That is good but that will only happen when a rapist is convicted. Due to our abysmal police and corrupt judicial system, the majority of rape cases cannot be proved or the perpetrators bribe off corrupt police officers or judges to get off the hook. Pakistan has a rape conviction rate of a mere 3%.

We need to fix our police and judiciary first.
 
Studies have shown capital punishment doesn't stop crime and sometimes has the opposite effect. It leads to what's essentially suicide by homicide (i.e. committing a crime to die).

There's also additional concerns such as punishing the wrong person (very common in places like Pakistan), dehumanizing all criminals (including those serving small sentences causing more criminal activity when they return), and changing your society's tolerance towards violent retribution.

Giving a mediocre legal system such as Pakistan's an option such as this is asking for trouble. This is the same system that can't handle the blasphemy law without getting itself twisted into knots.

Also take in consideration the rape laws in Pakistan. Very hard to get a rape conviction. Would you change hudood laws?

Awful law. I think Musharraf removed it though. However if its still an active law then it needs to go.

Society also needs to set good example of itself as well. There is a reason, as we are getting more aware, we do away with torturious public punishments. You have to focus on bigger picture, take this opportunity to fix the underline cultural and social issues... Violence is not solution to any problem, you don't want to make masses immune to violence. Blasphemy laws and extreme stands by govt/constitutions on religious matters is an example, it has increased violence an encourage mop lynching. Did it solved any problem? - Now Shias are next in line for percussion.

Women empowerment is key not dog and pony show of mass public hanging. You need to take 8/10 years old kids off the street, not just focus on criminals. Women empowerment automatically take cares of population control and brings more prosperity in the society and equality, its win win situation. You have to focus on finding long term cure for Cancer, not on next organ that has failed.

Again these are not sexy measures, but at some point you have to invest and plan for long term, this T20 mentality does not pay off in real work. Real world is like test cricket, where hard work pays off not just talent.

This law is the need of the hour. Exemption should be made for spousal rape which should be tried under domestic abuse laws.

None sense, firstly am certain you'd have a different view if you or your family were on the receiving end quiet literally. And secondly, the 'make them face and accept their deed' and 'until they are not a danger to anyone else' sounds like something out of a bloody fairy tale! I think both of you must be sharing a Disney+ account to presume that these offenders are transformed meticulously as human beings the moment they enter and come out the other side as good little birdies, on a personal note you would know how difficult it can be to adapt or change who you are, there are tweaks we can make along the way but in the end it is all dependent on the type of person we are, I feel that is is extremely dangerous to trust authorities who are responsible for ensuring the criminal feel remorse and importantly, get rid of the poison in their mind.

The only argument which I can somewhat see is miscarriage of justice, however this is why I'd like for a process which would remove any doubt in this regard prior to the death penalty being carried out; if the law is strong and the corruption minimal, then I see no reason why those responsible should pay for what they did permanently.

The British prison system can be redemptive. Some released offenders do not reoffend, including some paedophiles. That’s not Disney, that’s fact.

If there really was a way to say hit it where it hurts the most chemical castration is the way followed by hanging. These rapists and pedophiles need to be genuinely afraid for them to stop this. I personally think there is no way back for the rapist tbh. He destroys a life and the people around them and it pretty much impacts an entire generation.

It was banned as recently as 2013 in india, and separate law for sexually assaulting children was passed in 2012. so called democracy with so called great leaders like nehru and gandhis never thought about such an obvious thing.

Mostly what sounds good in books. And not that it’s wrong and should not be pursued but it alone doesn’t work to address this particular issue in a specific social environment in a particular part of the world. What you stated; however, is part of the solution.

In reality, in the first world countries, this has been done but rape and pedophilia is still rampant.

The monster knows that he will be out of prison in as a little as 6 months after being provided with three hot meals a day, laundry services, gym, internet, library, shower facilities, hair cut, medical care, and security. And all that at the expense of tax payer’s money. And incidentally, one of that tax payer could be a woman who was a raped or a parent of the kid who was molested. What an irony!

May be you are OK with it but I don’t want my tax money to be used to provide all these facilities to a sick monster and who will continue to live among our neighborhoods in the near future. I would rather see a 50 cents bullet in the back of his head after proven guilty based on DNA or other undeniable evidence in a fair trial.


Human psychology is different when you deal with it at an INDIVIDUAL level vs when you deal with it in MASSES.

