Indian TV Anchor Arnab Goswami Arrested

On top of that BJP's silence in this case is astonishing. With 350 parliament seats if they still cant stop the open gundagardi of Shiv Sena (a party with only 50 MLAs)...why should people vote for them? How many more seats in Parliament they want? Maharastra needs President rule asap. Enough.

Its pretty clear that Arnab is being harassed for questioning Sonia Gandhi/Uddhav Thackrey. Now his life is at risk with Mumbai's top encounter police arrrsted him and taken to a high profile jail.

And not a word from Modi/Amit Shah. Phew.

The BJP is in on it.

Arnab thought he could ride on their coattails forever and make enemies out of anyone and everyone - the Congress, Bollywood, Police, Cricketers, well unfortunately that strategy has an expiry date and his handlers aren't standing up for him to avoid compromising themselves.

LOL, where do we begin?

The channel has a YouTube page with all his debates uploaded. It's basically a loudspeaker for the Sanghis and everybody else is bullied. Of particular interest is him screaming at the top of his voice for Rhea Chakraborty's arrest - karma struck back in 3 months flat. Lovely.

If you miss him, don't worry. He'll be out in a matter of days. The powers that be (the BJP included) just want a public humiliation of him, which is being done as we type.

Where was he forced to drink cow urine?

Did you read about his behavior in courts or his son threatening police officers?
 
As far as Bihar election is concerned which my liberal brothers are enjoying since exit poll and I know will rejoice tomorrow, let me put my thoughts right now as I will be away tomorrow.

Its a vote for anti incumbency against Nitish rather than anger against Modi. Nitish Kumar is the longest serving CM after Naveen Patnaik and people just want change. It has no bearing on Modi's fate in 2024. Sorry to break it down but BJP will never be defated until Congress is strong.

In all state elections where BJP is losing power, its the regional parties that are defeating them and not congress - let it be AAP in delhi, TMC in Bengal, RJD in Bihar etc. But none of these parties will fight for PM candidate against Modi in 2024. It will be Congress and its crown prince Rahul Gandhi again. And Prince sahib will lose again for umpteenth time.

As far as Bihar is concerned, though I am not a fan of Nitish Kumar but someone who was born in Bihar and seen Jungle raaj, Laloo Yadav and Rabri Devi was worst. Nitish Kumar's JDU was definitely an upgrade over Lalu's RJD. But it looks like Lalu's son, who himself is a 7th std pass, managed to fool people by promising 10 lakh jobs. Lets see how this drama goes.

Nitish improved the law and order, but development has stagnated ( I have worked with his party during last year's general elections, but didn't like his complacency). Tejashwi may be 9th fail, but he is one to look out for future. Anyone whose talks of development and not caste/religion arithmetic, needs a chance. It is good to see the voters asking for development, while earlier they were happy if the person of their caste was the CM even if he did nothing for them.
 
Arnab Goswami: Bail denied to Republic TV founder arrested in suicide case

The high court in Mumbai has refused to grant bail to top Indian TV news anchor Arnab Goswami, who is under arrest in an abetment to suicide case.

The 47-year-old founder of Republic TV was detained last week and remanded to custody for 14 days.

He is being investigated for his alleged role in the death of an architect who designed his studio.

Mr Goswami and Republic TV network deny allegations he owed money to Anvay Naik, who took his life in 2018.

The case is being closely followed as Mr Goswami is a polarising figure whose contentious broadcasts have earned him loyal viewers as well as critics. His arrest, too, has divided opinion, with many alleging it was politically motivated.

A video aired on Republic TV on Sunday showed Mr Goswami shouting from inside a police van. He alleged that a prison official had attacked him the previous evening, his life was in danger and that he was not allowed to speak to his lawyer.

This happened while he was being transferred to a jail from a makeshift Covid quarantine centre where he had tested negative for the virus.

After Mr Naik killed himself, his wife accused Mr Goswami of not paying his fee. She said her husband had left a suicide note in which he blamed Mr Goswami for his death.

