Plea against Qureshi’s acquittal clubbed with other appeals

A Lahore High Court two-judge bench on Wednesday directed the office to club a prosecution appeal against PTI vice chairman Shah Mahmood Qureshi’s acquittal in Shadman police station attack with other May 9 cases’ appeals.

The bench comprising Justice Syed Shahbaz Ali Rizvi and Justice Tariq Mahmood Bajwa passed the order hearing the government’s appeal.

During the proceedings, Deputy Prosecutor General Muhammad Shafiq informed the bench that appeals filed by convicts sentenced in May 9 riots cases were already pending before the high court.

He said the office could provide the information about whether those appeals had been fixed for hearing.

At this, the bench directed the registrar office to club the prosecution appeal against Mr Qureshi’s acquittal with the other appeals relevant to the May 9 convictions.

The appeal argued that the trial court had acquitted Mr Qureshi contrary to the evidence on record, ignoring key facts that warranted conviction. It contended that the trial court failed to properly assess the evidence against the former foreign minister.

The prosecution asked the high court to allow the appeal and set aside the acquittal of Mr Qureshi.

On Aug 11, an anti-terrorism court had acquitted Mr Qureshi in two cases including Shadman police station attack and burning police vehicles near Jinnah House during May 9 riots.

On Sept 9, a trial court had acquitted Mr Qureshi in a case of torching a Supreme Court judge’s squad vehicle near Jinnah House, while another court set him free on July 22 in a case related to violence at Sherpao Bridge.

The former foreign minister is still behind bars facing trial in other cases of attacks that erupted after the arrest of PTI former chairman Imran Khan in a graft case by the NAB from the Islamabad High Court.

The leaders and the activists of the PTI had attacked military installations and other public properties.

ATC: The jail trial of two separate May 9 cases — including the burning of police vehicles in Gulberg and the attack on the PML-N office — entered its final phase, as the prosecution witnesses were cross-examined on Wednesday.

Anti-Terrorism Court (ATC) Judge Arshad Javed conducted the proceedings inside Kot Lakhpat Jail, where both incarcerated and bailed accused appeared before the court.

During the hearing of the Gulberg police vehicles case, defence counsel cross-examined five prosecution witnesses, completing their statements.

The judge adjourned further proceedings till Oct 22.

A prosecutor said the trial reached its concluding stage and the verdict would be announced after final arguments are completed.

In the case of the attack on the PML-N office in Model Town, the prosecution witnesses also recorded their statements.

The judge adjourned the hearing of that case till Oct 18.

Among those present during the jail trial were senior PTI leaders Dr. Yasmin Rashid and Ejaz Chaudhry, along with several other detained party members.

The PTI leaders are accused of instigating workers to riot and rebel during the violent protests that erupted on May 9, 2023, following the arrest of party’s founder Imran Khan in a graft case.

PTI leader Shah Mahmood Qureshi undergoes successful gallbladder surgery, lawyer says

Senior PTI leader and ex-foreign minister Shah Mahmood Qureshi underwent a successful procedure to remove his gallbladder, lawyer Rana Mudassar Umer said on Tuesday.

The senior PTI leader, incarcerated at Lahore’s Kot Lakhpat Jail since 2023, was hospitalised at the Pakistan Kidney and Liver Institute for gallbladder stone complications on October 31, his daughter Meher Bano said. She added that his condition deteriorated while imprisoned and that surgery was “unavoidable”.

Speaking to Dawn, Umer said Qureshi’s gallbladder was successfully removed during the procedure.

“Shah Mehmood Qureshi will remain under the constant supervision of doctors for a few days,” he stated. “Shah Mehmood Qureshi has appealed to the nation to pray for his speedy recovery.”

Meher Bano also spoke to Dawn about the procedure, saying that the procedure was successful and the PTI leader is currently under observation.

“The size of the stone inside the gallbladder was quite large, so the surgery took longer than usual,” she explained. “[The doctor] performed the surgery successfully in the best possible manner.”

Meher Bano added that Qureshi’s recovery will “take some time”, expressing gratitude to people for their prayers.

Meanwhile, PTI stalwart Asad Qaiser, in a post on X, prayed for Qureshi’s speedy recovery.

