I don’t know what was so difficult to understand in my post. The opposition created a defection within PTI, which ultimately led to parties like MQM and BAP breaking off from coalition and switching sides. It is not rocket science.

Nor is it illegal. MQM and other coalition partners have the freedom to decide which side they want to take.
 
ISLAMABAD: The Supreme Court of Pakistan may rule on the "unconstitutional" act by National Assembly Deputy Speaker Qasim Suri to block the vote of no-confidence against Prime Minister Imran Khan, today Thursday, the fifth consecutive day of deliberation on the matter.

The CJP had taken suo motu notice of the constitutional crisis that was triggered after Suri disallowed voting on the motion on April 3, deeming it "unconstitutional" — a move that the Opposition said was a blatant violation of the Constitution.

"The SC wants to wrap up the case today," Chief Justice of Pakistan Umar Ata Bandial had said, as the apex court resumed hearing the case on Wednesday.

“We first want to wrap up the case on what happened in the NA on April 3."

AGP Khalid Javed to present arguments

AGP Khalid Javed Khan, the counsels representing PM Imran Khan and the NA speaker will give arguments in today's hearing.

Attorney General Khalid Javed Khan will argue whether the SC can intervene in the internal affairs of the NA.

The AGP had earlier said on a private TV show that the NA speaker's ruling enjoys immunity under Article 69 only if there is a procedural irregularity, but the court has the jurisdiction to intervene in parliamentary affairs if there is unconstitutionality.

"The speaker's role is not unlimited,” he had said.

When asked if the NA speaker can give an extra-constitutional ruling on whatever he wants, he said that there are certain things that are part of the basic constitutional structure of Pakistan and those cannot be changed even through a constitutional amendment.

"As long as the NA's internal affairs and speaker's rulings are on a much lower pedestal [...], the apex court cannot intervene if Parliament unanimously wants to amend anything," he said, adding that this is not so in case of violation of fundamental rights.

During Wednesday's hearing, the counsel representing PTI and President Arif Alvi presented their defence.

Babar Awan presented arguments over the constitutionality of Suri's ruling, while Arif Alvi's lawyer Ali Zafar deliberated over the boundary between the judiciary and the legislature under Article 69 of the Constitution.

SC takes suo motu notice
CJP Bandial had taken a suo motu notice of the constitutional crisis that erupted after the incident. The judge maintained in a written judgment issued during Sunday's hearing that his fellow judges had approached him and had expressed concern over the situation.

"Any orders and actions that Prime Minister Imran Khan and President Arif Alvi regarding the dissolution of the National Assembly shall be subject to the order of this court," CJP Bandial had said taking the notice on Sunday.

Earlier, the SC restrained state institutions from taking any extra-constitutional steps and directed them to act strictly in accordance with the Constitution, besides asking all political forces of the country to remain peaceful.

Opposition's petition

The joint Opposition has also prepared a petition to cancel the ruling of the deputy speakers under which the National Assembly session was adjourned for an indefinite period as Suri cancelled the voting on the no-confidence motion, terming it “unconstitutional”.

According to the petition prepared by the joint Opposition, the speaker should be directed to convene the session today as “the deputy speaker cannot adjourn the session as it is unconstitutional.”

Furthermore, the Opposition has filed a petition against President Arif Alvi, PM Imran Khan, Speaker NA Asad Qaiser and Deputy Speaker Qasim Suri for violating the Constitution.

SCBA's petition

Meanwhile, Supreme Court Bar Association (SCBA) has also filed a petition in the Supreme Court on the constitutional crisis.

The constitutional petition filed by SCBA states that a voting of no-confidence motion was a must, and the speaker cannot cancel the voting by a ruling.

It was further noted that the deputy speaker’s ruling contradicts Article 95(2). It further said that according to Article 58(1) the premier cannot even “advise dissolution of the assembly,” once the no-confidence motion is filed against him/her.

Sources privy to the matter said that a special bench of the top court will hear the case.

Chief Justice of Pakistan (CJP) Umar Ata Bandial on Thursday questioned President Arif Alvi's lawyer where the constitutional crisis in the country was if everything was happening as per the Constitution.

At the top judge's inquiry, Senator Ali Zafar voiced his agreement. "I am also saying that there is no constitutional crisis in the country," the lawyer said.

This exchange came as a five-member bench, headed by the CJP and comprising Justice Ijazul Ahsan, Justice Mazhar Alam Khan Miankhel, Justice Munib Akhtar and Justice Jamal Khan Mandokhel took up the case around 9:30am.

