‘Demographic flooding’: India introduces new Kashmir domicile law

Srinagar, April 02 (KMS): The Indian government has announced a new set of laws for Indian occupied Kashmir, including domicile rights for Indian citizens, that experts and residents fear will alter the demographic status of the Muslim-majority Himalayan region.

Under the new law, those who have resided for a period of 15 years in the Indian Occupied Kashmir (IOK) or studied for a period of seven years and appeared in Class 10/12 examinations in educational institutions located in the region are now eligible to become permanent residents. The announcement came nearly eight months after the Indian government stripped the disputed region of its limited autonomy that had protected the region for decades from demographic changes.

The new law announced by the Ministry of Home Affairs also provided domicile status to the children of central government officials who have served in IOK for a total period of 10 years. The notification by India’s Hindu nationalist government comes as the country of 1.3 billion people is under a 21-day lockdown due to coronavirus fears.

The government changed the geographical and political status of the IOK on August 5 after it abrogated Article 370 – a law that restricted rights over jobs, scholarships and land to the permanent residents of the valley.

While the law has triggered fear among Kashmiris about the “permanent settlements by the outsiders”, the experts say it will lead to “demographic flooding”. “It is a lot to circumvent the law. I think it illustrates clearly that some will not stop from politicking during coronavirus,” Siddiq Wahid, a political analyst based in the IOK told a foreign media outlet, referring to the current coronavirus crisis.

“Obviously it is an attempt to change the demographics, not only change but flood it. It will lead to demographic flooding,” Wahid said. He said the change of law “is much larger than [the issue of jobs]”. “I am not even thinking about jobs.”

Sheikh Showkat Hussain, professor of legal studies based in the region, said: “It was in the offing.” “The whole purpose of revoking Article 370 was to settle outsiders here and change the demography of the state. Now this provides the modalities and entitles so many categories of Indians whose settlement will be legalised over here.”

According to the new law, jobs up to the lowest level of non-gazetted rank are reserved for Jammu and Kashmir domiciles. Khurram Parvez, a human rights defender based in the region, said: “By virtue of this order, outsiders are also going to be the claimants of jobs in Jammu and Kashmir, which already has a huge unemployment problem. This is an act against the interests of unemployed youth.”

Whilst the whole world fights against Coronavirus, extremist Modi thinks that introducing a new set of laws in IOK is the need of the hour.
 
Demographies will change for sure. Since article 370 has been revoked, Indians from all over the country will be settled in Kashmir overtime. The Muslim-majority status of Kashmir will be history and kashmir will be fully integrated with rest of the country.

There will also be separate townships for the displaced kashmiri Pandits. Modi will end the monopoly that Muslims have enjoyed over kashmir.

Jammu division has become hindu majority , kashmir should have at least 50% hindu

So this law means that all army men & their children who stayed for more than 10 years in kashmir can be called local resident & he can vote , can work in govt. positions

This law is major game changer in changing demographics for sure !

India on Saturday dismissed Pakistani Prime Minister Imran Khan’s remarks on New Delhi’s new domicile law for Jammu and Kashmir as an attempt to interfere in India’s internal affairs.

“We have seen the intemperate remarks by Pakistan Prime Minister Imran Khan on India. With regard to the Indian Union Territory of Jammu & Kashmir, it is very clear that Pakistan has no locus standi whatsoever on any aspect pertaining to it,” said Raveesh Kumar, spokesperson of the ministry of external affairs.

“Repeated attempts to interfere in India’s internal affairs will not make its untenable claims any more acceptable. If Pakistan really wants to contribute to the welfare of the people of Jammu and Kashmir, it could do so best by ending cross-border terrorism and desisting from its campaign of violence and false propaganda,” he said.

Earlier this week, Imran Khan in a series of tweets, had condemned India for issuing rules allowing non-Kashmiris to become permanent residents in Jammu and Kashmir.

Under the new rules, people from outside Jammu and Kashmir who have been residents of the Union Territory 15 years, will be treated as domicile residents. The notification also extended domicile rights to central government employees who shall have served in the state for 10 years and their children.

ISLAMABAD: The Foreign Office on Sunday dismissed as irresponsible remarks by the Indian Ministry of External Affairs on Prime Minister Imran Khan’s tweet condemning the recent Indian steps to illegally change the demographic profile of India-occupied Jammu and Kashmir.

