As the government continues to term the ‘leaked audio clip’ of former chief justice Saqib Nisar allegedly passing instructions to convict former prime minister Nawaz Sharif and his daughter Maryam, opposition quarters, mainly arch-rivals Pakistan Muslim League-Nawaz (PML-N) have demanded a forensic audit of the tape to "ascertain facts" behind it.

On Sunday night, journalist Ahmed Noorani had shared the audio clip claiming that the former CJP had directed his subordinates to send Sharifs to jail “as institutions wanted to bring Imran Khan into power”. Since then, the traditional and social media spaces remained awash with debate over the audio clip.

The journalist had said that a US-based firm has verified that the voice in the leaked audio clip matched with the retired CJP’s. However, the former top judge of the country has declared it “fabricated”.

Complicating the issue further a private news channel has claimed that the alleged remarks had been concocted using chunks of Saqib Nisar's previous statements made on different occasions.

Quoting the latest report, Federal Minister for Industries Hammad Azhar on Tuesday said, "If someone still thinks of the audio clip as not fabricated, then that person should be analysed by a doctor, rather than the analysis of the clip itself."

Meanwhile, Ahmed Noorani, who had released the clip two days ago, has said that "any statement given by anyone in recent times can be matched with the remarks given in the past", hence suggesting that the matching of some chunks of the explosive tape cannot declare it “fabricated”.

He further stated that he didn't hide the audio clip, but released it as per the standard practice, and went on to add that the tape, without further delay, should be checked through a forensic to prove whether it was fabricated.

Supporting the narrative, former prime minister and senior PML-N leader Shahid Khaqan Abbasi said the government should send the audio for forensic, besides "other measures that it may want, but the fact is that the voice in the clip is of the former chief justice".

"No one has so far said that the voice [in the clip] isn't of the former chief justice," Express News quoted Abbasi as saying.

He also said that regardless of who made the clip or why, "Nisar should be called in and asked whether or not he made the said remarks".

According to the veteran politician, it was clear that former prime minister Nawaz Sharif and his daughter were sentenced under a conspiracy.

Nisar, he added, is himself being heard in the clip saying that he had been ordered to send the duo to prison.

"The government's ministers and rented spokespersons will continue to hold pressers on the issue," he said and added, "the PML-N doesn't have anything to do with [former Gilgit-Baltistan chief justice] Rana Shamim's oath or Nisar's audio, we just demand justice.

"We may be punished if we have fabricated the oath or the clip, but if the oath is correct, then Saqib Nisar must be punished, and if it is wrong, then Rana Shamim should be punished, and if the audio clip is fabricated, then Ahmed Noorani should be taken to book," Abbasi concluded.

Commenting on the development, Minister for Information Fawad Chaudhry had said that the leaks and videos start emerging as soon as the hearing of cases against Sharif and Maryam starts in courts. “The nation is still awaiting the ‘receipts’ that the Sharif family had promised to give in their defence when the Panama Papers scandal had emerged.”

As the audio clip mentions the name of the incumbent premier, the information minister said that Sharif family did not give a single piece of evidence in their favour but PM Imran presented 40-year-old receipts pertaining to his properties in London.

Adviser to the PM Shahzad Akbar had also came forward to comment on the controversy, saying “the whole drama” was about hearing of Maryam’s appeal in the Islamabad High Court.

In a message on the social networking site Twitter, the PM’s aide said that everything would have been normal had the court not heard the appeals and the cases were adjourned as per the wishes of the offender.

From day one, he alleged, the Sharif family has been using delaying tactics and did not want real facts of the case to be discussed, adding that the funded agenda to make the constitutional institutions controversial was quite an old tactic of the PML-N.

The audio emerged days after the emergence of an affidavit submitted by the former top judge of the Gilgit Appellate Court, accusing Justice (retd) Nisar of “keeping” former PM Sharif and his daughter in prison till the 2018 general elections.

The Pakistan Democratic Movement (PDM) – an alliance of opposition parties -- on Tuesday decided that it would intensify its anti-government protest movement, particularly over the recent alleged audio leak of former top judge Saqib Nisar, who could be heard in a conversation with an unknown individual about PML-N leaders Nawaz Sharif and Maryam Nawaz's trial.

“The judiciary's integrity has come into question after recent allegations from within,” JUI-F chief Maulana Fazlur Rehman, who also heads the alliance, told the media, while referring to the alleged audio leak and the recent affidavit submitted by former Gilgit-Baltistan chief judge Rana Shamim.

Speaking alongside other PDM leaders after a meeting of the alliance in Islamabad, Fazl said the conspiracies hatched against former premier Nawaz Sharif, his party and the leaders of other political parties were in fact targeting the country and its democracy as well. “We respect the courts, but are also hurt. With a heavy heart, we think that they [judges] will have to regain their status through their character.”