The CJP's observation came as the president's counsel, Zafar, finished his arguments. At one point, Justice Bandial asked the counsel why he was not explaining whether or not there was a constitutional crisis in the country.


During the hearing, Zafar was asked by Justice Miankhel if the prime minister was the people's representative. The lawyer replied in the affirmative.

Justice Miankhel then inquired if the premier would be protected if the Constitution was violated in parliament. "Is Parliament not the guardian of the Constitution?" he asked. He also questioned how justice would be awarded in case someone is affected due to parliamentary proceedings.

At this, Zafar replied that the Constitution must be protected in accordance with the rules it underlines. He said that in order to protect the Constitution, each and every article had to be kept in mind.

Justice Bandial then asked what would happen when an injustice was carried out against the entire assembly, not just one member.

"Can Parliament interfere if there's a conflict between judges," Zafar offered as a counter argument. "The answer is no. The judiciary has to settle the matter. It can't interfere just like Parliament can't [interfere in judges' matters]."

The CJP also asked whether the formation of the federal government was an "internal matter" of Parliament.

Zafar said that the no-confidence motion and the prime minister's election fell within the ambit of Parliament. He said that the National Assembly is formed for the purpose of appointing a speaker and a prime minister.

He also referred to former PM Mohammad Khan Junejo's case, who was dismissed by ex-president Gen Ziaul Haq. "Junejo's government was dissolved and the court declared it unconstitutional," Zafar pointed out, adding that the court did not interfere in actions taken after the dissolution of the assembly.

However, Justice Miankhel said that the matter at present concerned the no-confidence motion. "A ruling came after the motion. Address this issue," he told Zafar. CJP Bandial also said that the verdict he was referring to was related to the oath. "Here the matter is about the ruling, not the oath. We have to draw a line somewhere."

However, Zafar argued that in this case too elections were announced after dissolving the assembly.

At one point, the CJP asked Zafar why he wasn't explaining whether or not there was a constitutional crisis in the country. "If everything is happening according to the Constitution, where is the crisis?" he asked.

Zafar replied that he was also saying the same and there was no constitutional crisis in the country.

The CJP also observed that there seemed to be a violation of Article 95. He noted that holding elections cost the nation "billions of rupees".

However, Zafar argued that the announcement of the election showed there was no malice behind the government's move.

Justice Mandokhel questioned whether the prime minister could still advise the president to dissolve the assembly if a majority of the members were opposed to it.

Justice Ahsan noted that the PTI still held the majority despite the recent defections. "But what if the majority party is ousted from the system?" he wondered.

Zafar replied that the president's counsel couldn't comment on political matters and ended his arguments.

'NA proceedings beyond judiciary's jurisdiction'
The lawyer for interim Prime Minister Imran Khan, Imtiaz Siddiqui, began by point out that the judiciary had not interfered in parliamentary proceedings in the past.

"The matter at hand concerns NA proceedings. [But] NA proceedings lie beyond the judiciary's jurisdiction," he argued, urging the court to tell parliament to settle its own matters. He said that the opposition had not objected to the deputy speaker chairing of the session.

"The deputy speaker made a decision according to what he thought was best," Siddiqui contended, adding that the deputy speaker wasn't accountable to the court for the ruling he gave. He reiterated that under Article 69, the apex court could not interfere in parliamentary proceedings.

Justice Akhtar noted that verdicts referenced concerned observations made by the courts. "The court is not bound by the observations given in the verdicts," he said.

Here, Siddiqui stated that the deputy speaker had relied on the assessment of the National Security Committee (NSC), adding that no one could influence the top forum.

This led the CJP to ask when the minutes of NSC meeting were presented before the deputy speaker. Siddiqui said that he unaware about matters concerning the deputy speaker, which prompted the court to tell the lawyer to refrain from talking about things he was unaware of.

"According to you, the deputy speaker was in possession of material on the basis of which he delivered his ruling," Justice Bandial observed, asking what would be the consequences of the premier violating Article 58.

He also observed that Suri had not objected to voting on March 28 but had passed the ruling on April 3. "Why did the deputy speaker not dismiss the no-trust motion on March 28?"

Justice Ahsan remarked that if the assembly was not dissolved, the house could have suspended the deputy speaker's ruling. "The prime minister took advantage of the situation and dissolved the assembly," he said.

However, Siddiqui argued that if the aim was to harm the Constitution, the deputy speaker could have suspended the membership of the dissident lawmakers. "The prime minister did not show any malice," he contended.

