Sure, you can believe Delhi Police instead... I mean, it's not like they were involved in the riots, or that there's even footage of them along with the rioters...

I will preempt your reply... BBC is anti-India therefore they can't be trusted either. And the Delhi Commission Report article quoted above is posted by The Wire, which is also anti-India.

For authentic news, we can only rely on outlets like Republic. And reputable institutions like Delhi Police.

BBC, Wire or republic....every news agency has their share of biases. My point is simple, if BCC did some 'investigation journalism' and found evidence against hindu rioters, why are they not handing over those evidences to the concerned authorities/supreme courts/NGOs etc? Surely BCC's request will not be ignored.

'BCC found Delhi police acted on line on hindu rioters' - that is such a cheesy line. But where is the proof of what BBC has found? I dont know what they found....so how can I take their statement on face value? If they accusing someone of something...they need to prove it in court of law no?

I am sorry but I dont trust in agenda driven post truths. Unless someone convince me with hardcore evidences, we have to go by the official statement.

AAP Councillor Tahir Hussain confesses to being Delhi riots mastermind

New Delhi: Suspended Aam Aadmi Party leader Tahir Hussain confessed to being the mastermind behind the February riots in Northeast Delhi, the Delhi Police has said in its interrogation report.

The report, accessed by ThePrint, is part of a larger chargesheet that was filed in June. It said Hussain claimed that he wanted to “teach Hindus a lesson” using his political position and money.

It added that he took help of an acquaintance, Khalid Saifi, on 8 January and met former JNU student leader Umar Khalid at the office of Popular Front of India, a Kerala-based radical organisation, in Shaheen Bagh.

The Delhi Police’s report noted that Hussain’s job was to collect acid, petrol, glass bottles and stones, which he stored on the rooftop of his house in Chand Bagh locality.

Saifi allegedly told him that another PFI member, Danish, was willing to provide financial assistance for the “war against Hindus”.

Pulled out CCTVs, moved family to safety
During the interrogation, Hussain said he met Saifi on 4 February to plan out the riots properly, the police said in its report.

According to the police, this is when they decided to instigate the riots around US President Donald Trump’s visit to put more pressure on the central government.

The Delhi Police also claimed that Hussain said he had decided not to harm the people of his own community during the riots, and hence shifted his wife, children and some relatives to a “safer place”.

The former AAP councillor also pulled out all CCTV cameras so the police could not find any evidence, the report said, adding that he also kept calling Delhi Police officers on the day of the riots so he was not suspected.

According to a chargesheet filed by the Delhi Police on 3 June, Hussain, along with nine others, planned the murder of Intelligence Bureau staffer Ankit Sharma, whose body was found in a drain in Chand Bagh on 26 February during the violence in Northeast Delhi.

A Hindu rioter speaks: Delhi violence was “revenge” against Muslims, police gave free reign

“You can call it self-preservation or revenge, but mainly it was revenge,” a 22-year-old Hindu resident of Karawal Nagar, who said he participated in communal violence in northeast Delhi, said. Over two interviews with The Caravan, the 22-year old described how during the violence in February 2020, he and other Hindu men targeted shops and vehicles belonging to Muslims, destroying these or setting them on fire. He admitted to beating up Muslim men for refusing to say “Jai Shri Ram.” The 22-year-old told The Caravan that the Delhi Police gave Hindu rioters free reign to target Muslims. “They told us to go and attack inside, in the Muslim areas, that they won’t come there … They said, ‘Show us that you’re Hindu,’” he said. He added that a police official told him that the Hindu rioters were being “given a chance,” and that “when we get a message from above, I will stop you. But until then, do what you want.’”

The 22-year-old also alleged that he had met a member of the Bajrang Dal, who handed him a rod to use while smashing properties of Muslims. According to him, the Bajrang Dal member also encouraged Hindu men to unite against Muslims, saying that “if you don’t do something now, you will never be able to do anything.” The 22-year-old said that the man from the Bajrang Dal told the mob to unite as Hindus and to discard their political affiliations for the duration of the violence. The 22-year-old said that through the days when the violence was ongoing in Delhi, he received messages and calls on WhatsApp that incited him into attacking Muslims. He said that the messages described, among other things, a heinous attack by Muslims on Hindus, and called for Hindus to be prepared to attack Muslims in the dead of night.

