I got that Captain, I read the article and the questions posed in my post were going around in my head so I tried my best to articulate them.
What a sad state of affairs in India, hopefully the majority will see through the drama that is this current extremist government and will send them packing.
I am somewhat reassured by some sane Indian posters who are not afraid to post the reality of the situation in their country.

Sadly, not for next few years....These fascists have blinded more than 40% of Indian electorate in believing that muslims have to be driven out of India, whatever the means and consequences it takes...

Delhi violence: Police books Jamia students under UAPA

New Delhi, Apr 21 (PTI) Delhi Police has booked Jamia students Meeran Haider and Safoora Zargar under the Unlawful Activities (Prevention) Act (UAPA) in a case related to communal violence in northeast Delhi over the Citizenship (Amendment) Act, said a lawyer.
Haider and Zargar, arrested for allegedly hatching a conspiracy to incite the communal riots in February, are in judicial custody. While Zargar is the media coordinator of Jamia Coordination Committee, Haider is a member of the committee.

The police has also booked Jawaharlal Nehru University student leader Umar Khalid under the UAPA in the case, said advocate Akram Khan who is representing Haider in the case.

Haider (35) is a PhD student and the president of RJD youth wing''s Delhi unit, while Zargar is an MPhil student of Jamia Millia Islamia (JMI) university.

In the FIR, the police has claimed that the communal violence was a "premeditated conspiracy" which was allegedly hatched by Khalid and two others.

The students have also been booked for the offences of sedition, murder, attempt to murder, promoting enmity between different groups on grounds of religion and rioting.

Khalid had allegedly given provocative speeches at two different places and appealed to the citizens to come out on streets and block the roads during the visit of US President Donald Trump to spread propaganda at international level about how minorities in India are being , the FIR alleged.

In this conspiracy, firearms, petrol bombs, acid bottles and stones were collected at numerous homes, the FIR claimed.

Co-accused Danish was given the responsibility to gather people from two different places to take part in the riots, the police alleged.

Women and children were made to block the roads under the Jafrabad metro station on February 23 to create tension amidst the neighbourhood people, it said.

Over 20 film personalities, including Anurag Kashyap, Vishal Bhardwaj, Mahesh Bhatt and Ratna Pathak Shah, on Sunday had released a statement raising their voice against the arrest of the students and activists by Delhi Police for protesting against the Citizenship (Amendment) Act and demanded their release.

Following this, the police had said investigations into the JMI violence and northeast Delhi riot cases were done impartially, and arrests were made after analysis of forensic evidence.

In December last year, the police had allegedly entered the JMI campus after protests over the CAA, being held a few metres away from the varsity, turned violent.

Rajya Sabha MP and RJD leader Manoj Jha had tweeted, "Delhi Police called him for investigation and then received orders from above and arrested Meeran Haider, who has been helping people during the time of coronavirus outbreak."

The Jamia Coordination Committee (JCC), a group comprising students and alumni from the varsity, had condemned the arrest and demanded his immediate release.

"The country is facing a massive health crisis, however, the state machinery is busy harassing and framing student activists in false cases to suppress voices of dissent," they said.

The JCC said Haider was diligently working to provide ration to the needy during the lockdown. Communal clashes had broken out in northeast Delhi on February 24 after violence between citizenship law supporters and protesters spiralled out of control leaving at least 53 people dead and around 200 injured. Man injured in Farooqia Masjid attack held for ‘rioting’

A 22-year-old man was arrested on April 19 in connection with the riots in north-east Delhi in February. His family claimed that he had lodged a complaint with the police about being attacked inside a mosque in Brijpuri on February 25 and was called to the police station on the pretext of identifying the accused in the case.

Javed, a resident of Mustafabad who is pursuing BA from open school, was arrested at Dayalpur police station, his father Shokeen Ahmed, 45, said.

A senior police officer from North-East district said, “He [Javed] has been carefully examined. He was found involved in rioting. Hence, has been arrested.”

Mr. Shokeen, who runs a milk business, said Javed had gone to Brijpuri on February 25 to collect money from a relative. From there he went to Farooqia Masjid to offer prayers. “While they were praying, some men in uniform entered [the mosque] wearing helmets and handkerchiefs and attacked everyone with sticks. Javed’s head and foot were severely injured in the attack. Whether they were real policemen or not, we don’t know,” he said.

MLC prepared

When Javed reached home in an injured condition, he was rushed to Al Hind Hospital where many injured were being treated at that time, said the family. Javed received 10 stitches in his head and was sent home. On suggestions of lawyers, who were active in the area providing legal aid to victims, his medico-legal certificate (MLC) was prepared from Guru Teg Bahadur Hospital on March 5. A copy of the MLC was seen by The Hindu.

There were no proceedings in the case for an entire month, but about 20 days ago, the family members said they were approached by police officers from the district who first asked them about the MLC and then about how Javed got injured. “Javed narrated the entire incident. They asked whether we want legal action and we said yes. They tried to dissuade us from pursuing but we still insisted. They then agreed and took a written statement,” Mr. Shokeen said.

On April 19, Javed allegedly received a call from the police station and was asked to come to identify the accused who had attacked him. “We went and they asked Javed what he does. He told them he studies. They asked him to bring his education-related documents. The officer who initially questioned us let us go but then we were taken to a senior officer who asked Javed if he was involved. Javed denied and said he was in Brijpuri to collect payment and then he had gone to the mosque for prayers. The officer took details of the relative and called him,” Mr. Shokeen said.

The relative allegedly got scared of being dragged into the investigation and fumbled while answering a few questions and Javed was arrested, said the family. He was sent to Mandoli jail the next day.

Police sources in a unit tasked to probe the riots said they have started examining MLCs and are speaking to those who were injured. “There’s a possibility that those who got injured were rioting,” a source said.

Javed’s lawyer Deeksha Dwivedi said that he has been arrested in an unnamed FIR on charges of rioting, vandalism and theft. She also said that “it’s an arbitrary arrest” after he went to file an FIR for the injuries he received during the riots for which an MLC was done. “The family wasn’t informed of the charges. We will file a plea for interim bail,” she said.

The father said, “They have not shown us any video footage. They haven’t spoken to the imam of the Masjid. The arrest has been made only because we got the MLC done and they got to know about Javed.”

Coronavirus pandemic leaves Delhi riots victims twice displaced

New Delhi, India - The three newly installed lights fail to illuminate Jameela Begum's burned ruin of a house.

Its walls heavily blackened with soot, this was the place she had called home for 18 years before religious violence in the Indian capital erupted in February.

"You can still breathe the ash in the air. It is in an unlivable condition," Jameela, 55, told Al Jazeera.

On February 23, Jameela's neighbourhood in northeast Delhi was ravaged by the worst violence the capital had witnessed in decades, which left at least 53 people dead.

The violence took place amid protests over a controversial new citizenship law, which critics said violated India's secular constitution and was aimed at further marginalising its Muslim minority.

Dozens of people, including a large number of Muslims, have been arrested for the violence.

Displaced again over pandemic

Following the riots, Jameela's family of eight was forced to move to a relief camp set up in an Eidgah (grounds where Eid prayers are held), along with 600 others.

On March 24, Indian Prime Minister Narendra Modi announced a nationwide lockdown and urged people to stay home to prevent the spread of the coronavirus pandemic.

As soon as the announcement came into effect the next day, the Eidgah relief camp was cleared and its residents forcibly evicted.

