LAHORE: Intelligence sources have claimed they found strong evidence linking Zeeshan Javed, the car driver killed along with three members of a family in Sahiwal earlier this week, to a terrorist group.

Pictures of Zeeshan with Usman, a terrorist who was gunned down by the Counter Terrorism Department (CTD) in an encounter in Faisalabad on January 15, were found in Zeeshan’s phone, intelligence sources said.

Moreover, the sources claimed the car under use by Zeeshan had been purchased in the name of Adeel Hafeez, another terrorist who was also gunned down in the January 15 encounter.

On January 19, four people – including three members of a family – were killed in an alleged encounter in Sahiwal. CTD personnel said they had killed a local commander of militant organisation Daesh and three others in the operation. Eyewitnesses, however, disputed the claim and said the people in the car did not fire at officials, nor were any explosives recovered from the vehicle.

The dead included a man, his wife and their teenage daughter, as well as Zeeshan, who was driving the car.

A Joint Investigation Team formed to probe the Sahiwal killings, in its initial report submitted to Punjab chief minister on Tuesday, mentioned negligence on part of the CTD officials. The report added that there was no link between the Khalil family killed in the incident and terrorism.

The way the operation was conduct has little to do with the government in charge and much more with the attitude of "our" security forces and their way of dealing with things. The security forces are already well "experienced" in conducting counter-terrorism activites since they have been involved in this "war on terror" since over a decade. This is how the things had already been working before the current "Madinah" state. It only got exposed real bad with no place to hide.

When they can openly massacre a whole family in broad daylight on a busy road, no one can convince me that this incident was a one off and normally the security forces take extreme precautions to avoid any harm to the innocent. You just don't start shooting at a bunch of people without first checking who they are, unless you have a habit of doing so. It is just their "luck" that usually these operations are conducted in remote areas where very few eyes are watching.

It is not a secret that the security forces like to and have been working independently from the ruling government. However when Imran Khan came to power he claimed that every institution will be under the state's control. Now the whole public and Imran Khan himself has seen how little regard the security forces have with respect to innocent lives and how carelessly they conduct such operations under the disguise of "counter-terrorism" and what lies they come up with to justify them.

So I can forgive the current government for not knowing any better beforehand. Though now they do. If the government is really any better than the ones before it then it should not only punish the guilty but also take serious measures to hold the security forces accountable for each operation they conduct. There should be within the armed forces an independent system to verify the claims and make sure that everything was done to the fullest to prevent any innocent bloodshed. No more abducting of suspects without a proper procedure and an independent authority to report to.

This is a very controversial topic. At one hand we have wannabe Desi "liberals" who bash the security forces at any oppertunity and then we have blind devotees who equate any criticism as treason. I am a firm believer in actio = reactio, what goes around comes around. The security forces had been independent for far too long, they need to be properly controlled, managed and held responsible for our own good and the welfare of the nation. There is only a certain limit to which crimes and transgression can go on without having serious repercussions.

We should bash the government and Imran Khan if they fails to bring real change and unable to draw clear boundaries for the armed forces but not beforehand. I would give them a bit more time.
 
LAHORE: The Lahore High Court on Thursday summoned members of the joint investigation team (JIT) on February 4, who have been tasked with probing the Sahiwal encounter which lead to the killing of four people.

On January 19, four people — including three members of a family — were killed in an alleged encounter in Sahiwal. Counter Terrorism Department (CTD) personnel said they had killed a local commander of militant organisation Daesh and three others in the operation. Eyewitnesses, however, disputed the claim and said the people in the car did not fire at officials, nor were any explosives recovered from the vehicle.

The dead included a man, his wife and their teenage daughter.

During the hearing, LHC Chief Justice Sardar Muhammad Shamim Khan asked Punjab Inspector General (IG) Amjad Javed Saleemi, how far along was the investigation was into the incident.

To this, the petitioner's lawyers told the court that statements of all the witness have not been recorded.

“How was the police allowed to fire,” the chief justice asked the IG. To this, the inspector general told the court that those responsible have been arrested and a JIT has been formed to probe the incident. "CTD officials involved in the incident have been suspended.”

