PESHAWAR: In yet another setback for the troubled Pakistan Tehrik-i-Insaf (PTI) government in Khyber Pakhtunkhwa (KP) province, party chief Imran Khan Wednesday issued a strong advisory to pull out from the coalition with Qaumi Watan Party (QWP).

Chief Minister Pervez Khattak earlier sacked two ministers belonging to the QWP over poor performances and corruption, PTI’s media cell confirmed.

Minister for Communication and Works Yusuf Ayub of PTI has also been removed from the cabinet for possessing fake degree. Ayub had lost his final appeal in the Supreme Court earlier in the day against decision of an election tribunal in Abbottabad which disqualified him.

Minister for Labour and Manpower Bakht Baidar and Minister for Environment Ibrar Hussain – both belonging to Aftab Ahmed Khan Sherpao’s QWP – were dropped from the provincial cabinet over allegedly being involved in corruption.


According to a statement issued by the PTI media cell, Imran Khan said the QWP was given two warnings about corruption of the two ministers.

“However, the QWP chose to tolerate corrupt practices of their ministers and instead showed its displeasure at the corruption being pointed out by boycotting the provincial cabinet meetings.”

Khan also stated that the PTI was elected on a mandate against corruption and there was zero-tolerance for any form of corruption among the party ranks.

“This should be a clear warning for all our ministers and MPAs and PTI cannot have as a coalition partner any party that tolerates corruption,” said Khan.

“Our Jamaat-i-Islami (JI) ministers have proven exemplary in this regard and we respect them for their commitment towards anti-corruption practices,” he said praising another coalition partner of the PTI.


Meanwhile, announcing his resignation as senior provincial minister in protest, Sikandar Khan Sherpao of QWP said his party was no more part of the PTI government in KP.

He accused the PTI of following ‘anti-Pakhtun’ policies and said it was conspiring against the Pakhtun nation.

Sherpao further said that removal of the two QWP ministers on “baseless grounds” was unethical. “QWP had not been taken into confidence on ministers’ issue other wise we would have taken action against the alleged corruption of the two ministers,” he added.

QWP ministers take oath in KP, Mushtaq Ghani sacked

PESHAWAR: Two Qaumi Watan Party (QWP) legislators took oath as ministers joining Chief Minister Khyber Pakhtunkhwa (KP) Pervez Khattak's cabinet on Tuesday as their party joined the PTI-led provincial coalition government after almost 20 months.

Provincial Governor Mahtab Ahmad Khan administered the oath to QWP's Sikandar Khan Sherpao and Anisa Zeb Tahirkheli.

Anisa Zeb Tahirkheli will serve as minister for mines and minerals as well as labour and manpower while Sikandar Sherpao will be the senior minister for home and tribal affairs as well as irrigation departments.

Sikandar Hayat Khan Sherpao also serves as QWP parliamentary leader in the provincial assembly while Anisa Zeb Tahirkheli is party's serving general secretary.

Earlier in September, QWP had entered into an agreement with the ruling Pakistan Tehreek-i-Insaf (PTI) to share power in province, almost 20 months after the former was thrown out of the province’s ruling coalition on corruption charges.

The agreement was signed by Chief Minister Pervez Khattak and Sikandar Hayat Khan Sherpao himself.

The QWP had become part of the ruling coalition in the province after the PTI formed the government in the wake of the May 2013 polls.

However, the PTI ousted it from the government on November 9, 2013 by sacking its both ministers, including Sikandar Hayat Sherpao and Bakht Baider Khan, on corruption charges.


Mushtaq Ghani sacked as Information Minister

Meanwhile, Chief Minister Pervez Khattak took the charge of information ministry from Mushtaq Ghani.

The minister who was serving as the provincial information minister since July 2014 was sacked to make room for the freshly inducted QWP ministers in the cabinet as according to 18th amendment of the constitution, Chief Minister KP can only keep 15 members in his cabinet.

Mr Ghani joined Pakistan Tehreek-i-Insaf (PTI) after winning a seat of provincial assembly in the last general elections as an independent candidate and was first appointed adviser to chief minister and later included in the cabinet as minister for higher education.

He replaced the former KP information minister Shah Farman as minister for information back in July.

Mr Ghani was the third information minister of the incumbent provincial government as his predecessor Shah Farman too had taken over the portfolio from Shaukat Yousufzai. All three belonged to PTI.

The Khyber-Pakhtunkhwa government finally enacts law providing wide-ranging powers to Ehtesab Commission for elimination of corruption


Taking the lead in fight against corruption.


