Prime Minister Shehbaz Sharif finalised on Sunday initially a 25-member plus federal cabinet, keeping 14 portfolios for Pakistan Muslim League-Nawaz (PML-N) and giving 11 to Pakistan Peoples Party (PPP) and other allies of the government.

PM Shehbaz, who has thus far been running a one-man show since assuming office, hammered out the details of the distribution of the portfolios in consultation with the coalition partners of the PML-N government.

A formal announcement, as well as oath-taking, was expected on Monday (today), PML-N officials said.
Among others, sources said, PPP Chairman Bilawal Bhutto-Zardari was expected to take the portfolio of the foreign ministry and become the next foreign minister. Initially, it was being said that the PPP chairman might not become a member of PM Shehbaz’s cabinet but now several PPP officials have confirmed that he would take charge of the foreign minister.

Apart from the federal minister, they said, the cabinet might also include state ministers, advisors and special assistants. They added that the new batch of the federal cabinet, as announced by the premier, was expected to be finalized in the next week or two.

Sources privy to the development said that PML-N was keeping portfolios of finance, interior, information, defence, commerce, energy, planning, and petroleum, among others.Former finance minister Miftah Ismail is expected to become the country’s new finance minister after being made an aide to the premier.

They said that PPP has expressed keen interest in foreign affairs and human rights ministries, adding that PPP and MQM-P were expected to decide who would keep overseas and maritime ministries.

Also, they added, PPP and MQM-P were in consultation over the governorship of Sindh, saying they were expected to give a name with consensus. PPP sources, however, said that PPP and MQM-P were also discussing the mayorship of Karachi and Hyderabad along with governorship, saying these will help finalize if MQM-P would become part of the federal cabinet or just keep these three positions.

MQM-P sources, however, emphasized that they were more interested in seeing the agreements made with PPP and PML-N leadership implemented in the coming days.

Apart from portfolios of the federal cabinet, PPP is eying the post of the chairman senate for former premier Yousaf Raza Gillani, who was defeated by the incumbent Senate Chairman Sadiq Sanjrani in the Senate elections last year.

Commenting on the speculations about a tussle between former president Asif Ali Zardari and JUI-F chief Maulana Fazlur Rehman, sources in PML-N and PPP said that no such tussle was going on as the slot is not yet available. If the President doesn’t resign, they said, votes of not less than two-thirds of the total membership of the parliament would be needed to remove the President.

Under Article 47(removal or impeachment of President), the President can be removed from office on the ground of physical or mental incapacity or impeached on a charge of violating the Constitution or gross misconduct.

JUI-F officials also denied the rumours, saying the party has not asked for any position, including that of the President, or portfolios in the federal cabinet. They said that the major objective before the JUI-F, Pakistan Democratic Movement (PDM) and PDM’s allies – PPP and ANP – was the removal of the former premier Imran Khan, which was achieved through a no-confidence motion.

The JUI-F officials said that Maulana led the opposition alliance to oust Imran Khan from power and not to take ministries or positions in the government, which might announce fresh elections once the electoral reforms were completed.

ISLAMABAD:
PPP Chairperson Asif Ali Zardari on Saturday said he did not think his patty would accept any ministries in Prime Minister Shehbaz Sharif’s cabinet, which is yet to be formed since the new premier was sworn in on April 11.

Similarly, Khalid Maqbool Siddiqui, convener of another coalition partner MQM-P, said he was more interested in serving the people than cabinet portfolios.

In an informal chat with journalists outside the National Assembly hall, Zardari said he wanted to give a chance to their “friends”, referring to the government’s new coalition partners.

Speaking on the occasion, PPP Chairman Bilawal Bhutto-Zardari told journalists that they should “enjoy” their independence.

“The raj of the selected is over,” he added, referring to the previous PTI regime.

“The media should be the ones most pleased with that.”

Separately, the MQM-P convener said a lot could be done for the people while remaining out of the ministries as well.

Elaborating further on the current system in the country, Siddiqui claimed that it was a “dynastic” democracy instead of a genuine one.

The MQM-P leader said there should be the people sitting in parliament instead of families.

“Those 98% Pakistanis who understand the problems of the common man should be sitting here. If they won’t sit here, neither will I.”