When asked how long the investigation will take, the IG Saleemi said the investigation will take 30 days to complete.

Moreover, the chief justice told the petitioner that the provincial government does not have the power to form a judicial commission, the federal government does. To this the petitioner replied, a request by the federal government has been submitted.

Furthermore, the judge formed a two-member bench for the hearing of the case and summoned members of JIT at the next hearing. The court also warned that an incident like this should not happen again and that all district police officers should be made aware.

A day earlier, Prime Minister Imran Khan had said if the need arises, the formation of a judicial commission on the Sahiwal killings could be considered. Stating that the incident was being probed by JIT, the premier assured that the findings would be shared with the nation.

I agree but if the all the guys in the car were terrorists rather than just one( going on what the REPORTS are saying), then the Police will be very nervous because when cornered these terrorists do blow themselves up along with anyone trying to catch them. What do you do then?

So the police thought why not kill the passengers themselves rather than giving the terrorist a chance to kill them? Sorry do not agree.



Even if there was UBL in the car the police's standard operating procedure should have been to apprehend him alive. An alive terrorist is a bigger source of info than a dead one. Just recall how arrest of ONE Indian spy, Kulbushan Yadav, resulted in so many arrests and terrorist attacks in Karachi plummeted.
 
You can't complain about drone bombings (US Imperialism aside) causing civilian casualties on one hand whilst justifying the cold blooded murder of children on the other.
 
Sahiwal tragedy: Opposition dissatisfied with PA briefing, demands judicial commission

LAHORE: Opposition has expressed dissatisfaction over the briefing given in the Punjab Assembly on Sahiwal killings and demanded formation of a judicial commission to further probe the incident which claimed lives of four citizens.

Hamza Shehbaz said that the culprits behind the Sahiwal killings will be found out through the judicial commission, calling the Joint Investigation Team ‘a waste of time’.

“The nation is anxious to find out what is happening… The seriousness of the government can be judged from the fact that the chief minister was not present in the Punjab Assembly session,” he said.

The Opposition leader’s political heir said that the Sahiwal issue should not become a hostage to politics.

“The day Model Town tragedy happened, Rana Sanaullah resigned from his post,” said Hamza Shehbaz.

Earlier in a Punjab Assembly session, Home Secretary Punjab Fazeel Asghar provided 'evidence' of deceased Zeeshan's involvement in terror activities.

Meanwhile, Prime Minister Imran Khan summoned Punjab Chief Minister Usman Buzdar to discuss the alleged Sahiwal encounter. According to sources, the premier has sought details from the chief minister over the incident and will discuss the initial report submitted by a joint investigation team probing the killings.

So in this case the public is left with no other option than to just cross their fingers and hope you don't ever hire a driver who happens to be on the police's radar.

There are so many plot holes in this story that it's to early to start moralizing the whole incident. Still let's try to humor the excuses. Apparently they had been following them from Lahore and if a suicide blast was really their main concern then they weren't actually holding a secure distance when they decided to engage the alleged terrorists.

This is where intelligence work comes in handy. At one hand the alledged suspect is supposed to be "deputy" in charge of daesh and at the same time the surveillance on him is so bad they can't tell what he is up to or when he is traveling with kids on board. I also highly doubt deput leader of terrorists groups indulge in suicide attack kind of operation. I am willing to bet such "VIP" people tend to remain in their hideouts with very little outside interaction.

How often have Americans distraught home grown terrorist plots by properly surveilling the suspect. Perhaps there is a thing or two our agencies could learn from them instead of just looking to buy more military equipments from the Americans.

Our institutions are very good at coming up with excuses to save their rear rather than to own up to their failures and short comings. The way the story developed in itself is disgusting and frightening. From 4 terrorists killed to terrorists using innocents as human shields. When in reality all those who were involved in the operation and shot the weapons knew than and there that they messed up. Though since their is no sense of responsibility or regard for innocent lives the normal reaction was to cover it up with lies and excuses until it was not possible to hide.

