Indian army used cluster ammunition along LoC in violation of international laws: ISPR

The Indian army earlier this week used cluster ammunition to target the civilian population in Azad Jammu and Kashmir (AJK) across the Line of Control (LoC) in violation of the Geneva Convention and international law, the Inter-Services Public Relations (ISPR) said on Saturday.

According to the statement, the Indian military on the night of July 30/July 31 targeted innocent citizens including women and children in Neelum Valley through artillery using cluster ammunition. The attack left two civilians, including a 4-year-old boy, dead and 11 others were critically injured.

"This is [a] violation of Geneva Convention and international humanitarian law," the military's media wing said, adding that the use of cluster ammunition is prohibited under the Convention on Cluster Ammunition because of its severe impact on non-combatants.

Dropped from planes or fired from artillery, cluster bombs explode in mid-air, scattering bomblets, with many civilians getting killed or maimed by their indiscriminate, wide-area effect. They also pose a lasting threat as many bomblets fail to explode on impact.

According to the International Committee of the Red Cross, "Cluster munitions kill and injure large numbers of civilians and cause long-lasting socio-economic problems. The 2008 Convention on Cluster Munitions prohibits the use, production, stockpiling and transfer of cluster munitions and requires States to ensure that they claim no further victims."

"This blatant Indian aggression against all international norms exposes true character of Indian Army and their moral standing," the ISPR statement said.

It added that it was time for the international community to take notice of "this Indian blatant violation of international laws" on use of cluster ammunition for the purpose of targeting innocent citizens.

The military's media wing also shared images of civilians who sustained gruesome injuries from the Indian troops' use of cluster munitions.

Govt's warning
The ISPR statement comes a day after the AJK government warned people, particularly those living along the LoC, against touching or picking any familiar and unfamiliar devices or gadgets if found lying anywhere in the shelling-infested areas to avoid any danger to their lives, Dawn reported.

Three people lost their lives and four others were wounded when they tried to tamper with a dud device in a shop near Muzaffarabad a few days ago.

The warning came from the home department in the wake of reports that several dud shells and bomblets, fired by the Indian troops in recent ceasefire violations, had scattered far and wide along the LoC.

Previously, a number of casualties had also occurred when LoC residents, mostly young children, had tried to play or tamper with dud shells or bomblets out of ignorance, even though similar announcements were also made then.

“The enemy troops are constantly firing toy-shaped cluster bombs, mort**ar and medium artillery shells in civilian-populated areas … If anyone spots any such device or gadget, including a mobile phone, he should not even touch it, let alone pick it up and take home,” said the home department in a press release. Instead, it added, “the nearest police station, civil defence officials or volunteers or village defence committee members should be informed about it becau*se such a device can take your life”.

We know who starts these ceasefire violations. And use of cluster bombs cannot be justified under any circumstances. These are our Kashmiri brothers and sisters which are getting killed. Go to India and drop cluster bombs on your own people. Not here.

ISLAMABAD: Prime Minister Imran Khan convened a meeting of the National Security Committee on Sunday to discuss issues pertaining to national security in the wake of cluster bomb attack carried out by India against civilians in Neelum Valley.

Special Assistant to Prime Minister on Information and Broadcasting Dr Firdous Ashiq Awan shared the proceedings in a tweet earlier today.

The Inter-Services Public Relations on Saturday said the Indian army had been using cluster bombs to target civilians along the Line of Control (LoC).




“Indian Army uses cluster ammunition along LoC deliberately targeting Civilian population. This is a violation of the Geneva Convention and international humanitarian law,” the military’s media wing said in a statement.

“Indian Army on night July 30th/31st targeted innocent citizens including women and children in Neelum Valley through Artillery using cluster ammunition. Resultantly two civilians including a four-year-old boy martyred while 11 got critically injured,” the ISPR added.

