No criminal record, no protest, yet Muslim men made to sign bonds in Uttar Pradesh villages

The clampdown of the Uttar Pradesh police against the Muslim community has now extended to those who have not taken part in the ongoing protests. In three villages located less than 30 km from Lucknow, at least 100 Muslim men have been made to furnish a bond of Rs 50,000 each under Section 107/116 of the Criminal Procedure Code, which virtually serves as an assurance that they will not participate in any protest. They will have to appear in court every fortnight or so for at least the next six months.

The section is meant to be a preventive measure: it is invoked by an Executive Magistrate against anyone under his jurisdiction who could pose a reasonable threat to the peace. He is supposed to do this after receiving information and forming an opinion that there is substantial ground for proceeding against the individual. Its invocation on a mass scale against those who have never violated the law in the past has come as a shock to the residents of these villages.

“Please don’t reveal our names but can you find out why the Muslims of this village are being treated like criminals,” asked a man in his early twenties, a resident of Kamlabad Badhauli vllage, who has been made to furnish a bond. He is preparing for the state public service commission exams. He pointed to a picture of the former governor of Uttar Pradesh, Ram Naik, awarding honours to his elder brother, a university topper – the brother too has been charged.

It is yet unclear how widespread the application of this section has been against the rural Muslim population of the state.

No one spared, from old to young
In the village of Kamlabad Badhauli, 20 km from Lucknow, it was bitterly cold at 7 pm on Thursday. A group of men sat huddled around the fire, too scared to speak to a journalist, yet desperate to be heard.

Among them were daily wagers, educated youth preparing for various entrance exams, a man employed in a shoe shop, two old men nearing seventy, and a young boy. All of them had been served notices under Section 107/116 of the CrPC. Thirty-seven men from 20 of the 25 Muslim families in the village had been issued these notices, in some cases all the male members of a family.

The residents of Kamlabad Badhauli told Scroll.in that on December 19, even as protests broke out in Lucknow to be followed by a brutal police crackdown, the day passed off normally in the village. No one from the village had gone for the protests, at least none of the 37 who have been served notices.

According to them, the first they heard of these notices was when on December 23, Vishnu Kumar, a chowkidar, was ordered by the local police station to go door to door with a list of names and addresses of the men charged under Section 107/116 of CrPC. They were asked to sign against their names but none of them realised what had transpired until December 26 when they were told they had to appear in court. It is then that they consulted a lawyer.

To make matters worse, it is not clear whether these charges will result in a criminal record being entered against their name. For many of the young men preparing for examinations and looking for government jobs, this has become an additional source of anxiety.

While charges under preventive sections do not amount to a conviction, and ordinarily should not amount to a criminal record, there are conflicting legal opinions about this. A judgement of the Chhattisgarh High Court has held that proceedings under Section 107 of CrPC make a person unfit for government employment.

Even without a criminal record, the men who have been served notices as potential troublemakers could become easy suspects, even fodder, for the next time the police wanted to pick up anyone for any perceived crime or breach of peace, said a lawyer.

Worse, notices under Section 107 of the Criminal Procedure Code allow a magistrate to order the arrest of an individual if he is convinced that only an arrest could avoid breach of peace. In the past, the Supreme Court and several High Courts have admonished the police for keeping people in jail for months using Section 107 and without registering any criminal case.

India ejects second European 'for protesting'

A Norwegian tourist on Friday said authorities had ordered her to leave India after taking part in protests against a new citizenship law, becoming the second European to be ejected over the demonstrations.

Janne-Mette Johansson, 71, told AFP that police gave her “verbal assurances” that she could take part in peaceful demonstrations against the law that critics say discriminates against India's Muslims.

“Yesterday [Thursday], Indian immigration officials came to my hotel for questioning and I was mentally tortured. Today, they again showed up at my hotel asking me to leave the country or they will take a legal action and deport me,” she said.

The woman, who had posted photos from the demonstration in the southern state of Kerala on Facebook, added that she would leave India for Dubai on Friday evening and then fly to Sweden.

European visitors to India require visas and the Press Trust of India news agency quoted an official from the Foreigners Regional Registration Office as saying that Johansson “violated visa norms”.

