Donald Trump is handing out pardons for money - is this legal?

(CNN)Allies and associates of President Donald Trump have collected tens of thousands of dollars in fees from those seeking pardons from the President, The New York Times reported Sunday.

The Times, citing documents and interviews with more than three dozen lobbyists and lawyers, reported that the lobbying for clemency intensified as it became apparent Trump had no standing to challenge his election loss to President-elect Joe Biden. Those who monetized the lobbying efforts include a former federal prosecutor, a former personal lawyer to the President and a former top Trump campaign adviser, among others, the Times reported.

As CNN previously reported, Trump has been expected to issue a flurry of pardons in the final days of his presidency and close business associates of the President and many high-profile criminals have ramped up efforts to secure a pardon before he leaves office.

As of late December, Trump was considering pardons for more than two dozen people in his orbit whom he believes were targeted -- or could be targeted in the future -- for political ends. That's in addition to hundreds of requests from others who have approached the White House directly, and tens of thousands more whose petitions are pending at the Justice Department.

According to the Times, former US attorney Brett Tolman has collected tens of thousands of dollars in recent weeks to seek clemency for several people. Tolman did not respond to the New York Times' request for comment. CNN has also reached out to Tolman for comment.

Former Trump attorney John Dowd has also accepted "tens of thousands of dollars from a wealthy felon and advising him and other potential clients to leverage Mr. Trump's grievances about the justice system," according to the Times. Dowd declined to answer questions to the Times and declined to comment on the report when reached by CNN Sunday.

And a former Trump campaign top adviser was paid $50,000 to secure a pardon for John Kiriakou, a former CIA intelligence officer who was convicted of illegally disclosing classified information in 2012, and agreed to a $50,000 bonus if the president granted it, according to a copy of an agreement obtained by the newspaper.

Kiriakou said, according to the Times, that an associate of Trump personal attorney Rudy Giuliani claimed the former mayor of New York could help with a pardon request for $2 million. Giuliani rejected those claims to the Times. CNN has reached out to Giuliani for comment Sunday.

The White House did not respond to CNN's request for comment Sunday and declined to comment to the Times.

The Times noted that "there is nothing illegal about Trump associates being paid to lobby for clemency" and that any explicit offers of payment to the President could be investigated for possible violations of bribery laws. There is no evidence, however, that Trump was offered money in exchange for a pardon, according to the newspaper.

Following Trump's reelection loss, calls and emails flooded into the West Wing from people looking to benefit. At one point, his staff was so inundated with requests for pardons or commutations that a spreadsheet had been created to keep track of the requests directed to Trump's close aides.

Trump has also discussed issuing pardons for himself and his children with new urgency since the attack on the US Capitol on January 6, multiple sources familiar with the matter told CNN. However aides and allies are concerned over the public perception of such a pardon following the violent insurrection, which led to the deaths of five people.

So far, the President has pardoned and commuted sentences of several people in his circle, including longtime friend Roger Stone, former campaign manager Paul Manafort and former 2016 campaign aide George Papadopoulos.

The simple question is, when Clinton, Bush and Obama gave pardons, were there any lawyers and lobbyists also collecting fees to plead their case with the administration?

We all know that Bill Clinton gave Democratic donor Marc Rich a pardon... for just being a donor.

If you read the NYT article, it sounds like Trump is doing something corrupt which had not happened before.

It may come as a surprise but US is pretty corrupt

Both legal and illegal

Trump isn't the only one doing it just look at some of the things people in congress do (forget the former presidents)

Just look at our millitary corruption there are also pretty crazy things happening there (like the story where they were selling 5 dollar equipment for $1000 and that's just the tip of the iceberg)

If it’s true, that was wrong as well. I think the whole concept is massively wrong and corrupt. Trump is expected to hand out 100 pardons tomorrow.

He has pardoned so many people convicted in the Russia probe and now he is figured out it’s a great way to make money.