To a query about his party’s “reservations” over the premier’s first speech, Siddiqui replied that it was a “misunderstanding”. “He [PM Shehbaz] wanted our input.”

Read PPP appears reluctant to join federal cabinet

Earlier in the day, the PPP issued a notification, inviting applications for party tickets in the national and provincial assemblies for the next general elections in the country.

It read that each application should be accompanied with a bank draft of Rs40,000 for an National Assembly party ticket and Rs30,000 for a provincial assembly ticket.

"Applications must reach the party secretariat in Islamabad or Bilawal House in Karachi by April 30," the notification issued by PPP General Secretary Farhatullah Babar added.

Sources said the PPP was more interested in constitutional offices than ministries. After bagging the slot of the NA speaker, it was now eyeing the positions of the NA deputy speaker, Senate chairman, and even the Presidency, hoping that Dr Arif Alvi would soon tender his resignation.

PM Shehbaz has been insisting that the PPP should join his cabinet. However, the PPP, the second biggest party in the ruling coalition, told him that it was more interested in supporting him while staying out of the cabinet.

The premier has been taking his time to form the new cabinet as he wants to take along all allies, especially those who had left the PTI-led ruling coalition and joined the opposition.

Interesting to see how this goes. Already gaping fractions seam to appear in the PDM coalition.

What is the wait? Are they waiting for US Senate confirmation hearings? Last week Biden was seen as shaking hands with no existent people, I think someone told him that the imported PK cabinet had arrived.

ISLAMABAD: The oath-taking ceremony of the new federal cabinet has been postponed after President Arif Alvi refused to administer the oath to them, ARY News reported, citing sources.

As per details, the federal cabinet that was scheduled to take oath today now has been postponed after an excuse from President of Pakistan Arif Alvi. The new cabinet is likely to take oath now on Tuesday or Wednesday, the sources privy to the development said.

Qaumi Wattan Party (QWP), one of the allies of the PML-N-led federal government has expressed reservation over the delay in the swearing-in- ceremony of the cabinet.

On the other hand, the matters of provision of ministries between the government-allied parties have not been resolved yet.

Pakistan Muslim League-Nawaz have 14 ministers and PPP 11 members in the federal cabinet of Prime Minister Shehbaz Sharif.

The government’s spokesperson Marriyum Aurangzeb earlier disclosed that the federal cabinet has been finalized and would be announced soon today.

“It was a lengthy process of consultations over the cabinet among the allied parties, which has been finalized and soon to be announced,” PML-N leader said.

Earlier, Pakistan People’s Party Syed Khursheed Ahmed Shah on Monday said that the federal cabinet will take oath at 8:30 PM today.

Get a 2/3 majority and you can. Or get the courts to open at midnight:)))

Its unlikely the PPP will take any "interior ministries" but will look for "exterior ministries" such as FM etc to try and distance themselves from the upcoming problems that the government is going to face.

ANP has broken their alliance with PDM. So first one bites the dust.

Apparently ANP was demanding a ministry and governorship of KPK. Talk about empowerment where someone with just 1 seat is demanding everything they wish for. Let's see how long this circus will last.

Already MQM is regretting their decision big time. Also Fazlu has come out in open demanding elections now too.

I see assemblies dissolving immediately after announcing budget or most likely to save face they would dissolve assemblies before budget. Elections most likely in Aug/Sep.

Govt claims allies’ reservations over ministries allayed

ISLAMABAD: The federal government on Monday claimed to have addressed “reservations” of the allies in the ruling coalition after which the first phase of the long-awaited induction of a 34-member cabinet will take place on Tuesday (today).

Meanwhile, the oath-taking ceremony of cabinet members was scheduled to be held on Monday, but it was learnt that President Arif Alvi had refused to administer the oath to the lawmakers, compelling the government to postpone the ceremony to Tuesday 11am.

Now, Senate Chairman Sadiq Sanjrani is expected to administer the oath to at least 29 federal ministers and four ministers of state.

Chaudhry Tariq Bashir Cheema of PML-Q, while expected to be in the cabinet, will not take oath today.

A source in the government said President Arif Alvi would also not attend Tuesday’s ceremony and Senate Chairman Sanjrani will administer the oath to the members.

The source said President Alvi will again go on leave on Tuesday on the pretext of an illness so that Mr Sanjrani could perform the duty.