Speaking about the PDM meeting, Fazl said the alliance would hold its next gathering on December 6 where "final and important decisions” would be made.

Leaders of all the constituent parties and their representatives attended the meeting, presided over by the PDM chief. Some leaders participated through video link.

Fazl told the media that unconstitutional laws were passed in the recent joint sitting of parliament and the PDM rejected them.

He claimed that overseas Pakistanis had been given the right to vote in an awkward manner.
“We will play a role in guaranteeing that overseas Pakistanis have an honourable representation in parliament."

The PDM chief also said according to the Constitution, the powers of the Election Commission of Pakistan (ECP) could not be restricted. "It is totally unacceptable to clip the ECP's wings.”

Speaking on the law related to the use of electronic voting machines (EVMs) in the next general elections, he said the PDM rejected “this pre-poll rigging”.

Fazl further maintained that the PTI-led government had turned the State Bank of Pakistan into "branch of the IMF [International Monetary Fund"].

The JUI-F chief also criticised the “fake” government for promising one 10 million jobs to the people, but instead “stealing over five million” from them so far.

On the long march and resignations from assemblies, Fazl said the opposition parties would seek the opinions on the matter from their respective working committees.

“The decisions will be announced on December 6,” he added.
During the meeting, sources said the participants discussed the alleged audio leak in detail and decided there would be no compromise over the matter.

In the audio clip, former CJP Nisar is purportedly telling another person that Nawaz and Maryam would have to be punished to make space for Imran Khan in politics.

The sources said the opposition leaders had decided to raise the issue of the audio leak on a national level.

The former CJP has described the audio clip as “fabricated” and refused to accept that it was his voice.

The sources said that the participants were also unable to agree on the date of the long march and resignations from the assemblies.

They added that the participants had decided to challenge the EVMs and other electoral law passed by the joint sitting in the apex court.

The PDM leadership has also demanded that general elections be held next year.

"Today, an audiotape is under discussion so I thought I should talk about it as well," PM Imran said while addressing participants of the Kamyam Jawan Convention in Islamabad on Wednesday.

"We can see tapes surfacing, with judges being named," he said, adding, "Let me tell you what this is about... they [Sharifs] are resorting to attacks on institutions because they were asked to respond about the sources of their [offshore] wealth."

The premier further said, “When I stepped into politics 25 years ago, I had deemed corruption to be the biggest problem of the country.”

“Nations don’t become poor due to lack of resources; they become poor when prime minister and ministers begin to launder money abroad… They don’t keep it in the country so that they can hide it from the masses.”

In doing so, he said, they inflict double damage to the country.

Referring to the Panama Papers leaks, PM said: “Maryam Nawaz was found to be the owner of four flats in London. “However, she was not able to put forth a single document to prove the money trail.”

This happened, he added, because it was stolen money. After failing to put forth a proof, “they begin to attack the judiciary and the military”.

“They lied about it in the National Assembly, followed by the fake Qatari letter and the Calibri font saga.”

He added, “Now they also deem me to be a tyrant.”

The prime minister said that he also has a flat in London but he provided every proof related to it over a period of 10 months. “I provided 40-year-old contracts related to my flat despite the fact that I was not a public office holder.”

A nation, he went on to say, cannot continue to stand on its feet when its ethical standards are destroyed. “We cannot reach the place where we want to be unless we lift our moral standards.”

He further said, “I have no doubts in the capabilities of the nation and I am certain that we will become a great nation.”

Pakistan Muslim League-Nawaz (PML-N) Vice President Maryam Nawaz on Wednesday confirmed the authenticity of a viral audio clip in which she could be heard issuing instructions to someone to stop advertisements to certain TV channels.

During a press conference earlier in the day, as Maryam took to address the issue of audio clip former chief justice, a reporter asked her if the audio clip doing rounds that contained her voice was authentic.

Ironically, the confirmation about her own audio clip was made in the same breath as her incrimination about the alleged audio clip of former chief justice of Pakistan Mian Saqib Nisar, which the PML-N leader has keenly picked as a new battle line against the ruling Pakistan Tehreek-i-Insaf.

"I am not saying it has been compiled from different [separate] occasions. It is my voice,” Maryam admitted as she maintained that it was an "old" clip from the time she was managing the PML-N's media cell.

However, she refused to shed further light on the matter, downplaying it on the account that it was not the subject of her presser today and added the issue of her audio clip merited another press conference.

“I was running the party’s media cell at that time and it is an old audio clip,” she added.

In the audio that went viral on social media, Maryam can be heard instructing someone that no advertisement will go to certain channels that she named.