The 22-year-old further said that he witnessed a mob of Hindus killing three Muslim men. One among these, he said, was thrown onto a vehicle for refusing to say “Jai Shri Ram.” The mob then set the vehicle on fire, killing the man. The 22-year-old praised the Bharatiya Janata Party leader Kapil Mishra, saying that Mishra had “done good work … he has taken the public along with him, he has given many suggestions.”

Between 24 and 26 February, northeast Delhi was engulfed in communal violence. Of the 53 people who were killed, 38 were Muslim. On 23 February, Mishra had given an incendiary speech at the Jaffrabad metro station. Nearby, Muslim residents of northeast Delhi were conducting a sit-in protest against the recently enacted Citizenship (Amendment) Act and the proposed National Register of Citizens—one among many such peaceful protests in India which had begun in mid-December 2019. Mishra had threatened that if the police did not clear up the crowd, “the matter would be taken out of the police’s hands.” His speech—delivered in presence of Ved Prakash Surya, the deputy commissioner of police for northeast Delhi—was followed by skirmishes between Hindu mobs and Muslim protestors.

In a few hours, the violence escalated. Muslim residents have since described how mobs shouting “Jai Shri Ram” entered their localities, burned down their shops, looted and set fire to their homes and in many cases, brutally beat, lynched or killed Muslims. Victims and witnesses have also accused the Delhi Police of aiding and shielding Hindu mobs—in one video that circulated widely on social media, police officials can be seen torturing Muslim men, one of whom subsequently died. Muslim residents of northeast Delhi told The Caravan that Mishra and other leaders of the Bharatiya Janata Party led mobs during the violence, and that senior Delhi Police officers participated in criminal intimidation, unprovoked firing, arson and looting during the violence. The residents said that the police ignored their complaints about these incidents and intimidated them, demanding that they exclude the names of senior officers and leaders from their statements.

In the chargesheets it has filed in cases related to the violence, however, the Delhi Police has blamed Muslim protestors for inciting the violence, claiming that they led the sit-ins in an attempt to discredit the Narendra Modi-led central government. In an affidavit filed in the Delhi High Court on 13 July, the Delhi Police claimed that the protestors in Jaffrabad had purposely blocked the road to trap non-Muslims within surrounding areas, and that they timed this protest to coincide with the United States President Donald Trump’s visit to India. The police also blamed activists that were associated with the protests for inciting riots. The police told the court that it had filed 750 first-information reports and 200 chargesheets related to the violence, and that by 11 July, it had arrested 1,430 people. Though the police has arrested some Hindu men, the names of leaders such as Kapil Mishra and the targeted attacks by Hindu mobs on Muslims are conspicuously absent from the Delhi Police’s narrative, as are any comments on its widely reported complicity in the violence.

On 8 July, the Delhi Police’s special commissioner for crime wrote to senior officers investigating the violence, cautioning them that “arrests of some Hindu youth … has led to a degree of resentment among the Hindu community.” He asked the officers to take “due care and precaution” before arresting any person. The police has since claimed that the letter was only informing senior officers of the view point of Hindu community leaders.

The 22-year-old’s testimony is at odds with the Delhi Police’s version of events. He admitted to participating in the violence for three days, alongside a group of Hindu men, all of whom, he said, were carrying weapons such as bricks, stones, lathis and iron rods. He added that some Hindus he saw were carrying pistols, too. “Two or four men had pistols … there was a six-rounder, a 315, a 309,” he said, referring to the types of guns. He added, however, that he did not see the men firing these guns. He said that he and his companions targeted Muslim property and vehicles. He said they destroyed many shops, broke the windshields of vehicles. “From Karawal Nagar to Kalighat Road, there is no count of how many vehicles were burned,” he said. The mob identified some vehicles by the inscription of the number “786”—a number considered holy by Muslims, as it is the sum of the numerical values of Arabic letters in the first line of the Quran—or by checking people’s government-issued identification cards, such as Aadhaar.

“I set fire to four to seven bikes,” he said. “There was one bike, it had 786 written on it. The guy who was driving it … we stopped him and asked him to say ‘Jai Shri Ram.’” When he refused, the 22-year-old said, “we beat him up and burned his bike.” He described various such incidents, when he and other Hindu men ganged up on and beat Muslims. “Aadhaar cards were being checked… if someone said the wrong name, we would immediately look up their car number and see which community they are from,” he said. He further said that he and his companions set fire to Muslims’ shops by using tyres and petrol. “We took tyre and put petrol in it, set it on fire, and threw it in the shops,” he said. “We took a few drops of petrol from nearby bikes or cars.” When asked how he identified Muslim homes and people, he said, “You can see them and tell. You can tell by their manner.”

