Sharjeel Khan case : Aaqib Javed testifies before anti-corruption tribunal [#316]

:))

That doesn't happen in any workplace. You're always suspended until the investigation is over.

If an accountant is messing with the books, will their firm just let them carry on as if nothing happened?

Ain't Nawaz Sharif still the PM?

LAHORE - The PCB's application to include evidence from the UK's National Crime Agency (NCA) against Sharjeel Khan has been rejected. The three-man tribunal's decision means the PCB will have to stick to the original evidence , under which the player was charged with five breaches of the Anti-Corruption Code. The case now hinges on another request by the PCB to push for Sharjeel's appearance for a cross-examination. The tribune will take up the matter from June 18.

"We were convinced that this application would be dismissed because it was completely speculative," Shaigan Ijaz, Sharjeel's lawyer said. "PCB itself didn't really know what they were looking for and it was only surmises and conjectures. Such an application could not be allowed when PCB and Sharjeel had completed their evidence and the case is in its final stages." In what appears to be another interesting turn-around the tribunal has decided to put its proceedings against Khalid Latif on hold. The tribunal will send a reference to the PCB chairman informing him about the objection raised by Latif and his lawyer. The case has been adjourned for an indefinite period.

After losing Asif, Salaman butt, and Amir, how could PCB not protect and educate diamond like Sharjeel?? Mind boggling to see waste of talent in Pakistan.

sharjeel if he has accepted taking money from bookies and contacting them willingly knowing who they are, even if he didnt spot fix, should be punished for this

if he has accepted, he is guilty, doesnt matter if its fixed or not

and i really think that many top management people in PCB are culprits as well, players are only low level culprits

watching interview of rashid latif and hearing him how PCB officials were involved in match fixing in the 90s just tells me, its cant really be players only, big fish must be caught and fried before the small fish and what about bookies? when will they be caught and fried?

sharjeel khan is not a kid, he knows he committed a crime and did something wrong, it is he who went with jepardising his career and now only paying for what he has done

I have strong suspicions that the PCB never had any intentions to convict Sharjeel in the first place. This whole facade is to just show the world that the PCB tried their level best to prosecute Sharjeel but the evidence was ultimately insufficient and this way Sharjeel when he comes back to the team can claim to have gone through the legal process.

Rizvi is firm.

PCB is trying too hard to destroy our only modern day batsman. I wonder who runs PCB.

Shame on PCB. After Asif, Amir and Salman getting wasted, this should have never repeated. PCB should have educated and taken care of these guys like a hawk to make sure that they never get tempted.

Hearing on twitter that Sharjeel is 90% to be cleared. However, these sources are not reliable so not getting too excited yet

Sharjeel Khan was threatened to admit the spot-fixing allegations

Mumbai, June 18: Pakistani opener Sharjeel Khan, who has been suspended for the spot-fixing allegations in the Pakistan Super League (PSL) was threatened (to accept the charges) to save his cricket career. This on Sunday was claimed by his lawyer Shaigaz Ijaz.

Speaking exclusively over his mobile from Lahore, where he was preparing to represent his client for Monday's hearing, he said, "in Dubai when Sharjeel Khan was being interviewed by the ICC officials Colin Tenant, Stephanie McCormick and Col. Khalid (Integrity Officer of Islamabad United team) at the ICC Head Quarters, Col. Azam Khan, (General Manager : Security and Vigilance Department (Pakistan Cricket Board, PCB) entered the room and asked Sharjeel "You will reply as I have instructed/told you".

"Col. Azam also took Sharjeel Khan along with him in his car from the cricket ground to ICC Headquarters and continuously threatened him to do as per his wishes if he (Sharjeel) wanted to play cricket again", the lawyer claimed.

Sharjeel Khan and his lawyer are believed to have the recording of this conversation. "It was a ploy to trap Sharjeel. Had he admitted these charges then, he would have been immediately banned". The 28-year-old left-handed batsman has played 1 Test, 25 ODIs' and 15 T20 matches for his country.

"It is evident that PCB's Anti-Corruption unit has concocted this scenario just to show their efficiency."That PCB's application to produce in evidence findings of NCA at this stage of the case is against the settled principles of law when both PCB and Sharjeel Khan have led their evidence", he further added.

The PCB in its cross examination is likely to produce few cricketers, who would watch the video recording of the match for their judgement. Sharjeel Khan has obtained the testimonials from Dean Jones (coach of his team at the PSL), Sadqi Mohammad (the brother of late Hanif Mhammad) and Mohammad Youfus, all former
cricketers. "Dean Jones coach of Islamabad United as well as Muhammad Yousaf and Sadiq Muhammad have all testified in support of Sharjeel asserting that alleged (two) dot balls were played on merit with intention to score runs. Sharjeel even ran on the second ball but was stopped by the non-striker", the lawyer further added.