However, the issue spiralled into yet another political controversy and gave new intensity to political tussles, serving as a tool for the ruling party to hit back at the rival party for its usage of the CJP’s alleged audio clip as a rallying cry against the legitimacy of Prime Minister Imran Khan’s government.

Giving clarifications for the audio clip, PML-N spokesperson Marriyum Aurangzeb stressed that the PML-N vice president was only talking about party advertisements in the audio clip.

“Decisions related to party advertisements are taken by the party,” she said, urging media not to create an issue out of this.

Aurangzeb said that Maryam bravely admitted the truth regarding the audio clip, as “there is nothing to hide in this”.

“When a person has done nothing wrong, they openly admit it,” she said, adding that people should instead talk about the audio clip that has "triggered inflation, unemployment, etc".

The federal minister said Nawaz Sharif and Maryam Nawaz should present the audio before the court hearing her case.

"If Maryam Nawaz believes she could elicit help from the audio, she should present it before the bench hearing her case," said Fawad Chaudhry on Geo News programme Naya Pakistan on Saturday.

It is the job of the judge who is hearing Maryam Nawaz's case to analyse the audio, in case she takes it to court, said the federal minister.

He also called into question the relevance of the audio. "The audio stands irrelevant as the Panama Papers case was heard by three CJPs, and nearly 16 judges and a trial court," Chaudhry noted.

Given that so many judges heard the case over stages, the surfacing of audio is thoroughly meaningless, he asserted.

"Whatever Maryam Nawaz and Safdar Awan say in this regard is irrelevant. The nation wants to know from where you [Sharif family] got the money for billions of rupees worth of constructions that you are currently living in," he continued. "You may answer this question today, tomorrow or afterwards. But if you fail to provide the details, the NAB court will penalise you for corruption under the NAB ordinance."

The irony, Chaudhry said, is that Nawaz Sharif lives in the apartments, appears from them and gives interviews, but the entire nation wonders if the apartments belong to him or not.

Chaudhry asked why such audios and videos are leaked when a vital case starts. The primary reason for such releases is that they do not want the merit-based verdicts so they get the attention diverted towards leaks, he said, adding that such leaks are let out under a well-planned conspiracy.

Islamabad High Court (IHC) Chief Justice Athar Minallah asked, in the hearing of a petition asking for a Commission of Inquiry to investigate an alleged audio clip of former Chief Justice Saqib Nisar, if the audio is correct, where is the original clip.

Having such an investigation could lead to anyone bringing an audio clip [to court] tomorrow and asking it be investigated, the IHC CJ said.

The petition has been filed in the IHC by Sindh High Court Bar President Salahuddin Ahmed and Syed Hyder Imam Rizvi, a member of the Judicial Commission.

At the start of the hearing, Justice Minallah asked the petitioner to state how the petition is admissible. "Against whom was the writ filed? Your application is related to the audio clip of the present service CJP," he said.

On the judicial inquiry, the petitioner responded that the petition was not about the present CJP but about the audio clip of a former CJP.

We will first issue a pre-admission notice to the attorney-general and talk about whether this application is admissible, the IHC CJ said.

During the case hearing on Monday, Justice Minallah said that the court will not engage in judicial activism and will only consider the facts as they appear in light of the law.

"The court wants to ensure that this does not open new floodgates," he added.

Justice Minullah stated that while the judiciary has faced significant challenges and the Bar has fought for the judiciary's independence, we now live in a society where social media is unregulated, to which the petitioner said that it is painful that the audio was leaked and is being discussed on social media too.

In response to the pre-admission notice, Advocate Salahuddin Ahmed stated that the Pakistan Bar Council has approved a decision, and that if the court finds it necessary, it should also send a notice to the bar council.

To this, Justice Minallah replied that the court respects him for the rule of law, "You are upset with some audio clips. Who has the authority to record Chief Justice Pakistan's audio tapes?" he asked.

"Did they [Bar Council] released it [audio tape] or did a man sitting in the United States?" asked the court.

The court stated that the alleged audiotape is related to a matter that is currently under appeal, and that the parties involved in the audiotape case have shown no interest in bringing it [the case] before the court.

The hearing of the case has been adjourned for a week.

ISLAMABAD: The Islamabad High Court (IHC) in a written order issued on Friday on proceedings related to former chief judge of Gilgit-Baltistan (GB) Rana Mohammad Shamim’s affidavit termed the replies submitted by the alleged contemnors ‘evasive’ and declared that charges would be framed against them on Monday in case they failed to submit the original copy of the affidavit.

The ex-chief judge in his statement had earlier taken the stance that his affidavit might have been ‘leaked’ by the UK’s Notary Public and published by the media. However, the IHC noted that the alleged contemnors had to discharge a heavy onus to satisfy the court about veracity of the published affidavit’s contents that appeared to be ‘false’.

