What happened to "innocent until proven guilty"? Did Scottish players become judges, juries, and executioners?

Why do these western players (be it cricket or football) act all uptight?

Kathmandu (AFP) – Scotland's cricketers refused to shake hands with rape-accused Nepal star Sandeep Lamichhane following a match between the two nations in Kirtipur on Friday.

Lamichhane is accused of raping a 17-year-old girl in a Kathmandu hotel room last August.

He was suspended as national captain and arrested, but was freed on bail at the end of last month, with Nepal's cricket association announcing a day later his ban had been lifted.

Lamichhane returned to the side in the opening game of the one-day international World Cup League 2 tri-series against Namibia in Kathmandu on Tuesday.

As has become traditional at the end of most cricket internationals, Nepal and Scotland lined up to shake hands with each other at the end of Friday's game but video footage confirmed the Scots made a point of refusing to do with Lamichhane.

Cricket Scotland made no public comment about the gesture which came at the end of a one-day match the Scots lost by three wickets.

But AFP understands it came after a unanimous vote by Scotland players and support staff, with both the Cricket Association of Nepal and the player himself made aware of the protest in advance.

Lamichhane, who has denied the allegations against him in a Facebook post, is likely to receive similar treatment when the teams next meet on February 21.

The 22-year-old took 3-27 on Friday as Nepal recovered from 77-5 and 177-6 to chase down 275 with three overs to spare.

In Tuesday's opening game against Namibia, Lamichhane took 3-66 in a two-wicket win.

Before the tri-series started, Cricket Scotland issued a statement, saying it was "aware of the reports regarding the legal status of Nepal's Sandeep Lamichhane, ahead of the upcoming ICC Cricket World Cup League 2 Qualifiers".

It added: "As a governing body, and as a squad, Cricket Scotland stands firmly against all forms of abuse, which have no place in modern society.

"The player's availability for these games is a matter for the Cricket Association of Nepal and the ICC (International Cricket Council) to consider."

The ICC, however, have yet to comment publicly comment on Lamichhane's selection.

Lamichhane had been a poster boy for the rise of cricket in Nepal, which gained one-day international status in 2018.

His big break came when he was snapped up by the Delhi Capitals for the big-money Indian Premier League that year, and he has since been Nepal's most sought-after cricketer.

Nepal's next match of the tri-series is against Namibia on Saturday.

But, he hasn't been convicted yet.

I am just pointing out the excessive uptightness of western players. We also saw that during Qatar World Cup.

The criminal proceedings are still ongoing and yes while technically he is still 'innocent' I can fully understand why the Scots would refrain from shaking his hand.

It puts them in a highly comprising situation shoulf a guilty verdict come out. I don't know why the Nepal board selected him here.

Once he is cleared then its all good but in this situation of limbo its not worth it.

Imagime if true how his victim will feel seeing him don the national jersey.

He's on police bail. Police can apply restrictions when someone is given bail, ie not allowed to travel etc.

When someone is not convicted, nobody should take it upon themselves to be judge and juror esp Scottish players.

I agree as usual the high and mighty westerners decide, although there is no rule of shaking hands so their choice.

First of all, I don't make friendships with that type of people. My friends are generally conservative-minded. Lamichhane seems like a radical liberal.

Secondly, at a sporting event, I have no issue with shaking hands with someone who wasn't found guilty. If he is guilty, I will probably refuse. Shaking hands is not same as inviting for dinner.

Do you understand the meaning of "innocent until proven guilty"? What if the female was lying? Let investigation be over first.

Charged with murder is different to be convicted of murder , Prince Andrew being a pedophile is an accusation you have made , until he is convicted in a court of law it remains just that an accusation. It's always these Western athletes and other Celebrities creating trouble in Third World or Muslim Countries ( Qatar ) by taking such moral stands to show how great, Superior and civilized they are.

Zero consideration for the local laws and cultural values.
 
If hes on bail he shouldnt be selected to play until all charges are dropped or hes cleared

The player, who is not being named for legal reasons, continued to play in his club’s first team last season and has also been a regular in the side in 2022-23. The club confirmed in July that it would select him until further notice and that he would not be suspended.

We would have to ask this particular football club about their standards. Everyone knows which club it is.

The national teams in the UK would likely approach this situation differently, (eg) the England cricket side suspended Ollie Robinson for the historic tweets.

This is an interesting incident that the Scottish players refuse to shake hands with Lamichhane and I can see many organisations who have failed to act and could have prevented this drama.

If we look at the recent rape and assault allegations put against the Manchester United player Mason Greenwood. His current status is that the police have dropped charges and are no longer investigating the matter. This may well mean he is innocent but this cannot be determined as the evidence wasn’t tested in court. More importantly, Greenwood spent some of his rape charge time in prison on remand and some of that time at home. Like Lamichhane, Greenwood could have played and been snubbed by rivals but he was not put in the firing line as Manchester United suspended him on full pay whilst the criminal proceedings were ongoing.

