If this is India's win then why did India's own lawyer have an issue with the "review and reconsideration" judgement?
 
He cannot be killed. He has to be given consular access. If he is tortured, that will come out during the consular visits and matter will be further taken up at international forums.

They will literally spin anything and everything into a win for India and/or Modi. Pakistan released Khulbhusan? Modi's pressure. Pakistan opened airspace? Indian pressure. Pakistan closed airspace? Pakistan scared.

India's wet dream of having hegemony over it's neighbor and rise in radicalized extremists hindu nationalism will always going to keep two nation at conflict and many more Yadhav will be spending either life in jail or dead.

Indian government can't afford to have peace with Pakistan, not having peace with Pakistan and appearing tough to Pakistan is not only main selling point but also their media's.
 
First of ICJ's ruling aren't even binding. Pakistan could choose to completely ignore it. LOL

UN resolutions on Kashmir are also non-binding. Pakistan will abide by the ICJ rulings because Pakistan has always maintained that it will abide by International Law.

Yadav has himself confessed to killing Pakistanis in Baluchistan, the same province from which that poster hails from. Yet here he is declaring Yadav as innocent. Before we go and capture people like Yadav we need to identify and eliminate the enemies within.

I am baffled some of these people don't go live in India. They can't even claim love for Pakistan, some of these people openly admit Pakistan shouldn't have been created. So what's stopping them?
 
No. It was not. It was to get consular access and have him tried in a civil court and also to stay his execution. All of which happened.

Once civil court gives its judgement, it will again move to ICJ.

Don't know what your propaganda machine news media says, but part of the case was that Kulbushan be released as he is an ordinary citizen (india'sperspective). That wasn't achieved was it. So it is quite a loss for India.

Good thing he would get counselor access. I hope the case does start as soon as possible in civilian courts. It would showcase evidence in front of the world how india was involved in terrorist activities inside Pakistan. Infact, would showcase how you guys massacred the children of Peshawar.

Having said that, I think if we are quick to accuse New India of hyper nationalism and desh-drohi ‘go to Pakistan’ syndrome, then we should try to avoid it as much as possible ourselves.

Not whether. The ICJ judgement calls for consular access,effective review and reconsideration of the judgement and suspension of execution. These demands of India has been accepted.

I feel a bit sad for Indians and their media that ever since February (Pulwama, Fake Surgical Strikes and Tea is fantastic episode) they have been so so desperate to get a moral victory over Pakistan.. they would go on and claim anything and their rubbish media with pathetic anchors like goswami would bark loud with their dirty mouths .they deep down know that all that Abhinandan thing was a massive international embarassment and they just want to save some bachi kuchi izzat..

It mean we should reconsider but we are not bound to reconsider it is upto us.
Giving consular access is also upto us if we want we can still deny it.

And iCJ did not tell us to annul the judgement neither they told us to release him and be handed back to India

As i said you should read the judgement. Its not upto pakistan to effectively review and reconsider, it has been ordered by ICJ to effectively review and reconsider. The method can be of pakistabs choosing.

Pakistan has been ordered by the ICJ judgemento to give consular access.

Pakistan cannot execute him.

Now pakistan can deny consular access and execute Jadhav. But that will be violation of ICJ orders and Article 94 can be invoked.

Which part of "ICJ cannot enforce its rulings onto countries" don't you understand?

A few months ago the ICJ with the same judge as this case told UK to withdraw from Islands in the Indian ocean because they belong to Mauritius. One Island is Diego Garcia where USA has a base.

Have they done it?

I am sure Yadav's family will be allowed to visit him in prison after making an appointment like they did before. We did also give permission to another RAW terrorist Sarbjit Singh's family to visit him as well some years back, we all know how that one ended. India and it's people can cry and scream all they want in desperation coz their man ain't gonna be released. Pak will let India cry for a while before Yadav is taken to the gallows. Even if we do give access to his family or Indian officials out of pity it is not to be misunderstood for him being released. Only fact that matters is Pak decides what happens to Yadav, he is in our custody.