The 22-year-old said that the police not only turned a blind eye to the Hindu mobs, it encouraged them to attack Muslims. “The police gave Hindus full support,” he said. “They themselves told us to go inside to these people’s areas and attack there, and said that there was no problem with that.” On being asked whether the police saw the group he was a part of carrying weapons, he said, “Yes … they just kept watching.” The 22-year-old added that personnel from the Central Reserved Police Force were also present alongside the Delhi Police.

According to the 22-year-old, police officials told the Hindu mobs that they had “free reign” for two hours. He said that one police officer told him, “You are being given a chance, do whatever you want. When we get a message from above, I will stop you. But until then, do what you want.” He added that the police told him and his companions: “You say you are ready to fight, that you are Hindu … then go fight, show us that you are Hindu. Let us see how much you can fight.”

The 22-year-old alleged that a man from the Bajrang Dal—a militant wing of the Hindu nationalist Rashtriya Swayamsevak Sangh, the parent organisation of the BJP—aided him in breaking shops belonging to Muslims. “I was holding a thick rod, of six or seven or eight feet, a shop was being broken and destroyed, and I was helping in that,” he said. A well-built man “came and said, ‘You won’t be able to do it with this,’ he took my lathi and handed me his.” According to the 22-year-old, members of the mob told him that the man was a member of the Bajrang Dal. The 22-year-old said the man then addressed the Hindu mob. “He said that we Hindu brothers must maintain unity … that if we don’t stay united, then we won’t be able to do anything,” the 22-year-old said. The man “told us to fight and that whatever has to happen, will happen,” the 22-year-old added. “He said, ‘Set aside your political affiliations, fight as Hindus only. Don’t think that someone here is from AAP, BJP, SP”—referring to the Aam Aadmi Party and Samajwadi Party—“Congress. Just fight as Hindus.’”

It was clear that 22-year-old had been greatly influenced by messages he received over WhatsApp, which prompted him to attack Muslims. He said that on 23 February, he had begun to receive a barrage of messages about the violence, calling on Hindus to unite against Muslims, to “be ready to defend” themselves. He said that Hindu men who participated in the violence had remained in touch throughout, via phone calls and WhatsApp messages. “We were collaborating, we would have done anything to save Hindus. We would have fought fire with fire.” He further cited allegations against the former Aam Aadmi Party councillor, Tahir Hussain, as proof that Muslims had conspired to instigate the Delhi violence. The police has named Hussain as an accused in the murder of Ankit Sharma, a staffer of the Intelligence Bureau who was killed during the violence. The police’s version of Hussain’s involvement in the violence, however, have been widely contested.

The 22-year-old described an audio message he had received over WhatsApp, which said that Muslims were surveying areas in northeast Delhi to ascertain the strength of their community. The man in the audio—which he played for us—said that Hindus should remain “alert.” The 22-year-old also described receiving messages about Muslim mobilisation. In another audio message that he played for us, a man could be heard saying that “an announcement had been made at the mosques that Muslims will attack after 2 am.” The messaged exhorted Hindus to “stay awake all night.”

He added that he had received messages or videos of attacks by Muslims on Hindus. “I saw that and got angry, that if they are beating Hindus, why should we stay silent?” The 22-year-old further said that he was angered by the protests against the CAA. “You come and sit on the streets, bothering the public, interrupting work … where will everyone go? They have been doing this for a month and a half or two months, and Hindus came and finished the job in two hours.”

Throughout the course of our interviews, the 22-year-old’s hatred for Muslims was palpable. He described Muslims as “merciless,” and accused them of always instigating violence. He claimed that Muslims are loyal to Pakistan, which was their rightful country—a common refrain among members of the Hindu Right in India, including prominent BJP leaders. “Hindus never fight first, it is always the Muslims who fight first. We thought, ‘Let’s end this once and for all,’” he told us. He cited other misinformation, such as the unproven claim that the population of Muslims is rising extraordinarily. He claimed that Muslims all have “ten children … that their population has risen a lot.” His claim echoed that of many BJP supporters and leaders, some of whom have previously demanded population-control measures against Muslims. “I would like for all Hindu brothers from Pakistan to come here and for Muslims to go there … then there will not be any fighting,” the 22-year-old said. “They are Muslims, they will never improve, they will attack us one day or another … this is true. Hindu brothers must be prepared.”