Back to Nepal and Lamichhane. In this instance, if we accept that the Nepalese cricket board is inexperienced at dealing with these matters, the ICC surely would have advised them Nepal cricket board to suspend the player as it brings the game into disrepute. In the Greenwood case, Manchester United suspended him but if they did not do so then the FA could have done so by accusing him of bringing the game into disrepute.

Now focusing on the Scotland Cricket board, they also messed up by not going public and the players did do as they have to now be consistent. What if they played England decades ago when Geoffrey Boycott played and Boycott had a convicting for assaulting a girlfriend, which I believe is true. Would they fail to shake his hand too? The Scottish board have rightfully said they find abuse etc abhorrent but they and the Scottish captain could have said they are against abuse but won’t interfere with any criminal process?

Anyhow all this maybe redundant and forgotten about if Lamichhane is found guilty but badly managed all round.

We saw how stupidly some of these European teams behaved during Qatar World Cup. They got their butts kicked thankfully.

That player has not even been charged. You can't stop dropping players if there hasn't even been enough evidence to charge them.

Or if he kidnapped someone off the street and “raped” her in the woods.

Many, many, many girls try to get social with leading sportsmen of the country, and try their luck with a love net - sometimes it works and many at times it doesn’t.

And sometimes they end up opening their legs and lose it all while the player walks away. This is usually when these sorta “rape” allegations start to surface.

I am not saying he is guilty or innocent - but if this is one of those girls who gambled to take the risk n lost it - then it should be taken into account when jury issues the verdict.

No, there is no victim blaming on my end. I started my opening sentence with "A FAIR TRIAL".
If the trial is fair and if he is found guilty of actual and fully non consensual RAPE then punish him with the sever possible one as per the law of the land.
But if the fair trial verdict proves him innocent, then the law enforcement should also go after the girl and his family who has instigated the allegation.

Yes, high-end hotels or any place else, does NOT give a "free license for sexual assault" - but the females should also use basic common sense when they try to dip their finger in a honey pot.
 
The Supreme Court says rape-accused cricket player Sandeep Lamichhane can go abroad to play for the Nepal cricket team.

A division bench of justices Sapana Pradhan Malla and Kumar Chudal made the order on Monday in response to an appeal filed by Lamichhane.

The court also ruled that Lamichhane is not needed to be kept in judicial custody while the trial is underway as demanded by the Office of the Attorney General.

Following the order, it is highly likely that Lamichhane will fly to the UAE, where Nepal are playing the UAE and Papua New Guinea in the penultimate series that is part of ICC Men’s Cricket World Cup League 2.

Seems like double standards. If a player was on bail for accusation of burning the Quran played against Pakistan, would we have Pakistanis defend "innocent till proven guilty"?

The Scottish players may have faults of their own, but rape is a very serious allegation that compares to murder. The Scottish players are not wrong in taking such a stance.

However, on Wednesday, acting on a petition filed by the cricketer, the apex court lifted the travel ban saying Lamichhane’s conducts were satisfactory.

The top court also upheld the Patan High Court’s decision to release Lamichhane on bail. A division bench of justices Dhruva Raj Nanda and Ramesh Dahal on January 12 had ordered the release of Lamichhane on bail with conditions.The court barred Lamichhane from traveling abroad and directed him to inform the police while leaving Kathmandu.

In a rain-hit match, UAE were invited to bat first after losing the toss and they scored 106 runs for the loss of 9 wickets in 27.3 overs before the heavens started falling.

But despite the ugly weather, the local fans didn't leave the stadium and waited for the match to get restarted. Several pictures of fans holding an umbrella and waiting for the match to resume have gone viral on the internet and they are getting huge shouts for their love for cricket.

There are mothers and sisters from social organizations and social networks and Papers claiming that they fight for wrongful justice and justice for business and have influential control and capacity to pressurise institutionally to state mechanism. This is my express and open challenge to all those so-called activists out there, you still have time to prove whether there was any relationship between me and Gaushala 26 either coercive or under undue influence. Just prove it with facts and evidence. In case you can prove in the court or out of the court room and if I am found to be guilty, I am ready to face any set of ordeal. No offence but he's a convicted rapist and pedophile. Do we really need to give this low-life any kind of attention?

This isn't exactly a case of innocent until proven guilty.

The fact that Rizwan flew over to Nepal to meet him and get pictures taken on the instructions of his PR agency right when the allegations were fresh shows how disgusting some folks running the business are.
 
Justice should be served. If this guy is found guilty then there is no sympathy for this guy otherwise we should not make up our mind for a guy who is still waiting for justice. IF he is found guilty, he should be hanged and same punishment should be for every individual who is involved in these kinds of activities.

He was sentenced to 8 years in prison, 4 months ago.

That was really shocking from a PR agency. Even if Lamichanne wasn't convicted back then, a simple Google search would have let you know what this guy was accused of. What kind of PR agency lets something like this happen?

Yeah he deserves to be blamed too. He's an international cricketer and a professional athlete. You can't be this ignorant and irresponsible in this day and age. You are not just representing yourself, you're also representing your country.

This isn't CSI. They are not going to discover footage that links him to the crime