Now consider how in this incident the public was fortunate enough to get to the truth and catch the liars. Now imagine what if the incident had happened at night in a remote area with not so many eye witnesses. Would the security forces have enough sense of responsibility and dignity to communicate to the public that they made an honest mistake and will be accommodating the innocent victims? Of course not! While we the ignorant and gullible public would be celebrating the death of 5 hardcore and dangerous "terrorists".

Isn't there a common joke where an elephant gets lost from the zoo and the Pakistani police takes a goat into custody and after a round of healthy interrogations the goats comes out and admits being the elephant that was lost. It might be humorous and funny but now things have gone too far and need to brought back under control.

Perhaps not the actual parties involved but at least the message of this poem should be relevant for us.

Isn't this unprofessionalism of the highest level? If everyone even was terrorist which is not something for police to decide counter-terrorist division must have a plan to capture them alive.
 
LAHORE: The spokespersons for the President House and Senate on Saturday rejected reports of calling and scheduling a meeting between President Arif Alvi and Senate Chairman Sadiq Sanjrani with the family of a man who was killed in the alleged Sahiwal encounter.

"No meeting was set up with deceased’s family," the President House spokesperson said.

"The Punjab government has been tasked with investigating who brought the family to Islamabad," the spokesperson added.

The Senate spokesperson also rejected the family's claims of a scheduled meeting with Sanjrani and said, "The chairman did not call the family nor did we receive any request from them to meet him."

"We will ask the Punjab government for a clarification regarding this matter and apologise to the affected family if they faced any trouble," the Senate spokesperson added.

On Friday, Jalil, the brother of Khalil who along with his wife and teenage daughter was killed in an alleged encounter in Sahiwal on January 19, lamented he and his family were called to meet President Arif Alvi in Islamabad, however, after hours of waiting they were told the president is out of town.

President Alvi requests to meet family of Zeeshan from Sahiwal encounter

According to Jalil, he and his family were taken by the police to Islamabad to meet President Alvi and Senate Chairman Sadiq Sanjrani. However, upon arrival and after hours of waiting they were told that the president and Senate chairman were out of the city.

“If the president did not want to meet us, why did he ask us to come?” Jalil asked while speaking to the media in Lahore.

“The police recorded our statements all night long and then we went around the city all day. Later we came to know that the president was in Karachi while the Senate chairman had gone to Balochistan,” Jalil said.

During the hearing Inspector General Punjab police, Amjad Javed Saleemi told the court the investigation will take 30 days to complete.

ISLAMABAD: The Senate Standing Committee on Interior on Tuesday demanded the formation of a judicial commission to probe the alleged Sahiwal encounter that killed four people.

On January 19, four people — including three members of the Khalil family — were killed in an alleged encounter in Sahiwal. Counter Terrorism Department (CTD) personnel said they had killed a local commander of militant organisation Daesh and three others in the operation.

The families of those killed in the alleged Sahiwal shootout appeared before the Senate Standing Committee on Interior today. During the proceedings, the committee rejected the joint investigation team's (JIT) findings and demanded a judicial commission be formed.

Chairman of the Senate Standing Committee on Interior Rehman Malik said the committee took notice of the killings six hours after the incident. Pakistan Muslim League-Nawaz (PML-N) Senator Javed Abbasi, who was also part of the panel, said the police were involved in the entire matter.

“No terrorist killed them. We do not accept any investigation from the police. How is it possible that the ones who committed the killings are the ones investigating the murder?”

The senator further urged that the investigation should be taken back from the police. “If the committee and Senate have rejected the JIT, then in what capacity is the JIT working?”

Moreover, during the hearing the PML-N senator criticised the provincial government and accused it of lying about the Sahiwal incident. To this, Pakistan Tehreek-e-Insaf's Azam Swati replied that the government should not be blamed. Abbasi, however, stuck to his statements and said the government is involved in the Sahiwal killings.

Earlier today, before leaving for Islamabad, the mother of Zeeshan, the driver of the car who was killed, said she hoped for justice for her son's death. Jalil, the brother of Khalil who was killed with his wife in the incident, rejected the JIT's report and said the family has changed their lawyer after alleged threats against the family.

