Information Minister Marriyum Aurangzeb said on Saturday that legislation would be made in Pakistan Electronic Media Regulatory Authority (PEMRA) laws to eliminate fake news.

The decision was reached during a meeting between the information minister and the Media Joint Action Committee. The forum reached a consensus that fake news damages national security interests and societal cohesion.

“Prime Minister Shahbaz Sharif will not compromise on the protection of freedom of expression,” Minister Aurangzeb said. “The prime minister wants to promote this constitutional and civil right. Death of journalism is the death of politics and democracy.”

“For four years, the people, politics and journalism has been derailed,” she said. The minister said during this time, attempts were made to snatch the 'freedom of the nation'.

Aurangzeb added that 'black laws' such as the PECA Ordinance and Pakistan Media Development Authority (PMDA) conspired to enslave 220 million people.

“The media was financially destroyed in four years like the country's economy,” Aurangzeb lamented. “Journalists are aware of the economic catastrophe. They want to repair the damage done to them as soon as possible.”

She added that journalists had lost their jobs and many also lost their lives and that the government was aware of the plight of their families.

“The government is trying to recover the country's economy as the former government conspired to bankrupt the country," she said.

Aurangzeb further condemned allegations made by former prime minister Imran Khan against journalists in the 'foreign conspiracy' scandal.

“Whoever speaks the truth, Imran refers to him as a traitor,” she said. “No media space should be given to those who throw mud on the institutions, the judiciary and the media in the name of a foreign conspiracy.”

She also added that the media should also play its role in curbing false rhetoric. A free and impartial media is the refuge of politicians and we will strengthen it, she assured.

The media delegation welcomed the move of repealing the PECA Ordinance and disbanding PMDA. It also congratulated Aurangzeb on assuming charge as the new information minister.

“It is hoped that the new government will maintain the democratic mood and will strengthen the freedom emanating from the constitution,” the delegation commented.

The Pakistan Electronic Media Regulatory Authority (Pemra) on Friday issued a show-cause notice to ARY News for airing what it called was "fake/unverified news" based on informal sources about the stance of Pakistan's former ambassador to the US, Asad Majeed, regarding the 'Cablegate' controversy.

The cable in question refers to a communique sent by Majeed that former prime minister Imran Khan has continuously claimed contains evidence of a conspiracy to topple his government. The National Security Committee (NSC) convened a meeting on the cable yesterday — the second time in as many months that the NSC held a meeting to review the cable's contents — in which the former US ambassador was also present and testified before it.

According to the show-cause notice, a copy of which is available with Dawn.com, the channel aired the news, regarding the ambassador's stance in the meeting, at 6:52pm on Friday.

According to the comments quoted in the notice, ARY News claimed citing sources that Majeed, in the NSC meeting, maintained that the cable's contents amounted to interference in internal affairs, and that it was a "reality" that threatening language had been used in the cable and the ambassador remained steadfast on his stance despite government pressure.


Pemra said that the airing of "fake/unverified news" quoting informal sources without taking Majeed's point of view appeared to be an "intentional move on the part of ARY News and tantamount to malign state institutions".

"Moreover, this act is against the established journalistic ethics wherein an official statement of the NSC was issued and yet ARY News is relying on informal sources with ulterior intentions to mislead viewers," the notice said.

It added that the airing of fake news and unverified content raised serious concerns about the performance of the channel's editorial board and the gatekeeping tools adopted.

"Airing of such fake /unverified news [is] tantamount to sheer violation of Section 20(f) of Pemra Ordinance 2002 as amended [by] Pemra (Amendment) Act, 2007 read with Clause 3(1)(i,k), 4(1), 4(2), 4(4), 4(7), 4(10), 5, 17 and 24 of Electronic Media (Programmes and Advertisements) Code of Conduct 2015, as well as orders of the Honourable Supreme Court of Pakistan in suo moto case No. 28 of 2018, duly communicated to the channel on various occasions," the notice said.

It directed the chief executive officer for ARY Communications Ltd to show cause in writing within seven days as to why legal action — including an imposition of fine, suspension and revocation of license under Section 29, 30 and other enabling provisions of Pemra Ordinance 2002 — should not be initiated.