"You're saying that the prime minister made a plan," the chief justice said, again asking why the ruling was not issued on March 28 instead.

Siddiqui replied that no plan was hatched to dismiss the no-trust motion. "We dissolved our government ourselves," he said. He went on to quote the prime minister as saying that he would never have ended his government if there was any malice behind his actions.

He added that according to Imran, billions were spent on holdings elections and he was going to the nation against those who had ruled the country for many years.

The joint session of parliament is likely to be held on April 10 to celebrate the Golden Jubilee of the 1973 Constitution of Pakistan.

National Assembly Speaker Raja Pervez Ashraf chaired 2nd Advisory Committee meeting to finalise the arrangements in connection with the Golden Jubilee celebrations.

He said that the objective of commemorating golden jubilee of 1973 Constitution is to highlight the importance of this document and sensitize citizens about their rights and responsibilities.

“Constitution is the only document which can guide a nation on the path of development and prosperity,” he said.

During the meeting, the advisory committee finalized certain proposals to commemorate the golden jubilee of the Constitution. The meeting proposed to commemorate constitutional day on April 10th in all educational institutions across the country.

Fifty years ago on April 10, 1973, the National Assembly of Pakistan passed the Constitution under the government of Zulfikar Ali Bhutto. The president of the NA authenticated it on April 12, 1973, and it came into effect on August 14, 1973.

Elections to be held within 90 days when the national assembly ends. As far as I remember, the national assembly day to end is August 13th, hence the 90 day qouta will start after that.

Our people don't even understand the meaning of constitution it was created by western countries and for western people. Our people only understand power hence a centralized presidential system is better for Pakistan imo. The parliamentary system has too many issues and will never work well in Pakistan.

i dont support Dar. And the disastor of an economy is a combination of PTI misusing IMF funds and wasting it on dumb projects, while at the same time, Dar has done nothing and just made more wrong policies.

Exchanging rate pegging is short term, economic policies are made for long term. You can try anyway you want to blame PDM, but PTI's policies destroyed the economy. Giving away petrol subsidized and than wasting IMF money on unsustainable projects was going to cause this.

Pakistan was on the verge of bankruptcy since 2020, no one wanted to believe it. THan came the health card program, which was always going to fail. PTI wasted IMF money, and than the promises of making CPEC more visible also ended up being a lie. PTI hid CPEC contracts for which they used to bash PMLN for

For his part, Advocate Azhar Siddique — the counsel of Awami Muslim League chief Sheikh Rashid Ahmed — demanded that the court should take notice of the language being used against the judiciary.

Referring to a PML-N rally held on Friday, he said that “derogatory remarks” were hurled at the judiciary in that public gathering.

Justice Mandokhail replied that political matters must be settled in the Parliament. “Go to your parties … why should the court hear this matter?”

At that, Naek said that he would seek direction from his party on the matter. He also requested the court to first hear the government’s objection on the bench.

Justice Bandial said that in normal circumstances, citizens knocked on the door of the court. “But today, the Constitution of Pakistan has knocked on our doorstep.”

Subsequently, the court observed that it will decide on Monday whether to form a full-court bench to hear the case.

“The court will also hear the objection raised against the two judges on Monday,” CJP Bandial remarked and adjourned the hearing till Monday, 11:30am.

For the first part I bolded, its to kill Imran Khan, file frivolous cases (its a banana republic after all), try to arrest him in violation of court orders to not do so, ban his party after planting their criminal polices own weapons in Imrans home. The Punjab police leader is openly threatening peaceful political workers, never has a government in the history of the world issued such threats and instigated violence by breaking peoples cars, shooting, injuring and murdering disabled PTI workers but with criminals in power this is the result. Meanwhile, there is sufficient evidence of ppp, pmln and armys corruption to hang them, but there is no rule of law there. Even recently they violated the constitution along with their paltu ''institutions'' by refusing to permit elections within 90 days of the caretaker government takeover, and maryam and her family of traitors even verbally and physically attacked the SC, but they walk around like thugs with VIP protocol and no Article 6 for treason (should be the case per constiution) is triggered against them whilst they arrest, injure and kill journalists, awaam, lawyers, politicial workers without any legal basis.

One has to question the kind of corrupt bhaygairats these traitors have installed in Pakistans police and army who continue to obey these criminals illegal orders despite knowing said criminals proven history of destroying Pakistan and the fact that they are breaking the law, these people are the real root cause of the issue who permit a couple of family of thieves and corrupt generals to run a circus and control over 200 million people with an iron fist.