When we asked whether he ever regretted participating in the violence, the 22-year-old said, “At the time I felt that I was doing the right thing, but then later it strikes you that everyone we attacked was poor … I feel some remorse sometimes, but what happened had to happen.” He said that he was swept in a wave of hatred and adrenaline, and the company of his Hindu companions. “People should not have been killed … but it was necessary to suppress Muslims,” he told us. “Earlier, they were like lions, and now they are scared mice,” he added. “They know now that Hindus are united, and they will not think about attacking us.”

Delhi violence: Mob burnt 22-year-old man’s unconscious body to check if he was dead, say police

The Delhi Police told a local court on Wednesday that a 22-year-old man, who was allegedly killed by a mob during the violence in the northeastern part of the city in February was beaten up first and then set on fire to establish that he had “actually died”, reported The Indian Express on Thursday. The mob had assaulted the man, Shahbaz, after they identified him as a Muslim and burnt his body later in case he was “trying to feign unconsciousness”, the police said.

The police made the submissions during the bail hearing of an accused, 24-year-old Rahul Sharma. Only a piece of Shahbaz’s skull and some pelvic bones have been found so far, which the victim’s family claims to be of the 22-year-old. However, the Delhi Police said that it can be established only through a DNA test.

Following this, Additional Sessions Judge Vinod Yadav dismissed Sharma’s bail hearing. So far, five people have been arrested in the murder case.

On February 25, Shahbaz had visited the city’s Guru Teg Bahadur Hospital around 7 am to get medicines for his eyes, the court records said, according to the newspaper. Around 2.25 pm, his brother, Matloob Ahmad, informed him that he was trying to get home from Karawal Nagar through the bylanes. However, Ahmad was unable to get in touch with Shahbaz after this. Two days later, Ahmad was informed that a mob had killed his brother and burnt his body.

“He tried to escape by jumping over the wall and running into the water near the bushes towards PTS Wazirabad,” the police told the court. “He [Sharma] and other rioters chased Shahbaz.... The rioters caught him again and beat him mercilessly. The riotous mob dragged Shahbaz to the main Pusta Road.” After looting and beating him up, the mob “poured some more petrol and burnt Shahbaz alive”, the Delhi Police said.

The Delhi Police informed the court that dump data analysis and manual identification had been used for the inquiry. The person who had informed Ahmad of his brother’s death was now a prosecution witness, the police said. Two people, identified as Aman and Mohit, have confessed to killing Shahbaz and burning his body. Meanwhile, Sharma’s team denied the police’s allegations.

The violence and investigation
Clashes had broken out between the supporters and opposers of the Citizenship Amendment Act between February 23 and 26 in North East Delhi, killing 53 people and injuring hundreds. The police were accused of either inaction or complicity in some instances of violence, mostly in Muslim neighbourhoods. The violence was the worst Delhi saw since the anti-Sikh riots of 1984.

In multiple chargesheets filed in June, the police had claimed the violence in Delhi was a result of a conspiracy to defame the Narendra Modi-led government. They alleged that people who had organised protests against the Citizenship Amendment Act were the conspirators. However, the police have failed to produce video evidence so far.

The random selected tweets serves well to play the victim card but not sure if it serves any other purpose.

Who is Uzair Hasan Rizvi? Why should we take his statement on the face value? When he will do fact finding on Ankit Sharma's stabbing?

Just bcoz I tweet something...does not make it post truth.

We have to go by the official statement and per Delhi's polices FIR statement Delhi riots were planned by Tahir Hussain, Umar Khalid to discredit India during Trump visit. Anyone has any alternate proof and version need to go the police/concerned authority rather than tweeting and playing to the gallery.

All these media claims fall flat in the court where you have to provide evidence. Merely making claims has no value in a court of law.

Tahir Hussain's confession proves that it was a planned attack on hindus to create a riot like situation.

Delhi Govt Flags Seven Videos of ‘Police Complicity’ in February Riots

Delhi: Delhi government’s home department flagged a set of seven video clips to the Delhi Police on October 5, as per the Indian Express report, demonstrating the complicity of some members of the police force in fomenting violence during the riots in the northeast Delhi in February this year.

The role of Delhi Police in the riots and the subsequent investigation has come under severe criticism. Ground reports and fact-finding missions have shown that the Muslim community bore a majority of the brunt of the violence. However, arrests have mostly focused on activists who were part of peaceful anti-Citizenship Amendment Act protests, while letting off leaders of the ruling BJP who made inflammatory speeches in the run up to the riots.

