SC accepts Imran’s bail pleas in eight May 9 cases

The Supreme Court on Thursday accepted the bail pleas of former prime minister Imran Khan in eight cases related to the May 9, 2023 riots.

In November 2024, a Lahore anti-terrorism court had denied Imran bail in the cases related to the May 9, 2023 riots, including an attack on the house of the Lahore corps commander.

The incarcerated PTI leader’s plea challenging that was also rejected by the Lahore High Court (LHC) on June 24. Subsequently, days later, Imran had challenged that dismissal before the apex court.

A three-member bench led by Chief Justice of Pakistan (CJP) Yahya Afridi, which also comprised Justices Muhammad Shafi Siddiqui and Miangul Hassan Aurangzeb, resumed hearing the petitions today.

Barrister Salman Safdar appeared on behalf of the PTI founder, while Punjab Special Prosecutor Zulfiqar Naqvi represented the state.

Both concluded their arguments, following which the CJP announced the bench’s decision.

However, Imran has multiple other cases against him. Imprisoned since August 2023 in a case related to state gifts, the PTI founder is serving a sentence at the Adiala Jail in the £190 million graft case and faces pending trials related to the May 9 riots.

The PTI hailed the SC ruling, using the hashtag “Victory For Imran Khan” in its post on X.

The hearing

At the outset of the hearing, the Punjab prosecutor informed the court that he could not appear yesterday due to illness.

CJP Afridi, noting he had two questions from Naqvi, asked, “You must have read the Lahore High Court’s verdict. Can a final observation be made in a case of bail?”

During the hearing on August 12, the chief justice had raised questions over some observations made by the LHC, noting that the SC will not touch upon the legal findings so as not to affect any party’s case.

Asking his second question, the CJP said, “This same court (LHC) gave bail to a suspect on the charge of conspiracy. Will the principle of precedence not apply to this case?”

The prosecutor responded that a court’s observation in a bail case was always of an “interim nature”. “A court observation does not have any impact on the trial,” he contended.

When the hearing resumed after a brief break, the prosecutor requested that the court allow him to assist on the merits of the case.

However, CJP Afridi observed, “We will not allow anyone to argue on the merits of the case. You may only answer the legal questions pertaining to the conspiracy [charge].”

The SC is a total circus. It has denied justice to people locked up years on this event totally perpetrated by the Junta. The evidence is poor that if heard in open court they would never live it down. Its the reason why the cases have been delayed. Obviously they will find other cases and he wont be released and nor will the other victims of this horrific abuse power by Munir and Co. Today IK is being tortured and so is his wife. This is the kuffar state of our leadership as they want him to beg them.
 
CJP is a crook. He gets direrct orders from Munir and he showed his colours many times. This decision is half baked and all.thta will happen is a fake trial will take place in which another year will be wasted and then it will come back to the SC and he will look shocked at the faked evidence. All the 9th May appeals should be heard ASAP and convictions thrown out.The evidence provided for today is the same for all the other cases- fake police eye witness accounts.

Take Shireen Mazari, for example. They threatened her only daughter. What choice did she have then? These are politicians, not soldiers. They’re not trained to resist like the armed forces. Mocking civilians who’ve been through such trauma is not just insensitive — it’s shameful.

Stories of the so-called torture that the government inflicted on PTI supporters on May 9 are greatly exaggerated. The ground reality is quite different.

The resistance wasn’t nearly as aggressive as it is made out to be and it’s just a ploy by PTI supporters to cover up their embarrassment and how they ran away like cowards.

As far as Shireen Mazari is concerned, she is a crazy woman. You can tell it by the way she dyes her hair with stupid colours and makes herself look like a clown.

She deserved the treatment that she got because she was abusing the authorities. You cannot do that and then play the woman card after you get punished for your actions.

As far as overseas Pakistanis are concerned, I have no issue with overseas Pakistanis who stay in their lane.

However, those overseas Pakistanis who act like they are the biggest patriots on earth and that they know better than the those living in Pakistan will be shown the station.

For example, I cannot sit here in Pakistan or elsewhere and tell you what’s happening in Norway. I can’t possibly be more aware of the ground realities than you as citizen of Norway are. Similarly, I will not listen to lectures from overseas Pakistanis on the situation in Pakistan because they don’t know better than me.

This judiciary can never do any justice. We have the CJPs of each High Court appointed to deny justice. They have sworn on the Koran to provide Justice and here they are as touts of criminals.