"The authorities said we were getting too comfortable. The last two days in the camp, we were told they didn't have essential food supplies to feed us due to the lockdown," Jameela told Al Jazeera.

The displaced families were given Rs 3,000 ($60), 20 kg of wheat, 10 kg of potatoes, and were asked to vacate the camp.

Now, Jameela's family lives in a tenement close to the camp with limited access to food, no medical supplies and no scope to practise physical distancing, forcing them to tackle the pandemic without state support.

"This kind of displacement exacerbates health problems - respiratory infections, diarrheal infections and stunted growth in children," said Dr Sylvia Karpagram, public health expert.

Author and activist Farah Naqvi told Al Jazeera that when people are forcibly displaced from their homes, they must be guaranteed a sense of security.

"Relief camps are set up as an immediate response for victims of targeted mass violence and are vital to give the affected community a sense of protection," she said.

"The state needed to shift its imagination to deal with victims of communal violence combined with COVID-19. They had to be given safe accommodation that would enable them to maintain physical distancing, sanitation and hygiene."

Failure to act in time

On March 20, a Delhi court ordered the state government to "prioritise the health needs" of the people in light of the COVID-19 pandemic and set up three additional camps to practice adequate physical distancing.

But the Delhi government did not follow the court order and closed down the relief camp four days later, claiming that the inhabitants "left voluntarily" and were not asked to leave.

"We are giving cooked meals to the poor and e-coupons [online registration to access food rations] are being provided to families who have lost their ration cards," Haji Yunus, a legislator in the Delhi government, told Al Jazeera.

On March 28, the Delhi High Court directed the government to aid the displaced victims and provided it with a list of more than a thousand families who needed rations and medical kits.

The list included riot victims living in temporarily rented accommodation or staying with relatives.

"On April 3, the Delhi government suggested to place them in shelter homes intended for migrant workers, which was unacceptable," lawyer Sneha Mukherjee of the Human Rights Law Network told Al Jazeera.

Naqvi said the suggestion displayed the Delhi government's lack of understanding of the different needs of homeless people and victims of targeted mass violence.

She said shelters for migrant workers are gender-segregated, while riot victims have different requirements, a psychological need for safety within their family being primary among them.

Naqvi said living in proximity to their homes and to be able to visit them helps the victims accept the tragedy and rebuild their lives.

Compensation to victims

The victims of the violence have also complained of delay by the government in disbursing compensations, which they also said were not sufficient.

Many said the Delhi government had handed out compensation forms but did not provide processing numbers to help them track their applications.

"The dispersal of compensation will take time as the limited government resources are being prioritised for COVID-19," Yunus told Al Jazeera.

For loss of life, the kin of those dead are being given a million rupees ($13,000), which they complained was not enough.

Mohammad Waqil, 58, who lost his eyesight after he was attacked with acid by the rioters in Delhi, said he received an assistance of only 25,000 rupees ($375) from the government.

Jameela Begum said she had asked for compensation of 800,000 rupees ($10,500) for the loss of her property but is yet to hear back from the government about its status.

"A government that claims to be a proponent of efficient governance has made colossal blunders in terms of withholding receipts, delayed dispersal of compensation, and untimely closure of the camp during [one of the] the worst global pandemics this world has seen," said Naqvi.

In Delhi violence investigation, a disturbing pattern: Victims end up being prosecuted by police

On February 24, communal violence engulfed North East Delhi, leaving at least 53 people dead over the next three days, most of whom were Muslim. Exactly a month later, India went under a nationwide lockdown to contain the spread of the novel coronavirus. Normal life came to a halt – but not Delhi Police’s investigation into the violence.

By April 13, the police had made more than 800 arrests, the Indian Express reported. An unidentified official was quoted in the report saying that the Union Home Ministry “insisted that police must continue making arrests under any circumstances”.

But many lawyers and activists say the lockdown reduced scrutiny of the police investigation and impaired access to justice for those arrested. On May 16, activists of the Peoples’ Union for Democratic Rights, a civil liberties group, wrote in The Hindu that very little was known about the status of most Delhi violence cases.

Based on an analysis of around 40 FIRs, it accused the police of displaying communal bias against Muslims, by diluting charges against Hindu accused. “It is imperative, for the sake of justice that all FIRs pertaining to the riots be opened to public scrutiny,” the activists said.

The same day, the Delhi Police issued a rejoinder to the article on Twitter, calling it “factually incorrect”. It said over 1,300 accused had been arrested in over 750 cases related to the violence, with the number of those arrested from the two communities “almost identical to each other”. Still, the Delhi Police have not made the FIRs public.

Activists say this raises further questions, given that Muslims bore the brunt of the violence: 38 of the 53 killed are from the community.

Nature of violence

Activist Harsh Mander said the nature of violence in North East Delhi on the first day was that of a riot as both communities engaged in violence. On the subsequent days however, he said, it evolved into a pogrom “where organisations and people of the majority community, with active state protection and support, attacked the properties and bodies of Muslim residents”.

“The maximum loss of life and the loss of property was of this minority community, as has happened in virtually every major episode of communal violence after Partition, barring very few exceptions,” he said.

Three months after the worst violence in India’s capital in three decades, information about the police investigation remains limited, making it difficult to draw any definitive conclusions. But Scroll.in examined a few cases closely to find a troubling pattern: often victims of the violence were being prosecuted by the police.

Over the past two months, even as most of Delhi struggled to deal with the lockdown to combat Covid-19, the police have arrested hundreds of people for their alleged role in the communal violence that gripped the city late in February. Their actions in the midst of the pandemic have prompted allegations that the authorities have taken advantage of the lack of scrutiny during the lockdown as well as the limited access to the courts to move forward with flawed investigations.

But the Delhi Police have denied any anti-Muslim bias in their investigation. In a tweet on May 16, a police spokesperson said that more than 1,300 accused had been arrested in over 750 cases related to the violence, with the number of those arrested from the two communities “almost identical to each other”.

However, activists say this only gives rises to further questions, given that Muslims bore the brunt of the violence. Of the 53 people killed from February 23 to February 26 in the violence, 38 were Muslim.

Harsh Mander, an activist who has worked with victims of riots, said that what made the arrests more “sinister and troubling” was that the Delhi Police “cynically used the cover of the lockdown to detain and arrest large numbers of mostly Muslim people, including direct victims of violence”.

Even in the course of the violence, disturbing videos and testimonies had suggested police complicity, either in turning a blind eye to the violence against Muslims, or in many cases actually abetting and participating in it.

Many Muslim residents allege this bias extends to the police investigation into the violence. The families of Muslim men arrested say police officials mocked them using communally coloured language. Within the community, there is a strong perception that they are being targeted for their participation in peaceful protests against the Citizenship Amendment Act and the National Register of Citizens.

Muslim massacre of February 2020 in Delhi by goons of BJP (with support from Police) was conveniently brushed under the carpet as Coronavirus came just in time to take over the headlines. Quite sad but even without Coronavirus there was going to be no investigation into this or any justice for the thousands of muslims who suffered and the millions of muslims who suffered yet another mental scar inna country that no more considers muslims it's own people.

Muslims in 2020 are second class citizens of India and every blind supporter of BJP is a contributor in making the situation come to this point.

Except the fact that no one buys this narrative. Except the fact that IB officer Ankit Sharma's brutal murder by AAP leader Tahir Hussain does not supports this narrative. Except the fact that Umar Khalid's specific call to protest & riot against CAA on the same day of Trump's visit tells a different story to this narrative.

