Seems our friend has done a runner but question is, will he ever comeback to Pakistan?

Will the Govt do a special deal to bring him back, or mount a legal challenge in UK for an extradition or will he be left alone to share notes with a fellow non-returnee from MQM?

On the instructions of the courts

The government allowed Nawaz to travel to London on a surety bond of Rs7.5 million which Nawaz challenged in the court after which he was allowed to travel to the UK without submitting any surety.

I think MNS now wants to come back to keep his popularity intact for next elections. He wants his comeback ordered by courts so PTI can't take credit. It would have been win-win for MNS.

I think IK has informations about MNS using courts for a comeback and that's why this issue has been main focus of PTI statements in this week to create a narrative that it was PTI who brought MNS back. If MNS now stays in UK, he is destroying his next election. If he comes back, PTI can take credit. Loss-Loss situation for MNS.

It wasn't 7.5m it was 7.5b and even that was on the insistence of the court. Then the court also did away with the requirement for 7.5b.

He did not have mercy; he couldn’t withstand pressure from Nawaz. Also, Immy showed his incompetency by not verifying Nawaz’s medical reports as most likely, they were forged. All in all, Immy turned out to be a coward and an incompetent leader.

Good luck with that question? The badniyaati of these losers playing both sides of the game is galling. If IK had not given permission, we would had endless threads saying NS is desperately ill and IK is trying to kill him, and when IK gave him permission, IK is incompetent and scared.
 
The Islamabad High Court (IHC) said on Tuesday that it was giving former prime minister Nawaz Sharif a chance "to surrender" and appear before the court at the next hearing scheduled for September 10.

An IHC division bench comprising Justice Aamer Farooq and Justice Mohsin Akhtar Kayani was hearing the appeals of Nawaz Sharif, his daughter Maryam and her husband, Safdar, against their convictions in the Avenfield reference.

The bench also heard an appeal filed by the National Accountability Bureau (NAB) against Nawaz's acquittal in the Flagship reference as well as appeals against his conviction in the Al-Azizia reference.

During today's hearing, Justice Farooq said that the court was not declaring Nawaz an absconder and was giving him "one more chance to surrender". "We are not taking a final decision as yet."

However, Nawaz's counsel, Khawaja Haris Ahmed, argued that by asking Nawaz to appear in person, the court had decided that the former prime minister had to return to the country. Ahmed maintained Nawaz could not return to the country due to the coronavirus pandemic.

"Do you fear that Nawaz will be arrested at the airport?" asked Justice Kayani. "If that is the case, please inform the court." To this, the lawyer replied he would do so if they feared such an occurrence.

Nawaz's counsel argued that his client's bail had been approved after his sentence in the Avenfield reference was suspended, adding that Nawaz had also been granted conditional bail in the Al-Azizia reference.

But at the same time, the counsel acknowledged that the ex-PM was currently not abroad on bail.

"His current status is that he is not out on bail. This is the legal position," Ahmed said, adding that the PML-N supremo was seeking medical treatment abroad.

He added that Nawaz's medical reports were forwarded to the authorities concerned but the Punjab government had rejected an application seeking an extension in his bail. The court then questioned whether Nawaz had challenged the order issued by the Punjab government to which his lawyer replied in the negative.

"He has not [challenged the Punjab government order] because he [Nawaz] is not in the country."

The court inquired whether Nawaz was currently under treatment at a hospital. "No he is not under treatment at a hospital. But he will return to the country once his treatment is complete," his lawyer replied.

The bench asked Nawaz's lawyer to satisfy the court that the PML-N supremo had not absconded. "The appeal can only move forward when Nawaz appears before the court," said Justice Kayani.

His lawyer maintained that Nawaz's fresh medical reports had been received which would be provided once they had been verified by the Foreign Office, adding that he had submitted one medical certificate to the court and would submit another.

During the hearing, the court observed that absconding from a court hearing or during a trial was also a crime. "We are not declaring Nawaz an absconder at the moment. But how can the appeal be heard in his absence?" Justice Farooq questioned.

Justice Farooq asked what the status of the appeal would be if the court declared Nawaz an absconder. To this, Ahmed replied that if the former prime minister does not appear "on purpose", the court could declare him an absconder.

During the hearing, the NAB prosecutor said Nawaz was a fugitive as he was not appearing for court proceedings "on purpose".

"Can Nawaz pursue the appeal through a representative?" asked Justice Farooq. "If he absconds, the court can appoint a representative," the prosecutor replied.

The former prime minister, who was serving a seven-year jail term following his conviction in the Al-Azizia reference, was last year allowed to leave for London on bail for medical reasons after he was diagnosed with an immune system disorder.

Last month, Adviser to the Prime Minster on Accountability and Interior Shahzad Akbar said Nawaz's four-week bail on medical grounds expired in December last year and the government had already approached the UK government for his extradition.

The bench also expressed displeasure at the large crowd that had gathered outside the court premises, apparently in support of Maryam, the former PM's daughter, who also appeared in court today.

