Judgement was originally planned to be announced on 9th June. I would hold NAB courts in high regards if they announce their verdict on 9th June. Supreme court has done commendable work to earn back the trust of an average Pakistani in the past year or so. Its time NAB court reinstate their confidence in people of Pakistan by announcing this decision on time.

If the judgement if further delayed then it would be quite clear that justice in Pakistan can either be bought or influenced and NAB courts credibility will be tarnished.

That is quite ridiculous, they had so much time and still delaying :facepalm:

I hope they are are purposely delaying it to ensure elections are over before Sharif gets punished.
 
Bro Avenfield is now in last stage. Prosecution has finished it's closing arguments and defence will present closing arguments on June 12th. This could take three days.

Cross examination of Wajid Zia will continue on June 11th for the Al Aiza case. Don't forget one more prosecution witness still to record his statement on that. Also Nawaz will answer 100 odd questions on that yet from the questionnaire!!! That will take another 3 days.

Also third reference of Hill Metal Establishment hasn't even started yet!! That is potentially another 2 weeks.

One good thing is Maryam and Safdar are only involved in Avenfield nor the other two. Nawaz and his son's are referenced in the other two but the son's won't be presenting themselves or their lawyers. So these two cases should finish quicker.

But still it might take another 5 weeks.

The reason why it's taking so long is because the judge has been giving long dates between hearings and Nawaz and co left the country several times. For example after two consecutive daily hearings he would then resume it after 5 days. That's how weeks were lost.

They will come back because the humiliation of running will be too much for their supporters. However, i do see an attempt delay by some guff about Kulsoom being seriously ill. So expect to see pics in the next few days with Kulsoom at deaths door.

According to Arshad a DEAL has been struck and this delay in verdict is a result of this.

What is this mockery? Supreme Court has been disappointing! We were promised that Nab will act in a specific time frame and now after so many months; we have a circus wherr jokers like Nawaz are just playing with the courts.

My fundamental rights are being violated: Nawaz Sharif

Former prime minister Nawaz Sharif, while addressing a press conference in Lahore on Monday, complained that his fundamental rights were being violated "as no lawyer will take up a case where he is not even allowed time to prepare and is asked to appear even on the weekends."

Sharif's presser was in response to an accountability court asking him to find a new lawyer after counself Khawaja Haris recused himself from the references being heard against Sharif.

Haris's decision had come after the Supreme Court asked the accountability court to speed up its proceedings and hear the case, even if it meant holding court on weekends.

"Does the chief justice not know that justice rushed is justice crushed?" Sharif complained in his press conference today.


Holding the prosecution responsible for past delays in the reference proceedings — they were initially supposed to last six months, but have been extended multiple times — Sharif said that it was a matter of record that his lawyers, including Haris, had never caused any of those delays.

He stated that when Haris told the apex court that it was not possible for a lawyer to continue appearing for proceedings everyday — especially if the hearings lasted late into the day and were held even on holidays — the chief justice said that the lawyer could be changed if it was not possible for the current one to continue representing Sharif.

Nawaz said that the apex court also allowed the accountability court to set its own timings in order to decide on the references, or a single reference, within one month.

Sharif complained that even if he is able to find a new lawyer, it would not be possible for him to resume his defense on Wednesday as there were thousands of pages attached with the case in addition to the statements of over 60 witnesses.

He claimed that he did not know of any other case where a lawyer was forced to represent his clients until late in the night, and then also made to appear on weekends.

Nawaz said the rights accorded to him under Articles 10A and 25 of the Constitution were being violated. He said that he is being deprived of his right of defence and even his right to be represented by a lawyer.

He again objected to the appointment of a monitoring judge to oversee the case, asking whether anyone in the country had ever faced over 100 hearings.

"This is a strange case of its own kind," he said.

"This last episode of the game that began with the Panama [Papers] is an extremely unfortunate example of oppression and injustice," he said, repeating his previous claims of injustices meted out to him in the case.

He also claimed that the court has backtracked on an earlier order to give a decision in all three references at the same time.

"I do not know whether my right to defence is more important or that the decision be given before the election. Are the standards of law and justice more important or a decision before the elections? Are the fundamental rights of a Pakistani citizen important or a decision before the elections?" he asked.

