Both sides expect the verdict to go their way. The verdict was reserved few months ago. No matter which way the decision goes, it’s going to be a huge news. My expectation is that Pak’s legal team would not have done its job properly and will lose the case. India will be allowed consular access. However, both sides will claim ‘victory’.

Your thoughts on what the verdict is going to be?
 
Likely that India will be allowed consular access. Not sure how that would hurt Pakistan though, he would still be in Pakistan, right?
 
as i said many times before, whatever the verdict will be, pakistan is not bound to it.

It gives India a chance at further propaganda. They will then say he doesn't look healthy, he isn't being treated well, he confirms he is innocent and being framed, etc...

In that case, Pakistan should give access to a neutral player only.
 
Does not matter what the court says coz India is never getting him back. Abhinandan was released as he was a soldier not accused or murdering innocent people. Kulbushan is a terrorist no doubt about it, what India says about him is totally irrelevant.
 
The verdict doesn't matter. He's still under arrest and won't be going anywhere until he's been milked of all the info.

Perceptions of what? He was caught and arrested. The whole case revolves around consular access...not the fact he's a spy who got caught. Regardless of the verdict, he's not going anywhere.

Not a spy. An agent of state sponsored terrorism according to Pak. Both sides will try to make the most out of a favourable verdict and you will see that at the end of the day, it is the perception that will matter.

Let me give you an example. Most Pakistanis think that their country had an upper hand in the recent tension with India. Indians, however, feel the same way about their country having the upper hand. The reality of whatever occurred is same for both the nations, but the perceptions they have been able to portray are polar opposites. As I said, in this day and age there is a perception war that is also to be won. This case, IMO, is all about perceptions.

He's caught and he's not going anywhere. That's the only thing that needs to be argued.

India acts like a teenaged girlfriend. When they're wrong, they will always go off tangent and try anything to salvage any self respect. Don't fall for it. If they spin it...let them.

They're only fooling themselves nobody else.

Yes, perception is really important. Too bad most Pakistanis don’t realize this.
 
So what happens now?

India gets consular access. The prime plea of India was for the release of Jadhav which didn’t happen but ICJ did ask Pakistan to review the decision to sentence Kulbushan for death sentence.

India may not have gotten what they hoped for but India will use this to further their narrative.
 
So in short acquittal denied release denied only access is given and the case is going into Pakistani civil court after military court that means he is going to stay in Pakistan and a repeat of same verdict although this time by a civil court.

That’s fine but it’s the narrative that India will spread that’s worrying. Everyone is underestimating the importance of having a narrative.

yes the decision that this should be tried in a civil court. it will be done and he will be given a worse punishment lol..he will not be released and consular access will not be given..essentially pakistan doesnt have to do squat..India can cry all it wants but it cannot deny the obvious..that he is a indian citizen..the ICJ was not there to try whether he was a spy or not..India wanted consular access..the ICJ has given a non binding judgment , in other words up to you pakistan..and pakistan says middle finger lol

I know but we can counter the narrative with a good strategy just like we did in February. This verdict of ICJ was expected so no surprising.

the judgment is non binding..the judgment to review is pakistans to carry out..when and how they like...we will do so and uphold the verdict..we can deny access again as per the 2008 bilateral agreement..essentially the ICJ just washed its hands of this case..lol..jadhav isnt going anywhere and your not going to get consular access to him either..and at the same time you cant go back to the icj eitehr..

He is a terrorist caught red handed. If he as India insists was caught in Iran then they have to take it up with them. Pak won't be releasing him no matter what the decision.

Judgement says you have to give him consular access. Pakistan is free to not abide by it.

It will mean next time pakistan goes to ICJ againist India, Pakistan will not have a leg to stand on.

ICJ rejects India’s plea for acquittal, repatriation of Kulbhushan Jadhav

The International Court of Justice (ICJ) on Wednesday rejected New Delhi’s plea to acquit and release self-confessed Indian spy Kulbhushan Jadhav.

Pakistan’s legal team headed by Attorney General for Pakistan Anwar Mansoor Khan was present in the courtroom where the verdict was announced on Wednesday.

Jadhav, a serving commander in the Indian Navy working for India’s Research and Analysis Wing (RAW), was arrested on March 3, 2016, from Balochistan.

Chief of the Army Staff (COAS) General Qamar Javed Bajwa on April 10, 2017, endorsed his death penalty.

The international court ordered Pakistan “effective review and reconsideration of the conviction and sentence”, according to a document on the court’s website.

Judges at the UN’s top court ruled Pakistan had breached the Vienna Convention on diplomatic relations, which gives countries the right to consular access when their nationals are arrested abroad.

In June 2017, the Indian spy had filed a mercy petition against his death penalty while India approached the ICJ against the conviction. The ICJ stayed his execution.

India argued that Commander Jadhav was an innocent businessman who was kidnapped from Iran, brought to Pakistan and tortured to confess that he was a commander in the Indian Navy and working for RAW, India’s primary intelligence agency.

Pakistan had rejected all Indian allegations. It said the evidence obtained from Jadhav after his arrest and during the criminal process leading to his conviction was amply demonstrating his activities in fomenting terrorism and engaging in espionage within Pakistan.

there are no lies. The ICJ have not aquitted him. they have said " please review your decision and do it via a judicial review, upto you how you do it" in other words as we say in urdu "aap ko thaal diya hay inho nay"..

So now what will happen is a civil court with review the decision as per the instructions of the ICJ. it will uphold the decision which the ICJ will accept because that is what it has recommended. Jadhav will remain a terrorist spy and will remain in custody..India will get nothing except conspiracy theories. The ICJ have washed their hands of the case...they will not be hearing it again..

Anyways, never thought my Pakistaniyat would be doubted for calling a spade a spade. Decision is that India is to be given consular access. Even if everything else stays the same, one thing has changed and that is in favour of India. So, guys accept the defeat.

I have no doubt that India is behind terrorist activities in Pak but as far as fighting a case in an international court is concerned I trusted Pak’s legal team to lose. This is an example of lack of talent/expertise/merit which is evident all around me in Pakistan.

The stay on execution was only till ICJ made its ruling. Learn to read.

there you have it in black and white...all india gets is consular access which is actually worse because it proves he is a Indian national travelling into pakistan with a fake passport.

And Pakistans verdict is not annuled so he is according to the ICJ a) an indian citizen as pakistan has said so b) a terrorist spy as it has not annuled the verdict c) will not be released..

so explain what has India won? his release no. An anulled verdict? no..consular access? no..we wont even give them that..

and to top it all off you cant even go back to the ICJ..lol

Right now pakistan has to allow Indian consulars to meet him. They have to look after him well. They have to review his case in a civilian court. He cannot be executed.

lol..Pakistan will simply allow the judicial review to take time, and time and time, and ajourn it as the ICJ has not given a fixed period when the review has to a) start and b) end..so meray bhai the review may start when Jadhav has passed away ...in other words it means diddly squat..

and even if the review is carried out which I highly doubt it will simply give the same verdict..then you can go to teh ICJ beg and plead but he will still not return..

there you have it in black and white...all india gets is consular access which is actually worse because it proves he is a Indian national travelling into pakistan with a fake passport.

And Pakistans verdict is not annuled so he is according to the ICJ a) an indian citizen as pakistan has said so b) a terrorist spy as it has not annuled the verdict c) will not be released..

so explain what has India won? his release no. An anulled verdict? no..consular access? no..we wont even give them that..

and to top it all off you cant even go back to the ICJ..lol

Also those claiming that this is Indian win, first read up what India's argument was. They wanted full acquittal and release of the dog. Did it happen?