I dont know which party you support but the entire motive of Delhi riot was to paint India as Islamophobic infront of Trump by opposition. Govt passes the CAA bill which was to protect persecuted minorities from neighbouring countries. It had nothing to do with Indian muslims. But opposition created a fake narrative that all muslims will be driven out of India by virtue of this law and made innocent Indian muslims paranoid. Due to this fake narrative Delhi burnt for 3 days and resulted in so many deaths.

As ususal this move by opposition backfired when AAP leader got caught, cctv footages surfaced etc. It turned out that Swara Bhaskar didnt even read the CAA bill when she got brutally exposed in ABP news.

I know the ultimate aim is to remove Modi from power and bring Congress back but my only message to opposition is to play the cards properly. Try to corner BJP on genuine issues like economy, jobs, trades etc. The more you spread fake communal narrative...more people will support Modi. Ask Deepika Padukone, who went to JNU supporting left students and trying to created a narrative this govt is anti minority. People mass boycotted her movie Chapaak. Indian people are no longer ready to buy liberal narrative. I thought 2019 election result after 5 years of relentless propaganda might have taught Indian liberals some lesson but I was so wrong. Keep the same approach and 2024 will be a bigger loss.

For myself, I'm not into Indian politics that much and would not be able to talk in length about the domestic issues of India. However, issues like CAA, NRC, Assam, Kashmir, etc are large issues which have made headlines into international mainstream news outlets and hence for us living outside of India these coverage of events give an insight into Indian political world.

I also understand the concept that there are two sides of a coin and the way you see the events unfolding would have been different to what someone else would perceive. However, passing opinions across as facts to someone who might not be very knowledgeable on the subject matter is the basis of misinformation.

There is a high chance that either professors publishing opinions in NyTimes or yourself is spreading misinformation. For my opinion, I would count in on something published in major news outlet as more reputable piece of information than something coming from a random poster on a forum.

In Delhi violence investigation, a disturbing pattern: Victims end up being prosecuted by police

On February 24, communal violence engulfed North East Delhi, leaving at least 53 people dead over the next three days, most of whom were Muslim. Exactly a month later, India went under a nationwide lockdown to contain the spread of the novel coronavirus. Normal life came to a halt – but not Delhi Police’s investigation into the violence.

By April 13, the police had made more than 800 arrests, the Indian Express reported. An unidentified official was quoted in the report saying that the Union Home Ministry “insisted that police must continue making arrests under any circumstances”.

But many lawyers and activists say the lockdown reduced scrutiny of the police investigation and impaired access to justice for those arrested. On May 16, activists of the Peoples’ Union for Democratic Rights, a civil liberties group, wrote in The Hindu that very little was known about the status of most Delhi violence cases.

Based on an analysis of around 40 FIRs, it accused the police of displaying communal bias against Muslims, by diluting charges against Hindu accused. “It is imperative, for the sake of justice that all FIRs pertaining to the riots be opened to public scrutiny,” the activists said.

The same day, the Delhi Police issued a rejoinder to the article on Twitter, calling it “factually incorrect”. It said over 1,300 accused had been arrested in over 750 cases related to the violence, with the number of those arrested from the two communities “almost identical to each other”. Still, the Delhi Police have not made the FIRs public.

Activists say this raises further questions, given that Muslims bore the brunt of the violence: 38 of the 53 killed are from the community.

Nature of violence

Activist Harsh Mander said the nature of violence in North East Delhi on the first day was that of a riot as both communities engaged in violence. On the subsequent days however, he said, it evolved into a pogrom “where organisations and people of the majority community, with active state protection and support, attacked the properties and bodies of Muslim residents”.

“The maximum loss of life and the loss of property was of this minority community, as has happened in virtually every major episode of communal violence after Partition, barring very few exceptions,” he said.

Three months after the worst violence in India’s capital in three decades, information about the police investigation remains limited, making it difficult to draw any definitive conclusions. But Scroll.in examined a few cases closely to find a troubling pattern: often victims of the violence were being prosecuted by the police.

I find it quite measly when an opinion is being passed onto an unknown user as a fact. This is the root cause of misinformation in the world today and your post above is a representation where your opinion is being passed onto the users of this forum as a "fact".

For myself, I'm not into Indian politics that much and would not be able to talk in length about the domestic issues of India. However, issues like CAA, NRC, Assam, Kashmir, etc are large issues which have made headlines into international mainstream news outlets and hence for us living outside of India these coverage of events give an insight into Indian political world.

I have given below a link to an opinion published in NyTimes by professors of renowned universities and with Indian background. This piece of opinion paints a very different picture to the one described above in your post.

None of the things I posted on my previous post are my individual opinion. As you yourself said, you dont have much knowledge about CAA, NRC etc and blindly going by the pieces published in foreign press. I would suggest try to read the preamble of these laws (avaible in internet) by yourself and then let us know how they were discriminatory. Just posting a link from NY Times wont help. The same NY times where Indian media rejects like Barkha Dutt and Rana Ayyub publishes anti India posts on a daily basis.

And if you still think (after reading those laws yourself) that my post was inaccurate, you may want to wait till 2024 and find out how seriously people in India takes NY times opinion .

I'm not going to into back and forth arguments or discussions with you over this as I don't have too much knowledge on subject matter to have a valid debate.

However, one thing I can tell you is that "credibility" is built over time, with efforts, scrutiny and unbiased views. Simply put if you are rejecting NYT, BBC, WP, etc does not put doubt in my head about their credibility. Credibility is much like respect which is not forced but earned, these news outlets have earned credibility over the decades and I would take their opinions on a particular subject far more seriously than a post from a random poster on a forum. Just my views on credibility and I'm sure I'm not alone in having these views.

It comes down to culutre, Indian culture is mostly about power and clout. 90% fights are "I know xyz", rather than actual fights. So, when you have such a big power culutre, it's natural for people to want to be aligned with the ruling party for the clout.

You get happy, when you a cop stops you for breaking a rule and you call a low ranked BJP worker and get away scot-free.

You throw in an evil "muslims" into the mix and viola, you gave people a reason to join the so called power group.

You need few generations for the mindset to evolve. Next 2-3 decades will be the same. Today it is BJP, a decade from now eill be someone else, however, this power chasing mindset will still be there which will be easy to exploit.

AAP ex-councillor Tahir Hussain played pivotal role in NE Delhi riots, claim cops

The second chargesheet filed by police on Tuesday alleged that Tahir Hussain, the suspended AAP councillor, played a pivotal role in the northeast Delhi riots. It also claimed that Hussain transferred Rs 1.1 crore to shell companies in the second week of January and later got that amount in cash.

The investigation claimed that Hussain transferred Rs 92 lakh to the accounts of Meenu Fabrication and SP Financial Services, Rs 20 lakh to Show Effect Pvt Ltd and another Rs 20 lakh to Yudhvee Impex. The money was allegedly used in preparations for the riots and distributed among anti-CAA protesters and several others from the locality, who were told to be ready for “big action”.

The chargesheet accessed by TOI mentioned Hussain got his pistol released on February 22 from Khajuri Khas police station, a day before the riots. “He purchased 100 cartridges against his licence, but only 64 cartridges and 20 empty shells were seized. Hussain couldn’t give a satisfactory answer about the 14 remaining cartridges and the 20 spent ones,” police said.