And when you deal with it in masses then always remember, DETERRENCE is one of the most effective ways. It works!

We need a combo of reducing corruption and enforcement of strict laws to curb this particular, and many other social ills in a third world country where resources are very limited, and there is a dire need to put out this fire.
The “long term unsexy measures” are welcome as a side kick but they serve a different purpose and play a great role in advancement and development of a society; however, human nature on a collective basis, does not change.

So along with these unsexy long term measures, a great reduction in corruption and introduction of strict laws is a must to provide a safe and healthy environment to our kids and women to grow.

T20 is the best way to deal with these sick monsters together with long term unsexy measures if your REALLY want to provide a TRULY safe and healthy environment to our kids n women.

That law can be supported by DNA based evidence. It should help to crack the case and render the justice.

Prolonged sentencing costs money. Death sentence seems like an appropriate punishment.

Remember, this monster has ruined a woman's life. So, it is logical that his life gets ruined also.

I think death sentences costs far more money because of the fanfare and security costs involve in it. Plus, they also have the risks of on the spot violence. Not to forget the legal costs of petitions and appeals run i the courts that would ultimately end up creating backlogs.

IMO, this route does NOT provide justice to the victim and/or his loved ones.
May be your case is different but many people won't like the sick monster being "rehabbed" after he has raped their kid or daughter. And rightly so. Such human emotions are normal and just.

You may be different. God forbids if your child gets victim of such a crime, you may be ready to send the rapist or murder to rehab - but not everyone should follow what suits your mindset in this case.

If someone has stolen something, or scammed money, or has taken a bribe etc then yes, it's a different case. They can be rehabbed. But if a sick monster has raped and killed a child then no, it's an altogether different story. The victims need justice. THEY should have the say whether they want the monster to be rehabbed (like you may want) or brought under the weight of law (which should be capital punishment) that other people may seek.
This is the right way to render the justice to both parties, IMO.

In that case, process needs to be shorter.

If this monster is found guilty, get a rope and hang him. No need for anything more once guilt is established beyond any doubt.

Rehabilitative justice is not fair towards the victims in cases of child rape and murder.

May be you are OK to send the monster into a prolonged sentencing and continuous vigilance and Rehab route but not everyone should be forced to follow this.

Personally, I don't want my tax dollars to be used to provide three hot meals a day, temp controlled room, shower facilities, internet, gym, library, health care and security to a sick monster who has raped or murdered mine or someone else's child. May be you are OK with it if that happens to you? If yes, good for you.

Notice that in recent decades when population growth has been explosive, new cities are built, new hospitals are built, new business are build, expansion everywhere - but one thing that does not get build is the NEW PRISON FACILITIES.

Show me, how many new prison facilities are built in your city or country in regards to the population growth? The answer will most likely be ZERO or a very low number!

The reason? There is an astronomical cost to run the prisons and no monetary return on the investment. In NYC, it costs $140,000 a year to house JUST ONE inmate.

We live in a capitalistic driven economy. Every single govt in the entire world is short on funds to run the existing prison facilities. Jails are crammed. Tax money collected from the hard working citizens is not enough to run the prisons so the jail term punishments are getting shorter and shorter.
Many rapists and pedophiles are out, in as little as six months. Many pedophiles in New Zealand were given a 6 months "house arrest" sentence. The underlying reason? simply because there isn't enough funds to run the prisons and house an over grown population of criminals.

When population grows, it does not have ONLY law abiding citizens. It will also have criminals too. This is part of human societies.
And there isn't enough tax money collected to make the ends meet.

It's not fair to actually punish the hard working tax payer and reward the convicted rapists and murders.

Much of the world is more enlightened now. Consider the Scandinavian countries which put much effort into education and citizenship, where there is very low crime, and where offenders are treated humanely and rehabilitated.

Why more danda is default answer for Pakistanis?? - You need to build culture of self respect and dignity. You don’t need to lower your self to the level of criminals. Rest of the world has moved away from violent punishments as a means of deterrence. This has many benefits, you want to build a modern society not a midevil one.

Even the rest of the world dealt out medieval punishments when they still lived in a medieval environment. First Pakistanis must relearn that they are collectively responsible when law and order goes out of the window, on this I am in full agreement with IK.

When Pakistan can show they have reached the maturity and sense of law and order as we have in the west, then we can start applying more humane standards over there. They must go through the same process we British did, and believe me, some of our punishments from a century ago would make hanging look merciful.

