindus started protesting claiming that he was innocent and arrested under pressure. Local leaders who took part in these protests include BJP and surprisingly Congress leaders. Irrespective of whether there is any truth to the framing conspiracy, it makes them insensitive fools to take out a march when members of the victim's family probably are from the same area.

This is very disturbing, sure people have issues over religion and politics but any civilised human being would put those to one side when rape and murder of a child is in question.

It’s shameful and disgusting.. Can’t put my disgust here in words as post will be deleted by mods..

Imagine there is 1% chance the dude is guilty and due to these protests and pressure he gets released, imagine letting a rapist free in society, tomorrow he might rape someone else..

Let the law take its own course but no everything’s has to be politicised in our country..
 
Assault and murder of 8-year-old Asifa Bano in Kathua (J&K) leads to protests by Hindu nationalists

NEW DELHI — In early January, Asifa Bano, an 8-year-old girl in a purple dress, was grazing her horses in a meadow in northern India. A man beckoned her into a forest. She followed.

According to the police, he grabbed her by the neck and forced her to take sleeping pills. With the help of a friend, they say, he dragged her to a nearby temple and locked her inside.

For the next three days, the police say, the two men and at least one other raped her, again and again. They told investigators that their motive had been to drive Asifa’s nomadic community out of the area. In the end, she was strangled, after one of the men allegedly insisted on raping her one last time.

Days later, Asifa’s crumpled body was found in the forest, in the same purple dress, now smeared with blood.

Eight men have been arrested in connection with the case, and several have confessed, according to the police in the state of Jammu and Kashmir, where the killing took place. Two of the accused are police officers said to have accepted thousands of dollars to cover up the crime. One of the arrested suspects said he was 15, though police officers, based on a medical examination, believe he is at least 19.

It seemed another isolated, horrific episode of sexual violence in India, perpetrated against a powerless girl by brutal men. But in the months since Asifa’s murder, the case has become another battleground in India’s religious wars.

Hindu nationalists have turned it into a rallying cry — not calling for justice for Asifa, but rushing to the defense of the accused. All of the men arrested are Hindu, and Asifa’s nomadic people, the Bakarwals, are Muslim.

Some of the police officers who investigated the case are also Muslim, and for that reason, the Hindu activists say, they cannot be trusted.

This week, a mob of Hindu lawyers physically blocked police officers from entering a courthouse to file charges against the men. The officers retreated to a judge’s house later in the evening to complete the paperwork.

Protests and counterprotests are now spreading. On Wednesday, much of Kathua, a small town in northern India near where Asifa was killed, was shut down by demonstrators, including dozens of Hindu women who helped block a highway and organize a hunger strike.

“They are against our religion,’’ said Bimla Devi, one of the protesters. If the accused men aren’t released, she said, “we will burn ourselves.’’

Police officials say they have physical evidence and DNA tests linking the defendants to Asifa’s death. They also say they have interviewed more than 130 witnesses, who “unequivocally corroborated the facts that emerged.’’

Several prominent members of India’s dominant political force, the Hindu nationalist Bharatiya Janata Party, are pushing to have the case taken out of the hands of the state police, arguing that the Central Bureau of Investigation would be a better, more neutral agency to handle it. Many suspect this is an attempt to win leniency for the accused, noting that the bureau is an arm of the central government, which the Bharatiya Janata Party controls.

That a Hindu temple is at the center of the crime makes this case even more combustible. The police say that Sanji Ram, the temple’s custodian, devised the plan as a way to terrorize the Bakarwals, and that he enlisted a nephew and some friends to kidnap and kill Asifa. The police say the culprits selected Asifa simply because she was by herself and “a soft target.”

For generations, Bakarwal nomads, who drift with their herds across the plains and hills of northern India, have leased pastures from Hindu farmers for their animals to graze in winter. But in recent years, some Hindus in the Kathua area have begun a campaign of abuse against the nomads. Villagers said Mr. Ram was their ringleader.

“His poison has been spreading,’’ said Talib Hussain, a Bakarwal leader. “When I was young, I remember the fear Sanji Ram’s name invoked in Muslim women. If they wanted to scare each other, they would take Sanji Ram’s name, since he was known to misbehave with Bakarwal women.’’

Feelings between the two communities are so bitter that when Asifa didn’t return from the meadow, her parents immediately suspected that something terrible had been done to her.

They enlisted the police and went to the small temple run by Mr. Ram works. He insisted that he had not seen the girl. The temple was locked. According to the police, at that moment Asifa was being starved inside, hidden under a table and some plastic mats.

Mohammad Yusuf Pujwala, Asifa’s father, said his daughter was killed for one reason: to drive the Bakarwals away.

“But we have land here and life here,’’ he said. “This is home for us.’’ He sounded almost too tired to grieve.

He said Asifa had never been to school, even though her brothers had. Her favorite thing to do was play in the meadow.

Asifa Bano: The child rape and murder that has Kashmir on edge

The brutal gang rape and murder of an eight-year-old girl in Indian-administered Kashmir has put the restive state on edge. Sameer Yasir, an independent journalist based in Srinagar, reports on how the investigation has split the region along religious lines.