Earlier this week a German studying physics in the southern Indian city of Chennai was also asked to leave after taking part in a protest and comparing the law to anti-Jewish Nazi legislation, PTI reported.

Photos on social media purportedly of the student, named as Jakob Lindenthal, showed him carrying a placard saying “1933-1945 We have been there”.

“After the Nazi era, many people claimed not to have known anything about genocides or atrocities or stated that they were only passive,” Lindenthal told German broadcaster Deutsche Welle.

“Therefore I see it as a duty to learn from these lessons and not only watch when things happen that one believes to be the stepping stones to a possibly very dangerous development.”

Indian authorities have not commented on his case.

The protests, which have raged for two weeks and left at least 27 people dead, were set to continue on Friday with mobile internet snapped in places and riot police deployed.

The government says that the law easing citizenship rules for religious minorities from Bangladesh, Pakistan and Afghanistan excludes Muslims because they face no persecution in those countries.

But coupled with a mooted citizens register, it has stoked fears including in Washington and the UN rights office about the marginalisation of Muslims who make up 14 per cent of India's 1.3 billion people.

India's tourism industry has been hit by a wave of violent anti-government protests across the country against a new citizenship law, with at least seven countries issuing travel warnings.

At least 25 people have been killed in clashes between police and protesters, and demonstrations against the Citizenship Amendment Act (CAA), which critics see as anti-Muslim.

The United States, Britain, Russia, Israel, Singapore, Canada and Taiwan have issued travel advisories asking their citizens to either refrain from visiting or to exercise caution when visiting regions embroiled in India's protests.

Officials estimate that in the past two weeks, about 200,000 domestic and international tourists cancelled or postponed their trips to the Taj Mahal, one of the world's most popular tourist attractions.

"There has been a 60 percent decline in visitor footfalls in December this year [compared to last year]," said Dinesh Kumar, a police inspector overseeing a special tourist police station near the Taj Mahal who has access to visitor data.

"Indian and foreign tourists have been calling our control rooms to check security. We assure them protection, but many still decide to stay away," said Kumar.

The 17th century marble monument is in Uttar Pradesh, the northern state that has witnessed the highest number of deaths and intense bursts of violence in two weeks of unrest.

A group of European tourists travelling in a group across India said they now planned to cut short their 20-day trip.

"We are all retired folks. For us, travel has to be slow and relaxing. The newspaper headlines have led to a sense of concern and we will leave sooner than we had planned," said Dave Millikin, a retired banker living on the outskirts of London, who spoke to Reuters news agency from the capital New Delhi.

The Taj Mahal, situated in the town of Agra, attracts over 6.5 million tourists every year, generating nearly $14m annually from entrance fees.

A foreign tourist pays 1,100 rupees (about $15) to enter the grounds, although nationals from neighbouring countries get a discount.

Managers in luxury hotels and guest houses around the Taj Mahal said last minute cancellations during the festive season have further dampened business sentiment at a time when the country's economic growth has slowed to 4.5 percent, its slowest pace in more than six years.

In a bid to clamp down on violence and unrest, authorities have suspended mobile internet services in Agra.

"Blocking the internet has affected travel and tourism in Agra by about 50 to 60 percent," said Sandeep Arora, president of the Agra Tourism Development Foundation that groups over 250 tour operators, hotels and guides.

Jayanta Malla Baruah, the head of the Assam Tourism Development Corporation, said the state, home to the world's largest concentration of one-horned rhinoceroses, is visited on average by 500,000 tourists during December.

"But this time, due to the ongoing protests and travel advisories by various countries, the number is down by 90 percent, if not more."

MULTAN: Unsettled by his failure to quell ragging street protests in India over his highly divisive policies, Prime Minister Narendra Modi is desperate to take the global spotlight off his authoritarian measures to muzzle dissent.

Pakistan has repeatedly intimated the United Nations about India’s sinister plans to launch a “false-flag operation” against Pakistan as its forces have cut the Line of Control (LoC) at five places and deployed missiles there, according to the foreign minister.

The global body has been informed that New Delhi could go for a military misadventure against Pakistan in an attempt to divert the world’s attention from its internal chaos and the continuing siege of Occupied Jammu and Kashmir (IOJK), Shah Mehmood Qureshi told a news conference on Sunday.

