LONDON: Broadsheet LLC owner Kaveh Moussavi’s allegations that the Sharif family approached him with a bribe has made a splash in the media, as the state-owned news agency Associated Press of Pakistan ran a headline based on the lawyer’s claim in a video interview this week.

Several newspapers carried this story and it became the focus of discussions on social media as well as talk shows.

Among other allegations levelled against former premier Nawaz Sharif, the asset recovery firm’s owner Mr Moussavi claimed that a person who claimed to be associated with Mr Sharif approached him in 2012 and offered a sum of money to drop the probe against him.

Broadsheet’s Moussavi says he met an individual named Anjum Dar twice; Hussain Nawaz denies any offer

Speaking to Dawn, Mr Moussavi repeated the allegations. He said: “A gentleman named Anjum Dar purporting to be Nawaz Sharif’s nephew turned up in 2012. I met him twice, once in Canterbury and then in London.” He said the individual offered him $25 million.


“He showed me a picture of him hugging Nawaz Sharif at home and sitting with him. He produced a tape recording as well — it was in Urdu so I didn’t know what it was saying.”

In response to a question about whether he considered the offer, Mr Moussavi said: “When we realised that he was basically offering some money for us to go away, my response was that any money being offered should come by way of lawyers in the arbitration.”

When asked why he did not report the development to authorities in the United Kingdom, or to the court-appointed arbitrator he said: “I certainly discussed it with lawyers but we decided not to take it up with the authorities.” He did not elaborate on why, but when asked who the gentleman is, he said to ask the Sharif family.

On the question of why the Sharifs or their representative would offer him a bribe in 2012, many years after his asset recovery contract with the government had ended in 2003, Mr Moussavi said: “We were in arbitration and the arbitrator would have to probe into the whole issue. They didn’t want that to come up.

Commenting on the development, Mr Sharif’s son, Hussain Nawaz, told Dawn: “This is absolutely not true. We have no relative named Anjum Dar. If an individual claiming such a thing had come to him [Moussavi] was it difficult for his investigative company to determine who he is before making such an allegation?”

He added: “Nawaz Sharif has two brothers and one sister and all their children’s names are in the public domain. Is Mr Moussavi such a poor investigator that he wasn’t able to determine this simple fact even after nine years?”

In an interview aired this week, the Broadsheet owner made corruption allegations against the Sharifs and offered his services to the Pakistan government to hire his company to investigate the family’s properties in Avenfield House. The government does not appear to be interested in his offers, and is reeling from the recent forced payment of nearly $29 million to Broadsheet LLC after a court order.

In another startling claim during the interview, a full recording of which is with Dawn, Mr Moussavi also alleged that an individual he met in 2018 regarding a $1 billion bank account was more interested in getting his cut than in investigating suspects.

“There was a delegation that came to London [in 2018] to discuss with the National Crime Agency money that had been frozen under an unexplained wealth order. At that time, I was asked to meet, and I did meet, at Cafe Rouge in North London, a gentleman who had all the documents. We said fine we will forget about the money you owe us on the judgement, let’s work together. They were skeptical… then I said I know of an account that has a billion dollars. They wanted to know ‘what is our cut’?”

The Broadsheet owner said Mr Shahzad Akbar, whom he also met with, may not have been aware of this individual’s question about a commission. He also said a man who said he was a general met with him at the time, but that he did not reveal his name.

A day earlier, Mr Akbar told this correspondent the government was not interested in Broadsheet LLC’s services as “it had skimmed Pakistan without giving anything”.

Broadsheet LLC, a company incorporated in the Isle of Man in 2000, was hired by elements in the Musharraf government the same year to probe and retrieve the alleged foreign assets of politicians and businessmen in Pakistan. According to its owner, the Sharif family was a major target of the government and that he later expanded his search to include 200 ‘targets’ and their suspected overseas properties.

Moussavi names Sherpao

In his earlier interview, Mr Moussavi alleged that though the Musharraf government had engaged his firm to probe certain individuals, it later requested that Broadsheet LLC drop some names from their investigation. He had hinted that one such request was made about a man who was later appointed interior minister by Musharraf.

“It was Sherpao,” he alleged, referring to Aftab Ahmed Khan Sherpao, who served as a minister in 2004.

I'm not a violent person but I want these looters (whoever they are, I don't care army, civilian) to suffer the exact same fate that they have made millions of people live through.

