Agreed. Its a little hypocritical too coming from people who are most likely living in and citizens of Western countries. As if they wouldn't be considered "burger" back home in Pakistan and are seedhay saaday log...
On a side note, I don't understand the ploy of arresting Jatoi's father. Legally how long could they even hold him under arrest? What would they even charge him for in the first place?

What i find questionable is that if the CJ can take on Musharraf fearlessly when he was at the peak of his powers, in uniform then why is a wadera, his spoilt son even if they are mega rich, connected to the President/PM proving to be so difficult for him?
The public is not stupid, the father will lose face big time if he takes the case back or backs down from here. This case has become too public now to go away just like that. However i sort of agree the other possibility is that the likes of Siraj, Murtaza and co take the fall for Shahrukh with promising of being well looked after in jail or being released in the future when the case dies down.

Shahzeb Khan Murder: Siraj Talpur Agrees To Become State Witness Against Shahrukh Jatoi
Karachi: Siraj Talpur, one of the two main accused in the Shahzeb Khan murder case, has agreed to become a state witness against Shahrukh Jatoi, the other accused, and will be presented in an anti-terrorism court tomorrow (Monday).
The move came after Siraj’s father Imdad Talpur met top police officials, sources said.
Shahrukh escaped from Pakistan on December 27 without going through the PISCES system of the Federal Investigation Agency (FIA).

Siraj Talpur, a prime suspect in Shahzeb Khan murder case, claimed that he did not shoot the 20-year-old, but it was Shahrukh Jatoi who had fired the rounds, reported Express News on Sunday.
Siraj was apprehended from rural Sindh on Saturday and has been in police custody along with his brother Sajjad Talpur since then.
During initial investigation, Siraj said that Shahzeb and Shahrukh’s worker Murtaza Lashari had gotten into an argument after which Shahzeb slapped Lashari several times. He said that the argument was soon sorted out but Shahrukh shot Shahzeb multiple times when he later went out that night.
Siraj also agreed to be a state witness to the case, and said that he has not been able to sleep since the incident. He added that he has not been in contact with Shahrukh since he fled to rural Sindh and was hoping that Shahrukh’s father Sikandar Jatoi would save him.
The arrested suspects – Siraj, Sajjad and Lashari – are due to be presented in court tomorrow. The other two suspects in the case, Shahrukh and Sikandar, are still on the run, while the federal government has cancelled their passports.
Shahzeb was shot dead near his home in Defence last year. A popular student and son of DSP Aurangzaib, Shahzeb’s murder created an uproar in civil society.
The Supreme Court took suo motu notice of the case after the news spread that influential people were creating hurdles in the arrest of the suspects.
In its first hearing, the police were ordered to arrest the suspects within 24 hours or risk losing their jobs.

He will lose face, but what if the killer's cohorts threaten the father that they will target the remaining members of his family? I think the victim had a sister, right?
That's how these things go in the sub-continent, and more so for Pakistan it seems,
I mean it won't just be threats, it'll be a combination of money plus threats .
Hard for a father to withstand, especially if he has other children.

not sure according to Pakistan laws. But it has happened before in muslim world. In Spain, a muslim son of a muslim ruler killed a jew, the son was well liked, the case went against him in court, a Diyyat deal was presented in court, the jew's family said that they want to accept that Diyyat deal but the ruler said he suspects that the jew's family are pressurized to accept this deal so he cancel the deal, the court order killing of the son, the enforcer back off so the muslim ruler himself come forward and execute his son.

KARACHI:
Prime suspect in the Shahzeb Khan murder case, Shahrukh Jatoi, has been remanded in police custody till January 23 by an anti-terrorism court (ATC).
Shahrukh was finally produced before the court three weeks after the murder, and after his short-lived escape to the UAE.
Shahrukh, his friends Siraj Talpur and Sajjad Talpur and their cook Ghulam Murtaza had allegedly killed Shahzeb on December 25, 2012, over a petty dispute.
Inspector Muhammad Mobin, an investigator in the case, had requested physical custody of Shahrukh till January 27.
Mobin told the court that Shahrukh needed to be interrogated in connection with the arrest of two absconding co-accused, Asif **** and Salman Jatoi. Two pistols and a vehicle used in the crime are yet to be recovered.
ATC-III Judge Ghulam Mustafa Memon, however, remanded him to police custody for seven days and directed the investigation officer to submit a final report by the next date of hearing.
Legality of arrest process
Naeem Qureshi and Amir Mansoob Khan, the defence lawyers, moved an application questioning the process adopted by police authorities for arresting Shahrukh in Dubai, where he was hiding. The arrest process is illegal, as legal formalities have not been followed, they alleged.
Issuing a notice to the special public prosecutor, the judge directed him to submit relevant documents showing whether or not legal formalities were adopted in the arrest process.
The judge also directed the police to produce Shahrukh before the police surgeon at the civil hospital, who will conduct an ‘ossification’ test to determine his age.
Defence lawyers argued that the suspect is a minor, and should be tried separately from the adult co-accused with concessions prescribed for juvenile offenders.
Shahrukh’s age, however, was not mentioned by the lawyers in their application.
Evidence
The suspect’s lawyers also pleaded to the court to order that the nine ‘empties’ allegedly recovered by the investigation officer from the crime scene be transferred to the custody of any other officer. “The investigation officer might tamper with the empties presently sent to the forensic science laboratory for matching,” they argued.
Special public prosecutor Abdul Maroof objected to the application, saying that the anti-terrorism court could not pass such an order, because it was tantamount to interfering with the investigation.
Sikandar Jatoi released
Meanwhile, the investigation officer told the court that due to the absence of solid evidence against Shahrukh’s father, Sikandar Jatoi, he has been released after investigation.
The judge directed the investigation officer to submit a proper report explaining on what grounds the accused was released.