"If the coronavirus spreads, who will be held responsible? We have to take some precautions ourselves."

Earlier today, PML-N Vice President Maryam Nawaz and her husband, retired captain Mohammad Safdar, appeared before the court.

Maryam travelled to Islamabad from Murree and was welcomed by hundreds of party workers and supporters, who shouted slogans and showered her with rose petals, when she reached Bhara Kahu.

Several PML-N leaders also accompanied Maryam to the high court including party leaders Pervaiz Rashid and Shahid Khaqan Abbasi.

Speaking to the media before the hearing, Maryam said that only the All Parties Conference (APC) will reveal whether the PPP was with the PML-N or not, adding that the latter will "definitely" attend it.

"Opposition parties should work together to take action against the government," she said.

She also commented on Nawaz's health. "No one would want to stay away from the country at this age. [Nawaz's] treatment is ongoing but was delayed due to the coronavirus."

She added that she wanted her father to complete his medical treatment and not come back to Pakistan. "[But] knowing his condition, I can say with certainty he will not stay away from Pakistan."

A large number of police officials were deployed to ensure security at the high court. According to Islamabad police, 560 officials, three DSPs and nine inspectors were deputed.

Only lawyers and media representatives were allowed to enter the court premises.

References against the Sharifs

All three references — the Avenfield reference, the Flagship reference and the Al-Azizia reference — are offshoots of the Panama Papers leak case relating to 785,000 offshore companies. The PTI, Jamaat-i-Islami and Minister for Railways Sheikh Rashid Ahmed had brought the matter before the Supreme Court.

The apex court had disqualified Nawaz Sharif as prime minister and directed NAB to file three references against the Sharif family and one against then finance minister Ishaq Dar in the accountability court.

Accountability court judge Mohammad Bashir had on July 6, 2018 convicted Nawaz, Maryam and Capt Safdar in the Avenfield reference while they were in the United Kingdom taking care of ailing Kulsoom Nawaz, handing the former prime minister 10 years as jail time for owning assets beyond known income and one year for not cooperating with the bureau.

Maryam was given seven years for abetment after she was found "instrumental in concealment of the properties of her father" and one year for non-cooperation with the bureau.

Her husband was given one year jail time — for not cooperating with NAB, and aiding and abetting Nawaz and Maryam.

Following the conviction, the Sharif family members returned to Pakistan and were imprisoned. However, all three were released from Adiala jail in September after the IHC had suspended their respective prison sentences in the Avenfield corruption reference.

LAHORE: Former prime minister Nawaz Sharif is unlikely to return to Pakistan by Sept 10 to face cases against him as his surgery in London is said to be scheduled this month and the PML-N bigwigs and the Sharif family members have also requested him to extend his stay till completion of his treatment.

“Mr Sharif’s treatment in London is scheduled in a couple of weeks. How come he can return home leaving his treatment in the midway? Neither the Sharif family nor the party is ready to compromise on the health of Nawaz Sharif and they want him to return after completion of his treatment,” a source in the Sharif family told Dawn on Thursday.

He said the Sharif family had been in consultation with its legal team and weighing options like filing an appeal against the court’s decision (directing him to return by Sept 10) or submitting ‘fresh medical reports and upcoming treatment schedule’ on next hearing of the case (Sept 10).

The source further said the party stalwarts had also requested the party Quaid to ‘get well first’ before making up his mind to return home to face cases and take part in politics. “However, some emotional voices in the party want their leader to return and spearhead the campaign to send Imran Khan’s government packing.”

PML-N president and opposition leader in the National Assembly Shahbaz Sharif has also hinted at no ‘immediate plan to return.’

Option of filing appeal or submission of medical reports / treatment schedule under study

When asked whether Nawaz Sharif would return by Sept 10 to face courts, Shahbaz said: “We always respected courts and law. Nawaz Sharif will return to the country if doctors (in London) allow him. Nawaz Sharif’s health matter is serious and once he gets well he will appear before courts here.”

Talking to reporters here on his return from Karachi, Shahbaz Sharif said his elder brother (Nawaz) and he underwent imprisonment. “My niece Maryam Maryam was arrested and sent to jail and my son Hamza is still in jail. We respect courts and continue doing so,” he said.

The Islamabad High Court (IHC) had, on Tuesday last, directed the three-time premier to appear before the court and surrender to the authorities by Sept 10 or face legal proceedings for absconsion. A division bench of the high court comprising Justice Mohsin Akhtar Kayani and Justice Aamer Farooq also directed the deputy attorney general to verify the medical condition of Mr Sharif through the Pakistani High Commission in London.

The last ‘fresh’ medical report of Nawaz Sharif was submitted to the Lahore High Court over a month ago.

Signed by Dr David Lawrence, a London-based consultant cardiothoracic surgeon, the report states the medical investigations and opinions are indicative of significantly reduced blood supply to Nawaz’s heart and its impaired functionality. “He must undergo coronary catheterisation as a significant part of his heart is at risk. The treatment of Mr Sharif has been carried out conservatively as is merited by the prognosis of various diseases he suffers from.”