It further directed the CEO to appear in person or through an authorised representative for a personal hearing on April 29 at 11:30am at Pemra's Islamabad headquarters along with the written reply.

"In case of non-compliance, ex-parte legal action shall be taken against the licensee in accordance with relevant provisions of Pemra Laws," the notice warned.

'Negative politics'
Meanwhile, PTI leader Fawad Chaudhry on Friday said the kind of pressure being faced by ARY chief Salman Iqbal was not "ordinary". "ARY team must have nerves of steal to ignore all pressures and stand up to the truth," he said.

Information Minister Marriyum Aurangzeb issued a statement rejecting the "misleading" claims made by ARY News although she did not name the channel she was speaking about.

She said the ambassador had presented his stance in the NSC meeting and the cable's content and context were reviewed. Aurangzeb said publishing such news after the ambassador's stance, intent and perspective were clarified amounted to "negative politics".

"Presenting lies as news is akin to running a knife on the throat of Pakistan's national interests," the information minister said.

The Foreign Office also issued a response regarding the incident. It said the ambassador briefed the NSC about the context and content of the cable and shared his professional assessment. "His briefing and assessment are accurately reflected in the statement issued at the conclusion of the NSC meeting today," the FO added.

Ever since his ouster through a no-confidence vote in the National Assembly, Imran has dismissed the Shehbaz government, terming it "imported".

The former PM said that the no-confidence move against him was part of a foreign conspiracy, claiming that the cable received from the ambassador on March 7, a day before the opposition officially filed the no-trust move against him, was evidence of the conspiracy.

Imran claimed that the cable showed Pakistan was threatened by a US diplomat who said the country would have to face consequences if he was not removed via the no-trust motion, which had not even been filed at the time.

“How could they know about the no-confidence motion even before it was filed?” Imran has asked charged supporters in several public rallies in the past few weeks, adding that local abettors colluded with their “foreign sponsors” to make the alleged conspiracy successful.

The issue was first raised by Imran at a public rally on March 27, four days before the first NSC meeting was held to review the contents of the cable.

Since then, Imran has referred to the cable in several public addresses when talking about an alleged plot to remove him from power.

In one of his addresses, Imran said the cable carried details of the ambassador’s meeting with US Assistant Secretary of State for South and Central Asia Affairs Donald Lu in which the latter allegedly threatened Pakistan.

Majeed, in the cable, reportedly said that Lu warned that Imran's continuation as the prime minister would have repercussions for bilateral relations. The US, Imran claimed, was annoyed with his "independent foreign policy" and visit to Moscow.

It was on the basis of this cable, which he saw as evidence of a conspiracy to oust Imran, that the National Assembly Deputy Speaker Qasim Suri gave a ruling to dismiss the no-trust move against the then premier on April 3, when voting on the resolution was set to take place, terming the motion contradictory to Article 5 of the Constitution, which mandates loyalty to the state for all citizens.

Suri's ruling was subsequently voided by the Supreme Court and voting on the no-trust resolution finally took place on April 10, as a result of which Imran was removed as prime minister.

PPP is only using PMLN against PTI. Had PPP chosen anyone from PPP to be pm, PTI would had had no issue. He made Shebaz pm on purpose because that trigger Imran's ego which forced him to resign from NA.

He played with PTI, and now he is playing with PMLN where they will get all the blame for bad economy. Had PMLN been smart, they would had not taken the premiership.

The difference between PTI and PMLN (PPP) is that PTI even when they had smaller numbers they would not sell their souls to work "under" their competitors. Even before 2008 IK was offered a significant ministry with 1 seat in Parliament yet he stood his moral ground (something PMLN (PPP) will never know anything about i.e. "morals").

On the flip side Bilawal is meekly taking orders from the man that has publicly ridiculed his mother and have publicly threatened his father with violence and the man who was the beneficiary from the hanging of this grand father. Talk about being spineless and morals and this action by Bilawal is utterly shameless even a villager who doesn't have food to feed his hunger will not sell his soul like that like how Bilawal has done.

Hours after the Federal Investigation Agency (FIA) challenged the Islamabad High Court’s order, declaring the Pakistan Electronic Crimes Act (PECA) Section 20 as unconstitutional, in the Supreme Court on Saturday, the coalition government announced withdrawing the petition.