KARACHI: Two eye witnesses Saturday identified the prime suspect of Shahzeb Khan murder in the magisterial court of southern district saying they saw the suspect chasing and shooting Khan.
Shahrukh Jatoi, the main accused of Khan’s murder, was brought to the court of magistrate Waqar Ahmad Soomro for the identification by the two witnesses. Aashiq and Ashghar were the two eyewitnesses who had to identify Jatoi.
The police brought Jatoi thrice for the identification parade for the witnesses along with the three other fake suspects and all the three times both the witnesses recognized Jatoi.
The witnesses in their identical statements told the court that they saw the accused firing at the Khan car and when the car overturned he also stopped by and again fired inside the overturned car.
Jatoi, however, told the magistrate that the police took him to the Boat Basin Police Station at 6 Friday evening where he was shown to the witnesses who also held a brief discussion with him.
The magistrate recorded the Jatoi claim. Legal experts said that the claim might weaken the case against the accused as the defence might take advantage of the assertion.

Medical Report revealed that Shahrukh Jatoi is not yet 18 years OLD. This means no death penalty. In case of life sentence it could be 14 years which means maximum 7 years in jail terms. Please correct me if wrong.

Shahzeb Khan murder: Suspect’s father gives conflicting details

During an interview on the show ‘To the Point’ aired on Express News on January 1, Shahrukh’s father Sikander Jatoi said that his son had been falsely accused of murder.
“He has been studying in Australia for the past eight years. He is pursuing his MBA at the moment. He came to Pakistan on December 14 and left on December 25.” Sikander said that his son had gone to grab a burger where the argument broke out. When Shahrukh stopped his car, an irate DSP Aurangzeb descended on him and struck his face, he claimed. “My son was bleeding. Shahzeb’s friends said sorry to him and let him go. His brother took him to a private hospital for treatment,” Sikander told Express News. “He left the hospital at around 2am and headed to the airport.” When repeatedly asked to name the hospital and the details of the flight, Sikander failed to answer. He last spoke to his son on December 24.
He said his sons carried weapons but they were registered in his name. A few minutes later, he contradicted himself, saying, “Shahrukh did not carry weapons.”
Among the eyewitnesses is actor Shamoon Abbasi, who saw the events unfold from the 11th floor of a building next to Country Club Apartments. He appeared on the same show on January 4. Abbasi said that around midnight, he was out on the balcony. “Suddenly I heard three shots being fired and glanced down to the corner of the lane.” Abbasi said that he saw a car speed off. “When I looked back at the spot, I just saw a couple of guards leisurely getting into vehicles.” He said that he first thought that a robbery had occurred, but then off to his right, he heard four more shots being fired and then the sound of a car crash followed by police sirens.
Gabol won’t back down
On the same episode, PPP MNA Nabil Gabol, who is Shahzeb’s uncle, recalled that after Shahzeb’s funeral, when he was crossing Sikander’s house, he saw around eight to 10 vehicles parked outside. A man told him that Jatoi was sitting calmly inside. “I called up the police and told them, ‘look, he’s still sitting in his house. Why don’t you just admit that you aren’t doing your job and have accepted bribes? Should I call up the chief minister?’”
Gabol added he would not back down unless “Shahzeb Khan is brought back to life or Sikander hands his accused son over to the courts”.

Abbasi said that around midnight, he was out on the balcony. “Suddenly I heard three shots being fired and glanced down to the corner of the lane.” Abbasi said that he saw a car speed off. “When I looked back at the spot, I just saw a couple of guards leisurely getting into vehicles.” He said that he first thought that a robbery had occurred, but then off to his right, he heard four more shots being fired and then the sound of a car crash followed by police sirens.
Gabol won’t back down
On the same episode, PPP MNA Nabil Gabol, who is Shahzeb’s uncle, recalled that after Shahzeb’s funeral, when he was crossing Sikander’s house, he saw around eight to 10 vehicles parked outside. A man told him that Jatoi was sitting calmly inside. “I called up the police and told them, ‘look, he’s still sitting in his house. Why don’t you just admit that you aren’t doing your job and have accepted bribes? Should I call up the chief minister?’”
Gabol added he would not back down unless “Shahzeb Khan is brought back to life or Sikander hands his accused son over to the courts”.