The Khyber Pakhtunkhwa PTI-led government took a lead from the other provinces for enacting a law and provided wide-range powers to Ehtesab Commission for elimination of corruption and corrupt practices from the public sector in the province.


The PTI-led provincial government under the Ehtesab Commission Act would constitute an independent and autonomous accountability body at the provincial level as it was not satisfied with the performance of the existing government institutions, especially the Anti-Corruption Establishment (ACE) department established for elimination of corruption within the government institutions. The ACE was not independent and was under the provincial government as the ACE had to get permission from the provincial chief secretary for taking action against the officials of grade-18 and above.
The Ehtesab Commission would act independently and even would directly take action against the chief minister of the province and the ministers if found involved in corruption.


On January 7, the provincial assembly unanimously passed the much-propagated Khyber-Pakhtunkhwa Ehtesab Commission Bill, 2013, which provides for the establishment of a five-member Ehtesab Commission and appointment of a director general for preventing corrupt practices and to hold accountable all public officeholders for these practices.


Under the Act, within 30 days of the enforcement of the act, the government will take necessary steps to set up as many as Ehtesab courts as may be necessary to ensure expeditious trial of offences under this act with territorial areas as specified by the Peshawar High Court and dispensation of justice within prescribed time as specified by the National Judicial Policy.
“Each court will consist of a judge, being a person who is district and sessions judge or a senior additional district and sessions judge. The government after consultation with the Peshawar High Court will appoint a judge of each court. The court will not grant any party more than one adjournment during the pendency of a matter from the filing of reference till its disposal,” said the act. The court would be bound to dispose of the case within three months and the accused persons have the right to a file appeal against the decision in the Peshawar High Court.


Senior Minister Sirajul Haq, on behalf of the chief minister, tabled the bill, which was recommended by the House’s Select Committee. Establishment of an independent and autonomous Ehtesab Commission in the province was part of the Pakistan Tehreek-i-Insaf’s election manifesto.
The Select Committee accommodated several amendments moved by the members of the treasury and opposition members. The unique amendment through the committee in the act was an accused person, if honourably acquitted by the final court of appeal, may file for financial compensation.


The provision has been added to Sub-Clause II of Section 44 of the Accountability Commission Act which was passed by the provincial assembly. “Provided that person is honourably acquitted by the final court of appeal, he may be compensated in accordance with Section 35-A of the Civil Procedure Code (CPC),” it states. The Ehtesab Commission will comprise five commissioners to be nominated by the search and scrutiny committee and will be sent to legislative committee on governance and accountability for confirmation.


The commissioners will hold office for one non-extendable term of four years. The speaker in consultation with treasury and opposition in the provincial assembly will set up the legislative committee within one month after the commencement of the act. The speaker will chair the legislative committee comprising five members of the House and will evaluate eligible candidates.


The Ehtesab Commission has the powers to appoint director general (DG), prosecutor general, and director internal monitoring and public complaints wing for the smooth functioning of the commission and effective discharge of the statutory obligations.


The commission will approve annual budget and regulation required to be made under this act. There will be directorate general of the commission that will comprise information and data processing wing, investigative wing, prosecution, finance and audit, internal and monitoring and human resource wings.
The director general will lead the directorate who will be appointed for a period of non-extendable four years.


The DG will cease to hold office if he has been convicted of an offence involving moral turpitude. A person who is a retired government officer in Grade 21/22 or equivalent or is a lawyer eligible to be appointed as a judge of the high court and has served in a leadership position in professional career will be appointed the DG.


The DG can call any person for the purpose of determining whether there has been any contravention of the provisions of this act or any rule or order made there under.


About financial autonomy of the commission, the bill said the remuneration payable to the commissioners, director general, directors, other employees, staff and administrative expenses of the commission will be an expenditure charged upon the provincial consolidate fund. The DG will be the principal accounting officer of the commission. The Auditor General of Pakistan will audit accounts of the commission.


There will be prosecutor general to be appointed for a period of four years. He will give advices to the commissioners and director general upon such legal matters. He will head the prosecution wing and will be responsible for overseeing the performance of special prosecutors who have been appointed to conduct prosecutions of cases and advocates that have been appointed to institute or define cases, appeals, petitions, applications and all other matters before any court or tribunal.


“The Ehtesab Commission will be fully autonomous and there will be no role of executive in hiring and firing. The proposed body can even order the arrest of the chief minister and ministers,” the provincial information minister Shah Farman told TNS. He said there would be Special Ehtesab Courts to conduct hearing into cases on day-to-day basis and that proceeding in any case could be adjourned for seven days only.