On the other hand, some government allies are still said to be “unsatisfied” over the demands they had extended to the government regarding distribution of ministries and other lucrative positions.

It has been learnt that the Balochistan National Party (BNP) and Jamiat Ulema-i-Islam-Fazl (JUI-F) may not join the cabinet on Tuesday, as the BNP has accused the government of not preventing violent incidents in the province, such as the recent firing on protesters in Chagai.

However, the government’s spokesperson, Ms Aurangzeb, said the list of cabinet members had yet to be finalised, hinting that last-minute changes could be made before the oath-taking ceremony.

Similarly, JUI-F chief Maulana Fazlur Rehman has demanded immediate general elections after being annoyed over the non-fulfillment of his demands regarding distribution of ministries and some constitutional posts like the offices of the president and Senate chairman.

Ruling PML-N leader Khawaja Asif claimed in a private TV show that all reservations of the coalition partners had been addressed and the oath-taking ceremony would be held on Tuesday.

He revealed the names of some of the PML-N leaders who were set to take up ministries in the new cabinet: Ahsan Iqbal is likely to get the Ministry of Planning and Development, Azam Nazir Tarar law, Shahid Khaqan Abbasi energy, while Ayaz Sadiq will get the Ministry of Economic Affairs.

Earlier, it was informally announced that Marriyum Aurangzeb would be given the portfolio of information minister and Rana Sanaullah the interior minister despite opposition within the ruling PML-N, and Miftah Ismail was said to be made the finance minister or adviser.

Mr Asif claimed PPP chairman Bilawal Bhutto-Zardari would be given the Foreign Ministry. However, a PPP leader told Dawn that the party chairman was not joining the cabinet in the first phase being announced on Tuesday and might opt for a ministry after a few days.

Perfect reply. Fawad was the science minister as well who thought we made Hubble and sent it to space and then had the audacity to laugh at India for actually reaching the moon. He also said what the use of going to the moon, everything is visible from Earth.

The current cabinet is crap apart from a few positions but to act like PTI's was anything great is laughable.

It is really sad and depressing to see the politicians of this country. They are mostly thieves, thugs, goons, dacoits , oppressors, land mafias, money launderers and they have infiltrated in all hierarchical levels of power. On top of that, we have an army full of corrupt generals who use such people to keep hold of their supremacy and their own looted wealth so they(our politicians) are not really out of favor at anytime and with the help of corrupt judiciary they somehow survive all the cases against them. This system has to fall.

So ignore the video, Tarar accused Awn Ch of being a drug dealer. Not a user, a dealer. I don't know if this law has been changed but as far as I know dealing is illegal and prison sentence follows. Are these 2 guys part of the same cabinet? And when is he being prosecuted?

• Tariq Bashir Cheema was just FA pass.

Yet, pti supporters including the privileged have the audacity to question others. Your leader was a fascist man, he would have ruined everything!

This is not the main problem. Problem is bail and criminals. We're destroyed as a society. Look what is happening in SC. CJP says court works 24/7 and no one has time to look at Nazim Jokhio's case.

Are Pakistani people just lower class human beings? Disregard for Academic credentials is not anywhere near horrendous than having a justice system working for the rich and powerful only. This is not the way to move forward.

History has many lessons across the world when injustice was at its peak. This will only deteriorate the society more. The society you and I are part of who will have their future generations here. Is that what we want them to remember Pakistan for. Is this the moral lesson we want to give to ourselves and the future world?

I'm all in for conviction of criminals. Even if it's someone from PTI or PDM. Instead of calling against each other why not recognize that when something is wrong, it is wrong. Is right not important anymore?

However, a source in the PML-N told Dawn that there was a divide within the party over the selection of cabinet members and distribution of portfolios among them. He said PML-N Vice President Maryam Nawaz was “unhappy” with the PM for not considering names of veteran party leaders, who have a close and long association with the party’s supreme leader Nawaz, who is presently in self-exile in the UK.

The source also said the PM had included only one member of the so-called Nawaz camp — Javed Latif, who did not take oath on Tuesday. He said Prime Minister Sharif’s motto, “the right person for the right job”, was not evident from the selection of cabinet members, as Nawaz’s close aides have apparently been sidelined, including Irfan Siddiqui, Pervaiz Rashid, Muhammad Zubair, Daniyal Aziz, Musaddiq Malik, Talal Chaudhry, Birjees Tahir, Tariq Fatemi and Zafarullah Khan.