In a written order, IHC Chief Justice Athar Minallah warned that charges would be framed if the maker of the affidavit, Mr Shamim, the publisher and editor in chief of Jang Group Mir Shakeelur Rehman, senior journalist Ansar Abbasi and resident editor Amer Ghouri failed to show it was executed and published for bona fide purpose.

Justice Minallah issued the order after going through the reply submitted by Mr Shamim in which he explained reasons for executing the statement on oath that former Chief Justice of Pakistan (CJP) Saqib Nisar had made a call to an IHC judge and asked him not to release former premier Nawaz Sharif and his daughter Maryam Nawaz before the 2018 general election.

“Perusal of the written reply submitted by Rana Mohammad Shamim shows that he has unequivocally taken the stance that he had neither circulated the affidavit to the press nor ‘shared it with anyone’. He has further stated that ‘I made the statement before the Notary Public at London and while placing the same in a sealed envelope, handed it over to my grandson with a clear instruction that neither he would open it nor share the same with anyone’. It has been stated that the copy of the statement was retained by the Notary Public in London for record,” Justice Minallah noted.

“It, prima-facie, appears that Rana Mohammad Shamim has suggested that the affidavit may have been leaked, without his consent, by the Notary Public who had notarized his affidavit in London. He has also unambiguously alleged that his affidavit was used for publication by the alleged contemnors, Ansar Abbasi, Aamir Ghouri and Mir Shakeel ur Rehman without his express or tacit consent/approval. If so, then this could have serious consequences for the Notary Public in London as well as the alleged contemnors who appear to have published the contents of the affidavit in haste with the intent to disseminating it widely amongst public at large,” the court order stated.

‘Judge named in affidavit was on leave’

Regarding Mr Shamim’s assertions that he had overheard a phone conservation of ex-CJP Nisar with the IHC judge on July 15, 2018, Justice Minallah observed: “The judge named in the copy of the affidavit attached with the reply was availing sanctioned ex-Pakistan leave and was out of the country on July 15, 2018.”

According to the IHC order, the timing of news report publication was “crucial” as it related to the appeals fixed for hearing. “It also raises questions regarding the professional conduct of the reporter, editor and publisher of the widely circulated newspaper,” the order stated.

Subsequently, the court held “it has become crucial for the alleged contemnor, Rana Mohammad Shamim, to produce the original affidavit before the court. Likewise, the veracity of the contents of the affidavit published in the newspaper is questionable and the facts narrated therein do not appear to be probable even to an ordinary person of prudent mind. There are, prima-facie, reasonable grounds to believe that the contents of the affidavit are false and its execution was not for a bona fide purpose.”

The court stated that the alleged contemnors “have to discharge a heavy onus to satisfy the court regarding bonafides of executing the affidavit in London and its publication without verification of the essential facts. The contents cast unfounded aspersions on the integrity, independence and impartiality of this court and its judges besides prejudicing the right of fair trial of the parties in the pending appeals and tends to interfere with the administration of justice.”

Justice Minallah termed the replies submitted by the alleged contemnors “evasive” and, prima-facie, unsatisfactory. The IHC warned Mr Shamim to submit original copy of the affidavit or else charges would be framed on December 13.

ISLAMABAD: The ongoing controversy regarding the leaked audio clip, allegedly featuring the voice of former chief justice of Pakistan Saqib Nisar, took a new turn after a private channel got a forensic analysis of the controversial clip done by an American company. As per the US company's findings, the clip was doctored and made up of multiple clips.

An audio clip allegedly featuring former CJP Nisar's voice had surfaced last month, in which he purportedly told another person that former prime minister Nawaz Sharif and his daughter, PML-N leader Maryam Nawaz, would have to be punished to make space for [Prime Minister] Imran Khan in politics.

Nisar, however, had refused to accept that it was his voice and termed it fabricated. "The audio clip is being falsely associated with me," he had stated.

The forensic report issued by US company Primeau Forensics stated that changes in the tone of the person speaking in the audio clip in question were observed multiple times.

According to the report, the person can be heard speaking from a distance in the first 25 seconds of the clip, while in the last 20 seconds, he is speaking from near the recording device, which shows that some of the 45-second clip was recorded in one place and the other at a different place.

The report further stated that Primeau Forensics holds 30 years of experience in forensic analyses of audio clips and videos and has conducted forensic investigations of 5,000 videos, audio clips, and pictures. It has provided expert opinion to local, governmental, and federal courts in 500 cases and American TV channels, Associated Press, and other big agencies are among its clients.

When asked about senior journalist Ahmed Noorani's news report, which claimed the audio clip is not fabricated, the forensics company stated that the clip comprises bits taken from more than a single source, recorded in two different environments.

Speaking about the development to a private TV channel, former top judge Nisar said: "Thanks to the Almighty that the truth has been revealed today."