The report further says a multidisciplinary approach was warranted for his safety while undergoing an invasive procedure due to underlying ITP (unstable platelet counts) and co-morbidities (hypertension, diabetes & kidney disease) which carry a significant risk of bleeding and possibility of a procedural or peri-procedural adverse cardiac event.

It explains Nawaz Sharif will be scheduled for an invasive cardiac procedure once the hospital starts planning elective procedures amidst Covid-19 pandemic and given that he, being in the high-risk category, is stable enough to go through the intervention.

Nawaz Sharif had left for London in November 2019 after the LHC granted him a four-week permission to go abroad for his treatment. He had submitted an undertaking to the court citing his record of facing the law and justice that he would return within four weeks or as soon as he was declared healthy and fit to travel by doctors.

He was also given bail in the Al-Azizia Mills corruption case in which he was serving a seven-year prison sentence in Kot Lakhpat Jail, Lahore, before he was left for London.

Not sure in which world are you living these days but in normal world any person (let alone 3 times PM) who lies about his health to escape punishment is considered shameless NOT the person who allows him to travel despite reservations.
 
The PML-N leadership on Saturday urged party supremo and former prime minister Nawaz Sharif to remain in the United Kingdom until his medical treatment is completed and his doctors grant him a "certificate of fitness", allowing him to return to Pakistan.

Addressing a press conference alongside other PML-N leaders, Ahsan Iqbal said that Nawaz was "not only an asset for his party but for the nation as well", therefore there could be "no compromise" when it came to his life and health.

The PML-N's presser came a few days after the Islamabad High Court (IHC) told Nawaz that it was giving him a chance to "surrender" and appear before the court at the next hearing scheduled for September 10.

"The delay in health services and treatment affected not only Nawaz Sharif but all other patients [as well]. We hope the judiciary will take this into consideration."

Iqbal added that Nawaz had "set an example not seen previously in Pakistan's history" by leaving his ailing wife Kulsoom Nawaz and returning to Pakistan in 2018 to "follow the law".

"This is why any discussion on [Nawaz's health] is dismissive of his example and an insult to humanity," he said.

Criticising PTI government members for "conjecturing" about Nawaz's health, he said they had done the same when Kulsoom was ill. "They used to make irresponsible statements regarding Kulsoom Nawaz's health and were not even ashamed later".

"This is a very serious matter and cannot be decided on talk shows. Nawaz Sharif is our asset and the nation's asset and no compromise on his health and life can be made," Iqbal added.

"He was granted permission to leave for treatment. He did not go for an excursion which is why he will return when his doctors decide he is healthy and fit to return. Our legal team will proceed according to the law," he said.

"[PML-N workers] request him to complete his treatment [...] When his doctors tell him he is fit to go, he will come back without any delay."

Responding to a question about the multiparty conference (MPC) due to be held by the opposition, Iqbal said that the meeting of the Rehbar Committee had decided it would be held on September 20.

"The MPC session will be called during a session of the National Assembly and further discussion [on all parties' agenda] will be held then," he added.

ISLAMABAD: Prime Minister Imran Khan on Tuesday tasked relevant authorities with bringing back Pakistan Muslim League-Nawaz (PML-N) supreme leader Nawaz Sharif from London, where he has been staying since November 2019 on medical grounds, at the earliest.

The decision was taken at a cabinet meeting where the prime minister also issued the directive to relevant authorities to pursue the matter vigorously, just a day before the Islamabad High Court (IHC) is expected to ask the government about measures it had taken to bring Nawaz Sharif back, a cabinet member told Dawn.

He said the government had already sent a request to the British government for the PML-N leader’s repatriation but it would now send a fresh application.

He said besides a normal application, a formal request for his extradition would also be made. “Although we have no extradition treaty with the United Kingdom, wanted people can be repatriated under special arrangements as we had also handed over some people to the UK,” the cabinet member said.

On Sept 15, the IHC had ordered that Nawaz Sharif be arrested and presented before the court.

In response to the court ruling, the PML-N had announced that it honoured the court decisions, but the supreme leader of the party would return once his health permitted him.

The IHC will resume proceedings from Wednesday to examine issuance of proclamation of Nawaz Sharif as the court is expected to ask about measures taken to bring him back.

On Nov 8, Nawaz Sharif, who was convicted in a corruption case, was allowed to travel abroad for his treatment while his daughter Maryam Nawaz had to stay behind “till further orders”.

While Prime Minister Imran Khan stuck to his stance for many months that no National Reconciliation Ordinance-like relief would be given to ex-PM Sharif, the former gave a go-ahead to his travel, raising many eyebrows.

Committee formed to deal with opposition

The prime minister also formed a committee of some cabinet members to deal with the opposition, which had announced a protest campaign against the government.

