KARACHI: Retired Captain Safdar on Sunday chanted the PML-N slogan "vote ko izzat do (honour the vote)" and urged people to join him, while on a visit to the Quaid's mauseoleum with PML-N vice president Maryam Nawaz.

Party workers and supporters responded to Safdar's call and chanted along for an extended period of time as Maryam Nawaz and party spokesperson Marriyum Aurangzeb looked on.

The move was met by a fierce reaction by government representatives who not only demanded an apology, but approached the police, asking them to initiate legal action against all those who participated in the act.

'Just not acceptable'

Minister for Maritime Affairs Ali Haider Zaidi said the behaviour "is just not acceptable'.

"The sanctity of Quaid's Mazar [has been] disrespected by these criminals masquerading as politicians," he wrote.

'Captain Safdar, Maryam must apologise'

Minister for Science and Technology Fawad Chaudhry also criticised Safdar and said both he and Maryam must apologise.

'They only have respect for Nawaz, no one else'
Minister for Planning, Development and Special Initiatives Asad Umar also demanded an apology from the party.

He said that these "shameless people are ignorant of their history, and have no sense of regard and respect for such a place."

"They only have respect for Nawaz. They don't know how to respect anyone else," Umar added.

'Shameful that the mazar was used for politics'

Minister for Information Shibli Faraz said that the fact that the mazar of the founder of Pakistan was used for politics is "highly condemnable and shameful".

He said the PML-N should have instead asked for forgiveness from the Quaid "for having mercilessly looted the country, gone against his ideology, and filled their pockets to leave the people dirt poor".

'Case must be filed against them'
Governor Sindh Imran Ismail said the inspector general of police "must file a case immediately" against such "shameless individuals" who disrespected the Quaid's mausoleum.

"I have never before witnessed such a dishonourable move at the Quaid's mazar. This is the height of ignorance."

PTI representatives go to police

A group of PTI representatives, including Haleem Adil Shaikh and Raja Azhar, rushed to the Brigade police station to lodge a case against the PML-N leadership.

According to the request, a copy of which was seen by geo.tv, the police have been asked to file a case against Capt Safdar, Maryam Nawaz, Marriyum Aurangzeb.

The Station House Officer has been requested to bear in mind that the PML-N top tier leadership violated the sanctity of the mausoleum by crossing the metal barrier placed around the grave and chanted slogans that not only disrespected the site but also hurt the sentiments of the people.

It stated that the incident occurred around 5:30pm and was broadcast not only locally but also by foreign media outlets.

"This not only prompted angry citizens to take to the streets, but law enforcement was prevented from taking any action, which is against the law," the request states.

It said that interference in the government's course of action is a "grave crime".

The request, signed by MPA Raja Azhar Khan, asked that legal proceedings be undertaken against about 200 people present there who took part in the act.

Mazar-e-Quaid management also file complaint

Separately, the management of Mazar-e-Quaid also filed a complaint over the event that transpired.

The application has been filed at the Brigade police station, where the PTI complaint has been registered.

The station house officer confirmed he has received the complaint.

Capt Safdar arrested from Karachi hotel for 'violating sanctity of Quaid's mausoleum'

PML-N vice-president Maryam Nawaz tweeted early Monday morning that her husband retired Captain Mohammad Safdar had been arrested by the police from their hotel in Karachi.

"Police broke my room door at the hotel I was staying at in Karachi and arrested Capt Safdar," Maryam said via tweet.

According to Maryam, she was sleeping when the police allegedly "barged in".

PTI minister Ali Zaidi, however, refuted her claim, saying "Maryam [is] once again lying that the hotel door was broken."

Safdar is being kept at the Aziz Bhatti police station. He has been arrested a day after he raised slogans at the Quaid's mausoleum before the Pakistan Democratic Movement's (PDM) second power show at Bagh-i-Jinnah.

It is expected that Safdar will be presented before court some time today.

The arrest comes after a first information report (FIR) was registered against Maryam, Safdar and 200 others for violating the sanctity of the Quaid's mausoleum. The complainant, Waqas Ahmed, alleged that the PML-N leaders, along with 200 of their followers, reached the Quaid's grave where Safdar jumped over the grill surrounding it.

The complainant said that he tried to stop him from doing so but Safdar "got out of control" and started threatening him and his fellows that he would kill them. He added that Safdar later damaged government property before leaving the site with his followers.

"My complaint is that Safdar and his cohort violated the sanctity of the Quaid's mausoleum and his grave. A case [should be] registered against him for raising political slogans inside the mausoleum complex, death threats against me and for damaging government property."

According to the FIR, a copy of which is available with Dawn.com, a case has been registered on Section 6, Section 8 and Section 10 of The Quaid-i-Azam’s Mazar (Protection and Maintenance) Ordinance, 1971.

Section 6: Meetings, etc. prohibited. No person shall organise, convene or take part in any meeting or demonstration or procession or engage in political activity of any kind within the Quaid-i-Azam’s Mazar or within a distance of ten feet from the outer boundary thereof.

Section 8: Sanctity of Mazar. No person shall do any act or behave in any manner which is or tends to be derogatory to the sanctity and dignity of the Quaid-i-Azam’s Mazar.

Section 10: Penalty, etc. (1) Whoever contravenes any of the provisions of this Ordinance shall be punishable with imprisonment for a term which may extend to three years, or with fine, or with both. (2) An offence punishable under this Ordinance shall be tried in a summary way in accordance with the provisions contained in sections 262 to 265 of the Code of Criminal procedure, 1898 (Act V of 1898).

Sindh govt distances itself from arrest

Senior PML-N leader and Maryam's spokesperson Mohammad Zubair, while speaking to reporters in Karachi, claimed that Safdar's arrest was a "sting operation by the state" and was carried out to damage the PDM alliance.

He said he had talked to Sindh Chief Minister Murad Ali Shah and PPP Minister Saeed Ghani and would reveal the facts before the public soon. "The easiest way for Imran Khan is to arrest [Safdar] so the entire blame will fall on Sindh government and police."

Ghani tweeted that while Captain Safdar's behaviour was inappropriate, the way his arrest was carried out was condemnable.

He alleged this was being done to create a rift among PDM and that Sindh government had no role in the arrest.

PPP MPA Sharmila Farooqi said "sloganeering inside Mazar-e-Quaid is inappropriate, but breaking doors & arresting Captain Safdar in this manner is also unacceptable".

"Sindh government is not a party to this. Clearly a blatant attempt to sabotage the solidarity of PDM and defame Sindh government," she added.

MNA and Pashtun Tahaffuz Movement (PTM) leader Mohsin Dawar — who had attended and addressed PDM's rally in Karachi a day earlier — also condemned the PML-N leader's arrest.

"The violation of privacy is shameful and goes against every norm of decency. Reportedly, Sindh police were forced by Rangers to do this. Those who planned it have attacked the sanctity of Sindh’s hospitality."

