The insurance companies will expect the ECB to have a legitimate explanation why the match couldn't be delayed, or even why they couldn't play a 4-day game. The assertion in the article that the ECB pushed for an abandonment despite the BCCI accepting a delay would make their insurance payout case dubious. One could argue that the allegation that the ECB did this for the insurance payout is tantamount to alleging insurance fraud by the ECB.

To the extent of ticket revenues, the ECB would have recovered the loss to reimburse the fans.
However, the insurance claim should also recover wider loss of revenue such as the potential rebates due to the broadcasters (sky, sony, bbc) if the match wasn't held.

ECB are peddling the line in media/social media that the test was called off on account of ''fear'' of Covid outbreak.
OTOH, the ECB medics tested the Indian staff and confirmed 4 positive cases. It was definitely not a fear but in fact a real outbreak of multiple cases.
Can the ECB now say that only the players count for the purposes of abandonment and not the support staff? Also, can they legitimately make a case that Indian players were unreasonable in not agreeing to play despite being in close contact with physios who tested positive?
Basically the above two questions are what would need to be decided if the matter reaches ICC.

That's a tad simplistic and not reflective of how the market works. The argument to let the fans in or not will be subject to detailed assessments and expert opinion on whether it was a justifiable move to disallow fans. In any case that's a hypothetical argument which isn't even pertinent to the case here as the match wasn't abandoned due to the presence of a crowd.
Even if the match is held next year, the ECB are perfectly entitled to an insurance claim for loss of revenue (in accordance with whatever policy they hold) and damages for the match not being held this year. The concept of future revenues will not be taken into account at all.

If there is no loss of revenue but just delay in it then insurance pay out will be a lot less.
Indian team wanted a proper bio bubble for this test. So spectators may not have been allowed. So there may have been reasons gor ECB to not allow the match even with delays.

Heading into game, India led the rubber 2-1.
The standalone Test will not be part of this series.
The ECB wants the ICC’s Dispute Resolution Committee to address the issue and expect that a forfeiture would be granted so that they can claim insurance as they are going to lose 40 million pound if the match is declared abandoned due to COVID.
COVID is an acceptable non compliance and the Indian camp has stated that it was unable to field a team for the match.
However, the ECB’s contention could be that the Indian players returned two negative RT-PCR results and were still reluctant to play.
Seniors such as skipper Virat Kohli didn’t budge from their stance that there was risk involved during the incubation period, which overlapped with Test dates as most players were treated by physio Yogesh Parmar, who is in isolation after contracting the virus.

There have been unconfirmed reports in English media claiming that it was the Indian team that refused to play the fifth and final Test.
Batting legend Sunil Gavaskar has come down heavily on those reporting that the the touring Indian cricketers’ refusal to play in Manchester led to the cancellation of the fifth and final Test against England. Gavaskar says unless anyone has a proof to substantiate the claim, such allegations should be stopped.
The gripping five-match Test series, which India led 2-1, came to an early end after covid fears in Indian camp with their physiotherapist testing positive a day before the Test was scheduled to get underway. The tourists were wary of more breakouts within the team should the match go ahead that would have led to further complications.
Hence, the 5th Test at Old Trafford was cancelled.
In an interview with Sports Tak, Gavaskar said, “Our players worked so hard to lead the series 2-1. And in Manchester, their bowlers would have been aided… why wouldn’t they want to play? They would want to play the match because they can win the series 3-1. So I will never believe that Indian players refused to play the 5th Test," Gavaskar said.
“If these reports are true, then the BCCI needs to officially say, that ‘Yes, our players said that they won’t play’. Else, I would request not to make such claims without any proof," he added.
He even thrashed claims that the book launch event attended by India cricketers along with head coach Ravi Shastri and his support staff was the precursor to covid breach in the touring camp. Following that launch, Shastri tested positive followed by members of his support staff.
“How does anyone know that it happened during the book launch?" Gavaskar asked. “Because even after the book launch, when players were tested, they were negative. From what I’ve heard, the tests that took place on the eve of the match were all negative. So if none of our players were positive, what was the problem?"
Gavskar also said that English media will always be critical of Indian team and never write anything positive about them.
“And reports that suggest the Indian players refused to play the match, I want to know who it was? These reports are only in English papers. They will never say or write anything good about the Indian team; they will always hold them responsible. Please find what is the truth and then point fingers," he said.

If the report about the Indian camps request to push out the game by a couple of days is true then it's on ECB. The reasons for postponement sound very reasonable. It looks like ECB jumped the gun in its attempt to mitigating its antifreeze financial loss. They better have a very good reason for not accomodating the Indian team's request otherwise ECB should not have any expectation for an insurance claim.
Gavaskar is right in indicating that the refusal to play by the Indians is conjecture at this point and has not been confirmed. The facts will come up soon and everyone can then decide to bash BCCI (or not).
It is funny though to see some of Pak fans being bent out of shape for something totally unrelated to Pakistan cricket
How? When the team doesn't have their physio and the assistant physio testing positive , how can I team play a 5 day match without any physio. Even a ball hitting an elbow or fielders having cramps needs to be treated for the game to go on. So the concerns were justified.