The current CJ's term ends in September ehrn he will be replaced by a PMLN supporter.
Then NS will be brought back...

Also the current CM of Punjab will be stepping down at this time and they intend to appoint their yes man.


Delaying elections to October allows them to get all the state machinery in their favour.

"This court cannot be dependent on the solitary decision of one man, Chief Justice," reads the 27-page judgement

Justice Syed Mansoor Ali Shah and Justice Jamal Khan Mandokhail, judges of the Supreme Court, on Monday observed that in order to strengthen our institution and to ensure public trust and public confidence in our court, it is high time that we revisit the power of “one-man show” enjoyed by the office of the Chief Justice of Pakistan.

The two judges issued a 27-page order, stating that the suo motu case regarding the Punjab and Khyber Pakhtunkhwa (KP) election dates announcement was dismissed by a majority of four judges out of seven.

The order’s preface says, “The jurisdiction of a court is determined by the Constitution and laws, not by caprice or convenience of the judges..... When caprice and convenience of the judges take over, we enter the era of an “imperial Supreme Court”.

They observed that the original jurisdiction of the apex court under Article 184(3) of the Constitution is not only “discretionary but also “special” and “extraordinary”, which is to be exercised “with circumspection only in the “exceptional cases of public importance relating to the enforcement of fundamental rights that are considered “fit” for being dealt with under this jurisdiction by the court.

They further held that the court cannot be dependent on the solitary decision of one man, the chief justice, but must be regulated through a rule-based system approved by all judges of the court under Article 191 of the Constitution, in regulating the exercise of its jurisdiction under Article 184(3) including the exercise of suo motu jurisdiction; the constitution of benches to hear such cases; the constitution of regular benches to hear all the other cases instituted in the court; and the constitution of special benches.

“It is this unbridled power enjoyed by the chief justice in taking up any matter as a suo motu case and in constituting special benches after the institution of the cases and assigning cases to them that has brought severe criticism and lowered the honour and prestige of this court.”

While addressing PTI workers and supporters via video link, Imran Khan said that the rulers think that PTI would be weakened by October and later they will go for elections. He added that PTI would never weaken in October.

“Sharif family has a history and they won’t accept independent judiciary. The Sharif family is running a campaign against the judges today. It is the same PML-N [Pakistan Muslim League Nawaz] which dropped pictures from aircraft in the past.”

Criticising the Pakistan Democratic Movement (PDM) parties, Khan said that they are afraid of facing a defeat in the elections. “The government personalities are giving threats to the families of the judges and spreading fear among the people.”

“They are violating the Constitution due to fear of losing elections. They lodged 143 cases against me and made character assassination of me and my wife.”

Imran Khan termed the Supreme Court’s (SC) verdict ‘historic’. He said that the nation should celebrate after the SC verdict in the election delay case ‘because they are heading to real independence’.

Loyalty to state, govt must be distinguished: LHC

he Lahore High Court has ruled that loyalty to the state has to be distinguished from loyalty to the government whose offices are being occupied by a political party as not everyone will have doctrinal affinity with a ruling party and, therefore, must be free to express feelings of disaffection towards its policies.

“Why should a citizen or a member of the press be charged with sedition for expressing hatred, contempt or disaffection towards a federal or provincial government?” Justice Shahid Karim poses a query in his 48-page detailed judgement against the offence of sedition under Section 124-A of the Pakistan Penal Code (PPC) 1860.

Through a short order issued on March 30, the judge had allowed a public interest petition and struck down the Section 124-A for being repugnant to the fundamental rights of the citizens protected in the Constitution.

Federal Minister for Information and Broadcasting Marriyum Aurangzeb presented the resolution, which was unanimously adopted by the Convention held at the National Assembly Hall. The resolution also demanded that the Constitution should be included in the educational activities of all schools, colleges, universities, training institutions of police, and other law-enforcement agencies under the control of provincial governments.

According to the resolution, National Constitution Day will be celebrated on April 10 every year. According to the resolution, the Fundamental Rights enshrined in the Constitution of 1973, along with an unbiased account of constitutional and democratic developments in Pakistan, should be included in the textbooks of all relevant subjects such as Pakistan Studies, History, Social Studies, Urdu, English, or any other subject taught in the schools, colleges, and universities in the provinces.