It won't change Pakistan into becoming a Sweden overnight if we take the route of "Rehab justice", ESPECIALLY with rapists and pedophiles.

Many first world countries have tried this and it didn't seem to work - including the Great Britain, and United States.

If you look at the rape statistics and registered sexual offenders in United States - even THAT ^^^ route didn't seem to work.

Here is a tiny example.
This is a 12 mile radius of a small City in United States that pin points the location of registered pedophiles and sex offenders.
Tell me, how did the "humane treatment" actually work?

Almost every single city in the USA presents this kind of picture.

in 80s three men raped and killed a young boy in Lahore. As per news the culprits were caught and hanged in front of thousands of people at jail road Lahore. There was some drop in those kind of crimes after that.

I don't want my tax dollars spent on his rehab. You can give your life earnings in donations to rehab such sickos, and I don't have an issue with it.

This is a great documentary on the Norweign prison system. In it they also interview parents or loved ones who lost someone due to Anders Breiviks mass murderous actions. This gentleman ( who lost soneome) gives the most moving and thoughtful argument against death penalty for this mass murderer. Well, good for that gentleman but not everyone will probably forgive.

You have to understand and respect that.

Not all crimes can be forgiven. Rape is one of those crimes. It can ruin a person psychologically. There has to be some consequences.

You’re putting the cart before the horse. You seem to suggest that rehabilitation doesn’t work because there are a lot of registered sex offenders in this area. What the map doesn’t show is how many of these offenders don’t reoffend.

Practically everyone in the US has sex before the age of 18 anyway, so the law says they are all sex offenders. You’d be executing nearly every American.

ISLAMABAD: The federal cabinet on Tuesday endorsed Prime Minister Imran Khan’s view about public hanging of rapists and vowed that the government would not accept any pressure from the West.

“If Islam guides us to give punishment to rapists publicly then there must be some wisdom in it,” Infor*mation Minister Shibli Faraz said at a post-cabinet meeting press conference in response to a question about the recent horrible incident of rape of a woman on the motorway near Lahore.

The cabinet meeting was presided over by Prime Minister Khan.

“The prime minister firmly believes in Islamic laws and Sunnah of Holy Prophet (peace be upon him),” Mr Faraz said.

The minister said the government would not accept any pressure from the international community and would make legislation regarding public hanging of rapists and chemical and physical castration of habitual sex abusers. “We will not tolerate any pressure from the west, east, north and south,” he declared.

“Rapists must be hanged publicly so that they become an example for others,” the minister said, adding that exemplary punishment should be awarded to the culprits of the motorway incident.

In an interview with a private TV channel on Monday, Prime Minister Khan had called for public hanging of rapists and said that habitual sex offenders should be physically or chemically castrated so that they could not commit such crimes in future. However, he said, hanging of a rapist publicly might be opposed internationally as many countries carried out castration of sex abusers.

I have noticed that the more I forgive and the less anger I hold onto, the happier my life becomes. Clearly the Norwegian gentleman agrees.

This works for you fair enough. For others, they may get healed and get closure when there is retribution. Anyway you don't have skin in the game here so easy to signal your virtues.

Human psychology when you deal with masses.

And DETERRENCE is the key word here. It has ALWAYS worked when you deal with human psychology in masses. I gave the examples of Stop Sign and paying Taxes.

Now ask yourself, what would this map look like if there was death penalty in place for sex offenders and child rapes and pedophiles? IMO, it would look A LOT less dense.

I do not throw away your idea of rehab for convicted criminals BUT Rape, murder and pedophilia should NOT automatically qualify for rehab justice. These three are special cases and must be dealt with accordingly.

For other petty crimes? be my guest and rehab them, and I don't have an issue.
We need clean and safe environment. By looking at that map, not many decent families would like to raise their family with small kids in such an area.

Is there any point Rob? We're not budging on our opinions and just end up going round in circles.

You are more forgiving and believe criminals deserve a second chance. I am not. Some crimes are too horrific so I don't believe criminal should be with us any longer.

Mr Khan said the legislation being prepared would not only provide for exemplary punishment for rape and child abuse offences but would also contain provisions for registration of sex offenders and effective policing. He admitted that only a very small percentage of such cases were reported to police in the country. Even after the arrest of offenders in rape and child abuse cases, their conviction was not easy in absence of proper prosecution and concrete evidence, he pointed out. For this reason, he said, the bill being prepared would also provide for witness protection.