Moussavi’s also revealed that when they found money NAB would let that person know and they would quickly withdrew the money from those accounts. NAB is not an organisation to fight corruption, it has always been an abetter of the corrupt elite.We need more Gen Amjads that were sincere and less Javeds.

The current NAB chairman isnt clean, he was appointed by NS and AZ and he is deliberately put cases on a back burner to a point where hardly any cases have reached court. This Buddha is one of the biggest hurdles to the elite crooks going down.
 
LAHORE: PML-N vice-president Maryam Nawaz on Saturday said that the Broadsheet scandal is a slap on the face of the PTI government.

She was talking to mediapersons outside an accountability court where she had arrived to witness proceedings against PML-N President Shahbaz Sharif.

"The Broadsheet scandal is a slap on the face of the PTI government. Their lies have come before them,” Maryam said.

Slamming the government over the controversy surrounding the settlement paid to the asset recovery firm, the PML-N leader said that "they tried to use Broasdsheet against Nawaz Sharif but the Almighty has once again vindicated him".

“They themselves have got trapped into it. They are so corrupt that they demanded a commission from the asset recovery firm,” she alleged.

Maryam Nawaz said that Prime Minister Imran will be left alone this year, adding that his advisers and ministers "have started to understand the truth."

"Imran Khan is an inexperienced player," the PML-N leader said.

She said that the PTI government has been exposed. "Lahore was a beautiful city and now they have turned it into a garbage dump."

While responding to a question, Maryam said that the Opposition parties would hold a big protest rally outside the Election Commission of Pakistan (ECP) on January 19.

"The PDM will decide about the sit-in after January 31."

When a journalist asked about Bilawal Bhutto’s planned absence from the ECP protest, Maryam said she’s unaware of it. According to reports, the PPP chairman is scheduled to visit Sindh cities on those days and may not be able to join other Opposition leaders in their protest.

Maryam claimed that PM Imran Khan considers Shahbaz Sharif his alternative, which is why he has thrown him into jail.

“Both Shahbaz and Hamza Shahbaz will definitely come out of jail and take part in politics too," she concluded.

Broadsheet case: Shahzad Akber says deals, NROs cost national exchequer

Adviser to Prime Minister on Accountability and Interior Shahzad Akber said on Monday that deals made by previous governments and national reconciliation ordinances (NROs) issued in the past had badly affected the country and cost the national exchequer.

Addressing a news conference in Islamabad, the adviser said that the Broadsheet case was being debated widely across the country.

He said that because of the debate, the government had decided to make public the judgment of a British court regarding Broadsheet and Pakistan involving liability and quantum awards.

He added that the documents were being made public after written approval was obtained from Broadsheet's lawyers.

Akbar said they had approached Broadsheet to make the judgment clear on the instructions of the prime minister to ensure transparency.

“The prime minister has formed a ministerial committee on Broadsheet and directed them to furnish its recommendations within 48 hours,” said the adviser, adding that the government’s next course of action will be decided in the light of those recommendations.

The adviser said that the 2007 NRO has been mentioned in the verdict, adding that it has said that the “stolen money’s” value was calculated to be Rs16 million.

Akbar also urged people to “respect the constitutional institutions” and lauded the National Accountability Bureau for its performance.

“Recoveries made by the anti-graft watchdog over the last two years are a clear proof of improvement in its working,” claimed the adviser.
 
PM Imran Khan constitutes 3-member committee to probe Broadsheet scandal

ISLAMABAD: With Prime Minister Imran Khan in chair, the federal cabinet has constituted a three-member committee to probe the Broadsheet LLC scandal.

The committee will be led by Federal Minister for Information and Broadcasting Shibli Faraz and comprise Federal Minister for Science and Technology Fawad Chaudhry, and Federal Minister for Human Rights Shireen Mazari.

The committee has been given the task to review Pakistan's agreement with Broadsheet LCC for the period 2002-2018, sources informed Geo News. "An investigation will be launched to find out who took advantage of the deal," the sources said as they revealed the cabinet's decisions.

Meanwhile, speaking about the Pakistan Democratic Movement (PDM), the prime minister said that the "Opposition's alliance would be allowed to hold their protest."

He, however, warned the PDM and said that the law would come into action if the 11-party alliance attempts to move against it.