KARACHI: Shahrukh Jatoi, the prime suspect in the Shahzeb Khan murder case, may escape capital punishment if the court accepts that he is a minor.
On Monday, Shahrukh underwent a bone ossification test at Civil Hospital, Karachi, to determine his age. The process consists of multiple tests and X-rays to estimate the age of an individual based on the formation and growth of bones.
The age test was ordered on January 17 by an anti-terrorism court on an application filed by his lawyer, seeking a separate trial from other suspects. Shahrukh was identified by two witnesses during an identification parade before a judicial magistrate on January 19.
Shahrukh, Nawab Siraj Talpur, 22, his younger brother Nawab Sajjad Talpur, 21, and their 23-year-old servant Ghulam Murtaza Lashari have been accused of murdering 20-year-old Shahzeb Khan, over a dispute in Defence on December 25, 2012.
If Shahrukh’s age is verified to be less than 18 years, he will be entitled to two major legal concessions as provided in the Juvenile Justice System Ordinance 2000, defence lawyer Amir Mansoob Qureshi told The Express Tribune.
“First, he cannot be handed down capital punishment [death penalty]. Second, his trial will be held separately from the co-accused,” he said. According to the report, Shahrukh is a minor aged 17 years and some days. He will turn 18 in November this year. Section 5 of the Juvenile Justice System Ordinance, 2000, ensures separate trial of minors from the adult co-accused.
Qureshi’s claim was seconded by senior lawyers specialising in criminal cases. Farooq Ahmed, associated with Muhammad Ilyas Khan and Associates, confirmed these concessions for juvenile suspects.
Under Section 12 of the Juvenile Justice System Ordinance, 2000, a suspect aged below 18 cannot be handed down a death sentence. “The maximum sentence a minor offender can be given is life imprisonment. But the trial has to be held separately from his adult co-accused, if there are any,” Farooq explained.
The lawyer cited, however, a judgment given by a larger bench of the Sindh High Court in 2006, when the court categorised the offences for which juvenile offenders could be tried by anti-terrorism courts. “Any suspect involved in heinous crimes, such as terrorism, abduction, kidnapping for ransom, sectarian killings or bomb blasts can be tried at anti-terrorism courts.”
Being a minor, can Shahrukh still be tried by the anti-terrorism court? Farooq said it was up to the court to establish the nature of the offence.
“If, the alleged offence is considered to have caused panic in the public, as in the case of Shahzeb because people took to streets, then I think, the underage suspect will be tried by the anti-terrorism court,” he said. “If the court considers it to be a simple murder, the case can be transferred to a sessions court for a formal trial.”
The cut-off age for juvenile offenders was 16 under the Sindh Children Act, 1976 but it was increased to 18 in the Juvenile Justice System Ordinance, 2000.
Habib Ahmed, a senior lawyer, believed Shahrukh’s case could be held at a sessions court since the offence did not fall in the categories described in the third schedule of the Anti-Terrorism Act, 1997. The crimes include abduction, kidnapping for ransom, terrorism, use of firearms or bomb blasts at worship places and courts. The experts also believe the possibility of a compromise in this case depends on the nature of the offence. Farooq and Habib both said that the inclusion of section 7 of the Anti-Terrorism Act in the FIR restricts any compromise. It will be mandatory to drop this section to transfer the case to a sessions court, they added.

ISLAMABAD: During Tuesday’s hearing of the suo motu notice over the murder of Shahzeb Khan, Chief Justice Iftikhar Muhammad Chaudhry said those who aided prime suspect Shahrukh Jatoi in fleeing the country should be arrested, DawnNews reported.
A three judge bench of the apex court, headed by the chief justice, heard the case pertaining to the killing of 20-year-old Shahzeb, son of Deputy Superintendent of Police Aurangzeb Khan, who was gunned down in Karachi on the night between Dec 24 and 25.
During the hearing, Deputy Inspector General Shahid Hayat presented before the bench the progress report on the case ongoing in the trial court.
In his remarks, Chief Justice Iftikhar said he expected that the case would be investigated fairly and properly.
Hayat told the bench that Shahrukh, the underage suspect who was recently sent to the juvenile jail on judicial remand till Jan 29 by an anti-terrorism court, had flown abroad on Dec 27, 2012.
Responding to which, the chief justice said Shahrukh’s father, Sikander Jatoi, had stated that his son had also gone to a hospital to receive first aid.
Hayat said Shahrukh had not suffered any injuries and neither had the police been able to locate the clinic where he had allegedly gone.
The chief justice then remarked that the information implied that Sikander had been misguiding the public on television and also obstructing the investigation.
He added that those who had aided Shahrukh in fleeing the country should also be arrested.
The chief justice said the Federal Investigation Agency (FIA) had stated that the police was in possession of Shahrukh’s (two) passports.
Upon which, Hayat replied that Shahrukh had travelled abroad on an ‘emergency’ passport.
Chief Justice Iftikhar further said that the First Information Report (FIR) stated that Shahrukh had left the country using someone else’s boarding pass.
He added that authorities had failed to determine who had assisted Shahrukh in fleeing the country.
The chief justice moreover stated that in certain cases, parties attempted at declaring the accused as a minor so that they may be saved from capital punishment.
Responding to which, additional prosecutor Sindh said Shahrukh’s passport gave Nov 27, 1995 as the suspect’s date of birth.
The chief justice added that a minor could not manage to escape the country as Shahrukh did.
Apart from Shahrukh, the ATC had also remanded three other suspects — Nawab Siraj Ali Talpur, his younger brother Nawab Sajjad Ali Talpur and their house servant Ghulam Murtaza Lashari — in judicial custody.
The hearing was later adjourned to Feb 4.