On the morning of 17 January, Muhammad Yusuf Pujwala was sitting outside his home when one of his neighbours came running towards him. He stopped in front of Mr Pujwala and broke the news: they had found his eight-year-old daughter, Asifa Bano. Her body lay in bushes in the forest, a few hundred metres away.

"I knew something horrible had happened to my girl," Mr Pujwala, a 52-year-old with deep sunken eyes, told the BBC in an interview recently. His wife, Naseema Bibi, sat beside him, faintly crying while repeatedly murmuring "Asifa".

Mr Pujwala belongs to a community of Muslim nomadic shepherds called Gujjars who crisscross the Himalayas with their goats and buffaloes.

The crime has shocked the community, exposing the fault lines between Hindu-majority Jammu and the Muslim-majority Kashmir valley in a sharply divided state. The Kashmir valley has a tumultuous relationship with India - there has been an armed revolt in the region against Indian rule since 1989.

Police have arrested eight men, including a retired government official, four police officers and a juvenile in connection with Asifa's death.

However, the arrests sparked protests in Jammu - lawyers tried to stop police entering the court to file a charge sheet and two ministers from the Hindu nationalist Bharatiya Janata Party (BJP) attended a rally in support of the accused.

The BJP rules the state in a coalition with the regional People's Democratic Party (PDP).

When she went missing on 10 January, her family was living in a village around 72km (45 miles) east of Jammu city. On that afternoon, her mother recalls, Asifa went to the forest to bring home the horses. The horses returned but Asifa did not.

Ms Naseema informed her husband. He and some neighbours started looking for her. Armed with flash lights, lanterns and axes, they went deep into the forest and searched through the night. But they could not find her.

Two days later, on 12 January, the family filed a police complaint. But, according to Mr Pujwala, the police were not helpful. One of the police officers, he alleges, said Asifa must have "eloped" with a boy.

As news of the crime news spread, Gujjar staged protests and blocked a highway, forcing police to assign two officers for the search. One of those who was assigned, Deepak Khajuria, was himself arrested in connection with the crime.

Five days later, Asifa's body was found.

"She had been tortured. Her legs were broken," recalled Ms Naseema, who had rushed to the forest along with her husband to see the body. "Her nails had turned black and there were blue and red marks on her arm and fingers."

What do investigators believe happened?
On 23 January, six days after Asifa's body was found, the Jammu and Kashmir chief minister, Mehbooba Mufti, ordered a investigation by the crime branch, a special unit of the state police.

According to the investigators, Asifa was confined in a local temple for several days and given sedatives that kept her unconscious. The charge sheet alleges that she was "raped for days, tortured and then finally murdered". She was strangled to death and then hit on the head twice with a stone.

Sanji Ram, a 60-year-old retired government officer, allegedly planned the crime with the help of police officers Surender Verma, Anand Dutta, Tilak Raj and Mr Khajuria.

Mr Ram's son, Vishal, his nephew, a juvenile, and his friend, Parvesh Kumar, are also accused over the rape and murder.

Investigators allege that Mr Khajuria and the other police officers - some of whom lodged the complaint and accompanied the family in the search - washed Asifa's bloodied and mud-spattered clothes before sending them to a forensic lab.

They believe that the accused men wished to terrorise the Gujjar community into leaving Jammu. The shepherds use public and forest land in Jammu for grazing, which has recently brought them into conflict with some Hindu residents in the region.

"It was about land," said Talib Hussain, a tribal rights activist and lawyer. Mr Hussain, who led a protest in support of Asifa's family, alleges he was arrested and threatened by local police.

Ankur Sharma, one of the lawyers who protested on behalf of the accused, alleged that the Muslim nomads were trying to alter the demographics of Jammu, where Hindus are currently the majority. "They are encroaching our forests and water resources," he told the BBC. He said the accused had been falsely implicated while the real culprits were still free.

While the crime did not receive much attention in Jammu, newspapers in Srinagar, the capital city located in the Kashmir valley, carried the story on their front pages.

In Jammu and Kashmir state assembly, Mian Altaf, an influential Gujjar leader and an opposition legislator, waved the newspapers with photographs of Asifa while demanding an inquiry. Rajiv Jasrotia, a BJP lawmaker, said the incident was a "family matter" and blamed Mr Altaf for politicising the crime.

What happened at Asifa's funeral?
The Gujjars wanted to bury Asifa in a graveyard where they had purchased some land a few years ago and had already buried five people but when they arrived there, Mr Pujwala said, they were surrounded by Hindu right-wing activists who threatened them with violence if they were to continue with the burial.

"We had to walk seven miles to bury her in another village," Mr Pujwala said. Two of his daughters were killed in an accident some years ago. On his wife's insistence, he adopted Asifa, the daughter of his brother-in-law.

His wife described Asifa as a "chirping bird" who ran like a "deer". When they travelled, she looked after the herd.

"That made her the darling of the community," Ms Bibi said. "She was the centre of our universe."

This news made me sick. I hav been thinking about it all morning.

Before killing the girl, one police officer wanted to rape her one last time. All joined in.

Then they killed her.

My blood boils.