The location of his mobile number matched with two other accused, Khalid Saifi and Umar Khalid, police said, adding that it corroborates with Hussain’s disclosure about their meeting prior to the riots.

Not surprised as people of India always knew Delhi riots were pre planned with the excuse of CAA. Good to see all masks are coming off now - slowly but surely.
 
This is quite meek attempt at masking the real reason for the violence from outside perspective.

The real reason there was chaos is because the police were bystanders rather than a force who should take quick and decisive decisions.

It's all too familiar a story where police goes missing and riots start resulting in fatalities.

Justice should prevail no matter what. If the councillor has incited violence and taken active participation in it then he should be lawfully dealt with under criminal law.

However, if India does not want a repeat of the same then actions should be taken (quite frankly criminal actions as by not intruding they are part of the crime being committed) against senior ranking police officials who were the decision makers in this crisis. When that happens actual justice for this crisis would be delivered.

Delhi Riots: New Charge Sheets Push ‘Hindu Retaliation’ Narrative

This week, the Delhi Police has filed seven charge sheets in connection with the communal violence that took place in Northeast Delhi in February this year. While the first four charge sheets focussed on anti-CAA protesters and alleged rioters belonging to the Muslim community, two have been on acts of violence allegedly from the Hindu side.

There are crucial differences between the two sets of charge sheets, which give an indication of the line of investigation.

‘Muslim Provocation’ vs ‘Hindu Retaliation’

The charge sheets seem to indicate that the main narrative is one of provocation from the side of Muslims and anti-CAA protesters and retaliation from the side of local Hindus.

Take for instance, this excerpt from the police’s note on the charge sheet filed regarding the murder of Aqil Ahmed (FIR Number 36) and Musharraf (FIR Number 38):

“Both the places of incident were not covered with any CCTV cameras. Based upon source information, it was revealed that some Hindu men had joined hands on 25th & 26th February, 2020, post the riots on 24.02.2020 in which Muslim mobs had done massive rioting in which large scale loss of lives and properties of Hindu community had taken place. The group was identified and some of the group members were picked up. During questioning, it was revealed that on 25th & 26th February, 2020, a ‘Whatsapp” group was created. This group had 125 members. Several members of the group were silent in the “Whatsapp” group. Subsequently, eye-witnesses were identified and examined. Bases upon oral evidences and the chat in the Whatsapp group, the identity of the perpetrators was fixed.”

Aqil Ahmed, a car mechanic and painter by profession was killed by the mob near Jal Boad Puliya in Bhagirathi Vihar, while Musharraf, an auto driver, was bludgeoned to death and his body thrown in the drain at C Block Bhagirathi Vihar.

Ten people have been arrested in connection with Aqil Ahmed’s murder and nine in connection with Musharraf’s killing.

In the police’s version, both the killings are being presented as a the reaction of Hindu men to the alleged rioting by Muslims the previous day.

“How is this possible? A vast majority of those killed are Muslims. The places of worship that have been destroyed belong to Muslims. So how can anyone say that the violence was caused by Muslims,” said senior advocate Mehmood Pracha, who is handling many of the Delhi violence cases.

The Conspiracy Angle

The conspiracy angle is a key element of the charge sheets against the anti-CAA side. For instance, the blocking of the Jafrabad road as well as the violence near Rajdhani School in New Mustafabad are accused of being part of a pre-planned conspiracy.

However, the conspiracy angle is entirely missing in the charge sheets involving the other side.

Interestingly, both the charge sheets involving accused from the Hindu community focus on the formation of WhatsApp groups. We already read the details of the WhatsApp group in the charge sheet on FIRs 36 and 38. The same can be seen in the charge sheet on FIRs 35 and 37, that deal with the killing of brothers Amir Ali and Hashim Ali. Here’s an excerpt from the note released by the police:

“During the investigation of these cases, it was found that during the peak rioting, a Whatsapp group was created in the intervening night of 25/26.02.2020, which had 125 members. Two active members of this Whatsapp group were located and joined in the investigation. During the investigation, their mobile phones were scanned and the specific Whatsapp group created on 25.02 was also identified. During the further investigation, it was revealed that while some members of these groups were only sending and receiving chats, few others were involved in active rioting.”

The police has claimed that “revenge” and “retaliation” were the key elements in some of the messages in these groups.

The police says nine people have been arrested in the Hashim Ali case and 11 in connection with Amir Ali’s murder.

However, in the Jafrabad case, a WhatsApp message has been used to allege a conspiracy. The message, supposedly found on the mobile of an accused, gives a list of steps local women can take to defend their homes.

Mehmood Pracha says that this clearly shows a one-sided probe.

“The only conspiracy here is from the Home Ministry and the Delhi Police. They carried out the violence, attacking Muslims,” said Pracha, who represnts Gulfisha, who has been charged under the Unlawful Activities Prevention Act.

‘Kaat Do’ Said Ragini Tiwari, ‘Eyewitness’ Saw Her Firing Bullets

"Bahut hua sanatan par vaar, ab nahi sahenge vaar. Sanataniyo baahar aao. Maro ya maar daalo. Baad mein dekhi jayegi. Bahut hua. Ab jiska khoon na khaula, khoon nahi wo paani hai (Enough attacks on Hinduism. We won't tolerate such attacks anymore. Hindus, come out. Die or kill. Rest shall be seen later. If your blood hasn't boiled even now, it's not blood but it is water).”

This is what self-styled Hindutva leader Ragini Tiwari alias Janki Behen, said on a Facebook live video near Maujpur on 23 February 2020, less than a day before communal violence erupted northeast Delhi.

The video went viral and several media outlets labelled her as one of the faces of the riots.

Less than four months later, Ragini Tiwari's Facebook account can’t be traced. Her name also finds no mention in the detailed chronology provided by the Delhi Police in their charge sheet that outlines the various speeches and events that led up to the riots.

In the same video, Tiwari can be seen saying, “Kaat daalo, jo bhi hai, kaat daalo... Bhimti hai kya? (Cut him up, whoever it is, cut him up. However, The Quint has learnt that Tiwari's actions in the run-up to the violence didn't just end with these remarks. She was present in the area well through the night on 23 February, until the early hours of the next day when the riots began to ravage Delhi.

‘Eyewitness’ Account

The Quint has accessed a detailed account of someone who has claimed to be an eyewitness to what happened in the area, including some of Tiwari's alleged actions from 23 February.

The name of the "eyewitness" is being withheld due to safety concerns.

But this account has been signed and submitted to SHO Gokulpuri Police Station, with copies sent to the Prime Minister of India, the home minister, the Lieutenant Governor of Delhi, Delhi's Commissioner of Police, Joint Commissioner of Police, the area's Deputy Commissioner of Police, the National Human Right's Commission as well as the National Commission for Minorities.

The statement has a police stamp saying, “received on 19/03/20”.

Here are excerpts from what the person has said in the signed statement:

“At around 9 PM (on 23 February) I saw Ragini Tiwari come in a car with some people. The people accompanying were carrying big guns and she began giving her speech. Often while making people chant slogans, she would fire bullets in the air, after which the mob began losing control.”

“Then at around 10 PM near Mohan Nursing Home, where she was giving her speech, the mob was chanting slogans Ragini Tiwari Zindabad" "Desh ke gaddaro ko, goli maaro saalo ko (shoot the traitors)", "Musalmaano ke do hi sthan, Pakistan ya qabristan (there are only two places for Muslims – Pakistan and the graveyard)" and vitiating the atmosphere.

