Rahul Dravid, who is currently the head of National Cricket Academy's (NCA) Cricket Operations, is the latest big name to get notice from BCCI's Ethics Officer on specific Conflict of Interest allegations levelled against him. BCCI's Ombudsman-cum-Ethics Officer Justice (Retd) DK Jain has sent a notice after receiving a complaint from Madhya Pradesh Cricket Association (MPCA) life member Sanjeev Gupta.

According to Gupta's complaint, Dravid is allegedly conflicted as he is the NCA Director and also employed as vice-president of India Cements group, which owns Indian Premier League (IPL) franchise Chennai Super Kings.

"Yes, I have sent a notice to Mr Rahul Dravid last week after receiving a complaint. He has been given two weeks to reply to the allegations of Conflict of Interest. Based on his reply, I will decide whether to proceed further or not," Justice Jain confirmed the development to PTI.

It is expected that Dravid will have to file his reply by August 16 and then might have to appear for an in-person hearing if Justice Jain deems it important.

Gupta is the same person, who had also filed similar Conflict of Interest complaints against Sachin Tendulkar and VVS Laxman for their dual roles as Cricket Advisory Committee member as well as mentor/icon of their respective IPL franchises - Mumbai Indians and SunRisers Hyderabad.

Both had categorically refused that they had any conflicts whatsoever. Tendlkar, in fact, in his affidavit said that he didn't take a penny from MI for his services.

Tendulkar had later made it clear that he won't like to continue unless he was given a proper Terms of Reference and Laxman in his reply had said that if his role of mentor was found to be conflicted with his responsibilities as CAC member, he was ready to quit.

The other member of the panel Sourav Ganguly also faced Conflict of Interest allegations levelled by one Bhaswati Santua for being the CAB president as well as the mentor of Delhi Capitals.

The CAC later became defunct and a new one was formed headed by Kapil Dev with Shantha Rangaswamy and Anshuman Gaekwad as its members.

The problem I think isn't the specifics of a situation but the lack of common sense that should have been applied while writing or enforcing this rule. Being a commentator and a selector have no logical conflict of interest, being involved in the ipl and being in a CAC which picks coaches again has little direct conflict of interest outside of sitting out the interview where if the coach from the specific team applies. Ganguly is the only one i think who is legitimately in conflict of interest given his multiple roles.

Of course you won't get paid on a leave of absence. What about before taking leave of absence?
We all know that compensation is tied in 'honorariums', 'gifts', 'travel expenses' etc etc. These are all ways to compensate someone. This would all need to be clarified.
Secondly, the issue is not money also, but the 'ability to influence' when you are in these positions of power. That would cause conflict.

Thats why its best to avoid multiple positions, esp. when the stakes are so high such as in the BCCI.

I am sure Rahul Dravid is a rich man and doesnt really need any money, so its not about money per se. Its about being in a position of power.

Some may show interest due to money, some may show interest out of respect given to them. If you are involved with an organization, (paid or unpaid), there will be a attachment involved whether one likes it or not. And this attachment will bring out the conflict of interest in cases like this.

he Committee of Administrators (CoA) on Tuesday cleared Rahul Dravid's appointment as Head of Cricket at the National Cricket Academy (NCA), ruling that there is "no conflict of interest" case against the former India captain.
Lt General Ravi Thogde, the new member of the CoA, said the ball is now in BCCI Ombudsman-cum-ethics officer DK Jain's court.

"There is no conflict on Rahul's case. He has got a notice and we have cleared his appointment. We had seen no conflict, but if the Ombudsman finds any conflict, we will give our response to the Ombudsman stating why we found no conflict," Thogde said after a CoA meeting here.

"After that he (Ombudsman) has to consider. It's a process and it will continue."

Dravid, one of the most respected figures in Indian cricket, found himself embroiled in a conflict of interest case after his appointment at NCA since he is an employee of India Cements which owns the Chennai Super Kings franchise in the IPL.

Dravid, who was in Mumbai prior to Tuesday's CoA meeting, has sent his reply to Jain but it could not be ascertained if he has resigned from his post.

While appointing him, the CoA had made it clear that Dravid will have to relinquish his post as vice-president of India Cements or be on leave until he completes his tenure.

Dravid did not resign, instead, he sought leave without pay from India Cements, prompting MPCA life member Sanjeev Gupta to persist with his complaint against Dravid.

Thogde stressed that the NCA needs to be of international standard under Dravid.

"There are a few things that needs to be done at the NCA. There are shortage of grounds and staff, including coaches. There has to be continuity.