Comments: This guy has to be, in fact is the best CJ in our history. It is sad that such a basic case for the police, the lower court judges requires the CJ to intervene suo motto style. Had he not taken this thing up, this b would have escaped any scrutiny. I hope CJ keeps pressing his buttons to ensure everyone involved is punished in the strictest possible terms and i hope he asks the right questions.

A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry heard the murder case of 20-year-old Shahzeb Khan here today, who was shot dead on December 25 in Defence area of Karachi.
During today’s proceedings, the investigating officer Mubeen told the bench that Shahrukh escaped by bribing a porter at the airport. He said that Federal Investigation Agency (FIA) should tell the bench about back doors at airport from where people are sent abroad stealthily. The officer further told that he contacted a porter to go abroad and he told the officer that those gates have been shut now after the orders issued by the chief justice.
He said that FIA should apprise the bench about the shift in-charge and deputy director’s duties.
CJ Iftikhar instructed Shahid Hayat to produce results. He further added that the porter is being made a scapegoat in the case. He said that the court cannot sit and watch silently as people are being murdered.
The Chief Justice addressed the DIG Shahid Hayat and said that he will be responsible for any ignorance, as he had delegated the investigation of the case to a sub-inspector.
He, then, questioned the DIG if he had seized the travel documents of Shahrukh Jatoi on the basis of which he managed to escape from the country.
On this, Shahid Hayat told the court that the documents are with the traveling agency and it is the duty of FIA to find out how Shahrukh managed to flee.
Chief Justice Iftikhar Chaudhry remarked that this case should set an example so that the culprits should know that they will not be spared if any such incident occurred again. He, then, told the DIG that he should have arrested the aides involved in Shahrukh’s escape.
Justice Gulzar Ahmed remarked that police department is the most ignorant one as every one knows about the killers except police.
Chief Justice alleged that it is possible that police have declared Shahrukh Jatoi as minor intentionally and asked the DIG if he has scrutinized his educational certificates. Responding to this, DIG Shahid Hayat told that an identity card number was issued to him but no picture was found from the record.
He told that investigations are underway to find out how the identity card number was issued to Shahrukh if he was not 18 years old. His date of birth, as per his passport, is November 22, 1995, he told.
Chief Justice Iftikhar asserted that the investigations should be carried out in a transparent manner, regardless of the influence of any party involved. Legal proceedings will not halt in any case, he added.
Later, the hearing was adjourned till February 4.
It may be mentioned that an anti-terrorism court on Saturday ordered Shahrukh Jatoi, a prime suspect in Shahzeb Khan’s murder case, to be sent to a juvenile jail after a medical report showed he was a juvenile.
The court sent four suspects to prison, and directed the investigation officer (IO) to submit a charge sheet against them.
The chief justice had taken suo moto notice of the brutal murder on 20-year-old Shahzeb Khan, based on press clippings carrying the story regarding his killing. Shahzeb Khan was gunned down in Karachi on December 25th, while police failed to make any progress due to immense political pressure.
The killing mobilised hundreds of the people against unquestioned authority that people with political connection enjoy in the country.