The Court finds that the Islamic Republic of Pakistan, in the matter of the detention and trial
of an Indian national, Mr. Kulbhushan Sudhir Jadhav, has acted in breach of the obligations
incumbent on it under Article 36 of the Vienna Convention on Consular Relations
THE HAGUE, 17 July 2019. The International Court of Justice (ICJ), the principal judicial
organ of the United Nations, today rendered its Judgment in the Jadhav case (India v. Pakistan). In
its Judgment, which is final, binding and without appeal, the Court,
(1) finds, unanimously, that it has jurisdiction, on the basis of Article I of the Optional
Protocol concerning the Compulsory Settlement of Disputes to the Vienna Convention on
Consular Relations of 24 April 1963, to entertain the Application filed by the Republic of India on
8 May 2017;
(2) rejects, by fifteen votes to one, the objections by the Islamic Republic of Pakistan to the
admissibility of the Application of the Republic of India and finds that the Application of the
Republic of India is admissible;
(3) finds, by fifteen votes to one, that, by not informing Mr. Kulbhushan Sudhir Jadhav
without delay of his rights under Article 36, paragraph 1 (b), of the Vienna Convention on Consular
Relations, the Islamic Republic of Pakistan breached the obligations incumbent upon it under that
provision;
(4) finds, by fifteen votes to one, that, by not notifying the appropriate consular post of the
Republic of India in the Islamic Republic of Pakistan without delay of the detention of
Mr. Kulbhushan Sudhir Jadhav and thereby depriving the Republic of India of the right to render
the assistance provided for by the Vienna Convention to the individual concerned, the
Islamic Republic of Pakistan breached the obligations incumbent upon it under Article 36,
paragraph 1 (b), of the Vienna Convention on Consular Relations;
(5) finds, by fifteen votes to one, that the Islamic Republic of Pakistan deprived the Republic
of India of the right to communicate with and have access to Mr. Kulbhushan Sudhir Jadhav, to
visit him in detention and to arrange for his legal representation, and thereby breached the

Thankfully I finally got to READ the ACTUAL judgement of the ICJ. And what I read in line 1 of the judgement is that Pakistan is in breach. I mean, the text of the judgement opens with that line :) and on and on it goes about how Pakistan is in breach of this and how Pakistan is in breach of that.
 
Effective review and reconsideration. ICJ can again be invoked in case Pakistan doesnot provide it.

Since ICJ has said it has jurisdiction.

Lol they will keep finding Kulbhushan guilty in every kind of trial and you will keep invoking ICJ. Kulbushan will rot in jail even if ICJ entertains India's rants one more time.

It is a defeat of India in the things that actually matter.

What did India win on and Pakistan lose on? India Getting their application admitted despite Pakistan's objections??? Lollll is thing some kind of big win?
Another thing was the consular access. Again a minor thing in the grand scheme of things. Highlighting these things is literally clutching at straws.

I'll tell you about the things that actually matter. The International Court of Justice has rejected remedies sought by India, including annulment of military court decision convicting Jadhav, his release and safe passage to India. these are the main things that actually mattered in the case. The crux of the matter is that Kulbushan will stay in Pakistan, Pakistan will again try him and again the decision will come out to be the same. Even if India appeals again in ICJ, at the very least Kulbushan will keep rotting in jail till life. Indian naivety is being exploited by jingoist Indian media. This is a massive loss for India on all fronts that actually mattered.

Exactly why would Pakistan want to hang and bury the success story. Pak Army captured an Indian agent who confessed, now that's a super success story. Pak Army is not naive to bury this success story by Hanging KY. Never. Pak Army will love every opportunity to spread this story at any platform. As a professional Army, IA shouldn't have taken this to ICJ because at the end of the day it gives limelight to a story where Pak Army has a success element.

India lost the case when they took it to ICJ.

Any army will try to minimize news of its agent who is captured by enemy. Any army but Indian.

This has been an own goal. Thank you IA. Please drag and publicise this case as long and as much as you can. Highlight it at every forum. That will keep the Josh of public very high but reciprocally lower the Josh of soldiers.

You and other bhartis are spinning the judgement in a way it clearly is not, and obviously when Pakistan doesn't do something it doesn't have to do, you can say "Pakistan did not adhere to the judgement".

India media is trumpeting the International Court of Justice’s (ICJ) ruling on RAW Hybrid War agent Kulbhushan Jadhav as a victory after the globalist body demanded that Pakistan review and reconsider his conviction and sentence, but looking beyond the Bollywood headlines at both the smaller details and the bigger picture, it becomes clear that it’s actually Islamabad that came out on top instead.