Cluster munitions, or cluster bombs, are air-dropped or ground-launched explosive weapons that releases smaller 'bomblets' over a wide area. They pose serious risks to civilians during and after attacks, as the unexploded bomblets can kill or maim civilians long after a conflict has ended, and are costly to locate and remove.

India using toy bombs to target children in Neelum Valley: report

cluster toy bombs, which are being traced back to India, have been recovered from near the Line of Control (LoC) in Neelum Valley, ARY News reported Saturday.

According to reports, the toy bombs were placed in the peripheries of Azad Jammu and Kashmir (AJK), near the Working Boundary (WB) of the two countries. WB is the line where Indian occupied Kashmir (IoK) meets Pakistan’s border.

The bombs, reports said, have so far killed three, including a four-year-old child, besides injuring 11 others.

Cluster bombs have been banned under the Geneva Convention, which India is a signatory of.

Shaped like harmless toys, they can be devastating after detonation — exploding into millions of razor-sharp blades that pierce through whatever stands within its range.

The civil and military leadership, during a National Security Committee (NSC) meeting called on Sunday, reaffirmed Pakistan’s resolve to respond to any "misadventure or aggression" by Indian forces, a press release by the Prime Minister's Office said.

The meeting was summoned by Prime Minister Imran Khan in the wake of the Indian army's use of cluster ammunition to target the civilian population in Azad Jammu and Kashmir (AJK) across the Line of Control (LoC) in violation of the Geneva Convention and international law.

Defence Minister Pervez Khattak, Foreign Minister Shah Mahmood Qureshi, Army Chief General Qamar Javed Bajwa, and other top civil and military leaders attended the meeting.

The participants condemned Indian army's "destabilising efforts" in AJK and occupied Kashmir at a time when "Pakistan and the international community were focused on resolving the Afghan conflict". They also noted that aggression by the Indian forces will "increase the level of violence and turn [the region] into a flash point and a destabilising factor".

"The more India is exposed internally and internationally in its machinations, the more there are chances that it may resort to desperate and risky options including false flag operations," the statement read.

In a major escalation in the ceasefire violations, India has begun using cluster munitions on civilian population living close to the LoC. The use of cluster bombs on the Neelum Valley over the past few days has caused multiple fatalities and injuries to several others, including minor children.

Over the past few years, besides a spike in terms of intensity of ceasefire breaches, India has also resorted to calibre escalation and air space violations along LoC. The use of cluster bomb is therefore a step further towards escalation in the situation along LoC.

In a series of tweets on Sunday, Special Assistant to the Prime Minister on Information Dr Firdous Ashiq Awan said that the political leadership of Pakistan needs to be on the same page and expose the "state terrorism by India in Indian-occupied Kashmir (IoK)" and the situation at the LoC.

She said that this was not the time for politics, rather, it was the time to stand up for the nation's welfare and for Kashmiris' right to self-determination, adding that the country's leadership should send a message of unity and solidarity.


Meanwhile, the Kashmir Media Service today reported that Indian army spokesperson Colonel Rajesh Kali, based in Srinagar, claimed that seven more individuals had been killed in IoK's Kupwara district.

In a statement shared by the PML-N on Twitter on Sunday, Leader of the Opposition in the National Assembly Shehbaz Sharif condemned the deaths of the Kashmiris.

He called on United Nations Secretary General António Guterres to take immediate notice of the situation and to play his role in stopping the "murder of innocent civilians in Kashmir". Additionally, he called on the UN Security Council and the rest of the world to take notice of Indian brutality in occupied Kashmir.

According to Azad Jammu and Kashmir’s State Disaster Management Authority (SDMA), the number of casualties increased to four on Saturday as another civilian fell victim to the shelling, whereas one of those wounded on Tuesday succumbed to injuries at a hospital. The SDMA has put the number of wounded in shelling incidents at 40.

Outraged over the firing of cluster munitions on civilian populated areas of Azad Kashmir, Pakistan on Saturday called for world attention to the disregard of the widely accepted international ban on the weapons by India and massive human rights abuses being committed by Indian forces inside occupied Kashmir.