She has been campaigning on social media for the case to be investigated thoroughly. Maharashtra state Home Minister Anil Deshmukh recently ordered a special team to look into the case.

Excuses. Arnab's arrest video is in public and for everyone to see. Does police havd any video or evidence where his son threatened or attacked police officer? And if he did, why is he not in jail yet?

Are you denying that Arnab is being targetted as Vandetta politics by Shiv Sena? Imagine if Pranoy Roy or Rabish Kumar is arrested in BJP state for questioning central govt. You guys would be up in street like Shaheen Bagh.

Its clear that Arnab is targetted because he raised several questions against Uddhav Thackrey in past 6 months. Even the police officers accepted that there is too much pressure from top to keep Arnab in Jail.

Kapil Mishra and Tajinder Bagga arrested from Delhi yesterday for protesting against Arnab's arrest. Same Delhi that allowed 2 months of protest for Shaheen Bagh.

Hypocricy ki seema aur hadh dono hoti hai bhai. Sabka time aayega.

1. First of all, arnab arrest is vendetta politics sure. But case is valid. It's being doing rounds for years now as to how the other dude named him in the suicide note.

2. Second of all, his behavior and his son's threats doesn't have any bearing on Arnab's case. It was just an added point on how he was behaving. Did you read up on what Judge said to arnab about his behavior in court?

3. Let me ask you this first.

Do you even know about the long list of people arrested by BJP on trumped up charges and kept in jail without bail?

Or is your news only restricted to pro BJP news?

They could have just quietly arrested him, bailed him and then dealt with the matter in court. Why bring anti terror cops with ak47s etc to drag him out his house?

Actually contrary to what many believe here, I am not a big fan of Arnab myself and dont subscribe his style of journalism. But Mumbai Police/Maharastra Govt have scored a spectacular self goal here and made Arnab even more popular than before with this arrest. As you rightly said, they could have dealt with him queitly under the law. But they tried to show Uddhav is the boss by sending encounter police to his house with Ak47s to arrest him. Now that supreme court blasted the state govt and asked to release Arnab asap, Uddhav Thackrey is looking like a fool and defeated.
The scenes that followed when Arnab came out of jail and his speech later absolutely check mated Maharastra govt.
 
Judiciary of India is a joke and by no means separated from the executive. Any sensible Indian will at least understand this even if he doesnt admit it openly.

Attorney General must not give consent. Small people should be ignored, not turned big by judiciary going after them.

kamra has a point, that SC wouldn't have taken up matter for hearing so quickly for a commoner. but he is ignoring that the mumbai police would not have shown such quick action for someone who had the favours of the state government, so it works both ways.
 
So the AG has given consent. Wrong decision. Judiciary cannot earn respect by initiating contempt of court. There will always be people who will bad mouth the judiciary, and they should be allowed.
 
New Delhi, India – Eight days after his arrest, in a rare hearing during a holiday recess, India’s Supreme Court granted bail to right-wing TV presenter Arnab Goswami, but critics have accused the top court of failing to show the same urgency for other jailed journalists.

Goswami, who was arrested over a 2018 suicide case, walked out of a Mumbai prison on Thursday flanked by his supporters. The journalist, who has been accused of pandering to Prime Minister Narendra Modi’s agenda in his nightly shows, has been charged with abetment to suicide of an interior designer and his mother.

Goswami, the founder of the pro-government Republic TV, has denied the charges and alleged that this is a conspiracy to muzzle him by the Maharashtra government which is run by a coalition of parties opposed to the governing Bharatiya Janata Party (BJP).

His arrest last week drew swift condemnation from ministers, including powerful Home Minister Amit Shah, from the Modi government that itself has been accused of silencing dissent.

The speedy hearing and bail given to the divisive TV presenter has brought into focus cases of other journalists and activists who are undergoing or have gone through prolonged periods of imprisonment due to judicial delays.

“The Indian judiciary runs on a hierarchy – there is the lower judiciary, the high courts and at the top the Supreme Court. All litigants have to follow this chain, except in rare cases when a higher court may intervene depending on the gravity of the case,” Tarannum Cheema, a New Delhi-based lawyer, told Al Jazeera.