'Propaganda continues'

Meanwhile, Noorani has said that the "propaganda in Pakistan continues" as the news channels who had "refuted" his news story in the first place are continuing to do it.

"My story on Saqib Nisar audio was based on a forensic analysis conducted by a credible US firm. The forensic firm was threatened by thousands of people from Pakistan to change the report but they always confirmed that they worked with Fact Focus," Noorani tweeted.

No one ever tried to contact him to get the audio clip he had with him, Noorani lamented.

Noorani went on to say that he is all geared up to issue the Pakistani news channels a legal notice for "spreading lies" if they run a news story against him or his story in the United Kingdom or the US.

'Continuity of forgery by PML-N'

Adviser to the Prime Minister on Accountability and Interior Mirza Shahzad Akbar, meanwhile, said while speaking to APP that a reputed forensic audit company had confirmed that the audio leak of former CJP Justice Saqib Nisar was made up of multiple audio clips, which is a continuity of forgery by the PML-N and its attack on different institutions.

He said that a private TV channel has conducted good investigative journalism.

The adviser said the PML-N attempted to take advantage of the Calibri font, audio leak, and affidavit of former chief judge of Gilgit-Baltistan Rana Shamim. "They [PML-N] do not answer to the basic query and attempt for forgery and falsification," he added.

"Maryam Nawaz calls for her acquittal on the basis of this audio clip but they don't present anything [evidence] before the court because they understand that they will get punishment if they did so in the same way they presented the [documents written in] Calibri font," he said.

WASHINGTON: Primeau Forensics, a US forensic audit company, confirmed on Wednesday it had inspected an audiotape forwarded by a Pakistani television channel, but said it could not share details of its report with the media.

“It was a specific thing that we did for our client and we are not discussing it with anyone,” a company representative told Dawn. “We have no press release.”

He said the client, ARY News, had the report and “only they can share the details with others”.

A report released in Islamabad claimed that ARY News had asked Primeau Forensics to do a forensic analysis of an audio leak of the former chief justice of Pakistan Saqib Nisar.

In this audio, two persons can be heard discussing cases against PML-N leader Nawaz Sharif and his daughter Maryam Nawaz. Reports in the Pakistani media claimed that one of the persons was Mr Nisar, the former chief justice.

Refuses to divulge details of its report

According to ARY News, the audit of this 45-second file showed two “reverberences” in the voice as the person spoke from two different locations. The voice was clearer during the last 20 seconds as it came from a closer range.

ARY News claimed that when it asked Primeau Forensics if the recording was of the original conversation or came from an edited tape, the company said the two parts of 20 and 25 seconds each were recorded in a different environment.

The company told ARY News that it believed “the unknown Fact Focus clip was generated from at least two different sources”.

They observed “two different reverberences, indicating that the first portion of the audio was likely recorded in a different environment than the second portion”.

Primeau Forensics is based in Rochester Hills, Michigan. A post on its website says that its experts have processed over 5,000 audio, video and image forensic investigations and provided expert testimony in over 500 cases in local, state and federal courts.

It claims to have 30 years of experience in this field, working for attorney generals of multiple US States, CNN, AP and other major organisations. ARY News claimed that it had paid Rs1 million for the audit.

In the un-dated leaked clip, the PML-N leaders are purportedly discussing a current affairs show, over its alleged “bias” against the PML-N government. The audio was run by two local tv channels.

In the clip, Rashid can be allegedly heard saying that Hasan Nisar is part of the show “who abuses us a lot”. Maryam allegedly interjects, saying now journalist Irshad Bhatti is also added to the programme. Bhatti also uses “vulgar language”, Rashid allegedly adds.

Rashid also mentions Babar Sattar, who used to be a part of the TV show before his appointment to high court as a judge, calling him an independent journalist.

As per the clip, the authenticity of which could not be verified at this point, the PML-N leaders also mention journalist Mazhar Abbas. Rashid purportedly says that Mazhar is “tilted against us” and sometimes spins things to ridicule the PML-N.

"Nobody there can be called our spokesperson,” Rashid allegedly adds. [Analyst Hafeezullah Niazi] did not propagate our narrative but the way they abuse us [PML-N] ... he would treat Imran Khan the same way,” the clip adds.

Almost a month after this scribe cited exclusive evidence and reported that former Gilgit-Baltistan chief justice Rana Shamim took the oath and signed an affidavit in the office of none other than Nawaz Sharif, audio evidence came to the fore on Wednesday, confirming the veracity of the evidence finally.

The recordings have been forensically analysed by audio experts who found no evidence of tampering or manipulation, thus substantiating the evidence cited by the report.

