An accountability court on Monday approved a plea of Prime Minister Shehbaz Sharif for permanent exemption from attending the hearing in the Ramzan Sugar Mills case, ARY News reported.

Accountability Judge Asad Ali Awan announced his decision, which was reserved over the plea in a previous hearing.

Shehbaz Sharif in his application argued that he could not appear before the court as the Prime Minister of Pakistan. He had sought the court’s instructions for nominating pleaders in the case.

The court adjourned further hearing of the case July 05.

The court also summoned lawyers in the next hearing for arguments over acquittal petitions of the accused.

In the plea filed through his lawyer, he had stated that he saved billions of rupees of the public in government schemes. He said he was neither a shareholder nor the director of the sugar mill as he had already transferred his properties to his children.

The National Accountability Bureau (NAB) has failed to prove corruption charges against him, he claimed, requesting the court to acquit him in the case.

In Dec, his son and now Chief Minister of Punjab, Hamza Shahbaz had moved an acquittal plea in the Ramzan Sugar Mills reference. He filed the acquittal plea on the basis of the amendments made to the National Accountability Bureau (NAB) law.

He stated that the corruption watchdog filed the reference against him for allegedly getting a drain built with the public funds to facilitate the Ramzan Sugar Mills.

The NAB reference is ill-founded and based on mala fide intentions and on political grounds, he alleged.

‘Black day’: President Alvi rejects bill amending NAB Ordinance

ISLAMABAD: President Arif Alvi on Monday rejected a bill amending the National Accountability Bureau (NAB) Ordinance due to the “flaws in its implementation”.

According to a statement released on the official Twitter handle of the President of Pakistan, Alvi said that as conceived originally, the bill took inspiration from “Hazrat Umar’s incident” when asked about the source of extra cloth in his cloak. “The onus in financial crimes is on the accused to provide a money trail,” the statement read.

“Unfortunately, there were flaws in NAB's implementation. It was misused for political exigencies by those in power [and] by vested interests,” the president said.

He also reiterated that the public clamoured for the return of the nation's looted wealth, but long judicial processes and poor prosecution failed most efforts.

“Instead of improving the law to avoid miscarriage, to close loopholes [and] make it stronger, we are weakening it beyond recognition,” the statement read.

According to the president, the proposed changes will “demolish accountability”, creating a “façade of justice” that blatantly hides a corrupt elite capture ensuring the exploitation of the common man in an unjust society.

The president said that the poor will continue to be jailed for petty crimes while the corrupt rich will be free to loot and plunder.

He said: “I personally abide by the Constitution, we must act upon injunctions of the Quran and Sunnah, and above all, I am answerable to Allah asking for His forgiveness.

“Therefore, with deep discomfort and pain, I state that my conscience does not allow me to sign this Bill.”

He added that "weak accountability is against the basic rights of the people of Pakistan who are the suffering masses, and, therefore, it is also against the fundamentals of the Constitution," he added

The president acknowledged that he was aware of the fact, in view of the ‘deeming’ provision under Article 75 (2) of the Constitution of Pakistan, that the NAB (Amendment), 2022 will be enacted into law even if the President of Pakistan does not sign the bill.

Former Wapda chairman appears before NAB in Rs753m corruption case

LAHORE: Former Water and Power Development Authority (Wapda) Chairman Lt Gen (retd) Muzammil Hussain Monday appeared before the National Accountability Bureau’s (NAB) office today where he was interrogated about corruption worth Rs753 million in the Tarbela Fourth Hydropower project, Geo News reported.

“All allegations levelled against me are false,” Hussain said while speaking to journalists outside the NAB office, where he stayed for around two hours.

The former chairman questioned how the corruption figure was of Rs753 million when the cost of the project was Rs750 million.

“No premature payments were made to contractors and the project was completed ahead of the scheduled time,” he said, adding that the cost was also recovered after the production of electricity started.

Regarding political involvement, in this case, Hussain rejected all speculations saying that no political motive was involved. “A complaint was lodged against me and the NAB considered it necessary to verify the news,” he added.

The former chairman clarified that he had answered all questions during the course of investigation, adding that he wasn’t given any sort of questionnaire. “I am ready to appear before NAB if they summon me again,” he maintained.

ISLAMABAD: Former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan has announced to challenge amendments to the National Accountability Bureau (NAB) law in Supreme Court (SC) this week, ARY News reported on Tuesday.

Earlier in the day, the former premier strongly criticized the amendments to the National Accountability Bureau (NAB) law and said the party would not remain silent and approach every constitutional and legal forum.

The former premier made these remarks while chairing a meeting of PTI spokespersons. The meeting discussed coalition government’s amendments to the NAB law.

Speaking during the meeting, Imran Khan said that the National Accountability (Amendment) Bill 2022 “would help the incumbent government get another NRO”. “These rulers are attempting to close the cases against them under the pretext of reforms,” he added.