ISLAMABAD: The Federal Investigation Agency (FIA) on Monday submitted to the Supreme Court its report regarding the prime suspect in the Shahzeb Khan murder case, Shahrukh Jatoi’s escape out of Pakistan, DawnNews reported.
A three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, heard the case.
During the hearing, FIA’s legal director Azam Khan told the court that Shahrukh’s passport contained a visa but it did not mention dates of validity.
He said that the suspect, under the fake name of Syed Shahrukh, had travelled to Dubai on Dec 27, accompanied by his brother Nawab Ali Jatoi and a friend, Khurram.
The FIA legal director added that the suspect purchased an air ticket without showing his passport and used a fake CNIC to obtain a boarding pass.
Justice Gulzar Ahmed inquired if it was possible to obtain an international air ticket without showing one’s passport to the travel agent.
Khan replied that it was not possible to do so but the travel agent had issued the suspect an international air ticket without seeing his passport, while PIA and Airport Security Force (ASF) officials also assisted the suspect in leaving the country without proper documentation or records.
Chief Justice Iftikhar inquired as to the identities of the concerned officials and was told by Khan that their identities would be known in two to three days’ time.
The chief justice also asked if Shahrukh’s visa was a permanent or a temporary one.
The FIA legal advisor also told the court that the ticketing counter which had issued the boarding pass to the suspect has also been identified.
The chief justice further said that the suspect’s father, Sikandar Jatoi, had told the media that his son had left for Australia on Dec 25, to which Khan replied that it was incorrect information provided by the suspect’s father.
The chief justice then inquired as to the action taken against the suspect’s father for misleading the police. He added that the case was high-profile and had highlighted various weaknesses in the immigration system of the country, which had helped the suspect to flee the country despite a computerised checking system in operation. He also asked about the lack of photographs in the immigration counter records.
The FIA legal director told the court that a FIR of the crime had been registered. Justice Sheikh Azmat Saeed remarked that registering a FIR would not help as the blame would be put onto the ‘smaller fish’.
The chief justice asked about the lack of developments in the case and if it was because the suspects were influential.
The court told the Inspector General (IG) that it was a high-profile case, therefore, the police must work harder to provide a transparent and impartial investigation, along with providing the witnesses with due security.

ISLAMABAD: The Federal Investigation Agency (FIA) on Monday submitted to the Supreme Court its report regarding the prime suspect in the Shahzeb Khan murder case, Shahrukh Jatoi’s escape out of Pakistan, DawnNews reported.
A three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, heard the case.
During the hearing, FIA’s legal director Azam Khan told the court that Shahrukh’s passport contained a visa but it did not mention dates of validity.
He said that the suspect, under the fake name of Syed Shahrukh, had travelled to Dubai on Dec 27, accompanied by his brother Nawab Ali Jatoi and a friend, Khurram.
The FIA legal director added that the suspect purchased an air ticket without showing his passport and used a fake CNIC to obtain a boarding pass.
Justice Gulzar Ahmed inquired if it was possible to obtain an international air ticket without showing one’s passport to the travel agent.
Khan replied that it was not possible to do so but the travel agent had issued the suspect an international air ticket without seeing his passport, while PIA and Airport Security Force (ASF) officials also assisted the suspect in leaving the country without proper documentation or records.
Chief Justice Iftikhar inquired as to the identities of the concerned officials and was told by Khan that their identities would be known in two to three days’ time.
The chief justice also asked if Shahrukh’s visa was a permanent or a temporary one.
The FIA legal advisor also told the court that the ticketing counter which had issued the boarding pass to the suspect has also been identified.
The chief justice further said that the suspect’s father, Sikandar Jatoi, had told the media that his son had left for Australia on Dec 25, to which Khan replied that it was incorrect information provided by the suspect’s father.
The chief justice then inquired as to the action taken against the suspect’s father for misleading the police. He added that the case was high-profile and had highlighted various weaknesses in the immigration system of the country, which had helped the suspect to flee the country despite a computerised checking system in operation. He also asked about the lack of photographs in the immigration counter records.
The FIA legal director told the court that a FIR of the crime had been registered. Justice Sheikh Azmat Saeed remarked that registering a FIR would not help as the blame would be put onto the ‘smaller fish’.
The chief justice asked about the lack of developments in the case and if it was because the suspects were influential.
The court told the Inspector General (IG) that it was a high-profile case, therefore, the police must work harder to provide a transparent and impartial investigation, along with providing the witnesses with due security.
Subsequently, the hearing was adjourned until Feb 13.