Ragini Tiwari was the first to shoot at us and it hit the head of a boy who was standing there. This caused confusion. After this, there was stone pelting and firing. This is when I ran home.”

The Quint has not been able to independently verify these claims.

A story by ABP News confirms a few aspects of this statement, most importantly the timing. The news story confirms that Tiwari was indeed present in the area until the time claimed by the statement. In fact the ABP News report shows that she was there until early morning.

The news story doesn’t, however, does not talk about Tiwari shooting in the air. It also leaves out the part from earlier on 23 February where Tiwari can be seen saying “Maro Ya Maaro” and “Kaat daalo”.

However, the story makes an important revelation - that Ragini Tiwari was also blocking the road along with her supporters. This is a claim that was also confirmed by Tiwari to these reporters.

However, despite that, it has not been mentioned in the police charge sheets which have been assessed by The Quint. The police narrative has been that only one side was blocking the road.

'Tiwari Campaigned for BJP Candidate in Delhi'

Not much is known about Tiwari except that she originally hails from Bihar and claims to be a proud "Maithili", a language spoken in the Northern and Eastern Part of Bihar. However, much of her political work is focused in Delhi. In an interview given to News24 on 29 February, Tiwari says isn't associated with any political party.

In another video, she herself claims that she campaigned for BJP candidate from Laxmi Nagar Abhay Verma in the Assembly elections in Delhi earlier this year.

This video statement by her indicates that while she admires Prime Minister Narendra Modi, she is critical of much of the political party's Delhi leadership, especially former state unit chief Manoj Tiwari and East Delhi MP Gautam Gambhir.

“We are with you Modi ji, crack the whip on the MPs and councillors from Delhi,” she says in the video.

According to another report she claims to be a follower of self styled preacher Yati Narsinghanand Saraswati, who made several controversial videos in January and February this year, allegedly calling for violence against CAA protesters.

Tiwari Responds to Allegations

The Quint reached out to Ragini Tiwari for her side of the story. When asked why she made the provocative statements in the video shared widely, she not only explained that they were blocking the road but that she was allegedly injured, “First get your hands on another video from the day when we were blocking the road and some people came and told me that stones and glasses were being thrown. I hurried towards the direction where people were walking ahead with stones etc where I have been injured. First see that and then ask me this question,” she says. When requested to share a copy of this video she clarified that Facebook shut her profile down.

Regarding the allegations against Ragini of shooting and injuring someone, she says they were ‘baseless allegations’.

We also asked her if she had campaigned for BJP candidate Abhay Verma and if she had campaigned for anyone else, she said, “I am the daughter of Maithili and he is also from there. Other than that I have no interest in any other party.” Tiwari also said she did not know about the complaint and was hearing about it for the first time from The Quint.

Response Sought from Delhi Police

The Quint also contacted Delhi Police PRO MS Randhawa and DCP North East Delhi Ved Prakash Surya, asking them if the police is investigating the allegations against Tiwari or if there was an FIR lodged against her. But neither of the two officials responded. The story will be updated as and when they respond.

We also reached out to the concerned SHO of Jaffrabad police station who said he did not have information about this complaint, “I came to this post very late, it has only been a month and a half, I do not know anything about this complaint,” he abruptly cut the phone after saying this.

Just to reiterate, we have withheld the name of the person who has written the statement for safety reasons but we would be happy to share the entire signed statement with the police if called upon to do so.

Four Months After Viral Video Of Policemen Beating Man To Death, FIR Says No Suspects

NEW DELHI — The Delhi Police’s First Information Report into one the most controversial deaths in the 2020 Delhi Riots omits any reference to the police’s alleged role in the incident.

23-year-old Faizan died in February this year, days after he was violently assaulted by uniformed policemen and forced to sing the national anthem.

A video of the incident sparked outrage after it went viral online and was also carried by several news outlets.

Yet the First Information Report registered by the Bhajanpura Police station makes no mention of the clearly documented video footage of the police assaulting Faizan; contradicts on-record police statements that Faizan was in police custody following his assault, and claims that Faizan died after he went missing from the Guru Tegh Bahadur hospital in northeast Delhi.

Three months and a half months after his death, Faizan’s family is yet to get a copy of the autopsy conducted on his corpse. Meanwhile, key witnesses in the case told HuffPost India that police officers were putting pressure on them to change their statements.

Kismatun, Faizan’s 61-year-old mother, told HuffPost India that the local police had asked her to change statements in which she placed the onus of Faizan’s death on the police for first assaulting her son in the streets, and then denying him medical treatment when he was held at the Jyoti Nagar police station.

“In the first week of March they called me to Jyoti Nagar station and this time, they addressed me as mataji. A policeman told me, ‘Whoever had to go is now gone. If you change your views, you will get some aid and money’.” Kismatun told HuffPost India. “I told the policeman, I did not want any money. If they had let my child go, I would have sold our house if needed, and got him treatment.”

“If the police had allowed my injured son to go, I would have saved him,” Kisamtun said.

Deputy Commissioner of Police (Crime Branch) Rajesh Deo who is heading the probe declined to comment on whether his team had identified the uniformed policemen who are seen assaulting Faizan in the widely circulated viral video, nor did he respond to the numerous discrepancies in the initial police complaint.

“The case is pending investigation,” Deo said. “If there are any discrepancies, they will come out in further investigation.” Three months have passed since Faizan’s death, but the police are yet to file a charge-sheet in the case, without which prosecution proceedings cannot begin in court.

“This is not a blind spot or a mystery case, one without any evidence, but one in which there is clear video evidence,” said Vrinda Grover, the lawyer for Faizan’s family. “Instead of following these video leads and testimonies of eye witnesses to identify the perpetrators, the police are questioning the morality and integrity of the victims, and those who captured the videos of the assault from a distance.”

“Even during a situation of riots or disturbances, formal orders get passed on which police units will be deputed in which areas. Who those 6 to 8 policemen were who assaulted Faizan is known to the police,” Grover said. “If the police SIT who are meant to investigate this impartially are not submitting a charge-sheet even after over three months, then it shows the police is shielding those men.”

The following account, based on the FIR, interviews with witnesses and family members, and HuffPost India’s previous reporting on Faizan’s death, raises troubling questions over the Delhi police’s investigations into the week-long communal riots that swept the national capital and claimed at least 53 lives. Reams of video footage from bystanders and CCTVs have shown policemen actively participating in the violence by attacking students and bystanders and damaging public and private property.

The police have registered over 750 first information reports, filed over 88 chargesheets, and claimed that the riots are a consequence of a pre-planned conspiracy by forces aligned against the government; yet the force has been curiously silent about the violence committed by its own policemen.

Omissions in police version
If the police FIR is to be believed, on Feb 25 Head Constable Manoj Bhatti arrived at GTB hospital and was provided Faizan’s medico-legal-certificate which claimed “physical assault by mob” as stated by the patient himself. Faizan, the FIR claims, had received treatment and left GTB hospital on his own. The FIR claims the police visited Faizan’s house, but he was not at home. Later, the police learnt he had sought treatment at Lok Nayak Hospital and had died.

The police version of events makes several omissions, as per a detailed investigation by HuffPost India published in March, and eliminates the active role played by the police all together.

An eyewitness who was assaulted by the police alongside Faizan had told HuffPost India that they were bundled into a police vehicle after their assault and taken to the Guru Tegh Bahadur hospital for a round of basic first-aid, after which they were taken to the Jyoti Nagar police station.