'All Pakistanis offended'

Information Minister Syed Shibli Faraz, while speaking to reporters at Peshawar Press Club, said that every Pakistani was offended by what happened at the Quaid’s mausoleum.

"Did you see the ruckus that was created by Safdar, Maryam? They disrespected the sanctity of the founder of Pakistan, the mausoleum," he said, adding that this arrest had nothing to do with politics but with actions having consequences.

Minister for Federal Education Shafqat Mehmood was "glad Sindh Police has enforced the law and arrested Capt Safdar".

"He committed a crime at the Mazar-e-Quaid yesterday and law must take its course."

PTI minister Shireen Mazari, responding to criticism of the arrest, said "there are rules and laws in place to observe sanctity of the mazar", sharing a picture. "And these laws were not devised by PTI govt!"

Minster for Science and Technology Fawad Chaudhry said the arrest was in accordance with the law, adding that the Quaid's mausoleum "was not a playground for lowly politicians".

Meanwhile, Maritime Affairs Minister Ali Zaidi warned the Sindh chief secretary and Sindh Inspector General of Police Mushtaq Mahar that action must be taken against the "hooligans who created ruckus" at the Quaid's mausoleum.

"If they are allowed to leave Karachi, you will be directly held responsible for letting them escape. You will be considered as aiders and abettors in the crime," he said in a tweet.

In a video shared by PTI, he said that it was "not acceptable", warning the opposition to "behave themselves". "Nobody will tolerate this hooliganism at Jinnah's mausoleum," he said.

In a separate tweet, the party's Karachi chapter said the PTI members of the provincial assembly had managed to get an FIR registered after "10 hours of continuous efforts".

What happened?

A day earlier, Maryam along with the senior leadership and a large number of workers went inside the hallway in Quaid's mausoleum to offer fateha and lay a floral wreath. As per the tradition, a qari recited verses from the Holy Quran and Maryam and a few others offered fateha inside the grilled premises.

As soon as the fateha ended, PML-N workers who were standing outside that iron grill in the same hall, shouted slogans in favour of Maryam. Capt Safdar signalled them, apparently to stop them from raising that particular slogan at the grave of Quaid-i-Azam, and started chanting vote ko izzat do slogan that too was against the protocol of the mausoleum.

While Maryam and other leadership stayed silent, Safdar kept on chanting another slogan, ‘long live mother of the nation’, and the crowd responded in an emotional manner. The scene lasted a couple of minutes and Maryam along with others left the premises.

Many social media users also considered the incident as disrespectful and vented their anger against Safdar, Maryam and the PML-N.

PTI central leader and Federal Minister Ali Zaidi had tweeted a video of Capt Safdar shouting slogans and wrote: “This is just not acceptable. The sanctity of Quaid’s Mazar disrespected by these criminals masquerading as politicians.”

Federal Minister for Planning and Development Asad Umar also tweeted the video and, in a strongly worded statement, demanded the PML-N to apologise to the nation for “disrespecting the sanctity of the Quaid’s mausoleum”.

Later in the evening, senior PTI leader Haleem Adil Shaikh reached Brigade police station to lodge an FIR against the PML-N leadership for violating the sanctity of the Quaid’s mausoleum.

And he has been released! Man, he is a despicable person. He was given VIP treatment. The police treated him gently and now the court has released him. There is no justice for the powerful.

It took 5 years for a poor farmer to get a bail for alleged chicken theft and these crooks are given special treatment wherever they go!

According to you nobody can disrespect Quaid-e-Azam's mazar but we are openly allowed to flout his principles of democratic sovereignty and equality for minorities.

IK can't run each and every institution from the PM's office. It is the job of the institutions, police, courts to take action, if they release favorable verdicts against the likes of the Sharif's, Zardari's, Bhutto's, how can he be blamed? Should he just declare martial law and make himself the sole authority in the country then?

PML-N's vice-president Maryam Nawaz and JUI-F chief Maulana Fazlur Rehman on Monday claimed that retired Captain Mohammad Safdar was arrested with the aim of dividing the opposition's anti-government alliance, with Maryam saying she never thought "for even a moment" that the arrest was carried out at the Sindh government's behest.

Instead, while answering a journalist's question at a press conference in Karachi, Maryam alleged that the Sindh inspector general of police was forcibly "taken to the sector commander's office and asked to sign on the arrest orders".

She claimed that when the IGP showed reluctance, he was told that the arrest would be carried out by the Rangers. "After his signatures were forcibly taken on the arrest orders, he was told police would carry out the arrest."

Her statement came hours after an audio clip emerged on Twitter in which PML-N leader Mohammad Zubair, who was recently appointed as spokesman for PML-N supremo Nawaz Sharif and his daughter Maryam, purportedly said that Sindh Chief Minister Murad Ali Shah told him the IGP was kidnapped and forced to register the FIR against Maryam, Safdar and 200 others for violating the sanctity of Quaid-i-Azam Mohammad Ali Jinnah's mausoleum.

Attempts by Dawn to reach the Sindh IGP's office for comment were unsuccessful.

"Police broke my room door at the hotel I was staying at in Karachi and arrested Capt Safdar," Maryam had said via a tweet early morning. According to her, she was sleeping when the police allegedly "barged in".

At the press conference, she narrated the order in which the arrest took place.

"We reached home late after the jalsa. We were sleeping when early in the morning I thought I heard someone's door being knocked on loudly. I woke up my husband and said the loud knocks were on our door.

"Safdar opened the door and police were standing outside who said we are here to arrest you. Safdar told them he'll change and take his medicine, since he is diabetic, but they broke down the door and came inside.

"Safdar asked them to not enter since I [his wife] was inside but they did and arrested him," she said.

The government is trying to give the impression that the Sindh government is behind this, said Maryam, "but Bilawal had called me and he was very angry".

"Sindh chief minister also called me and said that he never expected that something like this would happen with me," said Maryam. "I never thought even for a moment that PPP was behind this; they [PTI] thought they can drive a wedge between PDM — we know things like this would happen, we are ready as well."

She defended the slogans raised during her visit to Jinnah's mausoleum on Sunday, saying: "What is wrong with repeating Quaid-i-Azam's stance at his mausoleum? What is wrong with Madar-i-Millat (mother of the nation) slogans? No one chanted slogans for Nawaz Sharif or me."

Citing a video clip, she said PTI workers had also resorted to "rowdiness" during a visit of Prime Minister Imran Khan to the Quaid's mausoleum but they were never held accountable.

"We all know who hates the vote ko izzat do (honour the vote) slogan [...] We all know who these namaloom afraad (unidentified persons) are."

Without naming anyone, she added: "Now that you have become zameeni makhlooq from khalayi makhlooq, you will do this?"