With rain expected on most of the days and draw a very likely result, how do u think BCCI will let go of a chance to complete the series triumph. As I said in the prev post, a team needs a physio to compete in a 5 day game or even if it was expected to be rained out. Do u also think Moeen Ali , Sam Curran and co will be allowed by ECB to take off for IPL if the conspiracies posted here are true. After incurring losses for the cancellation, why will they allow IPL to go on with Eng players. Does not add up to the logic.
So what did they do? I dont have enough information but all indications are that England wanted to play? So who forfeited / cancelled it?

The issue is not just the outbreak of Covid in the Indian camp, but how the fallout has been handled by BCCI.
First, the coach goes on a book launch and gets Covid, then others close to him get it. But there is no acknowledgement from bCCI that the origin of this outbreak in Indian camp was a mistake by their own.
Second, as the Indian players refused to play on Day 1, there was no communication from BCCI to the public about what possible options are being considered: postponement of the test series/ postponement of IPL/playing an alternate XI/delay in the match start/compensating advertisers, ECB, ticket-buyers etc/ or anything. All we got was silence from the Indian camp, and ECB was the only one tweeting.
Third, The rush to fly to UAE and prepare for IPL while refusing to play in the final test is terrible optics. It shows that the team and BCCI prioritises IPL over the Test series. And the fact that English players snubbed this year's IPL showed how poorly this move by BCCI has been received internationally.
Lastly, today Ganguly came forward and clarified nothing about the issue, backed the Indian players and coaches to the hilt and just declared that the series is over and a one-off match may be played sometime in the future. It reeked of arrogance and petulance.
Also, FYI I am an Indian, loves Indian cricket and Pakistan cricket too (why else will I be on this forum), watch IPL will great interest but love test cricket above anything.

Firstly its not unrelated and secondly most cricket fans should be interested in something so new and big in the cricketing world.
Nobody knows exactly whats happened including yourself however the indications are that Indian players refused to play and not (BCCI themselves) last minute because they got worried that they were not provided adequate support staff. Indian players may even have though why should they play if they are not provided enough support staff since should they lose its them who will take the criticism from Indian fans?
England in all of this were expecting to play the last match of the series and they are within their right to seek for forfeiture from Indian side.

no chance in hell ,reason being there is a clause in wtc tournament that if a team refuses to play in case of covid the match will be deemed cancelled you can check that so ,aint happening.

Yeah I don’t think the ICC can work in accordance to an emotional Indian YouTube comment section.
A wrong precedent can be set if this isn’t called a forfeit. Test matches/series can be cancelled or abandoned midway by sides on the ascendency if they cite poor excuses. Also, Indian players have show themselves in the foot by flying to UAE instead of flying back home to remain safe from Covid.
BCCI hasn’t run away from PCB this time, they’ve picked on the wrong person I’m afraid.
India have already cancelled the match and traveled home (IPL). Covid threat is there for the whole world

They all tested negative and if they did not trust medical science then they should not have traveled half way across the world to UAE. I repeat Covid threat has been there for everyone since last two years.

As of now, it's becoming more and more apparent that the players didn't want to jeopardize their IPL plan$ by getting infected during the course of the 5th Test (had it happened). And I'm quite sure, BCCI also had the same intention$ as they know that an IPL without one or more of Rohit, Kohli, Rahul, Bumrah, Pant etc would have made things difficult from a broadca$ting per$pective.
Just hope they play this Test next year and not cancel it altogether. Would be the worst possible end to an incredible series..

You are right about Ambani. BCCI is also the richest cricket board in the world. I am sure they could have arranged a local physio for Indian team if they were serious about the 5th test.
That was for them to decide and they decided they did not want to.. If I was leading the series 2-1 I would play because I would not want series to be tainted this way with result unclear.
They played without Shastri so they could have / should have played without who ever else tested positive but obviously the players decided they would rather now travel to IPL.
Also note its not BCCI who did not want to play its the players.

testing negative is okay for an LOI or few hours travel but not okay for a 5 day Test during which they can test positive being close contacts of physio

Icc dont work on the emotions of bunch of emotional keyboard warriors sitting in england as well, precedent or not rules are rules,in case you don't know UAE has a very strict bio bubble ,in england the bio bubble wasn't that strict including one at hotel so you don't know if it was because of hotel or book launch, regarding picking the wrong or right person is concerned things don't work on assumptions, besides India had already asked for delay by 2-3 days before match ,it was ecb that denied that request,india also offered to play the match next year it was exb that denied that request so not sure about who shot itself in foot,as I said the clause clearly says that a team is not obliged to play match in case of covid outbreak that is the rule , matches are not played by precedent it is played by rules whether you like it or not.

Indian players where in contact of assistant physio including the covid subs who was tested positive not by india but England.

They didn't choose to play because the assistant physio who attends player's that includes subs as well was also tested positive .so they were well within rights to not play.