The NSC meeting came in the backdrop of Indian accusations of a cross-LoC incursion and resultant casualties. The Indian army had claimed it had "successfully foiled" a 'border action team' (BAT) operation by the Pakistan Army in the Keran sector of Jammu and Kashmir — a claim rejected by both ISPR and the Foreign Office (FO).

"Indian allegations of cross LOC action by Pakistan and possession of bodies are mere propaganda. Such blatant lies / staged dramas are Indian disinformation manoeuvre to divert world attention from increased atrocities by Indian occupation forces inside the occupied Kashmir," said ISPR.


Ban on cluster ammunition
Use of cluster munitions has been banned by 102 countries, most of which are signatories to the Convention on Cluster Ammunition, because of concerns that the weapon causes disproportionate civilian casualties. Some of the unexploded bomblets released from a cluster bomb may remain unexploded and may kill or maim civilians even afterwards.

The Organisation of Islamic Cooperation (OIC), in a press statement released today, expressed deep concern over the "deteriorating situation in the Indian-occupied Jammu and Kashmir, including reports of deployment of additional paramilitary forces and use of banned cluster munition by the Indian forces to target civilians".

The OIC called upon the international community to "rise up to its responsibility for the peaceful resolution of Jammu and Kashmir dispute".

The size of cluster munitions varies from four to five inches and because of their shape — resembling a soft drink can or an orange — villagers refer to them as “toy bombs”.

Military sources say though cluster bombs are designed as anti-personnel and anti-armour weapons, innocent civilians mostly end up being their primary victims, 40 per cent of whom are children who are drawn to the small, toy-like metal objects.

Cluster bombs are believed to be deadlier than landmines, which is why the 2008 Convention on Cluster Munitions — adopted in May 2008 in Dublin, Ireland, and signed in December 2008 in Oslo, Norway — prohibits their use, production, stockpiling and transfer and requires states to ensure that they claim no further victims.

Increased Indian deployment in occupied Kashmir
India has deployed at least 10,000 troops in IoK in recent days, with media reports of a further 25,000 ordered to the region. There are some 500,000 Indian security forces already based in the region.

The government has also introduced other security measures — including a call to stock up food and fuel — over terror threat claims.

Tourists and students have been scrambling to leave IoK since the Jammu and Kashmir state government said they should leave "immediately" amid new intelligence about "terror threats" to a major Hindu pilgrimage in the region.

Britain and Germany have also issued warnings against travel to the region.

But while the Indian military and the state government have highlighted the security risk, Kashmiri and opposition politicians in New Delhi have raised concerns that the extra troops were being deployed for other reasons.

They include fears that Prime Minister Narendra Modi's Hindu nationalist government could carry out a threat to scrap Kashmir's special status under the Indian constitution.

Political leaders in the territory have warned that cancelling constitutionally guaranteed rights — which mean only state domiciles can buy land in the region — could spark unrest in the Muslim-majority state.

On Saturday, the FO had expressed "serious concern over the progressively deteriorating situation" in IoK.

"There is a deepening anxiety and fear among the people of Indian-occupied Kashmir because of reports of deployment of additional 38,000 Indian paramilitary forces in recent weeks," read the statement.

Pak-India tension
Tensions ran high between India and Pakistan in the wake of a suicide attack on an Indian military convoy in Pulwama district of Indian-occupied Kashmir on February 14, which killed more than 40 paramilitary troops.

In what was the most serious military crisis in South Asia since 2008, Indian and Pakistani warplanes engaged in a dogfight on Feb 27, a day after a raid by Indian jet fighters on what New Delhi said was a militant camp in Pakistan. Islamabad denied any militant camp exists in the area and said the Indian bombs exploded on an empty hillside.

Pakistan downed an Indian plane for violating its airspace and captured its pilot after he ejected in AJK.

The tensions de-escalated after Prime Minister Imran Khan decided to release the Indian pilot as a peace gesture, and following concerted diplomatic efforts by countries including the United States, China and the UAE.