She denied that murder threats were issued while the slogans were being raised. "There were so many people, who would have heard this threat and why would anyone threaten to kill you?" she asked.

Maryam said the complainant in the case, Waqas Ahmed Khan, "is an absconder from an anti-terrorism court".

She said Safdar had been receiving threats "from the highest levels" for a long time.

"If someone thinks they can scare Nawaz Sharif with such tactics, they are wrong. Instead of blackmailing me through my relatives, if you have the courage, come and arrest me."

She said former military ruler retired Gen Pervez Musharraf made "blunder upon blunder" towards the end of his rule and added that the PTI government's "situation will soon be the same".

"I am not angry; whatever we do, we will do after giving it proper thought. We are not in a hurry," Maryam said about her party's future course of action.

At the end of her press conference, Maryam said she and her husband would depart from Karachi together because Safdar had been granted bail.

'Shameful act'
Rehman said the manner in which the arrest was carried out was shameful. "Is this the respect for a woman in our society?"

"This is a government of force, of oppression which does not consider itself bound to the law and the Constitution," said Rehman alongside Maryam.

He said after only two public meetings by the opposition, the PTI-led government appears unnerved. "Their [PTI] days are numbered."

Rehman, who is heading PDM, said that this arrest was "done through a conspiracy to create differences between PML-N and PPP" but the government failed to create a rift between the opposition parties.

"This attack is not on Maryam but on entire PDM. Maryam is a guest of the Sindh government [...] PPP chairperson Bilawal Bhutto Zardari has regretted this act."

Rehman claimed that the Sindh police chief, after he refused to take any action against Safdar, was "kidnapped" and "kept hostage for four hours" and made to register the first information report (FIR) against the PML-N leader.

He demanded that Safdar should be released forthwith and those who took the law in their hands should apologise.

Addressing the press conference alongside Rehman, PPP leader Raja Pervaiz Ashraf said no society could allow such a "shameful" act.

He said the act of "barging into the room of members of a respectable family" while they were sleeping could not be condemned enough.

He said Sindh Chief Minister Murad Ali Shah was "kept uninformed" of this act, which showed the PTI government was "panicking".

According to Ashraf, Bilawal and PPP co-chairperson Asif Ali Zardari had expressed sadness over the incident. He said Maryam was a guest of Sindh.

He said Bilawal had asked Shah to hold a "complete investigation" into the incident, adding that the details of the inquiry will be presented before the nation.

While speaking in the Senate on Monday, former Senate chairman and PPP leader Raza Rabbani too condemned Safdar's arrest. He said it was said that the arrest was made "according to the law" but noted that the FIR against Safdar was the first case registered under the relevant law.

He said if the Sindh government and chief minister were not taken into confidence before arresting the PML-N leader, "then it is another attack on provincial autonomy".

"This is another practical step towards imposing One Unit system," Rabbani added.

Arrest after PDM rally
Early Monday morning, Captain Safdar was taken into custody by the police. According to Maryam, she was sleeping when the police allegedly "barged" into her and Safdar's hotel room.

Workers and supporters of PML-N accorded a historic welcome to Maryam when she arrived in the metropolis on Sunday afternoon to attend PDM's second power show.

At the public meeting, she called Prime Minister Imran a “coward” and accused him of using the armed forces for his face-saving and declaring opponents as traitors only to save his skin and hide incompetence.

PTI leader and Maritime Affairs Minister Ali Zaidi on Monday denied reports that Sindh inspector general of police (IGP) was "kidnapped and forced to register" a first information report (FIR) against PML-N's retired Captain Mohammad Safdar.

Taking to Twitter, Zaidi said: “M. Zubair selling nonsense narrative that CM Sindh told him IG was kidnapped & forced to register FIR. If this is true then CM Sindh must fire IG Sindh or resign himself as his orders were followed.”

Zaidi was referring to an audio message shared by a journalist on Twitter in which Zubair purportedly can be heard saying that Chief Minister Murad Ali Shah told him the IGP was kidnapped and forced to register the FIR against Maryam Nawaz, her husband retired Captain Mohammad Safdar and 200 others for violating the sanctity of the Quaid's mausoleum.

Terming the alleged claim as "nonsense narrative", Zaidi said the Sindh government was trying to distance itself from the arrest and the FIR.

In the audio clip circulating on Twitter, Zubair, who was recently appointed as spokesman for PML-N supremo Nawaz Sharif and his daughter Maryam, purportedly said that CM Shah confirmed to him "they tried to put pressure on the Sindh Police first to arrest. When they refused to do that, Rangers kidnapped [the IG].

"This is what the chief minister told me [...] he [IGP] was picked up and taken to the sector commander's office where the additional IG was brought in and they were forced to issue orders," Zubair says in the clip being attributed to him.

Safdar was arrested early on Monday morning from a Karachi hotel where he and Maryam Nawaz were staying, she said in a message on Twitter.

"Police broke my room door at the hotel I was staying at in Karachi and arrested Capt Safdar," Maryam wrote.

While talking to reporters after the arrest, Zubair said he had talked to CM Shah and provincial minister Saeed Ghani and would reveal the facts before the public soon.

"The easiest way for Imran Khan is to arrest [Safdar] so the entire blame will fall on Sindh government and police," Zubair said.

Responding to allegations of state terrorism by the PML-N and Zubair, Zaidi questioned "if arresting a criminal is state terrorism, then what was Model Town massacre by police under Shehbaz when direct firing was done on pregnant women, children and elderly? Was that a training exercise?"

The minister also alleged that "certain elements" in the media and opposition were trying to confuse the issue.

"Instead of focusing on the crime that was committed, they are asking how Capt. Safdar was charged and arrested. Your nonsense won’t sell any more," he said.

The minister also lashed out at the provincial government after Sindh Police first shared on Twitter but later deleted a message which said that Safdar's arrest was done in accordance with the law and that the investigation will be impartial.

However, a couple of hours later, a similar tweet was shared again by Sindh Police on the social media website, which said that Safdar's arrest was made "according to law" and an "impartial" investigation will be carried out in the case.

Bilawal condemns arrest, says Sindh govt was not informed
For their part, PPP Chairman Bilawal Bhutto-Zardari, whose party is in government in Sindh, and provincial minister Saeed Ghani have both distanced their government from the arrest.

In a statement, Bilawal condemned Safdar's arrest and said he was "shocked to hear about the incident".

"Talking to Maryam Nawaz Sharif over telephone, the PPP Chairman expressed complete solidarity with her, adding the manner in which the arrest was made is against the traditions of Sindh," the statement read.

It said the Sindh government "was not informed about the arrest" and that the PPP chief had asked the chief minister to investigate the incident fully and to take all measures to secure Captain Safdar’s release.

Islamabad, Pakistan – Pakistani opposition political leader Muhammad Safdar has been released on bail, hours after being arrested by authorities on charges related to a speech at a mausoleum ahead of a major anti-government rally on Sunday.