The minister said that there would be ‘one-line’ budget to ensure the autonomy of the commission, which would be free from any political interference. He said initially, a 10-member legislative committee having equal representation from the treasury and opposition benches would select seven members of the search and scrutiny committee, who would nominate five Ehtesab Commissioners. The minister said the legislative committee could reject a nominated Ehtesab Commissioner proposed by the search committee with by 3/4th majority vote.

He said strict timelines had been prescribed to ensure that appointment process and functioning of the Ehtesab Commission was not sabotaged due to delays and secretary provincial assembly would serve as secretary to the legislative committee. He said that members of the search and scrutiny committee would hold domiciles of Khyber Pakhtunkhwa, while every member would declare his assets as per law.
He said the search and scrutiny committee would nominate one of the Ehtesab Commissioners as Chief Ehtesab Commissioner to the Legislative Committee on Governance and Accountability.


“As for the education qualification, an Ehtesab Commissioner should be a bachelor’s degree holder; the minimum age is at least 45 years old and at most 65 years old during the year of selection, and he should be competent, honest and of good repute,” he said.
Unlike the National Accountability Ordinance 1999, the new law envisages that there would be no plea bargain with an accused person by the Ehtesab Commission. Only the trial judge would be allowed to consider that full recovery of the assets accumulated through illegal means along with interest has been effected due to cooperation of the convict and consequently leniency may be shown in awarding imprisonment. The offence of corrupt practices will be punishable up to 14 years with fine up to one million rupees and confiscation of property.

KP accountability chief resigns in protest


PESHAWAR: Retired Lt Gen Mohammad Hamid Khan, the director general of the Khyber Pakhtunkhwa Ehtesab Com*mission, resig*ned on Wednesday in protest against promulgation of an ordinance by the provincial government that drastically amended the Ehtesab Act of 2015.

The ordinance, promulgated on Tuesday, makes approval of the five-member commission mandatory for arresting a suspect and reduces the maximum period of physical custody of a suspect from 45 to 15 days.


The ordinance provides that no legislator will be arrested by the commission without prior intimation to the Senate’s chairman or the speaker of the national or provincial assembly, as the case may be. Similarly the chief secretary will have to be informed before the arrest of a civil servant.

Gen Khan sent a three-page resignation letter to KP Governor Sardar Mehtab Ahmad and said that the amendments had rendered the post of director general redundant, made the accountability process controversial and questionable and negated the autonomy of the accountability watchdog.

PESHAWAR: The Khyber Pakhtunkhwa government on Thursday conditionally terminated the services of Pakhtunkhwa Energy Development Organisation (Pedo) chief Akbar Ayub Khan saying the termination is subject to the Supreme Court’s decision on his appeal.

A notification issued by the KP energy and power department said the after the June 7, 2017, judgment of the Peshawar High Court, the services of Pedo chief executive officer Akbar Ayub Khan were terminated subject to the interim order or final judgment of the apex court.

It added that the competent authority had assigned the additional charge of the Pedo CEO to the energy and power secretary with immediate effect until further orders.

A relevant official told Dawn that after disqualification, Mr Ayub was given 60 days on June 16 by the Peshawar High Court to continue as the Pedo chief for the filing of the civil petition for leave to appeal (CPLA) with the Supreme Court.

Says termination subject to SC decision on Akbar Ayub’s appeal

He said soon after the CPLA was filed, the relief granted to Mr Ayub was automatically withdrawn and therefore, the government had to de-notify him as the Pedo chief.

Earlier on Saturday, the KP government had filed an appeal with the Supreme Court against the high court’s decision to disqualify Mr Ayub.

Pedo accountant Fazal Rahim had challenged Mr Ayub’s appointment with the high court saying he didn’t have the required qualification and that his appointment was made in violation of merit.

He insisted that Mr Ayub’s appointment went against the Pedo Act 1933, which stated that the organisation’s head should have the experience of energy and power sector, but Mr Ayub had a finance background and was appointed for being supported by senior Pakistan Tehreek-i-Insaf leader Asad Umar, a member of the KP Energy Apex Committee.

On June 7, the high court had declared Mr Ayub’s appointment illegal ruling that the process of appointment of the Pedo CEO was a violation of merit and that he even should not have been shortlisted for the post.

However, the provincial cabinet in its meeting on August 17 approved an ordinance to amend the Pedo Act, 1993, to give legal cover to the appointment of Mr Ayub.