The cabinet meeting gave approval to a visa policy for Afghanistan following the visit of High Council for National Reconciliation Chairman Dr Abdullah Abdullah to Pakistan.

Besides, it permitted a one-time pre-shipment inspection of ships coming to Pakistan with stocks of wheat imported by the Trading Corporation of Pakistan.

Under a recent agreement between the UK and Pakistan on airline operations, the cabinet permitted Virgin Atlantic to operate between the two countries.

An inquiry report was presented before the cabinet regarding irregularities in the installation of telemetry system for ‘fair’ distribution of water under the Indus River System Authority (Irsa).

The meeting consented to the removal of Irsa members, as those from Khyber Pakhtunkhwa, Sindh and Balochistan had completed their term, while Punjab was asked to reassess the capability of its member.

The cabinet also gave a go-ahead to audit of Irsa affairs and allowed amendments to be made to its laws.

Under the Pakistan Medical Commission Act 2020, recently passed by the parliament in a joint sitting, the cabinet approved the appointment of Dr Arshad Taqi and Ali Raza as president and vice president of the Medical and Dental Council, respectively.

Appointment of Syed Hussain Abdi as chairman of the Pakistan Council of Scientific and Industrial Research, Islamabad, was also approved.

Former prime minister Nawaz Sharif's exit from Pakistan is a "mockery of the system", said the Islamabad High Court (IHC) bench on Wednesday.

The court passed the remarks after Additional Attorney General Tariq Khokhar presented a compliance report on Nawaz Sharif's arrest warrants issued by the high court.

The report was submitted to the two-member bench, comprising Justice Mohsin Akhtar Kayani and Justice Aamer Farooq, hearing the petition filed by the former prime minister against his sentence in the Avenfield apartments.

Khokhar, while briefing the court on the attempts made to arrest Nawaz Sharif, said that Rao Abdul Hanan, an officer of the Pakistani High Commission, had visited the residence of the PML-N chief in London. He added that Eddie, the person at the apartment, "refused" to receive the arrest warrant.

“Every effort was made to enforce Nawaz Sharif's arrest warrant,” the government's lawyer told the court. He also read Hanan's statements regarding the arrest warrant.

After Khokhar’s explanation, Additional Prosecutor General of the National Accountability Bureau (NAB) Jahanzaib Bharwana informed the court that they were aware of the attempts made to arrest Nawaz Sharif.

Khokhar then told the court that the Pakistani mission in London also contacted the commonwealth office, via telephone, over the warrant. He added that the commonwealth office informed them that it was not in their jurisdiction to implement the IHC's order.

'Nawaz Sharif must be sitting there laughing at Pakistan's system'

“This means that they [commonwealth office] are not ready to assist us,” observed the court. It added that the court has to be satisfied with evidence that it did its best to comply with the warrants.

“The purpose of all this exercise is so that when the accused comes tomorrow he does not say that he did not know [about the warrants],” remarked Justice Kayani. He then added that the accused knew that he had defeated the system to leave the country.

“He [Nawaz Sharif] must be sitting there laughing at Pakistan's system. It's a shame,” observed Justice Kayani. He added that the court will issue a verdict on the matter.

The court also observed that the federal government should also take care “from now on” who it can allow to leave the country. It also remarked that the time spent on delivering an arrest warrant to an accused could have been spent on providing relief to other litigants.

“The court, the government, the Foreign Office and the high commission are jointly executing a single warrant,” observed the court.

The hearing of the case was adjourned till October 7 as the IHC ordered that the statement of the high commission’s counsellor, Rao Abdul Hanan, will be recorded in the next proceedings via a video link.

IHC issues non-bailable arrest warrants for Nawaz Sharif

Earlier this month, the IHC had issued non-bailable arrest warrants for Nawaz Sharif during a hearing over the former prime minister's petition requesting exemption from appearing before the court.

In the brief ruling, IHC's Justice Mohsin Akhtar Kayani remarked that the PML-N supremo neither underwent a surgery despite citing it as a reason behind obtaining bail to travel to the United Kingdom nor was he admitted to a hospital.

"Our bail order has expired, which has its own effects," the judge said during a hearing at the IHC over a petition to cancel Nawaz's bail in the Avenfield properties reference.
 
Excuse me, didn't these courts allow him to leave the country? How can they blame the federal govt now? The courts had also said that if anything happens to his royal highness, the govt would be to blame.

ISLAMABAD: Prime Minister Imran Khan on Friday asked Pakistan Tehreek-i-Insaf (PTI) leaders to foil all moves of the opposition aimed at destabilising the government and maligning the army, and devise a legal strategy to bring back Pakistan Muslim League-Nawaz (PML-N) supreme leader Nawaz Sharif from the United Kingdom.

He issued the directives while presiding over the first meeting of a committee recently formed to counter the narrative of the opposition. The committee comprises federal ministers Shah Mehmood Qureshi, Asad Umar, Fawad Chaudhry, Shafqat Mahmood and Pervez Khattak.