Safdar was arrested at his hotel room in the southern Pakistani city of Karachi early on Monday, his wife Maryam Nawaz, the daughter and political heir to former three-time Pakistani Prime Minister Nawaz Sharif, said.

Later on Monday, Nawaz confirmed at a news conference that Safdar had been released on bail.

“We will both be leaving Karachi together because I have just received a message … that he has been granted bail,” Nawaz said.

Safdar was taken into custody in connection with charges against him for raising political slogans at the mausoleum of Muhammad Ali Jinnah, Pakistan’s founder, on Sunday.

That incident came hours ahead of a political rally of tens of thousands in Karachi that is part of the Pakistan Democratic Movement’s (PDM) countrywide drive to attempt to overthrow Prime Minister Imran Khan’s government.

Formed last month, the PDM is an alliance of 11 opposition political parties, including the Pakistan Muslim League’s Nawaz faction (PML-N), the Pakistan People’s Party, the Jamiat Ulema Islam’s Fazl faction (JUI-F) and others.

The PDM alleges Khan’s victory in the 2018 general election was rigged by the country’s military, which has directly ruled the country for roughly half of its 73-year history.

Khan and the military have routinely denied the accusation, with the prime minister accusing the opposition of attempting to deflect or discredit his government’s anti-corruption campaign, which has seen several top political opponents jailed or investigated for alleged corruption.

The military has taken an increasingly overt role in governance under Khan, with serving and retired military officials taking key positions in his administration, including in the areas of health, telecommunications, economic affairs and the $60bn China Pakistan Economic Corridor (CPEC) project.

Dwindling economy
At the rally in Karachi on Sunday, PDM leaders repeated their accusations against Khan and criticised him for his handling of the country’s economy.

It was the second major protest by the group, which launched its anti-government campaign with a protest by thousands in the central city of Gujranwala on Friday.

At that demonstration, PML-N chief Nawaz Sharif, addressing the gathering by video link from London, took blunt aim at the military, accusing army chief General Qamar Javed Bajwa of rigging the 2018 elections and engineering his removal as prime minister in 2017.

Sharif left for London on medical bail last year, as appeals against his conviction and sentencing to 10 years in prison on corruption charges continue.

Last month, an Islamabad court issued arrest warrants for him, demanding he returns to the country and appears in person for hearings.

Sharif is also facing sedition charges for criticising the military’s alleged role in politics.

The opposition’s movement to overthrow Khan comes as Pakistan’s economy – already struggling before the pandemic – is grappling with double-digit food inflation and negative economic growth.

Khan’s government says it will be taking on the issue of food inflation in the coming weeks, and blames the economic slowdown on the coronavirus pandemic and the state of the economy it inherited from Sharif’s PML-N in 2018.

The PDM will continue its countrywide protest movement with further anti-government demonstrations in the coming days, PDM leaders said on Monday.

Striking an unapologetic tone, PML-N leader Mohammad Safdar on Tuesday said that he will visit Quaid-i-Azam Mohammad Ali Jinnah’s mausoleum on October 18 every year and raise the slogan "long live the mother of the nation".

Speaking to the media in Lahore, he said that he wanted to send a message to those that had called Fatima Jinnah a traitor by raising Madar-i-Millat (mother of the nation) slogans during his visit to the mausoleum. "What was wrong with that?"

Safdar's comments come a day after he was arrested in Karachi on charges of violating the sanctity of Jinnah’s mausoleum and hurling murder threats at some individuals.

According to the FIR registered on the complaint of Waqas Ahmed Khan, Safdar was arrested on charges of violating the sanctity of the mausoleum of the founder of Pakistan, damaging official property and allegedly threatening the complainant with dire consequences. Around 200 other people were also booked in the case lodged at the Brigade police station.

The day-long episode, with several turns and twists, came to a close with a court granting the PML-N leader bail and the disclosure at a press conference in the evening that the complainant in the case was wanted in a terrorism case.

PDM leaders alleged that the move was an attempt by the federal government and its agencies, which “kidnapped the provincial police chief and forced him into signing the arrest order”.

The government, however, denied the claim with Maritime Affairs Minister Ali Zaidi calling it a "nonsense narrative".
 
Lahore's Shahdara police on Tuesday registered a case against PML-N Vice President Maryam Nawaz, her husband retired Captain Mohammad Safdar and other party leaders and workers for damaging public order by “causing trouble for citizens, blocking roads, unnecessarily using loudspeakers and microphones and violating coronavirus standard operating procedures (SOPs)” in the run up to the October 16 rally of the Pakistan Democratic Movement in Gujranwala.

The first-information report (FIR), a copy of which is available with Dawn.com, was registered under sections 269, 270, 290 and 291 of the Punjab Maintenance of Public Order Ordinance, 1960, and sections 6 and 16 of the Punjab Sound Systems (Regulation) Act, 2015.

It said that three policemen of the Shahdara police station — Mohammad Imran, Amir Ali and Sajjad Ahmed — were present at the Begum Kot Chowk when they were informed that PML-N leaders had set up a stage on a trawler to welcome participants of the Pakistan Democratic Movement's first rally in Gujranwala.

Malik Riaz, Samiullah Khan and Capt Safdar were present on that stage and they, along with 800 to 900 workers, were chanting slogans against the government and its institutions, the report added.

The policemen said when they reached the site, a caravan of 80 to 90 cars, led by Saleem Butt and Ali Pervez Malik had also arrived. Meanwhile, the main PML-N caravan also reached Shahdara Chowk via the Niazi Shaheed Chowk.

"There were two big cranes and a truck in front of the caravan, because of which, the traffic on Shahdara Chowk, coming from all directions, was disrupted and a painful situation was created for the public.

"The organisers of the caravan were asked to remove the cranes and truck but they refused to do so. Meanwhile, Capt Safdar, Riaz and other party leaders were illegally using loudspeakers and microphones to rouse party workers by raising incendiary slogans against the government and law enforcement agencies," the FIR reads.

It added that despite multiple threat advisories issued by security agencies to the PML-N leadership, party vice-president Maryam Nawaz came out of her car and addressed workers.

"Maryam then ignored security SOPs and addressed the workers, exposing herself and putting her life in danger.

"In this way, Maryam, Safdar and other leaders and workers collectively violated the law by sloganeering against the government, causing trouble for citizens, violated SOPs by not maintaining social distancing, blocking roads and [through] unnecessary use of loudspeakers and microphones."

The FIR further added that Maryam, in her address, asked party workers and leaders to "be ready to send Imran Khan's government home", adding that it incited them and they started "extreme sloganeering against the government".