“It is quite surprising that the Supreme Court chose to hear Arnab’s [Goswami] matter when the lower court, in this case, the High Court, had already directed that his bail plea should be heard by a local court,” Cheema said.

In its order, the court said, “We must send a message today to the high courts as well. Please exercise your jurisdiction to uphold personal liberty … if this court were not to interfere today, we are travelling on a path of destruction of personal liberty undeniably”.

Welcome ‘judicial verdict’

BJP’s national spokesperson welcomed the granting of bail for Goswami. “I have known Arnab Goswami for the last 20 years, and I know he is a fighter. He was put in jail under strange circumstances. We accept the judicial verdict, I am happy that he has been released”, Tom Vadakkan told Al Jazeera.

The arrest and subsequent bail of Goswami follows a string of cases involving journalists, students and activists, many of whom have been charged under draconian laws such as sedition, the Unlawful Activities Prevention Act (UAPA) and the National Security Act (NSA).

Last month, journalist Siddique Kappan was arrested in northern Uttar Pradesh (UP) state while on his way to report on a gang rape and murder case. He has since been charged under the UAPA by the state government run by Modi’s BJP.
In contrast to the swiftness with which Goswami has managed to access justice, Siddique’s lawyer has not been given access to even meet him.

“On October 6, we moved a Habeas corpus petition in the Supreme Court, it was listed for October 12. On that day the Supreme Court told us to go to the appropriate local court. A few days later, our application to meet Kappan in jail was rejected by the local court,” Kappan’s lawyer Wills Mathews told Al Jazeera.

“On October 29 we approached the Supreme Court again with a bail application and seeking directions permitting us to meet Kappan, we filed for urgent listing on November 2 but due to the holiday break the court has listed the matter for November 16.”

‘Two standards of justice’

Kappan’s wife, Rihanath, says her husband has been wrongly arrested.
“It’s been almost a month since we made a request to the Supreme Court. Arnab Goswami’s file was looked at quickly. Why are there two standards of justice?” she asked.

“My husband went to UP to report. That was his mistake, his crime. But Goswami’s arrest isn’t like that. It’s related to suicide. Why is his case more urgent? He is also a journalist. What’s the difference?”

Early last month, 27-year old Prashant Kanojia, a Delhi-based freelance journalist, was granted bail by the Allahabad High Court two months after he was arrested by the UP police for retweeting a tweet related to the Ram temple in Ayodhya. This was the second time Kanojia had been imprisoned by the UP state police since 2019. In both instances, he was jailed for tweets critical of the state BJP government.

“Contrary to what many people believe, jail and not bail is the norm in lower courts,” Kanojia told Al Jazeera.
“I would only urge the Supreme Court that how they should provide ease of bail to everybody who deserves it and not just the rich and powerful like Goswami who can afford expensive lawyers at the Supreme Court.”

Kanojia was lucky as national media highlighted his case but journalists from India’s northeast and Indian-administered Kashmir have faced prolonged imprisonment. Kashmiri journalist Aasif Sultan, who was arrested on terror charges in 2018, languishes in jail. Media watchdog the Committee to Protect Journalists has called for his release.

In the northeastern state of Manipur, 39-year old Kishochandra Wangkhem, an outspoken commentator, has been in jail for more than 40 days over what the local authorities claim are communally offensive social media posts.

This is the second time Wangkhem has been arrested. Last year he spent more than four months in prison under NSA and sedition charges for posting a Facebook video criticising the state Chief Minister Biren Singh and Prime Minister Modi.
He was finally released in April 2020 by the Manipur High Court owing to procedural lapses by the police.

“We will approach the sessions court who will, I hope, follow the example set by the Supreme Court”, speaking about his second arrest, his lawyer Chongtham Victor told Al Jazeera.

Another journalist from the northeast region, Patricia Mukhim, was slapped with criminal charges for discussing the lack of police action and justice for victims of violence against non-tribal people in Meghalaya state.