According to a report, Mr Khan said, 10 billion dollars were laundered from Pakistan each year. He said Hyde Park-1 was one of the most expensive properties in London. However, he said, former president Asif Zardari had a property in New York in his name and a case in this regard was in process.

“The opposition’s attitude on FATF legislation has confirmed my views about their leadership. The interests of their leaders and Pakistan are in contrast with each other,” he remarked.

He is correct, anybody who exhibits genuine remorse for his crimes should be a given a second chance at life, even a heinous crime like rape and murder. Compassion is the bedrock of humanity otherwise we are just animals.

For rape I would advocate a 10 yr term in prison and then he be released. Castration is nonsense.

I wonder if you will say the same thing if (God forbids) your loved one gets harmed like this.

Unless victim and her family forgive the rapist, rapist should pay a heavy price. That's just fair and logical.

By skin in the game, I meant you are not a pakistani, and what pakistanis decide for themselves doesn't affect you.

You do accept that others may get closure when there is revenge and retribution and that is as valid as your way of forgiving and moving on.
 
The British prison system can be redemptive. Some released offenders do not reoffend, including some paedophiles. That’s not Disney, that’s fact.

No it can't for crimes like these am afraid, you can't simply guarantee that these people will be reformed / have different wiring when they come out.

Well, in that case every offender of every type has to be jailed for life. Caught with a quarter ounce of cannabis? Whole-life tariff. You can’t guarantee that such a person won’t just buy more illegal drugs. Got into a bar fight? Whole life tariff. People can’t change after all.

No what I am saying is that Pakistan needs to be allowed to evolve at it's own pace same as Britain did. That won't take centuries obviously, as the world is interconnected now, and all countries can learn from each other and adopt codes and values which they feel improve on their own.

Let me make it a little simpler for you with an analogy. As an Indian you will have heard of the Sentinelese Islanders who are basically savages who have had no contact with the outside world. If you approach them and try to convince them to buy some Levi jeans for RS3000 or offer to give their children polio injections, they will probably shove a spear through your gut before you have finished the sentence. Does that mean they are being unreasonable and should have taken your offer in good faith?

I am surprised nobody has brought up the fact that in pakistan most women are confined to the boundaries of their home. In many places like Peshawar you can walk for hours and not see any women. If in pakistan women were out and about like India there would be more cases of rape/harassment .

It takes a certain character to get involved in gang rape or sexually assaulting little children / babies, I think we must be living in a fantasy world to presume the system would ensure these people will do time and return to society as normal people / not pose any threat. Even in prison, no one sits with the people who do rape; all the rapists have no friends and are left alone, even in crime there are ethics; thou shall not rape, sexually assault babies etc I can't fathom how you're unable to differentiate between the types of crimes people commit and what ultimately drives the individual towards those crimes, those who do gang rapes, sexually assault kids and serial killers etc are wired as such that you can't ensure they will be reformed after doing time, you can't guarantee the public's safety and that includes both our family's.

I am prepare to concede that some people of capable of change when it comes to certain things or crimes, but it takes a special type of sick individual to lose all morality when it comes to crimes like in the OP so I don't believe that these individuals can ever change who they are. It takes a certain character to get involved in gang rape or sexually assaulting little children / babies, I think we must be living in a fantasy world to presume the system would ensure these people will do time and return to society as normal people / not pose any threat. Even in prison, no one sits with the people who do rape; all the rapists have no friends and are left alone, even in crime there are ethics; thou shall not rape, sexually assault babies etc I can't fathom how you're unable to differentiate between the types of crimes people commit and what ultimately drives the individual towards those crimes, those who do gang rapes, sexually assault kids and serial killers etc are wired as such that you can't ensure they will be reformed after doing time, you can't guarantee the public's safety and that includes both our family's.

I am prepare to concede that some people of capable of change when it comes to certain things or crimes, but it takes a special type of sick individual to lose all morality when it comes to crimes like in the OP so I don't believe that these individuals can ever change who they are. Morality is taught as part of culture, it is not natural law.

Many paedophile offenders were themselves molested as children. I heard tell of a teenager who was imprisoned for molesting his kid brother. He told the police that his father had done it to him and he thought this was how men were supposed to behave. Such a person is redeemable - they just have to be re-educated.

Others can at least be scared into behaving themselves.