Regarding the matter of religious parties holding sit-ins and protests, the cabinet decided to consult the ulema. "This is a sensitive issue. We will take the ulema into confidence over this matter," the prime minister added.

Pakistan pays Rs4.59 bn to British firm for lost case

Pakistan made a payment of $28.706 million (Rs4.59 billion) to the British firm Broadsheet LLC after losing the long-running litigation at the London High Court.

The amount was transferred from the Pakistan High Commission (PHC) on behalf of the National Accountability Bureau (NAB) to the assets recovery firm — 21 years after it was hired to trace alleged foreign assets of dozens of Pakistanis which it failed to find any.

The London High Court’s Financial Division had issued on December 17 a Final Third Party Order for payment to NAB’s former client Broadsheet by December 30 — drawing curtains on a case that has cost Pakistani taxpayers billions of rupees.

ISLAMABAD: A deliberate decision was made by the National Accountability Bureau (NAB) to disregard the known risk of economic harm to the Broadsheet LLC, as the claimant submits, to turn a blind eye to damages that would or might be caused to the Broadsheet by entering into May 20, 2008 Settlement Agreement with Jimmy James and his Colorado companies or in making payments to them, stated Sir Anthony Evans through his Aug 2016 final award determining the liability issues.

“I hold, that was reckless conduct by NAB which give rise to tortuous liability, as alleged,” held Sir Evans, adding that evidence establishes that those who took the executive decision on behalf of NAB to enter into the settlement agreement believed that the Broadsheet was in liquidation and that the liquidator was not a party to the negotiations by accepting Jimmy James explanation that Broadsheet LLC had been reconstituted in the form of Broadsheet LLC in Colorado, which at best was a doubtful legal concept and if correct, could only mean that Broadsheet had ceased to exist.

The judgement also noted that senior lawyer Ahmer Bilal Soofi who acted on behalf of NAB as its consultant paid an agreed amount of $1.5 million in London by two cheques to Broadsheet LLC Gibraltor (a misnomer) or Broadsheet LLC (Colorado) and Jimmy James.


The consultant was informed in Feb 2008 by Jimmy James that the Broadsheet was or had been in liquidation in the Isle of Man and that the company had been somehow reincorporated in Colorado and that in SA James did not claim that he was acting for a liquidator.

By the time the settlement agreement was executed, both Ahmer Bilal Soofi and NAB believed that Broadsheet was in liquidation proceedings though both also knew that the supposed liquidator was not involved in the negotiations nor a party to the settlement agreement.

While holding that the claimant Broadsheet LLC was entitled to recover damages for the wrongful repudiation of the ARA, the award declared that Jimmy James had no authority from the claimant after March 2005 to enter into a settlement agreement.

The Dec 17, 2018 determination by Sir Anthony Evans on the quantum award in the Broadsheet LLC litigation mentions, according to the evidence, that the total value of the assets attributed to former prime minister Nawaz Sharif’s was $805.9 million. At the same time the award also acknowledges that the figure being gross do not necessarily relate to the current value of the alleged properties owned by the Sharifs. Of the total value of assets, $622 million was in Pakistan, $54 million in Saudi Arabia, $24.5 million in the UAE besides $105 million in the United Kingdom.

Finally the quantum decision held that Pakistan and NAB were jointly liable to pay $21.58 million plus interest to the Broadsheet LLC as damages for the Oct/Dec 2003 breach and repudiation of June 2000 ARA (asset recovery agreement).

The award summarizes the damages recoverable by the claimant (Broadsheet LLC) for the breach of contract with compound interest at the appropriate deposit rate. According to the table, a total of $21.58 million has to be recovered and given to Broadsheet of which $1.5 million had to be recovered from the Sharifs on account of Avenfield flats, $19 million for other assets from Sharifs, $48,760 from Schon Group, $25,000 from Sultan Lakhani, $85,600 from Fauzi Kazmi, $381,600 from Lt Gen (retd) Zahid Ali Akbar, Aftab Sherpao $210,000 and $180,000 from Jamil Ansari etc.

Broadsheet LLC was incorporated in the Isle of Man on May 28, 2000 and its registered shareholders were two Panamian companies namely Oxford International Holdings and Berkshire International Holdings while its common beneficial owner was Colorado-based businessman Jimmy James.

