IHC grants bail to Asif Ali Zardari on medical grounds [Update Post #157]

ISLAMABAD: A team of the National Accountability Bureau (NAB) reached Pakistan Peoples Party co-chairman Asif Ali Zardari’s Islamabad residence to arrest the PPP leader after the Islamabad High Court’s (IHC) rejection of their pre-arrest bail plea in the money laundering case.

The accountability body earlier approached National Assembly Speaker Asad Qaiser to seek permission before arresting the PPP lawmaker.

A two-member bench, comprising Justice Amir Farooq and Justice Mohsin Akhtar Kiyani, allowed the anti-graft watchdog to arrest the Zardari siblings.
Earlier today, a two-member bench comprising Justice Mohsin Akhtar Kiyani and Justice Amir Farooq reserved verdict on two pre-arrest bail petitions filed by Pakistan Peoples Party (PPP) Co-chairman Zardari and Sindh legislator Talpur in two cases related to money laundering of billions through fake accounts – the mega money laundering and M/S Harish & Company cases.

Zardari is accused of illegal awarding of a water supply contract to the private company – M/S Harish & Company. The high court disposed off pre-arrest plea in the M/S Harish & Company case after NAB said it had not issued arrest warrants in the case.

The cases are part of the investigations being conducted by NAB in pursuance of the Supreme Court’s verdict in the money laundering of billions through fake accounts case wherein it forwarded the joint investigation team (JIT) report with directions to investigate and file references.

Other suspects include Omni Group’s Anwar Majeed and his son Abdul Ghani Majeed, former Pakistan Stock Exchange chairperson Hussain Lawai, Summit Bank Senior Vice-President Taha Raza.

On May 14, the anti-corruption unit furnished details of inquiries, investigations and references in the fake accounts case. In the report, NAB listed down at least eight cases where Zardari’s link had been established. It further added that 22 inquiries and three investigations are underway while three references have been filed.

The fake accounts saga

Information regarding the fake accounts came to the fore when an intelligence agency picked up a prominent money changer in an unrelated case. In December 2015, the Federal Investigation Agency (FIA) began a discreet investigation into certain bank accounts through which multi-billion rupee transactions have been made.

The probe was initially shelved but resumed almost a year and a half later with FIA’s State Bank circle initiating a formal inquiry in January 2018. By June, the FIA had several high-profile names on its list but was unable to make headway–for several reasons.

It was at his point that the Supreme Court intervened and then chief justice Mian Saqib Nisar took suo motu notice of the ‘slow progress’ in the money-laundering case. In July, Zardari’s close aides Hussain Lawai, Taha Raza and two others were arrested. Subsequently, the first case was registered in the mega-corruption scandal.

The then chief justice ordered the formation of a joint investigation team to quicken the pace of the investigation. The JIT identified 11,500 bank accounts and 924 account holders at the start of their investigation.

The JIT report in a nutshell

According to the report, the JIT identified 11,500 bank accounts and 924 account holders at the start of their investigation.

Its experts generated 59 Suspected Transaction Reports (STR) and 24,500 Cash Transaction Reports. That means the transactions were flagged as suspicious.

Due to the high quantum of transactions, the JIT decided on a threshold of Rs10million “to track, follow and minutely investigate the flow of funds beyond the immediate counterparties and determine the source of funds and ultimate beneficiaries.”

It questioned 767 individuals, including Zardari and Talpur, while Bilawal submitted written responses.

I remember in last 2 years some analysts on PP and in Media used the argument that Zardari is being given special treatment and only Nawaz Sharif is facing all the music...

I never thought i will see a day when Nawaz and Zardari both will be in jail at the same time!
 
It took them a good 6 months to arrest him. AZ must have taken full advantage of all these bails by tampering with evidences, threatening witnesses, prosecution and judges behind the scenes

NA session is going to begin today so i can see a production order coming from NA speaker today or tomorrow so that Zardari can be released to attend NA session. Our whole system is a joke...

Also important to note that NAB have take into custody the key figures especially the senior management t of the Omni Group.

Whatever the situation, it does not look good for Zardari and his sister.

A 15-member team of the National Accountability Bureau (NAB), accompanied by police personnel, arrested PPP co-chairman Asif Ali Zardari from his residence in Islamabad on Monday.