Nevertheless, ceasefire violations along the de-facto border have been occurring regularly.

In the wake of India's decision to strip occupied Kashmir of its special status under Indian constitution's Article 370, lawmakers will decide Pakistan's future course of action in a joint session of the upper and lower houses in the parliament today.

“This House may discuss the recent surge in unprovoked firing and shelling on civilian population and use of cluster bombs by Indian forces in Azad Jammu and Kashmir; deployment of additional troops and atrocities in Indian-occupied Jammu and Kashmir and recent developments,” said the agenda issued yesterday by the National Assembly Secretariat for the joint sitting.

Opposition leaders are expecting that Prime Minister Imran Khan will also attend the sitting as the Kashmir issue is above all political differences. Azad Jammu and Kashmir Prime Minister Raja Farooq Haider will also attend today's session.

Opposition parties had demanded that a joint session be convened soon after media broke the news of India's decision to repeal Article 370. PPP Chairperson Bilawal Bhutto-Zardari was the first opposition leader who had called for immediately summoning the joint session of parliament. He then flew to Islamabad from Karachi to participate in the joint session, that has been summoned by President Arif Alvi.

Yesterday, India's ruling BJP stripped Kashmiris of the special autonomy they had for seven decades through a rushed presidential order. An indefinite curfew — that has entered its third day today — was imposed in Indian-occupied Kashmir and elected leaders were put under house arrest.

By repealing Article 370 of the constitution, people from the rest of India will now have the right to acquire property in IoK and settle there permanently. Kashmiris as well as critics of India’s Hindu nationalist-led government see the move as an attempt to dilute the demographics of Muslim-majority Kashmir with Hindu settlers.

Furthermore, Indian Home Minister Amit Shah, who is also president of the BJP, moved a bill to bifurcate the state into two union territories to be directly ruled by New Delhi.

A session of the Organisation of Islamic Cooperation (OIC) will take place today in Jeddah to discuss the developments regarding Indian-occupied Kashmir, the Foreign Office said on Tuesday.

On Monday, India's ruling Bharatiya Janata Party (BJP) stripped Kashmiris of the special autonomy they had for seven decades through a rushed presidential order.

In a tweet, Foreign Office Spokesperson Dr Mohammad Faisal said that Minister for Foreign Affairs Shah Mahmood Qureshi will represent Pakistan in today's meeting.

"Meeting of the OIC contact group on Jammu & Kashmir is being held in Jeddah today, on the recent condemnable illegal developments regarding IoK," said Dr Faisal.


On Sunday, the General Secretariat of the OIC expressed "deep concern" over the deteriorating situation in India-held Kashmir, including the reports of deployment of additional paramilitary forces there.

On Monday, the Foreign Office (FO) strongly condemned and rejected the move by the Indian government, stressing that occupied Kashmir was internationally recognised as a disputed territory.

"No unilateral step by the Government of India can change this disputed status, as enshrined in the United Nations Security Council (UNSC) resolutions," read the statement. "The decision will never be acceptable to the people of IoK and Pakistan."

"As the party to this international dispute, Pakistan will exercise all possible options to counter the illegal steps," the statement read while reaffirming Pakistan's commitment to the Kashmiri cause.

Leadership of various religious and political organisations in Pakistan called for the OIC to take the matter of occupied Kashmir and said that India was playing havoc with world peace. They said that more than 1.5 billion people of South Asia were particularly facing an alarming situation because of Indian aggression in the region.

A session of the Organisation of Islamic Cooperation (OIC) will take place today in Jeddah to discuss the developments regarding Indian-occupied Kashmir, the Foreign Office said on Tuesday.

On Monday, India's ruling Bharatiya Janata Party (BJP) stripped Kashmiris of the special autonomy they had for seven decades through a rushed presidential order.