"Someone of Dravid's stature will have to ensure that the NCA is of international standard. He has given his vision and we are fully in support of his vision. We will work together."

The CoA also discussed the upcoming BCCI elections in Tuesday's meeting, besides the appointment of various coaches of the national team.

"We discussed about the upcoming elections. There were discussions with (Electoral Officer) N Gopalaswami and certain things have been resolved. A code has been drawn out," Thogde said.

Asked about the state cricket bodies which are yet to come on board for the elections, he said, "There will be minor delays but there is still ample time. We just took a review and most of them will join by then."

"I don't see such a great difficulty in getting it done. Some of them are yet to register their constitutions. More than 24-25 bodies who have fallen in line. The intentions are to hold the elections around the date which has been set (October 22).

"Rest of the issues discussed are administrative, related to selection of head coach and selection of other coaches. Interviews will start now. Short-listing has already been done."

The Committee of Administrators (CoA) chief Vinod Rai has acknowledged that there exists a difference of opinion on the conflict of interest issue as interpreted by BCCI's Ombudsman-cum-Ethics Officer Justice (Retd) DK Jain and the CoA. Jain had sent notices to legendary cricketers like Sachin Tendulkar, Sourav Ganguly and Rahul Dravid, which in turn has not gone down well with many in the Indian cricket fraternity. "The CoA has a difference on the way the conflict of interest has been interpreted. We have a Supreme Court-appointed ombudsman and he took a view on it. It was very justified because the way he interpreted, he must have seen it right legally," Rai said while speaking in an interview to Times Now.

"It was given to us. We raised the issue with him that we need some clarifications on this application of conflict of interest because we do not see the way it has been interpreted. So, we brought it to his notice and we have gone to the Supreme Court.

"Whether it's a Sachin Tendulkar, Sourav Ganguly or VVS Laxman, it's not the issue of being an icon. The issue is the game has to be played with a certain amount of credibility," he added.

The CoA chief further said he believes that the Supreme Court will provide clarity on the issue so that no problem arises when it comes to the case of conflict of interest and its interpretation.

"We have sought from the Supreme Court that up till now, there's been no interpretational issue, it was only on this conflict of interest."

"We have a viewpoint on it and we have placed it before the Supreme Court so that, what is called to be a grey area, is converted into black and white. There are no two ways about it. Supreme Court will come out with a clear verdict."

He also asserted that the day BCCI elections are held (as per schedule, it is to be held on October 22), the CoA will demit the office. "There is no place for a committee of administrators after an elected body has been put into place."

He also claimed that the Board of Control for Cricket in India has not been losing on any revenue from the ICC.

The BCCI Ethics Officer DK Jain has made it clear to the board that former India skipper Sourav Ganguly has tractable conflict and must relinquish his interests and must not continue in more than one position. In a mail accessed by IANS, Jain has given the Cricket Association of Bengal (CAB) president the benefit of doubt, but has also gone on to explain that he must not hold more than one position.

“In the instant case, having regard to the afore noted stand of Mr. Ganguly, viz (i) that if it is found by the Ethics Officer that his presence in the CAC (Cricket Advisory Committee) has resulted in a “conflict of interest” situation, as envisaged in Rule 38 of the Rules, his Reply in these Complaints may be treated as his resignation there from immediate effect and (ii) that his involvement with the IPL Franchise has come to an end in May 2019, I declare that in the present case the “Conflict of Interest” is tractable, he wrote.

Ganguly faced the music for being the Cricket Association of Bengal (CAB) president as well as the mentor of Delhi Capitals. Ganguly had earlier voiced his resentment against the clause and asked for further clarity, rather than creating exceptions for certain cricketers. But Jain made it clear Ganguly would have to make his mind about not performing duel duties.

“Although it is trite law that the ignorance of the law is no excuse and, Mr. Ganguly was obliged to disclose the requisite information as stipulated in Rule 38(2) of the Rules, but bearing in the mind the fact that the Rules have come into existence only after August 2018, I am inclined to give benefit of doubt to Mr. Ganguly that perhaps he may not have realised that his occupying the said three posts did involve “Conflict of Interest”, the mail further stated.

“Accordingly, I direct the BCCI to ensure that Mr. Sourav Ganguly relinquishes his interests, which give rise to “Conflict of Interest” and does not continue to occupy more than one post as enumerated in Rule 38(4) of the Rules at any given point of time.”

Ganguly also does broadcasting work but does not see his commentary stint with a renowned broadcaster as a conflict.