It doesn't say anywhere he made any money. The lobbyists did. If you think Trump invented the US lobbying industry...
 
Not illegal, as the POTUS cannot be charged with a crime. He’s just gaming the system. It’s cynical, sharp practice.
 
Don't think A Presidential Pardon can be called Illegal but it sure is really cunning. Trump using his last days in office to bail out his allies, A businessman indeed.

In the final hours of his presidency, Donald Trump has pardoned 73 people, including his former adviser Steve Bannon, who is facing fraud charges.

Another 70 people had sentences commuted, ahead of Joe Biden's inauguration at noon (17:00 GMT).

Rapper Lil Wayne received a pardon and there were commutations for rapper Kodak Black and former Detroit Mayor Kwame Kilpatrick.

The president has not issued preemptive pardons for himself or family members.

Who are the key recipients of clemency?
Steve Bannon was a key strategist and adviser to President Trump during his 2016 campaign. He was charged in August last year with fraud over a fundraising campaign to build a wall on the US-Mexico border.

Prosecutors said Mr Bannon and three others defrauded hundreds of thousands of donors in connection with the "We Build the Wall" campaign which raised $25m (£18m). It was alleged Mr Bannon received more than $1m, at least some of which he used to cover personal expenses. He denies the charges and has yet to stand trial.

The White House statement said Mr Bannon had been "an important leader in the conservative movement and is known for his political acumen". It said prosecutors had "pursued" him with charges "related to fraud stemming from his involvement in a political project".

Lil Wayne, whose real name is Dwayne Carter, pleaded guilty to a federal weapons charge last year and has been pardoned. He posted a photo of himself with Mr Trump during the election campaign praising the president's work on criminal reform.

Kodak Black, who was also charged with firearms offences, had his sentence of three years and 10 months commuted. The White House statement praised his philanthropic work.

Kwame Kilpatrick was sentenced in 2013 to 28 years in prison on charges of racketeering, bribery and extortion in relation to his period as Detroit mayor from 2002 to 2008. His sentence is commuted - the White House said this was "strongly supported by prominent members of the Detroit community".

Anthony Levandowski received a full pardon from an 18 month sentence. He is a former Google engineer who admitted stealing secret technology related to the company's self-driving cars. The pardon says he had "paid a significant price for his actions and plans to devote his talents to advance the public good".

How and why is clemency issued?
It is common for outgoing presidents to issue pardons before they leave the White House.

A pardon cancels a criminal conviction, while a commutation shortens or ends a prison sentence.

When it comes to crimes charged in a federal court, the US president has virtually unlimited power to pardon.

There has been speculation Mr Trump could try to pardon himself or his family members ahead of any possible charges.

It is unclear whether he has the legal power to do so and there is no precedent of a US leader issuing such a pardon.

He does face a possible Senate impeachment trial for "incitement to insurrection", although dates have yet to be set for that.

Mr Trump has issued dozens of pardons in recent months. Many of those pardoned have been close associates and allies, such as former campaign manager Paul Manafort, long-time ally Roger Stone and his son-in-law Jared Kushner's father, Charles.

I wouldn't be that optimistic lol. The US has been this way for a long time, and they are only getting worse, as is the rest of the world. Intolerance, chaos, and immorality have become commonplace, unfortunately.
 
Obama, Bush, Clinton were all just as bad, they were just better and keeping things under the radar. Corruption is rife everywhere, money talks when your at the top.

True!

his problem is a bit magnified with the US and other civilized countries have governments with much more decency and ethicality.

I guess the whole conundrum with US is that the constitution promotes smaller governments, lesser regulations and laws and whatnot to promote capitalism and over time, people had found ways to exploit this freedom.
 
Federal investigators on Wednesday searched the apartment of Rudy Giuliani, Donald Trump’s personal lawyer, and seized his electronic devices according to multiple reports. The search indicates an escalation of federal investigators’ criminal investigation into Giuliani’s dealings in Ukraine.