The Delhi Police in its response on October 7 said that it had taken action on three of the seven videos, and other videos were being analysed, and a report regarding the same would be submitted in the due course of time after ascertaining location, exact time and date.

One of the videos purportedly shows policemen with arms, batons, and throwing portions of bricks along with rioters at the members of the Muslim community. The video clearly shows the faces of policemen and a police outpost, indicating the location. The Delhi Police said the particular video is being analysed, the Indian Express report pointed out.

In another video, policemen are seen egging on the rioters to charge in the opposite direction, following which both policemen and rioters are seen throwing bricks. The video shows several stores with hoardings and addresses on them. According to the Delhi Police, this video is being analysed as well.

The third video, which had garnered enough public attention already, show policemen forcing some men, lying down on the road after being hurt, to sing the national anthem. One of the men had been later identified as Faizan (24) and died in the due course of time. A case has been lodged in this connection under Sections 147, 148, 149 and 302 (murder) of the Indian Penal Code (IPC) at the Bhajanpura Police Station, the police said in their response, as per the Indian Express report.

The four other videos show a motley group of men making open threats and calling for violence to target the Muslim community. Delhi Police said action had been taken in two of those videos, and two others are being analysed.

The latest videos flagged by the Delhi government indeed lend credence to Amnesty International’s accusations about the alleged collusion of the Delhi Police with rioters. It has urged the Union government to carryout a “prompt, thorough and independent investigation” into allegations against law enforcement officials.

These allegations by Amnesty International are part of its 20-page report released in August this year.

Muslims in Northeast Delhi Sell Homes Below Market Rate to Escape ‘Continuing Harassment’

New Delhi: More than seven months after the communal riots that shocked northeast Delhi with instances of looting, vandalism and targeted killings of Muslims and their properties, survivors still report harassment and humiliation within their immediate neighbourhoods.

A month ago, 14-year-old Fiza’s family sold their house in Shiv Vihar so they could move to a safer location. Despite the COVID-19 pandemic, they not only moved out but also accepted the abysmal amount they received when they put their property on the market.

In ordinary times, the house, which they had bought in 2010, would have sold for Rs 20 lakh. However, with the property market down due to the pandemic, they could sell it for just Rs 12 lakh. The loss of Rs 8 lakh was worth it, they said, since they continued to feel unsafe in their Shiv Vihar neighbourhood long after the overt violence ended.

“Hindus in our lane had been making daily life difficult for us since the riots,” said Fiza’s mother, Nasreen (name changed)*. “They created a problem even if we walked past them. When they saw us walking down the lane, they used to call us ‘coronavirus’ and cover their mouths.”

She added: “They used to taunt us, saying that we were the rioters and we lack faith because we eat biryani.”

Fiza had grown up in that lane and was doubly upset when her family moved away, first, because she missed her home and second, because none of her close friends came to visit her when she was leaving. “They were behaving as if they don’t know us. We played Holi together, celebrated Eid together and used to go for our tuition sessions together. How can they forget all that?” she asked. “When they saw us emptying the house our father loved, they slammed their doors loudly.”

According to Nasreen, the neighbourhood had been a happy place until the riots. “This year, our voices couldn’t escape our throats to wish them a happy Holi, we were so scared of being attacked. Till now, our cheeks waited every year for their Holi colours and their plates waited for our Eid sewaiyaan (sweet vermicelli).”

Like Fiza’s family, Irfan (36) has sold a portion of his property at a loss of Rs 4 lakh. This portion had been a general store run by his family till the violence earlier this year, when it was looted and vandalised. Now his family has begun the process of seeking a home elsewhere so they can move out of Shiv Vihar permanently.

“Our children have been terrified since they witnessed the riots; they aren’t able to come out of the house because of their fear,” Irfan told The Wire.

Scarred by being targets of violence and plagued by financial losses due to the riots, Irfan’s family accepted the sale of their property at a lower rate due to their urgent need for money.

Whose home is it anyway?

According to estate agent Mohammed Rizwan, who has been working in Shiv Vihar for 17 years now, about 50 families have expressed their desire to sell their homes since the riots. Though these sellers are not very well off, they do not argue over offers less than the market value for their properties, he said. He understands this as a direct consequence of the riots.

“People here have never been communal in nature; the Hindu-Muslim divide has come to influence them since the riots,” Rizwan told The Wire. “Muslim sellers who come to me wish to sell their property and shift to Mustafabad, to live among their own community.”