Imran's nephew Shershah sent on five-day remand in May 9 riots case​


An anti-terrorism court on Saturday handed over former prime minister Imran Khan’s nephew, Shershah Khan, to police on a five-day physical remand in connection with the May 9 riots.

The order was passed by ATC Judge Manzar Ali Gill, a day after Shershah’s brother, Shahrez Khan, was remanded into police custody for eight days in the same case. Both were nominated in the case more than two years after the incident.

May 9 riots erupted nationwide following the arrest of Imran Khan, after which Pakistan Tehreek-i-Insaaf (PTI) leaders and workers staged protests targeting both civil and military installations, including Jinnah House and the General Headquarters (GHQ) in Rawalpindi.Monsoon travel packages

The military condemned the events as a "Black Day" and decided to try the protesters under the Army Act. Military court convicted 25 individuals, including Imran Khan’s nephew, Hassan Khan Niazi, and later sentenced 60 more. In January, 19 convicts had their sentences pardoned following successful mercy appeals.

According to court proceedings, Shahrez was arrested on August 21 and produced before the court on August 22, while Shershah was taken into custody on August 22 and presented the following day.

The prosecution argued that Shershah was present at the scene of the riots and that video evidence was available to establish his presence. Police had requested a 30-day physical remand to continue investigations and recover the accused’s social media accounts. The court, however, granted five days of custody instead.

PTI General Secretary Salman Akram Raja argued the 27-month delay in Shershah’s arrest was mala fide and victimisation, saying he had no political ties. Lawyer Rana Mudassar Umar added the delay showed prosecutorial ill intent, urging the court to discharge him.

A day earlier, the same court remanded Shahrez into police custody for eight days in connection with the May 9 riots. Police told the court that Shahrez had been nominated in two supplementary statements on September 23, 2023. Raja criticised the development as “ridiculous,” arguing that authorities had suddenly “remembered” the accused more than two years after the events, despite knowing he had no role in political activity.

He claimed Shahrez’s implication was part of a broader crackdown, pointing out that Aleema Khan’s house was raided soon after the Supreme Court granted Imran Khan post-arrest bail. Shahrez was in Chitral between May 6 and 13, he argued and urged the court to discharge him from the case. He added that Aleema Khan had already been discharged.

The judge asked the investigating officer to specify Shahrez’s alleged role. After briefly adjourning to review the case record, the court was told by police that the accused was not wanted in any other case linked to the May 9 riots. Raja further submitted that Shahrez is an athlete, warning that implicating him in such cases would send a “bad message” internationally.

 
Imran Khan’s nephew gets bail in Jinnah House attack case

An anti-terrorism court (ATC) in Lahore on Wednesday accepted the post-arrest bail plea of Shahrez Khan, nephew of incarcerated former prime minister Imran Khan, in a May 9, 2023 violence case.

Earlier in the day, the ATC reserved its verdict on the bail petition filed by Shahrez — son of PTI founder’s sister Aleema Khan — in the Jinnah House attack case. He was arrested on August 21.

The May 9 riots broke out across the country following the arrest of the PTI founder in a corruption case in 2023. The violence included attacks on military and state installations, with the Jinnah House incident becoming one of the most high-profile cases.

At the outset of today’s hearing, Shahrez’s counsel argued that allegations of inciting PTI workers had been leveled against his client, but the prosecution failed to produce any evidence to support the claims.

At this, the public prosecutor, while opposing the bail plea, told the court that the suspect’s affidavit had not been verified.

The court reserved its verdict after hearing arguments from both sides and announced it later in the night.

Earlier on August 30, the Lahore police presented Aleema’s son before the ATC court Judge Manzer Ali Gill upon the completion of his physical remand.

During the hearing, the prosecution sought an extension in physical remand for further investigation from the accused. Judge Gill, rejecting the police request, sent him on judicial remand.

It is pertinent to mention here that Khan’s second nephew, Shershah, is also in the police custody in the May 9 riots case. He was also arrested on August 22.

Following the expiry of his five-day physical remand, the ATC on August 29 sent Shershah on a 14-day judicial remand in the violence case.

Sources had told Geo News earlier that both of the suspects were primarily arrested for their alleged involvement in the Jinnah House attack.

"Shershah was present with Hassan Niazi at the time of the Jinnah House attack and had earlier been booked in connection with the case. He was facing accusations of arson, vandalism, and torching a police van, as well as "running an anti-state digital campaign for months".

He allegedly went into hiding after the violence and later fled to London, where he remained for nearly two years, the sources added.