There was an evidence, the award held, in 2001-02 former chief minister of Punjab Shahbaz Sharif made substantial payments to the National Accountability Bureau (NAB) amounting to Rs440 million ($7.35 million) and there was some dispute at the liability hearing as to whether these were assets recovered by NAB for the purposes of the Asset Recovery Agreement (ARA) between the Broadsheet LLC and NAB in 2000.

But after ending exile and the return of the Sharif family from Saudi Arabia, the payments together with different assets had been surrendered to NAB were returned to him and his family on the Lahore High Court (LHC) order which was also upheld by the Supreme Court of Pakistan.

“It seems, therefore, that these payments and assets are no longer relevant for present purposes,” the quantum award said, adding that in 2015 the files of Mossack Fonseca – a firm of Panama lawyers – became public knowledge thus disclosing the affairs of clients and former clients, including Nawaz Sharif and family members.

In Pakistan, proceedings were instituted by the leader of another political party, headed by Prime Minister Imran Khan, that resulted in the establishment of the Joint Investigation Team (JIT) on April 20, 2017 under the Supreme Court orders, with a task to inquire into the business affairs of Nawaz Sharif and members of his family in relation to certain allegations of corruption.

The reasons why the inquiry was not delegated to NAB was also explained in the SC order which stated that in normal circumstances, such exercise could be conducted by NAB but when its chairman appeared to be indifferent and even unwilling to perform his part, “we are constrained to look elsewhere and therefore constitute JIT” with six members including a NAB representative.

The NAB chairman at that time held office under Nawaz Sharif who had been the prime minister since 2013, the award said, recalling that the SC after the final JIT report disqualified the then prime minister on July 28, 2017 from being member of the parliament who resigned accordingly.

The apex court also directed NAB to file three references in the accountability court at Islamabad against him relating to four apartments in the Park Lane London known as Avenfield Flats.

The award also mentioned on July 3, 2018 first revised expert report of Stroz Friedberg (SF) – a consulting firm – engaged to carry out a forensic audit of the JIT report to identify potentially recoverable assets of the Sharif family. This resulted in a list of 76 items of property in three overseas jurisdictions the revise value of which was $820 million, the award said, adding the SF list did not purport to identify assets currently held by the Sharif family rather it lists items of property which have been held by or attributed to them over a period of 20 years.

The award also held that the evidence regarding receiving $160 million as bribe money from the contractors for the construction of the Islamabad-Lahore Motorway by the Sharif family, does not support the claim that an asset worth $160 million in his possession which NAB could have recovered from him or could recover now without further evidence linking that the cash or property asset which can or could have been seized.

Prime Minister Imran Khan has said that he has "nothing to do" with the Broadsheet issue and the agreement was made by former president Pervez Musharraf.

His remarks came in a television interview which was aired on Friday.

Referring to the Broadsheet agreement, the prime minister said that the asset recovery firm found Nawaz Sharif's assets worth $800 million "and a court declared that assets of $100 million really were owned by the former prime minister".

He said that the government was bound under the agreement, to pay the firm and if they did not pay, a day's interest would have amounted to 5,000 pounds.

The prime minister termed the foreign funding case against the PTI as one born out of malafide intent and said that he trusts the Election Commission scrutiny committee probing the matter.

Speaking of the increased power tariff, he said that it was done "so that the country does not fall further into debt".

A day earlier, the government named retired Justice Sheikh Azmat Saeed as the head of the committee probing the Broadsheet case and gave him the authority to add whomever he wants to the committee.

The Opposition parties have voiced major reservations against the move, owing to Saeed's past appointments.

Former President Pervez Musharraf had hired British firm Broadsheet in 1999 to recover the properties of Nawaz Sharif, Asif Ali Zardari, and Benazir Bhutto among others.

However, the agreement was terminated by National Accountability Bureau in 2003 after which the firm had filed a case against the Bureau in the arbitration court.

The court had ruled against NAB in August 2016 and ordered it to pay a fine. On December 31, Pakistan made a payment of $28.706 million (Rs4.59 billion) to the British firm Broadsheet LLC after losing the long-running litigation at the London High Court.

In recent days, more revelations have come to light regarding the Broadsheet case, after which the government decided to investigate the matter.

ISLAMABAD: Prime Minister Imran Khan’s hilltop house in Banigala resurfaced again in the National Assembly debate on Friday when the Pakistan Muslim League-Nawaz (PML-N) member Afzal Khokhar moved a privilege motion against the razing of his house in Lahore last Sunday.

