Army chief Gen Qamar Javed Bajwa gets six months conditional extension by Supreme Court

In normal situation i will oppose this decision but in current security situation it was necessary and he is a pro democracy General so i will say a good decision.

Good decision. We're in a unique situation and unique circumstances, important to have your best people in the most responsible roles.
 
Do not agree with this decision, but I get why it has been taken. Army is probably one of the few proper institutions in the country and a continued change over of command lets the merit to come forward.

It was very surprising he didn’t take or ask for another term, with his resume and Other Shariff at that time, it would had been easy for him to even taken over.

I think he wanted to take extension but NS did not gave him. NS always wanted a subservient army chief but fortunately for us, it never worked for him, Musharraf, Raheel and Bajwa were his selections and all of them showed him his place.

It has to do with America wanting to leave Afghanistan and obviously the Kashmir issue.

SC suspends army chief’s extension notification, issues notice to all parties

The Supreme Court (SC) suspended on Tuesday notification of Chief of Army Staff (COAS) General Qamar Javed Bajwa's tenure extension.

During the hearing taken up by Chief Justice of Pakistan (CJP) Asif Saeed Khosa, the three-member bench suspended the notification and has issued notices to all parties, including the COAS. The CJP said only the president of Pakistan can extend the tenure of the army chief. The attorney general (AG) told the SC that the army chief's tenure was extended after the president's approval.

The CJP said out of 25 cabinet members, only 11 had approved the extension."Fourteen members of the cabinet did not give any opinion due to their absence," the chief justice said.

A petition was filed against the extension in the army chief's tenure by Jurist Foundation appealing the court to declare the extension null and void. However, the CJP rejected the application and took suo motu notice, local media reported.

The bench has adjourned the hearing till tomorrow (Wednesday).

Prime Minister (PM) Imran Khan had approved three-year extension in the tenure of General Bajwa in August. The army chief was set to retire on November 29.

“General Qamar Javed Bajwa is appointed Chief of Army Staff for another term of three years from the date of completion of current tenure," a notification issued from the PM's Office had said.

According to the constitution, the president is superior to the COAS. However, in practical terms, the president is a mere puppet.

Arif Alvi will do his duty to King Bajwa if he wants to keep his ceremonial post.

If only the courts showed the same urgency on issues like Model Town where atrocities were committed against unarmed civilians by the state , or other cases such as the corruption allegations on various former PMs/Presidents/Leader of the Opposition of both PML and PPP, surely those are all more in the interests of the country ?

So for some people this decision is brilliant and all of a sudden the same judiciary is upstanding and righteous but when the same judges declared Nawaz Sharif as a looter and plunderer then the judiciary was being forced by establishment.


Some people have zero morals and can take U-turn after U-turn.

Sign of democracy in Pakistan is getting healthier, It isn't perfect, it will never be perfect in Pakistan but to see every institution is trying their best.

As I have said it before, it is a slow process.

I believe government made a correct decision by not appealing against LHC decision, keeping NS in Pakistan would have served no purpose.

Federal Law Minister Farogh Naseem has resigned from his position, Railways Minister Sheikh Rasheed confirmed in a news conference on Tuesday.

He said Prime Minister Imran Khan has accepted Naseem's resignation which was tendered during a meeting of the federal cabinet today.

According to Rasheed, Naseem has resigned because he will represent the government in a case regarding Army Chief Gen Qamar Javed Bajwa's tenure extension in the Supreme Court tomorrow. He will be accompanied at the court by the attorney general of Pakistan.

Naseem belongs to the Muttahida Qaumi Movement (MQM), a coalition partner of the ruling PTI.

Special Assistant to the Prime Minister on Accountability Shahzad Akbar said Naseem has "voluntarily" resigned from his office because he could not represent the government in the case being a federal minister. He will now join the attorney general to clarify the government stance on the issue of Gen Bajwa's tenure extension.

Once the assistance is completed, Naseem can also return to the cabinet subject to the prime minister's approval, Akbar said.

The announcement comes hours after Chief Justice of Pakistan Asif Saeed Khosa suspended the government's notification of the army chief's tenure extension until the top court's hearing tomorrow.

The chief justice observed that "the summary and approval of army chief's extension is not correct."

The court issued notices to the defence ministry, federal government and Gen Bajwa, who is due to retire on November 29 (Friday).

On August 19, Prime Minister Imran had approved an extension in the tenure of Gen Bajwa for another three years.