Spokesperson Ayesha Farooqui said the latest Indian action, aimed at further usurping the fundamental rights of the Kashmiri people through changing the domicile law at a time when the world is busy fighting COVID-19 pandemic, once again betrays the BJP leadership’s rank political opportunism and moral bankruptcy.

“India’s incessant regurgitation of the claim that Occupied Jammu and Kashmir is an “internal affair” will neither turn this falsehood into truth nor make this illegality legally valid,” she said in a statement.

“The IOJ&K is an internationally recognized “disputed” territory, as enshrined in the relevant United Nations Security Council Resolutions. These Resolutions stipulate that the final disposition of the State of Jammu & Kashmir will be decided through the democratic method of a free and impartial plebiscite under the UN auspices,” the statement read.

She said no amount of Indian sophistry could obfuscate India’s state-terrorism in IOJ&K and the RSS-inspired “Hindutva” agenda being imposed by the BJP Government and nor would India’s use of brutal force ever succeed in breaking the will of the Kashmiri people fighting for their inalienable right to self-determination.

anybody can get citizenship if they reside in india for 12 years, if they matched this criteria.
Any genuine Kashmiri whether it’s a buddhist, Jain, Muslim, Christian or Hindu should not be worried with this. Of course some out of state terrorists need to be worried.

What if kashmir valley has hindu majority in future like jammu division and then india says 'ready for referendum' then what will be pakistan's position ? Will they agree for referendum as per UN resolutions at that point in future ?

The fact that a court in Pakistan even found these guys to be innocent is what is being pointed out.

At this point it seems like damage control.

I am asking a simple question.

The answer is either yes or no. I am not getting why its so difficult for you to answer and i had to repeat myself 3 times over the same question.

But i am not the person who tries to avoid answering. In order to answer your question, its a bi lateral issue but india doesn't give damn about what Pakistan thinks.

Its like a clash between a husband and wife. Neighbors can't intervene because its a husband wife bi lateral issue. But that doesn't make the husband or wife forced to do whatever the whining one wants.

Pakistan is in no position except giving some tweets. Kashmir annexation was legal. Instead of crying now, Pakistan should have thought over that when separation was going on. Once it was legally annexed, there's no way any country will give up its land.

JEDDAH: The Organisation of Islamic Cooperation's (OIC) human rights body on Sunday condemned the "unrelenting vicious Islamophobic campaign in India maligning Muslims for spread of COVID-19", the disease caused by the novel coronavirus.

In a statement issued Sunday, the OIC's Independent Permanent Human Rights Commission (IPHRC) also condemned the "negative profiling [of Muslims in India] in media subjecting them to discrimination & violence with impunity".

The international body called upon the Prime Minister Narendra Modi-led government to take notice of and "take urgent steps to stop the growing tide of Islamophobia in India".

The Indian government should "protect the rights of its persecuted Muslim minority as per its obligations" under international human rights laws, it added.

Prime Minister Imran Khan, too, had earlier in the day tweeted about India's wicked tactics earlier in the day, comparing the Narendra Modi-led government to the Nazis.

"The deliberate & violent targeting of Muslims in India by Modi Govt to divert the backlash over its COVID19 policy, which has left thousands stranded & hungry, is akin to what Nazis did to Jews in Gerrmany," PM Imran wrote.

An New York Times report earlier this week said the outbreak of coronavirus in India had triggered a series of attacks against Muslims across the country, with the health ministry of Modi's Hindu nationalist government claiming that Muslims were spreading the virus.

“Young Muslim men who were passing out food to the poor were assaulted with cricket bats. ... Other Muslims have been beaten up, nearly lynched, run out of their neighborhoods or attacked in mosques, branded as virus spreaders,” the paper said.

It highlighted that Hindu extremists were scapegoating the country’s entire Muslim population for deliberately spreading the virus through “corona jihad”.

Earlier, Indian author and activist Arundhati Roy had told Deutsche Welle (DW) the New Delhi government was trying to instigate communal rifts as it was exploiting the coronavirus issue against its minority Muslim community.