Shahrukh Jatoi, main accused in Shahzeb Khan murder case, has been accused of illegal escape to Dubai. A Sessions judge on Saturday allowed Federal Investigation Agency’s (FIA) human trafficking department to interrogate Shahrukh for a day.
The new case has been registered under different sections of Pakistan’s Passport Act and Penal Code.
Shahrukh is accused of having no Pakistani immigration details on his passport when he travelled to Dubai and according to prosecution for the case in the anti-terrorism court; the facts confirm that he travelled illegally without proper clearance from the immigration authorities.
In addition, Jatoi was not registered as a passenger on the plane EK-605 and boarded the plane on someone else’s boarding pass.
On Sunday, FIA suspended the shift in-charge at Jinnah International Airport (JIA) Karachi for helping Jatoi escape.
Earlier, Chief Justice (CJ) Iftikhar Muhammad Chaudhry heard the case of the murder of 20-year-old Shahzaib Khan and ordered the authorities concerned to arrest those who helped the prime suspect of the murder to escape from the country.
A reliable source told Pakistan Today that FIA Immigration Circle had launched internal investigations after Supreme Court (SC) ordered the arrest of all those who helped Shahrukh escape. “During initial investigations, the agency got some clues about those who helped Shahrukh escape abroad. Based on initial enquiry report; Immigration Additional Director Malik Subah Sadiq suspended JIA Karachi shift in-charge Inspector Iqbal from his post,” he said. “Inspector Iqbal was suspended and posted in FIA zonal office in Sindh,” he said.
He added that it was yet to be determined whether Inspector Iqbal was suspended on negligence or malign intentions. “FIA Immigration at JIA Karachi works in four shifts and every shift had 45 to 50 employees,” he said. “However, it was not confirmed weather Inspector Iqbal helped Shahrukh to escape abroad or someone in his shift helped the prime suspect to escape abroad,” the source said.
FIA Additional Director Malik Subah Sadiq when approached for comments disconnected the phone call by saying that he was driving his car and requested the scribe to call him again after a few minutes. When Sadiq was called again later, he did not pick up the call.

The Federal Investigation Agency (FIA) on Monday informed the Supreme Court that Shahrukh Jatoi, the main accused in Shahzeb Khan’s murder case, used a “bogus passport” to flee to the United Arab Emirates last December.
It said the passport was issued to Swabi resident Muhammad Ali.
During Monday’s proceedings, the country’s top court was also informed that the officers who helped the main accused escape from the country had also been identified.
A three-member bench of the top court, headed by Chief Justice Iftikhar Muhammad Chaudhry, comprising Justice Gulzar Ahmed and Justice Azmat Saeed Sheikh was hearing the case regarding the killing of a DSP’s son in Karachi. Shahzeb, a 20-year-old resident of Karachi, was killed on December 24 in the Defence area over a petty argument with Siraj Talpur and Shahrukh.
On Monday, the chief justice asked the FIA why it hadn’t registered any cases against the accused.
FIA Legal Director Muhammad Azam Khan submitted the FIA report which states that Shahrukh, along with his brother Nawab Ali Jatoi and Muhammad Khurram, had fled abroad on December 27. The court was told that Shahrukh obtained a boarding card under the name of Syed Shahrukh and used Muhammad Ali’s passport number and the tickets were issued through the Fazal-i-Rabi Travelling Agency.
The FIA official said that though 139 passengers had taken the flight there was no record of five people who boarded the plane. He told the court that officers who helped Shahrukh escape to the UAE have been identified and cases have been registered against those who helped him in escaping the country.
The owner of the travelling agency told the FIA that the ticket was issued under an “emergency” and the entry was made in violation of the airport rules — this procedure is only adopted for a VIP protocol. The court was told that at the time of departure the camera did not even capture Shahrukh’s photograph for records.
Justice Azmat Saeed then asked the council if the FIA was able to identify the ticketing counter from where Shahrukh had obtained his board card. The FIA legal director responded that they have already identified the counter and cases against the officials of that counter have been registered.
DIG Shahid Hayat also revealed before the bench that eyewitnesses have given statements that they had themselves seen Shahrukh open fire on Shahzeb.
The chief justice said, “Was the culprit so powerful that he hoodwinked the officials at three checkpoints at the airport? In such activities the big shots are involved but the lower-end staff gets tangled.”
Before adjourning the hearing, the court directed the FIA to present a charge-sheet of the case at an early date with the list of all eyewitnesses.
The court also sought the recording of Shahrukh’s father’s interview which was aired on Express News in which he misled investigators about the whereabouts of his son.
The bench will resume the hearing on February 13.

KARACHI: A judicial magistrate on Wednesday allowed the Federal Investigation Agency (FIA) to investigate Shahrukh Jatoi, the main suspect in the Shahzeb Khan murder case, at the Juvenile Jail till February 11. It also directed prison authorities to produce Jatoi at the court on Saturday, February 9.
Judicial magistrate for district Malir, Abdul Shakor Kalhoro, allowed the investigation officer of FIA’s anti-human trafficking department, Saeed Ahmed Memon, to interrogate Jatoi, after a new case had been registered against him under the Passport Act on Tuesday.
The new case, No. 26/13, was registered after investigations revealed that Jatoi had illegally left the country. Sohail Ahmed, a travel consultant affiliated with Fazal-e-Rabbi (Pvt) Limited, and Muhammad Taha Hussain, a check-in agent at Gerry’s Dnata (Pvt) Limited, were accused of helping Jatoi escape from Jinnah International Airport. Gerry’s Dnata provides ground handling services to airlines at airports in Karachi, Lahore, Peshawar and Islamabad.
The case was registered at the FIA police station, under Sections 419 (punishment for cheating by impersonation), 420 (delivering property through cheating and dishonest means), and 109 of the Pakistan Penal Code, and Sections 3, 4 and 6(1) of the Passport Act. FIA had added Ahmed and Hussain’s names in the FIR under section 109 (abetment).
Kalhoro had on Tuesday allowed the FIA officer, Memon, to interrogate Jatoi for one day. On Wednesday, Memon told the judge that Jatoi kept to the statement that he had given in the office of the deputy superintendent of Juvenile Jail on February 2, and that he needed more time to interrogate him.
The judge accepted the FIA official’s request, and directed the superintendent of Juvenile Jail to produce him before the court on February 11.
Shahzeb, son of DSP Aurangzeb, was shot dead in the upscale Defence neighbourhood of Karachi on December 25 over a petty dispute. The prime suspect, Jatoi, had then fled the country to evade arrest, and was finally brought back by law enforcers from Dubai over two weeks back.