In a tweet, Foreign Office Spokesperson Dr Mohammad Faisal said that Minister for Foreign Affairs Shah Mahmood Qureshi will represent Pakistan in today's meeting.

"Meeting of the OIC contact group on Jammu & Kashmir is being held in Jeddah today, on the recent condemnable illegal developments regarding IoK," said Dr Faisal.


On Sunday, the General Secretariat of the OIC expressed "deep concern" over the deteriorating situation in India-held Kashmir, including the reports of deployment of additional paramilitary forces there.

On Monday, the Foreign Office (FO) strongly condemned and rejected the move by the Indian government, stressing that occupied Kashmir was internationally recognised as a disputed territory.

"No unilateral step by the Government of India can change this disputed status, as enshrined in the United Nations Security Council (UNSC) resolutions," read the statement. "The decision will never be acceptable to the people of IoK and Pakistan."

"As the party to this international dispute, Pakistan will exercise all possible options to counter the illegal steps," the statement read while reaffirming Pakistan's commitment to the Kashmiri cause.

Leadership of various religious and political organisations in Pakistan called for the OIC to take the matter of occupied Kashmir and said that India was playing havoc with world peace. They said that more than 1.5 billion people of South Asia were particularly facing an alarming situation because of Indian aggression in the region.

As Pakistan-India tensions flare, a child mistakes a bomb for a toy

JABRI, Pakistan (Reuters) - Deep in the mountains of the Neelum Valley, where a river separates Indian and Pakistani Kashmir, is the small village of Jabri, usually far enough away to avoid being hit by exchanges of fire between the countries’ armies.

That changed late last month when Indian artillery shells hit the village and an unexploded device found its way into the hands of four-year-old Ayan Ali.

“He found a bomb that looked like a toy and he brought it here,” said Ali’s uncle, Abdul Qayyum, pointing to their home.

Ali showed the “toy” to his siblings as the family sat down to breakfast. It exploded, killing Ali and wounding eight of his siblings, his mother and a young cousin.

“They tried to snatch it from him and then it exploded. He died on the spot,” Qayyum said, adding that two of the children are in hospital in critical condition.

Pakistan’s military said the device was a cluster bomb, a weapon that releases many smaller bomblets that can kill or wound people over a wider area. They are prohibited under the Geneva Convention governing international warfare.

The Indian government and army denied the allegation, and two army officials told Reuters that its shelling across the border was proportionate and in response to Pakistani fire.

On a visit to the Jabri area on Friday, a Reuters journalist was unable to independently verify the type of device that killed Ali, though there were signs of damage in the home.

A small crater in the concrete floor marked the place where Ali was standing when the device exploded.

“The little kids were playing and then there was a loud sound. There was smoke everywhere, I couldn’t see anything,” said Sadaf Siddiq, Ali’s older sister.

A shell hit another nearby home, opening a large hole in the roof but nobody inside was injured, said its 37-year-old owner Muhammad Hanif.

The Pakistan military said they had cleared a number of unexploded devices from the area. One military official showed a toy-sized device that he said was part of a cluster bomb, which could not be independently verified by Reuters.

Cross border exchanges of fire have intensified in recent years and India and Pakistan accuse each other of regularly violating a ceasefire agreement along the 740-km (460-mile) Line of Control (LoC), which serves as a de-facto border in the disputed Kashmir region.

Tensions increased this week after India set a new policy to revoke Jammu and Kashmir state’s rights to set its own laws, arrested hundreds of political leaders and activists, and severed nearly all communications from Indian Kashmir.

Both countries claim Kashmir, and have fought two of their three wars over the Himalayan region, which they have disputed since partition and independence from British colonial rule in 1947.

Isn't that what jihadis (a.k.a 'non state actors') have also been doing? Is sending jihadis across the border to indiscriminately kills civilians okay?

This cluster bomb story started by the ISPR has been debunked. Indian army does not have cluster bombs in its inventory.

For the record, I strongly oppose such destructive items like cluster bombs or chemical weapons, regardless of who uses it.