The author had said "the situation is approaching genocidal", telling the foreign publication that the coronavirus pandemic had laid bare the facet of India that "all of us knew".

"We are suffering, not just from COVID, but from a crisis of hatred, from a crisis of hunger,” she had said, adding that the world needs to keep its eyes on the matter of anti-Muslim hatred in India.

Linking the fresh wave of singling out Muslims during the pandemic to the recent Delhi riots, she had said it began with people protesting against the anti-Muslim citizenship law. Under the guise of COVID-19, the Hindu nationalist government was arresting young students and fighting cases against lawyers, media personnel, activists, and intellectuals.

Roy had termed the current wave of vitriol against Muslims tantamount to the one by Nazis during the Holocaust.

Princess slams Indian expat for targeting Muslims

Earlier this week, Princess of Sharjah and Emirati businesswoman Sheikha Hend bint Faisal Al Qassemi had slammed an Indian expatriate for targeting Muslims and claiming that Hindus were facing a hard time in the Middle East.

Saurabh Upadhyay had further said Hindus had built cities such as Dubai from scratch and had big stakes across major ventures in the Middle East. He had also criticised Muslims the Tablighi Jamaat incident in New Delhi.

In response, the princess had said: "You make your bread and butter from this land that you scorn and your ridicule will not go unnoticed.

India on Sunday rejected criticism by Pakistan’s top leadership of the “deliberate and violent targeting of Muslims”, saying such remarks were an attempt to shift focus from Islamabad’s “abysmal handling” of its internal affairs.

Pakistan Prime Minister Imran Khan and the Organisation of Islamic Cooperation (OIC) had criticised what they described as the deliberate targeting of Muslims by the Indian government against the backdrop of the Covid-19 pandemic.

External Affairs Ministry’s spokesperson Anurag Srivastava rejected the criticism by saying: “The bizarre comments by the Pakistani leadership are an attempt to shift focus from the abysmal handling of their internal affairs. Instead of concentrating on fighting Covid-19, they are making baseless allegations against their neighbours.”

In a reference to incidents of the oppression of Pakistan’s Hindu minority, Srivastava said, “On the subject of minorities, they would be well advised to address the concerns of their own dwindling minority communities, which have been truly discriminated against.”

Khan had followed up on tweets by the Independent Permanent Human Rights Commission of the OIC and compared the Indian government’s treatment of Muslims to “what Nazis did to Jews in Germany”.

“The deliberate & violent targeting of Muslims in India by Modi Govt to divert the backlash over its COVID19 policy, which has left thousands stranded & hungry, is akin to what Nazis did to Jews in Germany,” Khan tweeted.

In a tweet, President Arif Alvi, a close aide of Khan, accused the Indian government of suppressing the Kashmiri people through “extreme violence, torture and oppression”.

In recent months, Khan has repeatedly criticised the Indian government’s attitude towards the country’s Muslim minority and the external affairs ministry has pushed back against his remarks, describing them as interference in India’s internal affairs. The Indian side has also targeted Khan for failing to counter cross-border terrorism emanating from Pakistani soil.

India’s foreign minister was invited as a special guest to a meeting of foreign ministers of OIC states in the UAE last year, marking a high point in New Delhi’s often testy relations with the Islamic grouping.

However, in recent months, the OIC has repeatedly criticised the Indian government’s handling of the situation in Kashmir and attacks on Muslims. The external affairs ministry has rejected this criticism.

Kashmir journalist charged for 'anti-national' social media posts

Outrage in Kashmir as photojournalist Masrat Zahra, 26, is booked under stringent Unlawful Activities (Prevention) Act.


Pulwama, Indian-administered Kashmir - Police in Indian-administered Kashmir have booked a female photojournalist under the stringent Unlawful Activities (Prevention) Act (UAPA) for indulging in "anti-national activities" on social media.

Masrat Zahra, a 26-year-old photojournalist from the region's main city of Srinagar, is accused of "uploading anti-national posts [on Facebook] with criminal intentions to induce the youth".

A statement by Srinagar's Cyber Police Station on Saturday said it received information through "reliable sources that one Facebook user namely 'Masrat Zahra' is uploading anti-national posts with criminal intention".