"Malik Riaz, Samiullah Khan, Pervaiz Rashid, Rana Mohammad Iqbal, Rana Mohammad Hayat, Rana Sikandar Hayat, Rana Mubashir Iqbal, Mohammad Zubair, Mirza Javed, Bilal Yasin, Saiful Malook Khokhar, retired Colonel Mubasir and Capt Safdar along with 2,000 to 2,200 party workers were present in Shahdara Chowk in blatant violation of the government's coronavirus SOPs."

According to the FIR, none of the leaders or workers were wearing a mask or maintaining social distancing. Traffic was also badly blocked from New Ravi Bridge to the matchsticks factory on GT Road and from Shahdara Chowk to Begum Kot Chowk [because of the rally], it said.

The registration of the case comes a day after Safdar was arrested and then granted bail for "violating the sanctity of the Quaid's mausoleum" in Karachi.

Both Maryam and Safdar were in Karachi to attend the second major rally organised under the banner of PDM on Sunday.

Maryam had tweeted early Monday morning that her husband retired Captain Mohammad Safdar had been arrested by the police from their hotel in Karachi.

"Police broke my room door at the hotel I was staying at in Karachi and arrested Capt Safdar," Maryam said via tweet.

He was later granted bail by a judicial magistrate against surety bonds of Rs100,000 in Karachi.

An FIR was also registered against Maryam, Safdar and 200 others for violating the sanctity of the Quaid's mausoleum. The complainant, Waqas Ahmed, alleged that the PML-N leaders, along with 200 of their followers, reached the Quaid's grave where Safdar jumped over the grill surrounding it.

The complainant said that he tried to stop him from doing so but Safdar "got out of control" and started threatening him and his fellows that he would kill them. He added that Safdar later damaged government property before leaving the site with his followers.

"My complaint is that Safdar and his cohort violated the sanctity of the Quaid's mausoleum and his grave. A case [should be] registered against him for raising political slogans inside the mausoleum complex, death threats against me and for damaging government property."

According to the FIR, a case has been registered under section 6, 8 and 10 of The Quaid-i-Azam’s Mazar (Protection and Maintenance) Ordinance, 1971.
 
Sindh chief minister announces ministerial probe into Safdar's arrest from Karachi hotel, 'false' FIR

KARACHI: After a turn of events that put the provincial government under much public scrutiny, Chief Minister Sindh Murad Ali Shah on Tuesday announced that a ministerial committee will be formed to probe the circumstances surrounding the arrest of retired Capt Safdar from a hotel in Karachi a day earlier.

"We are forming a ministerial committee to probe the incident. The names have not been finalised but there will be three to five ministers [in the committee]," said Shah, while addressing a media conference at the Chief Minister House.

CM Shah, while speaking of the events in the lead up to the arrest, said there was "a minister" who was giving the police "ultimatums". "I will see how a case is not registered," said the chief minister quoting the minister, but declining to name him.

He said while it is not a crime to be present within a police station, "it is a crime to register a false case".

He accused this "minister" of being part of the "lies" that surround the "false case" against Capt Safdar. He said that the inclusion of 506 (b) (punishment for criminal intimidation if threat be to cause death or grievous hurt) was done purposely because when such a case is brought to the police, it is duty bound to register such a case.

CM Shah said that on two occasions prior to that, PTI ministers went to the police attempting to register a case after which even the Mazar's board approached police with the PTI ministers accompanying them in a third instance. They were told by police a summary trial like the one sought falls under the jurisdiction of the magistrate and it is not up to the police to register a case.

The chief minister said that the man named Waqas — who is the complainant in the case — told police that he was threatened. CM Shah said that to the contrary, it is "clear" that this was planned.

"If he was a private person, we would stop to think. But they were standing right next to him [at the police station]," said CM Shah, adding that they were happily posing for photographs while they were at it.

"They attempted to pressurise the police. The police did not fall under pressure [...] from about six in the evening, they kept at this till one in the night."

"The jalsa venue continued to swell with people and all the while they were attempting to do this," he said, criticising that elected representatives were "resorting to such moves".

They pushed to do something illegal, said CM Sindh. "Their state of panic [over the jalsa's success] was evident."

The chief minister stressed that the police will never do anything wrong and the PPP will never ask it to.

CM Shah said that Waqas, in a statement to police, said that he was present at the Mazar-e-Quaid when the PML-N raised slogans there, but when his phone was tracked between 4:30pm and 4:52pm, he was in the vicinity of Baqai Medical University on the Super Highway.

CM Shah went on to say Waqas is an "absconding criminal".

The chief minister said that while the act of raising slogans at Mazar-e-Quaid was inappropriate, the PTI has done the same in the past.

He said that the manner in which a case was registered against Capt Safdar, raises a lot of questions and the court will now determine the true facts behind the case.

CM Shah said a meeting between cabinet members had taken place and it was decided that the truth must be brought to light. "Certain facts have emerged and those will be probed, he said, adding: "What transpired between 4:30pm on October 18 to the morning of October 19 will be investigated."

"If they summon me during the inquiry, I will gladly go," he added.

It is an open and shut case, he was caught blatantly on camera doing the offence, not just him but also Maryam Nawaz. There is a specific law against this with the penalty being a 3 year prison sentence. If this was an ordinary individual, the person would have been behind bars without any questions or halla. The media and the opposition is trying to create chaos out of nothing.

The PML-N leader had been taken into custody by police in the early hours of Monday after a case was registered against him for allegedly violating the sanctity of the Quaid-e-Azam’s mausoleum by raising political slogans.

Following the arrest, PML-N representatives had claimed that the police had been put under pressure to pick Capt Safdar up, with Bilawal in a press conference alleging that Sindh Inspector General of Police Mushtaq Mahar’s office had been surrounded at 2am the night of the arrest and that he was taken away at 4 in the morning.

Addressing a press conference in Islamabad today alongside Ashraf and Durrani, Abbasi said that he expresses solidarity with the Sindh government and also extended his support to Sindh Police for taking a “principled stance” on the matter.

Several senior Sindh Police officers, including IG Sindh Mushtaq Mahar, had a day earlier decided to go on leave citing demoralisation of the police force. He later announced he is deferring his leave and asked fellow police officers to set aside their applications for 10 days.

“Every citizen in Sindh is feeling insecure,” said Abbasi.

He said that had the Constitution reigned supreme, the prime minister would have made a phone call to Chief Minister Sindh Murad Ali Shah after such events transpired.

“But did the prime minister deliver a speech? Did he issue a statement?” asked the PML-N stalwart.

Addressing PM Imran Khan directly, he continued to ask: “Do you not care about the federation? Are you worried at all about the provinces?”

Abbasi then went on to say that the prime minister instead is concerned about “what food should be given to Shahbaz Sharif in jail”.

“He is completely unaware of the pain and misery of the common man,” Abbasi said of the prime minister.

The PML-N leader accused the prime minister of “resorting to any means possible to torture his political opponents”.

“We condemn all of this,” he declared.