A story published in The Express Tribune on Dec 26 had cited unspecified evidence and quoted Charles D. Guthrie — the London-based solicitor who had notarised Shamim's affidavit — as saying that the document was notarised at an office in Stanhope Place in Marble Arch, London.

The report had sparked hue and cry as well as suspicions over the credibility of the said evidence, which had been by then still under the wraps and withheld by the scribe.

Now, in light of the above, a detailed forensic analysis of the audio evidence is being released, extracts of which are available on the “Irfan Hashmi Official” YouTube channel.

The audio evidence has been forensically analysed by Joseph Naghdi, UK’s top forensic expert, who declared it to be “genuine, unadulterated, wholesome, and unedited.”

“I, Joseph Naghdi, confirm that the audio recording “Voice 001.m4a' is genuine, unadulterated, wholesome, and unedited. The examined audio waveform does not indicate any tampering or edit in its audio stream,” confirmed Mr Naghdi.

A thorough comparative inspection was carried out on two different samples to ascertain whether the waveform patterns matched.

The comparison showed that both voices, taken from two different sources, do match and belong to the same person who is identified as Charles Guthrie of ‘Charles Guthrie & Co Legal Ltd’, Golden Cross House, 8 Duncannon Street, London, WC2N 4JF, UK.

Contrary to the norm in Pakistani media where mudslinging is never backed by any credible evidence, the evidence cited by this scribe had been sent to a top forensic lab in the UK and had been analysed for its credibility before being published.

TV appearance helped in authenticating evidence

The forensic inspection further proves that the audio conversation did in fact take between Mr Guthrie and the reporter himself. The voice analysis has been done by placing it in comparison with the audio of a much-cited video interview on a TV channel that Mr Guthrie gave publicly.

The interview served for the forensic investigation as a much-needed audio comparison, which was previously difficult. It is pertinent to note that the evidence was secured before Charles Guthrie gave the interview, which is also available on YouTube and other social media platforms.

Saqib Nisar’s forensically controversial audio

Two different companies gave different versions of the controversial leaked audio allegedly belonging to Justice (r) Saqib Nisar. One of the companies had declared it a fake. On the contrary, the audio of Mr Charles Guthrie has been certified by UK’s top forensic firm.

As a computer forensic investigator, expert witness (civil and criminal), Mr Naghdi has extensive experience in capturing, analyzing examining electronically stored information and reporting on it by making use of the current and technologically advanced hardware/software tools.

The forensic expert has been also assisting law firms, police forces, government agencies, local councils, fraud investigators, insurance companies, private individuals and financial institutions with digital forensic investigations since 2007. Joseph also worked with BBC World Service in 1996 as a Producer.

Guthrie on the spot: “No comments”

Meanwhile, ever since these revelations came to light, Mr Guthrie has switched off his phone and has declined to offer any comment. In fact, when he was asked in a different interview about the place Shamim signed the affidavit at, Mr Guthrie responded: “No comments”.

The scribe also notes that Mr Guthrie volunteered this information.

Five excerpts from the audio made public

In the five audio clips, Charles Guthrie can be heard confirming that Rana Shamim was indeed present at Marble Arch.

Mr Guthrie confirmed his information three times.

“The judge guy was in Nawaz Sharif’s office.” When asked in the audio “That was which office? Like here in London?”, Guthrie responds “Marble Arch.”

In the audio clip, Guthrie was further asked: “He was in Nawaz Sharif’s office? They were like quite cozy when they were in there?”

To that, the notary replied “Very… yeah.”

In the audio, Charles Guthrie also said: “That is one of his mates you know what I mean. When Nawaz Sharif was Prime Minister “I will make you the head judge in Pakistan and that type of thing.” And if you've been the head judge, ruled over 10 to 15 years, so he was one of his friends”

Another startling revelation that the Notary made was that he has never read the documents.

These disclosures and evidence raise several questions: 1) Was Rana Shamim was under duress? 2) Who invited Rana Shamim to visit London? 3) Where did he stay in London? 4) Who sponsored his visit? 5) Can Rana Shamim produce hotel receipts that he paid for from his pocket? 6) Who received him from the airport? 7) Who introduced him to Charles Guthrie? 8) Who leaked the affidavit as denied by Charles Guthrie?

Complete silence in the Sharif house

Ever since the evidence against Rana Shamim’s affidavit was published, there has been no rebuttal or denial from either member of the PML-N or from Charles Guthrie himself.

Several attempts have been made to contact both parties for a comment which have gone unanswered.

Nasir Butt, a close aide of PML-N supremo, refrained from making any comment on it by saying: “Hamein Mana Kiya Gaya Hai (We have been forbidden to speak with you). He was approached outside Hassan Nawaz’s office for comment from Nawaz Sharif.