Shahrukh Jatoi, the prime suspect in the Shahzeb Khan murder case, underwent a rigorous age test on Wednesday. The court had previously trashed aside a report that declared the alleged murderer a minor.
Amid tight security, the accused was brought to the Sindh Services Hospital hand-cuffed, suggesting law enforcers already consider him an adult.
Inside the hospital, a six-member medical board formed on the court directive physically examined the suspect and x-rayed his bones as well as the dental structure. Forensic medicine experts and radiologists recorded Jatoi’s weight and height and also examined his skin, hair and the genital region. X-rays of his wrists, shoulders and hip bones were also taken before he was taken to the hospital’s dental unit to examine his teeth.
All x-rays and physical examination reports have been sealed and would be opened when the board meets again to determine the suspect’s possible age, Sindh Services Hospital Medical Superintendent Dr Muhammad Taufiq, the medical board secretary, told The News.
The experts have also asked the case investigation officer to provide the birth certificate and educational documents among other particulars of the accused before the next meeting of the medical board on Saturday, he added.
Taufiq denied reports suggesting the medical board had already declared the suspect an adult, saying no such decision or announcement was made by any board member. “All the reports will be reviewed on Saturday to reach a unanimous decision,” he said.
Forensic medicine professor Dr Farhat Hussain Mirza, radiologists Prof. Dr Atique Ahmed Khan and Dr Tariq Mehmood, Prof. Dr Saba Sohail, Dr Mazhar Ahmed Siddiqui and Dr Hamid Padhyar are members of the medical board.

Shahrukh Jatoi, the prime suspect in the Shahzeb Khan murder case, underwent a rigorous age test on Wednesday. The court had previously trashed aside a report that declared the alleged murderer a minor.
Amid tight security, the accused was brought to the Sindh Services Hospital hand-cuffed, suggesting law enforcers already consider him an adult.
Inside the hospital, a six-member medical board formed on the court directive physically examined the suspect and x-rayed his bones as well as the dental structure. Forensic medicine experts and radiologists recorded Jatoi’s weight and height and also examined his skin, hair and the genital region. X-rays of his wrists, shoulders and hip bones were also taken before he was taken to the hospital’s dental unit to examine his teeth.
All x-rays and physical examination reports have been sealed and would be opened when the board meets again to determine the suspect’s possible age, Sindh Services Hospital Medical Superintendent Dr Muhammad Taufiq, the medical board secretary, told The News.
The experts have also asked the case investigation officer to provide the birth certificate and educational documents among other particulars of the accused before the next meeting of the medical board on Saturday, he added.
Taufiq denied reports suggesting the medical board had already declared the suspect an adult, saying no such decision or announcement was made by any board member. “All the reports will be reviewed on Saturday to reach a unanimous decision,” he said.
Forensic medicine professor Dr Farhat Hussain Mirza, radiologists Prof. Dr Atique Ahmed Khan and Dr Tariq Mehmood, Prof. Dr Saba Sohail, Dr Mazhar Ahmed Siddiqui and Dr Hamid Padhyar are members of the medical board.
Shahzeb Khan was shot dead in the Defence area of Karachi on December 25. Shahrukh Jatoi fled the country but was later brought back from Dubai after the Supreme Court took suo motu notice of the incident. The prime suspect has been identified by eyewitnesses as the alleged killer.
News Desk adds: Unconfirmed reports suggested that Jatoi had a complete set of 32 teeth, including four wisdom teeth.
An individual must be at least 18 years of age if he has a complete set of teeth, according to medical experts. However, the reports were brushed aside by board members, who insisted the x-rays had not been disclosed.

After a medical examination of his teeth, it was proven that Jatoi is at least 18 years old as he possesses all 32 teeth, including four wisdom teeth.
According to medical experts, an individual must be at least 18 years of age if they have a complete set of 32 teeth.
Earlier today, six X-rays of Shahrukh Jatoi were taken by the medical board tasked to determine his age.