A number of party workers and Zardari's children Bilawal and Aseefa saw him off as the former president was driven away in a black Landcruiser. He is being taken to the NAB Rawalpindi office.

The arrest comes hours after the Islamabad High Court rejected an application seeking extension in the pre-arrest bails of Zardari and his sister Faryal Talpur in the fake accounts case.

Police personnel, including female officials, had entered the former president's house after the court decision. All roads leading to the residence were blocked by police.

A two-member bench that had earlier reserved its verdict on their application announced the verbal order. Both Zardari and Talpur had left the court building before the verdict was announced.

The warrants for Zardari were apparently issued yesterday. No warrants have been issued for Talpur as yet, however.

The accountability watchdog had constituted two teams for the arrest of the former president, DawnNewsTV reported citing officials. One team was dispatched to Parliament House and another to Zardari House in Islamabad, officials said.

According to Geo News, NAB had informed the National Assembly through a letter that it was going to execute the warrants against Zardari issued by the NAB chairman.

Zardari and Talpur have the option of appealing the IHC judgment in the Supreme Court.

The case pertains to suspicious transactions worth Rs4.4 billion allegedly carried out through a fictitious bank account. According to the prosecution, the account titled M/s A One International was fake and it received a sum of Rs4.4bn out of which Rs30m was paid to the Zardari Group at two different times.

Meanwhile, the PPP has called a consultative meeting to discuss the future legal options of Zardari and Talpur. According to sources, Zardari has called his legal team to the meeting to deliberate on whether to challenge the IHC judgement in the SC.

The spokesperson for PPP Chairman Bilawal Bhutto-Zardari, Mustafa Nawaz Khokhar, appealed to PPP supporters across the country to remain peaceful.

"We are waiting for IHC's written order," he said, adding that future strategy will be decided once the party receives the order.

Bail proceedings
Earlier, when Zardari arrived at the court for the hearing, he was accompanied by his daughter Aseefa. Security measures around the court were tightened prior to the former president's arrival.

"Let a bail hearing remain just that, do not turn it into a trial hearing," Justice Farooq said while telling the NAB lawyer to only mention any details missed during arguments rather than recapping the whole case.

The NAB prosecutor argued that as per the standards set by the Supreme Court, bail cannot be granted in this case.

PPP workers gathered close to the court as prisoner vans were also brought to the site.

PPP workers in Punjab have already planned a protest in case Zardari is arrested. The party planned blockade of all major roads of the Punjab capital by arranging workers’ protests there in case of arrest of the party’s co-chairman.

A PPP worker, Azizur Rehman Chan, said that the protest would be “vigorous” as committees had been formed and duties assigned for each protest point.

Faisal Mir, another PPP leader, said that if Prime Minister Imran Khan managed to get Zardari arrested through the NAB, he would be laying the foundation for the removal of his government.

A NAB officer investigating the fake bank accounts case had informed an IHC division bench last month that the investigation team of the case had sought approval from the NAB chairman for the arrest of Zardari and his sister.

The fake accounts saga
In 2015, the Federal Investigation Agency (FIA) had launched a probe into fake accounts and fictitious transactions conducted through 29 ‘benami’ accounts in Summit Bank, Sindh Bank and UBL on the basis of a tip-off.

Initially, seven individuals, including Zardari and his Talpur, were said to be involved in using those accounts for suspicious transactions. The accounts were allegedly used to channel funds received through kickbacks.

Later, the apex court took a suo motu notice on the delay in the FIA probe into the case. The SC also constituted a Joint Investigation Team (JIT) to probe into the matter.

The JIT during the course of investigation uncovered 33 more suspicious accounts linked to the case, while nearly 170 individuals linked to the case were put on the no-fly list.

According to a report submitted in the court, 210 companies were also found to have alleged links to the case. As many as 47 of these companies and 334 people were associated with the Omni Group — owned by a close aide of Zardari. At one stage, the top court had frozen all assets and accounts of the group.

The accountability watchdog and the FIA allege that an account titled M/s A One International was fake and it received a sum of Rs4.4 billion out of which Rs30 million were paid to the Zardari Group at two different times.