Unlike Khalid Latif, Sharjeel Khan has not objected to the composition of the panel, which is investigating the charges. "There are people in this committee of high integrity and we have no problems with them", he signed off.

This just begs the question why would they do this?

what are the reports ? any chance of sharjeel coming back in the next series....

I doubt it. He'll most likely get banned for not reporting the meeting with the bookie. I think it was 6 months or so, but if they include the previous months of which he hadn't been playing and banned, he'd be back soon enough.

It all depends on these reports though, and if there's and truth in them.

Lol this is getting stranger by the day.

Isn't Sethi the new PCB head now?

I wonder how that will play out in the near future.

Entrapment? Seriously, how stupid can PCB get? IF those reports are true, Sharjeel has an opportunity to flip the case and try and get these individuals put in front of a court for blackmail and entrapment.

And while all of you would like Sharjeel to do the right thing, some of you seem to be laboring under the assumption that he is guilty and refuse to believe otherwise.

Look, PCB holds all the cards here. They got a tip before the match. They purportedly had records of Sharjeel's conversations with the bookie. They supposedly knew the details of what Sharjeel had to do to accept the fixing. If they had all these pieces of information, if they really did, Sharjeel would be stuck-there would be absolutely zero chance of his exoneration.
But despite apparently having all these pieces of evidence, all appearances are that they are not capable of getting him convicted.
So why don't those of you who believe he is guilty consider the reasons why he may be innocent?

This just begs the question why would they do this?

The only explanation i can think of is that initially there might have been some misunderstanding on part of ACU where they would have thought that sharjeel is guilty.. they jumped the gun way too early to show that they are an efficient body and have caught a big fish but later realized that its nothing serious. Sethi on the other hand announced stuff publically and made matters worse which meant that any possibility of backtracking was lost. Everything snowballed into a big mess. Sure there might have been approaches made by bookies but maybe nobody spot fixed and its just a cover up to avoid embarrassment.

A three man tribunal has reached a decision on whether Sharjeel will have to appear but will not publicly announce it for a few more days. Wonder what this means

the case against Sharjeel is extremely weak now; if PCB has any integrity left they will declare Sharjeel not guilty provided Sharjeel promised in writing to not take them to court.

How do you know that case is weak Bhai?

3-5 years ban is on the cards

Can someone fill me in to what is actually going on?

I've lost track.

From the top of my head, PCB made various allegations against Sharjeel but have not provided adequate evidence to support them so are struggling to get the guilty verdict.

I just wonder if PCB would even select Sharjeel if he is proven not-guilty because he'd have embarrassed them in court.

Aaqib Javed invited as an expert in spot-fixing inquiries

Former Pakistani fast bowler Aaqib Javed has been invited as an expert observer on the ongoing spot-fixing allegations against players in the Pakistani Super League (PSL), it is learnt here.

According to the highly placed sources in the PCB, the Anti-Corruption Tribunal comprising of Justice (retired) Asghar Haider, General (retired) Tauqeer Zia and Wasim Bari has summoned Aaqib Javed on July 6 and give his verdict after seeing the footage of one of the PSL matches where Sharjeel played the two dot balls.

“Aaqib, who has coached the Pak. players will be asked whether the balls were played on merit or in a pre-determined manner”, the source explained, adding, “at present only Aaqib has been invited but more players will be called, if required”.

“Both parties- the PCB and Sharjeel Khan will also be given an opportunity to cross-examine Aaqib”.

In another development, the Anti-corruption tribunal has also dismissed the PCB’s appeal to invite Sharjeel Khan into the witness box.

“The charges are levelled by the PCB and they have to prove the allegations and it is not the other way round where Sharjeel has to prove his innocence first”, the source further added.

Sharjeel Khan, through his three witnesses, Dean Jones, Sadiq Mohammad and Mohammad Youfuf have already told the court that the dot balls were played on merit and not in a pre-detemined manner as alleged by the PCB.

Apparently seems sethi and co rushed to make allegations but have no evidence to back them up !! Again i say 6 months -1 year ban maximum. Even he may be acquitted !

Wow this is just getting out of hand. If the board had no solid evidence why did Sethi run around the media and gave statements about it.

Well this really makes the PCB look really bad, they should have looked into this before pointing fingers.