Former India captain Rahul Dravid would depose before BCCI Ethics Officer D K Jain on Thursday to explain the conflict of interest allegations against him. Dravid is currently the Director of National Cricket Academy (NCA) in Bengaluru, besides being a vice-president in the India Cements group, which owns the IPL franchise Chennai Super Kings. The 46-year-old former batting mainstay was the head coach of the India A and Under-19 teams before being handed the NCA role, which includes monitoring the progress of these two sides as well.

The complaint against Dravid, by Madhya Pradesh Cricket Association (MPCA) life member Sanjeev Gupta, alleging that there is conflict in interest in Dravid's role as NCA head and being an India Cements employee.

Dravid has already given a reply and defended himself saying he has taken leave of absence from employers India Cements and he has nothing to do with the Chennai Super Kings.

Similarly, BCCI employee Mayank Parikh has been asked to depose before the Ethics Officer on Thursday.

Parikh, who too faces of conflict of interest allegations.

A part of the operations team in the BCCI, Parikh is also associated with multiple clubs, with voting rights, in the Mumbai Cricket Association (MCA).

Dravid's hearing will be in the morning, followed by Parikh's. As per the BCCI constitution, no individual can hold more than one post at the same time. The BCCI Ethics Officer would give his judgement based on the hearing on Thursday.

New Delhi: Hours after the Board of Control for Cricket in India (BCCI) Ethics Officer D.K. Jain sent a notice to the Cricket Advisory Committee (CAC) comprising of Kapil Dev, Anshuman Gaekwad and Shantha Rangaswamy with regards to allegations of conflict of interest, as claimed by MPCA life member Sanjeev Gupta, Rangaswamy has resigned from her position in the CAC.

Speaking to IANS, the former India cricketer said that people complaining is fine, but if the Ethics Officer picks up every complain, then it creates a difficult scenario and getting former cricketers to come into administration will be difficult.

“I gave my resignation from the CAC, as also the directorship of the players association. Last night I mailed it to the concerned authorities. Now, I can understand individuals complaining. But if the Ethics Officer acts on that, then it is not worth continuing. And I think one of the pressing demands for the new BCCI committee will be to provide clarity on this conflict of interest clause and from where are they looking to get eligible cricketers in key committees,” she rued.

Rangaswamy went on to add that the notice to the trio on Saturday wasn‘t the first time that former players have been pulled up. She feels that this must stop. In fact, she is shocked that someone like Rahul Dravid has been pulled up for looking to work towards bettering the future of Indian cricket.

“See, they first pulled up Sourav Ganguly, Sachin Tendulkar and VVS Laxman. Now to Kapil, Anshu and me. Trying to target Rahul Dravid for training the future cricketers of India? If this is the scenario, most former cricketers will not prefer to be associated with the BCCI. Why give room for the speculations and all, so thought best is to resign in the interest of the game,” she explained.

The legal team of the BCCI under the Committee of Administrators had given the trio a green light to be a part of the CAC and appoint the new head coach of the Indian team.

BCCI ethics officer D K Jain on Sunday said he is examining a conflict of interest complaint against India captain Virat Kohli from Madhya Pradesh Cricket Association life member Sanjeev Gupta, who has levelled similar charges against other players in the past which were deemed “infructuous”.

In his latest complaint, Gupta has alleged that Kohli is conflicted as he occupies two posts -- captain of the Indian team and director of a venture which has co-directors linked to a talent management company that has on board, several of his teammates.

Gupta has alleged that it is a violation of the BCCI constitution which bars one individual from holding multiple positions.

“I have received a complaint. I will examine it and then see if the case is made out or not. If yes, then I have to afford an opportunity to him (Kohli) to respond,” Jain told PTI.

Gupta claims that Kohli, who is one of the directors at Cornerstone Venture Partners LLP and Virat Kohli Sports LLP, is conflicted as his co-directors -- Amit Arun Sajdeh (better known as Bunty Sajdeh in Indian cricket circle) and Binoy Bharat Khimji --, are also a part of the talent management company Cornerstone Sport and Entertainment Private Limited.

Kohli does not have a role in Cornerstone Sport and Entertainment Private Limited.

The company manages the commercial interests of the India skipper and his many other teammates including K L Rahul, Rishabh Pant, Ravindra Jadeja, Umesh Yadav and Kuldeep Yadav.

“In view of the above, Shri Virat Kohli is occupying two posts at a time in blatant violation to BCCI Rule 38 (4) approved by Supreme Court Of India. As such, he must relinquish his one post at once in compliance...,” wrote Gupta in his complaint.