The meeting also discussed the recent statement by Energy Minister Khurram Dastgir. “The statement has proved that the incumbent government wants NRO. Inflation and public issues are not the priority of imported government,” the PTI Chairman added.

The meeting also condemned Defence Minister Khawaja Asif’s statement regarding the President, terming it ‘shameful’ and ‘deviation from oath’, sources told ARY News.

The former premier further said that NRO had caused irreparable damage to the country economically and morally. “We will not remain silent and will approach every constitutional and legal forum against NAB amendments,” he added.

ISLAMABAD: The National Accountability Bureau (NAB) Chairperson Zahir Shah on Wednesday approved the transfer of 13 directors, including those who were probing senior PM-N leaders in corruption cases, sources privy to the matter said.

According to a statement issued by NAB, the names of the officers on the list include NAB Lahore Director Intelligence Muhammad Asghar, Aftab Ahmed, Khawar Ilyas, and NAB Lahore Director Administration Nadeem Shah.

NAB Director Intelligence Asghar, who arrested Prime Minister Shehbaz Sharif, has been transferred from Lahore to Sukkur, said the sources. Sources added that Aftab Ahmed and Khawar Ilyas, who were included in the list, were investigating Defence Minister Khawaja Asif, Railways Minister Khawaja Saad Rafique as well as Nisar Ahmed Cheema and former principal secretary to the prime minister Fawad Hassan.

According to the notification of NAB, Acting Chairman NAB Zahir Shah has approved the transfers of the 13 grade-19 officers of the bureau to the different regional offices. Four of the officers were from NAB Lahore, two each from NAB Karachi and NAB Balochistan and one each from NAB Headquarter Islamabad, NAB Sukkur, NAB Multan and NAB Rawalpindi.

As per the notification issued on Wednesday, Additional Director NAB Headquarter Islamabad Mufti Abdul Haq was transferred to NAB Lahore, Additional Director NAB Lahore Aftab Ahmed to NAB Karachi, Additional Director NAB Lahore Muhammad Asghar to NAB Sukkur, Additional Director NAB Lahore Nadeem Ahmed Shahid to NAB Headquarter Islamabad, Additional Director NAB Lahore Khawar Ilyas to NAB Balochistan, Additional Director NAB Karachi Shahzad Imtiaz Ahmed to NAB Headquarter Islamabad, Additional Director NAB Karachi Haroon Rasheed to NAB KPK, Additional Director NAB KPK Zahir Shah to NAB Multan, Additional Director NAB Balochistan Muhammad Faisal Qureshi to NAB Rawalpindi, Additional Director NAB Balochistan Hina Saeed to NAB Headquarter Islamabad, Additional Director NAB Multan Omar Khan to NAB Rawalpindi, Additional Director NAB Sukkur Muhammad Tariq Khan to NAB Lahore and Deputy Director NAB Rawalpindi Saleem Ahmed Khan to NAB Balochistan.

ISLAMABAD – Federal cabinet on Thursday approved appointment of Aftab Sultan as new Chairman of National Accountability Bureau (NAB).

According to details, Aftab Sultan has served as Director General of Intelligence Bureau.

The position of Chairman NAB had been unoccupied since the former chairman Justice (R) Javed Iqbal retired on Jun 2, 2022. Deputy Chairman Zahira Shah was performing as acting NAB head.

Aftab Sultan joined the police force as assistant superintendent of police (ASP) in 1977.

The incumbent government on Thursday approved the appointment of former director general of the Intelligence Bureau, Aftab Sultan, as chairperson of the National Accountability Bureau (NAB).

A federal cabinet meeting was held under Prime Minister Shehbaz Sharif wherein various issues were discussed, including the approval of former DGIB Aftab Sultan as NAB's new chairman.

Aftab Sultan's name, who has a reputation of being an honest officer, was suggested by the Pakistan People’s Party (PPP). He has earlier served as inspector general of the Punjab police and the commandant of the National Police Academy.

His father and mother-in-law have been members of the National Assembly twice. Aftab belongs to Faisalabad and started his career in the Police Service of Pakistan in 1977 as an assistant superintendent in Punjab police.

In a 2-1 verdict, the Supreme Court (SC) on Friday ordered to restore the corruption cases against public office holders that were withdrawn after amendments were made to the country’s accountability laws.

The reserved verdict was announced by a three-member bench comprising Chief Justice of Pakistan (CJP) Umar Ata Bandial, Justice Ijazul Ahsan and Justice Syed Mansoor Ali Shah on PTI Chairman Imran Khan’s 2022 petition challenging amendments made to the accountability laws.

CJP Bandial and Justice Ahsan declared Imran’s plea to be maintainable while Justice Shah disagreed with the majority verdict, according to which not just the corruption cases but also the inquiries and investigations were directed to be restored.

The court also declared some amendments to the accountability laws to be contrary to the Constitution and struck them down.

These included one which limited the National Accountability Bureau’s (NAB) jurisdiction to cases involving over Rs500 million and one which allowed the accused to claim the amount of plea bargain deposited after being acquitted.