The government, however, defended the operation.

When Adviser to the Prime Minister on Parliamentary Affairs Dr Babar Awan questioned the tabling of the motion and said, “this house cannot defend land grabbers”, the PML-N members stood up from their seats. Some of them even surrounded the speaker’s dais and raised slogans.

The issue of the UK-based assets recovery firm, Broadsheet, also remained in the spotlight.

Opposition members questioned whether awarding damages to Broadsheet came under the purview of the Assets Recovery Unit and if the government had hired any other firm to trace offshore properties and assets of Pakistanis.

The house was informed that people, especially those in the low income group, were compelled to pay 30 to 40 per cent taxes on the use of mobile phones.

“On one hand, the illegal palatial house of Prime Minister Imran Khan in Banigala has been regularised at a cost of Rs1.2 million while on the other my legitimate house is demolished,” Afzal Khokhar said in his privilege motion.

“If we are land grabbers, then Imran Khan is Qabza Mafia as well,” the PML-M member said, adding that, “I have not given my sisters sewing machines from the government funds”.

He said he was the fifth bona fide purchaser of the demolished house.

Refuting Babar Awan’s claim, Mr Khokhar said the local administration, police and Lahore Development Authority carried out the operation at about 4am despite stay orders from the Lahore High Court.

“My daughters and sisters were sleeping in the house when the eight-hour long operation was carried out, forcing them to stand outside in the cold weather,” he said, adding that “sisters and daughters are not kept in illegal houses”.

The PML-N member said his house was razed to punish him for his loyalty to former prime minister Nawaz Sharif and his family. “We will remain loyal to Nawaz Sharif forever,” he added.

Mr Khokhar asked National Assembly Speaker Asad Qaisar to send the matter to the relevant standing committee of the lower house to thoroughly discuss it.

“I challenge Babar Awan that if I am found guilty, I will accept any punishment announced by the speaker, but what punishment would you suggest for yourself if you are found to be wrong,” he added.

At this, the speaker reserved his ruling on the motion and did not send the matter to the privilege committee.

Prime Minister Imran Khan, during his visit to Sahiwal on Friday, had said Nawaz Sharif and his daughter Maryam Nawaz were backing Qabza Mafia in Lahore.

Later, PML-N leaders Shahid Khaqan Abbasi and Ahsan Iqbal held a joint press conference outside the Parliament House, in which they said if the privilege committee could not look into Afzal Khokhar’s case then what could it do.

“Demolishing Khokhar Palace is a malicious attempt of the government against the opposition,” Mr Abbasi said in the press conference.

The NA speaker became furious when the PML-N members protested against Babar Awan’s remarks and snubbed former federal minister Ahsan Iqbal.

“You call yourself a professor; is this the way you talk,” he remarked.

Earlier, during the question hour, PML-N leader Murtaza Javed Abbasi said mobile phone companies were charging 30 to 40 per cent taxes on phone bills.

“These companies are collecting advance tax, sale tax and tax of mobile cards,” he added.

Babar Awan endorsed Mr Abbasi’s point, but said the present government had reduced withholding tax on mobile phone users from 14pc to 12pc.

Replying to Pakistan Peoples Party (PPP) leader Naveed Qamar, Adviser to the Prime Minister on Accountability Shahzad Akbar said the present government had not made any agreement with an assets recovery firm, including Broadsheet.

“We are now focusing on government to government deals,” he said.

Another PML-N member Shiza Fatima asked under what criteria the number of Ehsaas programme beneficiaries had been increased.

“The last poverty survey was conducted in 2018 and we heard that the government had excluded over 800,000 beneficiaries from the Benazir Income Support Programme but later included hundreds of thousands under what basis,” she added.

Ms Fatima questioned why the number of Higher Education Commission’s scholarships had been reduced.

To this, a treasury member replied that scholarships had in fact been increased as a large number was being provided through the Ehsaas programme.

Earlier, NA Speaker Asad Qaisar expressed his displeasure over the absence of ministers and parliamentary secretaries from the house.

Babar Awan and Naveed Qamar endorsed the speaker and said in the absence of ministers, at least the parliamentary secretaries should attend the proceedings.

“The Senate is quite strict on the issue and does not allow any parliamentary secretary to speak on behalf of the minister,” Mr Qamar added.

