ISLAMABAD: An accountability court on Tuesday summoned Pakistan Muslim League-Nawaz (PML-N) Vice-President Maryam Nawaz to appear in a case related to the fake trust deed in the Avenfield Apartments case.

Judge Muhammad Bashir issued the notice to Maryam asking her to appear in court on July 19.

According to the National Accountability Bureau (NAB), the trust deed Maryam presented in the Avenefield case was fake and have requested a trial against the PML-N leader for fraudulent documents.
In 2017, a Pakistani team investigating former prime minister’s Nawaz Sharif alleged illegal offshore properties – flagged in the Panama Papers – released its final report that mentioned ‘Calibri’.

That report surmised that some of the documents it received from Maryam were forged, because they used Microsoft’s ‘Calibri’ font.

In and of itself, that was not a problem. There was just the small matter of the documents being from 2006, when the font was not available for public use. Microsoft only released it for public use back in 2007.

An accountability court in Lahore on Wednesday rejected the National Accountability Bureau's (NAB) request for an extension in the physical remand of PML-N leader Maryam Nawaz and her cousin Yousuf Abbas and ordered that the duo be sent on judicial remand for 14-days.

During the court proceedings, heard by judge Ameer Muhammad Khan, NAB prosecutors Hafiz Asadullah Awan and Haris Qureshi presented their statements. They said further investigation of the two was required in the Chaudhry Sugar Mills (CSM) case.

On August 8, Maryam and her cousin had been arrested by NAB in the CSM case. Since then, their physical remand has been repeatedly extended.

During today's proceedings, the NAB prosecutor said that during the investigation of two they had found out about an agreement for the division of the family's assets.

He said shares valued at Rs14.558 million were divided between former premier Nawaz Sharif, Leader of the Opposition in the National Assembly Shahbaz Sharif, Abbas Sharif, Kausar and Shamim Begum.

According to the Securities and Exchange Commission of Pakistan (SECP) record for 2008, shares valued at Rs26.2 million were belonging to the CSM, the prosecutor said, adding that the assets were not included in the Sharif family's assets.

Additionally, the investigative officer Usman Ifthikar said that in 2008, Maryam's assets were not compatible with her income and inorder to investigate assets and income they had summoned members of the Sharif family.

The NAB prosecutor said that in 1998, via telegraph transfer, Maryam received revenue from Sadiqa Syed Mahmood and later transferred this income to CSM.

In 1999, he said, the suspect had received Rs160 million but there was no evident link between her and the woman who sent it. He added that the woman had also paid the debt of the CSM.

During the proceedings, the court asked what Maryam's date of birth was. The investigative officer said that she was born in 1973 but he did not know the date of her birth.

Maryam added that she was born on October 28.

The NAB prosecutor said that in 2015, CSM was shifted from Gojra to Rahim Yar Khan and Rs1.5 billion was spent on shifting the sugar mill.

Awan said that the revenue spent on shifting CSM also needed to be assessed.

A two-member bench of the high court, comprising Justice Ali Baqar Najafi and Justice Sardar Ahmad Naeem, announced the verdict. The legal representatives of Maryam and National Accountability Bureau (NAB) were present in the court.

The PML-N leader has been ordered to furnish two surety bonds, each worth Rs10 million, and deposit an additional Rs70million and surrender her passport to secure her release.

"Since the prosecution has shown the bank statement of the [...] petitioner in which on 28.11.2011 [...] Rs7 crores were withdrawn and the prosecution has apprehension of fleeing away of the petitioner, therefore, to satisfy our judicial conscience we would pass a conditional order," says the court's written order, granting Maryam bail under under Article 199 of the Constitution.

PML-N supporters gathered outside the court celebrated the bench's order while party president, Shehbaz Sharif, via a statement welcomed the decision.

He also appealed to supporters to not indulge in celebrations or distribute sweets and instead, pray for former premier Nawaz Sharif's health.

PPP Senator Sherry Rehman also welcomed the court's verdict, adding, "Hope that the PPP leadership, including President Zardari who is in custody for questioning, will also be released soon. Keeping political opponents in jail with no wrong proven is bad news.

The PML-N vice president had approached the high court on September 30 seeking post-arrest bail in the CSM case, in which she is suspected of money laundering.

Following the sudden deterioration in the health of her father, former prime minister Nawaz Sharif, she then filed a miscellaneous petition on October 24 seeking immediate bail on the basis of fundamental rights and humanitarian reasons. On October 29, the Islamabad High Court suspended her father's sentence in the Al Azizia case for eight weeks.