The lawyer representing family members of Khalil had alleged that CTD officers were trying to save their colleagues and that members of Khalil’s family including his brother were receiving death threats.

ISLAMABAD: Punjab’s Addi*tional Chief Secretary Fazeel Asghar on Wednesday, while briefing the Senate Functional Committee on Human Rights, conceded that the Counter Terrorism Department (CTD) made blunders during the Sahiwal incident, and there had been a number of alternative ways to find out whether children were seated in the vehicle.

However, he added, the video statement of the child, who said that his father had offered money to the CTD officials but they killed him nevertheless, was incorrect and suggested waiting for the report of the Joint Investigation Team (JIT) to get a clear picture.

Contrary to the 16 officials that were mentioned in the FIR, Mr Asghar also claimed that in the incident were involved only six officials, including a sub-inspector and five constables, including a driver. Mr Asghar, who has constituted the JIT, elaborated that he could tell in advance that the JIT would declare the driver of the car, Zeeshan, a ‘terrorist’, Khaleel and his family innocent, and would pin the responsibility on six officials.

“The car that was being driven by Zeeshan was owned by the Naib Amir of Daesh [the militant Islamic State group], Adeel. The agencies had identified the car two days prior to the incident, as it was parked in a street, but the agencies failed to identify the house in which Zeeshan was residing. However on Dec 19, the car disappeared and could not be traced despite the 8,000 CCTV cameras in Lahore. But at 9:30am a camera at Manga Mandi identified the number plate of the car and generated an alert. It took an hour to convey the message to an intelligence agency,” he said.

He said it was believed that all persons were wearing suicide jackets due to which officials shot them rather than making arrests. He also claimed that Zeeshan opened fire at CTD officials.

“Two calls from Afghanistan have been tracked down, which prove that not only were Adeel and Zeeshan acquainted with each other but that Zeeshan was also member of the IS, as the second call said that a member of the militant group had been killed. Moreover, a SIM, recovered from Adeel who was killed earlier in Faisalabad, showed that Adeel had visited Zeeshan’s house,” he said. Mr Asghar added that at least one ‘terrorist’ was killed every six to seven days, and if the facts were shared with parliamentarians, they would not be able to sleep.

Senator Ayesha Raza Farooq said that after getting the briefing she had become even more concerned, explaining that Zeeshan ought to have been arrested to obtain information. She also expressed the fear that now, six officials would be made scapegoats and action would not be taken against the senior persons implicitly responsible.

Chairman of the committee Mustafa Nawaz Khokhar said that the child had given a statement that his father offered money to officials of the CTD but they killed him nevertheless, raising the question that if that conversation was possible, why had the CTD officials not made arrests.

Mr Asghar’s reply was that the statement was incorrect and that the matter ought to be left to the JIT to determine.

However, Senator barrister Muhammad Saif said that he believed that the immediate statement of a person, especially a child, could not be wrong, adding that the police should not have established the JIT. “The crime scene has been compromised and if a weapon was recovered, it can be tampered with. Police officer Rao Anwar carried out fake encounter killings. In a meeting of the Interior Committee, the Pakistan Telecommunications Authority claimed that now calls cannot be made from Afghanistan but here it is being briefed that two calls from Afghanistan, were recorded,” he said.

The committee unanimously agreed that the JIT culture must be abolished, with members concurring that a parliamentary judicial commission should be established to address the issue.

Lahore High Court (LHC) Chief Justice Sardar Mohammad Shamim Ahmed on Monday said that the federal government should be informed that resolving the Sahiwal killings case is its responsibility.

The elite Punjab police had in an alleged fake encounter last month killed four people, including parents Khalil and Nabeela, their teenage daughter, and neighbour Zeeshan, sending shock waves across the country as one of the couple's three surviving children who were witness to the episode denied the official version in a video that went viral on social media.

While hearing a petition calling for the formation of a judicial commission to replace the joint investigation team currently looking into the case, the chief justice ordered that the the testimony of the family members of the deceased be recorded.