LONDON: Broadsheet owner Kaveh Moussavi has alleged that British journalist David Rose asked for a commission in exchange for his assistance in recovering the sum of about $29 million from the Pakistan government.

The journalist, who writes for The Mail on Sunday and Mail Online and whose story against Pakistan Muslim League-Nawaz president Shehbaz Sharif is presently at the centre of a defamation suit, has denied asking for any commission.

In October 2019, when Mr Moussavi was desperate to recover the court-mandated award of $29m from the Pakistan government, he approached Mr Rose and asked for his assistance. It has now emerged that Mr Rose set up the first meeting between Mr Moussavi and Special Assistant to the Prime Minister on (SAPM) Accountability Shahzad Akbar at the Royal Garden Hotel in Kensington, and that he was present during the meeting.


In an interview to Geo News, Mr Moussavi said: “David Rose said he knew Shahzad Akbar so we had a chat at my house and he later organised the meeting [with Akbar]. He [Rose] asked what was in it for him, and wanted his mortgage to be settled if Broadsheet entered into a deal with Pakistan.

“We shook hands that I would settle his mortgage of GBP250,000,” said Mr Moussavi, indicating that if he had recovered the payment from Pakistan at the time, he would have paid Mr Rose the commission.

David Rose says he introduced Broadsheet owner to SAPM, but denies asking for commission

Mr Rose tweeted on Monday, saying Mr Moussavi asked him to arrange the meeting. “I’ve known Shahzad for a long time too, so I agreed to do this. So far as I was concerned, I was just doing a favour for a friend, though twice Kaveh said he would pay me a commission if he concluded a settlement,” he wrote.

“At first I thought he was joking, but when he repeated the offer by text, I told him (verbally) I couldn’t accept this. I never asked for and never received any payment in relation to this meeting.”

Broadsheet was engaged by Gen Musharraf some 20 years ago to investigate the offshore property of former prime minister Nawaz Sharif and his family members.

In December 2018, former English court of appeal Judge Sir Anthony Evans QC, as sole arbitrator, issued an order for payment of $22m to Broadsheet by the government of Pakistan. In July 2019, the government appealed the arbitration, but was unsuccessful in its bid. The arbitrator found that Pakistan and the National Accountability Bureau (NAB) had wrongfully repudiated an asset recovery agreement with Broadsheet and ruled that the company is entitled to damages. For the next few months, Broadsheet was in correspondence with members of NAB as well as the AGP for the payment of the funds.

In October 2019, Mr Moussavi met with Mr Akbar to demand the $22m payment as ordered by the court, but Mr Akbar sought a discount to limit the loss to the national exchequer. Mr Moussavi rejected requests for a discount and approached the court to enforce the payment. In December 2019, the company successfully secured a third party debt order which forced the payment of around $29 million to Broadsheet which accumulated into $28.7m due to non-payment of interest, which incurred at a rate of $4,758 per day.

When asked to comment on this development, SAPM Shahzad Akbar told Dawn, “I didn’t have any contact with Kaveh prior to October 2019. David made me meet him — it wasn’t a secret meeting.”

Mr Akbar said he has no knowledge about any request for commission.

Later on Geo anchor Shahzeb Khanzada’s show, Mr Akbar said Mr Rose is his friend and has known him for six years.

Mr Moussavi in the past has accused the Sharifs, former president Asif Ali Zardari, Gen Musharraf, an unnamed general and an unidentified individual of bribery, kickbacks and selective accountability. He has also criticised Mr Khan and his cabinet for apathy and an ‘insincere’ accountability drive. The government has formed a commission to probe the Broadsheet saga.

Mr Rose’s publication the Mail on Sunday is currently in the midst of a defamation suit filed by Shehbaz Sharif, who said the journalist has wrongly accused him of corruption.

The paper alleged in a 2019 story that Shehbaz misappropriated UK taxpayers’ money, in particular government aid intended for the victims of the 2005 earthquake in Pakistan. Shehbaz denies the charges and has demanded a retraction, an apology and damages.

After the story was published, the PML-N president accused the Pakistan Tehreek-i-Insaf (PTI) government of feeding ‘fake news’ to the Mail. He named Prime Minister Imran Khan and Special Assistant to the Prime Minister on Accountability Shahzad Akbar as having been behind the report and vowed to take legal action against the paper and the government officials. At the time, the PM’s aide had dismissed Mr Sharif’s remarks about the ‘politically-motivated story’, and said he was willing to place evidence of the alleged corruption before London courts.