A source privy to the meeting told Dawn that the prime minister was committed to bringing back Nawaz Sharif from London and directed the committee members to devise a legal strategy because in the absence of an extradition treaty between Pakistan and the UK, it would become difficult to get the PML-N leader extradited.

A couple of days ago, Adviser to the Prime Minister on Interior and Accountability Shahzad Akbar had told Dawn that he had written fresh letters to the British authorities for Mr Sharif’s repatriation, adding that a formal application had also been sent for his extradition. The adviser was of the view that though both countries had no extradition treaty, wanted people could be handed over to each other under special arrangements.

The source said the committee would meet on a daily basis and make day-to-day plans on how to counter the opposition’s moves in parliament, media and on political forums.

The meeting also decided to contact the five ‘rebel’ PML-N members of the Punjab Assembly who had recently met Chief Minister Usman Buzdar without informing the party leadership.

Prime Minister Khan vowed to defeat the opposition’s designs and defend state institutions, including the army. “Enemies of the army are in fact enemies of Pakistan,” the prime minister was quoted as saying.

He said he did not fear the opposition’s campaign against the government, once again ruling out any National Reconciliation Ordinance-like concession. He said it was his mission to expose corrupt politicians. “The opposition leaders have a problem with the army, and that is why their corruption is being traced.”

Mr Khan said Nawaz Sharif and India wanted to weaken the country. “Nawaz Sharif wants to bring people on to the streets while he and his children are sitting in London,” he said, adding that the former prime minister wanted institutions to protect his interests.

Responding to Mr Sharif’s claim that he had been asked by former Inter-Services Intelligence director general Lt Gen Zaheerul Islam to resign, the prime minister wondered: “Why did he [Nawaz Sharif] not take a firm stand then and why did he not speak on that occasion?”

Prime Minister Khan held separate meetings with Chief Ministers Usman Buzdar of Punjab and Jam Kamal Khan Alyani of Balochistan and discussed with them problems facing their provinces as well as development-oriented initiatives.

In another meeting, the prime minister reviewed progress on the Ravi Riverfront Urban Development Project. It was attended by CM Buzdar, Naya Pakistan Housing and Development Authority chairman retired Lt Gen Anwar Ali Haider, Chief Secretary Jawad Rafique, Federal Board of Revenue chairman Javed Ghani, the Ravi Urban Development Authority chairman and investors from the construction sector.

Prime Minister Khan said the Ravi riverfront project was aimed at uplifting Lahore city and also meeting its water needs. He said the project would create job opportunities and stir economic activity.

The Punjab chief minister informed the prime minister that the project was being monitored at the highest level and targets had been set for its implementation. He assured the premier that every effort would be made to ensure its timely completion.

Later, a delegation of overseas Pakistanis called on the prime minister and presented him a cheque for Rs10 million for Diamer-Bhasha dam. The delegation comprised Afzal Mehmood, Sheikh Rafiq, Maroof Hussain and Majid Khan.

Meeting on petroleum

Prime Minister Khan was given a briefing on the exploration and production management system. He was told that the system would make gas and petroleum products available at affordable rates and ensure data was collected from all public and private petroleum firms about their stock.

The government is hopeful Nawaz Sharif will be back in Pakistan soon to answer for the corruption charges against him, with one minister going so far as to say he will be back "by January 15".
Adviser to the Prime Minister on Interior and Accountability Shahzad Akbar on Wednesday said that the government is working with British authorities to finalise the modalities for Nawaz's return, while Minister for Science and Technology Fawad Chaudhry expressed the hope that the return will take place by January 15.

Speaking to a television news channel, Chaudhry said decision makers in UK are holding discussions in this regard and an announcement is likely soon as "the British government is loosing its image by giving shelter to looters and plunders".

Meanwhile, Akbar, speaking to Hamid Mir on Geo News programme "Capital Talk" and referring to the date provided by Chaudhry said: "It will be my aim to bring him back even sooner."

He said that it is up to the UK government but quipped: "There is a flight of deportees coming back soon and we would want to save money and have him come on the same flight."

The premier's adviser said that the government has written to UK home secretary Priti Patel, as has also been reported by Financial Times, and she has been informed Britain is "duty bound" to deport Nawaz who has been in London for nearly a year since he was allowed to seek medical treatment there in November 2019.

Nawaz Sharif “has been responsible for pillaging the state and I trust that you will be supportive of our efforts to bring those responsible for corruption to account”, Akbar wrote to Patel on October 5.

The letter urges Patel to use her “extensive powers” to deport Nawaz, arguing she is “duty bound” to do so. It cites immigration rules that criminals sentenced to four years or more must be refused leave to remain in the UK.

Akbar said what sets Nawaz's case apart from MQM founder Altaf Hussain — in London and wanted in cases of murder, targeted killings, treason, inciting violence and hate speeches — is that Hussain has been sentenced to death and UK law prohibits the extradition of such individuals.