Farhana Khan, however, has been trying to stop Muslims from moving out of Shiv Vihar. She herself is a victim as well as a witness of the humiliation Muslims now face in the locality. Farhana and few others have claimed that Hindus in the neighbourhood deliberately chanted “Jai Shri Ram” right after the Maghrib azaan (evening call to prayer) every Tuesday for over a month. This has now stopped after a few Muslims brought this to the notice of the local police.

In addition to this, several lanes in Shiv Vihar have now been gated. The installation of these gates was initiated by the Hindu majority of the area. Muslims, who generally live in just two or three homes in each lane, have reported being locked outside the lanes randomly at any time of the day by the Hindu keepers of the gate keys.

“These people lock the gates out of the blue and make us wait and then we have to plead to enter our own lanes,” said Farhana.

Despite this harassment, Farhana continues to ask Muslims to remain in Shiv Vihar. “Why should we leave? What have we done? If we continue like this, Muslims will disappear from Shiv Vihar,” she said.

Delhi Riot complaint names BJP MLA, court seeks report from police

A Delhi court has directed police to file an action taken report (ATR) into a complaint accusing BJP MLA Mohan Singh Bisht of leading a mob and throwing a petrol bomb at a house during the Northeast Delhi riots in February. Metropolitan Magistrate Rakesh Kumar Rampuri issued a notice to police in the application filed by Mohamad Mumtaz, the owner of a chicken shop at Karawal Nagar. He had filed an application through Advocate Mehmood Pracha asking the court to direct police to register FIR based on contents of an application that names Bisht and 21 others.

As per the complaint, on February 23, Mumtaz’s shop was set on fire by rioters named in the complaint. On that day, after filing an unnamed complaint with the police, Mumtaz alleged he spotted Bisht around 10 pm and heard him give a speech to a mob asking them to “find and kill Muslims” while the mob shouted, waving pistols and swords in the air.

On February 25, around 7.30 am, Mumtaz named some persons in his complaint for carrying pistols and hurling bombs at his neighbourhood as rioters took control of terraces. Mumtaz tried to shoot the video but was pelted with stones by rioters, he alleged.

“After a little while, Bisht came there along with his driver and another person who had applied a big tikka on his forehead. As soon as they arrived the mob started raising the slogan ‘Mohan Singh Bisht zindabad’, and Bisht told them to finish the task soon… Then he entered the street leading the mob… Then the applicant/complainant saw that Bisht took a bomb from his henchman and threw it at applicant/complainant’s house…then they broke the lock of the door and entered his house,” the complaint read.

Bisht refused to comment on the allegations. Mumtaz alleged rioters took Rs 24 lakh in cash, 40 tola gold and 5 kg silver kept in a bag along with other items. The court was told police refused to register FIR.

Northeast Delhi riots: HC grants bail to accused Saiyad Iftikhar

NEW DELHI: A Delhi High Court granted bail to a man arrested for alleged rioting and theft during the communal violence in northeast Delhi. The court noted that there were no call detail records (CDR) to establish that the accused was available at the site on a particular day.

Justice Suresh Kumar Kait granted bail to Saiyad Iftikhar, who was arrested by the Delhi Police on April 11, on furnishing a personal bond of Rs 15,000 and a surety of the like amount. “Keeping in view, the fact that petitioner is in judicial custody since April 11, therefore, I am of the view that the petitioner deserves bail,” the judge said.

The HC directed him not to directly or indirectly influence any witness or tamper with the evidence. Iftikhar, represented through advocate Mehmood Pracha, sought bail in the case. Police arrested Iftikhar for the alleged offences of rioting, theft and causing mischief by fire or explosive substance with an intent to destroy a house under the IPC.

A case was lodged against him at Police Station Bhajanpura. The HC noted in its order that it was not in dispute that Iftikhar’s eyesight is weak, having a power of minus 3.75 and when he was arrested he was wearing spectacles. The petitioner was arrested on basis of CCTV footage along with co accused Ali Hasan but admitted fact is that in CCTV footage, Iftikhar is not wearing spectacles.

“The alleged incident is dated February 24 at 21:31.50 hour. Thus, it cannot be believed that a person having such weak eye sight would have clear vision at night without spectacles. Moreover, CDR is not on record, whereby it could have been established that the petitioner was available at the site,” the court said.

Communal violence had broken out in northeast Delhi on February after clashes between citizenship law supporters and protesters spiralled out of control, leaving at least 53 people dead.