The LHC chief justice was presented with the joint investigation team's initial report on the matter. The hearing had earlier been postponed for a few hours after the JIT chief had failed to present the report in court.

According to the government's lawyer, the JIT had collected all the evidence in the case and recorded all the statements.

"Tell the court what evidence has been discovered," the chief justice said, at which he was told that all discoveries have been provided to the court in writing.

"Who sends the counter-terrorism department to conduct an operation?" the LHC chief justice asked while also inquiring about the arrest of the officer who gave the orders [for Sahiwal operation] and the other suspects involved in the case.

The petitioner's lawyer said: "While 16 people were involved in the case, only five have been arrested."

The head of the JIT informed the court that the officer who had given the orders for the operation was suspended and made part of the investigation. "If someone tries to change the record, you will all be in jail," warned the chief justice.

The judge directed that a response from the government on resolving the case should be presented in the next hearing and adjourned the hearing until February 7.

Federal govt holds powers to form judicial commission, not the court
The bench had, earlier in the day, conceded that the court no longer holds the power to order the creation of such a commission.

"The court had ordered for the formation of a judicial commission in the Model Town case," the petitioner's lawyer said.

"The law has been changed and the federal government now holds the power [to order the creation of a judicial commission],"said while ordering that the court be informed about the steps to be taken for the formation of a commission.

Last week, the Punjab government had agreed to the formation of a judicial commission if the opposition is not satisfied with the JIT's report on the Sahiwal tragedy.

Yesterday, Prime Minister Imran Khan in a one-on-one meeting with Punjab Chief Minister Usman Buzdar, directed him to ensure speedy justice to the grieving family.

LAHORE: An eight-year-old boy who witnessed the killing of his parents and an elder sister besides his neighbour near Sahiwal by personnel of the counterterrorism department has disclosed that his family was gunned down after one of the CTD personnel talked to someone over the phone.

In a written statement submitted to the Joint Investigation Team, Umair Khalil said the armed personnel first shot at and killed Zeeshan and then talked to someone over the phone before opening fire on his father, mother and sister.

The witness categorically rejected police’s version that someone from inside the unfortunate car or from a motorcycle fired at the CTD personnel first. “It is also a lie that police found any substance of terrorism from the car,” he insisted.

The boy said he along with his mother Nabila, father Khalil Ahmad, elder sister Ariba and younger sisters Muniba and Hadia along with neighbour Zeeshan left Lahore on Jan 19. “Our neighbour Zeeshan was driving the car and when we reached near Qadirabad area of Sahiwal, suddenly the armed men from behind opened fire on our car,” he said.

As result of massive fire, he said, the car hit the footpath, some police personnel with their covered faces reached there on two vans. The police personnel shot at uncle Zeeshan and killed him on the spot, he said. “Then a cop called someone on phone and my father offered them money and pleaded them not to kill,” he said.

“Please take money and don’t kill us,” Umair said while quoting his father’s last plea to the shooting squad. However, he added, ignoring the request of his father, the cop after ending his phone conversation gave a signal to his colleagues who unleashed massive fire on the car.

“As a result of fire, my father, mother and elder sister died instantly while I received a bullet in my leg and my younger sister in her arm,” Umair stated.

The witness disclosed that he and his young “sisters survived because before death my mother had protected me and my youngest sister Hadia pushing us under the seats and my father concealed Muniba to protect her from bullets”.

After stopping fire, he said, the CTD personnel shifted him and his two sisters to their vehicle and again fired at the car. They later drove them to a distance and abandoned them at a deserted place, he said, adding that he and his sister were left in immense pain due to gunshot wounds.

A few minutes later, he said, a passerby saw them weeping and crying. He dropped them to a petrol pump, the boy claimed, adding that the CTD personnel who had opened fire on their car arrived at the petrol pump after some time and shifted them to a local hospital.

Sahiwal killings: Khalil’s brother to appear in court for judicial inquiry today

SAHIWAL: Muhammad Jalil, the complainant and brother of Sahiwal incident victim Muhammad Khalil, will appear before the court of Senior Civil Judge Shakeel Ahmed Goraya at the District Courts today (Monday) regarding a judicial inquiry related to Sahiwal killings.