“The UN has been informed about the threat to peace and security of the region from India,” he added.

Qureshi said the whole world was noticing the recent developments in the neighbouring country. “Protest demonstrations against the Citizenship Amendment Act (CAA) are being staged not only across India but also in important world capitals,” he said. “The Modi government’s ideology of Hindutva has been exposed to the whole world.”

The Modi regime hid its brutalities in IOJK through an information blackout but it could not conceal ragging protests in its cities, which were jointly held by Muslims, Christians, Sikhs, Dalits and other communities, he added. Even the chief ministers of five Indian states have refused to impose the CAA.

“The Indians today are divided into two groups. One section is supporting secularism while the other is working to impose the extremist Hindutva ideology,” Qureshi said, adding that a former Indian minister, P Chidambaram has also denounced the CAA as an unconstitutional law. He hoped the Indian Supreme Court would strike it down.

“Some 25 people have died while hundreds of peaceful citizens have been arrested by the police for protesting the CAA,” he added. “The CAA has, in fact, unmasked the extremist Modi regime, damaging the country’s image internationally.”

Qureshi was optimistic that the OIC meeting scheduled to be convened in Islamabad in April 2020 would “raise an effective voice on the IOJK situation”. “It has already expressed its concerns over human right violations in the valley,” he added.

To a query, the minister said the Modi government was not expecting any reaction from the IOJK people. “Even those Kashmiri leaders who supported India in the past are now voicing concerns over the Indian government’s actions.”

The minister said China had also demanded of the UN military observers to brief the UN Security Council.

He lauded the American-Pakistanis for effectively presenting Pakistan’s viewpoint in the United States and urged them to play their role in countering the Indian lobby. “The US Congress has discussed the Kashmir issue in three different sessions,” he added.

The foreign minister was of the view that Malaysian Prime Minister Mahathir Mohamad tried to unite the Ummah by hosting a summit of Muslim nations in Kuala Lumpur in order to launch socioeconomic projects and address issues related to Islamophobia, and Pakistan respected Mahatir’s efforts.

“Pakistan has good relations with all Muslim countries and would try its best to remove misunderstandings among them,” said Qureshi. “Turkish President Recep Tayyip Erdogan would visit Pakistan in February, while the Pakistani leadership would also visit Malaysia in the near future.”

NAB ordinance

Qureshi said the National Accountability (Amendment) Ordinance, 2019 was neither an NRO nor was it meant for hiding corruption. “The Pakistan Tehreek-e-Insaf (PTI) government has zero tolerance for corruption,” he added.

He lamented that it had become a trend to criticise the government’s moves, saying that earlier the opposition was calling for amendments to the NAB laws but now it is criticising the government without studying the new ordinance.

Laying to rest the opposition’s concerns that the business community is worried and the economy is not heading forward due to tight policies, Qureshi said it is true some people were arrested due to procedural flaws and others were also in a state of fear; however, the NAB ordinance would help promote business by addressing the procedural flaws.

The minister advised the Pakistan Peoples Party, which had also been demanding change in the NAO 1991 to talk to the government and present its recommendations instead of opting for criticism.

Qureshi vowed that the government would not allow any misuse of public money.

Rejecting rumours

Qureshi rejected any chance of a clash among the state institutions over the death penalty awarded to former military ruler Gen (retd) Pervez Musharraf by the special court in the high treason case.

Qureshi said, “Parliament, the executive and the judiciary have defined roles as per the Constitution. All institutions are run by sensible people, who work within their defined ambits.”

He also lauded Pakistan Army for eliminating the menace of terrorism from the country.

Gas shortage in country

The foreign minister said the Sindh government is doing politics over gas shortage as the whole country is facing the issue.

He asked the Sindh government to sit with the federal government and find a solution to the issue.

“Karachi is the main industrial hub of the country and the federal government does not wish to create any gas shortage there,” said Qureshi. “The industry’s role is vital for enhancing exports and the incumbent government is striving hard for the purpose.”

The government, he said, was trying to import liquefied natural gas and installing more terminals to bridge the gap between demand and supply of gas.