In Delhi 2020 Riots Case On Activist Sharjeel Imam, Supreme Court Clarifies

The Supreme Court on Friday clarified the observations made in respect of JNU student Sharjeel Imam in the Delhi High Court verdict, which rejected the bail plea of co-accused Umar Khalid in a case of alleged conspiracy behind the February 2020 riots in northeast Delhi, will not prejudice his case pending before the court.

A bench of Justices SK Kaul and AS Oka, which was hearing Imam's plea concerning the remarks made against him in the October 18 judgement of the high court, said one of the paragraphs in the verdict clarified "nothing stated hereinabove shall tantamount to an expression of any opinion on the merits of the case".

"This happens when people argue bail applications like it is an appeal on merits," Justice Kaul observed, adding that bail applications should not be argued for over 10 minutes.

In its verdict rejecting former JNU student Khalid's plea seeking bail, the high court had said he was in constant touch with other co-accused and allegations against him were prima facie true.

"....having carefully gone through the charge-sheet and taking into consideration the fact that the appellant (Khalid) was in constant touch with other co-accused persons, including Sharjeel Imam, who arguably is at the head of the conspiracy; at this stage, it is difficult to form an opinion that there are not reasonable grounds for believing that the accusation against the petitioner is prima facie not proved," the high court had said in its verdict.

During the hearing before the top court, the counsel appearing for Imam told the bench they are constrained to move the apex court as serious prejudice would be caused to the petitioner due to the observations made by the high court in the order denying bail to one of the co-accused in the case.

"We have noticed that in paragraph 68 of the judgement, the division bench of the high court has clarified that the observations shall not tantamount to an expression of any opinion on the merits of the case," the bench said.

"We clarify that any observations made in respect to the petitioner (Imam) will not prejudice the petitioner...," the top court said.

Justice Kaul observed he finds it complete wastage of time when hearing on bail applications goes on and on.

Umar Khalid, Sharjeel Imam and several others have been booked under the anti-terror law the Unlawful Activities (Prevention) Act (UAPA) and provisions of the Indian Penal Code for allegedly being the "masterminds" of the February 2020 riots, which left 53 people dead and over 700 injured.

The violence had erupted during the protests against the Citizenship (Amendment) Act (CAA) and National Register of Citizens (NRC).

Ex JNU Student Umar Khalid, Arrested In Delhi Riots Case, Gets 7-Day Bail

A court on Monday granted one-week interim bail to former JNU student Umar Khalid, arrested in a case related to the northeast Delhi riots, for his sister's wedding.

Additional Sessions Judge Amitabh Rawat granted relief to Umar Khalid from December 23 to 30.

Mr Khalid, a former student leader of Jawaharlal Nehru University (JNU), had moved an application seeking two weeks' interim bail for his sister's wedding.

Mr Khalid was charged under the Unlawful Activities (Prevention) Act (UAPA) and provisions of the Indian Penal Code for allegedly being a mastermind of the February 2020 riots, which had left 53 people dead and over 700 injured.

The violence had erupted during the protests against the Citizenship (Amendment) Act and National Register of Citizens.

Umar Khalid was arrested by Delhi Police in September 2020.

Delhi Riots Accused Umar Khalid Out On Bail To Attend Sister's Wedding

Umar Khalid on Friday walked out of Tihar Jail following an earlier December 12 order by a Delhi Court giving him an interim bail of seven days to attend his sister's wedding.

Umar Khalid was released from Tihar Jail today.

On December 12, a Delhi court granted a week's interim bail to student activist Umar Khalid in the larger conspiracy case of the 2020 Northeast Delhi riots.

Additional Sessions Judge Amitabh Rawat of Karkardooma Court had granted Khalid bail for a period of one week, starting December 23.

Mr Khalid has been granted bail for attending his sister's marriage on December 28. He has to surrender on December 30. He had sought an interim bail of two weeks for attending the marriage.

The detailed order is awaited.

During the arguments on November 6, Mr Khalid's counsel senior advocate Tridip Pais had assured the court that he would not talk to the media or give any interview if granted interim bail for the wedding of his sister.

He also said that he would abide by any condition imposed by the court, including providing his live location.

It was earlier submitted by the Delhi police that Mr Khalid's release on interim bail may lead to unrest. Delhi police had submitted a report filed in Karkardooma Court opposing the interim bail plea moved on Mr Khalid's behalf.