"If it is necessary or compulsory to arrive at a decision regarding me before July 25, then make the decision. If it is this way, then this is tantamount to tearing apart law, justice, fundamental rights and fundamental human rights," he said.

ISLAMABAD: Former prime minister Nawaz Sharif and his daughter Maryam were exempted on Tuesday from attending the corruption hearings against them for four days.

The former premier and his daughter are in London to tend to Nawaz's wife Begum Kulsoom who is under treatment there.

As Accountability Court Judge Mohammad Bashir started hearing the three National Accountability Bureau (NAB) references against the Sharif family, the counsels of Nawaz and Maryam submitted appearance exemption requests of their clients for a week.

The court, however, accepted the plea for four days only and adjourned the hearing of the Avenfield case until tomorrow.

Khawaja Haris returns as Nawaz's counsel
Khawaja Haris, the chief counsel in the three corruption cases against Nawaz, resumed his role as lead counsel on Tuesday after previously recusing himself from the case.

As the hearing started today, the judge inquired from Haris if he was in court to withdraw his request ending his power of attorney for Nawaz.

“First, I have to file another petition. I have a right to know whether the court will hear the three cases simultaneously or separately,” Haris responded.

To this, the accountability court judge said Haris’ request last week to withdraw the power of attorney was never accepted in the first place.

However, NAB prosecutor Sardar Muzaffar Abbasi pointed out, “We did not even object and the request was dismissed.”

Haris then requested the prosecution "to coordinate with each other and try our best to not pull each other's legs".

"There is a law for everything. The Supreme Court asked us to work on Saturdays as well and under what law does that fall?" Nawaz's counsel questioned.

At this point, Jahangir Jadoon, who was appointed in Haris' place, told the court, "People are asking why the court is not announcing a judgment."

Judge Bashir responded saying, "The court follows a procedure and on my behalf tell those people that why are they commenting [on the case] when they are not respondents."

Haris then resumed presenting final arguments in the Avenfield case before the hearing was adjourned until tomorrow.

Haris had recused himself from representing Nawaz on June 11.

Among other reasons for the decision, he had said the Supreme Court "dictated on completing the trial within a month" and asked him to work on weekends.

On June 14, Nawaz had hired Jahangir Jadoon to represent him in the NAB references.

The cases

Nawaz and his family are facing three corruption cases in the accountability court after NAB filed references against them in light of the Supreme Court's verdict in the Panama Papers case.

The trial against the Sharif family had commenced on September 14, 2017.

The corruption references, filed against the Sharifs, pertain to the Al-Azizia Steel Mills and Hill Metal Establishment, offshore companies including Flagship Investment Limited, and Avenfield properties of London.

Nawaz and sons Hussain and Hasan are accused in all three references whereas his daughter Maryam and son-in-law Safdar are accused in the Avenfield reference only.

The two brothers, based abroad, have been absconding since the proceedings began last year and were declared proclaimed offenders by the court.

The court originally had a deadline of six months which ended in mid-March but was extended for two months after the judge requested the apex court.

Later, the deadline was extended twice more, with the new date falling at July 10 now.

Panama Papers: new leak shows Pakistani clients struggling to avoid trouble

ISLAMABAD: A fresh batch of leaked documents of Panamanian law firm Mossack Fonseca reveals how the release of Panama Papers triggered panic among the firm and its clients, several of them Pakistanis who had to change their plans of hiding wealth abroad amid fear of yet another leak.

Following the leak, a person nominated by Pakistan People’s Party (PPP) for interim prime minister, who had also been chairman of the Pakistan Cricket Board (PCB), abandoned the process of opening two accounts in Swiss banks through his two benami shell companies which came to surface earlier but their ownership was unknown.

Former attorney general Justice (r) Malik Qayyum disassociated himself from the benami company. Its Swiss bank account had Qayyum and his wife as signatories. Samina Durrani, the mother of Tehmina Durrani, ‘gifted’ one offshore company holding property in the UK to Asimullah Durrani, her son, a few months after the release of Panama Papers.