LONDON/ISLAMABAD: Asset recovery firm Broadsheet LLC was made to pay GBP20,000 (amounting to Rs4.5 million) to the Sharifs in litigation costs this week as part of the costs owed by the company for withdrawing its claim to the family’s Avenfield apartments.

The receipt of the payment by Broadsheet was confirmed by the legal representatives of the Sharif family. The development is the latest episode in the Broadsheet saga, in which the company made several attempts to secure the payment of $29 million from the Pakistan government as awarded to it by an English court in 2018. The arbitrator found that Pakistan and the National Accountability Bureau (NAB) had wrongfully repudiated an asset recovery agreement with Broadsheet and ruled that the company is entitled to damages.

Since then, the firm attempted to secure the payment for its services by targeting several entities in the UK with purported links to the Pakistan government. In the same period that it laid a claim to four Avenfield House flats, Broadsheet LLC also wrote to the Pakistan government and threatened to “seize the assets of the Pakistani cricket team” to recover the outstanding funds owed by NAB.


Earlier, it was reported that in its effort to recover the payment from the Pakistan government, Broadsheet’s lawyers even approached the Sharif legal team for assistance.

The law firm representing the Sharifs denied assistance to Broadsheet in its enquiries.

Claim on Avenfield House

On June 19, 2020, Broadsheet approached the High Court with a plea to attach four apartments in Avenfield House through an Interim Charging Order as part of the recovery of money owed to it by the government of Pakistan and NAB. The company had argued that NAB held beneficial interests in the Avenfield Apartments pursuant to the court’s Avenfield reference judgement in July 2018. A Charging Order is a court order that essentially gives a creditor security for their debt.

The Sharif lawyers contested this claim, and said that the accountability court judgement did not vest any interest in the Avenfield Apartments to either the government of Pakistan or NAB and that it was, therefore, incapable of being enforced by the UK High Court.

On Dec 2, 2020 — mere weeks before Broadsheet secured its payment through a third party debt order which drew the outstanding $29 million payment from the Pakistan High Commissiom’s bank account in the UK — its solicitors withdrew the case from the High Court.

The Court made an order on the same day discharging the Avenfield Apartments. As a result of this, Broadsheet was bound to pay the Sharifs’ legal costs. According to the general rule in litigation of civil cases, the losing party pays the successful party’s legal costs.

“Our client could have claimed higher amounts from Broadsheet. However, in view of additional recovery costs and the uncertainties due to Broadsheet’s liquidation, they chose to accept the settlement,” read a statement drafted by Sharifs’ lawyers.

Broadsheet LLC was registered in the Isle of Man on June 20, 2000 and helped the Musharraf government and the newly-established NAB track down foreign assets purchased through alleged ill-gotten wealth.

Owned since the mid-2000s by Iranian-born former Oxford University academic Kaveh Moussavi, Broadsheet now stands liquidated. Moussavi, who was not initially involved with the company when it entered into an agreement with the Musharraf government, later funded the arbitration. He served a year-long prison sentence in England for contempt of court in unrelated proceedings.

Broadsheet maintains that it was created to be a company specialising in the recovery of assets and funds, and was, therefore, engaged to trace, locate and transfer such items back to the State.

A lawyer associated with the company earlier told Dawn that the Sharifs were the “top target” of the Broadsheet investigation. Its contract was terminated in 2003 by NAB.

In Islamabad, a one-member inquiry commission comprising retired Justice Sheikh Azmat Saeed on Tuesday summoned the record related to UK-based firm Broadsheet from NAB.

The commission had summoned three federal secretaries along with the relevant record. They have been directed to appear with the record regarding matters relating to the terms of references of the commission.

However, the secretaries have requested for further time for giving complete record to the commission.

The commission has so far recorded statements of four former chairmen of NAB. In addition, statements of a former deputy High Commissioner, Pakistan’s High Commission in London, former joint secretary in the Ministry of Law and Justice and a few other officers/persons, who were associated with Broadhseet matter, have also been recorded.

The witnesses have been further directed by the commission that they might be required to appear again before the commission as and when needed, a statement issued by the Ministry of Law and Justice said.

It may be mentioned that amid resistance of the opposition parties, the federal government has formed the one-man commission comprising Justice Sheikh Azmat.