The court directed that the cases that were withdrawn after NAB’s jurisdiction was limited to investigating cases below Rs500m be fixed for hearing in accountability courts.

The court also declared null and void the verdicts issued by the accountability courts in light of the amendments made to the laws.

It directed that the cases withdrawn as a result of the amendments be fixed for hearing in accountability courts within a week. The court further directed the NAB to send the records to the relevant courts within seven days.

This is fake judgment by the crooked Bundiyal. On the face of it looks a great decision but the reality is that Isa will either overturn it on appeal or if it stays the Generals will black mail the mafia into supporting their Junta. We have to face facts that there will be no justice, no money will be recovered and PK has legalised corruption.

“I had also suggested to hold proceedings of cases against the ruling party on a daily basis. My recommendations were not listened to at that time and now, everyone will bear the consequences of making wrong decisions.”

Abbasi said, “Cases will only be filed against politicians. The NAB was established 24 years ago and hundreds of [corruption] cases were filed but who has been sentenced till today.”

ISLAMABAD: The Supreme Court decision to strike down controversial amendments to accountability laws has re-empowered the National Accountability Bureau (NAB) to lay its hands on politicians and bigwigs involved in white-collar crime, involving less than Rs500 million, virtually reopening about 1,800 closed cases.

Other bigwigs whose cases have been reopened are former ministers Khawaja Saad Rafiq, Khawaja Asif, Rana Sanaullah, Javed Latif, Akram Durrani, Saleem Mandviwalla, Shaukat Tarin, Pervez Khattak, Amir Mehmood Kiani, Khusro Bakhtiar and Faryal Talpur as well as former chief ministers of Punjab and Sindh Hamza Shehbaz and Syed Murad Ali Shah.

An inside source in NAB told Dawn that the apex court’s decision has breathed new life into NAB and work has been started to assess the number of cases to be reopened and referred back to courts.

 
If cases proceed on merit in NAB then PPP will be most affected. Let's hope that NAB will made quick decisions in these cases and punished who involved in corruption
 
Resurrected’ graft cases back in court
ISLAMABAD: Cases that were closed as a result of amendments made in the National Accountability Ordinance (NAO) by the PDM government have been revived by accountability courts after the Supreme Court set aside the amendments last week.

An apex court bench, headed by former Chief Justice of Pakistan Umar Ata Bandial, had on Sept 15 declared the amendments void and directed the NAB to revive the closed cases within seven days.

NAB sources said that the cases had been returned to the accountability courts of Islamabad, Rawalpindi and Quetta.

NAB prosecution submitted the record of 80 cases to the accountability court, Islamabad.

It may be mentioned that the judges of two accountability courts were transferred as the amended law curtailed the NAB’s jurisdiction.

 
Army officers, judges ‘fully liable’ under NAB laws: Justice Shah

Supreme Court’s Justice Mansoor Ali Shah on Monday observed that members of the armed forces and judges of constitutional courts were “fully liable” under accountability laws.

He made this observation in a dissenting note for the apex court’s September 15 verdict wherein it struck down changes to the accountability laws and ordered the restoration of corruption cases against public office holders.

A three-member bench comprising then-chief justice of Pakistan (CJP) Umar Ata Bandial, Justice Ijazul Ahsan and Justice Shah had announced the verdict on PTI Chairman Imran Khan’s 2022 petition challenging amendments made to the National Accountability Bureau’s (NAB) laws.

Justice Bandial and Justice Ahsan had declared Imran’s plea to be maintainable while Justice Shah had disagreed with the majority verdict, saying that not just the corruption cases but inquiries and investigations should also be restored.

In the hearings towards the end of the case proceedings, Justice Shah had repeatedly urged for a full court to hear the case, citing the then-frozen Supreme Court (Practice and Procedure) law.

The top court is now set to hear the first-ever intra-court appeals (ICAs) against the majority judgement, which have been filed by the federal government and former SSGCL managing director Zuhair Ahmed Siddiqui.

In the detailed note issued today, Justice Shah concluded that Imran’s petition was “meritless”.

He noted that the petitioner’s counsel “utterly failed to clearly establish beyond any reasonable doubt that the challenged amendments in the NAB Ordinance are constitutionally invalid on the touchstone of ‘taking away’ or ‘abridging’ any of the fundamental rights”.

On the matter of members of the armed forces being held accountable, which had previously been discussed in multiple hearings of the case, Justice Shah noted that the “generally professed opinion that members of the armed forces and the judges of the constitutional courts are not triable under the anti-corruption criminal laws of the land, requires some clarification”.

He highlighted that such an understanding would “make the members of the armed forces and the judges of the constitutional courts untouchable and above the law”.

The same would be “reprehensible and revolting to the conscience of the people of Pakistan and bring the court into serious disrepute”, the judge added.

“We must, therefore, strongly shun the above generally professed opinion and be clear that members of armed forces and the judges of the constitutional courts are fully liable under the NAB Ordinance, like any other public servant of Pakistan,” he stated.