Qureshi lamented that the “disease” of spreading fake news was harmful. “Everyone seems to be propagating their own viewpoints or ideologies through fake news not only in the country but also at the international level.”

South Punjab sub civil secretariat

The minister said he had met Punjab Chief Minister Usman Buzdar and discussed the issue of setting up the South Punjab sub civil secretariat. The role of the secretariat is to resolve civil administration issues in South Punjab instead of Lahore.

“Things in that regard would move forward soon,” he added.

Cricket

The minister thanked the Sri Lankan cricket team for touring Pakistan and wished that the Bangladeshi team would visit the country, “which seemed to have been influenced by India”. “Politics should be kept away from sport,” he added.

Urs

Qureshi appreciated the Multan District Administration for finalising arrangements for the Urs of great saint of the sub-continent Hazrat Shah Ruknuddin Alam, commencing from the first of January. He urged the residents of Multan to welcome the devotees of the saint, coming from other cities and provinces as it would help promote inter-provincial harmony.

The Kerala Assembly Tuesday passed a resolution demanding scrapping of the Citizenship Amendment Act (CAA), which was cleared by both Houses of Parliament last month.

The ruling CPI(M)-LDF and the Opposition Congress-led UDF supported the resolution while BJP’s lone MLA and former Union minister O Rajagopal’s was the only dissenting voice in the one-day special session.

While presenting the resolution, Vijayan said the CAA is against the “secular” outlook and fabric of the country and would lead to religion-based discrimination in granting citizenship.

“The Act contradicts the basic values and principles of the Constitution. In view of the anxiety among the people of the country, the Centre should take steps to drop the CAA and uphold the secular outlook of the Constitution,” he said.

The Chief Minister added that the contentious act had “dented India’s image in front of the international community.” Vijayan also ensured the Assembly that there won’t be any detention centres in the southern state.

He hit out strongly against the Rashtriya Swayamsewak Sangh (RSS), BJP’s ideological parent, alleging that it is going ahead with a dangerous agenda to break the country’s secular principles and undermine the minorities.

“RSS considers Muslims, Christians and Communists as their internal enemy. In Germany, Hitler similarly saw Jews and Bolsheviks as his internal enemy. RSS’s views are that of Hitler’s,” Vijayan said.

Chennithala, supporting the resolution, said, “The Centre’s aim is to turn India into a theocratic state. That’s why they have brought the CAA. They are going ahead with implementing the national population register (NPR). The Centre cannot go ahead without taking the states into confidence. We’re not against a census but there are changes in the questionnaire. It is creating fear in the minds of people. Through the NPR, they want to implement the NRC.”

Leader of Opposition Ramesh Chennithala had suggested convening a special session of the Assembly to pass the resolution in order to display Kerala’s stern opposition to the law that’s widely criticized as ‘discriminatory’ and ‘violating secular principles’ of the constitution. On Sunday, the CM obliged by convening an all-party meeting to discuss the issue, which the BJP boycotted.

The one-day special session was originally scheduled for ratifying a resolution which is related to extending the reservation of SC/ST communities in Lok Sabha and the Assembly for another 10 years.

Several times in the past, a state Assembly has passed resolutions against policies of successive union governments on issues such as disinvestment and nuclear deal. But, an Assembly debating a resolution against a legislation cleared by Parliament is rare.

Bihar Police Arrest Hindutva Activists for Killing Teenager Who Joined Anti-CAA Protest

Patna/New Delhi: In what is likely to be the first documented instance of an anti-CAA protestor falling victim to violent reprisals by Hindutva groups, the police in Patna have arrested two men with links to Hindu extremist groups for the murder of 18-year-old Amir Hanzla, a resident of the Phulwari Sharif area of Patna who had attended an anti-Citizenship (Amendment) Act (CAA) protest in Bihar’s capital on December 21 before disappearing and turning up dead ten days later.

Speaking to The Wire, Phulwari Sharif police station in-charge Rafiqur Rahman said, “So far we have arrested six accused and they have confessed to their crime. Right now, they are in judicial custody and we believe that some more people are involved. An operation to nab them is on.”

According to another police officer, “The accused have confessed that the murder was carried out in Sangat lane and it seems that they knew that Amir was part of the anti-CAA and NRC [National Register of Citizens] protest.”