The International Court of Justice (IJC) issued its decision on Kalbhushan Jadhav, the RAW Hybrid War agent who was captured by Pakistan in 2016 and sentenced to death the year after. The globalist body’s rulings are binding, but nevertheless unenforceable, making them more a matter of normative legitimacy than anything else. It’s for this reason why Indian media trumpeted the ICJ’s demand that Pakistan review and reconsider his conviction and sentence as a supposed victory, but looking beyond the Bollywood headlines at both the smaller details and the bigger picture, it becomes clear that it’s actually Islamabad that came out on top instead.

The court did indeed find that Pakistan hadn’t informed Jadhav of his rights, didn’t notify India of his detention “without delay”, and also didn’t provide him consular access, disagreeing with Islamabad’s claims that he wasn’t entitled to any of them because he was at that time (prior to his publicized confession and conviction) a suspected spy whose case was being decided by a military court (which is the standard procedure in most countries across the world whenever a foreign national is accused of espionage). It didn’t, however, acquit him, demand that he be repatriated, or recommend against the death penalty, representing a major defeat for India.

Furthermore, the very fact that Jadhav’s case was brought to the ICJ in the first place was a serious blow to its soft power, even though India has yet to realize this unprecedented self-inflicted wound to its international reputation. The country must have been under the mistaken impression that Pakistan’s unfairly dismal reputation abroad would be further damaged in a significant way by the court’s possible decision against it, never stopping to think that giving its enemy the global podium to prove their Hybrid War agent’s crimes in Balochistan would inevitably harm their own previously positive reputation much more.

In hindsight, it would have been much better if India just let Pakistan execute Jadhav and that be the end of the entire affair, but instead Modi panicked because he was under severe pressure from ultra-jingoist Hindutva hardliners to do something in support of their captured spy. The end result is that New Delhi was denied the normative legitimacy that it was seeking from what it expected would be the court’s unenforceable decision to have Islamabad acquit and repatriate him, having to simply settle for it recommending consular access to him after its risky gamble failed and ruined its international reputation by forever associating it with Hybrid War.

The armies narrrative has been Khulbhusan is a spy can’t even given councilor Access. The ICJ judgement just destroyed that narrative.
Not sure whether the judgement is binding on Pakistan or not but they have been advised to give him councilor access and review of the judgement. I’d say that’s a win.
India would have argued for his release but in reality they got what they wanted.

If they ignore the judgement, there goes their narrative. If they review the case than evidence against Khulbhusan will have to provided to his lawyer as well. Hopefully they are not counting on the videos of confessions under duress as the evidence. That will be interesting.
 
UN court rejects Pakistan’s argument in Indian spy case


THE HAGUE, Netherlands — The United Nations’ highest court ordered Pakistan on Wednesday to stay the execution of an alleged Indian spy and undertake a full review of his case, after agreeing with India’s contention the man’s rights had been violated in a case that has been a source of friction between the nuclear neighbors.

International Court of Justice President Abdulqawi Ahmed Yusuf said the panel of judges found 15-1 that Pakistan violated international law by not providing Kulbhushan Jadhav access to consular assistance or the ability to choose his own defense attorney.

Jadhav was arrested by Pakistan in 2016 after allegedly entering the country from Iran, and convicted of espionage and sabotage by a Pakistani military tribunal and sentenced to death in 2017.

India had denied that Jadhav was a spy and asked the world court to order his release, arguing his rights were violated in breach of an international treaty.

The court rejected Pakistan’s contention that Jadhav wasn’t entitled to those rights, as “an individual suspected of espionage.”

It did not, however, order Jadhav’s return to India or annul the military court’s decision as India had wanted.

Pakistan and India are bitter regional rivals that have fought three wars since gaining independence from Britain in 1947. The nuclear-armed countries each claim the Himalayan territory of Kashmir, and their forces regularly exchange fire there despite a 2003 cease-fire.





Both sides claimed victory after the court’s judgment.

“This is a clear, clear win for Pakistan,” Pakistani Attorney General Anwar Mansoor Khan told reporters outside the courtroom. “Pakistan has in fact been very clear from the outset that they will consider the review and reconsideration.”