The FIA had filed the case before a banking court in Karachi which had issued an arrest warrant for Zardari. Subsequently, the PPP leader had obtained protective/transitory bail from the IHC on August 18, 2018. Later, the case was shifted from the accountability in Karachi to an accountability court in Islamabad as the investigators accused the PPP of influencing the case.

During the course of the investigation, on April 8, two accused in the case — Kiran Aman and Noreen Sultan — became approvers against Zardari and Talpur.

Several close friends of Zardari had been arrested in the case, while the PPP chief and his sister Faryal Talpur were on an interim bail which was extended multiple times before being rejected on Monday. Both Zardari and Talpur are on bail in at least seven other cases of corruption and malpractice.

I would take martial law any day over this so called iblis ka nizaam.

During "martial law" our economy was growing at 7+ rate annually and there was an effective system of local governance that was taking development to grass roots level.

PPP Chairperson Bilawal Bhutto Zardari, while addressing a press conference hours after the arrest of his father Asif Ali Zardari, complained that he was not allowed to speak "yet again" in the National Assembly during Monday's session.

"Three of the government members got the chance to speak but I was denied to speak in the house," he alleged. "I condemn the attitude of National Assembly speaker [Asad Qaiser] and deputy speaker [Qasim Suri] and demand that they resign from their posts because they are not impartial — they act like an extension of the government."

The National Assembly session on Monday was adjourned after opposition members surrounded the speaker's dais and protested against Deputy Speaker Suri giving the floor to Railways Minister Sheikh Rashid instead of the PPP chairperson.

Suri had assured the protesting MNAs that Bilawal would be allowed to speak after Sheikh Rashid's speech. The deputy speaker said that he had given the floor to the railways minister because the latter wanted to respond to Leader of the Opposition in the National Assembly Shehbaz Sharif, who had named Rashid in his speech.

"We have seen with our own eyes that when someone from the government indicates, the speaker gets up or sits down," Bilawal said in the press conference. "I wasn't allowed to speak in the National Assembly — I am a representative of the people of Larkana, an elected MNA."


'Censored' Pakistan

He also lambasted the government for turning the country into a "censored Pakistan".

"Our media is facing censorship, as I have been saying since the elections. Those who don't toe the line, face repercussions. Interviews are not aired, woes of judiciary are not being discussed.

"This doesn't happen in a democracy; this is not a democratic Pakistan — this is a censored Pakistan.

"Every citizen has the right to a fair trial, they deserve to know if a reference is being filed against them, not from a ticker on the television but from those filing it," said Bilawal, alluding to the reference against Justice Qazi Faez Isa.

"If the government was filing references [against sitting judges], they should have told the National Assembly."

Speaking on the arrest of his father, Bilawal said the former president turned himself in because he wants to avail his right to a fair trial. "We have never hidden behind arrests or cases. What's the difference between this naya [new] Pakistan and the Pakistan of retired Gen Pervez Musharraf or that of General Ayub Khan? People were silenced then and the same is happening now.

"When the government is selected and weak, it is scared of criticism — whether the criticism is from me, Zardari, Shehbaz Sharif, Hamza Shehbaz or Manzoor Pashteen."


'I am not impatient'

"As the son of [former prime minister] Benazir Bhutto and the grandson of [former prime minister] Zulfikar Ali Bhutto, it is incumbent upon me to continue the struggle for democracy," he added.

"I wanted to ask the speaker today: how can you scare the child whose grandfather was hanged, whose grandmother was beaten, whose mother was fired at with teargas, whose uncle was poisoned?

"They have arrested Zardari, [former prime minister] Nawaz Sharif — when all the 'corrupt' people are in jails and this government is 'uncorrupt', then why are people's pockets still empty? What did they do with the money that was saved from getting rid of all the corrupt people?" asked Bilawal.

"We understand that to run this country means that you take all institutions and political parties together. There are so many problems in this country, if one person or a single institution thinks that they can solve everything alone, that is wrong," he said.

When asked about the role of the establishment in the recent developments, Bilawal said to the reporter that this was a very "innocent" question.

"They are running everything; we know this, you know this, they know this as well," he said to the reporter.

"But PPP has always tried to uphold democracy and convince them that in democratic, civilised countries, army is posted in three positions: at the border, at the barracks and in the battlefield.