The Nawaz Sharif camp of PML-N believes Mr Siddiqui, who has over 25 years of experience in the field of education, was ignored and Rana Tanveer given the education portfolio.

Moreover, putting rumours to rest, for now, PPP chairman Bilawal Bhutto-Zardari did not join the cabinet. Similarly, another PPP leader, Mustafa Nawaz Khokhar, who was to be made a minister of state, reportedly refused the office for not being given a federal ministry and preferring junior party leaders over him.

PPP sources said Mr Bilawal was scheduled to leave for the UK on Tuesday night and was likely to meet Nawaz Sharif in London to express reservations of his party and other allies about the formation of the federal cabinet. The PPP is also eyeing two constitutional offices — the president and Punjab governor.

The PPP sources further said the party leadership was upset over the selection of lawmakers and ignoring allies like Balochistan National Party (BNP), Balochistan Awami Party and Awami National Party, who had been given guarantees by PPP Co-chairman Asif Ali Zardari about their due share in the government.

Interestingly, the ANP and independent MNA Mohsin Dawar did not find any spots in the federal cabinet apparently after JUI-F chief Maulana Fazlur Rehman opposed their inclusion.

However, a couple of days ago, Mr Zardari had explained to Mr Rehman that he (Asif Zardari) was a “guarantor” in the opposition alliance and had promised the ANP and Mr Dawar a ministry each for their contribution to the efforts to topple the previous PTI government.

On the other hand, the BNP refused to become a part of the cabinet in protest against the alleged firing of security forces on protesters in Chagai last week.

The oath-taking ceremony of the cabinet members was scheduled to be held on Monday, but it transpired that President Dr Arif Alvi had refused to administer the oath to lawmakers, compelling the government to postpone the ceremony to Tuesday.

PTI reaction

Meanwhile, reacting to PM Sharif’s cabinet selection, the former ruling PTI alleged that most newly inducted ministers were facing corruption charges and were on bail.

Former information minister Fawad Chaudhry said in a tweet that: “24 members of the federal cabinet including the prime minister are accused and on bail.”

“A clear message to the world would have been given if IG (inspector general) jails would have administered oath to the cabinet members instead of chairman senate,” he added. “Only Kulbhushan Jadev (detained Indian spy) is still in jail while all others have escaped.”

Cuba Ambassador to Pakistan Zéner Caro on Monday called out Federal Minister for Planning and Special Initiatives Ahsan Iqbal for his "disrespectful" remarks on Cuba, given during a press conference in Lahore yesterday.

At a media talk on Sunday, Iqbal had said that Pakistan wanted to become a strong country for which it needed a strong economy and positioning with the global economy.

He said he did not want Pakistan to turn into Cuba or North Korea. "We have to set Pakistan on the path of [development, like] Malaysia, Turkey, China and South Korea," the minister had added.

Responding to Iqbal's comments today, Caro tweeted, "Fortunately, Minister Ahsan Iqbal's disrespectful mention of Cuba in his press conference in Lahore does not represent and has nothing to do with Pakistanis' true respect and deep affection for Cuba."

Earlier, journalists and activists on Twitter had also criticised the minister for his remarks, recalling Cuba's support for Pakistan in tough times.

Zebunnisa Burki, a journalist, said someone needed to explain basic history to Iqbal. "He seems to think Cuba = North Korea," she added.

Another journalist Murtaza Solangi remarked that Pakistan would always remain "grateful to the heroic people of Cuba".

Meanwhile, activist Ammar Ali Jan demanded an apology from Iqbal.

Following the Cuban ambassador's tweet, the federal minister took to Twitter and clarified that his remarks were "only in the context of foreign policy".

"We have deep respect for the people of Cuba and our deep affectionate relations with Cuba," Iqbal said, adding that Pakistan couldn't forget how Cuban doctors played a heroic role during the aftermath of 2005 earthquake in Pakistan.

Former interior minister Sheikh Rashid Ahmed challenged the appointment of Pakistan Muslim League-Nawaz (PML-N) leader Hanif Abbasi as special assistant to prime minister (SAPM) on Friday through a petition filed in the Islamabad High Court (IHC).