Before the court reserved its verdict on Maryam's bail plea, NAB's additional prosecutor general Jahanzaib Bharwana had opposed her request for bail on humanitarian grounds and said: "It has been established by Supreme Court's verdicts that a suspect can only be granted bail in extraordinary circumstances.

"Maryam Nawaz's case does not qualify as an extraordinary one."

The PML-N leader had been allowed to see her father once last month when she herself was admitted to the Services Hospital due to some health complaints. The development came after a request was sent by the party to the Punjab Home Department asking for special permission to be granted.

LAHORE: A local court in Lahore extended on Monday the interim bails of Pakistan Muslim League-Nawaz (PML-N) President Shehbaz Sharif and his son, Punjab Assembly opposition leader Hamza Shahbaz in the alleged Ramzan Sugar Mills scandal, till August 16.

Both the PML-N leaders appeared before the Additional Sessions Judge, Hamid Hussain, during the hearing at a banking court.

The Federal Investigation Agency (FIA) submitted their reply over the bail pleas of the accused leaders.

According to the FIA’s reply, Shehbaz and Hamza "are not cooperating in the investigations."

The investigations wouldn’t be completed if the court kept extending the interim bails of the accused, read the reply.

The FIA officials maintained that Shehbaz and Hamza committed Rs2.5b of money laundering by creating fake bank accounts against the names of low-income employees of Ramzan Sugar Mills.

They apprised that it was found in the investigations that the details of the account holders do not match the assets they possess.

Maintaining that they fear that Hamza and Shahbaz may flee from the country, the FIA officials requested the court to dismiss the bail pleas.

Moreover, the accused being released on bail could endanger the witnesses, said the FIA officials.

During the hearing, the counsel representing Shehbaz moved the court to adjourn the hearing until a date after August 13, since Shehbaz has to attend the National Assembly sessions.

Separately, Hamza’s counsel apprised the court that the Punjab Assembly sessions will also continue till the aforementioned date.

The court accepted the counsels’ requests and adjourned the hearing till August 16, extending the accused’s bail pleas until the same date.

Bails granted
The accused leaders had been granted interim bails in the sugar scandal on June 21, after FIA's Lahore wing summoned Shahbaz in its ongoing probe into the scandal that led to a shortage and an extraordinary hike in the commodity's prices.

In order to avoid being arrested by the FIA, the PML-N president and his son reached out to the court to seek bails, contending that the FIA has registered a baseless case under money laundering allegations.

The National Accountability Bureau (NAB) has already filed a reference on money laundering allegations against the two PML-N leaders.

ISLAMABAD:The Islamabad High Court (IHC) registrar raised on Tuesday two objections on Pakistan Muslim League-Nawaz (PML-N) Vice President Maryam Nawaz miscellaneous plea seeking acquittal in Avenfield Apartments case.

According to the registrar, Maryam Nawaz's plea contains the same request as made in the main petition. The registrar's office further observed that the accused can only provide fresh grounds in the plea after permission from the court.

A special bench of the IHC will hear the PML-N leader's plea along with the objections raised by the registrar's office tomorrow (Wednesday). The bench comprises Justice Amir Farooq and Justice Mohsin Akhtar Kayani.

Separate plea

Earlier in the day, Maryam Nawaz had filed a separate petition in the high court against the verdict given by an accountability court in the Avenfiled Apartments case.

According to Express News, Maryam Nawaz, through her counsel Irfan Qadir, urged the high court to declare the accountability court's decision in the Avenfield Apartments case void over "serious violations".a

Maryam and her father ex-prime minister Nawaz Sharif were convicted in the case on July 6, 2017, by Accountability Judge Muhammad Bashir, who sentenced them to seven and 10 years in jail, respectively. The IHC later suspended their sentences.

In her plea, Maryam also alluded to a speech made by former judge Shaukat Aziz Siddiqui during a bar address. In the speech, Siddiqui had alleged that the SC was being controlled from 'the outside' while hearing the Avenfield case. He was subsequently sacked over misconduct.

The petition also raises questions on the Supreme Court's role in the case. Maryam said the SC supervised the investigation as well as prosecution in the case, that was unprecedented. "The court’s role in the constitution is neither that of an investigator nor that of a prosecutor," the PML-N vice president added.

She said the National Accountability Bureau (NAB) filed three separate references in the assets beyond means case which was a violation of the law. She said that NAB failed to act in a transparent manner, adding that these references and the subsequent trial could have been a result of coercion.

She requested the court to quash the sentences handed down in the Avenfield case over serious violations of the law.