“Please note that this petition stands withdrawn immediately, as it is squarely against the government’s stated policy and principle of standing for and ensuring freedom of expression. The prime minister has taken strict notice of the filing of this petition,” Information Minister Marriyum Aurangzeb said in a tweet.

She clarified that she and Prime Minister Shehbaz Sharif only came to know a short while ago that FIA had filed the petition in apex court. “Unfortunately, the news of this petition was a little late to reach us due to the fact that we were in Bisham during the day where there were no signals,” she maintained.

The FIA in its plea to the top court had contended that the IHC provided the Pakistan Federal Union of Journalists (PFUJ) relief “without legal justification”, claiming that the high court had misinterpreted Articles 19 and 19-A of the Constitution.

The petition filed in the apex court stated that the IHC’s decision resulted in the inactivity of Section 20 of PECA claiming that the decision will encourage violators to break the law, calling for the decision of the Islamabad High Court dated April 8, 2022 to be suspended.

The controversial act was passed by the ousted Pakistan Tehreek-e-Insaaf (PTI) government, and subsequently challenged by the Pakistan Broadcasters Association (PBA) as well as various journalist organisations.

Media organisations challenged the FIA’s ‘undue’ powers under Section 20 of the PECA ordinance, which made defamation a treasonable offense, in the IHC.

The high court on April 8, in a four-page order, declared Section 20 of the PECA law “null and void” and ordered an investigation into the abuse of power by the FIA under the PECA law.

The court further dismissed the cases registered under Section 20 of PECA.

PFUJ welcomes govt’s move

PFUJ welcomed the prime minister’s order for withdrawing FIA’s petition against IHC judgement on section 20 of PECA act 2016 soon after, saying, “We are urging for an urgent meeting of joint action committee for review of PECA act.”

For cordial media-government relations dialogue is the only solution for ensuring right of expression and press freedom, it said in a statement issued on its official Twitter handle.

Punjab’s controversial defamation bill signed into law​


Acting Governor Punjab Malik Muhammad Ahmad Khan has signed the Defamation Bill that was passed by the provincial assembly to curb the dissemination of misleading and factually incorrect news reports.

The defamation bill will come into force after being officially published in the government gazette.

The new law will apply to print, electronic, and social media. According to the bill, cases of defamation can be filed against the spread of false and inaccurate news stories.

The provisions of this Defamation Bill will also apply to the spread of fake news through platforms like YouTube and social media.

It provides for action against news stories that harm a person’s private life or public standing.

According to the bill, specialized tribunals will be established to hear defamation cases.

These tribunals will be required to decide on the cases within 6 months.

This bill provides for a compensation of up to 3 million rupees. Cases against individuals holding constitutional positions can be heard by a High Court bench.

After being passed by the Punjab Assembly, Punjab Governor Saleem Haider had expressed reservations about signing the bill.

Haider, who is from the PPP, had assured a group of journalists that he would not sign the bill into law without taking into account all the factors. However, the bill was signed by the acting governor who is from the PMLN.

 
Punjab defamation law challenged hours after its approval

The controversial legislation about defamation which imposes curbs on press freedom became a provincial law on Saturday after acting Governor Malik Ahmad Khan — a PML-N member — gave his assent to the bill in the absence of PPP-nominated Governor Sardar Saleem Haider, who had embarked on leave after assuring “consultations” on the Punjab Defamation Act 2024.

The law, which had already drawn much flak from journalists, civil society organisations, as well as the opposition, however, soon landed in the Lahore High Court (LHC) after a joint petition was filed by two journalists challenging its legality.

The petition asked the high court to strike down the defamation law, saying it violated the fundamental rights of citizens protected in the Constitution. Journalists Riaz Ahmad Raja and Jaffar Ahmad Yar, who moved the pela, said that in the presence of two legal instruments i.e. the Defamation Ordinance 2002 and the Punjab Defamation Act 2012, it would have been better to amend the existing laws rather than coming up with a whole new legislation.

It said the definition of ‘journalist’ and ‘newspaper’ provided in the impugned law was vague, irrational and ambiguous.