In the petition filed through his counsel Sajeel Sheryar Swati, Rashid questioned the federal government’s appointment of Hanif Abbasi, stating that the office of the SAPM required the selection of “people possessing high virtues and strong moral fibre…to these important public offices.”

The petitioner contended that Abbasi, “a person with a criminal conviction, particularly a conviction for dealing in narcotics which is an offence involving ‘moral turpitude’,” is unsuitable to hold such a position.

In his petition, Rashid argued that the SAPM’s office was one of the few public offices recognised and identified by the provisions of Article 260 of the Constitution. It furthered that while the PML-N leader was convicted and sentenced for the offences registered against him, the Lahore High Court’s (LHC) suspension of the sentence did not forgive his conviction.

“In criminal jurisprudence, there is indeed a marked difference between conviction and sentence. Conviction is finding someone guilty positively of the offence(s) charged with, whereas sentence is the punishment (imprisonment or fine or both) for being guilty of that offence. The Honourable Lahore High Court only suspended the sentence of the Respondent No.2 [Hanif Abbasi] meaning thereby that he still carries the conviction. Therefore, for all intents and purposes, Respondent No.2, being a convict, is disqualified from holding the public office of Special Assistant to the Prime Minister,” the petition read.

The petition lambasted Prime Minister Shehbaz Sharif’s judgement stating, “although the Prime Minister’s discretion to appoint Special Assistants is apparently without codified conditions or limitations but in essence, this discretion is neither 'unfettered' nor 'absolute'.”

Rashid, who also heads the Awami Muslim League (AML), furthered that the premier is subject to exercise the discretion reasonably, lawfully and constitutionally - to appoint a person who is fit to hold such high public office and is not otherwise disqualified from holding such office.

“Unfortunately, by appointing a convict (that too in narcotics case), the Prime Minister has not only misused his authority but also made a mockery of the rule of law and the Constitution,” it maintained.

It was further argued that the appointment stands in contravention to the judgment of the Honourable Supreme Court reported as PLD 2021 SC 379, Munsif Awan, Advocate v FoP which notes that there are limits to the discretion, particularly where the appointees “suffer from any blot or blemish on their names or reputation for having been convicted for an offence of any nature or are under a cloud for having committed an illegality for which they have been convicted by a court of competent jurisdiction…”

The petition contended that Hanif Abbasi is not in “consonance with the principles of good governance or the rule of law and also rests on the abuse of discretion vested in the Prime Minister.” Adding that in such, cases the courts of this country never “shy away from setting aside patently illegal and unconstitutional appointments, upholding the emblem of Constitution and the rule of law.”

In 2018, an anti-narcotics court handed down life imprisonment to Hanif Abbasi in the eight-year-old ephedrine case.

According to the judgment that was issued late at night, Abbasi, who was the PML-N candidate from NA-60 against the AML chief Sheikh Rashid Ahmed, had failed to defend himself, and the charges levelled against him had proven to be true.

However, in 2019, the LHC had suspended the PML-N leader's life sentence in the ephedrine quota case and ordered his release on bail.

ISLAMABAD: Prime Minister Shehbaz Sharif on Saturday approved the appointment of renowned lawyer Ashtar Ausaf Ali as the Attorney General for Pakistan.

The post of attorney general fell vacant after Khalid Javed Khan resigned on April 9 following the departure of the PTI government, saying he had tried to serve the country to the best of his ability and conscience.

It is pertinent to mention here that Ashtar Ausaf Ali had served as special assistant to the prime minister (SAPM) on law and justice during 2015-16. He had been the AGP during the tenure of former prime minister Nawaz Sharif.

He previously served as Advocate General of Punjab twice, from 1998 to 1999 and 2012 to 2013. He also served as Prosecutor General of the province from 2011 to 2012, and as Advisor on Human Rights to Prime Minister Nawaz Sharif in 1997.

ISLAMABAD: The Islamabad High Court (IHC) has directed Prime Minister Shehbaz Sharif to review the appointment of PML-N’s Hanif Abbasi as a special assistant to the prime minister.

IHC Chief Justice Athar Minallah heard the petition of former interior minister Sheikh Rashid against the appointment of Hanif Abbasi as a SAPM, with the former interior minister appearing before the court on Monday.