It is the first high profile complaint Jain has received since he got a one-year extension last month.

In the first year of his job, Jain had dealt with the conflict of interest complaints against Indian cricketing greats Rahul Dravid, Sourav Ganguly, VVS Laxman and Kapil Dev.

All of these came from Gupta and the iconic former players had to resign from one position before the complaints were rendered “infructuous” BCCI President Sourav Ganguly has already stated that the conflict of interest norms as prescribed by the Lodha Committee are unrealistic.

Cornerstone Sport and Entertainment, Virat Kohli’s managers for over a decade, have refuted charges of conflict of interest against the India captain.

“This is with reference to the recent “conflict of interest” speculations surrounding Virat and Cornerstone. It is unfortunate to repeatedly see Virat’s name being dragged into absurd allegations every now and then. Such speculations are based entirely on conjecture, nothing more,” said Cornerstone CEO Bunty Sajdeh in a media release.

Sajdeh was reacting to a complaint by Sanjeev Gupta with the BCCI ethics officer DK Jain that Kohli violated rule 38 (4) in the BCCI rulebook, pertaining to conflict of interest.

In his complaint, Gupta has said that Kohli’s co-directors at Virat Kohli Sports LLP and Cornerstone Ventures Pvt Ltd also hold the same position in Cornerstone Sports and Entertainment Pvt Ltd, a company that has India cricketers as clients. The complaint also mentions Chisel, a chain of gym and fitness centres, jointly owned by Kohli, with CSE, a subsidiary of Cornerstone Sport & Entertainment.

Sajdeh said Kohli is nothing more than a contracted client like all other cricketers. “Virat is a contracted, exclusive client of Cornerstone exactly like the rest of our esteemed talent roster. And as a responsible agency, we once again reiterate that there is no question of any conflict of interest with Virat or any other of our talent for that matter.

“Third parties with whatever vested interests prefer to think otherwise. I request them to simply check all facts before jumping to their own conclusions. We carry out our business in a very professional and transparent manner which can be easily verified from the documents filed with public authorities from time to time. This is all we have to say on this matter once and for all.”

Jain has said he is examining the complaint before deciding if a case is made against Kohli.

Dubai: The ticklish issue of conflict of interest came back to bother Indian cricket once again with allegations being raised against Virat Kohli and Sourav Ganguly, the Indian captain and president of Board of Control for Cricket in India (BCCI), respectively.

Sanjeev Gupta, a member of the Madhya Pradesh Cricket Association, has complained to BCCI that Kohli’s various posts are in violation of the BCCI rules that bar an individual from holding multiple positions. According to him, Kohli’s co-directors at Virat Kohli Sports (LLP) and Cornerstone Venture Partners (LLP) were also directors in Cornerstone Sport and Entertainment Private Limited, a leading sports management company that has several current Indian cricketers as their clients to handle their branding and commercial interests.

“I have received a complaint. I will examine it and then see if the case is made out or not,” D.K. Jain, ethics officer of the Indian board was quoted as saying by the Indian media. “If yes, then I have to afford an opportunity to him (Kohli) to respond.”

The leading cricketers whose portfolios are being handled by Cornerstone currently are KL Rahul, Ravindra Jadeja, Rishabh Pant, Kuldeep Yadav, Umesh Yadav and the young batsman Shubman Gill. Kohli’s long relationship with Cornerstone, which had signed him up as an youngster around 2008, is quite well documented in the cricketing circles.

Incidentally, this is not the first time that an Indian captain had been at the receiving end of such complaints. Mahendra Singh Dhoni, Kohli’s predecessor, was reported to be a stakeholder at Rhiti Sports Management Private Limited - a Delhi-based sports management firm which were also handling the commercial interests of a number of prominent players in the national team as well as the marketing rights for IPL franchise Chennai Super Kings. A three-member probe committee, including the then BCCI president Jagmohan Dalmiya, was constituted and Rhiti’s defence was they had bought back the shares from Dhoni.

Meanwhile, Ganguly, against whom charges of ‘conflict of interest’ were raised before he took charge of the BCCI, found himself in the centre of another controversy over his role as the brand ambassador of JSW Cement (Jindal Steel Works). He, on Saturday, posted a picture on Instagram where he was seen wearing a JSW t-shirt apart from appearing in a TV commercial of the company alongwith Indian football captain Sunil Chhetri.