According to the petition, the law provides initiation of defamation claims without any proof, which is a clear violation of Article 10-A (fair trial) of the Constitution.

The petition argued that it was ridiculous and unconstitutional to allow a person to bring a claim of defamation without any proof.

It stated that the law provided two different procedures to hear claims against private individuals and public office holders, which raised questions on the fairness, impartiality, and equality clauses of the Constitution.

It further said that removing the impugned Act from the umbrella of the law of evidence enabled the special tribunal constituted under this law to hold “summary trials”, which would be a clear negation of the right to a fair trial.

According to the petition, a trial on the basis of affidavits filed by the litigant parties, as is the practice in family law cases, cannot be seen as a fair trial since the defamation law entails penal consequences. The petition asked the court to declare that the impugned law is against the fundamental rights enshrined in the Constitution.

PPP faces flak

After the bill was passed by the assembly last month amid much criticism, the governor — a PPP man — had hinted that he would send the bill back to the provincial assembly for further consultations due to the criticism it had garnered from the journalist community.

But Governor Sardar Saleem Haider left for Dubai paving the way for the acting governor Malik Ahmad Khan to sign the controversial bill into a piece of legislation.

The journalist community took exception to this and accused the PPP of being in cahoots with the PML-N government over this legislation.

A statement issued by the Lahore Press Club (LPC) said the PPP had expressed its reservations over the controversial bill, but the conduct of its governor suggested the party was “working hand in glove with the government”. LPC President Arshad Ansari said the governor went abroad without sending the bill back to the assembly, which “gives an impression” that PPP was “opposing the law just for point-scoring”. However, he added, the journalists had rejected the law earlier and would do so again.

A joint action committee of provincial and national journalist organisations, in a meeting at the press club, decided to boycott the coverage of the federal and provincial budget sessions to express their displeasure towards the law. Similarly, they would also stay away from official events of the Punjab government and its allies. The committee also decided to organise protest rallies and processions against the bill.

The participants of the meeting decided to pursue legal action against the controversial bill. It was unanimously agreed that besides the parties in the government coalition, other political parties, human rights organisations, and bar councils would be consulted to put up a joint front against the bill.

The committee resolved to approach the United Nations and international human rights organisations against the controversial law.

Meanwhile, the PPP tried to dissuade the impression of being a part of efforts to enact the legislation, with its leader Hassan Murtaza claiming that PML-N took advantage of the absence of the governor and signed the bill.

Mr Murtaza said the party would soon convene a meeting to take up the matter, adding the party was not in the loop with the government on the issue of the defamation law.

Gazette notification for Punjab Defamation Bill 2024 issued

On June 7, Acting Governor Malik Ahmed Khan sent the document to the Punjab Assembly after signing the bill, which was held by the PPP’s governor.

According to the notification, the Punjab Defamation Bill 2024 has been enforced across Punjab with immediate effect.

The law will address the pervasive issue of misinformation on social media platforms, including YouTube, TikTok, Twitter, Facebook, and Instagram. Under the bill, a defamation case can be filed on those spreading ‘fake news’.

Journalists’ reaction

The journalist community rejected the bill and termed it ‘non-democratic

During the press conference, Arshad Ansari, the president of the Lahore Press Club, stated that a protest was called in the Punjab Assembly on behalf of government members following a meeting of the Joint Action Committee regarding the Defamation Bill 2024.

He added that the committee had offered to delay the protest and requested the government members to postpone the bill for a week, but this request was not accepted.

HRCP’s reaction

Meanwhile, the Human Rights Commission of Pakistan (HRCP) has expressed grave concern over the defamation bill 2024, with its chairman saying the content and language of the bill is “troubling on several counts”.

“First, it proposes a parallel structure to adjudicate claims of defamation. HRCP has consistently decried special parallel judicial structures on the grounds that they invariably violate fundamental rights and other universally accepted norms governing the fair functioning of the judiciary,” the statement said.

 
The PPP is once again running with hares and hunting with the hounds. It is supporting this bill to protect the mafia while telling everyone it opposes it. These munafiqs tell us they are democratic but they have murdered more journalists than the Nooras and the Junta. Lets we forget the sacrifices of Jokhio and Memon and many others.