Shailendra Tomar, the Station House Officer of Jyoti Nagar station, where Kardampuri falls, had in February, confirmed to Huffpost India that Faizan and the other men seen in the assault video were brought to the station on February 24 from GTB hospital.

Kisamtun, Faizan’s mother, said she went to the Jyoti Nagar police station to plead for her son’s release on three separate occasions: The night of February 24, the morning of February 25, and then finally the night of February 25 when the police finally allowed her to take Faizan home at about 11 PM at night.

The next morning, Kisamatun and her relatives rushed Faizan to the Lok Nayak Hospital after his health deteriorated considerably. He died the same day.

“The police had beat my son so severely that his body turned blue by the time they released him from Jyoti Nagar police station on the night of February 25,” Kisamtun, Faizan’s 61-year old mother told HuffPost India in an interview soon after Faizan’s death. “The policemen had put batons inside his throat and he could not swallow or eat when he got him home. Even his fingers were swollen and broken.”

Crucially, the family was unable to get any official documentation regarding Faizan’s death — neither his medico-legal-certificate from when he was first brought to GTB hospital, nor his autopsy. In fact, his body was not released for three days as police officials at the neighbouring police stations of Bhajanpura and Jyoti Nagar argued over who had jurisdiction over his case.

Three months into the case, Faizan’s family say members of the Crime Branch have interviewed them, even as the local police force has sought to silence their testimonies.

“I told the investigators that I went to Jyoti Nagar station on the night of February 24. There, a policeman confirmed to me that Faizan was in the station lock-up,” Kismatun recounted. “But the station staff were rude and dismissive. They threatened me, ‘Go, get lost, we will lock you in too’.”

“I went again the next morning but they would not respond to me. Late at around 11 at night of February 25, when his condition kept getting worse and he had started vomiting, the SHO told my neighbours to tell me to take him back. I and relatives of two men who had also been assaulted by the police requested a neighbour to drive us in an auto to the station and six of us returned together from the station.” Kismatun said.

As mentioned earlier, the police subsequently called Kismatun and asked her to change her statement. She isn’t the only witness the police have sought to influence.

“The police are interrogating the person who shot the second video which provides an aerial shot of the police assaulting Faizan and four men next to the Kardampuri mohalla clinic and corroborates the incident,” said a member of Faizan’s family, referring to the fact that there are three separate videos of the police assaulting Faizan. “After they were questioned, the family approached us in April and told us they were terrified. They asked if we had registered a police case against those who shot the video.”

The relative said the police intimidated the person who shot the video by insinuating that he was a rioteer too.

“Similarly, the police have been questioning Faizan’s co-workers about his reputation, whether he took part in protests against the citizenship law or not, and so on,” the relative said.

One of Faizan’s former co-workers at the poultry shop, where Faizan worked shortly prior to his death, confirmed that the police had interrogated him about Faizan’s involvement in protests against the Citizenship Amendment Act (CAA), Modi government’s controversial new citizenship law that critics say discriminates against Muslims.

“The police asked me what kind of boy Faizan was, was he participating in CAA protests, had he gone to work that day,” said Qureshi. “I told them I had dropped him at the circular road as per usual at 2:30 pm on February 24. He had come to work every day in the weeks prior to his death, we left home at 6am for Ghazipur and usually returned by 3 or 4 pm.”

One of the men who was in lock-up with Faizan before his death said his relatives were being questioned by the police as well.

“The police have been making enquiries from my relatives on how I am related to them, what they think of me, do I keep bad company, was I up to any mischief and rioting. I told my relatives to speak freely ― when I have done no wrong, why should I be scared?” said the young man who remained bed-ridden for weeks after he was assaulted on February 24.

He recounted that the police had assaulted him, Faizan and three others around 4 pm on February 24.

“Women from Kardampuri had organized a peaceful sit-in protest for over a month. That day, someone shouted that a fire had started on the main road and there was chaos,” the eyewitness recounted. “When I got there, it was a stampede-like situation. I fell and policemen caught me, beat me and dragged me till the mohalla clinic till my skin peeled off. Four men lay in a heap near the clinic and I was the fifth. I thought I was going to die that day.”

He continued: “They were in police uniforms, and they beat us and threatened us to sing the national anthem, and taunted us to chant ‘Azaadi’. They were shooting a video making us sing, and that video got leaked by one of them. One of them even threatened us openly ‘Even if you die, nothing will happen to us, and it will be written off as a riot case’.”

He reiterated that Faizan was kept in the lock-up at Jyoti Nagar after being brutally assaulted by the police, and reiterated the timeline corroborated by Kismatun, and the other witnesses in the case.

“The policemen took us to GTB hospital, and then locked us at the Jyoti Nagar station,” he said. “Faizan was asking for water. He was vomiting. We spent February 24 night in the lock-up. We were so badly injured, we could not stand up on our own. Some held Faizan and then me to even go to the toilet. We needed treatment.”

The men were finally released on February 25, the eyewitness concluded.

“The Crime Branch officials tried to ask me many indirect questions on my interest and involvement in protests, but this is the simple sequence of events which I have stated to them as well,” the witness said.

Safoora Zargar: Bail for pregnant India student blamed for Delhi riots

An Indian court has granted bail to Safoora Zargar, whose imprisonment on charges of instigating riots had triggered global outrage.

She was more than three months pregnant when she was arrested in April.

Police called her a "key conspirator" in anti-Muslim riots that swept Delhi in February, in which 53 people died.

Ms Zargar's family denied the allegations, saying that she had only been a part of protests against a controversial citizenship law.

However, Ms Zargar was charged under the Unlawful Activities Prevention Act (UAPA) - a draconian law that makes it nearly impossible for the accused to get bail.

Her incarceration in the overcrowded Tihar jail had caused a lot of concern, especially at a time when India was under a strict lockdown to fight the coronavirus pandemic.

On Tuesday, the Delhi High Court granted her bail in response to a plea filed by a fellow student who said that Ms Zargar was suffering from medical complications. The government, which had opposed all her bail pleas so far, said it would not oppose it this time on "humanitarian grounds".

The court has asked her not to leave the city and also told her not to engage in "any activity which would hamper the progress of the investigation" in her case.

She has been asked to pay a personal bond of 10,000 rupees ($132; £106) before her release.

Her husband - who has declined to be named - told the BBC that they expected her to be released today.

Ms Zargar is among a number of Muslim students and activists who have been jailed since India's lockdown began on 25 March, leading to accusations that the government is using the pandemic to crack down on free speech and dissent.

As a member of the Jamia Coordination Committee (JCC), a student group at her university, she had been active in organising peaceful protests against the Citizenship Amendment Act in north-east Delhi. Critics of the law have said that it discriminates against Muslims.

Ms Zargar, now six months pregnant, soon emerged as the face of state repression against students and activists.

"The government of India has been exceedingly intolerant towards free speech and dissent," Amnesty International India Executive Director Avinash Kumar said in a statement at the time of her arrest.

"But to arrest Safoora who is in the second trimester of her pregnancy and send her to an overcrowded prison during the pandemic highlights how brutal is the ongoing clampdown in the country."

This led her to be attacked by government supporters on social media, who attempted to slut-shame her, posting vulgar comments suggesting she was unmarried and raising questions over her pregnancy.

If that’s what a highly ranked police officer said about Muslims then how can Indian Muslims rely on the police at all? I wonder if any action will be taken against the ACP or is this like a routine thing that goes unpunished?