I can't claim to know details of what the Pakistani SC does. I was only referring to the bold part of what Mamoon posted.

Rest is all topi drama - even this case won't matter much - its all a kabuki theatre, jostling back and forth for bit of power. Just like that Maulana March. Ultimately there is only one power that calls the shots in Pakistan. Everybody knows who that is.

And until that changes, nothing will change. "Tabdeeli" is decades away.

India illegally violated Pakistani territory on false narrative. Pakistan return the soldier immediately, which was used by Indian government as "Pakistani were scared", it is Indian media which demand loyalty from every India who has anything to do with Pakistan, it is India media which make up things out of thin air.

Now please explain who is maintaining hostility.
 
Pakistan has not maintained hostility against India since early 2000.

Please educate yourself on how many terrorist attacks have taken place in India since "early 2000". Even Mumbai 2008 criminals like Zak Lakhvi and his buddies are yet to be punished.

This is not the fault of the average Pakistani citizen, who I readily believe isn't really "hostile" against Pakistan. Its the feudal zamindars in uniform that control your government and its policies that is hostile.


On the "media", I think Pakistanis are placing too much stock in media - they are selling masala entertainment and shock value is easy currency. I could point to a lot of ******** examples in Pakistani "media", and the normalization and acceptance of hateful stereotype against Indians and hindus in Pakistan - but that is the symptom, not the cause. Do you understand what I mean with those 2 words?

I'm someone who grew up as a child in India. I am also someone who had Pakistani friends in college and beyond. I have no innate "hostility" towards Pakistanis, but at the same time, the actions of the Pakistani state do not leave me any choice but to support things like the Balakot air strike.

I would love to see peace and normalcy between the 2 countries - that is the natural state, not this artificially sustained enmity. I personally believe it is completely unnecessary. But it is obvious that there are powerful interests in Pakistan who stand to lose a lot if the Ind-Pak hostility disappears or even reduces. By the way, the same really cannot be said about stake-holders in India - not honestly or realistically anyway. I know Pakistanis love to give examples of Indian "media" and election rhetoric, but that's really just a whole lot of hot air.

These courts are laughable. Allowing a jailed convict to travel abroad for medical treatment and then over turn the extension of the COAS at a time when we are facing multiple security challenges. Is there any institution this establishment of the PML-N and PPP have not penetrated in Pakistani Society?

I will always respect CJP khosa, and if he says this decision is against the law, then his decision is right. Lets see if its just a technicality or something more fundamental. Either way the SC will be right

Khosa was an establishment puppet because of his remarks and verdict in Panama case now all of a sudden here comes a uturn from Raiwind's cult followers

So, President did sign the proposal and allowed the extension. Signatures of 14 Federal ministers required with in 24 hours, out of 25, 11 did sign the proposal with in 24 hours while 8 signed it after 24 hours.

But according to rules, if some one dont sign the proposal it will be accepted as a YES.

CJP statement is bit vague in this honestly. The summary which Govt had prepared said " Appointed " not extentsion. Because you can not give extension to any one, but you can appoint/ re-appoint COAS.

But CJP statement saying "Extension".


2ndly according to Article 243B PM will take a decision and will forward his decision to the President. CJP has made an issue of Signatures but according to law, this shouldnt be a problem.

You should recall that I criticized the Supreme Court for not having the guts to stand up to the military establishment. It was very clear that they were actively attempting to remove Nawaz even though the charges against him were weak. However, now that they have shown some guts, I have no issues in praising them. As I have said many times before, only the judiciary in Pakistan has the power to stand up to the bullying of the military.

You didn’t answer the question. Bajwa has done nothing wrong and there is a precedence of granting extensions to COAS.
You are clutching at straws yet again.

There is a precedence but that precedence needs to be stopped. Perhaps you can answer the following questions:

Is the next COAS in line incapable? Would India suddenly be all over Pakistan because of his incompetence? Does Bajwa not have faith in his the military?

What will change over the next 3 years? Will Modi not be in power?

Will India‘s policy towards Pakistan change? Will the Kashmir no longer be a issue? Will the forces of Pakistan and India play Ludo at LoC?

Will Pakistan no longer accuse India of having non-state actors in Balochistan?

If the next COAS will handle things after 3 years, why cannot he do it now?

Answer these questions and I will stop clutching at straws. In fact, any poster who is supporting Bajwa’s extension are free to answer these questions.

It is such a non-issue, getting extension in tenure and supported by current government, turned in to something else.