"The Facebook user is also believed to be uploading photographs which can provoke the public to disturb law and order. The user is also uploading posts that tantamount to glorify the anti-national activities and dent the image of law enforcing agencies besides causing disaffection against the country," it said.

Police said a first information report (FIR) was filed on Saturday and an investigation is on. She has been summoned before the police on Tuesday.

The UAPA allows the government to proscribe individuals as "terrorists" and empowers the federal National Investigation Agency to probe such cases.

A person charged under the law can be jailed for up to seven years.

Zahra on Monday told Al Jazeera over the telephone that the police and government are trying to "muzzle the voices of journalists in Kashmir".

"Police has nowhere mentioned that I am a journalist. They have said that I am a Facebook user," she said.

Zahra said she had been charged for posting her already-published works over the years, calling the allegations "shocking".

"I have been sharing my archival images which have already been published in different Indian and international organisations on social media for which I'm being booked," she said.

Zahra's work has appeared in several publications including The Washington Post, The New Humanitarian, TRT World, Al Jazeera, The Caravan and others.

'Gags against media'
Meanwhile, journalists from the region have reacted strongly to the charges against Zahra.

In a statement released on Monday, the Kashmir Press Club condemned the charges against her and other journalists from the region, and demanded intervention by India's Home Minister Amit Shah.

"It is very unfortunate that when the world is in a grip of pandemic and when we need to stand together to combat the COVID-19, police has started filing cases against journalists and harassing them," it said.

"This is unacceptable for journalists of Kashmir who are well within their rights to seek freedom of expression and speech as guaranteed under the constitution like other parts of the country."

Kashmiri journalist Gowhar Geelani told Al Jazeera that "invoking stringent provisions of a draconian law" against Zahra "speaks volumes about the gags against media to silence journalists, to control the narratives by use of force, and to contain the Kashmir story with lawlessness".

Muzamil Jaleel, deputy editor of New Delhi-based The Indian Express newspaper, tweeted that Zahra has "honestly told stories of Kashmir in a four-year career".

"Invoking UAPA is outrageous. In solidarity with our colleague, we demand FIR withdrawn. Journalism isn't crime. Intimidation/censorship won't silence Kashmir's journalists," he posted.

India has sought to take advantage of the world's preoccupation with the coronavirus crisis to further push its "Hindutva" agenda in Indian-occupied Kashmir including by attempting to alter the region's demography, the Foreign Office (FO) said on Tuesday.

Referring to India's new domicile law, under which an Indian citizen who has lived in occupied Jammu and Kashmir for 15 years can call the territory their place of domicile, FO Spokesperson Aisha Farooqui said the changes "represent another opportunistic move by the RSS-BJP dispensation to advance their sinister aim of effecting a demographic change in the occupied territory".

"Pakistan and the Kashmiris have firmly rejected these Indian machinations in the past and will continue to do so in the future," she added in a statement.

The FO also categorically rejected what it termed "baseless" Indian allegations of “infiltration attempts” by Pakistan and "unfounded claims" that Indian troops have targeted “launching pads” across the Line of Control (LoC).

The statement also rejected the "provocative statements" of Indian Defence Minister Rajnath Singh, including his recent claim that India is “dominating the enemy”.

"There is nothing new about Mr Rajnath Singh’s delusions; nor about his belligerent anti-Pakistan rhetoric," the statement said, adding that it was obvious that the "Indian propaganda machine is in over-drive".

According to the handout, the repeated Indian allegations were aimed at diverting the world's attention from India’s "state-terrorism and grave human rights violations" in occupied Kashmir. It said India also seeks to use these allegations as a pretext for “false flag” operations which Pakistan has been sensitising the international community about.

"India’s belligerence continues to imperil peace in the region," the statement said, noting that India had committed 882 ceasefire violations in 2020 alone and "deliberately targeted innocent civilians" living close to the LoC in Azad Jammu and Kashmir (AJK)

Meanwhile in occupied Kashmir, Indian forces have been targeting the youth in the garb of "so-called cordon-and-search operations", the FO said, adding that in April alone, 29 Kashmiris have been martyred, including seven since the onset of Ramazan.

The statement also criticised India for the harassment and intimidation of Kashmiri journalists, saying it has further intensified under the notorious “Unlawful Activities Prevention Act”, while Indian forces continue to operate with "complete impunity".