New Delhi: Rumours that some supporters of BJP leader Kapil Mishra had set fire to a podium of an anti-CAA protest could have sparked large-scale violence in Delhi in February, Delhi Police sources have said. This detail has come out of an investigation into the killing of policeman Ratan Lal, 42, during the violence that consumed parts of north-east Delhi.
The clashes were linked to the Citizenship Amendment Act or CAA that fast-tracks citizenship to non-Muslim minorities from neighbouring nations and is seen by many as discriminatory.

Head constable Ratan Lal died after being attacked by a mob near Dayalpur police station, some 5 km from Jaffrabad, where violence began and spread to many parts of north-east Delhi.

According to a police chargesheet, people who were out on the streets in protest against the CAA were served rumours that Kapil Mishra's men had set an anti-CAA protest site at Jaffrabad on fire. Mr Mishra had led a rally on February 23 in favour of the CAA in Maujpur, less than 2 km from the Jaffrabad anti-CAA protest.

The police sources said the rumours were spread to instigate rioters. Head constable Ratan Lal, who was trying to control a crowd near Dayalpur, died after this mob attacked him as they went about damaging and setting property on fire, the police said.

"There were rumours that an anti-CAA protest site at Jaffrabad had been set on fire by Kapil Mishra's men, but we didn't see anything like that happen," the police sources said, quoting an eyewitness in the chargesheet.

The chargesheet says Swaraj India chief Yogendra Yadav gave a speech at an anti-CAA protest at Chand Bagh. Mr Yadav's name is not in the list of accused in the chargesheet.

"Links of the organisers of the (Chand Bagh) protest site with the likes of DS Bindra (AIMIM), Kawalpreet Kaur (AISA), Devangana Kalita (Pinjra Tod), Safoora, Yogendra Yadav indicate a hidden agenda behind the violence," a Delhi Police officer said.

Police chargesheet is there, but there is no charge. I'm not an accused. They haven't said anything against me, except one thing - that I used to come and go and give speeches. It wasn't a secret. Every speech that I gave is in public domain," Mr Yadav said in a video statement.

The latest chargesheet filed in connection with the Delhi riots has made no mention of incendiary speeches by BJP leaders, including Mr Mishra. At the rally, he gave an "ultimatum" to the Delhi Police to clear the roads in the area, else, he said, they would have to hit the streets.

Hours later, clashes had broken out between the two groups, which spiralled over the next few days. Over 50 died in the violence.

A government-appointed commission promoting the rights of India's religious minorities said police failed to protect Muslims campaigning against a new citizenship law during violent riots in Delhi state this year.

At least 53 people, mostly Muslims, were killed and more than 200 were injured in the worst communal violence in the Indian capital since more than 3,000 people of the Sikh minority community were killed in 1984.

The Delhi Minorities Commission (DMC) said on Thursday that Muslim homes, shops and vehicles were selectively targeted during days of rioting that coincided with US President Donald Trump's trip to India.

The violence erupted in February after the leaders from the governing Hindu nationalist Bharatiya Janata Party (BJP) and their supporters attacked peaceful sit-ins in northeast Delhi organised against the new citizenship law.

The Citizenship Amendment Act (CAA) passed in December by the Indian Parliament fast-tracked the path to citizenship for religious minorities from neighbouring countries except for Muslims. Critics said the law was against the spirit of the country's secular constitution.

'Fundamentally discriminatory' law

The law, which the United Nations called "fundamentally discriminatory", triggered nationwide protests, mostly led by Muslim women and posed the biggest political challenge to Prime Minister Narendra Modi since he took over in 2014.

In all, 11 mosques, five madrasas or religious schools, a Muslim shrine and a graveyard were attacked and damaged, a fact-finding team from the commission said in its report released on Thursday.

Recommendations made in the commission's report to safeguard minority rights are not binding.

"Seemingly, to crush the protests, with support of the administration and police, a retaliatory plan of pro-CAA protesters was worked out to trigger violence at a large scale," it said.

The commission said police had charged Muslims for the violence even though they were the worst victims.

Delhi police spokesman Anil Mittal rejected the allegation of bias and said police had acted fairly.

"We have filed 752 first information reports, over 200 chargesheets, arrested over 1,400 people in connection with the riots. We have also formed three special investigation teams and are still open to receiving complaints," Mittal said.

Critics of Prime Minister Modi's BJP government say it has been promoting a Hindu-first India and that the citizenship law aimed to further marginalise the country's 170 million Muslims.

The BJP has denied any bias but says it is opposed to the "appeasement" of any community. But critics say BJP's charges of "Muslim appeasement" does not hold water, as a government commission report in 2006 said the minority community is at the bottom of the most development indices.

The DMC report also alleged some senior BJP leaders like former member of Delhi legislative assembly Kapil Mishra of fuelling the February 23 violence, but a party spokesman said there was no basis of such allegations.

"When Delhi police has already stated in court that there is no role proved of Kapil Mishra, then on what grounds DMC is saying this," BJP spokesman Harish Khurana said.

The minorities commission said witnesses spoke of police failure to intervene in the rioting.

"Multiple testimonies collected by this Fact-Finding Committee recount reports of police inaction even as violence unfolded before them, or of police not arriving despite being called repeatedly," it said.

Delhi Police Affidavit Shows Muslims Bore Brunt of Riots, Silent on Who Targeted Them and Why

New Delhi: A Delhi Police affidavit giving the most detailed government account yet of the communal violence which shook the capital’s north-east district in February this year has provided for the first time an official break-up by religion of the victims.

And though the Sangh parivar rumour-mill has consistently described the riots as ‘anti-Hindu’, the data makes it clear that Muslims bore the brunt of what was essentially targeted, organised violence.

The list of the dead provided in an annexure to the affidavit submitted to the Delhi high court on July 13 establishes that 77% of the civilians killed – 40 out of 52 – were Muslim while the remaining 23%, or 12, were Hindu. The 53rd victim was a policeman, head constable Ratan Lal, who died of gunshot wounds, and even if he is included in the list of Hindus, Muslims still make up three-quarters of those killed.

A separate annexure provides a Hindu-Muslim break-up of houses and shops destroyed. Here, even though its tabulation establishes that Muslims suffered greater losses, the Delhi Police appear to have deliberately undercounted the extent to which they were targeted.

For houses damaged, the police give the total number as 185, comprising 14 Hindu houses, 50 Muslim ones and zero ‘unknown’. This suggests that just 27% of the homes damaged or destroyed belonged to Muslims. But when the area-wise breakup is correctly added, the Muslim total rises from 50 to 90, i.e 48.6%. But even this is a gross undercount as the police has withheld the breakup for Khajuri Khas – where the single largest number of houses were destroyed (54) – and Karawal Nagar (23). Both are Hindu majority areas with Muslim pockets within them and it was the residents of those pockets who bore the brunt of the mobs. Assuming many if not most of the 41.6% houses belonging to the ‘unknown’ category are in fact Muslim houses, then it could be that 85-90% of the brunt was borne by Muslims.

But even here, the police numbers seem an undercount. On March 3, the Eidgah relief camp had around a thousand displaced Muslim men, women and children, mostly the poorest amongst those whose homes were damaged or destroyed. Even at 5 members to a family, that is 200 households. Many others had moved in with relatives or left Delhi.

The same pattern of undercounting is evident when it comes to the break-up of damage to shops. Again, the police are not able to add up the Hindu and Muslim columns properly.