JSW Sports, the sports arm of the business conglomerate JSW Group, co-owns the Delhi Capitals franchise in the Indian Premier League (IPL) with the GMR Group. Ganguly had even served as the mentor of the Delhi Capitals side in 2019 season and helped them qualify for the play-offs after seven years. However, he had stepped down from the post before taking over as BCCI president.

Clarifying his position on the subject, Ganguly told the Indian media: “How do I influence? I am not brand ambassador of JSW Sports (which handles Delhi Capitals in IPL). Ganguly endorsing brands has raised eyebrows in some circles. And before the AGM, reports had emerged that some members of the board members were planning to ask Ganguly to come clear on the issue of him endorsing a brand that is the BCCI sponsors' competitor.

But nothing of that sort happened during the 89th annual meeting of BCCI in Ahmedabad. "Not a single question was asked and contrary to a particular media report, it was never a topic of discussion," a state unit member said.

Ganguly, who promotes My11Circle that directly competes with Dream11, remains in the headlines.

"Ganguly is legally in the clear and as far as asking questions is concerned, the BCCI never questioned erstwhile N Srinivasan after his son-in-law was arrested for alleged spot-fixing in 2013. That was way more grave," the BCCI member added.

It was also learnt that the general body decided in favour of Ganguly continuing as a director in the ICC Board.

Secretary Jay Shah will be the alternate director as well as India's representative at the Chief Executive Committee meets of the global body. The formal stamp will be given by office-bearers as per the General body's decision.

Tendulkar (or indeed any other player to my knowledge) weren't involved in any sponsorship negotiations though. The Board president, unfortunately, is in a much more privileged position. The thing I find hilarious is that Ganguly is pretty brazen about it all, and to be fair, I would expect nothing else from a Srinivasan protégé.

Bcci sponsorship are decided by open tendering. And Ganguly got these sponsors after Bcci had signed up their sponsors.

Conflict would be if Bcci and Ganguly had same sponsors and not different ones. As someone mentioned, legally Ganguly is in the clear and anyone can approach the BCCI ombudsman if they feel Ganguly is doing something illegal.

Ganguly belongs to anti Srini regime and is a protege of Dalmiya.

Speaking at the Indian Express’ Express E Adda, former India coach lashed out at people dragging BCCI to courts on the name of Conflict of Interest, adding that he is not able to commentate or coach in IPL. He cited the example of Ricky Ponting, saying the Aussie cricketer speaks freely during his commentary stints at BBL and no one questions him.

“It is over the top this conflict of interest. I was not really for it. A masseur with the Indian team cannot work with an IPL team. Conflict of interest is absolute nonsense. It should be thrown into the bin. For me to not be allowed to do commentary if I am India coach, how is that conflict of interest?”

He added that surge in Conflict cases are hindering game’s progress as cricketers like Sachin Tendulkar aren’t able to comeback and contribute to the game as there is always a possibility of someone dragging him to the court with the ‘C’ word.

“Ever since it came out in Lodha report, I was against it. You aren’t giving your cricketers a chance. It’s absolutely nonsense, this conflict of interest clause, should be thrown into the bin,” he added.

Shastri had been in the bio bubble for months and he had made it clear that he wanted to leave the job because of stringent Covid protocols. When asked about his future plans or a possible coaching role in IPL 2022, he said: “I have just got out of the bubble. I have not discussed anything with anybody. I want to later come back to what I love. TV and media. I just want to coach on a grassroots level now.”

He also said that politicians in the country have done a good job administering cricket. “Politicians have done an excellent job in administering cricket in India. BCCI is one of the most efficient boards over the last 40 years.”

When asked about the recent spat between Virat Kohli and Sourav Ganguly, he replied that the matter could have been handled better, adding that he has got nothing personal against the Bengal icon. “I see no residue. Just events and you react to those events. That aside, we are cricketers. Both of us know the game. That does not mean we will agree on anything. Interacted with Ganguly many times. With good communication, the Indian team situation can be handled better.”

Tbh it's fair what he's saying. Just barring coaches and support staff makes no sense.

Look it's no secret the likes of Dhoni, Rohit and Kohli too have used their influence to get players from their IPL teams India cap over the years. It's only natural as they see those domestic players first-hand and think they can do the same job for national team.

Sometimes their judgement could be wrong, but if you're entrusting them to lead the team, you can't tie their hands.

Conflict of Interest is something that should be viewed in context like when Dhoni was linked with a sports management company that was managing players in his squad while he was captain. Now that is something that can't happen.

Blanket banning something is just being lazy/stupid.