The energy and power department, which has the administrative control of the Pedo, shared the draft ordinance with the law department on June 15, hardly a week after Mr Ayub’s disqualification by the court.

However, the law department, in its reply on the same day, asked the energy department to ensure that the amendment is not in violation of the high court’s order against Mr Ayub.

The cabinet approved the proposed amendments to Section 5(1) of the Pedo Act 1993.

“The government shall appoint CEO of the organisation from amongst the person of known integrity and competence, with minimum of 12 years of experience in the field of law, business, engineering, finance, accounts, economics, or power industry on such terms and conditions as the government may determine,” it read.

The same clause had led to the disqualification of Mr Ayub for lacking experience of energy and power sector.

A law department official told Dawn that the energy department was eager to add the retrospective effect to the ordinance but the law department managed to get it deleted.

He said the ordinance had yet to be signed by the KP governor and that it would be promulgated once that happened.

At least the Sharifs get something out of it, namely their (and all others') money, but what do they get in return in supporting the Sharif dynasty (the third generally is already being geared to continue the mental slavery) ? I mean apart from the fact that this stolen money could have been invested in areas like eradicating illiteracy, alleviating poverty, etc

Asset Recovery Unit to begin probing thousands of foreign properties held by Pakistanis

Special Assistant to the Prime Minister on Accountability Shahzad Akbar in a joint press conference with Information Minister Fawad Chaudhry on Friday said that the newly constituted Asset Recovery Unit comprising National Accountability Bureau and Federal Investigation Agency officials will investigate thousands of properties abroad held by Pakistanis, Radio Pakistan reported.

Akbar said that members of the ARU had been selected, and details of over 10,000 properties in Dubai and England had been received.

He added that details of at least half of the 10,000 properties were previously available but no action was taken.

Notices have been issued for 300 properties from the list.

He added that the list had been divided into two parts, one for politically exposed people, and one for other citizens.

The ARU will submit a fortnightly progress report to the Supreme Court, he said.

Akbar also said that Islamabad is in contact with the Swiss government regarding the ratification of a treaty for exchange of information.

Akbar said that the treaty would be ratified and acted upon soon.

Akbar claimed that ratification of the Swiss treaty for the exchange of information, which would give Pakistan information on bank accounts, was supposed to be completed by 2013-14 but had been intentionally delayed by former finance minister Ishaq Dar who prevented the ratification from taking place for five years.

The special assistant on accountability said that the solution their department had found for this was to approach the German government, which has in 2013 announced that it had acquired information on Swiss accounts until then, and would make it publicly available to all governments, particularly those of developing countries.

Despite this, Akbar said, the government of Pakistan had not asked the German government for this information.

"You all know whose details would have come out if they had asked for the information," he remarked.

Akbar said that their department had officially asked the German government for the information and once it was received, they would be able to access information for accounts created, both in the past, and in the future.

He said that India had previously taken information on Swiss accounts from the German government, which Pakistan quoted as an example in their request to the German government for which they are awaiting a response.

He hoped that keeping the government's vision in mind, and the cooperation that they are receiving, Islamabad would receive the same cooperation from the German government so that proceedings could be initiated against the information regarding Swiss bank accounts.

The Prime Minister's special assistant on accountability said that Pakistan had also invited other countries such as the United Arab Emirates, United Kingdom, China and the United States with whom it has existing bilateral treaties to revisit these treaties and add similar clauses for the exchange of information. Akbar said that this was to ensure that banking and asset details could be provided to Pakistani institutions.

He said that the previous government's shortcomings were evident in the arrangement with the US, which allows Washington to access Pakistanis' details but does not grant similar access to Islamabad as there is no such clause in the agreement.

"These are the shortcomings that we are trying to eliminate," said the PM's special accountability assistant.

Indeed. At least the Sharifs get something out of it, namely their (and all others') money, but what do they get in return in supporting the Sharif dynasty (the third generally is already being geared to continue the mental slavery) ? I mean apart from the fact that this stolen money could have been invested in areas like eradicating illiteracy, alleviating poverty, etc

Most of their supporters that I have observed are a part of status quo in one way or another and they feel that change(tabdeeli) will have negative impact on their livelihoods. From clerks to commissioners, from patwaris to top bureaucrats, most of them are a part of the very status quo that Imran fought against so their alignment with the corrupt is understandable.

There is a reason why these opportunists are all so happy siting behind keyboards and typing rubbish instead of coming out on the streets and demand for their 'rights' which requires moral/ideological courage.