'Govt seeks to spread chaos'
Ashraf, addressing the media, seconded Abbasi in questioning why there had been no statement from any government representative — ministers or the prime minister himself.

“The federal government, under a planned conspiracy, seeks to spread chaos in the country,” he alleged, adding that through “systematic planning” it wants to “destabilise the country”.

Ashraf praised the manner in which PPP chairman Bilawal Bhutto Zardari and the Sindh government had handled matters a day prior.

He said that the prime minister had become irked after witnessing the scale of the gathering at the Pakistan Democratic Movement rally held in Karachi on Sunday.

Referring to the protest in front of Parliament House by various sections of society, foremost Lady Health Workers, protesting rising inflation and low salaries, he asked: “Why are our mothers and sisters sitting in front of the parliament?”

“The people of Pakistan are fed up and have come out,” he said, answering his own question, adding: “And you are not perturbed in the least.”

Referring to what the Opposition has termed as the government’s tactics to prevent it from holding mass contact campaigns, and with the arrest of Capt Safdar as the latest example, he said that cases are registered simply for holding rallies.

“The writing’s on the wall. The people have rejected your government.”

'Grave crisis'
Meanwhile, Durrani said that the country is going through a “grave crisis”. “Such incidents have never before occurred in the country’s history.”

“The opposition had said on the first day that this is a fake government, they do not accept it,” he said.

The Jamiat Ulema-e-Islam-Fazl (JUI-F) leader said that there was an opinion that the oath should not be taken but then the oath was taken anyway. He said “we also gave time to the government [to reconsider]”.

“Name one mega project that has been started [by the PTI government] in the entire country,” Durrani said.

Police have declared the first information report (FIR) registered against PML-N leader retired Capt Mohammad Safdar for 'violating the sanctity' of Quaid-i-Azam Mohammad Ali Jinnah's mausoleum in Karachi as fake in the charge sheet submitted to a local court on Monday.

The investigation report concluded that neither the complainant, Waqas Khan, nephew of Pakistan Tehreek-i-Insaf (PTI) leader Haleem Adil Sheikh, joined the investigation nor was the veracity of his claims established during the probe, which showed that he was not present at the mausoleum when the alleged offence took place.

Safdar, who is the husband of PML-N Vice President Maryam Nawaz, was taken into custody by police on the morning of October 19 from a hotel where the couple was staying during their visit to Karachi for the opposition Pakistan Democratic Movement’s public gathering held in the city a day earlier.

Hours later, he was granted bail by a magistrate's court against a surety of Rs100,000, with the Sindh government alleging that the federal government had forced the provincial police to carry out the arrest in a bid to create a rift in the PDM, the 11-party anti-government alliance which has the PPP and PML-N on its forefront.

According to the FIR, Safdar, Maryam and a cohort of their supporters violated the sanctity of the Quaid's mausoleum by creating a ruckus and chanting fiery political slogans inside. They were also accused of intimidating people.

Earlier, the prosecution had pointed out discrepancies in the previous charge sheet, noting that the investigation officer neglected to record statements of the independent witnesses available on the spot where the alleged offence took place.

It said that the IO failed to get required approval from his senior officers before submitting the charge sheet and he neither attached the complaint moved by the administration officer of the mausoleum board nor recorded his statement.

However, the prosecution later approved a new, amended charge sheet. It wrote that the offences would be tried under the Quaid-i-Azam's Mazar (Protection and Maintenance) Ordinance, 1971, if the same complaint is routed through the concerned SHO on the application of the mausoleum’s administrator.

On the applicability of the Pakistan Penal Code, it said: “We are of [the] firm opinion that despite efforts of IO, [the] complainant failed to join the investigation and preparation of memo of site inspection. Also absence of the complainant on the date and time is established with the CCTV footages and CDR collected by the IO.”

District public prosecutor Zainab Hamirani and deputy public prosecutor Arif Sitai wrote in the scrutiny note that they agreed with the IO that there was no evidence available to establish the offences and he had rightly presented the report under B (false) class.

PML-N supremo and former prime minister Nawaz Sharif on Tuesday termed the report of the inquiry carried out by the army into the events leading up to and following the arrest of his son-in-law retired Capt Mohammad Safdar in Karachi as a "cover-up", saying the report was "rejected".

"Inquiry report on Karachi incident is a cover-up scapegoating juniors and shielding the real culprits. Report “Rejected”," the ousted premier tweeted.

No other leader from the PML-N has commented on the party's official stance on the report. However Mian Iftikhar Hussain, the spokesperson of the opposition's Pakistan Democratic Movement (PDM) alliance, termed the development in the inquiry "a victory of the democratic forces".

In a statement, he said the PDM had demanded that the inquiry be made conclusive. "Now those responsible should be brought to justice. PDM will hold further consultations in this regard," he added.

Nawaz's comment comes hours after the military's media wing announced that officials of the Inter Services Intelligence (ISI) and Pakistan Rangers, Sindh, involved in the "Karachi incident" had been removed pending further departmental proceedings for acting "overzealously".

"The court of inquiry has established that on the night of Oct 18/Oct 19, officers from Pakistan Rangers (Sindh) and ISI sector Headquarters Karachi were considerably seized with the fall out of the desecration of Mazar-e-Quaid.

"They were under increasing public pressure to ensure prompt action as per the law. Assessing the response of police authorities against this developing yet volatile situation to be slow and wanting, in a charged environment, the concerned officers decided to act, rather overzealously," an Inter-Services Public Relations (ISPR) statement said.

The concerned officers "were indeed experienced enough to have acted more prudently and could have avoided creating an unwarranted situation that led to the misunderstanding between the two state institutions", it added.

The announcement was made after the court of inquiry constituted to redress the grievances of the Sindh inspector general on the orders of Chief of Army Staff Gen Qamar Javed Bajwa was completed, according to the ISPR.

Nawaz's use of the term "rejected" in his tweet is an apparent reference to the April 29, 2017, tweet sent out by former ISPR Director General Maj Gen Asif Ghafoor which had "rejected" the directives issued by the Prime Minister's Office when Nawaz was the premier regarding an inquiry report concerning a story published in daily Dawn. The story reported the details of a high-level civil-military meeting.

The following month, the Pakistan Army had "withdrawn" the tweet, saying it had become infructuous.

Fall out of Safdar arrest
Last month, the ISPR said the army chief had taken notice of and ordered an immediate inquiry into the "Karachi incident".

At the time, the ISPR did not specify which incident it was referring to. However, the statement came minutes after PPP Chairperson Bilawal Bhutto-Zardari called on Gen Bajwa and ISI Director General Faiz Hameed to investigate the circumstances of Safdar's arrest in Karachi last month.