“I will be filing a special leave petition in the Supreme Court. Going by the court’s latest judgement I am sure I too will get timely hearing and relief as the grounds of upholding personal liberty are applicable to my case as well”, said Mukhim, who is the editor of Shillong Times.

‘The credibility of the judiciary’

Rights activists have also pointed out that 99 percent of the habeas corpus petitions filed in the High Court in the wake of mass arrests following the stripping of Kashmir’s special status are pending.

Legal experts point out that as on November 1, 63,693 cases were pending in the Supreme Court alone while the total number of pending cases across the country hovers around 40 million.

Given the backlog, there is invariably a long waiting period before cases are taken up by the country’s top court.

But which cases get listed on a priority basis is a prerogative of the court. This opaque selection criteria has been criticised in recent times, especially regarding bail pleas involving academics like Professor Anand Teltumbde, lawyer Sudha Bharadwaj, and activists and social workers such as 84-year old Stan Swamy and 79-year old Varavara Rao, all of whom are in prison under the UAPA. On Thursday the Bombay High Court denied Rao bail despite the investigative agency admitting that he is in poor health.

On Friday, comedian Kunal Kamra was charged with contempt over his tweets criticising the top court’s decision to grant bail to Goswami. Kamra has declined to apologise for his tweets.

The president of India’s Supreme Court Bar Association highlighted the subjectivity in hearing pleas in a letter on November 10.

“In April this year as well, Goswami had received almost instant hearing at the Supreme Court and got relief as well. I am not against the latest verdict or Goswami. I just want that every lawyer and his/her client receive the same access to judicial remedy,” Dushyant A Dave told Al Jazeera.

“Selective treatment for the high and mighty like Goswami only lowers the credibility of the judiciary as an institution.”

Is there any reason why the SC is being selective in releasing journalists? Siddique Kappan has been in jail for a month now after being detained by the BJP government in UP.
 
The arrest for these two cases were under which acts?

Arnab was arrested under Section 306 of the Indian Penal Code (suicide abement). Kappan was detained under UAPA act by the local police in UP. Is there a difference in merit of arrest between the two cases?
 
Arnab Goswami, arguably India's most controversial TV anchor, became the story when he was arrested recently over a suicide case. He denies the charges and has been granted bail, but the case only adds to his polarising personality, reports BBC's Yogita Limaye.

"In a country where 80% of the population is Hindu, it's become a crime to be Hindu," Arnab Goswami declared on the prime time show of his Hindi language TV station Republic Bharat in April.

"I ask today that if a Muslim cleric or Catholic priest had been killed, would people be quiet?"

He was speaking about an incident where two Hindu "godmen" travelling in a car, and their driver, were lynched by a mob.

Police said the men had been mistaken for child kidnappers. The attackers and victims were all Hindu. But for nearly a week, the Republic network ran programmes claiming the victims' Hindu identity was a motive for the crime, echoing an unfounded theory floated by some members of India's governing Bhartiya Janata Party (BJP)

This, critics say, is the real danger of Mr Goswami's brash, cacophonic and often partisan coverage.

They believe viewers of his network are being drip-fed false information, divisive and inflammatory views, and propaganda for the Hindu nationalist BJP - its six years in power have been linked to the increased marginalisation of India's 200 million Muslims.

Mr Goswami and Republic TV didn't respond to the BBC's request for an interview, or answer questions about allegations of airing fake and inflammatory news, or partisanship towards the BJP.

A contentious style

Mr Goswami is certainly not the first to adopt this manner of coverage but he has made it louder and more aggressive than ever before. The tone is often polarising, tapping into India's religious fault lines.

In April, for instance, he falsely accused a Muslim group Tablighi Jamaat for violating lockdown orders, and called on India's Prime Minister Narendra Modi to "lock up their leadership".

In the early days of the pandemic, the group's gathering in Delhi was linked to at least a 1,000 covid cases across the country. The event's organisers insisted the congregation had been held before the government imposed a lockdown, a claim which has now been upheld by many courts in India.

But misleading broadcasts by Republic and other networks triggered Islamophobic reactions on social media.