Exactly,the people need to understand this , plus they have families along with them easier to say that they could have would have played but what if the player's or the family members got infected

Sourav Ganguly said the players refused to play, but you can’t blame them. Physio was such a close contact of the players. The players were devastated when they came to know that Physio had tested positive for COVID19.

The ECB excluding some of their best players from the IPL is having an effect. I'm pretty sure the ICC decision will be a continued series for next year. The ECB will then allow certain players to back out of the Pak series.

BCCI apologists in a desperate attempt to justify their stunt by comparing to ECB bailing on SA ODI series.
Remember folks, when ECB bailed in SA, it was during the news of a new variant outbreak in the absence of a vaccine, when the world was in lockdown.
BCCI on the other-hand, bailed mid series because vaccines are available and no Indian player tested positive cos they were caught shopping in Manchester Piccadily.
Also both the england board and South Africa board agreed to cancel the match.
In this case, the bcci and ecb proceeded with the match.
It was the Indian players wanted to cancel the match 2 hours before the toss on the day of the test. This counts as a forfeit

Why was the 4th test held at Oval and 5th at Manchester? Was the 5th test meant to be cancelled due to IPL and this was part of the secret arrangement between ECB & BCCI. The Indian players were very quick to fly from England. This all sounds very fixed & fishy to me.

Should they have forfeited? It depends how important getting away from England with a series win trophy in their swag bag was. I think it was worth too much, so they would never forfeit. A chance Covid scare gave them the potential of a priceless series win and a getaway car parked and running. They jumped in and off they went, trophy in hand.

The BCCI have confirmed that they've made an offer to the England and Wales Cricket Board (ECB) to play two extra T20Is, should both parties decide to settle for an amicable resolution over the standoff that resulted following the cancellation of the Manchester Test.
BCCI secretary Jay Shah told Cricbuzz that India have agreed to play two extra T20Is against England so that the ECB can recover the losses incurred from the cancellation of the Old Trafford Test, with the condition that there should not be a demand for the forfeiture.
"It is correct that we have offered to play two extra T20Is when we visit England next July (only for the white-ball games). Instead of three T20Is, we will play five T20Is. Alternately, we will be willing to play one-off Test as well. It is up to them to choose either of the offers," Shah told Cricbuzz on Monday (September 13).
The Test in Manchester was cancelled after Virat Kohli & Co expressed apprehension at playing, following a spate of Covid-19 positive cases in the Indian camp.
The Daily Mail in the UK reported on Monday about the BCCI offer: "However, the offer -- designed to help ease a potential shortfall of 40 million pounds in English cricket's already stretched budget -- would be instead of, not as well as, the rescheduled Test. The offer of a rescheduled Test still stands." Shah confirmed the same.
The BCCI secretary also said that was unaware of reports of ECB knocking on the doors of ICC's Dispute Resolution Committee (DRC) with a demand to treat the cancelled Test as forfeiture. But Shah made it clear that the extra games will be played only when there is no such demand.
Meanwhile, Shah denied knowledge of any move to split the international captaincy between Virat Kohli and Rohit Sharma. "There is no such proposal and the team is led by Virat and we are backing him," Shah said, agreeing with the comments of his colleague Arun Singh Dhumal, who "rubbished" the reports earlier in the day. "We are sensitive to the fact that such a proposal is not in the interest of Indian team when it will take part in a World Cup," the BCCI treasurer told Cricbuzz.

What's so wrong in playing the same match next year against a better English team( Having Stokes)?
More like stating it very clear that forfeit drama will not work with BCCI.
It's a clear offer - drop your forfeit claim with ICC and settle between both board and get two extra T20.
If you still want to go to ICC, let ICC decide then. But in that case forget any extra matches.
ECB is in soup now.
This is a body blow by BCCI. ECB has no choice now.
Not the case, the cancellation in South Africa was officially a mutual decision between both boards.
The only gaps in the schedule are in May (during the IPL) or in the August slot intended to allow the England test players to participate in the first half of the hundred. Maybe some kind of deal for Indian participation in the hundred next year in return for the replacement test encroaching on that slot?
So why did ECB did not coperate with India when South Africa coperated with them in cancelling the series due to covid.
The covid circumstances were similar for both teams.
ECB became numb seeing 40 million pound loss and the insurance claim and did everything to pressurise Indian players to play despite of covid cases in the camp.

If it will do Zilch then why is Jay Shah begging them not to?
If they lose the forfeit case which can also happen ( since ICC will look into covid clause ) then they will lose the insurance money as well as revenues from potential matches next matches. Remember Jay shah has clearly stated - No T20 matches if no resolution between boards.
ECB is not stupid enough to miss this opportunity.

BCCI is a bad boy. Jay Shah has given a pure warning - a clear message. Go to ICC for resolution and say bye to lucrative T20.

This was not your typical pyjama league or a mohalla cricket match which can be postponed by 2 days on such a short notice. ECB also had to think about their broadcasters, people who purchased the match tickets and so many other little things that are arranged for every match.