 
Notices issued on plea of Imran’s nephew

A Lahore High Court two-judge bench on Thursday issued notices to the federal and Punjab governments to hear arguments on registrar office objections raised against a petition filed by Barrister Hassaan Khan Niazi, a nephew of incarcerated PTI founding chairman Imran Khan.

Mr Niazi challenged his handover to the army and subsequent trial proceedings in connection with the May 9 riots.

The bench comprising Justice Syed Shahbaz Ali Rizvi and Justice Tariq Mehmood Bajwa took up the petition as an “objection case.” The office had objected that a certified copy of the commanding officer’s impugned order was not attached with the petition and that the petitioner had not approached the relevant forum before moving the court.

The bench directed the law officers of both governments to come up with arguments on the objections on Sept 16.

Mr Niazi was handed over to the military for trial in 2023 and was sentenced to 10-year imprisonment later in December in the Jinnah House attack case.

In his petition, the petitioner contended that after his arrest in the May 9 case, he was not produced before a civilian court and was instead handed over to the military by Sarwar Road police. He argued that this handover was illegal as it was not based on any judicial order.

The petitioner asked the court to set aside the Aug 17, 2023 notification of the commanding officer authorising his custody by the military, and declare all proceedings before the military court unlawful. He further asked the LHC to order his release or production before an anti-terrorism court.

 

ATC rejects Imran Khan's request for halt in GHQ attack case proceedings​


An anti-terrorism court (ATC) in Rawalpindi on Tuesday rejected Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan's plea seeking the halt of court proceedings in a May 9 case pertaining to the attack on General Headquarters (GHQ).

ATC Judge Amjad Ali Shah conducted the hearing today over two petitions, filed by Khan, seeking the court to provide the CCTV footage of the court proceedings on September 19 and stopping the proceedings till the high court's order on the transfer of the jail trial.

During the hearing, where Khan was presented virtually before the court via WhatsApp link, the PTI founder's lawyer Faisal Malik contended that they did not want to become part of the case proceedings sans consultation with the former prime minister.

To this, the court said: "During the last hearing, you consulted with the PTI founder who [then] boycotted the proceedings".

When advised by the court to challenge the WhatsApp communication in the high court, counsel Malik said that they had already done so.

"[A] WhatsApp call cannot be considered as [attendance] via a video link," the lawyer said while requesting the court for more time to challenge the court's previous order.

"You can challenge it [however] the court proceedings cannot be stopped," the court responded.

Highlighting that the defence lawyers boycotted the previous hearing, prosecutor Ikram Amin said that the prosecution was not obligated to answer any of their queries.

"The defence lawyers boycott court hearing and then ask for more time the next day. Their conduct shows that they are not serious about the trial," the prosecutor said, adding that the defence team was wasting the court's time.

Responding to prosecutor Zaheer Shah's argument that questioning the court's order amounted to contempt of court, lawyer Malik said that they were merely seeking a fair trial.

"If the suspect cannot listen to his lawyer and vice versa, how is this a fair trial," the defence lawyer contended.

On the defence team's request for the CCTV footage, prosecutor Zaheer said that as per the Lahore High Court (LHC) directives, neither any footage nor a transcript can be provided to anyone.

At this, Khan's lawyer Salman Akram Raja said that the court does not operate on government instructions but works as per the constitution.

"It is not possible to present a person locked in a cell on WhatsApp," Raja stressed, to which the court said that they have the right to challenge the court order.

After hearing both side's arguments, the court rejected the petitions filed by the former PM.

With a total of 41 witnesses recording their statements in the case, the court also adjourned the hearing till September 27.

The development follows ATC's last week's decision of rejecting Khan's plea for in-person appearance in the said case after the Punjab government cancelled the jail trial of all May 9 cases, including the GHQ attack case.

GHQ attack

PTI founder Khan along with dozens of other PTI workers indicted in the GHQ attack case related to May 9 violent protests in December 2024.

Over 143 individuals, including Khan, were named as accused in the case, while 23, including Zulfi Bukhari, Shahbaz Gill and Murad Saeed, were listed as fugitives. Additionally, all accused have been prohibited from travelling abroad.

At least 70 PTI leaders were accused of planning the May 9 events and inciting the workers and supporters to attack military and government installations following the arrest of the ousted prime minister by the National Accountability Bureau (NAB).

The May 9 riots were triggered across the country after the deposed prime minister Khan's arrest in the £190 million settlement case. Hundreds of PTI workers and senior leaders were put behind bars for their involvement in violence and attacks on military installations in 2023.

During the protests, the miscreants targeted the civil and military installations, including the Jinnah House and General Headquarters (GHQ) in Rawalpindi.