This is first time that he will come to Sahiwal for recording his statement about the controversial killings of his brother and his family members and a family friend, Zeeshan, by the officials of the Counter Terrorism Department (CTD) near Qadirabad on Jan 19.

Mr Jalil stated this while talking to Dawn on phone on Sunday.

It is learnt that on the repeated requests of Jalil and Zeeshan’s families Lahore High Court Chief Justice Sardar Muhammad Shamim had ordered a judicial inquiry into the incident and appointed Senior Civil Judge Shakeel Goraya for the said job.

Mr Jalil confirmed that he had received a court letter and would appear before the judge. He categorically stated he was not meeting any members of joint investigation team (JIT) formed by the Punjab Police or appearing before it. He said the family had shown dissatisfaction with ongoing JIT investigations under Additional DIG Ijaz Hussain Shah.

The District Court sources confirmed that the senior civil judge had issued notices to all parties regarding proceedings of the judicial inquiry.

While replying a question, Mr Jalil said he had no knowledge whether any member of Zeeshan’s family would appear for the judicial inquiry at Sahiwal or not.

It is important to note that Zeeshan’s mother and brother while appearing before Senate Standing Committee had denied Punjab Police’s claim that Zeeshan was a terrorist and he had links with operation held in Faisalabad two days before the Sahiwal incident.

On other hand, JIT head Ijaz Shah visited Sahiwal on Sunday to chair a second meeting of the JIT at Police Rest House, Police Lines, which was attended by all the team members.

A source close to the situation told Dawn that the JIT head had finalised two major tasks, i.e. completing challans of six CTD officials who were arrested in connection with Sahiwal killings and completion of the report going to be presented to Chief Minister Usman Buzdar on Feb 19.

The local Anti-Terrorist Court (ATC) had sent six CTD officials on 15 days judicial remand which would end on Feb 21.

It is learnt the JIT head also interrogated six arrested CTD officials before finalising the report to be presented to CM.

LAHORE: A Lahore High Court (LHC) two-judge bench received a sealed report of a judicial inquiry conducted by a judicial magistrate into Sahiwal killings while it turned down a plea to constitute a judicial commission to hold the probe.

The bench, headed by Chief Justice Sardar Muhammad Shamim Khan, observed that no law authorised the high court to form a judicial commission.

Muhammad Jalil, brother of Khalil who was gunned down along with his wife and a teenage daughter in the Sahiwal incident, had sought constitution of a judicial commission.

To an argument of the petitioner’s counsel, the chief justice pointed out that the judicial commission on Model Town incident was formed by the provincial government. The chief justice asked the counsel to present before the bench any law empowering the court to form a judicial commission.

The federal and provincial law officers also opposed the plea for the constitution of the commission. After hearing the arguments, the bench dismissed the plea.

The bench had on Feb 14 ordered the judicial inquiry into the Sahiwal killings and the sessions judge had appointed civil judge-cum-judicial magistrate Shakeel Goraya to hold the inquiry into the incident within 30 days.

A special anti-terrorism court in Lahore on Thursday acquitted all suspects in the Sahiwal encounter case giving them the benefit of doubt.

The court announced the verdict after the suspects' lawyers completed a cross-questioning of the testimonies of government witnesses.

ATC-I Judge Arshad Hussain Bhutta heard the case.

During hearings of the case, the court had recorded statements of 49 witnesses, including close relatives of a victim Zeeshan and another victim Mohammad Khalil. During the proceedings, all the suspects appeared before the court.


The injured witnesses [children of Khalil who were accompanying the victim when he was targeted] had not identified the suspects nor were the suspects identified during photogrammetric tests. The court added that the official who had provided the suspects with the weapons said he was returned all the weapons and bullets.

In January, Mohammad Khalil, his wife and their three children were travelling in a car, with their neighbour Zeeshan behind the steering wheel, when Counter-Terrorism Department (CTD) personnel stopped the vehicle and opened fire on the passengers suspecting them to be terrorists. Khalil’s two children Umair and Muneeba had survived the attack.