On October 19, PML-N leader Safdar, who was staying at a Karachi hotel with his wife, PML-N Vice President Maryam Nawaz, was arrested for "violating the sanctity of Quaid-i-Azam Mohammad Ali Jinnah's mausoleum" a day after the Pakistan Democratic Movement (PDM) had staged a rally in the city.

Following Safdar's arrest, a purported voice message by PML-N leader and former Sindh governor Muhammad Zubair was shared by a journalist in which Zubair alleged that the Sindh inspector general of police was kidnapped and forced to register the first information report against Maryam, her husband Safdar and 200 others for violating the sanctity of the Quaid's mausoleum.

In the audio clip circulating on Twitter, Zubair purportedly said that Chief Minister Murad Ali Shah confirmed to him that police was pressured into making the arrest. "When they (police) refused to do that, Rangers kidnapped [the IGP]," Zubair had said.

Maryam had also alleged that the Sindh police chief was forcibly "taken to the sector commander's office and asked to sign on the arrest orders".

The Sindh chief minister had addressed a press conference later and said that a ministerial committee would investigate the mysterious "circumstances" that led to the early morning raid on Maryam's hotel room and arrest of her husband, but defended the police action against Safdar once an FIR had been lodged against him.

However, the presser failed to convince the police hierarchy that was in low morale following the episode and which applied for leaves en masse. Later, Sindh IGP Mushtaq Mahar decided to defer his own leave for 10 days and ordered his officers to do the same after Gen Bajwa took notice of the incident, spoke to Bilawal over the phone and promised an immediate inquiry.

'It was never a comedy'
The announcement by the military's media affairs wing of the removal of officers over the Safdar arrest saga elicited a variety of responses from journalist and analysts.

Senior journalist Mazhar Abbas, apparently referring to the PTI leadership terming the alleged abduction of the Sindh IG as a "comedy", tweeted: "It was never a comedy what happened on Oct 19th with IGP, Sindh. Army inquiry just confirmed that some officers did [cross] their red line. PTI government put itself in an embarrassing position."

Journalist and former Dawn editor Abbas Nasir said Bilawal had asked the army and ISI chiefs to hold an inquiry, adding that "he has had his wish granted."

Activist and lawyer Jibran Nasir in a tweet said the alleged desecration of the Quaid's mausoleum "is no excuse to act where one has no jurisdiction otherwise all citizens will take [the] law in their hands, stating that police response was 'slow & wanting'".

Federal Minister for Maritime Affairs Syed Ali Haider Zaidi asked in a tweet whether after the military's action, the Government of Sindh will "take any action against police officers involved in the 'mutiny' of submitting [en masse] resignations or will [it] sleep as usual?"

Journalist and TV host Zarrar Khuhro said he was wondering "where all the many tweeps who were so sure this was a 'drama' done by Sindh police are".

Journalist Talat Hussain commented that the ISPR statement had "informed the nation that the incident involving the Sindh IG and his senior associate had, in fact, taken place".

"But the prime minister was saying this matter was a 'drama'. Sir, what is this confusion?" he wrote.

The federal government on Friday approached a court in Karachi against the Sindh Police’s recommendation to declare as ‘B-class’ a case against PML-N leader retired Capt Safdar Awan pertaining to the alleged violation of the sanctity of Quaid-i-Azam Muhammad Ali Jinnah's mausoleum.

The move by the Pakistan Tehreek-i-Insaf government comes in the backdrop of a report submitted by the case's investigation officer to the court earlier this week, wherein he declared the case against the PML-N leader ‘fake’ and recommended its disposal in ‘B’ class.

Federal govt jumps in
Earlier this week, the investigating officer (IO) of the case had filed an amended charge-sheet with the judicial magistrate (South) Wazir Ali Memon, concluding that neither the complainant of the FIR, Waqas Khan, who is a nephew of PTI leader Haleem Adil Sheikh, had joined the investigation nor was the veracity of his claims established during the probe, which showed that he was not present at the mausoleum when the alleged offence took place.

The IO and the special public prosecutors after scrutinising the amended charge-sheet had recommended the court to accept the same in ‘B’ (false) class. However, the court has yet to reach its decision.

On Friday, the federal government jumped into the matter, with an assistant attorney general filing an application with the court on behalf of Ghulam Akbar Memon, an officer of the Mazar-e-Quaid Management Board.

He sought the court’s direction for the IO to collect evidence from the media and social media against the suspects, as “this is a matter of grave violation of sanctity of the tomb/shrine/Mazar-e-Quaid of the national Muslim leader of Pakistan and this is a matter of Shariah.”

The federal law officer Muhammad Ahmed argued that the violation of the sanctity of founder of the nation's grave was a sin/transgression in the Shariah, and “is not political issue”.

He argued that the (incumbent) magistrate is competent to take cognisance of an offence, if upon considering not only the investigation report filed under Section 173 of the Criminal Procedure Code (CrPC), but also material collected during investigation they come to the conclusion that a cognisable offence has been made out.

The federal attorney argued that the film or video footage of the offence had gone viral on local and international media, which was objectionable and answerable by the state. He added that the negative CDR report of the mobile phone of the complainant (Waqas Khan) did not make a valid ground, as he was not present at the place of occurrence of the alleged offence, but under the law any person could lodge a complaint and could inform the local police about an offence.

The federal law officer argued that under Article 164 of the Qanoon-e-Shahadat Ordinance, 1984, the production of evidence had become available because of modern devices and in such cases, the court may allow production of such evidence that may be possible because of the availability of modern devices or technology.

Moreover, the counsel contended that Article 227 of the [above-mentioned] Ordinance's provisions relating to the Holy Quran and Sunnah was very clear about the sanctity of a grave, in accordance with with the Shariah and Holy Quran/Hadith.

He appealed that an investigation under the Criminal Procedure Code must be completed without unnecessary delay, praying the court to direct the IO of the case to submit a charge-sheet against the nominated suspects. He also pleaded the court to decide the matter on merit.

KARACHI: The administration of Mazar-e-Quaid on Saturday approached the court to file a case against the PML-N leaders including Captain Safdar, Maryam Nawaz and Marriyum Aurangzeb for violating the sanctity of the mausoleum last month.

The mausoleum’s administrator, Syed Ghulam Akbar, filed a complaint seeking action against PML-N leadership and recorded the statement.

The development came after a court quashed the FIR filed by a PTI member on October 18 against Captain Safdar for violating the sanctity of the mazar and threatening him. The judge had concluded that there was insufficient evidence to take action against the PML-N leader.

In his statement to the court, Akbar said the PML-N leaders and workers violated the sanctity of the mausoleum by chanting political slogans, breaking down the grill and damaging the premises.

He said the suspects should be tried under the Criminal Procedure Code (CrPC).

On October 19, Sindh Police arrested Awan from his hotel room early morning causing a political uproar. He was granted post-arrest bail the same day.