An investigation into a new case registered under the Passport Act against Shahrukh Jatoi – the prime suspect in Shahzeb Khan’s murder – has revealed that he managed to leave the country illegally with the help of a travel agent and an airline data operator.
The revelations were made by an official of the Federal Investigation Agency (FIA) anti-human trafficking circle before a judicial magistrate on Tuesday. Abdul Shakoor Kalhoro, a judicial magistrate in Malir district, allowed Saeed Ahmed Memon, an investigation officer of the anti-human trafficking circle, to interrogate Jatoi for an additional day in a juvenile jail and remanded the data operator and travel agent in to police custody for four days.
Law enforcement personnel arrested Sohail Ahmed, an agent associated with Fazale Rabbi Travels, and Muhammad Taha Hussain, a data operator at Emirates airlines, for allegedly helping Shahrukh escape the country.
Memon told the court it was revealed during investigations that Jatoi travelled with a boarding pass bearing the name of one Muhammad Ali with the help of Ahmed and Hussain. He requested the court to allow him to interrogate the suspect for one more day as the two accused had been arrested in the case.
The new case was lodged against Jatoi at the FIA police station.

ISLAMABAD: The main accused in Shahzeb murder case Shahrukh Jatoi escaped with the help of two officers from the Crime Investigation Agency (CIA), both of whom manage protocol for the Bilawal House guests, revealed Director FIA Mohammed Malik before the Supreme Court today, Geo News reported.
The Director FIA appeared before the Supreme Court bench today, and revealed that Shahrukh Jatoi had also been a guest at the Bilawal House, and that one of the officers Waseh Akhter had secured bail before arrest on the 28th of February.
The Chief Justice remarked, that the Director General FIA must keep in mind that nobody is above the law.
Jatoi indicted by ATC
Meanwhile, Shahrukh Jatoi along with three others was indicted by the ATC today in Karachi.
Shahrukh Joti, Siraj Talpur, Sajjad Talpur and Ghulam Murtaza Lashari were produced before an Anti-Terrorism Court (ATC) amid tight security, where they were indicted in the murder of 20-year old Karachi youth Shahzeb Khan.
However, the accused pleaded not guilty. The ATC has directed all the witnesses in the case to appear before the court on Friday.

CCTV shows Shahrukh Jatoi being escorted through airport
KARACHI: Shahrukh Jatoi was escorted through the airport by unidentified men as he attempted to flee the country after allegedly killing Shahzeb Khan, CCTV footage obtained by Express News shows.
The video came into limelight over 60 days after that fateful December night. It had previously been played in the Supreme Court of March 7, 2013.
The footage shows Shahrukh entering the Karachi airport. He is wearing a red cap that obscures his face.
He is escorted by a group of unidentified men who oversee as Shahrukh passes through a metal walk through gate and frisking by a security official.
Shahrukh was then stopped by a security guard of the airport, but a member of Shahrukh’s escort came to the rescue and he was escorted to the waiting lounge.
On December 25, 2012, Shahzeb was murdered allegedly by Shahrukh over a petty dispute near Mubarak Masjid, DHA, in Karachi.
His death sparked a movement on social media and triggered off a series of protests, condemnations by political parties and a suo motu notice by the chief justice.
Following the suo motu notice by the Supreme Court, Shahrukh’s name was entered in the Exit Control List (ECL), yet he managed to flee the country to Dubai via fake passport and documents. The passport had his name as Syed Shahrukh Jatoi.

They can still appeal which can be overturn the verdict or somehow this could be made political and get their punishment delayed, until they are not hanged or they don't rot in jail for years, I wouldn't say justice is served.

The case settled. All four accused forgiven by Shahzeb's family. They have submitted their written request in the High Court that they have forgiven the murders of Shahzeb and they have made settlements out of the court.
Even though Shahzeb's family has claimed that they have not done it for money but we all know what might have happened in the background.

IMO this allowing the victim's family to forgive accused shouldnt be allowed. In this case the victim is not present to defend himself. And law should be same for all. This allows a difference between justice for rich and poor. How can money pay for a life?
It is not the kind of development that a moderate Pakistani was hoping to hear. It is true, per media source, that the parents have submitted the document stating their freewill to forgive the accused of their son. The court in Pakistan have held them guilty of the crime and were given death sentenced.

This is so depressing.
Its very common in Pakistan as well. This story only made it in to the news because it happened in Karachi but there are so many people like Shahzeb who are brutally murdered in rural Pakistan and then their families are forced/coerced/persuaded in to taking diyyat.

What's sad that it's all very clever. You use religion and no one dares to stand up against the action taken (or lack of) . It's sadder because it's a very exclusive Islamic law that shouldn't be used for such cases for several reasons ( the pathetic 'motive' of the murder being one reason..no cold blooded killer should ever be pardoned ).
It's like the Raymond Lewis case all over again.

The concept of 'blood money' is absolutely pathetic, its basically a free 'get-out-of-jail' card for rich powerful families. Even if they hint at refusing, they can always flex their powers and intimidate/threaten the other side.