"We have [spent] a majority of our time under dictatorships. It will take us time to pass through this transition [to reach the position] where every institution plays its role. We will keep trying to strengthen Pakistan's democracy.

"PPP has always supported democracy [...] I am not impatient, I will continue to struggle just like my mother and grandfather."

I remember being concerned in 2008 after Musharraf's resignation about Zardari becoming president and what he would do to Pakistan given his penchant for corruption and many people in my office argued "He has already made so much money in his life, everyone has a limit, he won't do any more corruption, we should be happy the millitary is on its way out and we have a civilian president, the worst democracy is better than the best military dictatorship, let the system run on its own and it will correct itself".

Well the results are in front us with the nations debts having gone up from $36 billion to a $100 billion in the last 10 years and Current Account Deficit standing at $38 billion. Zardari arrested by NAB after IHC rejects bail plea, taken to Rawalpindi

A 15-member team of the National Accountability Bureau (NAB), accompanied by police personnel, arrested PPP co-chairman Asif Ali Zardari from his residence in Islamabad on Monday.

The arrest came hours after the Islamabad High Court rejected an application seeking extension in the pre-arrest bails of Zardari and his sister Faryal Talpur in the fake accounts case.

A number of party workers as well as two of Zardari's children — PPP Chairperson Bilawal and youngest daughter Aseefa — saw the former president off as he left from Zardari House in Islamabad to the NAB Rawalpindi office in a black bulletproof vehicle.

Senior PPP leaders wrote to NA Speaker Asad Qaiser requesting that production orders for the former president be issued as per Rule 108 of the Rules of Procedure and Conduct of Business in the NA, 2007.

"As a custodian of the House, it is therefore requested that you may kindly issue the production order of honourable MNA Mr Asif Ali Zardari without unnecesssary delay in order to allow him to attend the ongoing session of the NA," a letter signed by former premier Raja Pervez Ashraf, Shazia Marri, Javed Shah and Sajid Turi said.

A meeting of the PPP's central executive committee was held later in the evening. According to the party's media cell, a protest has been called tomorrow at Karachi's Hassan Square to protest against Zardari's arrest.

How it happened
As a two-member bench of the IHC reserved its verdict on the applications filed by Zardari and Talpur, the duo left the court building.

According to Geo News, NAB had informed the National Assembly speaker through a letter that it was going to execute the warrants against Zardari issued by the NAB chairman.

While NAB already had warrants for Zardari, no arrest warrant has been issued for Talpur as yet.

Following the refusal of bail, the accountability watchdog constituted two teams for the arrest of the former president; one team was dispatched to Parliament House and another to Zardari House in Islamabad, officials said.

A 15-member NAB team as well as male and female police personnel arrived at Zardari House while all roads leading to the residence were blocked as a security measure.

Zardari and Talpur now have the option of appealing the IHC judgment in the Supreme Court.

The case pertains to suspicious transactions worth Rs4.4 billion allegedly carried out through a fictitious bank account. According to the prosecution, the account titled M/s A One International was fake and it received a sum of Rs4.4bn out of which Rs30m was paid to the Zardari Group at two different times.

PPP protests
Soon after the verdict, the PPP called a consultative meeting to discuss the future legal options of Zardari and Talpur. According to sources, Zardari had called his legal team to the meeting to deliberate on whether to challenge the IHC judgement in the SC.

PPP Chairperson Bilawal Bhutto-Zardari urged party workers to remain calm. "The people have never accepted controversial court verdicts," he was quoted as saying.

"The PPP believes in the rule of law despite biased court decisions."

A number of PPP workers in Lahore protested against the IHC decision at Gulab Devi Chowk, Ferozepur Road and Garhi Shahu. They blocked the Metro Bus track, burnt tyres and chanted slogans against the government.

The PPP Karachi division asked party leaders and workers to show up at the Karachi Press Club in the evening to protest what it called the "oppressive machinations of this selected incapable government". It termed the court decision a part of the government's alleged policy of "political victimisation in the name of accountability".

Bail proceedings
Zardari arrived at the court for the hearing on Monday morning and was accompanied by his daughter Aseefa. Security measures around the court were tightened prior to the former president's arrival.

Additional Prosecutor for NAB Jahanzeb Bharwana assisted the two-member bench comprising Justice Aamer Farooq and Justice Mohsin Akhtar Kayani.