Meantime, Indian Prime Minister Narendra Modi tweeted that “we welcome today’s verdict.”

“Truth and justice have prevailed,” Modi said. “Congratulations to the ICJ for a verdict based on extensive study of facts. I am sure Kulbhushan Jadhav will get justice.”

As a remedy to the rights violations, the U.N. court ordered Pakistan to “take all measures to provide for effective review and reconsideration including, if necessary, by enacting appropriate legislation.”

Yusuf said it was up to Pakistan how to carry out the case’s review but that “the right of defense of the accused should receive close scrutiny.”

“The review and reconsideration of the conviction and sentence of Mr. Jadhav, in order to be effective, must ensure that full weight is given to the effect of the violation of the rights” in international conventions, Yusuf said.

As the case was being considered, the U.N. court had ordered Pakistan not to execute Jadhav, and extended that to now include Islamabad’s review of the case.

“The court considers that a continued stay of execution constitutes an indispensable condition for the effective review and reconsideration of the conviction and sentence of Mr. Jadhav,” Yusuf said.

The court’s rulings are final and legally binding, and Indian External Affairs Ministry spokesman Raveesh Kumar said “we expect Pakistan to implement the directive immediately.”

“This landmark judgment validates India’s position on this matter fully,” Kumar said. “We will continue to work vigorously for Jadhav’s early release and return to India.”

Pakistan’s Foreign Ministry reiterated it believes “this is a clear care of Indian state terrorism,” but indicated it would comply with the court’s decision.

India and Pakistan routinely accuse each other of harboring terrorists.

“Pakistan, as a responsible member of the International community, upheld its commitment from the very beginning of the case by appearing before the honorable court for the provisional measures hearing despite a very short notice,” the ministry said in a written statement. “Having heard the judgment, Pakistan will now proceed as per law.”

lol...yes after getting hammered by the ICJ judgement pulling up Pakistan for its many 'breach' of International law including denying him consular access, now Pakistanis have begun singing a different tune. That 'Pakistan was always ready to consider consular access'.

Pakistan is famous for scoring self goals.

Let me tell you two simple things that Pakistan should have done in this case:

1. Should have given him consular access.
2. Tried him in the open, and not in secret.

The moment you try someone in secret, hidden away from the rest of the world, your credibility is suspect in the eyes of the world. No one in the world will believe that it was a fair trial.

More importantly, for a country like Pakistan with a questionable history of democracy, such secret trials held by the Pak Military, only reinforces incredulity in the eyes of the world that the true levers of power in Pakistan continue to rest in the hands of the Military generals.

Very poor optics.

After this ICJ ruling that starts line one of the printed judgement with 'Pakistan is in breach of...', this is one event that shall be invoked time and time again by interests inimical to Pakistan, that this ruling is documentary evidence from a neutral world body that Pakistan flouts international norms.

In a world where optics matters, in a world where Pakistan has to go running to the UN every so often to lament Indian atrocities against muslims/Kashmiris, Pakistan should try and avoid self goals like strictures from the ICJ.

Calmer minds should have prevailed within the Pakistani Army and ISI, and they should have allowed the civilian government of Pakistan and the civilian judiciary of Pakistan to have tried this case. Hopefully the Pakistani Army Chief will allow Prime Minister Imran Khan to handle this.

[BTW, on an unrelated note, I personally feel that Imran Khan is one of the best Pakistani PMs ever. Sensible and calm person, who if allowed to implement things the way he wants to, would do wonders for Pakistan]

India’s conduct amounted to rights abuse: Justice Jillani

THE HAGUE: The International Court of Justice’s (ICJ) verdict in the case of Kulbhushan Jadhav, a serving Indian naval commander who had been awarded death sentence by Pakistan on charges of espionage, came with a detailed dissenting note authored by Justice Tassaduq Hussain Jillani, an ad hoc judge of the court.

Justice Jillani wrote that the court should have found India’s application to be inadmissible because its conduct amounted to abuse of rights. He recalled that the 2008 agreement between India and Pakistan specifically governed questions of consular access and assistance in cases of arrest and detention on national security grounds.