Going by the neighbourhood-wise breakup, 14% of shops damaged belonged to Hindus and 53.4% to Muslims. But Khajuri Khas and Karawal Nagar have no religion-wise breakup, so “unknown” is 32.4%. Again, assuming the bulk of the ‘unknowns’ are Muslim, given the two localities and contemporary media reports, Muslims appear to have been the target for 80-85% of the attacks on shops and businesses.

However, the Delhi Police makes no note of the evidence of this targeting that is hiding in plain sight in its annexures because it runs counter to the thrust of its affidavit – that the riots were a conspiracy by the anti-Citizenship (Amendment) Act protesters to “execute a secessionist movement in the country by propagating an armed rebellion” in which “the anti-government feeling of Muslims, will be used at an appropriate time to destabilise the government.”

The Delhi police filed this affidavit in response to a clutch of petitions filed by Harsh Mander, Shaikh Mujtaba Farooq, Rahul Roy, Brinda Karat and others demanding, inter alia, that FIRs be registered against BJP politicians like Kapil Mishra and Anurag Thakur for inflammatory speeches in the run up to the February violence. “It is submitted that during the investigations conducted so far in all the aforesaid matter related to North-East Delhi riots no actionable evidence has surfaced yet indicating any role being played by [these] persons instigating and/or participating in the riots,” the police said.

Number of ‘temples damaged’ rises from two to six

Most curious of all is the figure of six for “temples damaged” and 13 for mosques, considering that in a reply to an RTI query last month, the Delhi Police itself gave the number of mosques/madrasas damaged as 11 and temples as only two. How the figure of two has now grown to six is not clear.

The targeted mob attacks on mosques, dargahs and madrasas during the riot had been widely documented in the media. Scroll.in provided details with photographs of 15 such places that had been burnt. On February 25, The Wire‘s reporters were witness to the burning of a mosque in Ashok Nagar and the planting of a Hanuman flag on top of its minaret. In contrast, there have been no reports of any Hindu temple sustaining serious damage.

While mobs pelted stones at the Gauri Shankar Mandir in Shiv Vihar and a Hanuman temple near the Rajdhani School which had been taken over by a mob was also briefly targeted, not even the pro-Hindutva media which devoted a lot of space to describing the violence as the ‘anti-Hindu Delhi riots’ has alleged that temples had been systematically targeted or damaged. One right-wing portal did claim that a Muslim mob had climbed atop a Shiv Mandir in Chand Bagh to throw stones but this was debunked by none other than the priest of the temple.

In a separate list of 473 civilians injured, the police have listed the name and father’s name of each of them. Though religion is not mentioned, going by the names, Hindus account for 216, or 45%, while Muslims account for 257, or 55%.

A total of 108 police personnel were also injured.

Police play up violence against Hindus in affidavit

Though the data contained in the annexures of the Delhi Police affidavit makes it clear that Muslim lives, homes, shops and places of worship bore the brunt of the violence seen across north-east Delhi in February, it is hard to reconcile that data with the affidavit’s structure and contents – which give no indication whatsoever that there had been any targeting of Muslims.

Curiously, the only individual victims it describes all happen to be Hindu. After stating that 473 civilians were injured in the riots, the affidavit says:

“It is shocking to note the following:

“Contrary to what circulated in public domain the head constable Shri Ratan LaI has died due to bullet injuries sustained by use of firearm…

“An Intelligence Bureau officer Sh. Ankit Sharma was stabbed multiple times and his body was dumped in a large drain (nala). His dead body was found.

“A person was burnt alive and his body was found on the first floor of the building. Investigation have revealed that prior to being burnt he was brutally assaulted.”

The last case is a reference to the widely reported murder of a Hindu sweetshop employee, Dilbar Negi. Why Delhi Police felt the need to highlight his killing in the affidavit, or that of Ankit Sharma, over others that were also brutal is not clear.

The affidavit’s narrative speaks broadly of battles between mobs – those opposed to the Citizenship (Amendment) Act, who had conspired to launch riots, versus those opposed to their sit-down protest. February’s Delhi riots ‘well-planned’: Inquiry report

February’s riots in the Indian capital New Delhi were “well-planned,” said a fact-finding report by the Delhi Minorities Commission on Thursday.

In a report, the commission highlights that riots caused the displacement of a large number of Muslim families.

The communal riots, which turned violent, in northeast Delhi between Feb 23 and 27 killed over 53 people, mostly Muslims, and injured over 250.

The report also documented that 11 mosques, five Muslim seminaries, one shrine, and one graveyard were attacked and damaged in the violence.

It also points out that the submission of charge sheets into complaints, without proper investigation, has created doubts over probe’s impartiality.

‘Inflammatory’ speech

The report noted that violence erupted in various parts of northeast Delhi within hours of Feb 23 “inflammatory” speech by Kapil Mishra, a politician affiliated with the ruling Bhartiya Janata Party (BJP).

On Feb 26, High Court asked Delhi Police to take a “conscious decision” to register a first information report (FIR) in 24 hours against Mishra, Anurag Thakur and Parvesh Verma for their speeches that led to incitement of violence.

To date, no FIR has been registered against the BJP leaders.

Speaking to Anadolu Agency, MR Shamshad, advocate-on-record, Supreme Court of India, who headed the 10-member fact-finding committee, said the whole narrative of the riots was changed by the police.

“Certain set of FIRs were prioritised causing a perception that Muslims instigated the riots. This would not have happened if the complaints from Muslim residents were also investigated without lapses, their complaints were mostly bypassed or delayed,” said Shamshad.


He further added that the victims, most of whom were Muslims, would have stood better served with fast justice and faster disbursement of monetary relief. In several areas of northeast Delhi, properties owned by Muslims were looted, burned, and destroyed.

Ruling BJP rejects report

The 130-page fact-finding report has been submitted to Delhi’s Lt Governor Anil Baijal, and Chief Minister Arvind Kejriwal, who are yet to take any action.

The commission’s report also points out that large armed mobs of people attacked the Muslim-dominated northeast Delhi, chanting slogans like “Jai Shri Ram”, “Har Har Modi,” slogans associated with the right-wing ruling party.

“Mobs specifically vandalised and burned Muslim places of worship and learning as well as religious symbols like copies of the Holy Quran. Non-Muslim places of worship in Muslim majority areas remained untouched and were guarded by Muslim neighbors during the riots,” it stated.

The fact-finding committee has made its recommendations, asking the government to ensure proper and prompt registration of cases, ensure the recording of victims’ statements, and provide witness and victim protection, among many others.

Shamshad added that there is a lower-footing of such reports and it is has been sent for a wait.

Harish Khurana, the ruling BJP spokesman, rejected the report.

“When Delhi Police has already stated in court that there is no role proved of Kapil Mishra and Parwesh Sahib Singh [BJP’s general secretary for Delhi State] then on what ground DMC [Delhi Minorities Commission] is saying this,” he said on Twitter.

He is a reporter for AFP. He is quoting a fact-finding report released by the Delhi Minorities Commission.

Sure, you can believe Delhi Police instead... I mean, it's not like they were involved in the riots, or that there's even footage of them along with the rioters...

I will preempt your reply... BBC is anti-India therefore they can't be trusted either. And the Delhi Commission Report article quoted above is posted by The Wire, which is also anti-India.

For authentic news, we can only rely on outlets like Republic. And reputable institutions like Delhi Police.