Speaking of the case of former finance minister Ishaq Dar — also in London and who has been declared an absconder by an accountability court on corruption charges — he said: "Ishaq Dar is not a convict, he is undergoing sentence [...] we have a [Memorandum of Understanding] with the UK authorities and they will implement the decision through the court."

He said in Nawaz's case, deportation is sought, not extradition because Nawaz has already been convicted and he violated an agreement with the government.

Akbar said the other two individuals have reportedly sought asylum, so that makes the matter different on an additional count.

Earlier in the day, during a press conference in Islamabad, Minister for Information and Broadcasting Senator Shibli Faraz said the government was employing optimum diplomatic channels to ensure Nawaz's early return from London.

He said since there was no extradition treaty with the UK, the government had formally requested the UK authorities through the Pakistani ambassador in London to initiate the repatriation process of Nawaz Sharif, who has been declared an absconder by the court.

The minister said the past rulers had deliberately refrained from signing an extradition treaty with certain countries, including the UK, keeping in mind the option to escape in future to those states where they had stashed looted national wealth and built palatial houses.

ISLAMABAD: The federal government has requested the UK government for a third time to send back former premier and supreme leader of the Pakistan Muslim League-N (PML-N) Nawaz Sharif to serve out his sentence in a Pakistani prison, with the letter this time handed over personally to the British High Commissioner in Islamabad, according to sources.

The letter was handed over to the British diplomat some three weeks after Mr Sharif made a fiery speech at the opposition’s multiparty conference (MPC) through video link from London in which he criticised the military establishment over its alleged role in politics.

Through the letter, the Pakistan government has asked the British authorities to consider cancelling Mr Sharif’s visit visa, which has allowed him to live in London on medical grounds since November.

The letter has cited Britain’s own immigration laws of 1974 under which any person sentenced to imprisonment of more than four years had to be deported to the country of his/her origin.

When contacted, Adviser to the Prime Minister on Accountability and Interior Shahzad Akbar confirmed that the government had made three requests to the UK authorities to deport Mr Sharif, with the last request made on Oct 5.

The previous letter, he said, had been dispatched after the cancellation of Mr Sharif’s bail by the Islamabad High Court (IHC) last month.

Mr Akbar said in the latest letter his government had pointed to a possible way out of the issue of “specific deportation” of the former premier. “The ball is now in the court of British government,” he said.

The IHC had on Sept 15 issued non-bailable arrest warrants for Mr Sharif in the Al Azizia reference while hearing three applications filed by him, including the ones about forgoing the requirement of his surrender before the court and exemption from personal appearance.

The former prime minister had left for the UK after the Lahore High Court granted him permission to go abroad for medical treatment. He had submitted an undertaking to the court that he would return within four weeks or as soon as he was declared healthy and fit to travel by doctors.

Mr Sharif criticised the military establishment not just at the MPC but also recently at the Gujranwala rally of the opposition Pakistan Democratic Movement.

A day after that PML-N rally in Gujranwala, Prime Minister Imran Khan addressed a convention of his Tiger Force and declared he would get “even more tough” with the opposition and vowed to make all-out efforts to bring Mr Sharif back and send him behind bars.

“Now I will try my best to bring you back and put you in a common prison, not a VIP one,” he said.

Earlier, the APP news agency reported that British newspaper the Financial Times had partially revealed the content of the letter sent by Mr Akbar to Priti Patel, the UK home secretary.

The letter said Ms Patel “is duty-bound” to deport Mr Sharif, to serve his jail sentence for corruption.

In the letter Mr Akbar wrote that the former prime minister was responsible for pillaging the state. “I trust that you will be supportive of our efforts to bring those responsible for corruption to account.”

The letter to Ms Patel urged the British secretary to use her “extensive powers” to deport Mr Sharif, added the newspaper.

The Foreign, Commonwealth and Development Office’s Pakistan and Afghan Department said this in response to a letter sent to Prime Minister Boris Johnson by Labour MP Stephen Timms, on behalf of a Pakistani constituent.

“We are aware that Mr Sharif is in the UK. The UK law sets out clearly and publicly what the Government can and cannot do on immigration matters, we act strictly in accordance with the rules in all sides," said the FCO’s Pakistan section, in a letter.

“Mr Sharif’s status under Pakistani laws is a matter for the Pakistan government and legal system. As such, the non-bailable arrest warrants which have been served by the Pakistan High Commission in London have no legal bearing on his current status in the UK. The UK police cannot arrest someone in the UK on the basis of non-UK court orders,” said the letter.

The FCO clarified to the MP that both the countries do not currently have an extradition agreement but did acknowledge that such actions have been taken in the past.

"If any extradition request were to be submitted through the proper channels it would be considered in line with the UK laws,” said the FCO.

On the other hand, a source at UK PM Boris Johnson’s Office said that it received a letter from Mr Stephen Timms MP and forwarded it to the FCO to address the issue.

The source said that the PM was unable to act in this matter and had no authority and the FCO was the right forum to deal with such matters.