"If there is one culprit for what we are going through as a nation in an aggravated manner, like it or not, it is the Tablighi Jamaat," Mr Goswami said in one of his many contentious segments.

In July, the network turned its lens on the death of Bollywood actor Sushant Singh Rajput, who police said had killed himself.

But Singh's family registered a police complaint against his girlfriend, actress Rhea Chakraborty, alleging abetment to suicide.

Ms Chakraborty has denied the charges, but they have sparked a relentless wave of vitriolic and misogynistic coverage - Republic ran a campaign calling for her to be arrested on charges of abetting Singh's suicide and displayed hashtags on screen like #ArrestRheaNow.

"A comparison that people love to make in India is between Republic TV and Fox News, but I think that is a bit misplaced," says Manisha Pande, executive editor at Newslaundry, which runs a weekly critique of Indian news media. "While Fox News is seen as partisan and pro-Trump, Republic TV is outright propaganda and it often spreads misinformation in service of the current national government."

"What Republic does is it sort of demonises people, often people who don't have the power to fight back, whether it's activists, young students, members of minority communities, or protesters."

The fans and the critics

Republic claims it's India's most-watched news network, an assertion that was widely believed because of the numbers the channels racked up on television ratings platforms. But the figures are now disputed and Mr Goswami and Republic are being investigated for rigging them, an allegation they have denied.

But it's clear that Mr Goswami has a large and ardent following.

"The first channel I switch on when I get home at night is Republic. Arnab Goswami is very bold and attempts to tell the truth to the public," says Giridhar Pasupulety, a financial consultant.

When asked if he was bothered by allegations that Republic runs fake news, he said: "I don't believe that. He only tells us the truth after investigation."

"It's a kind of flashy journalism, but it's required to get the message across. It's kind of a show business as well. Ignore the flashiness and look at the information being given, which is different to what other channels are showing," says Lachman Adnani, an accountant.

Author Shobhaa De believes this kind of influence is dangerous. "We need better scrutiny, more checks and balances in place. We certainly can do without this brand of hectoring and untruth, trying to pass off as 'investigative journalism'," she says.

How it all began

Mr Goswami was born in the north-eastern state of Assam. The son of an army officer, he graduated from Delhi University and then earned a scholarship for a master's programme at Oxford University.

He started his career at The Telegraph newspaper in Kolkata (formerly Calcutta), before joining NDTV, which was among the first private news channels in India. Former colleagues remember him as a balanced presenter who steered dignified debates.

It was after he moved to the channel Times Now, which launched with him as its main face in 2006, that his on-screen persona evolved into what it is today. He tapped into the pulse of India's middle class, which was angry at the then Congress party-led government for security failures during the 2008 Mumbai attacks, and for corruption scandals. He quickly became a household name in urban India.

At Republic, which he founded in 2017, Mr Goswami became even more strident and partisan. In 2019, he also launched a channel in the Hindi language, extending his popularity beyond cities.

Ms De used to participate in Mr Goswami's programmes. "I appeared frequently on his shows as a panellist at a time when he had credibility as a journalist," she says. "I stopped when I lost respect for him as an unbiased professional doing his job. He has been out of line on several fronts, and there are serious questions about his integrity these days."

Mr Goswami was recently arrested over the death of an architect who designed his studio. He and Republic TV network deny allegations that they owed money to the architect.

Many believe he was targeted because of his strident criticism of the Maharashtra government, led by the Shiv Sena, an estranged former ally of BJP.

Mr Goswami's political clout became evident when several BJP ministers came out in his support, calling his arrest an attack on press freedom in India.

It was a striking claim because dozens of journalists over the past few years have been arrested or detained in states governed by the BJP. Many have been slapped with charges such as terrorism and sedition. But party leaders and ministers have not spoken up on their behalf.

India now ranks 142 out of 180 countries on the press freedom index released by Reporters Without Borders - it dropped six places over the past years

In an interview to Gulf News in 2018, Mr Goswami was asked about bias towards the BJP. "This is an unverified complaint. In fact, we are the most robust in our criticism of the BJP on issues when it needs to be criticised," he said.