The senior advocate also referred to the cases where interim bail was granted to the accused under UAPA. He also referred to the case of Siddique Kappan where an interim bail was granted by the Supreme court imposing the condition of no interaction with media. The same condition may be imposed in this case as well.

Pais had said, "Siddique Kappan was granted interim bail by the Supreme Court. A condition was imposed. Please see the condition put -- the same condition may be put on my client. During his (Khalid's) visit, he shall not give any media interviews. Not media public persons... Agreed I won't. Only family and relatives."

The counsel also referred to the case of co-accused Ishrat Jahan who was granted 10 days interim bail for her own marriage.

On the other hand, Special Public Prosecutor (SPP) Amit Prasad had opposed the bail plea. He said that in the case of Siddique Kappan, interim bail was granted by the Supreme court and other judgements cited don't apply to Umar Khalid's case.

SPP submitted that here we are in a situation where his bail has been rejected. "So far as Siddique Kappan is concerned, it was by Supreme Court... if it is passed by this court, then they will say freedom of expression will be agitated. Tomorrow everybody will say."Delhi police had filed a status report on the interim bail plea. The fact of wedding has been verified by the police.

A court in Delhi has sentenced nine persons convicted in a case pertaining to the 2020 northeast Delhi riots to seven years of rigorous imprisonment, observing that communal riot is a menace that poses a serious threat to the sense of fraternity among the citizens.

The court also said the acts of the convicts left a deep scar on the social fabric, economy and stability of the country, besides instilling a sense of insecurity among the people and jeopardizing the communal harmony in the society.

Additional Sessions Judge Pulastya Pramachala on Tuesday pronounced the order, sentencing Mohd Shahnawaz, Mohd Shoaib, Shahrukh, Rashid, Azad, Ashraf Ali Parvez, Mohd Faisal and Rashid.

On March 13, the court had convicted the nine accused, saying the charges levelled by the prosecution were proved beyond a reasonable doubt.

"All the convicts shall undergo rigorous imprisonment for a period of seven years for the offence punishable under Section 436 (mischief by fire or explosive substance with intent to destroy house etc.) of the Indian Penal Code and each convict shall pay a fine of ₹ 20,000," the judge said.

The ASJ also said from the recovered fine, ₹ 1.5 lakh would be disbursed to the complainant or victim as compensation and in default of payment of the fine, each convict would undergo simple imprisonment for one year and six months.

"Communal riot is that menace, which poses a serious threat to the sense of fraternity among the citizens of our nation. Communal riots are treated as one of the most violent forms of public disorder that afflicts society and leads to not only loss of life and property but also causes great damage to the social fabric," the judge said.

He said during communal riots, innocent and ordinary people get caught in circumstances beyond their control, which also leads to the violation of human rights in the present case, the convicts indulged in communal riots, which impacted the mindset of people both within and beyond the territorial limits where the act was committed.

"Thus, the impact of the crime committed by the convicts, in this case, is not limited to loss caused to the complainant only. Rather their acts left a deep scar on the social fabric, economy and stability of our nation and the alleged acts instilled a sense of insecurity among the people while jeopardizing the communal harmony in the society," the judge said.

Noting that the defence counsel referred to reformation and sought a lenient approach in sentencing, the judge said the repercussion of crime in the case does not allow invoking the reformatory theory of sentence.

"Moreover, though reformation is the most ideal aim, but even for that purpose there must be some indication appearing from the conduct of the convict and it cannot be demanded just to escape the consequences of misdeeds," the ASJ said.

In the present case, the sentence must be based on the consideration of balancing the impact of crime on the society and background of the convicts, the judge added.

The court also noted that the nine people were held guilty of the charges of forming an unlawful assembly with the object of causing maximum damage to people of a particular community, besides instilling fear and insecurity in their minds, and in pursuance of their common object, the convicts committed vandalism, theft and mischief by fire in the complainant's house in Chaman Park area on the intervening night of February 24 and 25, 2020.

During the proceedings, Special Public Prosecutor D K Bhatia sought maximum punishment, saying a message should go to the masses by giving severe punishment to the convicts.

A charge sheet was filed at Gokulpuri police station against the accused under sections 147 (rioting), 148 (rioting, armed with a deadly weapon) 380 (theft in dwelling house, etc.) 427 (punishment for committing mischief and thereby causing loss or damage to the amount of ₹ 50 or upwards) 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object), 188 (disobedience to order duly promulgated by public servant) and 436 of the IPC