"Let a bail hearing remain just that, do not turn it into a trial hearing," Justice Farooq said while telling the NAB lawyer to only mention any details missed during arguments rather than recapping the whole case.

The NAB prosecutor argued that as per the standards set by the Supreme Court, bail cannot be granted in this case.

Representing Zardari, lawyer Farooq H. Naek argued that all documents submitted by NAB stated that the alleged fake accounts were opened by the Omni Group. None of the documents prove that Zardari had opened any of the suspected accounts, he added.

PPP workers gathered close to the court as prisoner vans were also brought to the site.

A NAB officer investigating the fake bank accounts case had informed an IHC division bench last month that the investigation team of the case had sought approval from the NAB chairman for the arrest of Zardari and his sister.

The fake accounts saga
In 2015, the Federal Investigation Agency (FIA) had launched a probe into fake accounts and fictitious transactions conducted through 29 ‘benami’ accounts in Summit Bank, Sindh Bank and UBL on the basis of a tip-off.

Initially, seven individuals, including Zardari and his Talpur, were said to be involved in using those accounts for suspicious transactions. The accounts were allegedly used to channel funds received through kickbacks.

Later, the apex court took a suo motu notice on the delay in the FIA probe into the case. The SC also constituted a Joint Investigation Team (JIT) to probe into the matter.

The JIT during the course of investigation uncovered 33 more suspicious accounts linked to the case, while nearly 170 individuals linked to the case were put on the no-fly list.

According to a report submitted in the court, 210 companies were also found to have alleged links to the case. As many as 47 of these companies and 334 people were associated with the Omni Group — owned by a close aide of Zardari. At one stage, the top court had frozen all assets and accounts of the group.

The accountability watchdog and the FIA allege that an account titled M/s A One International was fake and it received a sum of Rs4.4 billion out of which Rs30 million were paid to the Zardari Group at two different times.

The FIA had filed the case before a banking court in Karachi which had issued an arrest warrant for Zardari. Subsequently, the PPP leader had obtained protective/transitory bail from the IHC on August 18, 2018. Later, the case was shifted from the accountability in Karachi to an accountability court in Islamabad as the investigators accused the PPP of influencing the case.

During the course of the investigation, on April 8, two accused in the case — Kiran Aman and Noreen Sultan — became approvers against Zardari and Talpur.

Several close friends of Zardari had been arrested in the case, while the PPP chief and his sister Faryal Talpur were on an interim bail which was extended multiple times before being rejected on Monday. Both Zardari and Talpur are on bail in at least seven other cases of corruption and malpractice.

Reading through this list, I had second thoughts; let Zardari and Sharifs continue their way and in next 10 years, they will own 50% of London,Paris. 75% of Dubai. If it were not interrupted by PTI, master plan of Zardari and Sharifs was to take control of London, Paris, Dubai; all for the cause of "Pakistan Khapay".

IK has no control over NAB,if he did then the chairman would have long gone. NAB is with the these crooks and are probably creating wholes in their own case so that he can be let off by some crooked judge. As far as another fight goes, AZ is crook and timing is irrelevant. Great news today.

Relax. The vast number of his "workers" and aides are now without his supervision. Thing with Mafia bosses is they don't trust anyone, not even family and when they are away for a long time, company tends to disintegrate.

From management POV, Sharifs and Zardari in Jail are a bigger headache but they won't return back money if they aren't in jail. They ultimately have to return back the looted money or in couple of years one by one they all will end up in Jail.

With new local body format, PTI will be stronger beyond the imaginations of PMLn and PPP. This will take powers away from bureaucrats who are PMLn appointees (Majority in Punjab). And Local bodies governance was the most significant factor in PTI winning KPK at 2018 General Elections.

These arrests will handicap opposition against PTI for LB elections in Punjab.

And we all are contributing to make it bigger every day. It's all around us 24/7.

Why blame the govt, the NAB is doing what it is supposed to do? You want the PM to now act extra judicial and direct, interfere with the NAB and tell them not to do anything with Zardari when they have a solid case against him?

NAB is not under his control because if it was there would be alot more people behind bars and more to the point, they would actually get around to prosecuting someone. Can you name some they have prosecuted?