Responding to a question, Stephen Timms MP said: “I wrote to the Prime Minister about this, on behalf of a constituent, to ask what the Government’s approach was.”

Stephen Timms had written to 10 Downing Street on 6 December 2020 asking PM Boris Johnson if any arrangements were made to send back Nawaz Sharif, ex-premier of Pakistan, on behalf of British Pakistani Khalid Lodhi.

The British MP in his letter had said that the UK was bound to send back the ex-prime minister of Pakistan.

Khalid Lodhi told this reporter that he had also written a letter to British Home Minister Priti Patel informing that Mr Sharif has been “convicted in Pakistan”, had “absconded” and should be sent back “immediately”.

The letter said that Nawaz Sharif came to London for his medical treatment and has now stayed in the UK for more than a year and the UK government should send him back to Pakistan.

The Islamabad High Court declared on December 02 former prime minister Nawaz Sharif a proclaimed offender in the Avenfield and Al-Azizia references.

Prime Minister Imran Khan on Thursday urged countries he termed "havens" to provide a commitment to "immediately and unconditionally return all foreign assets that are shown to be stolen or whose legitimacy cannot be explained".

He also called for the development of international anti-money laundering legal instruments.

Addressing the virtually held launching ceremony of the Final Report of the High-Level Panel on International Financial Accountability, Transparency and Integrity for Achieving the 2030 Development Agenda, as a keynote speaker, the prime minister said that when his government came into power the country's coffers were empty due to "illicit financial outflows from our country".

He said the FACTI Panel's interim report had confirmed that trillions of dollars flow out of developing countries each year.

"Seven trillion dollars in stolen assets are parked in the financial haven countries," said the premier.

He said that the flight of this vast capital from these developing countries is the "principle cause" for the under development, poverty, inequality and political instability.

The premier reminded the panel his suggestions for several policy actions at the time the interim report was released and proceeded to recount them.

The suggestions include immediate return of stolen assets, penalties on the financial institutions, lawyers and accountants, and other "enablers" of corruption, crime and tax evasion, disclosure of the "beneficial ownership" of companies, review and revision of unequal investment treaties and a coherent mechanism for monitoring illicit financial flows set up under the United Nations.

"I am glad these proposals have been reflected in the final report of the panel," he said.

The prime minister said that as the report states, the problem is a systemic one, that is embedded in the international financial architecture.

"It requires a systemic solution. It cannot be resolved by piece-meal, or cosmetic actions. The magnitude of the illicit financial flows is staggering. If recovered and returned, they can have a transformational impact of the development prospects of developing countries," he said.

He said recovery of stolen assets will enable the developing countries to "eradicate poverty, reduce inequalities, build back better after the COVID crisis, address climate change and strengthen human rights".

PM Imran Khan said he endorses the three-point plan prepared by the panel:

1. Apply international values of honesty and integrity to all financial actions.

2. Strengthen policy frameworks.

3. Reform and reinforce the relevant institutions dealing with these illicit financial flows.

He called for national and cross-border financial transactions to be regulated under a "values-based system, encompassing accountability, transparency, legitimacy, fairness, inclusion and equity".

The premier said these values must be reflected clearly in all national and international financial transactions, instruments and institutions — particularly in bodies that combat illicit financial flows.

"All such activities should conform to rules and standards that are compatible with and contribute to sustainable development," he stressed.

PM Imran Khan said global financial governance must improve and policies on illicit flows must be implemented in a coordinated and coherent way by national and international institutions and bodies.

He said international bodies dealing with tax matters, corruption and illicit financing "should not be used as instruments of pressure and coercion against developing countries".

The prime minister also highlighted the need for a global forum under the United Nations which coordinates all bodies dealing with tactical, legal and political aspects of illegal financial flows.

"It should incorporate a mechanism to adjudicate and mediate disputes related to illicit financial flows," he said.

Addressing leadership from other countries, he said that it is now time to act on the FACTI panel's recommendations. "Pakistan will be happy to join in proposing the adoption of the FACTI panel report by the United Nations Economic and Social Council and the General Assembly," he said.

The prime minister then urged for some immediate "concrete actions".

"First, a commitment by haven countries to immediately and unconditionally return all foreign assets that are shown to be stolen or whose legitimacy cannot be explained," he said.

He said the Organisation for Economic Co-operation and Development's proposal to "freeze and return the unexplained assets of foreign politically exposed persons" is also worthy of consideration.

"Secondly, the UN should initiate [...] negotiations on the new international tax cooperation and anti-money laundering legal instruments like the convention on corruption, adopt common principles identified by the FACTI panel that would apply to all financial transactions, and establish a UN coordination, adjudication, and mediation mechanism on illicit financial flaws," he said.

PM Imran Khan said Pakistan would work with like-minded countries to realise these vital objectives.

The event was also addressed by 75th President of the General Assembly Volkan Bozkir and 76th President of the Economic and Social Council Munir Akram.

The report presents 14 recommendations to reform, redesign and revitalize the global architecture, so it can effectively foster financial integrity for sustainable development.