He is one of the cleanest. He also provide his straight forward opinion to committee probing Sydney test loss. Video leaked

Well both of the previous witnesses (Dean Jones and Moyo) rubbished corrupt Sethi's assertions so now they are looking for someone who will say the things they want to be said.

We may never know if he was guilty or not. But I think decision will be positive for Sharjeel considering the situation that is now, Seems no solid evidence is there with PCB except the match footage, videos from Dubai and WhatsApp messages, these too are only between Khalid and Nasir.

The million-dollar question is: Do the whatsapp messages contain specific reference to two dot balls that were to be the first two balls Sharjeel faces up to Hasan Ali?

I think that is not the case, otherwise PCB would not have been struggling like they are now to form a case.

I am pretty sure there is insufficient evidence for them to convict Sharjeel of spot-fixing. More likely, they will give him a six-month ban for not reporting an approach and go after Khalid Latif and Nasir Jamshed.

Here is my take on this incident

Sharjeel has met the bookie,he informed Wasim a bit late after he had been in trouble
PCB fear Cricketers haven't learnt a lesson and don't know what happened, they have a poor case and don't have a valid argument,To stay out of controversy they want to convict Sharjeel guilty and say I told you so,He should have the same punishment as Nawaz,Sharjeel didn't play those on purpose,he didn't have a different grip on his bat, that bookie could have been his fan whom Sharjeel walked away from once he started doggy dealings

Khalid Latif this guy is the one that was going to Fix but didn't play, with his incident and deal with the bookies and different grips the PCB also found out about Sharjeel,

Sharjeel sent a tweet when pak won this was the first time since before the PSL,seems he is out of hot water

He will definitely get punished but from 1-6 months

Hearing murmurs that Sharjeel has been cleared by the tribunal. I can't confirm it yet but some news channel has a graphic on the screen stating the news.

Lets hope he is clear so that he can join Fakhar Zaman to formthe most devastating ODI partnership we have had simce the days of Saeed Anwar and A sohail.

Seems like the case will take 1 more month to produce an output.
First court witness will present on 6 July.

I've been getting a lot of questions on this one.

The TV graphic has been taken out of context. Basically it says 'Tribunal rules in Sharjeel Khan's favour' but that doesn't mean he's cleared, it's simply as mentioned in the above report; PCB asked to invite Sharjeel into the witness box but the tribunal declined, thus they 'ruled in his favour'. But the case is still ongoing.

Suppose Sharjeel gets some fixed months ban, will the duration of investigation and hearing be be taken into consideration to reduce ban some period of ban he has already served considering he has missed a few series, PSL and Champion Trophy?

Yes will be considered

All those people jumping and down about Sharjeel being cleared - read above.

We still have to wait a while cos the next case is in July. But at least we don't have any series until October so if he is cleared (big if) he won't be missing anything most likely. I think the suspension from PCB that resulted in him missing PSL, Pak-WI series and CT may mean he may not get a ban even for failure to report. But SL in UAE we don't need him that badly. I hope if he is cleared he is back for the NZ tour. Would love to see him and Zaman against Boult and Southee

I received some emotional messages how PCB destroyed career of an innocent Sharjeel :)

Yeah, I think you're right. Thing is though the tribunal ruling against the PCB is a huge turn of events seeing as though that was what the PCB relied on to prosecute Sharjeel. It also shows Sharjeel msy have a better case to fight against than Latif and Jamshed.

Think Sharjeel is coming back. Lack of evidence to convict is probably the situation which explains why the trial is taking so long. My prediction with others that Sharjeel will get the small ban up to a year for not reporting a fixing approach early enough and by the time that punishment is dished out, he will have already have served that time of suspension out of cricket.

Sharjeel may be innocent here, but I've always been suspicious of people caught with meeting a bookie, with all the warnings around (and even without that), don't really think players go and eat dinner/have meetings with bookies by accident, I feel it's most often with purpose and the player themselves had the intention to fix. I think it's also very difficult to prove the act of fixing, just because they can't find hard evidence after the player agreed to fix, doesn't mean it didn't happen.

Having said that I really do hope that Sharjeel is truly innocent. Not guilty and convicted. Or worse guilty and not convicted. We've had enough of this fixing drama and it would be nice for this all to be a mistake, so wishing he is innocent.

I am ok with at least one year. Hopefully others establish their place and he is no longer required. Also fine with him being banned and challenging it in court and the whole process taking enough time for his career to be over.
Generally speaking PCB is pretty soft on all types of fixers, but because this concerns their main money spinner, the PSL, I hope they are cautious and ban him regardless of weight of evidence.