A Pakistani banker in the Middle East, Saleem Sheikh, was found seeking an explanation from the law firm about the steps taken to prevent any embarrassment in future through yet another leak. Instead of replying to his concern, Mossack Fonseca served him notice in April 2017 together with other Pakistani passport holders having companies in British Virgin Islands to change their registered agent as ‘an administrative decision has been taken to resign as registered agent/office for companies with links to high-risk countries.’

Pakistan is among those 21 countries declared prohibited for business by BVI in April 2017. Nielsen and Nescoll, the offshore companies owned by the Sharif family had changed their agent in 2014 hence no detail was found in the latest leak.

The newly obtained documents also bring under spotlight financial details of sports celebrities like soccer superstar Lionel Messi, politicians like Argentine president’s family and a former Kuwaiti official convicted for looting his country’s social security system.

The fresh leak comprises 1.2 million documents which date from a few months before April 2016 (when 11.5 million Panama Papers were released) onward to December 2017. The documents were leaked to Munich-based Süddeutsche Zeitung, which shared them with International Consortium of Investigative Journalists (ICIJ).

The Mossack Fonseca announced its closure in March this year due to what it describes the reputational deterioration. The new leak reveals how the embattled law firm scrambled to contain the fallout from the leak and identify its own clients. A couple of months after the firm became aware of its records had been leaked, it was unable to identify owners of more than 70 percent of 28,500 active companies in the British Virgin Islands, its busiest offshore hub, and 75 percent of 10,500 active shell companies in Panama.

‘Know your client’ law makes it obligatory for a financial institution to know who they are doing business with and what’s their past – a due diligence process often ignored.

Two such anonymous companies were legally represented by Justice (r) Malik Qayyum: Camberwell Financial Limited and Fernbridge Resources Inc. The former is registered in the British Virgin Islands and the latter in Panama. Who is the beneficial owner remains unknown todate. Both were used for opening accounts in LGT Bank Switzerland Ltd wherein Malik Qayyum was a signatory of the account (his wife was co-signatory of the account opened in the name of Fernbridge Resources Inc.)

When contacted for his version a week before the release of Panama Papers on April 4, 2016, Qayyum said Fernbridge had been his client and he couldn’t disclose details about the owner. About his wife as co-signatory, he explained the client required two signatories and his wife was travelling with him. “It is my practice to normally have a trusted backup signatory in such transactions,” he had said.

Two Panama-based companies owned by the PPP nominee for interim PM who also happened to be the president of a bank in last PPP government would have remained anonymous had this fresh leak not made possible. Tavendish Engineering SA and Jeflian Investment SA were part of documents leaked earlier but the ownership was kept secret.

As companies were in process of opening bank accounts at Swiss bank, LGT Bank, (where companies represented by Qayyum also had accounts), it was made known he, his wife and son are the beneficial owners. They, however, changed mind regarding opening bank accounts after the release of Panama Papers fearing the secrecy they look for is vulnerable to leaks.

The release of Panama Papers also hurried the transfer of a company from mother (Samina Durrani) to her son (Asimullah Durrani).In March 2016, when contacted Tehmina Durrani (daughter of Samina and wife of Shahbaz Sharif) and her mother were untraceable, she expressed ignorance of any property owned by her mother. As the story of Samina’s offshore companies featured prominently, the process of gifting started completing on November 10, 2016.

Armani River Limited which has been gifted to Asad owns a property in the UK whose estimated value has been declared as one million pounds. Source of funding for this property has been described as the saving of his late father, Shakirullah Durrani, former governor of the State Bank of Pakistan.

Star Precision Limited and Rainbow Limited are two other offshore companies of Samina Durrani. Star Precision’s described assets as per Panama Papers is “cash as the investment portfolio. We are also holding 1,165,238 shares in Orix Leasing Pakistan Limited.”

I am not a legal expert but can anyone confirm is it necessary for accuseds to appear in court when verdict is announced or court can do it in their absence? Because i don't see them coming back soon
 
I do not see Nawaz and children coming to Pakistan as they know what is in store for them.

There was no intention of actually jailing them: they were allowed to leave the country and their names were not placed on the ECL. Nawaz and his children will spend their lives in the U. K.