There is a special place in hell for the perpetrators.

See, call me a cynic, but these tweets by "celebrities"...how much of it is actually their own opinion. They are just playing the party line, so to speak.

The fact that these tweets are out means that the climate is being prepared. Popular opinion is being shaped. This case is one which they could not wriggle out of, so they have to calm the mob.
 
Not only is the crime revolting but those coming to the defence of the perpetrators.
 
The more disturbing as aspect is the collusion of authorities to cover this up.
 
On the forum we have a good Ind posters who put their humanity above group identification. Its a shame their are not more of them in Ind and i hasten to add, same goes for PK.

When I read the thread title that this rape and murder led to protests by Hindu nationalists I thought they may have been protesting against the perpetrators like normal humans would but they are actually protesting in support of the killers. So sad!

Muslim rape-murder case in India disrupted by Hindu groups

When police in northern India went to court on Monday to file charges implicating eight men in the rape and murder of a Muslim child, they were confronted by dozens of Hindu lawyers determined to keep them out.

The killing of eight year-old Asifa Bano, details of which were released on Wednesday, and ongoing efforts by Hindu groups to disrupt the police investigation have sickened many Indians and deepened concerns about a growing sense of impunity among religious nationalists.

Asifa, a member of a nomadic Muslim tribe, was grazing horses on 10 January in Kathua, a district of Jammu and Kashmir state, when a farmhand lured her away. She was confined in a small Hindu temple, drugged, raped for five days by a group of men and killed with a rock.

Police allege the crime was intricately planned by Sanji Ram, the temple custodian, who they say agreed to pay local officers 500,000 rupees (£5,400) to create false evidence that would lead investigators away from him and his men.

Ram had been a staunch opponent of the settlement of the Muslim tribe, known as the Bakarwals, in the area, and saw Bano as a soft target in a plot to frighten the group into leaving, police said.

The arrest of Ram, his men and several police officers quickly took on religious overtones in Jammu where, as in other parts of India, rightwing Hindu groups have become increasingly active.

In February, state ministers and senior officials from the ruling Bharatiya Janata party (BJP) helped to form a protest group that marched through Kathua waving Indian flags and demanding the release of one of the accused officers.

They argue that because some of the investigating officers in the case are Muslim, they cannot be trusted to be impartial. They called for the case to be transferred to the Central Bureau of Investigation, an agency overseen by the national government.

The prime minister, Narendra Modi, a staunch Hindu nationalist, is yet to comment on the case or the involvement of his party’s ministers and officials in protests in support of some of the accused men. On Thursday he and other senior BJP officials were holding a daylong fast in protest at obstruction by the opposition in the Indian parliament.

Criminal cases have been registered against more than 40 lawyers for trying to prevent the police from filing the charges on Monday. The district bar association released a statement in support of the protests, saying the government had failed in “understanding the sentiments of the people”.

Violence between Muslims and Hindus, and between Hindu castes, has been commonplace in the seven decades since Indian independence. Modi’s critics say his rise to power has emboldened extremists who share his Hindu nationalist ideology.

In December, a Rajasthan man ranted about Hindu nationalist causes as he filmed himself killing a Muslim migrant labourer using a pickaxe. Last month a Hindu religious procession in Jodhpur city included a float that appeared to honour the killer.

Ranjana Kumari, an activist and the director of the Centre for Social Research, said the silence about Asifa’s murder from national political leaders was horrendous. “It is for political advantage with an election year in 2019,” she said. “It really is the lowest thing.”

I have zero hope for this country in my lifetime it’s goig to remain a hell hole and after I die I could care less if it becomes a super power or not.. The people of this country have destroyed the most beautiful and diverse country in the world.. Such a shame

You know what’s shocking is not the crime - as revolting and heinous as it is because these crimes have very sadly been happening a lot recently.

It’s the reaction to the crime that sickens me. Playing politics and mixing religion is going to a new low.

Let’s get one thing straight - this reported crime is just the tip of the iceberg in Kashmir.

Now compare this story to the reaction to Afridis tweet. The Indian media reaction was beyond hysterical but now they have total egg on their face.

All I want to know is What did Afridi say that was wrong, let alone controversial ??

People are slowly waking up to the reality of what India truly is, and what it has become under Modi and Hindutva. The comments of media outlets are full of white indigenous folk who are absolutely ripping India, Modi, and his apologists to pieces. It has gotten to the stage where the typical deflection/comparative to Pakistan tactic is not even working.

Children throwing stones are accused of being terrorists, then murdered and maimed by the Indian Army, and it seems even innocent children, who are simply enjoying life, are not spared either.

This story is an absolute tragedy for humanity, and a complete and utter PR disaster for India.

The Indian media and even the Indian public outraged by the incident are only focusing on one aspect of the monstrosity which is the rape and murder of the child but are perhaps consciously or subconsciously ignoring the fact that this was a calculated, cold-blooded hate crime on a little Muslim girl designed to terrorise the community and is symptomatic of the rising intolerance in India in recent years. But despite their best efforts the incident has brought to light to the rest of the world the plight of Muslims in Indian Occupied Kashmir and the dangers of Hindu extremism.