Former chief justice of Pakistan Mian Saqib Nisar on Tuesday issued a rebuttal, saying that the latest audio clip — purportedly of a conversation between him and PTI legal adviser Khawaja Tariq Rahim regarding a high-profile case currently being heard by the Supreme Court — was a “theft” as he questioned its authenticity.

Speaking to Dawn.com, Nisar termed the audio clip a violation of his right to privacy, adding: “This is a theft of my fundamental rights.”

“I am a citizen of Pakistan, an ex-CJP and I give free advice to those in office. Khawaja Tariq Rahim is a friend and I gave him advice,” he said and went on to question the authenticity of the leaked clip.

In the audio clip, which has not been independently verified by Dawn.com, a voice, allegedly of the former chief justice, could be heard giving the reference of a 2010 SC judgement to PTI’s Rahim.


“Please look into that … it is a seven-member judgment […] this is suo motu number 4 of 2010, sir […] seven-member judgement, 2012, has been reported on page number 553 of the Supreme Court,” Nisar purportedly says.

Here, the man on the other end of the call, believed to be Rahim, replies in the affirmative. “Whoever is your lawyer, tell him to check it out. It states that if … never mind, you’ll know when you will read it,” the ex-CJP allegedly says.

In response, the PTI lawyer purportedly says: “I will read. I have seen the seven-member bench judgment. They have stated in it that until the act is not formulated… if you read it carefully, clause three has it…”

At that, the man believed to be Nisar replies “yes I have seen that, it is the way out for you”.

He allegedly goes on: “And secondly Tariq sahab, if any person of yours is ready, you can use the Munir Ahmed Khan [judgment] which is a clear case of contempt of court.”

“That too … that too,” Rahim apparently replies after which the ex-CJP purportedly says “after what happened in Azad Jammu and Kashmir, I don’t think there is any…”

Interjecting the man believed to be Nisar, the person on the other end says that “we are only waiting for the three-member bench’s verdict … it can take another half an hour … after that, we are filing a contempt application”.

The audio leak comes days before an SC bench — comprising Chief Justice of Pakistan Umar Ata Bandial, Justice Ijazul Ahsan and Justice Munib Akhtar — is set to resume hearing a case pertaining to elections in Khyber Pakhtunkhwa and Punjab.

Earlier this month, the top court — while hearing a PTI petition — had directed the Election Commission of Pakistan (ECP) to hold general elections to the Punjab Assembly on May 14. However, the government had rejected the apex court’s orders.

After repeated back and forth, the Supreme Court last week afforded a temporary respite to the country’s main political parties, giving them a week to develop a consensus on the date for elections to the provincial and national assemblies, so they could be held simultaneously across the country. It is expected to resume the hearing on April 27.

The latest audio is the second clip to surface in the past few days. On Sunday, an audio purportedly featuring a conversation between two women — one of whom was said to be the mother-in-law of a top-ranking serving judge of the SC, while the other was the spouse of PTI’s Rahim — started doing the rounds on social media. The two women could also be heard discussing the case linked to KP and Punjab polls.

PML-N calls for transparency
In a press conference immediately after the audio leak surfaced, Law Minister Azam Nazeer Tarar called the clip “unfortunate”, saying that Nisar should be more careful because of the “perception of the people” about him.

“This conversation clearly shows that he is guiding regarding what needs to be done. He can be heard giving references of judgments,” he stated. “This is a very difficult situation.”

Tarar went on to say that transparency was important to ensure that the Constitution and law were upheld in the country. “People should be able to trust institutions, especially the judiciary … and this can only happen when there is transparency.”

In a tweet, Defence Minister Khawaja Asif said that he was disappointed to hear the audio, claiming that Nisar had moved way too far in his revenge against PML-N supremo Nawaz Sharif.

“You took revenge on Nawaz Sharif and sentenced him. How long will you continue to feed on this poison?” he added.

The PML-N — especially its chief organiser Maryam Nawaz — has time and again blamed Nisar for disqualifying the party’s Quaid Nawaz Sharif as prime minister in 2017 in the Panama Papers case.

Minister for Planning Ahsan Iqbal said that the “mastermind of the 2017 regime change and judicial martial law conspiracy still conducting the orchestra”.

On the other hand, PML-N leader Malik Ahmed Khan said that a suo motu notice should be taken on the recent audio leaks.

Audio leaks
Of late, a slew of audio leaks featuring key government and opposition figures — including Prime Minister Shehbaz Sharif, PTI Chairman Imran Khan, PML-N Vice President Maryam Nawaz, and others — have surfaced on social media.

The clips, seemingly featuring informal conversations, had raised serious concerns regarding the security of government offices — particularly the Prime Minister’s Office.

PM Shehbaz had termed the surfacing of audio leaks a “very serious lapse” and announced that a high-level committee would be constituted to probe the matter.