“Shah Mahmood Qureshi sahib has been enduring innocent imprisonment for the past two years due to his loyalty and steadfastness to Imran Khan’s vision,” he wrote. “The courage, patience, resolve, and spirit with which he has borne this trial set an exemplary standard within him. I salute his steadfastness.”

After Qureshi was hospitalised, three former PTI leaders arrived in his hospital room at the start of November to convince him to join their ‘release Imran Khan campaign’ — a move rebuffed by the ex-FM.

According to Umer, former leaders Fawad Chaudhry, Imran Ismail, and Maulvi Mahmood managed to gain access to Qureshi when he was alone in his room.

“Shah Mahmood Qureshi was surprised to see them and immediately asked the police on duty to call his lawyer, who had left just a minute ago, and tell him some ‘guests’ had arrived,” he said.

In another case linked to the May 9 riots, an anti-terrorism court (ATC) on Saturday acquitted former foreign minister Shah Mahmood Qureshi, while awarding 10-year prison sentences to senior PTI leaders Dr Yasmin Rashid, Omer Sarfraz Cheema, Mian Mehmoodur Rashid and former senator Ejaz Chaudhry.

ATC-I Judge Manzer Ali Gill announced the verdict inside Kot Lakhpat Jail after concluding the trial of the accused in FIR No 852/2023, which relates to an attack on the entrance gate of the GOR-I Club Chowk. The case had been registered by the Race Course police, who later submitted a challan against 25 accused persons, including PTI leaders and party workers.

In the same case, the court also handed down 10-year imprisonment sentences to PTI workers Qasim Elahi, Muhammad Shehbaz, Mushtaq and Abdullah. However, the judge acquitted 12 other accused due to a lack of sufficient evidence against them.

This marks the fifth case in Lahore in which Mr Qureshi has been acquitted, while Dr Yasmin Rashid, Omer Cheema, Ejaz Chaudhry and Mehmoodur Rashid have been convicted. The majority of those convicted were charged with participating in the attack while armed with clubs, pelting stones and chanting slogans.

Previously, verdicts have already been announced in several other cases arising from the May 9 unrest, including trials related to the attack on Shadman police station, violence at Sherpao Bridge, the burning of police vehicles near Rahat Bakery, and the torching of a Supreme Court judge’s squad vehicle near Jinnah House.

Barrister Taimur Malik, counsel for Shah Mahmood Qureshi, stated that despite the acquittal, the PTI vice chairman would not be released from Kot Lakhpat Jail as his bail pleas in three other cases are still pending. He expressed hope that bail in those cases would be granted sooner rather than later, instead of Mr Qureshi having to wait for the completion of the trials.

“We have now obtained his bail or acquittals in around 50 cases across Punjab and Islamabad over the last three years,” the counsel added.

The May 9 riots erupted following the arrest of PTI founder Imran Khan by the National Accountability Bureau from the premises of the Islamabad High Court. Subsequently, PTI leaders and workers launched protests across the country, during which military installations and public property were attacked.

Joint letter

Separately, five senior PTI leaders currently incarcerated at Kot Lakhpat jail issued a joint letter through their lawyer, stating that dialogue is the only viable path to steer the country out of its ongoing crises.

The letter, signed by Shah Mahmood Qureshi, Dr Yasmin Rashid, Omer Sarfraz Cheema, Ejaz Chaudhry and Mian Mehmoodur Rasheed, stated that the party’s central leadership firmly believes that dialogue at all levels is the sole workable solution to the prevailing situation.

The incarcerated leaders said that Pakistan has been grappling with severe political, economic and social crises for the past three years and eight months, and that it is the responsibility of every patriot to think in the national interest and pursue objectives through peaceful and constitutional means.

According to the PTI leaders, negotiations alone can help pull the country out of the current turmoil. The letter further stated that the PTI founder has asked the Tehreek Tahafuz Ayeen-i-Pakistan to engage in consultations with national political parties in order to chart a way forward.

It added that broad-based consultation opens the door to meaningful dialogue. The imprisoned leaders also expressed hope that Mahmood Khan Achakzai and Allama Raja Nasir Abbas would provide guidance to the nation during this critical period.