Probably not. I can tell you now it's probably not a slam dunk hence all these issues. But it's thee kind where everyone knows the player is guilty but don't have the critical 10% to successfully prosecute. Since this is not a legal tribunal per se, I am happy with them not having the standards of a criminal court. Sentence him and be done with it, I say.

They are just wasting time. Give him a 6 month ban for not reporting and bring him back. If we had Sharjeel opening with Zaman we would have scored 400 against the bhartis :)))

Now this is a certainty that he is guilty of something, Late reporting, Not reporting, Agreeing to fix or whatever. Because the charges made by PCB are regarding these offences, Now we have two points to look at here, Tribunal have rejected two of PCB's requests and basis for rejection and argument presented by both sides is not clear as basis for reasons.

As per the PCB Lawyer the evidence presented by them is more than enough, 30-70 in favor of PCB right now I think.

If he is guilty of fixing, Then he should be banned for a long time or even life ban. Can't set a wrong example.

We have young players coming up who need to be aware of what they're doing.

Should be banned if guilty of fixing.5 year ban.Even if he has agreed to fix but didn't,should be banned for at least 2 years.

I see a lot of people mention that Sharjeel has met a bookie. Can someone post a news article confirming this or is this all just hearsay?

To me, it looks like PCB (Sethi) jumped the gun again...

I am sure Aqib will not be asked to demonstrate some lush cover drives at the hearings. Whether he could bat or not is irrelevant man.

The entire nation is drooling over the prospect of Sharjeel and Fakhar opening together. The entire nation actually believes we can win the CWC 2019.

Well I hope that isn't how they conclude the trial and verdict. If there's lack of evidence, fair enough but don't go by what the future may hold if he or other are let off. We clearly didn't learn anything from the Waqar/Wasim and the Qayyum report.

Fully agree with that.

Aaqib testifies before anti-corruption tribunal

LAHORE: Former Test medium fast bowler Aaqib Javed said on Friday that if the story narrated by the Pakistan Cricket Board (PCB) was true, then spot-fixing did occur in the opening match of the Pakistan Super League (PSL).

Aaqib was talking with media after recording his statement as an expert witness before the PCB Anti-corruption Tribunal probing allegations of spot-fixing.

He said anyone could play dot balls and players of the calibre of Chris Gayle could also play dot balls, and so too Sharjeel Khan.

The PCB alleged that it had proofs of Sharjeel’s involvement in spot-fixing that he had played two dot balls in the opening match of the PSL between Islamabad United and Peshawar Zalmi according to the plan of bookies.

Aaqib said the tribunal did not show him any video or picture, or play any audio but narrated a story, according to which a plan for spot-fixing was made and it was executed exactly.

To a question, the former fast bowler urged the PCB to take stern action against those involved in the dirty practice. He said the cricketers should have informed the PCB immediately if any bookie had contacted them.

He added had the PCB taken action against those involved in such activities in 90s, the disease would not have spread. “Due to careless attitude of the PCB, youngsters find themselves attracted to such practices,” he maintained.

He also criticized the PCB for covering such cricketers in the past with the stance that they were talented so they should not be punished and they would not repeat their ‘mistakes’.

To another question, Aaqib said T20 cricket was unpredictable. A player could lose his wicket even on a full-toss delivery and sixes could be hit on good deliveries.

Former Test cricketers Mohammad Yousuf and Sadiq Mohammad had told the tribunal in their statements that Sharjeel had played the dot balls on merit.

Meanwhile, PCB’s lawyer was delighted over Aaqib’s statement and praised him for being a fine cricketer and principled person.

He said Aaqib was of the view that spot-fixing was like a cancer and stern action should be taken against those involved in the crime.

The counsel further said an official from the England National Crime Agency would appear before the tribunal as a witness either personally or through Skype on July 13.

He requested the tribunal to question Sharjeel itself if the cricketer was not ready to answer the lawyer’s questions.

The attorney further said Nasir Jamshed’s lawyer was not well so he did not appear before the tribunal, however, he had submitted the answering brief to the tribunal.

They only reason Aaquib Javed was called is because he would tow PCB's line on the matter and his testimony would be taken as "proof". This would be explained by no audio or video recording shown to him, instead just a story narrated and also the reaction of the PCB lawyer who was "delighted" by Javed's statement. Corrupt Sethi at it again.

Looks like PCB made a huge blunder while trying to get good numbers from ICC. Anyone can play dot balls

Don't see how this testimony from Aaqib will help the case. Or any of the testimonies, in fact.

Just show the 'proof' that allegedly exists and let's move on.