The whole process of accountability looks a farce now. The only punishment for the massive loot and plunder was Nawaz Sharif’s disqualification. Not good enough.

As far as I know they can be declared guilty in absentia.

According to most lawyers on TV since they participated in the trial, it will not be considered a trial in absentia. And verdict can be announced against them.

Does a guilty verdict automatically disqualify her from running for elections? In any other country it would be stupid to ask this question but not in Pakistan where murderers and rapists are running for elections on PML-N tickets.

2. If guilty then they will be classed as criminals immediately and if they are not in Pakistan then arrest warrants will be sent.

3. If not in Pakistan then interpol will be informed and court will tell interior ministry to put them in ECL as soon as they return so they cannot leave.

4. If they don't return to Pakistan voluntarily then Pakistan government can ask UK government to send them but remember there is NO extradition treaty between the two countries so they may not return.

5. Nawaz and family will then start their sympathy drive and seek political asylum. They will build a narrative that they didn't get a fair trial and will seak some sort of deal to find a county to live in peacefully.

6. Nawaz's assets in Pakistan will be frozen.

7. PMLN will be more or less finished in Pakistan and Shabaz alone will be snookered too.

July 6th will be a watershed moment for Pakistan.

Candidates are already quite careful about their asset declarations and tax payment so this sort of decision will send a strong signal that it is NOT ok to steal and stash the money overseas and you will need to justify your assets as a member of parliament.

I don't see how Nawaz Sharif can escape from this, quite clear he presented absolutely nothing and his only proof 'Qatari letter' went to bin (quite understandably).

Nawaz is already disqualified... zayda se zayda they will ask him to be arrested etc but that may never happen since he will not come to Pakistan again unless the establishment or a future government helps him out.

What is more important is that Maryam Nawaz and her hubby will be disqualified and this will mean the end of politics for Nawaz and his clan. The situation is ripe for Shahbaz and his sons to take over, but they do not enjoy the same popularity and a poor showing in the 2018 elections would mean a sudden and swift demise to their politics as well.

Ready to go to prison, says Maryam Nawaz

LONDON: Pakistan Muslim League-Nawaz leader Maryam Nawaz remarked on Wednesday that she is willing to go to prison to pay the high price of the path she has taken.

When asked if she is ready to go to prison, she remarked: "I am absolutely ready.

“There is nothing to be scared of. Once you have picked up this flag of a work which no one has done in last 70 years, there is a price we have to pay and we are paying currently,” she added.

“There is a cost which one must pay and I am aware of it.”

Maryam's comments come a day after the accountability court, hearing the Avenfield reference against the Sharif family, had reserved its verdict in the case.

The verdict will be announced on July 6.

The Avenfield reference, pertaining to the Sharif family's London properties, is among three filed against the Sharif family by the National Accountability Bureau (NAB) last year on the Supreme Court's directives.

The accountability court resumed hearing the case on Tuesday, where Maryam Nawaz and Captain (retd) Safdar's counsel presented his final arguments.

Judge Mohammad Bashir, during the hearing on June 29, had directed Maryam's counsel Amjad Pervez to conclude his final arguments on July 2 in any case.

However, the hearing on July 2 (yesterday) was adjourned until today after Pervez failed to conclude his arguments.

The accountability court has heard the case for nine and a half months and reserved the verdict against Nawaz Sharif, Maryam Nawaz and Captain (retd) Safdar.

I remember him from days of Young Doctors' strike in Punjab during 2010-11. FHF was more powerful than Punjab Cabinet,and more like a defecto CM. He can be "An Asset" better than Ishaq Dar.

You guys are missing a key point NAb court was given the dead line of 9 July by Supreme Court after 3 extensions to give at least one case verdict. NAB can't go out of the way to postpone verdict without consulting SC
 
The judge will probably hear deliberations on the postponment request tomorrow first, after that is rejected he will announce it. Court proceedings will begin 9 am Pakistan time.

Inshallah it'll be like Panama case where I woke up to dozens of congratulatory texts from relatives and friends and it was the first thing I saw in the morning. What a wonderful day that was.
 
Reports are Nawaz Sharif wants to delay judgement because he wants to finish applying for political asylum in the UK, if he is judged guilty it will be considered political asylum.