Pakistan lawfully withheld consular access and assistance while examining the case of Jadhav on its merits. Even if the Vienna Convention was applicable in the case, Pakistan had committed no breach of its Article 36 because the country had already in place the procedures necessary for ensuring effective review and reconsideration of the conviction and sentence of Jadhav, he said.

Justice Jillani said in his dissenting note: “The Court’s judgment appears to set a dangerous precedent at the times when states are increasingly confronted with transnational terrorist activities and impending threats to national security. Terrorism has become a systemic weapon of war and nations would ignore it at their own peril. Such threats may legitimately justify certain limits to be imposed on the scope of application of Article 36 of the Vienna Convention on Consular Relations, in the bilateral relations between any two states at any given time.”

Justice Jillani said: “The present case is distinguishable from the Court’s Avena and LaGrand jurisprudence on which the Court has heavily relied. Among various distinguishing factors, the most important one is that the Court was faced here with special circumstances of an individual arrested, detained, tried and convicted for espionage and terrorism offences.”

He said the Vienna Convention had been concluded to contribute ‘to the development of friendly relations among nations’ and it could hardly be the case that the drafters of the convention intended for its rights and obligations to apply to spies and nationals of the sending state (India) on secret missions to threaten and undermine the national security of the receiving state.

Justice Jillani wrote in his dissenting note that India had provided no rebuttal throughout the proceedings to the circumstances in which it had provided an authentic Indian passport, with false identity, to Jadhav and the particulars of Jadhav’s mission in Pakistan, despite the serious nature of the crimes he had committed. The court should have drawn the necessary inferences there from.

Justice Jillani said: “Since 31 May 2017, Pakistan has sent six requests to India for necessary cooperation in the investigation of the criminal case [against Jadhav] and about the passport issue, but these were of no avail. Pakistan even offered to extradite Mr Jadhav to India, if India was prepared to indict him under the Indian laws. The accounts of three respected Indian journalists, Mr Karan Thapar, Mr Praveen Swami and Mr Chandan Nandy, based on interviews conducted with Indian officials, confirm that Mr Jadhav was a RAW agent.”

Justice Jillani said that India’s persistent refusal to cooperate in the investigation against Jadhav was contrary to the United Nations Security Council resolution 1373, which, inter alia, mandated that all United Nations member states shall “(f) [a]fford one another the greatest measure of assistance in connection with criminal investigations or criminal proceedings relating to the financing or support of terrorist acts, including assistance in obtaining evidence in their possession necessary for the proceedings”.

According to Pakistan, Jadhav’s conduct of perpetrating acts of terror was part of a chain of acts carried out by India to destabilise Pakistan, said Justice Jillani.

According to Pakistan, he stated, “Mr Jadhav was apprehended by security agencies when he entered Balochistan from Iran (Saravan border). India claims that Mr Jadhav is a retired naval officer who was kidnapped from Iran where he was doing business.

‘‘However, neither in its memorial nor in its reply has India given his date of retirement from the Indian Navy. It has not placed any document on record either to indicate the kind of business he was carrying in Iran or when and how he was kidnapped. If Mr Jadhav was in fact kidnapped, as contended by India, India could have lodged a complaint with the Government of Iran, but it failed do so.”

One question to our oh so vocal Indian friends. has the judgement been annuled? because the only way to say "Pakistan's court system as been rejected" was for the ICJ to annul the judgement. they did not. theya ctually doubled down and let the pakistani judicial system carry out its own review!!

Yes they criticised Pakistan for failing to provide consular access, but then Pakistan wasnt sure initially if kulbashan was a indian citizen as his own govt denied his identity. Hence Pakistan could not provide conuslar access to someone who's identity had not been verified.

Also once it was proven he was a spy, it became complicated.. But he will now recieve consular access and a review of his judgment will be carried out by the military courts who will uphold the judgment. and he will remain a terrorist who helped kill Pakistanis , and will stay in jail forever..

In the meantime cups of chai will be sent to delhi..

He is going to have his sentence reviewed and reconsidered, to the point that the court asks pakistan to even enact a legislation if need be to make such a review effective.

“The court considers that a continued stay of execution constitutes an indispensable condition for the effective review and reconsideration of the conviction and sentence of Mr. Jadhav,” Yusuf said.