Furthermore, the resolution called for extra and co-curricular activities on educational campuses to prioritise themes related to parliamentary democracy, fundamental rights, and constitutionalism in Pakistan. It also urged public service broadcasters and independent private media to devote a fair amount of time to expanding their understanding of the Constitution and its relevance as a vibrant contract between citizens and the state.

SCBA challenges PBC’s notices in SC
Council removes association’s secy from post; latter suspends 10 executive body members for ‘ties’ with former

The dispute between the Supreme Court Bar Association (SCBA) and Pakistan Bar Council (PBC) has reached the Supreme Court.

SCBA President Abid Zuberi and Secretary Muqtedir Akhtar Shabbir have filed a petition in the top court.

The plea is against the show-cause notices issued by the PBC to SCBA President Zuberi and its secretary for violating the code of conduct.

The association pleaded that court should declare the show-cause notices null and void.

In its plea, the SCBA pointed out that Federal Law Minister Azam Nazeer Tarar was also a member of the PBC and claimed that he was exerting his influence over the council to further the agenda of his political party.

“Given the fact that such political figures are members of the [PBC] and have hijacked [it] in order to further their own political agenda, the petitioners have no confidence in the respondents’ ability to conduct themselves in an independent and fair manner; and the same is in violation of the petitioners’ fundamental rights as enshrined under Articles 10A, 17, 18, 19, 19A and 25A r/w 4 of the Constitution,: the petition read.

It claimed in the petition that the PBC was “favouring” the government and the show-cause notices were issued to the SCBA office-bearers on political grounds.

Top judge says decisions should be made as per the law and Constitution

Chief Justice of Pakistan Umar Ata Bandial on Sunday noted that if the Constitution mandated that elections should be held within 90 days after the dissolution of an assembly, then the Supreme Court would have no other option but to implement it.

“When it comes to constitutional enforcement we [SC judges] must not blink our eyes. If it says 90 days for holding the polls, it is our duty to say that and not our choice,” the top judge added while speaking at a conference named after the late CJP AR Cornelius held in Lahore on the issues faced by minorities.

The CJP's remarks come at a time when discussions among political parties are under way on the issue of simultaneous elections across the country, following an order by the top court to hold the elections in Punjab on May 14.

However, the government has repeatedly shown its reluctance to hold the polls. Instead, it has been urging to hold them later in the year.

Chief Justice Bandial remarked that the court had been informed that negotiations between political parties were under way for holding same-day elections across the country.

However, he added that the SC judges had nothing to do with this matter. The CJP said that political parties realised that it was their duty to uphold the Constitution.

“We [SC judges] are there to support them, otherwise our decision is there,” he continued, referring to the top court’s April 4 verdict to hold the polls in Punjab on May 14.

Alvi says upholding constitution is responsibility of all

President Dr Arif Alvi on Monday said upholding the constitution was the responsibility of all segments of society as the document not only guaranteed political stability but also ensured citizens’ fundamental rights.

“The supremacy of the constitution is vital as its pillars set out the goals for basic rights in various areas, including education, health, employment, and social and economic justice,” the president said in his address at a ceremony held at the Presidency to recognise public contribution towards social welfare.

“The constitution vested its power in citizens which led to realising a welfare state with a political system based on social justice. A constitution does not belong to a politician or an institution, but to every individual of the country,” he added.

In addition to the administrative authority, the president said, it is the duty of the state and its organs to bring about improvement to the society through a system based on welfare.

The event, organised by the Network for Human and Social Development (NHSD), acknowledged the services of departments and individuals in the field of humanitarian service and philanthropy.

President Alvi emphasised the importance of social welfare and philanthropy to address the problems amid the growing population, particularly in the shape of poverty, illiteracy and unemployment.

As per Unicef data, he said, the 27 million out-of-school children of Pakistan were a serious challenge that required urgent steps for their inclusion in the educational and skill-set system. Also, the country’s 10 per cent population of persons with disabilities needed mainstreaming, he added.

I feel Army Chief should be the supreme leader of Pakistan. Changed after 3 years. The appointment will be made internally. No court can challenge their decisions or they can be punished


Pakistan Army will vet all the civil servant, Judges, and politicians. They can kidnap anyone without warrant that speaks against "Interest" of the country. Elections can take place under them, no need to ECP but only their will be accepted, other than that it will be rejected by the Army no matter what people want to vote for.


The whole drama of democracy should be over by now, it is useless and pointless. It is best for the country, at least Pakistan Army won't be breaking any law under the new constitution that I have suggested. Their roles and duties will be formalized.
