I currently have an ongoing divorce in California. My wife and I both are pakistani citizens and have green cards. We have no kids.

Due to some other circumstances, I have to permanently move back to Pakistan.

Would I be able to apply for divorce in Pakistan (even with an ongoing case in California)?

And if the California family court grants my wife alimony etc after divorce , would that be enforceable in pakistan? I don't think it should because under pakistan/sharia law, I should only be responsible for maintenance during the 3 month iddat period.

Sorry to hear and everything works out best in the future but I would suggest to post this on other forums (law / Islamic) rather than here. The likelihood you will get a thorough answer is very low here

Thanks for your wishes. Are there any pakistani specific law forums you can recommend?

I can’t say if the alimony would be enforceable in Pakistan, but if you were to return to the US, there would be tax and naturalization consequences for not having paid it. If you are a citizen or a resident, taxation would be an issue even if you did move to Pakistan.

If you have no intention of ever returning to the US, then there is no way the potential alimony that the US courts can give your wife, can be legally enforceable in Pakistan. Don't worry, they are not going to send people after you in Pakistan.

Since it does not sound like a amicable divorce, I would not recommend telling your wife, or the courts that you are going back to Pakistan permanently.