The Ministry of Interior on Wednesday recommended the Foreign Office to not renew the passport of Pakistan Muslim League-Nawaz (PML-N) supreme leader Nawaz Sharif, saying that the former prime minister had failed to satisfy the government on why his passport should be renewed and therefore he cannot be given ‘further relief’ until he appears in court.

Sharif, serving a seven-year prison term after his conviction in December 2018, was given a rare permission in October 2019 to get medical treatment abroad in view of a debilitating health condition.

The Islamabad High Court (IHC), however, declared him a proclaimed offender on December 2 as the former premier failed to appear before the bench – originally formed to hear his appeals against his convictions – despite various notices.

According to a report published in London-based Financial Times newspaper in October last year, Pakistan also asked the British government to repatriate Nawaz Sharif through a letter that Adviser to the PM on Accountability Mirza Shehzad Akbar wrote to British Home Secretary Priti Patel. The Ministry of Foreign Affairs had sent a request to the Pakistan High Commission in the UK to renew the passport of the three-time premier which was later sent to the interior ministry for further processing.

The interior ministry, while rejecting the request, said that both IHC and National Accountability Bureau (NAB) have declared Nawaz Sharif a proclaimed offender and therefore he cannot be given further relief until he appears in court.

The letter stated that the former premier was granted bail for eight weeks and it was not extended by the Punjab government. "Nawaz Sharif has to spend the rest of his sentence in Kot Lakhpat Jail. He fled the country to escape his punishment," it added.

The letter to the Foreign Secretary further stated that there were three cases pending against Nawaz Sharif in the IHC and one reference in the NAB.

"Nawaz Sharif could not satisfy why his passport should be renewed further. If he wants to return, he can apply for an emergency travel document (ETD). Pakistan High Commission should respond to Nawaz's request in writing that his passport cannot be renewed," the letter further stated.

Some experts believe it will be Nawaz Sharif who will benefit from a decision of not renewing his passport. They said if Nawaz’s passport is not renewed, the British government may give an extension in his visa. They said the UK government has done the same in the case of PML-N leader Ishaq Dar.

When the Pakistan government refused to issue him a new passport after the expiry of the previous one, the UK government gave Dar permission to stay in Britain, they said, adding that Nawaz Sharif is not on the negative list of any security agency and there is no adverse report against him either.

An accountability court in Lahore on Friday gave the nod to the National Accountability Bureau (NAB) to auction former prime minister Nawaz Sharif's properties in the Toshakhana reference.

Giving out the verdict, the court told chairman of Securities and Exchange Commission of Pakistan (SECP) to sell Nawaz' shares.

According to the court, authorities may proceed with any auction that they do not receive an objection against.

The court also directed the deputy commissioners of Lahore and Sheikhupura to auction the former premier's properties within 60 days and submit a report in this regard. The amount from the auctions shall be submitted to the national exchequer, the court said and added that Nawaz' vehicles be forfeited with the assistance of police and also auctioned within 30 days.

The accountability court also directed to transfer the amount in the bank accounts of the Pakistan Muslim League-Nawaz (PML-N) supremo to the exchequer.

The court had earlier declared Nawaz an absconder, and issued the verdict as NAB conveyed that the former premier had not been appearing in the hearing. On April 19, the country’s top graft buster started the process of auctioning all the properties of former prime minister Nawaz Sharif and his dependents and has requested an accountability court to issue directions to the concerned authorities in this regard.

The PML-N supreme leader has been in London since November 2019 when the PTI government gave him a rare permission to fly abroad to get medical treatment for a debilitating health condition.

The Islamabad High Court (IHC) on December 2, 2020 also declared Nawaz Sharif a proclaimed offender after he ignored all summonses and proclamations of the bench that was originally formed to hear appeals against his conviction in two graft cases.

PML-N leader Shehbaz Sharif on Twitter wrote: “Strongly condemn [the] cowardly attempt to barge into the office of Hussain Nawaz where Mian Nawaz Sharif was also present. They seemed to be armed and clearly had a sinister design but thankfully, could not succeed. London police must investigate the incident from all angles.”

A source in the party told Dawn the incident occurred on Thursday, after which the family informed the police. According to the source, four men, three of whom were wearing hoodies and masks, attempted to enter the Sharif family office on the pretext that they had an appointment with Mr Sharif. When the staff told them there was no such appointment, the men “became aggressive and forcibly attempted to enter”.

The men left in a car after Mr Sharif’s security detail and workers of the party who were present at the office premises on Stanhope Place approached.

“They were not Pakistani, it appeared as if they had been paid by someone to harass Nawaz Sharif,” the source added.

Condemning the incident, Maryam Nawaz on Twitter said the episode was akin to “criminality” and will “not silence Nawaz Sharif”.

In September last year, after Mr Sharif made a fiery speech against the security establishment’s alleged interference in governance, protesters had gathered outside his family’s residential apartments in Avenfield House and hurled abuses.