The development comes days after the newly appointed SAPM announced a reward of Rs50,000 to anyone who brought him Rashid's wig, a statement over which PPP Secretary-General Farhatullah Babar had expressed concern.

The IHC CJ summoned Rashid to the rostrum and regretted the accusations made against courts at public gatherings. "Do you and your ally PTI have confidence in the Islamabad High Court?" the IHC CJ asked.

"Maybe PTI does not trust the court. Political statements are made at rallies questioning why courts opened at night. It is said that the courts open at the behest of someone," he said.

"If Imran Khan does not trust the IHC, I apologise as the CJ and will send the case over to another court," said IHC CJ Minallah, adding that there are other courts and judges who can hear his cases as it is important to have trust in the court.

Justice Minallah said important and big cases are pending in the high court like the cases of missing persons and Baloch students. "Sheikh sb, these courts are for everyone," he said, to which Rasheed replied, "right sir".

Rashid said he has approached the court because he has trust in it, to which Justice Minallah said that the court will hear his petition if he has faith in it.

The IHC CJ again referred to statements made at political rallies, pointing out that it was said [at the rallies] that the courts are not independent.

"Your lawyers must have told you that there are rules and the chief justice can take up a case at any time," he told Rashid.

Later, the court issued notices to the federation through the Cabinet division secretary and Hanif Abbasi on the plea against his appointment as the SAPM.

The hearing was adjourned till May 17.

Lahore High Court’s (LHC) acting Chief Justice Malik Shahzad Ahmad Khan on Wednesday issued notice to concerned quarters and sought a reply by May 18 in regards to a writ petition requesting the court to fix and decide the appeal of Pakistan Muslim League-Nawaz (PML-N) leader Hanif Abbasi who had filed a petition against the punishment handed to him in ephedrine quota case.

The petitioner’s counsel, President Supreme Court Bar Association (SCBA) Ahsan Bhoon, appeared before the court and contended that his client had been deliberately implicated in a politically motivated case in 2018 by the Anti-Narcotics Force (ANF) with the intention to humiliate him.

Later, the Control of Narcotics Substances (CNS) court in Rawalpindi had awarded Abbasi life imprisonment, the counsel prayed.

He further contended that an appeal had been filed but in the meanwhile, LHC had suspended the implementation of punishment and had released the appellant.

“Appeal of the convict had not been decided yet,” the counsel prayed. “The appeal should be transferred to Lahore's principal seat and be decided.”

It is pertinent to mention that a CNS Court, in July 2018, handed life imprisonment to convict Abbasi in the ephedrine quota case.

Abbasi at that time was contesting elections against Awami Muslim League chief Sheikh Rashid from NA-60 (Rawalpindi).

Judge Sardar Muhammad Akram had pronounced the judgment, saying Abbasi was found guilty of selling 500kg ephedrine illegally to narcotics smugglers.

He also imposed a fine of Rs1 million on the PML-N leader. The court had also acquitted seven other accused in the case while giving them the benefit of doubt.

Islamabad High Court (IHC) Chief Justice Athar Minallah Tuesday said a person convicted in any case is ineligible to hold any public office in the country.

These remarks came during a hearing of a case relating to the appointment of Hanif Abbasi as a special assistant to the prime minister.

During the hearing, Hanif Abbasi's counsel Muhammad Ahsan Bhoon argued that the post of special assistant to the prime minister is not similar to the other public offices.

At this, the court said that the special assistant's job is to advise the prime minister, adding that a person can give his advice to the premier without notification as well.

The court hoped that Hanif Abbasi will not use the public office until the next hearing.

The matter will be discussed further at the next hearing scheduled for May 27.

The case
On May 6, former interior minister Sheikh Rasheed Ahmed challenged a notification over the appointment of PML-N’s Abbasi as a SAPM.

According to the petition, Abbasi has been convicted in an ephedrine quota case against which an appeal regarding his sentence is pending in the Lahore High Court. The petitioner said that a convicted person cannot be appointed as the SAPM.

Earlier, IHC Chief Justice Athar Minallah had issued a notice to the Cabinet Division directing the premier to review the decision following which a summary was sent to Prime Minister Shehbaz Sharif to review the appointment of PML-N leader Hanif Abbasi as his special assistant.