"On the other hand, continued communications restrictions and lack of unfettered access to medical and other essential supplies are compounding the Covid-19 situation for the Kashmiris in IOJ&K," the statement noted.

The FO asked India not to underestimate "the resolve of the people and the armed forces of Pakistan to thwart any aggressive design".

"Our immediate and effective response to India’s Balakot misadventure clearly demonstrated Pakistan’s will, capacity and preparedness," the statement said.

The statement stressed that Pakistan will continue to extend its moral, political and diplomatic support to the Kashmiri people till the realisation of their right to self-determination as enshrined in the UN Security Council resolutions.

The FO statement comes days after Inter-Services Public Relations (ISPR) Director General Maj Gen Babar Iftikhar had called out India for "promoting Hindutva and saffron terrorism", saying its attempt to "link coronavirus with Muslims and Pakistanis has failed badly".

Recently, Indian army chief General MM Naravane had alleged that Pakistan was "exporting terror" during the Covid-19 crisis while India was helping others and its own people.

“It is very unfortunate that at a time when the whole world and India is fighting the menace of this pandemic, our neighbour continues to foment trouble for us,” The Hindustan Times had quoted Navarane as saying.

The allegation was rejected by both the FO and the military's media wing.

I am asking on ground in kashmir what exactly changed rather than few tweets or speeches in UN.

Imran is all talk, only thing he can do is keeping talking on social media, nothing is going to change. Oh one thing will change though; in the coming decade, a lot of mainland Indians will be living in Kashmir which will eventually kill off any Islamic extremism and then India and Pakistan will go their separate ways and won't talk about Kashmir. Till then you will hear Imran's Tweet Missiles which will make India tremble :).

Pakistan rejects India’s new Kashmir domicile rules

ISLAMABAD: Pakistan on Tuesday rejected Indian government’s recently announced domicile rules for occupied Kashmir which allows non-locals to seek permanent residence in the disputed region.

On Monday, India notified new rules that permit those who have lived in India-held Kashmir for 15 years, or studied there for seven years and appeared in class 10th or 12th examinations in a local school, to apply for Kashmir domicile, a mandatory condition for seeking jobs in the Himalayan region.

Before the abrogation of Article 370 and the new domicile rules, no outsider could apply for permanent residency or government jobs in the conflict-hit region.

The Foreign Office spokesperson said in a statement that the Jammu and Kashmir Grant of Domicile Certificate (Procedure) rules were in clear violation of the relevant United Nations Security Council resolutions, international laws, including the Fourth Geneva Convention, and bilateral agreements bet*ween Pakistan and India.

“The domicile law is aimed at changing the demographic structure of IOJ&K and undermining the exercise by the Kashmiri people of their right to self-determination through free and impartial plebiscite as per the relevant UNSC resolutions. We reiterate that such steps can neither change the disputed nature of Jammu and Kashmir recognised as such by the United Nations and the international community nor can they prejudice the inalienable right to self-determination of the Kashmiri people,” the Foreign Office stated.

It observed that the timing of the illegal Indian action was particularly reprehensible as it used the world community’s preoccupation with the coronavirus pandemic and reflected the opportunistic and morally bankrupt mindset of RSS-BJP.

The Kashmiri people would never accept the sinister “Hindutva” agenda of dispossessing them of their land, marginalising them politically and economically, and depriving them of their distinct identity, the FO stated.

It said Pakistan had been consistently sensitising the international community about the real Indian designs behind its illegal and unilateral actions of Aug 5, 2019.

Through these actions, along with continuing res*trictions, excruciating military crackdown, extr*a*jud*icial killings, arbitrary det*e*ntions and inc*arc*erations, and grave human rights violations, India seeks to perpetuate its illegal occupation of held Kashmir.

The UN and international community must take immediate action to stop India from changing the demography and distinct identity of held Kashmir and hold India accountable for the persistent violations of international law, urged the FO.

India eases rules for security forces to acquire land in Kashmir

The Indian administration of Jammu and Kashmir has lifted a requirement set in place by a 1971 circular under which Indian security forces had to obtain a special certificate in order to acquire land in the disputed region.

The order allows "Indian Army, Border Security Forces, paramilitary forces and similar organisations" to acquire land without a "no objection certificate" (NOC) clearance from the region's home department, according to a report by the Anadolu Agency on Tuesday.