On the other hand, the PTI had filed a petition in the SC seeking a probe into the audios. Former premier Imran Khan had also written a letter to Chief Justice of Pakistan Umar Ata Bandial and other SC judges, and sought “enforcement” of the fundamental rights of the public, including the Constitution’s Article 14 (fundamental right to privacy).

Interior Minister Rana Sanaullah Khan said on Tuesday the entire country was facing a chaos-like situation due to a case in the apex court about the Punjab elections date.

He said a forensic audit of a recently leaked audio conversation between two women should be carried out to clear the situation.

Addressing PML-N workers at Chardaywalla village here, he said some people were claiming that the purported conversation was a private discussion between two housewives.

"How come it could be called private talk if the women were discussing most sensitive and important issue of the country?" the minister asked.

He said one woman in the leaked audio was clearly supporting a political party and urging the superior court judges to announce a favourable verdict. Therefore, it could not be called a private and personal conversation, he added.

Sanaullah rejected the allegations that the PML-N was trying to avoid elections, adding that it was only propaganda by the opponents.

"We are fully prepared to participate in elections, but our demand is that the electoral process for all assemblies must be held simultaneously for economic stability in the country."

In the audio clip, Najam Saqib can be allegedly heard discussing about his cut with a ticket-holder, Abuzar Chadar.

During the conversation, Abuzar greets Najam and praises his efforts. Upon Najam's response, Abuzar says that his efforts have borne fruit.

Najam: I have received the information.

Abuzar: Okay, sir.

Najam: Yes, tell me, what needs to be done now?

Abuzar: We are currently printing the tickets. Once they are printed, please do not delay in distributing them. Time is very limited.

Najam: Okay, just come to meet baba (father ex-CJP Nisar) to thank him. Nothing else (needed).

Najam: He'll come to the office by 11 o'clock. Just come and hug him. He's worked very hard.

In light of an audio leak pertaining to the distribution of PTI tickets wherein the son of a former chief justice of Pakistan was also featured, the National Assembly speaker on Wednesday formed a ten-member parliamentary team to investigate the leaked clip.

Separately, a reference has also been filed before the Election Commission of Pakistan (ECP), seeking action against PTI chief Imran Khan and ex-CJP Saqib Nisar for their alleged involvement in corrupt practices.

The parliamentary panel was formed after lawmakers sought action against individuals who had been “facilitating” PTI chief Imran Khan.

“National Assembly Speaker Raja Pervaiz Ashraf has been pleased to appoint a special committee to audit, inquire and investigate the audio leaks of Mr Najam Saqib s/o Mr Saqib Nisar, ex-Chief Justice of Pakistan with [a] PTI ticket holder,” said a notification issued on Wednesday.

A day after the arrest of former prime minister Imran Khan, audio leaks surfaced on social media on Wednesday, indicating that the leadership of the Pakistan Tehreek-e-Insaf (PTI) was allegedly involved in the attack on the residence of Lahore Corps Commander, Express News reported.

The purported audio clips reveal that PTI leaders had urged party workers to gather at the Jinnah House and they "rejoiced" about the damage caused during telephone calls.

"We have destroyed the entire Corp Commander House and ended their story," Ali Chaudhry could be allegedly heard telling Ejaz Chaudhry in one of the audio recordings.

In an appalling incident of vandalism nev*er witnessed before in the country’s political history, the historic corps commander’s house in Lahore which also served as res*idence of the founding father of the nation Quaid-e-Azam Muhammad Ali Jinnah, was attacked by PTI supporters on Tuesday hours after Imran Khan’s arrest by the Rangers personnel in Islamabad.

Later, all roads leading to the Corps Commander House, Assembly and sensitive areas were closed.

Due to the unprecedented situation, the interim provincial governments requisitioned army troops to maintain law and order in Punjab and Khyber-Pakhtunkhwa (K-P).

At least five protesters have been reported dead as the protests turned violent, with several others injured. At least three policemen were also seriously injured in clashes with PTI supporters in Peshawar.

Officials at Edhi Foundation reported two deaths in Lahore while another three were reported in Peshawar.

Attack on Radio Pakistan

According to Director General Radio Pakistan, Tahir Hassan, hundreds of 'miscreants' suddenly stormed the national broadcaster's building in Peshawar.

The enraged crowd wreaked havoc in the newsroom and various sections of the building.

He added that 'miscreants' had attacked Radio Pakistan yesterday as well.

In today's attack, the protesters vandalised the building, tortured the staff including women and engaged in arson, the DG said. They set fire to Chagai Yadgar and Radio Auditorium.

Hassan also said that records and other materials were destroyed by arson in various sections of the Radio Pakistan building.

"Vehicles parked in the building of Radio Pakistan were also set on fire," he said.