Last week, Mr Goswami was released after seven days in custody. His return to his newsroom was broadcast live on his network with the hashtag #Arnabisback prominently displayed.

His team greeted him with applause and cheering. "They are going after us for our journalism," Mr Goswami proclaimed in a dramatic speech. "I will decide the boundaries of our journalism."

"What Republic does cannot be called journalism," says Ms Pande. "It's just good reality TV. But he's successfully able to colour people's opinions. And that's troubling in a democracy."

The emergence of far right across the world could be troubling but it is a direct result of the domination of far left in the last few years. An incident involving minorities becomes a national issue while the majority is silent. It's not pragmatic to imagine that would continue. Far left liberal agendas were pushed at a breath neck pace by partison channels that claim to be fair and neutral. Ironically, the majority felt voiceless in many countries. This is an age of extremes and people like Arnab, Hannity know how to capitalize on it. The liberal agenda will continue to be pushed and the far right will continue to rebel resulting in the death of balanced opinion.

Indian police have arrested the chief executive officer of a media group that owns a polarising television news channel on charges of rigging the ratings system, a major component in determining what a channel can charge advertisers.

Police arrested Vikas Khanchandani, the chief executive of ARG Outlier Media, on Sunday at his home in Mumbai, India’s financial capital, Republic TV, which is owned by ARG, announced during a broadcast. Republic TV, which broadcasts in English and Hindi, aggressively supports Prime Minister Narendra Modi and his nationalist policies.

Republic TV denounced the arrest. “I know he will go in and come out with his head held high,” the news channel’s co-founder, Arnab Goswami, said of Khanchandani on his firebrand nightly show.

The arrest is part of a police investigation that began in October into some TV channels in the western state of Maharashtra, of which Mumbai is the capital, over accusations that they rig the ratings system.

Khanchandani had also been questioned by police earlier.

Experts say the arrests are part of a feud between Republic TV and the local administration in Maharashtra, where the coalition of governing parties resisted efforts by Modi’s party to form an alliance in the state.

Last month, police arrested Goswami at his Mumbai home and charged him with abetting suicide in connection with the 2018 deaths of an interior designer and the designer’s mother.

Multiple senior leaders of Modi’s Hindu-nationalist Bharatiya Janata Party and ministers were quick to condemn Goswami’s arrest. The Supreme Court later intervened and granted him bail after a week’s imprisonment.

Goswami has also been charged in two other cases with inciting communal tensions and promoting hatred between religious groups. He has denied all the charges.

India has one of the world’s most vibrant and competitive media environments, with more than 850 news channels broadcasting in multiple languages. But over the years, the industry has faced a crisis of credibility. Television debates among its commentators have become increasingly strident and shrill.

Many powerful television news anchors, known to support Modi and his right-leaning administration, often indulge in rancorous and chaotic debates in which shouting, screaming and name-calling have become staples.

Republic TV recently ran exhaustive coverage of the Mumbai police and accused them of mishandling an investigation into the death of Sushant Singh Rajput, a popular actor. Stories about the actor’s death sidelined other critical issues, such as India’s stalling economy, the government’s coronavirus response and growing hostilities with China over a border dispute.

The result was a surge in ratings for some TV channels, including Republic TV.

Republic TV has consistently denied the allegations of falsely bolstering its ratings data. However, the alleged ratings fraud has led to some Indian advertisers taking never-before-seen measures.

Automobile giant Bajaj Auto and Parle Products, India’s biggest biscuit maker, recently said they were pulling advertising from news channels that endorsed toxicity and hate-mongering. The companies did not name the channels, but the move was widely cheered on Indian social media.

India’s News Broadcasters’ Federation in a statement late Sunday called the arrest “highly disturbing”.

It urged the Indian government “to immediately set up an independent and neutral national agency to investigate into any allegations of professional misconduct by journalists, executives, and owners of media companies, in order to prevent selective harassment by the State Authority and to ensure the Freedom of Press”.