Amir went missing after he was seen participating in an anti-CAA and NRC protest called by the Rashtriya Janata Party (RJD). On December 31 morning, his body was found near the water tank of the Phulwari Sharif block office. According to the post-mortem report, he was attacked by a sharp weapon in his abdomen twice and also hit on the head with something heavy. Details about other wounds could not be ascertained because the body was found in a very bad condition.

The six arrested in the murder case are identified as Nagesh Samrat, Rais Paswan, Chaitu Mahto, Sanoj Mahto, Vikas and Deepak Kumar. As per police claims, one of the six is associated with a local Hindutva group, Hindu Putra Sangathan, while another is linked to the Hindu Samaj Party of Kamlesh Tiwari, who was killed in Lucknow last year. According to locals, Tiwari had visited Sangat Gali several times before his killing.

Nagesh is a national pracharak of the Hindu Putra Sangathan. Rajeev Brahamarshi, head of the organisation, used a video to raise questions about Nagesh’s arrest. The Hindu Putra Sangathan is among 18 organisations whose functionaries’ details were sought by the Bihar Police Special Branch in May last year. Moreover, many cases are registered against the organisation in Patna and Hajipur.

According to a fact-finding report by several civil society organisations, on December 21, multiple incidents of violence had occurred in various parts of Phulwari Sharif. The report by civil society organisations had alleged, “The police were not able to de-escalate the tension. The right-wing forces were involved in this pre- meditated and organised violence.” Allegedly, a Hanuman idol was also damaged. As per the report, nearly a dozen protesters sustained injuries during the clash.

The police had also used tear gas and water cannon to disperse the people. According to Garima Malik, senior superintendent of police (SSP) Patna, a case was registered against 40 named and 500 unnamed people.

Hanzla’s family members have demanded speedy action in the matter. They have said that those guilty of killing Amir should be sentenced to death and the government should also provide compensation for the family. Hanzla’s brother Md Sahil said, “We got to know that in order to escape from the violence, he took refuge in Sangat lane and that is there he was killed. I am also told that the attackers were asking names of the protesters and then attacking them. Probably Amir’s name was also asked.”

Hanzla’s father Suhail Ahmed has refused to see his son’s killing as a result of a clash between Hindus and Muslims. “Hindus are also saddened by the news of the killing of my son. They have come to me to express their condolences,” Ahmed told The Wire, adding “I don’t think it is a Hindu-Muslim issue.” He said there are some radical forces amongst Hindus who are giving a bad name to the Hinduism.

According to Hanzla’s family, the teenager was barely interested in politics and worked at a bag repairing centre. He had finished Class 10 last year and had been working at the bag repairing centre as the family needed his support.

Meanwhile, on Thursday evening, some students of Patna University organised a protest demanding justice for Hanzla and opposing the CAA and NRC. “We demand that Rs 50 lakh should be given to the family as compensation along with a government job to one of the family members,” Zeeshan Mehboob, a protester and Patna University student told The Wire.

I was wondering same but there is no follow up on their timeline. Looks like the students are writing these post card in hurry there sitting on floor so maybe someone missed writing the "lockdown" word on postcard and the whole meaning is changed or maybe there are some other forces at work as i mentioned earlier to undermine the protest and divert attention.

This seems awfully fishy, with all the violence that is done by a certain small section of the population and blaming BJP, common sense tells me this would be the last thing BJP would do, especially at this time if ever. THIS was a planned setup by the Italian Congress Government, I feel to tarnish BJP, quite easy to see. However it's too late for Congress as majority of India wants Modiji and BJP in power, so they will stay in power regardless of what Congress does...

Instead of putting them in detention camps , why can’t we distribute them in all states and give them some jobs to support themselves. These people are living here for many years and it will be truly unfair if we make them stateless...think about their family and kids... Our government should strengthen the borders like those European countries and make sure that no illegal immigrants are coming to our country. Not stripping of citizenship from those who are living here for many years.

Assam wants no illegal immigrants to give citizenship regardless of religion. Even if CAA includes Muslims, even then it is against Assam accord and protest will continue. That's the difference between protest of Assam and rest of the country. While others want inclusion, but Assam wants exclusion.