The order cites the extension of the 2013 Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act to the Jammu and Kashmir region after it was declared a federal territory in a controversial move by the Indian government in August last year.

In view of the federal law's extension, the circular requiring an NOC from the erstwhile state's home department prior to acquisition or requisition of land by the security forces was withdrawn, according to the order.

The move came on the heels of the regional administration agreeing to legal changes to allow construction in the region's "strategic areas" by the Indian armed forces.

Drawing comparisons with Israel’s “settler” tactics in the Palestinian Territories, Modi’s Hindu nationalist government aims to change the demographic makeup and identity of the Muslim-majority region, critics say.

The Himalayan former princely state has been split between India and Pakistan since independence from Britain in 1947.

What has Modi done so far?
In the Indian-occupied part a conflict between separatist rebels and government forces has killed tens of thousands since 1989, mostly civilians.

More than 65 percent of the population is Muslim. In the Kashmir Valley, the main centre of the rebellion, it is close to 100 percent.

On Aug 5, 2019 Modi’s government revoked articles in the Indian constitution that guaranteed Kashmir’s partial autonomy and other rights including its own flag and constitution.

A huge accompanying security operation saw tens of thousands of extra troops — adding to 500,000 already there — enforce a siege-like curfew. Thousands were arrested and telecommunications were cut for months.

Jammu & Kashmir state was demoted to a union territory governed directly from New Delhi, while the Ladakh region was carved out into a separate administrative area.

Creating such new “facts on the ground” in Kashmir has long been advocated by the Rashtriya Swayamsevak Sangh, the hardline Hindu parent organisation to Modi’s BJP party.

The move sent a further shudder through India’s 200-million Muslim minority and defenders of its secular traditions, who fear Modi wants to create a Hindu nation — something he denies.

“What I see unfolding is a Hindu settler colonial project in the making,” Mona Bhan, associate professor of anthropology at Syracuse University who has long researched Kashmir, said.

Modi’s government tore up Kashmir’s special residence rules dating back to 1927 which had ensured only permanent residents could own land and property, secure government jobs and university places and vote in local elections.

Now a raft of different categories of people from anywhere in India can apply for domicile certificates, giving them access to all the above.

The changes are “the most drastic imposed since 1947,” Siddiq Wahid, a historian and political analyst, said. “It was done with the intent to open the gates to demographic flooding.”

What do locals have to do?
Locals too now have to apply for the new “domicile certificates” in order to qualify for permanent resident rights.

To get this, they have to produce their Permanent Resident Certificates (PRC), cherished documents valid since 1927, which then become worthless.

An engineering graduate said young Kashmiris were in effect being forced to give their political loyalty to India in exchange for a livelihood. “They say, you want a job, OK, get the domicile document first,” he said.

What happens if people complain?
Some 430,000 new domicile certificates have been issued — despite the coronavirus pandemic. It is unclear how many of them are to people from outside and how many to locals.

Many locals are refusing to swap their old documents, even though this makes life harder. Some do it in secret for fear of censure from their neighbours.

Wary of being labelled “anti-national” by the authorities many Kashmiris are also scared to speak out openly. Some are deleting their Twitter accounts.

“It’s a travesty that I have to compete with outsiders for citizenship rights in my own homeland,” said a student — who also wished also to remain anonymous out of fear of problems with the authorities.

Kashmiri terrorism will be around for another 10 more years max I feel, If the demographic change happens in hordes and hordes from Mainland India to Kashmir in the coming years, there will be no more bombs or terrorism. Pakistan's official Kashmir strategy of using Kashmiris as pawns will be RIP, Pak Army and ISI will have to find another reason to convince the public why they need majority of the money from the economy....

Well they had the option to live in peace but they chose to throw stones and blow up people.. Also no one forgets the genocide they have done to 1000s of Pandits. And this ongoing islamic terrorism cant just keep going in the region, all good things must one day come to an end.

No one is innocent here bro, Pakistanis with their 'strategic' concern for the Kashmiris to achieve their agenda and India with its brutality.... Its too bad Kashmiris are too dumb to realize they are being played by both India and Pakistan, oh well, that's their fate...