The Cabinet Division on Jan 29 issued the notification for the commission of inquiry along with its terms of references. According to the notification, the commission has been empowered to constitute committees consisting of government officials and experts.

The commission is examining into the contracts signed by NAB with Broadsheet LLC and other international asset recovery (IAR) firms to unearth foreign assets made by Pakistanis through ill-gotten money.

Broadsheet case: Inquiry commission wraps up investigation

A commission of inquiry headed by Justice (retd) Azmat Saeed Sheikh has completed its probe into the Broadsheet case.

According to sources, a 100-page inquiry report has been prepared. It is expected that the report will be sent to the federal government sometime this week.

UK-based asset recovery firm Broadsheet LLC had been hired in 2000 by General (retd) Pervez Musharraf’s government to help recover assets stashed by past Pakistani rulers abroad.

Sources said that statements and documents of several people have been attached to the 100-page report separately.

The commission was set up on January 29 this year to probe the Broadsheet case. It had formally launched its investigation on February 9, 2021, while the Opposition had refused to accept the commission headed by Justice (retd) Saeed.

Sources said the report said a payment of Rs1.5 million to Broadsheet is missing from the records.

Broadsheet company was wrongly paid Rs1.5 million, the report said, adding that wrong payment is counted as fraud with the state of Pakistan.Payment alone cannot be termed as negligence, the Broadsheet commission report said. It added that files were stolen from the ministries of finance and law and the attorney-general's office.

The Broadsheet commission got all its details from NAB documents, the report said.

UK court orders NAB to pay $1.2m to Broadsheet

LONDON: A London High Court has ordered the National Accountability Bureau (NAB) and Pakistan government to pay a sum of 1.2 million dollars to asset-recovery firm Broadsheet LLC by next week.

After hearing the arguments from both sides, the court ordered NAB and the Pakistan government to pay $1,222,037 and GBP110 as well as the claimant’s application cost of GBP26,296 to NAB’s solicitors until 4.30pm on August 10. It said NAB’s solicitors Allen and Overy shall pay all sums received from the government of Pakistan to Broadsheet LLC’s solicitors Crowell and Moring by 4.30pm on August 13.

If this payment is not made by the government of Pakistan and NAB to its solicitors, and subsequently to Broadsheet, the court ordered that Broadsheet’s lawyers will notify United National Bank Limited (UBL UK) and that UBL UK will pay the outstanding funds. The failure to pay will trigger the enforcement of a third-party debt order, which allows a creditor to take the money owed to them directly from whoever has the money.

NAB and Broadsheet landed up in court once again after the two could not agree on the payments of legal costs and interests.

Lawyers on behalf of NAB agreed to pay $1,222,037 and GBP110 but contested the payment of interest demanded by Broadsheet amounting to GBP33,646.84 and costs of GBP35,000.

On Monday, the court ordered that along with the payment of $1.2m and GBP110, NAB and the Pakistan government must pay Broadsheet additional GBP26,296. The amount was less than demanded by Broadsheet for interest and costs.

Earlier, in its effort to recover the payment from the Pakistan government, Broadsheet’s lawyers even approached the Sharif legal team for assistance, but were denied.

In January this year, a high court in the UK ordered a debit of $28.7m from the accounts of the Pakistan High Commission in London over non-payment of the penalty by NAB to the foreign firm.

‘Disrepute to Pakistan’

While reacting to the new order against NAB in the Broadsheet case by a British court, Central Secretary Information of the Pakistan Peoples Party Faisal Karim Kundi said NAB was causing disrepute to Pakistan in the international arena.

He demanded the names of NAB chairman and accountability adviser be added to the Exit Control List (ECL) and that the parliament be told how much had been spent on NAB officers’ foreign trips and the fee given to domestic and foreign lawyers.

The former deputy speaker of the National Assembly alleged that trillions of rupees had been stolen and wasted with the connivance of NAB and the government against political opponents. Demanding closure of ‘NAB drama studio’, Mr Kundi said NAB was the creation of a dictator whose main job had been political engineering. Voices had also been echoed in the higher judiciary regarding the NAB’s political engineering, said Mr Kundi, adding that the fine imposed on Pakistan should be recovered from the chairman and directors of NAB who had been allegedly misleading the nation by fabricating false stories and ruthlessly squandering the national treasury and building their assets.