Awan's arrest sparked outrage from opposition parties and the Sindh government claiming Sindh IGP Mushtaq Mahar was 'abducted' and forced to act against the PML-N leader.

This ensued a court of inquiry, ordered by Chief of Army Staff General Qamar Javed Bajwa. On November 10, the Inter-Services Public Relations (ISPR) said some officials of the Inter-Services Intelligence and Pakistan Rangers (Sindh) were removed from their posts pending further departmental proceedings for acting 'overzealously'.

ISLAMABAD:The National Accountability Bureau (NAB) on Wednesday closed its inquiry against Pakistan Muslim League-Nawaz (PML-N) leader and former National Assembly member Captain Safdar Awan, because of absence of proof, the graft-buster said in a press release.

It said that the Executive Board Meeting (EBM) of NAB, chaired by its Chairman Justice (retd) Javed Iqbal, authorised filing of three references and approved nine inquiries and three investigations against various suspects on allegation of inflicting billion of rupees losses to the national exchequer.

“The EBM authorised closing inquiries against officers and officials of NHA (National Highway Authority), Captain (Retd) Safdar Awan, former MNA, officers, officials of Pak P.W.D and others, Muhammad Arsila Khan and others, Dr Mujeebur Rehman, former DIG and others, Amanullah Khan Jadoon, former Petroleum Minister and others, [and] closing investigations against officers and officials of Gilyat Development Authority due to absence of proof as per law,” the press release said.

The forum authorised filing of three references, including a reference against Ehsanullah Mehsood, former senior member of the Board of Revenue, Khyber Pakhtunkhwa, on the accusations of allegedly allotting 1,976 Kanal state land in Dera Ismael Khan by abuse of power which caused heavy losses to the national exchequer.

The EBM okayed filing another reference against Maqbool Ahmed Lehri, former district Nazim, Dr Kalimullah, former Mayor, Metropolitan Corporation Quetta and others. The suspects have allegedly been involved in doling out 5,292 square feet state land on lease at much cheaper rates illegally to favourites thus inflicting Rs529 million losses to the national exchequer.

The EBM authorised filing another corruption reference against Mir Muhammad Amin Umrani, former provincial Excise and Taxation minister, Balochistan, and others on the accusations of amassing assets totally unmatched to their known sources of income – obviously by abusing authority.

'SHARIFS FAILED TO DISCLOSE SOURCES OF INCOME TO NAB'

The EBM approved nine inquiries against various personalities, including Amir Muqam, a PML-N leader and former adviser to the prime minister. The others, against whom the inquiries were approved were Dr Naveed, Director General Agriculture Research, Tariq Mehmood, administrative officer and others, officers and officials of ministry of housing and works, Pakistan Works Department and others, Mumtaz Khan and others, Nasir Khan, former MNA, Shahab Khattak, Secretary C&DW Department, Khyber Pakhtunkhwa and others, Muhammad Naseem, Managing Director, Nasir, Ghafoor, General Manager, Aliur Rehman, Zonal Manager, WSSP and others, officers, officials of the Revenue Department, Gwadar, Ghulam Hussain Jaffar and others, and chairman of the Township Housing Scheme, district Khuzdar

The forum okayed three investigations which includes the management of Health Department, Quetta and others, Abdur Razzaq Durrani, former director general of the Gwadar Port Authority and officers and others, and officials of the Revenue Department, Gwadar, and others.

The EBM also transferred the inquiry against officers and officials and others of the Civil Aviation Authority to Director General Civil Aviation Authority for further proceedings.

The forum authorised sending three inquiries against the officers and officials of the NTDC to National Electric Power Regulatory Authority (Nepra) for further action.
 
KARACHI: A judicial magistrate in Karachi rejected on Tuesday a plea filed by the Quaid-e-Azam Mazar Management Board to register a case against PML-N leader Maryam Nawaz, her husband Capt Safdar Awan, and party workers over the alleged violation of the sanctity of Quaid-e-Azam's mausoleum.

The decision was announced by judicial magistrate South in a hearing held in Karachi today.

Court asks police to submit report
Back in March, a judicial magistrate in Karachi directed the Senior Superintendent of Police (Investigations) to investigate Maryam and her husband Safdar over the alleged violation of the sanctity of Quaid-e-Azam's mausoleum last year.

The case, filed by the Quaid-e-Azam Mazar Management Board, states that Capt Safdar and his accomplices physically harmed the mausoleum.

Karachi court quashes FIR against PML-N's Captain Safdar
In November last year, a judicial magistrate had quashed a different FIR filed against Safdar Awan after categorising the case as "C class".

The police complaint had accused Awan, husband of PML-N vice-president Maryam Nawaz and son-in-law of former premier Nawaz Sharif, and a cohort of PML-N supporters to have violated the sanctity of Quaid-e-Azam's mausoleum by chanting political slogans and intimidating people.

On October 19, a day after his visit to the mazar, Sindh Police arrested Safdar from his hotel room in the early morning, causing a political uproar.

He was granted post-arrest bail the same day.

On November 9, the investigating officer (IO) submitted an amended charge sheet before the judicial magistrate. He and the special public prosecutor had then recommended the court to declare the case as “B class”.

However, the judicial magistrate rejected the police's recommendation to categorise the FIR as “B class” and quashed it as “C class”.

What is a C class FIR?
There are three classes of the FIR - A, B, and C.

When the FIR is true but the accused persons cannot be traced, the report is classified as A-class, while B class means the complaint was found to be "maliciously false".

In C class, the FIR is disposed of as being a non-cognisable offence - meaning the criminal case was filed due to a mistake of fact or the offence is of a civil nature.

The aftermath of Awan's arrest
Awan's arrest sparked outrage from opposition parties, with the Sindh government claiming Sindh IGP Mushtaq Mahar was "abducted" and forced to act against the PML-N leader.

Captain (retd) Mohammad Safdar and Pakistan Muslim League-Nawaz (PML-N) member of provincial assembly (MPA) Imran Khalid have been indicted by a court on Saturday in the case of sedition and interference with the government.

According to Express News, the case was heard against Federal Minister Khurram Dastgir, Safdar and others including the MPA. Safdar and Imran Khalid appeared in the court of Judicial Magistrate Muhammad Azam Khan.

The court also summoned witnesses on June 20, while those accused of having interfered in the affairs of the government were summoned on June 29.

However, Safdar and Dastgir were granted exemption from appearing at the next hearing, whereas the former deputy mayor and MPA Imran Khalid were ordered to appear at every hearing.

In 2020, a FIR was lodged against Safdar in Gujranwala for sedition and for “provoking the people against the state and its institutions.”

According to the FIR, Safdar had held a meeting at Imran Khalid’s residence and had threatened to “oust the government through protests”.

Safdar had announced that if authorities refused to give permission to the PML-N to hold a rally in Gujranwala, he would force them into giving the permission, the FIR claimed.