The suspects said that they had information that Zeeshan had links with a terrorist outfit. They also claimed that all the victims were killed in an 'encounter' which turned out to be false after the two minor children narrated facts of the incident to the public.

Initially, the trial was conducted in Sahiwal, however, the Lahore High Court on June 17 shifted the proceedings to Lahore allowing an application filed by the victims' family. The petitioners contended that they had been facing problems while attending trial proceedings in Sahiwal. They also cited security reasons and asked the court to shift the trial proceedings from Sahiwal to Lahore.

Prime Minister Imran Khan has directed the Punjab government to submit an appeal against the verdict handed down by a special anti-terrorism court (ATC) acquitting all suspects in the Sahiwal encounter case, Special Assistant to the Prime Minister on Information and Broadcasting Dr Firdous Ashiq Awan said on Friday.

In a post shared on Twitter, Dr Awan said the premier had also instructed the authorities to investigate weaknesses and shortfalls in the case presented by the complainant pleading the case.

On Thursday, the ATC in question had acquitted all six personnel of the Counter Terrorism Department (CTD) of the charge of killing four persons in an alleged encounter earlier this year.

In a subsequent tweet, the special assistant to the premier today said that the whole country had seen the video of the parents being shot in front of their children.

"The government is committed to providing justice to [these] innocent children. If their family doesn't become the plaintiff, then the state will act as the plaintiff in the case."

On Jan 19, Yousafwala police had registered a First Information Report (FIR) on the complaint of Muhammad Jalil, Khalil's brother, under Sections 302, 324, 337(F1, F-A1 and F3) and 201 of the Pakistan Penal Code and Section 7 of the Anti-Terrorism Act, 1997.

Initially, the trial was conducted in Sahiwal. However, the Lahore High Court (LHC) had on June 17 shifted the proceedings to Lahore, allowing an application filed by the complainant.

The suspects — Safdar Hussain, Ahsan Khan, Muhammad Ramzan, Saifullah, Hasnain Akbar and Nasir Nawaz — were acquitted by the trial court yesterday.

"The prosecution has failed to prove the case against the accused [...] while dispensing justice the court has to see the evidence available on record," trial judge Arshad Hussain Bhutta ruled in the verdict.

THERE is widespread disbelief in the country over an antiterrorism court’s verdict in January’s shootout case in Sahiwal. The government has decided to challenge the ruling which acquitted all six CTD officials in the killing of four people.

While not a unique occurrence, no less than 27 of prosecution witnesses turned hostile, allowing the accused relief. These witnesses were originally there to help prove the guilt of the accused police officials in the killing of Muhammad Khalil, his wife Nabila, their teenage daughter and Zeeshan, a friend of Khalil’s who was driving the car.

The Lahore-based family was on its way to a wedding when it came under a hail of bullets. In the absence of any witnesses testifying against the accused, the ATC judge dismissed the possibility of supportive evidence reinforcing the prosecution’s case. This included the footage showing images of the car in which the victims were travelling along with three minor children who survived the attack. The footage led to outrage across the country.

This was considered an open-and-shut case of an overzealous police force going mad with their chase after a wrong tip-off. Even the prime minister and members of his cabinet promised exemplary punishment for those responsible.

However, there were also sceptics who warned that the proceedings in court could lead the judge to draw conclusions contrary to the general perception. Those cynics have been proved right, pending of course a government appeal against the verdict.

The Sahiwal verdict on Thursday was followed by a statement by Muhammad Khalil’s brother who accepted the ruling and asked that the case not be used for any political motives. But if that was an attempt to quickly end the matter, the government’s decision to challenge the decision, even if it had to do so without support from the heirs of the victims, has thwarted the move. The case, the debate it stirred, is still open, with its many dimensions about justice, privileges and necessities justified by emergencies.

There have always been grave concerns about how easily the police get away with the gravest of excesses but this is about a more privileged law-enforcement arm. The CTD is a force born of special needs in the wake of the war against militancy, with special cover provided to its acts. But it must still be held accountable for actions that take the life of the innocent.
